Full textSherpas needed a new platform to monitor machines on their network. The platform they wanted to use was Nagios Core to monitor resources like CPU, disk, memory, bandwidth, webservers and SQL servers. The monitor solution also needed a simple way to add new hosts. Addons for a dashboard and graphs was also needed for a better overview. The monitor platform was installed on a test environment with a stationary computer, laptop with 3 virtual machines and a switch. Nagios Core was installed on the stationary computer. NRPE was used as the agent and was installed on all Linux servers. Nagios plugins was also installed to be able to monitor the required resources. Monitoring of Windows machines was done with WMI. To monitor switches and routers a plugin was created with Bash. To simplify configuration for new hosts, host groups were used. All host groups are linked to a service and when new hosts are created the required services are monitored by selecting all the host groups which the services are linked to. This decreased the time required for configuring new hosts. The solution was only done with a very small environment and the plugin that was created could contain a few bugs that can be detected in the future. The program also used a programming language not suited for the situation and should be changed in the future. No focus on security was done and is something that should be implemented in the future.

A regulamentação internacional da biodiversidade é um dos maiores desafios do Direito Internacional Ambiental. A comunidade internacional, no intuito de conservar e regulamentar a biodiversidade ? como elemento essencial para a biosfera, e consequentemente para a humanidade e o seu desenvolvimento econômico e social ?, adotou diversos tratados sobre a matéria, com destaque à Convenção da Diversidade Biológica e o Protocolo de Nagoya. O recente Protocolo de Nagoya ? sobre acesso e repartição justa e equitativa de benefÃcios da diversidade biológica ? oferece mecanismos especiais para conservar e utilizar sustentavelmente a biodiversidade. Um destes é o certificado internacional de conformidade. Mas muito pouco se sabe sobre tal mecanismo. Por essa razão, é fundamental compreender a natureza jurÃdica e os aspectos legais da implementação dessa nova ferramenta no cenário jurÃdico internacional. A presente dissertação, com base no método dedutivo e pesquisa bibliográfica e documental, conclui que o certificado de conformidade é um instrumento internacional, compulsório e público, possui natureza jurÃdica sui generis, e sua implementação é concretizada ao ser inserido no regime internacional de comércio. Inicialmente, traça-se um panorama da construção histórica do Direito Internacional Ambiental, seus sujeitos e fontes, assim como o impacto da fragmentação e do conflito norte e sul na sua formação. No segundo capÃtulo, levantam-se os aspectos históricos e tratados especÃficos da regulamentação internacional da biodiversidade. Em seguida, analisam-se o Protocolo de Nagoya e as especificidades da natureza jurÃdica do certificado internacional de conformidade. Por fim, pondera-se sobre a relação entre comércio e meio ambiente, e os seus regimes próprios do Direito Internacional, em especial a aceitação da Organização Mundial de Comércio da matéria ambiental. Encerra-se com a justificativa da possibilidade de inserção do certificado no regime internacional do comércio, de forma mais plausÃvel pela aceitação consolidada dos certificados de origem na OMC, com base no princÃpio da integração sistêmica do Direito Internacional de Koskenniemi.
Abstract : The international biodiversity regulation is one of the biggest challenges of International Environmental Law. The international community aiming to preserve and regulate biodiversity ? like an essential element for the biosphere, and by this matter for humanity and its economical and social development ? adopted several treaties about this matter, as the Biological Diversity Convention and the Nagoya Protocol. The recent Nagoya Protocol ? on access and the fair and equitable sharing of biological diversity?s benefits ? offers special tools to preserve and use in a sustainable way the biodiversity, one of these tools is the International Certificate of Compliance. Few things are known about such tool and because of it, it is fundamental the comprehension of such legal nature and its implementation aspects, as it is a new mechanism presented to the international legal context. The present dissertation, based on deductive method and bibliographical and documental research concludes that the Certificate of Compliance is an international, compulsory and public mechanism that have sui generis legal nature, and its implementation is sure to be insert in the context of international trade. To start, draws an overview about the historical background of environmental international law, its subjects and sources, likewise the fragmentation impacts and conflicts between north and south during its formation. The second chapter of this dissertation studied the historical aspects and treaties about biodiversity international regulation. Then, on the third chapter the Nagoya Protocol is analyzed about its specificities concerning the legal nature of the International Certificate of Compliance. Finally, the last chapter brings an analysis on the relationship between trade and environmental international regimes, especially the debate of environmental matters by the World Trade Organization. And concludes presenting the possibility of the Certificate?s insertion into the international trade regime, in a similar way that the WTO accept origin certificates, based on Koskenniemi´s principle of systemic integration of international law.

