ABSTRACT Spontaneous adrenal hemorrhage (SAH) in the absence of trauma or adrenal tumor is a rare condition. Its incidence has been reported from 0.14 to 1.1% and it usually involves the right adrenal gland. During pregnancy, unilateral SAH has been reported very rarely. We describe a case who presented to us with pregnancy-induced hypertension and pain in right flank region for 1 day and diagnosed as a case of spontaneous right adrenal hemorrhage and managed conservatively. Abstract:
ABSTRACT Purpose This study is aimed to determine the efficacy of temporalis muscle and fascia flap in the treatment of unilateral temporomandibular joint (TMJ) ankylosis in adults. Treatment of TMJ ankylosis has been a topic of debate and the treatment options are multidimensional. Achieving good postoperative mouth opening and functional and cosmetic outcomes of surgery, depends on the method of reconstruction. The need of study is to give the best possible solutions with minimal morbidity to the underlying deformity. Materials and methods A retrospective study was done on 51 patients to evaluate the postoperative results for unilateral TMJ ankylosis. Parameters such as etiology, postoperative mouth opening on 1st, 2nd, 6th week and 6 months and intraoperative and postoperative complications were recorded. The operative protocol for unilateral TMJ ankylosis entailed: (1) Resection of the ankylotic mass, (2) intraoral ipsilateral coronoidectomy, (3) contralateral coronoidectomy when necessary, (4) interpositional tissue transfer to the TMJ with temporalis muscle and fascia flap, (5) maxillomandibular fixation (MMF) and (6) early mobilization and aggressive physiotherapy. Results The results were encouraging and functional results of interpositional arthroplasty were satisfying with minimal complications. Early postoperative initial aggressive exercise, physiotherapy, and strict follow-up play an important role in preventing postoperative adhesions. Conclusion The findings of this study support the use of temporalis muscle and fascia flap in adult patients with unilateral TMJ ankylosis. - In its Order of 15 October 2008, rendered in the case concerning Application of the International Convention on the Elimination of All Forms of Racial Discrimination (Georgia v. Russian Federation), the International Court of Justice indicated provisional measures directing both Parties, inter alia, to ensure that no action of racial discrimination be taken against the persons living in the Georgian territory of South Ossetia and Abkhazia. The Court's Order deals with interesting issues concerning the extraterritorial application of the Convention on Racial Discrimination, the interpretation of the compromissory clause embodied in Article 22 of the Convention and the relationship between human rights law and humanitarian law. The most debated issue, however, revolved around the question as to whether there existed a dispute between the Parties as to the interpretation and application of the Convention. While Georgia may have used its unilateral application for political purposes which are connected to the broader conflict following Russian military intervention of August 2008, it is argued that the Court's decision on the existence prima facie of a dispute and of its jurisdiction appears to be a sound one.

Lasers have become widely used in various sectors such as industrial, military, social settings, and as well as cosmetic. Laser epilation is an increasingly popular method of hair removal. However, if not used with care, it can cause serious ophthalmological and psychological disorders; this may lead to job loss and economic loss. Eye injuries in the workplace are quite common worldwide, particularly in low-income and middle-income countries. The retina is the most vulnerable tissue to laser-related injury, which can lead to serious needless visual impairment. Therefore, precautions need to be taken to prevent such injuries, which could become a critical public health problem. This report relates to a 41-year-old female esthetician with unilateral maculopathy. An acute visual field defect occurred inadvertently with unplanned laser exposure while trying to repair Alexandrite laser device without any eye protection. Fundus examination, colour, red-free photography, fluorescein angiography (FFA) and optical coherence tomography (OCT) were performed. This report is important because it will raise awareness within both the medical and public sectors about the risks of misuse of laser epilation devices.

