Espinoza, Espinoza Juan Alejandro. "On the named Wrongful Acts." IUS ET VERITAS, 2016. http://repositorio.pucp.edu.pe/index/handle/123456789/123303.

Full text
Abstract:
This article addresses the topic of civil wrongful acts that can cause tort liability. The author criticize the position that holds that wrongfulness is not an element of tort liability. In accordance with that position, not considering wrongfulness as an element of tort liability, it permits to consider that some “lawful acts” could cause tort liability. On the contrary, Espinoza consider those supposed “lawful acts” as examples of abuse of law so they are actually wrongful acts.

Abstract:
The traditional model of visual arts practice is one that privileges highly individuated reflection and research on studio based, predominately material outcomes. This archetypal approach to thinking about cultural production tends to overlook all of the conceptual and contextual collaborations that take place, both informally and formally in the process of making artworks. The aim of this practice-led research project is to creatively and critically explore the potential for actively engaging in a collaborative process for making artworks. It will focus on this approach to research and making through performance and video based works made in conjunction with Kate Woodcroft. Through doing this it aims to explore the possibilities for thinking and working beyond singular, materially based practices and develop new understandings for this as a model for generating new and unexpected creative outcomes. Key departure points for this discussion include; tertiary performance, conceptual art, and humour.

Abstract:
Art investment has become a popular alternative investment choice all over the world, among different kinds of art works, contemporary art work performes an espespecialy unsual price changes in the market, it’s hard to predict its price consistent with the value. Many contemporary art works even have unbelievable high prices beyond the public recognizations, which are criticised by the professionals sometime. It seems that the investors and the market start to chase some popular contemporary art works with fast and high profits than real valuable and artistic work. To have a better understanding of this phenomenon, this paper defines the internal and external factors of art work price, uses the hedonic pricing model to explain how factor affects the price of the art work, if internal factors affects the prices of the art work, any remaining discrepancies in prices will represent differences in the art work’s external factors. The paper will continue to discuss the potential external factors and reasons to occur their existences, and then give some suggestions to investors when choosing contemporary art works.

Full text
Abstract:
Her Name Was is an examination of the oppression of transgender people in a society that is built on the nominalization of cisgender people, those who gender matchers their sex assigned at birth, and how this oppression lends itself to violence. In the summer of 2015, the body of Shade Schuler, an African American transgender woman, was found in a field outside of Dallas, Texas. Ms. Shade is part of an alarming epidemic of escalating levels of targeted violence against the transgender community. This documentary pulls back the curtain as it captures the feelings and struggles of the transgender community as they attempt to navigate and survive in a cis dominating society.

Abstract:
Recent political developments in the world show us that different cultures need to know and understand each other better. Even though technological developments like the Internet, satellites, cable television and conglomeration of big media entities have made mass communication more effective and faster, we cannot easily say that these developments help to bring world cultures together. As a result, mass audiences are not very much able to see what few productions do speak to these issues in a constructive manner. The main aim of this documentary film project is to serve as a small step towards helping different cultures to understand each other better. This documentary film conveys the basics of Mevlevism by following the formal gatherings of a Mevlevi den in Istanbul, Turkey. A den or tekke is a place where Islamic people gather and perform their religious activities. During these gatherings they do the sema, they pray, they listen to music, and they discuss spiritual matters. Sema is the entire ritual they perform as part of their ceremonies including listening to music, singing and chanting to attain a state of religious emotion and ecstasy or vecd. The documentary film is structured around a twelve year old girl, Elif, who is learning the basics of Mevlevism. The interviews conducted with regulars from the den explain to the audience why people are attracted to this belief system. Filming the ceremonies at the 550-year-old Mevlevi temple in Galata, Istanbul accentuates the historic background of this belief system. The Night of Reunion is the day in which Mevlevis celebrate the passing of Mevlana Celaleddin Rumi, the founder of Mevlevism and provides the climax of the film. Elif performs on that night, a very important moment in her spiritual life.

Full text
Abstract:
The undergraduate thesis began with the research question of whether the Islamic community is being profiled by the use of the Foreign Intelligence Surveillance Act (FISA) following the terrorist attacks on September 11, 2001. At the beginning of the project, the researcher's hypothesis was that Muslim community had fallen victim to profiling through the use of electronic surveillance conducted by the American government. The research presented reveals a pattern of profiling and injustices against many different groups of Americans throughout the history of United States surveillance laws starting with the illegal alcohol producers in the 1920's. Amendments to FISA have set necessary modern electronic surveillance regulations back 30 years. The researcher brings to light the injustices the Islamic community has endured out of the panic caused by the attacks on 9/11. The research presented was achieved by using empirical legal studies techniques of incorporating a mix-methods approach to utilize both quantitative and qualitative research components. The researcher developed a spreadsheet that included all published federal opinions of prosecutions involving FISA since its enactment in 1978. Statistical data was analyzed using frequency and average software, known as Stata, and the results of study suggest an extreme increase in the amount of prosecutions involving the Islamic community since 9/11 compared to prior.

