Abstract:
Religious activities traditionally served an important role by providing ethical rules and values with supernatural legitimation, but also by providing occasions on which these values were performed in the form of rituals, exorcist theatre, and the retelling of moralistic stories. Lord Guan as an enforcer of moral values had an important place in this discourse, because he could reward and punish with the utmost authority. As an overseer of moral behaviour, the deity also became the putative author of moralistic texts, produced through spirit writing. In the course of the nineteenth century, spirit writing groups in Sichuan and elsewhere started adding a new layer to the deity’s mythology, in which he became increasingly seen as a saviour of humanity and eventually even replaced the Jade Emperor himself.

Larsen, Timothy. By Their Fruits Ye Shall Know Them. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198753155.003.0011.

Full text
Abstract:
This chapter focuses on Mill as political and social activist, including his parliamentary career as MP for Westminster. ‘By their fruits ye shall know them’ was the scriptural text he offered to defend his conviction that the parliamentary candidacy of the atheist Charles Bradlaugh should be supported because he was a productive worker on behalf of much-needed, practical reforms. The moralistic, passionate Mill who agitated against slavery, the Confederacy during the American Civil War, and Governor Eyre is on display. Not least, this chapter explores The Subjection of Women (1869) and Mill’s courageous, pioneering advocacy for women’s rights and gender equality.

Arena, Valentina. Fighting Corruption. Oxford University Press, 2017. http://dx.doi.org/10.1093/oso/9780198809975.003.0003.

Full text
Abstract:
Corruption was seen as a major factor in the collapse of Republican Rome, as Valentina Arena’s subsequent essay “Fighting Corruption: Political Thought and Practice in the Late Roman Republic” argues. It was in reaction to this perception of the Republic’s political fortunes that an array of legislative and institutional measures were established and continually reformed to become more effective. What this chapter shows is that, as in Greece, the public sphere was distinct from the private sphere and, importantly, it was within this distinction that the foundations of anticorruption measures lay. Moreover, it is difficult to defend the existence of a major disjuncture between moralistic discourses and legal-political institutions designed to patrol the public/private divide: both were part of the same discourse and strategy to curb corruption and improve government.

Bennett, Christopher. Retributivism and Totality Can Bulk Discounts for Multiple Offending Fit the Crime? Oxford University Press, 2017. http://dx.doi.org/10.1093/oso/9780190607609.003.0004.

Full text
Abstract:
This chapter examines how multiple offenders seem to pose a problem for broadly retributive principles of sentencing, focusing on the proper place and exercise of discretion to show why such problems are only apparent. It begins with a discussion of the issue of multiple offending and the discretion it seems to give sentencers as well as the bulk-discount principle that appears to guide decisions. It then considers two ways in which bulk discounts may appear to conflict with retributive sentencing theory, the fittingness problem and the selection problem. It also analyzes the key guiding thought within retributive approaches to criminal justice and distinguishes between two types of retributivism, moralistic and legalistic. The chapter concludes with the argument that retributivism is compatible with common approaches to multiple-offense sentencing.
