Full textIl presente progetto di ricerca si concentrerà su due questioni di rilevanza morale: la natura dell’esperienza morale degli morali ed un possibile giustificazione del concetto di supererogatorio. Anche se, ad uno stadio preliminare, queste due questioni non sembrano essere in relazione, diventerà chiaro in secondo momento come esse siano entrambe espressioni di quella complessità tipica dell’ambito morale. Come punto di partenza, seguirò l’approccio della fenomenologia morale come viene definita da Maurice Mandelbaum. Tale studio fenomenologico è quindi inteso come l’analisi, dalla prospettiva della prima persona, di cosa voglia dire fare una data azione. A questo proposito, l’esperienza morale dell’agente appare multiforme ed eterogenea. Ad un livello normativo, la miglior teoria che permette di affrontare e comprendere tale complessità sembra essere il pluralismo morale. In particolare, distinguerò due tipologie di pluralismo: un pluralismo metodologico (che riguarda i diversi modi di ragionare moralmente) ed un pluralismo assiologico (che riguarda i diversi valori a cui diamo una rilevanza assoluta). Queste due interpretazioni rappresentano due modi di comprendere la moralità in virtù della sua essenziale complessità. Come tale, l’approccio della complessità morale si fonda sul riconoscimento della struttura variegata della morale. A questo proposito, analizzerò la posizione di Charles Larmore come espressa nel suo Strutture di complessità morale. La sua identificazione di diversi principi morali egualmente validi, non solo spiegherà qualcosa di essenziale riguardo all’esperienza morale, ma diventerà particolarmente funzionale quando, nell’ultimo capitolo, farò riferimento alla sua teoria per la giustificazione degli atti supererogatori. Il supererogatorio, come evidenzierò, è un concetto morale che si fonda sull’esistenza dei diversi livelli della morale e sulle molteplici modalità di conseguire il bene. In questo modo, una chiara distinzione tra il Giusto ed il Bene fornirà lo spazio teorico per questa categoria di atti. Definirò tale operazione la necessità della complessità, ovvero, il bisogno di una struttura teorica a più livelli che ricordi la distinzione tra precetti e consigli che ha dato vita al concetto nella tradizione cristiana. Cercherò di dimostrare come la perdita di complessità morale è la prima causa delle difficoltà teoriche che le principali teorie moniste (in particolare utilitarismo ed etica kantiana) si trovano a fronteggiare nella giustificazione degli atti supererogatori. Questi approcci teorici, infatti, tendono ad essere anti-supererogazionisti per un motivo ben chiaro. Quando il livello del Giusto ed il livello del Bene si fondono nella stessa categoria, non resta alcun modo diretto di rendere conto degli atti moralmente buoni che vanno oltre il senso del dovere. Credo che l’adozione di un sistema pluralista risolverà il così detto problema del supererogatorio, ristabilendo una chiara distinzione tra le due facce della morale: il deontico e l’assiologico. Da qui il motivo per cui, nel capitolo finale, introdurrò la Multiple Sources Dynamics come una possibile spiegazione, ad un livello normativo, di come si diano le azioni supererogatorie. Un sistema che garantisca molteplici fonti del bene ha gli strumenti per fondare le nostre obbligazioni morali e, allo stesso tempo, per vedere e perseguire beni di altro genere che stanno oltre il livello degli obblighi. In questo lavoro il pluralismo morale viene inteso come una sorta di inferenza alla miglior spiegazione di diverse questioni moralmente rilevanti. Questa affermazione verrà giustificata evidenziando come il pluralismo morale possa spiegare perché la nostra esperienza morale è essenzialmente complessa (fino al punto di fronteggiare reali dilemmi morali) e dimostrando come si possa fornire una giustificazione soddisfacente del concetto di supererogatorio. Se queste due questioni (che a questo punto si danno come direttamente relazionate) sono verificate come valide, l’adozione di un sistema pluralista sarà considerata come l’opzione preferibile tra i vari sistemi normativi.

