Abstract:
Many writers defend or attack the position nowadays known as legal moralism. According to the most common formulation, legal moralists endorse the following thesis: the fact that φ‎ing is morally wrong is a reason to criminalize φ‎ing. This chapter considers a different kind of legal moralism, here called instrumental legal moralism (ILM). According to ILM: the fact that criminalizing φ‎ing will probably prevent moral wrongs is a reason to criminalize φ‎ing. Section I draws some relevant distinctions. In doing so, it clarifies the difference between ILM and the act-centred legal moralism (ALM) commonly discussed in the literature. Sections II–IV consider two prominent arguments for ALM: the retributivist argument, offered by Michael Moore, and the answerability argument, offered by Antony Duff. The chapter shows that, contrary to the intentions of these authors, both arguments in fact support ILM.

Abstract:
This chapter examines men's reactions to prostitution legislation. Different contours of masculinities informed by location and by political and economic power influenced the degree of condemnation of or support for anti-prostitution laws. Men's reactions also differed depending on the age of prostitutes. A question that seemed relevant for this discussion of men's sexual politics is what it might take for moralists to become defenders of prostitutes' rights. The change of identity from being a moralist to an advocate for prostitutes' rights underscores the fluidity of debates about prostitution and the shifting positions of moralists. In “defending” prostitutes' rights against the injustice of the colonial state, men deployed the vocabularies of political and cultural nationalism, as they highlighted the integrity of “traditional” customs or criticized the British for imperial failure.

Abstract:
This chapter argues that we should use the terms “sexism” and “misogyny” to mark an important contrast. Sexism is taken to be the branch of patriarchal ideology that justifies and rationalizes a patriarchal social order, while misogyny is the system that polices and enforces its governing norms and expectations. So sexism is scientific; misogyny is moralistic. Sexism wears a lab coat; misogyny goes on witch hunts. A close look at the well-known misogyny speech made by Julia Gillard, then prime minister of Australia, shows that the foregoing ameliorative analysis of misogyny is in keeping with its broadly feminist usage. And this usage was defended and became the basis for revising the term’s dictionary definition. The ameliorative analysis also helps to unify various cases that have seen people reach for the term “misogyny” lately, whether they stem from, e.g., a sense of aggrieved entitlement, sanctimonious moralism, or evince male dominance.
