Abstract:
The relationship between a country's political decision-making and top military leadership is central, but also debated. Not least whether the military side should take political life into account and to what extent one should become a part of it. This essay aims to increase the understanding of the challenges of the military-political relationship, focusing on the borderland between peace and war that is usually described as a gray zone. Through scenario-based interviews with senior officials and politicians within the Swedish government and government office, it is investigated what impact a gray zone problem can have on the military advice provided. By combining a future scenario with interviews, an empirical material unique to the research field is created. The results show that the gray zone affects the strategic decision-making process, but not really by adding any completely new challenges, but mainly by strengthening and partly developing existing ones. The logic of peace, rather than war, on strategy should therefore form the basis for how the gray zone is viewed from a decision-making process perspective. The gray zone's character of ambiguity creates and reinforces tensions between different actors in the strategy process, which in turn risks delaying strategic decisions. The ambiguities arise mainly in three areas: the view of the strategic problem, the political consequences and the organization that will deal with the gray zone. Some of the ambiguities are amplified by the opponent, while others are more the result of internal factors. In order to reduce the negative effects of the gray zone problem, a much closer integration between the military and politics is proposed than in peacetime: policy-making must take place jointly and traditional boundaries need to be redrawn. The key is spelled relationships and these must be created and maintained in good time before the gray zone enters.

This dissertation examines how changes in training after Vietnam altered the Air Force’s way of war. Specifically, the rise of realistic training exercises in the U.S. Air Force, particularly in the Tactical Air Command, after the end of the Vietnam conflict in 1975 ushered in a drastic increase in the use of tactical fighter aircraft to accomplish Air Force missions. Many scholars, including Benjamin Lambeth and Richard Hallion, have emphasized the primacy of technological developments in the renaissance of air power between Vietnam and the Gulf War. This neglects the importance of developments in training in the Tactical Air Command during the same period. This dissertation demonstrates that throughout the 1970s and 1980s Air Force leaders reconsidered some of their long-held assumptions about air power’s proper use and re-cast older ideas in ways that they considered more realistic and better justified by past experience. Realistic training exercises led to better tactics and doctrines and, when combined with technological advancement, changed the way the Air Force waged war. Tactical assets became the weapons of preference for Air Force planners for several reasons including their ability to precisely deliver munitions onto targets and their ability to penetrate and survive in high-threat environments. Tactical assets could accomplish these missions precisely because of the changes that occurred in training. At the same time, the rise of tactical assets to equality with strategic assets directly led to the demise of both Tactical Air Command and Strategic Air Command and the creation of the single Air Combat Command. The conventional view that a massive technological revolution in military affairs took place in the 1980s and led to success in Desert Storm is conceptually too limiting. That interpretation places too much emphasis on the technological advancements used to prosecute war and slights the experiences of the airmen themselves in the development of the training exercises that helped change how the U.S. Air Force waged war.

History
Ph.D.
This dissertation explores the development of America’s infantry forces between 1918-1945. While doing so, it challenges and complicates the traditional narrative that highlights the fierceness of the rivalry between the U.S. Army and Marine Corps. During the First World War, both commissioned and enlisted Marines attended U.S. Army schools and served within Army combat formations, which brought the two closer together than ever before. Both services became bonded by a common warfighting paradigm, or way of battle, that centered upon the infantry as the dominant combat arm. All other arms and services were subordinated to the needs and requirements of the infantry. Intelligent initiative, fire and maneuver by the smallest units, penetrating hostile defenses while bypassing strong points, and aggressive, not reckless, leadership were all salient characteristics of that shared infantry way of battle. After World War I, Army and Marine officers constructed similar intellectual proposals concerning the ways to fight the next war. Although there were differences in organizational culture, the two were more alike in their respective values systems than historians have realized. There was mutual admiration, and targeted attempts to replicate each other’s combat thinking and spirit. They prepared for battle by observing each other’s doctrine, and sharing each other’s conception of modern combat. When preparation turned to execution in World War II, they created solutions for battlefield problems that evolved from their near-identical way of battle. At the conclusion of the war, the common bonds between the Army and Marine Corps were all but forgotten. This, ultimately, led to increased friction during the Congressional defense unification battles in 1946.

Eastburg, Amy J. "Assessing the dose after a radiological dispersal device (RDD) attack using a military radiac instrument." Thesis, Georgia Institute of Technology, 2010. http://hdl.handle.net/1853/39604.

Full text
Abstract:
The detonation of a radiological dispersal device (RDD) may result in casualties receiving exposure of radioactive materials. Assessments of potentially contaminated personnel are necessary to determine the level of contamination received in order to prioritize and treat individuals. The use of improvised explosive devices (IEDs) and the number of orphan sources in deployed and combat areas such as Iraq, present an opportunity for terrorists to use an RDD against deployed ground forces. There is limited capability in Iraq to assess radiological casualties, as the process of obtaining and analyzing bioassays is time consuming and not readily available in country. Military units are equipped with AN/VDR-2 and AN/PDR-77 radiac detectors which are capable of detecting gamma radiation. Therefore, a study of the use of these radiac sets in assessing internal contamination was conducted. A model of the detector probe was created using the Los Alamos National Laboratory Monte Carlo N-Particle transport code, MCNP Version 5. This model was experimentally validated and used in conjunction with both reference male and reference female computational Medical Internal Radiation Dose (MIRD) phantoms to compute internal dose. The instrument model was evaluated at the following locations, the posterior upper right torso, the anterior upper right torso, the lateral upper left thigh and the anterior of the neck. Nuclides were distributed throughout the phantoms using the Oak Ridge National Laboratory Dose and Risk Calculation (DCAL) software for inhalation pathways. Based on the likelihood for use in RDDs and the capabilities of the instrument, Co-60, Cs-137 and Ir-192 were evaluated.