Full textThis thesis's subject is the setting up of philosophy workshops aimed at inmates serving some time in jail. Our educational project allows them to learn and exchange on philosophical topics related to moral dilemmas. In prison, the teacher's main role is to prepare the inmates for their release and teach them how to understand better the world in which they live. Our research founds its framework for this purpose. The issue raised in this particular work is «To what extent can the use of discussions on moral dilemmas between inmates take a part in their moral development and/or behaviour ?». Our first hypothesis deals with the mobilisation of the rational dimension in their own judgement, in order to give them the opportunity to develop and increase their previous state of moral behaviour. The second hypothesis takes into account the emotional and affective dimension as regard the wording of moral judgements, as it might alter the rational approaches. On the methodological aspect, we focus on the qualitative side that is to say on the content analysis. Starting from the transcript of the discussions on moral dilemmas, we proceed to the coding of the units of meaning of the verbatim, in connection with the values guiding the theory of the stages of moral development of Kohlberg. Then, we apply the content analysis method to reach the sharp understanding of the learners' arguments. At last, from the whole discussions, we grasp the level of the prisoners' moral development and draw their profile of moral educability. This reflexive work on the dilemma aims at the subject's moral educability, based on the premise of a still possible educability. The outcomes of this research, by assessing the potential of the moral educability of the detainees, could alter a decision making on the judicial level. Our research also shows that some arguments can't be related to Kohlberg's grid. Indeed, the theory of moral development levels does not take into account the presence of family values, idealized for detained people. We therefore postulate the existence of a new stage of moral development, of a postconventional level, which could be called "stage of unconditional respect for family values". It would have, as a guiding principle, the absolute preservation of one's family members

More precisely, we claim that, to achieve a full understanding of our moral psychology, we need to distinguish between three different kinds of moral judgments: moral judgments about what happens (good or bad), moral judgments about agents' dispositions (praiseworthy or blameworthy) and judgments about agents' responsibility for a given event. For each kind of moral judgment, we describe the underlying mechanism, and the way it interacts with the others. Finally, we draw some conclusions for moral psychology and philosophy

Relationships between morale, ability, training, and experience are linked to productivity so that managers can incentivize employee productivity more precisely. The data from this survey are effective at the individual level, but are more useful on an aggregate scale, using a theoretical regression. The survey and regression are theoretical, and provide managers valuable information about employees’ productivity and factors that affect it over time. Follow-on research should test the survey’s viability, adjust data collection procedures and the regression equation, and examine the cost-benefit analysis of modeling morale.

Full textIn the Renaissance, short fiction is defined by fictional narratives inspired from reality and claiming to be truthful. These are often narratives staging different social groups and representing all human types. In my analysis of a number of collected sixteenth-century novellas, I noted that great emphasis was laid on social structures (couple, family, social group, location) that represent the basic framework of communal life. However, these works, which at first sight seem pregnant with ideological implications, often stage characters that, for various reasons and at different levels, are made to choose particular paths. Thus, all the debates and polemics raised in these narratives relate to two kinds of morality, one individual and the other communal. The objective of this study is therefore to look into the different representations, and determine the interference, of these two moralities in the novella genre. Scrutiny of the different social, religious, political and cultural codes enabled me to establish the existence of this interference and its impact on the fabric of literary texts. In depicting life in sixteenth-century France, the story-tellers developed a new way of viewing men in their relation to society and the world. As a result, they were able to invent a new morality, thus changing the very perception of the individual

Full textMoral liberalism, which is intimately linked to political liberalism, consists in trying to define the principles of a minimal public morality which makes moral disagreements on conceptions of Good possible. The only way it can have any meaning is by being radically anti-perfectionist, that is, by refusing to contain in itself the least element akin to any conception of Good. The former foundations of liberalism based on the concepts of autonomy and individualism have therefore become inappropriate in justifying the ideal moral neutrality of the public sphere. Neither autonomy nor individualism belong to the uncontroversial values sought after by contemporary anti-perfectionist liberals. The justification and application of the two fundamental principles of anti-perfectionist liberalism, that of to do no harm to others and that of equal respect for each human being, depend, on the one hand, on our moral beliefs being rooted in the liberal and democratic political culture that has developed over the past two centuries and, on the other, on the recognition of the heterogeneity of the sources of our moral deliberations which are completely fallible as soon as they abandon their fucntion of founding those same principles through the understanding internal to the liberal community. Anti-perfectionist moral liberalism is thus opposed to all moral relativism while, at the same time, rejecting the idea that an absolute and infallible moral principle capable of solving all our moral dilemmas could be discovered. All it has to offer is a public morality which does not seek to answer all the questionings which haunt our personal moral experience

