Full textSince the second part of the 20th century, the role of three main greenhouse gases (GHG) : Carbon Dioxide (CO2), Methane (CH4) and Nitrous Oxide (N2O) has been clearly established by the scientific community as the main cause of the recent forcing of the Earth energetic processes from human-induced activities, resulting among other disturbances in an increase of the annual mean surface temperatures. As GHG are well-mixed in the atmosphere and due to the complexity of atmospheric transport processes, the main emitters do not necessarily face the consequences of the additional radiative forcing that they directly induce. In this study, we restrict the analysis to CO2, CH4 and N2O because they are the most important GHG in the atmosphere. For the following-up of GHG, the Paris Agreement has a device named the “Enhanced Transparency Framework “(ETF). Within the ETF, countries have to report annually or biannually their GHG emissions and removals starting in 2023 within the Global Stocktake (GST). The ETF is based on the Monitoring, Reporting and Verification (MRV) provisions of the PA, aiming at the measurement of GHG for the PA signatory countries, at the centralization of the regularly updated country-reports, and at the verification of the respect of the countries ex ante vs. ex post pledges. This GST will represent a challenge for many Non-Annex I countries, including Africa, where emissions and removals in national inventories have been irregular since the UNFCCC creation in 1992. The literature tends to be scarce about GHG emissions from African countries, usually thought to be small emitters by non-experts. However, the recent Sixth Assessment Report (AR6) of the IPCC (Intergovernmental Panel on Climate Change) underlines with high confidence that the speed of surface temperature increase in Africa has already been higher than elsewhere in the world due to anthropogenic emissions (IPCC Working Group I, 2021). Recent analyses also predict a fast increase of African emissions correlated with its demographic growth, which is the fastest in the world. Pioneering papers on anthropogenic emissions and the carbon balance in Africa like the one of Ciais et al. (2011), already underlined that “Africa is likely to increase its share of global emissions over the coming decades” (Canadell, 2009). That is the reason why we chose to strictly restrict to Africa the scope of our central analysis in the original study of the present manuscript. Our aim is to assess African CO2, CH4 and N2O anthropogenic emissions and removals using bottom-up datasets (inventories and process-based models) and to compare them with top-down inversions coming from satellites over three decades (1990-2018) in order to deliver trends’ analyses. The purpose of this analysis is also to discuss the following main question: how can the current state of science help for the evaluation of the Respect of the Paris Agreement (PA) in Non-Annex I countries, and most specifically in Africa? Chapter 1 presents CO2, CH4 and N2O main features and impacts with regards to the Earth Radiative Budget forcing, and contextualizes the scientific monitoring of GHG emissions and removals from anthropogenic origins in the climate policy context of the Monitoring, Reporting and Verification (MRV) provisions of the PA. Chapter 2 delivers an original analysis of GHG emissions and removals trends over the last three decades for the case of Africa. Chapter 3 discusses more broadly the conclusions of the African case analysis and proposes larger perspectives from both a scientific and from a climate policy view for future developments in the evaluation of the respect of the PA

Full textThrough the analysis of governmental work from 1993 to 2015 within the perspective of the constitutional and political stability, it is obvious clear that the implementation in Cambodia of the main principles of the Western model of the rule of law, liberal and pluralistic democracy, with the implementation of the 1991 Paris Agreements did not take place satisfactorily. The goal to make the Cambodian society, a democratic one where everyone obeys to the law, where justice is independent from the Executive where the armed forces as economic forces are subject to the public authority which is of the guardian general interest, where every power can be balanced by a counter-power, has not been reached. The obstacles to this actual transposition reside in the gap between the principles of an imported or imposed model and the burdens of the tragic history that Cambodians have lived between the years 1970 and 1980, on the one hand and the traditional foundations of Cambodian society still very present to nowadays on the other hand

Full textThe international community and the international law are facing a great challenge: find the solution to end the Israeli-Palestinian conflict. The study of the Israeli-Palestinian conflict in light of international law shows many difficulties related to the emergence of a Palestinian state. Indeed, this conflict is a source of violation of international law specifically a violation of human rights that continues to strike in this area. Violations against international law go back to the time of the British mandate and are finally characterized by the impunity towards the entities that have committed them. Therefore, this allows us to highlight the weaknesses of international law, more specifically those of the United Nations that is confronted with the constant breach of its principles and decisions. We have tried to overcome this infernal situation by using the techniques offered by the international law that aims to put an end to a conflict. There is a technique that seems to be the most appropriate for the Israeli-Palestinian conflict known as the negotiation. However, the peace process that began in 1990 is now almost forgotten.Despite all this, the creation of a Palestinian state is the base to the solution of the Israeli-Palestinian conflict. This present study aims to demonstrate, based on the definition of the State under international law, that Palestine has, on one hand, confirmed elements/components that are imperfect, allowing the latter to constitute a State under international law, and on the other, that it can’t achieve statehood to the extent that certain elements necessary for statehood remain questionable. Full textEstablished in the 1960s with the independence of territories of the former French empire, the defense cooperation allowed the old French, colonial power to continue to maintain its influence in Africa, while at the same time establishing autonomous national African armies. Unfortunately some of the political and military choices made by France and the instrumentalization risks of a strictly bilateral involvement, have revealed the archaism of French – African relations, and have generated a crisis in cooperation. Having become inadequate due to changes in the international political arena that occurred in the 1990s characterized by the end of bipolarity, the French defense cooperation African has suffered from international competition from the commitment of African States to the effective exercise of their sovereignty as well as their full involvement in globalization and in new areas of solidarity and international cooperation, and from terrorist threats.In subscribing to the realist security approach, and considering the political-sociological constructivist theory of national interest defended by Alexander Wendt on the one hand, and on the other hand the regional security complex concept by Barry Buzan, this study proposes to show how France has put in place a new security policy based on new defense agreements in Africa, the continent closest to Europe in a context of proven strategic breakdown and security threats. Defined in a global regional context, this study demonstrates the strategy of France for security in Africa in a partnership that should be both transparent and efficient

Full textThe Convention on Biological Diversity (CBD), concluded in 1992, has established for the first time in international law a genetic resources (GR) regime on access and benefits sharing arising from their use (ABS system). This system is based on the recognition of the sovereignty of States over their natural resources, supposed allow them the control of their use and reaping the associated benefits. Therefore, the Convention was presented as a gain for South’s countries, the main suppliers of GR and therefore the main beneficiaries of this system. Two years after the conclusion of the CBD, the Agreement on Trade Related aspect of Intellectual Property (TRIPS) was concluded under the aegis of the World Trade Organization (WTO.) Under the influence of North’s countries concerned to shape the international patent system on their own model, this Agreement extend the patentability scope to all technologies, including those which were excluded from this scope by many countries, especially in South. Biotechnologies are the most concerned by this obligation. In this regard, South’s countries have expressed reluctance, considering that TRIPS is not adapted to the requirements of the ABS system of CBD since it allows the patentability of GR which are the base of biotechnologies without regard to these requirements. These countries, moreover, considered that the Agreement could compromise the implementation of this system. Therefore, the two texts found themselves at the center of a real debate between the South and the North whether to denounce their incompatibility or support their synergy. Its then, precisely that African issue translated by an updated heading: agreements in the resolution of internal armed conflits in Africa. »The analysis considered in the present study will expose the conclusion of political agreements by insisting distinctly on political environment, their formation as well on the legal framework which characterizes them, on one hand.