Full textA Convenção sobre Diversidade Biológica, concebida em 1992, destinou-se à proteção da conservação e o uso sustentável da diversidade biológica além da repartição justa equitativa dos benefícios provenientes da utilização dos recursos genéticos (termo em inglês, ABS ). O terceiro objetivo não restou suficientemente aclarado e os países signatários sentiram a necessidade de legislar sobre o tema diante da notória importância dos direitos advindos da exploração dos recursos genéticos e dos conhecimentos tradicionais a eles associados e os danos transfronteiriços decorrentes da exploração predatória. Os países se depararam com uma crescente degradação da biodiversidade, de forma descontrolada e uma redução da fauna e da flora. Passou-se a questionar o uso com viés exploratório e a necessária preservação da sociobiodiversidade para as gerações futuras tendo por base a interculturalidade, e o reflexo de tais direitos na seara social, cultural, política e econômica. Para enfrentar tais embates, no cenário internacional exsurgiu o Protocolo de Nagoia e, no Brasil, a Lei 13.123, de 2015. Ambas as legislações caminharam no mesmo sentido, flexibilizando o acesso aos conhecimentos tradicionais e à biodiversidade, primando pela expansão da pesquisa e da inovação. A presente pesquisa bibliográfica foi feita utilizando-se do método dedutivo, encontrando-se na temática na Linha de Pesquisa de Direitos da Sociobiodiversidade e Sustentabilidade. O Protocolo de Nagoia deixou a regulamentação nacional a cargo de cada país, trazendo ditames mínimos. O Brasil não o ratificou, mas implementou legislação específica que compreendeu a proteção aos recursos genéticos e os conhecimentos tradicionais associados, todavia, cedeu lugar ao viés exploratório.

Full textA great number of Lithuanian poets were forced to experience the exile or emigration. Literature created in the foreign lands is often characterized by the nostalgia of the native land, homelessness and other features. It is very important in the analysis of the master’s work theme – the dialogality in the poetry of the Zemininkai (the Lithuanian land poets). The Zemininkai are the brightest group of the emigration poets called by the name of the anthology ‘Zeme’ ( ‘the Land’) which appeared in the USA in 1951. The tendencies of the bright poetry modernisation are typical for this poets’ generation. The search for the dialogue with the lost world unites all the Lithuanian land poets. In their poetry they solve the existential problems of the human life having philosophical, deep psychological, religious and other aspects. By this master‘s work it is tried to show that the problem of the dialogality in the creative work of the Zemininkai is important and actual. According to the theory (by M. Buberis, E. Levinas, A. Mickunas, etc.) the dialogue is realized as the relation with the ‘another one‘, intersubjectivity, mutuality, situation of the address and answer, conversation and the other topic (touch, look, sense). The aim of the study is to disclose the different relations of the dialogality based on the methodology of phenomenology and hermeneutics in the early poetry of Henrikas Nagys and Nyka-Niliunas. Full textThe report describes the work and results of a comparison between Sensu and op5 Monitor, which are both tools used to monitor devices in a network, more commonly known as network monitoring systems. The subject was chosen due to the fact that there is such a wide range of network monitoring systems, and it is constantly expanding. It was considered valuable to compare a newcomer with an older tool that is built with a different mindset. It was considered interesting to test how these tools handled the reports created and collected by them, to see if the final results from this would differ or not. To test this a virtual testing environment was built, where Sensu and op5 Monitor were run in parallel to each other and monitored the same systems and used the same set of plugins. The experiments were conducted on two services, BIND9 and Apache2, since the plugins were constructed in different ways, so were the various experiments. In these experiments information was gathered about how the two monitoring tools handled the reports they received, which was then compiled and analysed. The conclusion of it all was that Sensu and op5 Monitor handles the collected information in a similar manner. The reported results were in all cases the same, thus the two monitoring tools behave in the same fashion.