Full textAdam smith has all too frequently been made the founder of politiqual economy, in a hidden kind of way since he considered his moral work (theory of moral sentiments) as more important than the wealth of nations and since the economy is, for him, always grounded in moral philosophy. In realty, he only became an "economist" for philosophical reasons. There is an evolving process of the transformation from philosophy to economics : the enigma of the self regulating market is finally resolved, the solution is finally found in wich the fundamental problem of a long term social link is optimal. All economic theses are based on a paricular philosophical hermeneutic of the market. In order to demonstrate this thesis, it is intended to uncover the virtues of the self regulationg market, taking as the guideline the ever espace present concept of nature in the wealth of nations. The "commercial society" is the historical manifestation of human nature, with de smith's version of natural law. It embodies the emergence of a system of "natural" economic laws (in the sense of a mechanism tending toward an unintentional state wich reveals itself unconciously orientated towards the public good). But the analysis of wealth of nations seem to contradict the results of the moral philosophy. Hence the "adam smith problem". An examination of the theory of moral sentiments shows that two models exist: one wich links the moral to the social, by fully developing natural morality; and the other by withdrawal. The weath of nations is only the "becoming" part of this withdrawal, a minimal articulation of the order of moral coexistence and the economic order. A realistic solution is one of the lesser evil, which brings about the apparently denied moral ends by other means. It is here that lies the philosophical dignity of the market as the semi dialectic inheritance of natural morality

Full textThis thesis is an explorative investigation of moral non-conforming, and the motivation of moral non-conformers. A moral non-conformist is a person who, for moral reasons refuse to behave like the group behaves, as he/she believes the group behaves immorally. The results showed that moral non-conformity can be divided into six groups : The intervening, The activists, The Whistle-blowers, The conscientious objectors, and Duty. All these groups have their own motivation that promote their moral non-conforming behaviour. The conclusion must therefore be that there are no general motivations which promote moral non-conformity, but every moral non-conformer has their own motivation and trigger situation to permit their behaviour. These conclusions are based on open questionnaires and interviews with respondents of different ages, nationalities, and social economic status. The nationalities are Chinese, British, French and Swedish, but it is worth noticing that nothing in the analysis showed a pattern based on national culture. Full textMy thesis develops the problem of the compatibility between moral responsibility and the physical causation of human decisions. This problem is dealt with the supposed relevance of two different conditions of responsibility: the power to choose otherwise and the control over the source of behaviour. The alternative-possibilities condition is examined by reference to the Frankfurt-type examples, while the source-condition is supported by the manipulation examples. My analysis rejects both of those argumentations. The examination of P.F. Strawson’s and J. Feinberg’s works show, in my opinion, that it is impossible to define the conditions of responsibility without embracing some sort of normative ethical theory. So I came to analyse the notion of moral obligation and finally I propose a contractualist approach, based on the works by T.M. Scanlon

Specifically, there are seller’s rights versus purchaser’s rights or third party rights like that of the property’s occupant. In the face of this crisis of trust, the moral stakes of this contract raise great interest, in particular regarding the moralization of real estate sale by the combined action of the legislature and judges. They are interested in the good of all contracting parties where the mere domain of law is exceeded. Indeed, in terms of morality, an action is evaluated according criteria of right and wrong, whereas, in terms of justice, an action is evaluated according criteria of fair and unfair. Law, which is based on justice, concerns « the fair balance of assets sharing between citizens ». The good consists of « an equilibrium where harmony among all parties is realized by a fair measure ». Full textThe moral suffering in the workplace has already been mentioned by Dr. Villermé in the 19th century, it rises from the ashes whenever difficult times in the economy or politics arise. Understanding the psychological mechanisms are required for the law to assign the most appropriate legal qualification. The damage that is caused to the worker must then find a compensation corresponding to the damage. The creation of a specific prejudice station dedicated to psychological disorders is an approach that I have tried to put in place for its recognition as a lesion is appreciated just as a physical wound. The "psychometer" (scales of assessments of psychological disorders) rested on a proven set of methods and scientific technics. At present, these methods allow us to assess and evaluate with great precision the psychological suffering of the worker at work. The degree of pain, intensity and disability of the employee by an expert allows us to assign a compensation for the damage based on a specific schedule that I developed for psychological disorders. Thus , the prevention of risks should be the approach of all social enterprises and the partnerships (Unions and employers). As a result, the skills of experts from the medical world, ergonomics, law, etc. must be collected to achieve the objectives. The role of the employer, the CHSCT and the Institution Staff Representative is essential in the process of prevention of occupational hazards