Poichè le alterazioni della funzione vestibolare possono essere causa di disequilibrio, i principali reperti sviluppati ad oggi per misurare il controllo posturale e l’integrazione sensoriale nel danno vestibolare sono stati ottenuti grazie alla posturografia. Tuttavia, al fine di superare i problemi legati a tale genere di tecnologia, sono stati proposti gli accelerometri indossabili (ACC) come un’alternativa portatile e a basso costo per la misurazione dell’oscillazione corporea in ambienti confortevoli. D’altro canto, nessuno studio ad oggi ha dimostrato la validità sperimentale delle misurazioni ottenute con ACC - rispetto a quelle derivanti dalla posturografia - in soggetti affetti da deficit vestibolare. Pertanto, l’obiettivo del presente lavoro è stato quello di i) sviluppare e validare una strumentazione pratica che potesse consentire la misurazione dei disordini dell’oscillazione corporea nell’ambito della valutazione otoneurologica attraverso gli ACC e ii) fornire un’analisi delle oscillazioni affidabile ed automatica, che potesse implementare in modo sensibile ed accurato la possibile discriminazione di pazienti affetti da deficit vestibolare unilaterale (UVF). A tale scopo, un gruppo di 13 pazienti (sette femmine, 6 maschi; età media 48.6 ± 6.4 anni) affetti da UVF da almeno 6 mesi e un altro omogeneo di 13 soggetti sani sono stati invitati a mantenere la posizione eretta durante l’esecuzione della posturografia statica (FBP) mentre indossavano a livello lombare - vicino al centro di massa - un sensore Movit® (by Captiks) costituito da accelerometri 3-D. La correlazione ‘product-moment’ secondo Pearson ha dimostrato un elevato livello di corrispondenza di quattro misure, estratte da ACC e da FBP, nel dominio del tempo e di tre in quello della frequenza. Inoltre il t-test ha evidenziato che due parametri nel dominio del tempo e due in quello della frequenza si sono dimostrati affidabili nel discriminare i soggetti affetti da UVF. Tali aspetti, nel loro complesso, dovrebbero focalizzare l’attenzione in ambito clinico e di ricerca su tale tecnica di registrazione, considerato l’arricchimento quantitativo e qualitativo di informazioni utili nella discriminazione, diagnosi e trattamento di pazienti affetti da UVF. In conclusione, noi riteniamo che la misurazione basata su ACC offra un’alternativa confortevole, affidabile, economica ed efficiente utile, assieme ai test clinici di equilibrio e mobilità, in molteplici circostanze così come negli studi implicati nella diagnosi, controllo e riabilitazione di pazienti affetti da UVF.

Hingga saat ini belum ada penelitian tentang Absensi Palmaris Longus di Lampung.Tujuan penelitian: Mengetahui Prevalensi Absensi Palmaris Longus Tendon Suku Lampung pada Civitas Akademika Universitas Malahayati Bandar Lampung.Metode Penelitian : Jenis penelitian kuantitatif, dengan rancangan observasional. Populasi penelitian ini seluruh Civitas Akademika Universitas Malahayati Bandar Lampung yang bersuku Lampung. Data diambil menggunakan teknik Total Sampling. Pemeriksaan fisik menggunakan tes Schaeffer dan dikonfirmasi dengan pemeriksaan fisik lainnya yakni Tes Mishra I, Tes Mishra II, Tes Thompson, Pushpakumar’s two fingers sign. Hasil penelitian : Dari 104 responden Absensi Palmaris Longus Tendon sebanyak 6 orang (5,8%). Absensi Palmaris Longus Tendon unilateral sebanyak 3 orang (2,9%), Absensi Palmaris Longus Tendon Bilateral sebanyak 3 orang (2,9%), dengan jenis kelamin laki-laki sebanyak 3 orang (2,9%), dan jenis kelamin Perempuan sebanyak 3 orang (2,9%).Kesimpulan : Prevalensi Absensi Palmaris Longus Tendon Suku Lampung pada Civitas Akademika Universitas Malahayati Bandar Lampung sebanyak 6 orang (5,8%). Saran untuk penelitian lebih lanjut agar mendapatkan hasil yang lebih akurat mewakili populasi Indonesia perlu subjek yang lebih homogen dan lebih banyak. The population of this research is the entire academic community of Malahayati University in Bandar Lampung, who are of Lampung ethnicity. Data were collected using the total sampling technique. The physical examination used the Schaeffer test and confirmed by other physical examinations, namely the Mishra I test, Mishra II test, Thompson's test, Pushpakumar's two fingers sign.Results: Of the 104 respondents, there were 6 Palmaris Longus Tendon attendances (5.8%). Absence of unilateral palmaris longus tendons as many as 3 people (2.9%), absence of bilateral palmaris longus tendons as many as 3 people (2.9%), with male gender as many as 3 people (2.9%), and female gender as many as 3 people (2.9%).Conclusion: The prevalence of Palmaris Longus Tendon Absence of the Lampung Tribe in the Academic Community of Malahayati University in Bandar Lampung is 6 people (5.8%). Suggestions for further research in order to get results that more accurately represent the Indonesian population need more homogeneous and more subjects. Abstract:
This study aimed to examine the cortical microvessel diameter response to hypercapnia in misery perfusion using two-photon laser scanning microscopy (TPLSM). We evaluated whether the vascular response to hypercapnia could represent the cerebrovascular reserve. Cerebral blood flow (CBF) during normocapnia and hypercapnia was measured by laser-Doppler flowmetry through cranial windows in awake C57/BL6 mice before and at 1,7, 14, and 28 days after unilateral common carotid artery occlusion (UCCAO). Diameters of the cortical microvessels during normocapnia and hypercapnia were also measured by TPLSM. Cerebral blood flow and the vascular response to hypercapnia were decreased after UCCAO. Before UCCAO, vasodilation during hypercapnia was found primarily in arterioles (22.9% ± 3.5%). At 14 days after UCCAO, arterioles, capillaries, and venules were autoregulatorily dilated by 79.5% ± 19.7%, 57.2% ±32.3%, and 32.0% ± 10.8%, respectively. At the same time, the diameter response to hypercapnia in arterioles was significantly decreased to 1.9% ± 1.5%. A significant negative correlation was observed between autoregulatory vasodilation and the diameter response to hypercapnia in arterioles. Our findings indicate that arterioles play main roles in both autoregulatory vasodilation and hypercapnic vasodilation, and that the vascular response to hypercapnia can be used to estimate the cerebrovascular reserve.

