Abstract:
This book defends the theory of legal monism against dualism and pluralism. Whereas dualism holds that different bodies of law such as international and national law are entirely separate and pluralism argues that there are many potentially overlapping and heterarchical bodies of law, monism considers all law to form part of one unitary and hierarchically ordered legal order, be it international, EU, or national law. To this end, this book will use the pure theory of law of the Vienna School of Jurisprudence, which has—since its inception in the first half of the twentieth century—been largely ignored by legal theorists. On the basis of philosophical/epistemological, legal, and moral/political arguments, it will argue in favour of monism under the primacy of international law, i.e. that in cases of normative conflicts, international and EU law prevail over national law, and thereby restore the respect for international legal cooperation. In other words, it will argue that only this version of monism takes the law and the concept of legal validity seriously; that it can better describe and explain the relationship between legal orders and resolve normative conflicts than dualism and pluralism; and that it has a superior moral dimension, which can help bring about a cosmopolitan legal order under global democracy and peace.

Abstract:
We simultaneously perceive many things—colours, tastes, sounds, etc.—and are aware that we do so. Are the mental acts that we are simultaneously conscious of distinct mental acts, independent of each other? In Psychologie Brentano’s answer was an adamant No. All mental acts that we are jointly aware of are conceptual parts of one and the same mental activity (Mental Monism). Soon afterwards he changed his mind to Yes, our simultaneous mental acts are distinct and mutually independent, but co-conscious acts are accidents of one soul. I explore Brentano’s Mental Monism and defend it against Brentano’s own critique. At any time, there is only one mental act that we partially describe when we talk about seeing and hearing and consciousness of these activities.

Abstract:
Chapter three examines Spinoza’s views on metaphysical dependence, in which the role of the conceptual is arguably the clearest. Spinoza uses some twenty-two different terms for dependence in the opening pages of the Ethics, and a fierce interpretive debate has erupted over how to understand the relations among these seemingly different forms of dependence. This chapter argues that Spinoza holds an especially austere view, which is here named conceptual dependence monism: there is exactly one form of metaphysical dependence, and it is conceptual in kind. This interpretation is defended on both textual and systematic grounds, pointing out some of its implications for our understanding of other, more familiar Spinozistic doctrines. Along the way, a clearer understanding is also gained of Spinoza’s explanatory requirements in metaphysics.

Abstract:
This chapter depicts and defends monism in its positivist-epistemological manifestation (as envisaged by the Vienna School of Jurisprudence’s pure theory of law) as the most viable concept to theorize the relationship between different bodies of law. After a short introduction to the (neo-)Kantian sources of Kelsen’s theory, the concept of the Grundnorm and the hierarchy of norms will be discussed in detail. Subsequently, it will be argued why legal monism under the primacy of international law is the only avenue through which the law can be meaningfully cognized and the concept of legal validity be taken seriously. The last part of the chapter is dedicated to a defence of legal monism against two of its staunchest critics, namely H.L.A. Hart and Joseph Raz.

The aim to defend legal monism requires more than just mere epistemology, as sceptics might argue that monism is incapable of describing the real legal world and the law as it is. Consequently, this part offers a precise analysis as to whether two or more distinct bodies of law blend into a unitary legal order or whether they evade such integration. Thus, it will assess the assumptions of the pure theory of law, and in particular those of legal monism, namely between national law and public international law; and between national law and European Union law. The objective of this assessment is to show whether monism is in fact capable of describing the legal reality as well as or even better than dualism or pluralism.

This chapter looks beyond the mere epistemological and descriptive horizon of legal monism and enquires as to what follows from a unitary view of the law in normative sense. Furthermore, this necessitates the question of whether monism is indeed capable of improving the law as it is, and if the answer is yes, in what way it can achieve this goal. It will be argued that especially regarding international law, the pure theory of law is very open to extra-legal elements, namely in three distinct areas, which will also form the main sections of this chapter: ideological criticism; democracy (as well as constitutional review); and pacifism (as well as cosmopolitanism).

Chapter 3 (“Ethics 1p5: Shared Attributes and the Basis of Spinoza’s Monism”) develops replies on Spinoza’s behalf to two objections (the “Hooker-Bennett objection” and the “Leibniz-Bennett objection,” respectively) to his demonstration in Ethics 1p5d that substances cannot share an attribute. Both of these replies appeal to a positive aspect of the priority of substance over its modes: that modes are in and conceived through their substances. In his important 2002 article “Spinoza’s Substance Monism,” Michael Della Rocca develops replies to the objections that appeal instead to a negative aspect of the priority: that substances are not in or conceived through their modes. This postscript argues that neither of the negatively based replies is satisfactory on its own within the argumentative structure of the Ethics and that the positively based replies of Chapter 3 are more likely to capture Spinoza’s own thinking about the impossibility of shared attributes