Full textThe xx century has known an historical disaster which raises serious questions for the subject of philosophical inquiry. Actually, Auschwitz is a "caesura" between a "past" and a "future". Never before today has mankind known such a defeate. Given this defeat, it seemed at the begining that philosophy had abdicated its role because philosophical concepts were thrown back from the silence, removing from a philosophical discourse all its meaning. It is therefore incumbent upon us to return to a new philosophical critique but also to return to a philosophy of moral consciousness. It seems that it is the end of philosophy; however, never more than today it has been confronted with the exisgency of its survival. Then, how to construct a philosophical discourse which has a meaning after Auschwitz? First, we must analyse the meaning of otherness and barbarism to understand the task of philosophy. In order, to begin to reconstruct a new discourse of philosophy, we must first analyse the principal dimensions of the question of antisemitism. Full textThe starting point of this work is the nietzschean criticism of christianity in the sense that it has degenerated into moral doctrine. This work shows that this criticism is relevant as regards some historical achievements of christianity but not as regards the fundemental nature of christianity (ch. I). The christian god is not the god of morality : the old testament and the new testament attest that the love of the christian god is of a free, spontaneous, disinterested nature (ch. Ii and iii). This thesis comes within the framework of teleological ethics : it brings out the main ideas of the aristotelean ethics and analyses the link made by p. Ricoeur, in "soi-meme comme un autre", between deontological and teleological dimensions. Thomas d'aquin is a means to introduce the theological dimensions of ethics (ch. Iv, v, vi). The third part uses the concepts developed by p. Ricoeur so as to link together the moral, ethical and theological dimensions. The golden rule is a determining element which enables to understand the link between law and human wish (ch. Vii). The reevaluation of heteronomy by p. Ricoeur allows to conceive grace; then notions of attestation conviction, imputability, responsibility and recognition enable to seize the identity of the christian ethical subject (ch. Viii). Full textThe aim of this study is to develop a theory in order to describe, explain, and regulate moral disagreements. Ours is an empirical approach to moral disagreement, based mainly on empirical data provided by social and moral psychology.The morphology of moral disagreement (part 1) reveals that it is drawn from polemical imagination, which consists of three key elements: analogy, metaphor, and symbol. Such hybridization gives birth to symbolic networks, organizing the relationship between the moral opponents.The genealogy of moral disagreement (part 2) aims to determine the sources of these symbolic networks. We will analyse the psychological, anthropological, and socio-historical processes underlying the moral disagreements. The key role of family – as matrix, model and object of disagreement – will be emphasized.The polemology of moral disagreement (part 3) attempts to reorganize the symbolic networks through a pragmatic and normative approach. We will analyse the procedures in view of a regulation including the transformation of polemical imagination into consensual imagination.Thus, moral disagreement must be reasserted, before any attempt to rehumanising the moral field.Key-words: moral disagreement, moral philosophy, social psychology, moral psychology, imagination, analogy, metaphor, symbol, family

Full textOur thesis consists of four sections that correspond to the different categories of intellectual history as defined by r. Darnton. In the first section, we outlined the "field" of ethics as we perceive it through the works, opinions, polemics of philosophers an moralists. We show how the christian ethic based on the revelation is gradually eroded by the idea of natural ethics, the two being mutually and reciprocally dependend. The second section analyses the ethical idea according to the opinions of the revolutionaries. The same themes are taken up again and studied in the context of the revolution in order to fully grasp the evolution and the interrelations that they imply. We demonstrate that from natural ethics to republican ethics, it is not the definition of the ethical idea that changes but rather its modalities of distribution and application. In the third section, we deal with the question of the distribution of the ethical idea in the french society through the various institutions created by the revolutionaries, while the fourth section analyses the processes of appropriation and reception of the message by the popular classes