Abstract:
This article discusses challenges that artificial photosynthetic (AP) systems will face when entering and competing in a global market characterized by established fossil fuel technology. It provides a perspective on the neoliberal principles underpinning much policy entrenching such environmentally destructive technology and outlines how competition law could aid overcoming these hurdles for AP development. In particular, it critiques the potential for competition law to promote a global AP initiative with greater emphasis on atmospheric carbon dioxide and nitrogen fixation (as well as solar-driven water splitting) to produce an equitable, globally distributed source of human food, fertilizer and biosphere sustainability, as well as hydrogen-based fuel. Some relevant strategies of competition law evaluated in this context include greater citizen–consumer involvement in shaping market values, legal requirements to factor services from the natural environment (i.e. provision of clean air, water, soil pollution degradation) into corporate costs, reform of corporate taxation and requirements to balance maximization of shareholder profit with contribution to a nominated public good, a global financial transactions tax, as well as prohibiting horizontal cartels, vertical agreements and unilateral misuse of market power.

Abstract:
“The Protection of the European Strategic Sectors”. The kind of protection that is at the heart of this doctoral thesis is the defence of the strategic companies established in the European Union (EU) from takeovers by foreign investors, that is to say investors from countries which are not part of the European Economic Area. This work aims, on the one hand, at outlining the main features of a screening mechanism of foreign investments at the EU level and, on the other, at identifying the proper legal basis in the EU Treaties for its establishment. Chapter 1 contains a non-exhaustive list of the European strategic sectors which consist in all the economic sectors in which the EU or its Member States have adopted rules to limit foreign investors’ right to acquire participations in strategic companies for reasons of public security. Indeed, the Court of Justice of the EU (CJEU) used the expression “strategic sectors” in relation to undertakings whose activities are deeply linked to the protection of public security. The EU notion of public security contains both internal and external security, but also the production of goods and the supply of services which are essential for the very existence of a country. Chapter 2 provides a comparative study of the present situation of strategic enterprises’ protection in three EU Member States (Germany, Italy and France). It shows that a fragmented landscape of foreign investment control rules adopted by national authorities represents both a constraint to an efficient internal market of capital movements, and a limit to an effective protection of the European strategic sectors. By contrast, an EU foreign investment control mechanism could lead to a less fragmented system of strategic companies’ protection, which would be able to encourage foreign investments. At the same time, a single EU body of foreign investment control should be more efficient in order to protect EU public security. Moreover, unlike Member States measures such as “golden shares”, this mechanism could enjoy a greater degree of compatibility with the fundamental freedoms of the Treaties. In effect, the CJEU recognises a “presumption of conformity” with the freedoms of movement to the EU secondary legislation which pursues objectives of general interest like the protection of public security. Chapter 3 analyses the most significant experience of foreign investment control at the global level, the Committee on Foreign Investment in the United States, in order to understand if it could be a suitable model for the establishment of a similar body in the EU, the Committee on Foreign Investment in the EU (CFIEU). Once outlined the key aspects of the CFIEU, chapter 3 focuses on the search of the most proper legal basis in the EU Treaties for its establishment. The study tries to demonstrate that Article 207(2) TFEU on unilateral measures of Common Commercial Policy (CCP) could be the right legal basis for the creation of the CFIEU. Indeed, after the Lisbon Treaty, the CCP has become an exclusive competence of the EU which also encompasses the admission and the treatment of foreign direct investments. In conclusion, chapter 3 tries to figure out the implications of the establishment of the CFIEU both on Member States competences (especially their exclusive competence on national security by virtue of Article 4 TEU), and on the international obligations undertaken by the EU towards third countries, with particular reference to the World Trade Organisation rules and international investment law.