Full textRapporten tar upp en kartläggning av nätverksövervakningssystem (NMS) som används för att övervaka nätverkstjänster och noder på ett nätverk. De egenskaper för NMS som utvärderas är vilket stöd systemen har för att övervaka ett flertal tjänster, hur god prestandan är för varje system samt hur god användbarheten i gränssnittet är. Resultatet visar att Nagios, OpenNMS samt Argus hade stöd för samtliga tjänster medan Munin inte hade stöd för nätverksenheter och Cacti endast stöd att övervaka SNMP. Det visar även att Nagios och OpenNMS generellt hade möjlighet att larma vid fler händelser samt att dessa två system var markant snabbare än Cacti och Munin. Användbarheten visade relativt stor skillnad i olika system. OpenNMS hade högst totalpoäng, men Nagios presterade något bättre i vad Sundström (2005) kallar för interaktion. Munin och Argus fick samma resultat med låg funktionalitet och högre struktur medan Cacti hade god funktionalitet och interaktion men väldigt låg struktur.

Full text1.1.1 Disaster planning and management: an overview With the rapid economic development and urbanization, the cities are growing fast. Throughout the world it is common to observe that large cities and urban agglomerations along with a wide range of opportunities also bring a variety of safety risk. Cities, as those grow bigger and bigger and become more complex, generally become increasingly vulnerable to hazard, both natural and man-made (Misra, 2004). Many cities are located on seismically active zones, near active volcanoes and on areas prone to cyclones and floods and possibilities of damage by these hazards have increased significantly. Due to the lack of proper awareness and preparedness to disasters, the number of casualties affected and economic losses caused by natural disasters have been increasing over recent decades (EM-DAT, 2004). For example, the Tangshan earthquake (July 28, 1976) in China devastated the whole municipality, and killed 242, 000 people with millions of people homeless (Liu, 1985). The Indian Ocean earthquake (December 26, 2004) and subsequent tsunamis caused a total of 229, 866 people lost, including 186, 983 dead and 42, 883 missing (United Nations, 2005). Now, most of the countries have taken various countermeasures to reduce the losses due to disasters. Safety, risk management and disaster preparedness, are now becoming very import aspects of city management in Japan. In the wake of accelerated urban growth and emergence of strong market forces, local area needs and priorities in Japan changed and so was the perception of day to day risks and security from disasters (Misra, 2004). The structural countermeasures are effective in saving people’s lives and properties especially from the small-scale low-impact disasters. While for the low-frequency high-impact disasters, these measures probably cause more losses especially when the risks level greatly exceeds the resilience capacity of infrastructure. That was exactly what happened in the Great Hanshin-Awaji earthquake (January 17, 1995) in Japan (The Asashi Simbun, 1996). The earthquake also taught people that the impact of a low-frequency high-impact disaster (catastrophic disaster) may exceed the present capacity of the public rescue and relief services. In most of the similar cases of catastrophic disasters, the local governments are found to be not able to provide the sufficient services to the citizens in the time of disaster. Though various types of national or international assistances from outside of the suffered region may be available, such as those provided by NGOs, NPOs and INGOs, that kind of external assistance is not at all sufficient, particularly for rescue, relief and recovery. So, it is needed to stress the need for community capacity building. Both communities and local authorities should be empowered to manage and reduce disaster risk by having access to the necessary information, resources and authority to implement actions for disaster risk reduction (Hyogo Framework, 2005). If the local government is only the decision-maker in such cases, they may inevitablely be in bias due to the lack of local knowledge even with the experts’ help. The local government should also learn from