Rowe, Joshua Luke, and josh@email nu. "Improving internet usability - a framework for domain name policy evaluation." RMIT University. Business Information Technology, 2009. http://adt.lib.rmit.edu.au/adt/public/adt-VIT20091111.101705.

Full text
Abstract:
A domain name is a unique alphanumeric designation that facilitates reference to sets of numbers which actually locate a particular computer on the Internet. Domain names are a fundamental part of the Internet's user interface. Improving the usability of the Internet depends upon effective domain name policy. This study is intended to contribute to improvement in Internet usability for the end users of domain names. Benefits of more usable domain names include: higher sales, customer satisfaction and productivity, and reduced support costs. Domain name policies worldwide vary considerably. Consequently, end users are inconvenienced by contradictory domain name policies, diminishing the predictability of an entity's domain name, and thus decreasing usability for end users. The study objective was to develop criteria with which policy makers can evaluate their domain name policies, in order to improve the usability of domain names for end users. The main research question posed was: What are the criteria for an effective domain name policy? The research methodology included a literature review, domain name policy examination and an ethnographic narrative. The literature review found existing research examining either domain names or usability in isolation. However, research examining the intersection of the two is scarce. The existing research describes domain names as part of the web user interface. In practical terms, this is about how people use domain names to access web sites, email addresses and other Internet resources. It was established that the predictability (and thus usability) of domain names relies on effective domain name policy. The non-standardised and widely delegated process of domain name policy development leads to unpredictable and inconsistent domain names. The narrative recollection presented the researcher's inside perspective on the domain name industry, with a focus on domain name usability. The researcher provided first-hand insights into the evolution of the industry and policy development process, from Australian and international perspectives. To address the problem of poor domain name usability, a framework for domain name policy evaluation is proposed. The framework extends the current research that treats domain names as a user interface by proposing criteria which address usability concerns. The framework allows policy makers to critically assess domain name policies with end users in mind. Examples of the criteria include: understanding who are its intended and untended users, and whether it's consistent with other domain names. The framework has the potential to set an international standard for the critical evaluation of domain name policy, and become the basis for further research. This study was developed from the researcher's perspective as a participant in the domain name industry. A secondary lens regarding the usability of domain names was then applied. This study has only scraped the surface in terms of how the research fields of domain names and usability may be considered together. The research methodology for this study was primarily qualitative and interpretive. A quantitative study of domain name policies globally could provide further insight into areas including: the differences in second level country code domain names, and language implications of domain names.

Full text
Abstract:
Recently, some men have taken their wives' last names upon marriage rather than following tradition. The goal of this study was to examine the attitudes that men and women have toward these nontraditional men. Ideological hegemony and social identity theory comprised the framework for examining participants' beliefs. A survey first elicited participants' extant sexist beliefs about men and the characteristics of a nontraditional man compared to a traditional man. An open-ended question further explored participants' opinions. The results indicated that benevolent sexism influences respondents' attitudes towards nontraditional men and that most respondents view nontraditional men as more nurturing and committed to their marriage than traditional men. The results further revealed a dichotomy of positive and negative attitudes towards nontraditional men indicating that society's feelings about nontraditional men are changing.

Tung, Anne An-Yi Lin. "A Study Of Lu-Pitch Name Signification: A Translation with Commentary." Thesis, North Texas State University, 1986. https://digital.library.unt.edu/ark:/67531/metadc500549/.

Abstract:
The purpose of this thesis is to provide translation of documents on lu from two primary sources for a study of the theory of ,lu, with the main focus on the interpretation and the signification attached to each of the twelve lu-pitch names. To establish the background information of the lu-10 system, an explanation of its acoustical properties is first presented. Based on the most important and widely used tonal system in ancient China -- the san-fen-sun-i system, the illustration is provided for the process of tone generation. Methods proposed by the main theorists who engaged in the discussion of the system of lu are presented. The introduction of the concept of yin and yang in reference to the twelve lu and the signification of the lu-lu system in relation to the human and natural world will also be discussed. The main body of this study is devoted to the translation of written references on the meaning of the twelve lu. The first part is the translation of the selected passages from The Anthology of the Historical Document of Ancient Chinese Music. edited by Tsai-Ping Liang; the second part is the translation of a modern exegesis from an article written by Deh-I Liu. This translation offers a perspective to understand the concept of l-pitch names from the ancient points of view in relation to philosophy, education, religion, and science.

Abstract:

Abstract:
This Bachelor’s thesis examines the use of ancient bronze statues in the 2017 film Call me by your name by director Luca Guadagnino. Various scenes which feature ancient statues are examined individually using semiotic analysis. The scenes are examined individually, first described on a denotative level, then analyzed on a connotative level. The theoretical stand point is based on the studies of art works in film. Key theoretical concepts used are ”in between-ness” which is a state in which change in narrative is made possible through looking at art, and ”parallels”, a means of which to make art represent the characters in the film. The thesis finds the sculptures in Call me by your name to play a part in affecting the narrative of the film, mainly in regard to the love story between the two lead characters, two men named Elio and Oliver. The acts of looking, examining, and touching the statues in this film help the narrative turn in favor of the lead characters romantic relationship. The thesis argues that the nude bronze sculptures of men from ancient Greece are used in this film as signifiers of desire, timelessness and homoerotic lust.