Full textThis work explores the history of the conflict between a benign and a strict tradition of moral investigation in France between 1630 and 1700. It develops in two main areas : polemics and theology. The evolution of polemics is caracterized by a permanence of themes and arguments. Each party has a defined role, partly for institutional reasons that also explain the distance between polemic and theology. The evolutions of moral theology follow a different rythm from that of polemics. A significant part of benign theologies remains free of critics et remains in use. Few new texts come to light at the end of the century. The benign tradition though on a defensive stand as to its conclusions, is able of producing new instruments. Rigorist theology exists, but encounters difficulties in breaking with its adversary. Cultural practices related to casuistry remain stable

Full textPropositions for a descriptive ethics, case, rule, norm. The starting point of the thesis is to note the opposition between two types of moral codes. Universal prescriptive moral codes retain their compulsory value, but, they cannot be applied to individual circumstances ; parenetic and individualist moral codes remain attached to the individual circumstances of the act, but they lose their normative value pertaining to any moral code. The historical section develops and illustrates this opposition in two parts, one of them devoted to the moral codes of the norm (theonomic moral codes, kantian formulation of a moral code, social moral code), the other to the moral code of the case (parenesis, moral guidance, confession ; casuistry, situation ethics ; the individual example). The dialectic section defines the useful concept in an analytical part (norm, rule ; human setting ; cases) before setting out in a problematic part a reformulation of moral questions. Drawing from works on phenomenology (schutz, berger and luckmann) and ethnomethodology (garfinkel), the descriptive ethics tries to outline the bargaining and regulating processes by which the members of a same culture identify, deal with and solve their morally difficult circumstances. The project relies on the presentation and the analysis of samples which are taken from the fields of bioethics. In any difficult moral circumstance, it is possible to find which ethical to apply through the use of a normative description. This is the very process used by members of a same culture. Thus, the thesis lays the foundation of a overall hermeneutics of the method of the ethical practices of any culture

Full textAfter the "ṧahada" (the testimony of faith), which is the first pillar of Islam, conversion requires the new Muslim to obey the laws and rules inspired by the Qur'ân and the prophetic tradition (Sunna). It implies following a set of norms related to the religious practice that a Muslim commits himself to respect. This thesis analyzes cases of conversion, while taking into account the family and social origins of each convert. It examines the changes in the lives of these new Muslims, following their conversion. From this point of view, the question is whether, in the case of converts, such a change leads to dilemmas related to the pre-conversion respect of norms in a secular country, and whether or not these dilemmas are sustainable or intractable. These dilemmas, far from being limited to a few specific areas (such as wearing the veil, prayers, etc.), extend to the much broader field of the subject’s existence, in its complexity. This thesis also aims at clarifying the overall vision of the place of converts in is the so-called "Islam in France". However, this vision assumes that Islam is thought in association with immigration, whereas these converts are not immigrants. In order to answer these questions, this thesis addresses the question of moral responsibility according to an approach related to the sociology of morality and the sociology of religions, focusing on the respect of Islamic norms in a secular country such as France

Cocteau's art rests on the notion he has of poetry. With the help of the example set by Erik Satie, Raymond Radiguet and Pablo Picasso, he understood at an early age that poetry resided within him and that only by exploring himself and by following a set of morals--in this instance, morals signifies behaviour which conforms to the demands of poetry--would he attain a level of pure poetry.
All of this is evident as much in the ideas the poet conveys as in his style. The personality of the poet, his "ligne" to use Cocteau's words, becomes apparent the more the idea is accurate and the word chosen significant. As a result of this "ligne", of its presence in the work, the poet approaches immortality.
According to Cocteau, the work of a poet cannot flourish within human limits. The poet must transcend such limits to embody universal activity. It is for this reason that the poet must redefine religion and create for himself a personal mythology, that he must reconstruct the world starting from a play of spatial and temporal perspectives. His role thus proves essential to human survival. In effect, the poet fills the cosmic void in which man is evolving.