the local residents. On the other hand, the individual citizens and the local community should have sufficient professional advice for preparation in advance to cope up with the sudden disaster shocks (The Asashi Simbun, 1996). Often due to the lack of professional knowledge, the individual citizens and the local community fail to find their best way to get prepared for disaster risks. They also need to learn from the local government, experts, or NGO/NPOs. This kind of two-way risk communications are often called “social co-learning” (Okada, 2005). Japan, realizing the need for promotion of ‘bottom-up’ planning and closer involvement of the civil society in urban development, also brought in appropriate changes in its Urban Planning Law in the 1992 and made it mandatory for the local governments to adopt participatory urban planning at the local level (Misra, 2004). After the 1995 Great Hanshin-Awaji earthquake, the local government has started to take the proactive countermeasures in collaboration with the local communities and individual citizens. Institutional changes are also under way, which gradually shifted the conventional type of top-down approach towards the bottom-up approach (multi-stakeholder participatory approach) (Okada et al., 2004). In Japan, self help (“Jijyo” in Japanese) and mutual aid (“Kyojyo” in Japanese) are now more advocated by many policy makers and frequently quoted as keywords for community-based disaster reduction, in the official documents and manuals on disaster planning and management. For example, the Disaster Planning Manual of Kagawa Prefecture (2006) emphasizes the importance of self help, and mutual aid for disaster risk management. Such self-help and mutual-aid activities can enhance the individual citizen’s awareness, and enhance their internal communications with other neighboring individuals and communities. Besides the individuals and the community, disaster volunteers, such as NGOs and NPOs, are also taking more and more important roles in the community’s disaster prevention planning and management.

Full textProject has been designed to alert administrators of disruption of the system, that he can get SMS messages every moment and to be able to know exactly what problems occurred in the system. On this project I analyzed and compared different software for sending SMS, analyzed the technical means for sending SMS. I choose Gammu and Nagios software which I make to interact with each other as one. To interact two different software helps shell script that uses configured SMS daemon. First software is Gammu which encompasses applications, scripts and drivers for managing various functions on cellular phones and similar devices. Second software is Nagios which in the event of a failure can alert administrator of the problem, allowing him to begin remediation processes before outages affect server processes. For sending SMS messages I used a device that can send SMS messages. Was chosen mobile phone SE W810i which is connected to the computer via a USB cable and seen directly in FreeBSD. MySQL relational database system - this Gammu uses to store/retrieve the SMS messages. Created web site where I can set phone numbers, several phones or just manage SMS storage. On SMS storage I can delete messages, or search for messages which I need. Web site is protected with password so on this web site can get in only administrator.

Full textDuring the Predynastic and Early Dynastic Periods (3900-2700 B.C.), anthropomorphic imagery is a theme of prime importance in Egyptian art. Human figures coming from the iconographic, ambiguous and written modes of communication are depicted on a large range of sources. While most of the studies focus on a single type of document, this work concentrates on a particular pattern, the human figure, by proposing a transversal approach of the anthropomorphic imagery. Therefore, this study aims to constrain the evolution of the human depictions during these periods. Through the inspection of the human figures, the study also aims to unravel the way the first Egyptians conceptualised themselves. This work is based on the creation of typologies for the human figures and associated patterns, analysed using statistical tools.The results reveal a chronological evolution of the human figures, with a distinct rupture between the Predynastic Period and the Early Dynastic Period. This transition relates to the introduction of a royal monarchy. This introduction causes a dichotomy between royal and private documentations owing to the appropriation of the art by the state. Besides, the anthropomorphic figures show the appearance of a personal identity in addition to the pre-existent collective identity. This feature is evidence of an increasing individuation

