Abstract:

Nadine Gordimer, écrivain anglophone sud-africain a reçu le prix Nobel en 1991 ; il récompensait l'auteur de dix romans et de neuf recueils de nouvelles. Dans le cadre d'une approche narratologique on constate l'utilisation particulière que l'auteur fait de la focalisation, recourant avec subtilité a divers modes. Il confère un rôle important au narrateur dans les relations auteur lecteur et narrateur, tout en contraignant son lecteur a s'investir dans le récit par le biais de "l'effet-personnage". On remarque l’évolution, d'une part du rôle accorde par l'auteur au personnage noir, d'autre part des relations inter-raciales au fil des recueils. La fonction du personnage ainsi que sa caractérisation directe et indirecte sont examinées. Si nadine gordimer est influencée par le contexte socio-politique dans lequel elle écrit, elle ne limite pas sa thématique aux problèmes spécifiques a l’Afrique du sud, mais l’étend aux relations humaines en général. Une certaine cohésion apparaît dans chaque recueil centre sur une idée directrice. Par la valeur cathartique et didactique de son écriture Nadine Gordimer témoigne de son engagement contre l'apartheid, tout en ne mettant pas sa plume au service d'une idéologie
Nadine gordimer, an english speaking south african writer received the nobel prize in 1991. It rewarded the author of ten novels and nine collections of short stories. Scrutinizing her short stories in a narratological approach one is struck by the particular use made of focalization by the author. She confers an important part on the narrator in its relations to the reader and to the author, while compelling the reader to participate in the text through "the character-effect". Along the various collections one notices the evolution of the part granted by the author to the black character on the one hand, to interracial relations on the other hand. The character's function as well as its direct or indirect characterization are examined. Although nadine gordimer is under the influence of the sociological and political background from which she writes, she does not restrict her themes to specifically south-african issues but includes human relations as a whole. Coherence is achieved in each collection by the fact that stories all focus on a leading topic

Abstract:

Le roman des frères Goncourt dédié à la bourgeoisie, Renée Mauperin (1864) met en place différentes scènes dans lesquelles la jeune Renée doit faire face aux attentes de sa famille et de son entourage, la bourgeoisie des années 1850, et ainsi, incontournablement, un long et minutieux portrait de cette jeune femme se dessine tout au long des pages. L’accent est mis sur l’absurde éducation que le XIXᵉ siècle impose à ces jeunes demoiselles à marier, rompues aux arts d’agrément et à toutes les délicatesses comme si elles devaient vivre à la Cour. La jeune Renée transgresse les interdits imposés par les mœurs, et manifeste des excentricités inquiétantes. Comme pour la plupart des romans des Goncourt, Renée Mauperin commence au milieu d’un dialogue, et tout l’intérêt se concentre sur le langage des personnages ; c’est donc la première scène du roman, celle de la baignade dans la Seine, celle qui fit scandale tant par l’audace et la supposée inconvenance de la posture, que par les familiarités pittoresques et malicieuses que Renée y égrène à plaisir, avec une franchise et une gaieté, qualifiées par Nadine Satiat de « rafraîchissantes ». L’agencement des éléments linguistiques de l’écriture artiste des Goncourt, ainsi que les différentes traductions espagnoles du texte, vont nous montrer à quel point la présence de l’eau et du monde imaginaire qu’elle évoque, sont par eux-mêmes des éléments transgresseurs et évocateurs de l’interdit pour les jeunes femmes de l’époque.DOI: http://dx.doi.org/10.4995/XXVColloqueAFUE.2016.3882

Abstract:

Who is „senior emploee“, where we can find this institute of law in czech legal system and what it takes to become one? That is subject of this article. Senior employee is defined by § 11 of the Labour Code and its legal regulation is completed with jurisprudence. Law defines most importat conditions for the funnction of senior employee and rights and duties that are conected with it, espacially special rights and duties as duty of care for the safety and helth of subordinate employees, or right to get financial compensation for greater responsibility. According to jurisprudence of the Supreme Court of the Czech Republic senior employee stands between employer and subordinates, but relationship between senior employee and employer is still based on § 6 of the Labour Code and senior employee is still subordinate to employer.