Unilateral refusals to license intellectual property (“IP”) present one of the most complex and thorniest issues in antitrust context; Qualcomm’s worldwide scheme for its licensing standard essential patents (“SEPs”), which was confronted by competition agencies over several jurisdictions, specifically depicts such an issue, further leading to what this article aims to delve into: “whether” and “when” a unilateral refusal to license SEPs violates antitrust laws? While recognitions and applications of essential facilities doctrine to impose a general antitrust duty to deal were not uncommonly seen, empirical cases in the US saw a gradual negative treatment, therefore makes the doctrine worth a discussion in this article. As to the intertwined applications of IP laws and antitrust laws invoked by unilateral refusals to license, the US federal circuits had promulgated several approaches and that no coherent view was reached thus far; accordingly, the threshold question of when antitrust laws can interfere when IP holders are exercising their statutory right to exclude is to be tackled with in this article. This article attempts to define the scope of an IP holder’s rights with respect to patent misuse doctrine, and distinguishes refusals to license into two types: selective refusals that discriminate licensees and pure refusals. This article suggests the former to be recognized as a form of patent misuse. This article further proposes a Two-Tiered Approach to determine if a unilateral refusal to license constitutes an antitrust violation by examining: firstly, if there is evidence of IP misuse, and secondly, if the IP at issue as an essential facility can be found. In addition, this article seeks to infer potential influences of the US Supreme Court case Trinko on refusals to license cases and to summarize the US courts’ current view on the issue by conducting empirical quantitative analyses as to post-Trinko federal courts’ refusals to license decisions. When it comes to unilateral refusals involving SEPs as was seen in the recent Qualcomm case, issues including the relation between SEPs and essential facilities, the definition of relevant markets participated by SEPs holders, and the determination of market power arise. Along with analyses regarding these issues, this article makes further review and commentaries on both the US district court’s denial of Qualcomm’s motion to dismiss and Taiwan-FTC’s Qualcomm case decision, and examines Qualcomm’s licensing scheme by applying the proposed Two-Tiered Approach.

Il presente studio monografico indaga gli strumenti variamente deputati ad accrescere le garanzie di tutela della salute dei lavoratori e ad elevare gli standard di sicurezza previsti normativamente. Rispetto alle previsioni di cui al d.lgs. n. 81/2008 possono essere create, ad iniziativa del datore di lavoro o in accordo tra le parti, misure o soluzioni ulteriori dirette al perfezionamento e all’integrazione dell’obbligo di sicurezza. La trattazione si snoda attraverso le «buone prassi», quali atti unilaterali del datore di lavoro, le misure inserite e negoziate all’interno di una intesa contrattuale, prevalentemente a livello d’azienda, nonché i modelli organizzativi, frutto di una scelta libera e insieme “necessitata” del datore di lavoro. L’Autrice si sofferma sull’esatto raccordo con l’art. 2087 c.c., posto che le soluzioni migliorative, unilaterali o contrattate, e i modelli organizzativi sono considerati misure per adempiere l’obbligo di sicurezza. La rilevanza degli strumenti menzionati induce a riflettere sulle conseguenti implicazioni giuridiche e a verificarne la diffusione in altri Stati membri. L’analisi comparata è, in particolare, volta a mettere in luce i meccanismi partecipativi e le sedi di confronto e di promozione della formazione di regole in azienda per la tutela della sicurezza sul lavoro.