Resumo: A analbuminemia congênita é uma doença autossômica recessiva caracterizada por níveis traços de albumina plasmática (< 1 mg/mL) e sintomas clínicos leves. Entre as comorbidades apresentadas pelos indivíduos e ratos analbuminêmicos (ratos Nagase - NAR), os distúrbios no metabolismo/transporte de lipídeos plasmáticos são as mais marcantes. A dislipidemia associada à analbuminemia é caracterizada por níveis aumentados de colesterol e triglicérides, e déficit de ácidos graxos livres (FFA). Nesta tese, são apresentados três estudos independentes sobre a analbuminemia, os quais objetivaram investigar: 1) os mecanismos da hipertrigliceridemia e do déficit de FFA plasmático do NAR; 2) o metabolismo de carboidratos no NAR; 3) as funções mitocondriais no NAR. Também é apresentado um quarto estudo (aspectos metodológicos) sobre o uso do probe safranina para avaliar o potencial elétrico transmembrana mitocondrial. Os principais resultados destes estudos foram: Estudo um: as taxas de lipogênese (596 ± 40 vs. 929 ± 124 ?mol 3H2O/g/h) e de secreção de triglicérides para o plasma (4,25 ± 1,00 vs. 7,04 ± 1,68 mg/dL/min) foram mais lentas (P ? 0,05) no NAR do que no rato controle Sprague-Dawley (SDR). As injeções de heparina ou de albumina no NAR promoveram um aumento de FFA plasmático em função do tempo. Noventa minutos após a injeção de albumina, os níveis de FFA plasmáticos nos NAR se elevaram de 0,36 ± 0,05 para 1,34 ± 0,16 mEq/L (P ? 0,05), atingindo os níveis do SDR. Estes resultados indicam que a falta de albumina plasmática inibe a lipólise intravascular e causa o déficit de FFA plasmático na analbuminemia, e que a produção hepática de triglicérides não contribui para a hipertrigliceridemia no NAR. Estudo dois: a concentração de glicose plasmática foi similar entre os NAR e os SDR alimentados ou em jejum, porém a insulinemia no estado alimentado foi maior nos NAR do que nos SDR (P ? 0,05). O NAR apresentou maior tolerância à glicose quando comparado ao SDR (P ? 0,05). Esta maior tolerância a glicose está associada à maior resposta insulinêmica à administração de glicose. Não houve diferença entre os grupos para a sensibilidade periférica a insulina. Apesar do conteúdo similar de glicogênio hepático no estado alimentado, o NAR apresentou menor conteúdo de glicogênio (40% do SDR) após 6 h de jejum. A injeção de piruvato (substrato neoglicogênico) promoveu um aumento mais rápido na glicemia do NAR em comparação ao SDR. Deste modo, os resultados indicam que o NAR apresenta metabolismo de glicose acelerado. Estudo três: a capacidade de retenção de Ca2+ pelas mitocôndrias isoladas do fígado do NAR aos três meses de idade foi ~50% daquela do SDR. Esta variável não se diferiu entre os grupos quando avaliada aos 21 dias de vida dos ratos. Foi observada uma depleção de ~20% no conteúdo de nitrosotiol e um aumento de ~30% na expressão de ciclofilina D nas mitocôndrias de fígado do NAR. Nenhuma das variáveis relacionadas ao estado redox mitocondrial diferiu entre NAR e SDR, tais como: o conteúdo de tióis reduzidos, de glutationa total, a taxa de liberação de H2O2, e o estado reduzido de NAD(P)H. Com isso, conclui-se que a maior expressão de ciclofilina D, um componente importante no processo de transição de permeabilidade mitocondrial, e o menor conteúdo de nitrosotiol nas mitocôndrias dos NAR podem explicar a sua menor capacidade de retenção de Ca2+