Abstract:

The content of this article is the Commission’s proposal of the AI Liability Directive. The text analyzes the procedural aspects of liability for damage related to artificial intelligence and the related concepts “disclosure of evidence” and “rebuttable presumptions”. And it further presents Presumption of causality and New AI liability regime. In the new regime the burden of proof will be alleviated from claimants. If the commercial entities do not voluntarily provide access to such evidence, the harmed person may upon a reasoned request get a national court to order the disclosure of such information. If the entity still refuses to disclose the relevant information the court will therefore assume causality between the fault of the defendant and the output produced by an AI system or the failure of an AI system to produce the intended output.

Abstract:

This paper is dedicated to the environmental protection according to the rules of Roman law. Combining Roman and environmental law may seem controversial, since the latter is regulated by the means of public law, and on the contrary, Roman private law is not suitable for systematic environmental protection. Hence, the protection of environment was neither a main issue of Roman politics nor Roman law. Nevertheless, the Romans created several legal instruments that could be used to protect the collective interest in preventing the environmental damages. Regarding the above mentioned, this paper offers a view on the different sources that record the protective attitude of Romans towards the nature and environment. In addition, this paper examines the instruments of legal protection of environment in the sources of Roman law, i.e., interdicts and actions that tend to protect the purity of air and waters. The paper is intended to serve as a source of information for practitioners as well as for historians or academics dealing with Roman law, while everyone will be approaching the text differently and with different questions.

Democracy is created on the base of values and the people’s sovereignty realized by means of electing their deputies. Obviously, the institute of referendum is connected with the direct democracy execution, and besides that, its accomplishment signifies the level of the highly developed society. Therefore, the dealing with all society problematic topic sis most reliable when their resolving possesses the high degree of legitimacy which is predominantly guaranteed by the referendum voting. Abstract:

In the introduction to the paper, the author mentions the anchoring of freedom of expression both internationally and nationally, as well as the purpose, forms and content of freedom of expression. Since freedom of expression is not absolute, it must be restricted in certaincases. In the context of the case-law, the author has indicated which conditions must be met in order to be a constitutionally acceptable restriction on freedom of expression. In conclusion, the author pointed to an attempt to introduce a new crime of spreading false information, citing arguments that justify its contradiction with the Constitution of the Slovak Republic.

The right of the necessary road through the adjacent land to the land on which the building is located, in the conditions of the Slovak Republic can be established by a constitutive decision of the court, under the prerequisites of the provisions of Section 151o (3) of the Civil Code. Application practice subsequently interprets these statutory prerequisites, among others, for example, in the decision of the Supreme Court of the Slovak Republic of 30 June 2022, Case No. 5 Cdo 51/2020, which is the focus of this paper.

Abstract:

Os surtos de cólera têm vindo a aumentar na Região da África Oriental e Austral (AOA) desde Janeiro de 2023, com uma transmissão generalizada e alargada no Malawi e em Moçambique e surtos registados na Tanzânia, na África do Sul, no Zimbabué, no Burundi e na Zâmbia.1 Existe o risco de uma maior propagação causada pelos efeitos do ciclone Freddy, que atingiu Madagáscar, o Malawi e Moçambique em Março de 2023. Continuam a registar-se surtos na Somália, na Etiópia, no Quénia e no Sudão do Sul, onde os países estão a atravessar uma situação de seca após sucessivas estações chuvosas deficitárias.1 O contexto de resposta na AOA é complexo. Isto deve-se à escassez de recursos de saúde pública, incluindo a insuficiência de vacinas orais contra a cólera, e às múltiplas emergências de saúde pública e humanitárias simultâneas, incluindo a reemergência do poliovírus selvagem. O envolvimento da comunidade nas respostas ao surto de cólera é essencial, especialmente enquanto o impacto da COVID-19 ainda se faz presente na região, sobretudo no que tange à confiança na saúde pública e nos esforços de vacinação.2,3 O objectivo do presente guia de orientação é apoiar os Ministérios da Saúde, a UNICEF e outros parceiros de resposta na concepção e implementação de um envolvimento comunitário eficaz, centrado na comunidade e baseado em dados, para a resposta ao surto de cólera. Este guia de orientação foi redigido em abril de 2023 por Megan Schmidt-Sane e Tabitha Hrynick (IDS), com a colaboração de Stellar Murumba (Internews), Ngonidzashe Macdonald Nyambawaro (FICV), Eva Niederberger (Anthrologica), Santiago Ripoll (IDS), Nadine Beckmann (LSHTM), Mariana Palavra (UNICEF) e Rachel James (UNICEF). Les flambées épidémiques de choléra s’intensifient dans la région Afrique de l’Est et australe (ESAR) depuis janvier 2023, avec une transmission généralisée et étendue au Malawi et au Mozambique, ainsi que des flambées épidémiques signalées en Tanzanie, en Afrique du Sud, au Zimbabwe, au Burundi et en Zambie.1 Il existe un risque de propagation accrue causée par les effets du cyclone Freddy, qui a frappé Madagascar, le Malawi et le Mozambique en mars 2023. Les flambées épidémiques se poursuivent en Somalie, en Éthiopie, au Kenya et au Soudan du Sud, où les pays sont confrontés à la sécheresse suite à plusieurs saisons des pluies consécutives lors desquelles les précipitations n’ont pas été assez abondantes.1 Le contexte de riposte dans la région ESAR est complexe. Cela est dû aux ressources limitées en santé publique, y compris les pénuries de vaccins par voie orale contre le choléra, et aux nombreuses urgences sanitaires et humanitaires simultanées, y compris la réapparition du poliovirus sauvage. L’engagement communautaire dans les ripostes contre les flambées épidémiques de choléra est essentiel, en particulier lorsque l’impact de la COVID-19 continuent de se faire sentir dans la région, notamment en ce qui concerne la confiance dans la santé publique et les mesures liées à la vaccination.2,3 La présente note d’orientation a pour objectif d’aider les ministères de la Santé, l’UNICEF et d’autres partenaires de la riposte à concevoir et à mettre en œuvre un engagement communautaire efficace, axé sur la communauté et basé sur des données afin de répondre à la flambée épidémique de choléra. Cette note d’orientation a été rédigée en avril 2023 par Megan Schmidt-Sane et Tabitha Hrynick (IDS), avec la contribution de Stellar Murumba (Internews), Ngonidzashe Macdonald Nyambawaro (IFRC), Eva Niederberger (Anthrologica), Santiago Ripoll (IDS), Nadine Beckmann (LSHTM), Mariana Palavra (UNICEF), et Rachel James (UNICEF). En este documento de trabajo se comentara de manera breve el impacto que tuvo la pandemia en los comerciantes de Sogamoso, no sin antes realizar una caracterización delimitada, de los diferentes modelos de negocio existentes, que es a donde se espera llegar con la investigación, para luego identificar las diferentes estrategias que fueron utilizadas por los comerciantes de la localidad y que de alguna manera demostraron efectividad a la hora de salir avante de esta crisis histórica que nadir predijo, que nadie tenia documentado como afrontarla, y que acabo con mas de un microempresario, es por esto que se debe analizar a fondo cada una de estas estrategias aplicada con éxito para luego documentarlas y socializarlas con la comunidad sogamoseña, para tener por escrito fundamentos de un precedente que puede volver a presentarse, junto con escenario poco probables e inesperados que puedan afectar nuestra economía local y global, por ultimo se debe socializar los resultados obtenidos en el ejercicio investigativo y velar por que todos aquellos que se pueden ver afectados en sus negocios apropien este conocimiento generado por la academia.