Chen, Hsin-Teh. "Factors Affecting Perception of Fit of Jeans." Thesis, North Texas State University, 1987. https://digital.library.unt.edu/ark:/67531/metadc500737/.

Full text
Abstract:
The purpose of this research was to determine if perception of fit in jeans will vary by target wearer, sex, educational background, political-social attitudes, and brand name. One hundred and sixteen usable questionnaires were completed by students enrolled in the 1987 spring semester at a university in North Texas. The questionnaire gathered data about perception of fit in jeans, social-political attitudes, clothing interest, and jeans consumption. No differences were found between perception of fit by sex or target wearer. Factors found to affect perception of fit were educational background, political-social attitudes, brand name, and clothing interest. Subjects indicated fit was the most important factor considered when purchasing jeans.

Berzins, Kathryn Mara. "Mental health service users’, carers’ and professionals’ perceptions of the named person provisions of the Mental Health (Care and Treatment) (Scotland) Act 2003." Thesis, University of Glasgow, 2009. http://theses.gla.ac.uk/927/.

Full text
Abstract:
Background: The Mental Health (Care and Treatment) (Scotland) Act 2003 reduced the role of the nearest relative, identified by a hierarchy of relationships, who previously could admit and discharge a patient as well as receive information about their care. This role is now reduced to one of receiving basic information only and the hierarchy for identification has been modernised. Service users may now nominate a named person with similar rights to service users to help protect their interests. This person cannot admit or discharge but is entitled to information and consultation about their care. If a patient has not appointed a named person, then the primary carer is appointed by default and, if there is no primary carer, the nearest relative assumes the position. Aims: To explore service users’, carers’ and professionals’ perceptions and experience of the named person provisions. Method: Twenty service users, ten carers, seven MHOs and nine professionals with influence on government policy were interviewed about their experiences. Interviews were carried out face-to-face (service users and some carers) and by telephone (carers, MHOs and policy influencers). The resulting transcripts were analysed using thematic analysis. Findings: The majority of all interviewees welcomed the introduction of the named person provisions because of the increased choice it gave service users. Service users often did not wish to nominate their nearest relative, many choosing to nominate a friend. Important factors in making a nomination were that the nominee knew the service user’s wishes and could be trusted to carry them out. Some service users chose not to nominate relatives to spare them responsibility. However, the provisions were not without their problems; uptake was perceived to be low and there were particular problems in relation to the level of understanding of the implications of a nomination by service users and of the lack of accessible information and support to increase this understanding. The imbalance of power in relationships between service users, carers and professionals was thought to impact on the autonomous choices of service users and carers. Further problems were identified with named persons appointed by default in relation to service user choice and confidentiality. Conclusion and recommendations: Although the choice is welcome to some service users, there appears to be a lack of full understanding of the role, and continued awareness-raising is required with service users, carers and professionals which should further be supported by accessible information for both service users and carers. There is currently a lack of support for carers in particular and it is recommended that this be addressed using carers’ services. It seems that many named persons are being appointed by default (itself an anomaly in Scots law) which threatens human rights, because of the lack of choice of the service user about who is involved in their care and their inability to prevent the sharing of confidential information with the default named person. The current lack of a right of service users to reject having a named person at all restricts choice and autonomy, and may further place unwanted responsibilities on carers and relatives which are difficult to remove. To ensure that service users’ rights are fully protected, the named person should become an optional nominated position and the default mechanisms removed.

Burt, Stephanie. "Re-Branding Palliative Care: Assessing Effects of a Name Change on Physician Communicative Processes During Referrals." Thesis, University of North Texas, 2011. https://digital.library.unt.edu/ark:/67531/metadc67964/.

Full text
Abstract:
Although provision of palliative care on the United States is growing, referrals to the service are often late or non-existent. The simultaneous care model provides a blueprint for the most progressive form of palliative care, which is palliation and disease-oriented treatments delivered concurrently. Research indicates the existence of a widespread misconception that associates palliative care with imminent death, and some organizations have chosen to re-brand their palliative care services to influence this perception. The goal of this study was to assess the effects of a name change from palliative care to supportive care on the communicative process during referrals to the service.

Abstract:
The battle of the brands is being waged in an ever increasingly competitive and global business environment, a battle which generates the largest body of academic and professional literature in the field of marketing communication. Although much of the ground has been repeatedly ploughed, the literature conveys an impression that the "Brand" is perceived to lack clarity and agreement on its definition, strategic deployment and evaluation measures and that the overall concept of the brand is fraught with complexity and confusion. This thesis attempts to categorize and frame these impressions using content analysis to systematically unpack and analyze the layers of meaning embedded in the literature. The output from this study will inform the development of a simplified brand schema representing both sides of the brand equation, consumer and manager, recognition of which holds significant implications for the custodial guidance of this most vital business asset.