Abstract: Congenital analbuminemia is a rare autosomal recessive disorder characterized by a trace level of albumin in blood plasma and mild clinical symptoms. Analbuminemic patients and rats (Nagase analbuminemic rats - NAR) present associated abnormalities, among which the disturbances in plasma lipid metabolism and transport are hallmarks. The dyslipidemia associated with analbuminemia comprises a unique plasma lipid profile (i.e. high cholesterol and triglycerides, but a severe free-fatty acids deficiency). Three independent works on analbuminemia are presented in this PhD thesis, whose aims were: 1) to investigate the mechanisms of NAR hypertriglyceridemia and plasma free-fatty acids deficiency; 2) to study carbohydrate metabolism in NAR; 3) to evaluate mitochondrial (dys)function in NAR. Also, a methodological study about the use of the dye safranine as a fluorescent probe for the assessment of mitochondrial transmembrane electrical potential is presented in this thesis. The main results from these studies were: Study one: lipogenesis (596 ± 40 vs. 929 ± 124 ?mol 3H2O/g/h) and triglyceride secretion rates (4.25 ± 1.00 vs. 7.04 ± 1.68 mg/dL/min) were slower (P ? 0.05) in fasted NAR than in control Sprague-Dawley rats (SDR). The injection of either heparin or albumin elicited an increase in NAR plasma FFA levels over time. FFA levels reached control levels 90 min after the albumin administration into NAR, increasing from 0.36 ± 0.05 to 1.34 ± 0.16 mEq/L (P ? 0.05). These results indicate that the lack of plasma albumin inhibits intravascular lipolysis and causes the FFA deficit observed in NAR. Moreover, hepatic triglyceride output seems not to contribute to NAR hypertriglyceridemia. Study two: plasma glucose levels were similar between fed and fasted NAR and SDR, but fed insulinemia was higher in NAR than in SDR (P ? 0.05). NAR displayed increased glucose tolerance compared to SDR (P ? 0.05). This enhanced glucose tolerance was associated with higher insulinemia after the glucose load, and with similar insulin sensitivity between the groups. Despite similar liver glycogen content in fully fed condition, NAR had lower glycogen content (40% of control) after 6-h fasting. The injection of pyruvate (gluconeogenic substrate) elicited a faster rise in glycemia of NAR than in SDR. Therefore, NAR display enhanced glucose metabolism. Study three: the Ca2+ retention capacity of the liver mitochondria isolated from 3-month-old NAR was about 50% that of the control. Interestingly, the assessment of this variable in 21-day-old NAR and SDR indicated that the mitochondrial Ca2+ retention capacity was preserved at this age. A 20% decrease in mitochondrial nitrosothiol content and a 30% increase in cyclophilin D expression were observed in NAR liver mitochondria. None of the variables related to mitochondrial redox state differed between the controls and NAR, i.e., namely the contents of reduced mitochondrial membrane protein thiol groups and total glutathione, H2O2 release rate, and NAD(P)H reduced state. We conclude that the higher expression of cyclophilin D, a major component in the mitochondrial permeability transition process, and decreased nitrosothiol content in NAR mitochondria may underlie their lower Ca2+ retention capacity

Con el surgimiento de la crisis ecológica global y la idea de la sociedad de riesgo, se crean tratados y convenios internacionales en busca de la protección de la diversidad biológica recayendo directamente en el Derecho Agrario debido a las cuestiones de la falta de alimentos, territorios devastados y derechos y conocimientos tradicionales de los pueblos. Relevante, para ello lo es, la Convención sobre la Diversidad Biológica que busca la utilización sostenible de los recursos genéticos y la distribución justa y equitativa de los beneficios de dicho uso. El Estado, propietario originario de los recursos biogenéticos, busca prevenir la explotación depredadora, y a veces ilegal, de la biodiversidad y de los conocimientos de las comunidades tradicionales. El Protocolo de Nagoya, un instrumento importante que Brasil necesita ratificar, está destinado a complementar y asegurar la mencionada Convención, trayendo una mayor seguridad jurídica y transparencia para los proveedores y usuarios de recursos genéticos a nivel mundial, permitiendo el acceso adecuado y la transferencia de tecnologías. Otro punto a tratar es la Ley de Biodiversidad que ha recibido críticas por la restricción de algunos derechos de los pueblos tradicionales, dando espacio para la incursión de empresas e investigadores de los conocimientos tradicionales y de los recursos genéticos. Por lo tanto, esta disertación aborda el problema de cómo entender el verdadero desarrollo sostenible, teniendo en vista la Ley de Biodiversidad y la no ratificación del Protocolo de Nagoya. Así, la metodología de investigación será su análisis desde la perspectiva interdisciplinar y en los aspectos jurídico-sociológicos. Para ello, se utilizará la investigación teoría, así como el razonamiento deductivo y dialéctico. El marco teórico constará de: José Eli da Veiga, Ignacy Sachs y Amartya Sen, para el estudio del fenómeno de desarrollo; Vandana Shiva, para el análisis de la diversidad de conocimientos; y, por último, se tiene como referencia los datos primarios tales como el Convenio sobre la Diversidad Biológica, el Protocolo de Nagoya y la Ley de Biodiversidad. Como resultado, se produjo la ruptura del paradigma de que el desarrollo no puede ser sostenible y se evidenciaron sus elementos reales como la expresión de libertad, el proyecto social subyacente, la protección de la biodiversidad, así como sus aspectos territoriales, económicos y políticos. En lo que se refiere a la legislación vigente, se afirma la necesidad de la ratificación del Protocolo de Nagoya como un mejor apoyo de la Ley de Biodiversidad, teniendo como finalidad la protección de la mega diversidad brasilera tanto biológica como de sus saberes tradicionales.
Com o surgimento da crise ecológica global e a ideia da sociedade de risco, criam-se tratados e convenções internacionais na busca de proteger a diversidade biológica, incidindo diretamente no Direito Agrário, nas questões da falta de alimentos, territórios devastados e direitos e conhecimento dos povos tradicionais. Destaca-se a Convenção sobre Diversidade Biológica, que visa o uso sustentável dos recursos genéticos e a justa e equitativa distribuição dos benefícios desse uso. O Estado, detentor originário dos recursos biogenéticos, busca impedir a exploração predatória, e por vezes clandestina, da biodiversidade e dos conhecimentos das comunidades tradicionais. O Protocolo de Nagoya, importante instrumento que o Brasil precisa ratificar, visa complementar e garantir a mencionada convenção, trazendo maior segurança jurídica e transparência para os provedores e usuários de recursos genéticos a nível mundial, proporcionando seu acesso adequado e a transferência de tecnologias. Outro ponto discutido é a Lei da Biodiversidade que vem recebendo críticas por restringir alguns direitos dos povos tradicionais, abrindo espaço para o acesso por empresas e pesquisadores aos conhecimentos tradicionais e recursos genéticos. Desta forma, a pesquisa levanta a situação-problema de conceituar o verdadeiro desenvolvimento sustentável; tendo em vista a Lei da Biodiversidade e o ainda não ratificado Protocolo de Nagoya. Destarte, tem-se como metodologia sua análise sob a perspectiva interdisciplinar e sob a vertente jurídico-sociológica. Para isso, utiliza-se a pesquisa teórica, como os raciocínios dedutivo e dialético. O marco teórico foi composto por: José Eli da Veiga, Ignacy Sachs e Amartya Sen, no estudo do desenvolvimento; Vandana Shiva, na análise da diversidade dos saberes; e, por fim, têm-se como referência dados primários como a Convenção sobre Diversidade Biológica, o Protocolo de Nagoya e a Lei da Biodiversidade. Como resultado, produziu-se a quebra do paradigma de que o desenvolvimento não pode ser sustentável e evidenciou-se seus reais elementos como a expressão da liberdade, seu projeto social subjacente, a proteção da biodiversidade, como também seus aspectos territoriais, econômicos e políticos. Quanto à legislação vigente, afirma-se que se necessita da ratificação do Protocolo de Nagoya para melhor amparar a Lei da Biodiversidade com o fim de proteger a megadiversidade brasileira tanto biológica como de seus saberes tradicionais.

This article regards these two novels as a single inner-connected story to reveal a hidden structure, which makes the novels unique. This structure turns out to be a cycle which regularly repeats birth and death. I will try to analyse this circular structure by using thoughts of a theologian Mircea Eliade and Buddhism