Perkins, Jennifer L. "Effects of Military Training Activity on Red-cockaded Woodpecker Demography and Behavior---AND---New Territory Formation in the Cooperatively Breeding Red-cockaded Woodpecker." Thesis, Virginia Tech, 2006. http://hdl.handle.net/10919/35054.

Full text
Abstract:
The red-cockaded woodpecker (Picoides borealis) is a federally endangered species. As such, populations need to be increased in order to achieve recovery goals outlined by the U.S. Fish and Wildlife Service. My thesis is composed of two chapters that represent opposite sides of this issue. The first chapter investigates whether military training activity negatively affects red-cockaded woodpeckers. Military installations in the southeastern United States contain several of the largest remaining red-cockaded woodpecker populations. Six of the 15 installations harboring these birds are designated primary core populations; thus, population increases on these sites are critical to recovery of the species. However, restrictions on military training activity associated with red-cockaded woodpecker protection are a cause of concern on military installations that sometimes constrains management for population growth. Current restrictions are based on assumptions of potential impacts rather than scientific evidence, so we evaluated two different restriction regimes to test for training activity effects. The second chapter concerns how to induce populations to grow more rapidly through natural processes. As a cooperative breeder, red-cockaded woodpeckers preferentially compete for existing breeding positions and queue in the form of helping or floating to obtain a breeding vacancy, rather than create new territories. I used 20 years of demographic data collected as part of a long-term monitoring study of red-cockaded woodpeckers to investigate mechanisms that stimulate territory creation in this cooperatively breeding species.

Abstract:
Introduction: This study rescued the reconfiguration of the School of Nursing, Red Cross Branch State of São Paulo (EECVB-HSPA) in the years 1940-1945, of which was a propagator of the military model of education in nursing, characterized by disciplined and hierarchical relationships the knowledge and practice of nursing. Objectives: This study aimed to: discuss elements that configure the games of power, knowledge and truth in the formation of EECVB - FESP; analyze pedagogic device that fostered nursing education and its effects on the constitution of the modes of subjectivity in women pupils; analyze the relations of power / knowledge and the production of modes of subjectivity of the subjects in teaching offered by EECVB-HSPA and discuss aspects of current legislation at the time, as well as their impacts on nursing education and the military model of education that school. Method: We chose the framework proposed by Michel Foucault, based on the discursive statements of media and documentary sources, that support the study, enabling us to questioning and analyzing the findings and brought to light the relations of power-knowledge in field training of nurses in EECVB-HSPA. According to this framework, the researcher of history seeks to unveil what is laid, launches other questions about the obvious that sometimes go unnoticed in everyday life. The sources used were composed of matter and conveyed newspaper advertisements in the newspaper A Gazeta, published articles in the journals of the Brazilian Red Cross and documents own EECVB-HSPA. Taking as an object of study the discourses that emerge from these sources on nursing education, the analysis focused on the articulation and circulation of knowledge-power relations in contemporary pedagogical context. Results and discussion: The 1940s was a watershed period in Brazilian history, especially the early years by movements ensejadas the Second World War (1939-1945) and his immersion in a dictatorial policy named Novo (1937-1945) State. Among other professions, nursing was present in the machinery of intertwined power of government force at the time, leveraging strategies that realocavam and reaffirmed the role of women in society, either as a mother, wife and daughter, ie the caregiver. The list of documents examined in the light of the proposed reference amounts to a discursive web that on the one hand, and updates justifies the importance of nursing education in the period and the possibilities of emancipation of women into public space. The data also revealed that linked to a lack of autonomy, there were representations made by the nurse-EECVB FESP pervaded by the ideals of altruism and selflessness, which required low complexity of scientific knowledge for practical actions in the context of care faced by professionals the times and spaces in which traditionally worked. In the legal context of the time, it was observed that the laws on nursing education reinforced the military model of training of nursing and therefore gave emphasis on discipline and hierarchy. Conclusion: The sources analyzed, especially in the media perspective of the time not only veiculavam information, opinions and comments about the girls / women / nurses, but made up statements that can be problematized, as prescribed forms to do, learn, teach and above, of being and understanding the world, so mustering an effective pedagogical machinery of governance of education of nursing, with strong emphasis on conduct and disciplining of the corpus of nursing. The military model of training of nurses EECVB-HSPA is a picture of the interest of the State of New transforming the woman-nurse in careful, dutiful, docile mother, but servile as orchestrated by male domination.

Full text
Abstract:
The measurement of stress hormone levels in wild free-living animals is becoming an increasingly effective method for examining proximate mechanisms of animal behavior and the physiological impacts of human activities on wildlife. In these studies I measured plasma levels of the stress hormone corticosterone in the endangered red-cockaded woodpecker (Picoides borealis) to determine their role in the reproductive behavior of individuals in this species, and whether they are affected by human disturbance. In chapter one, I provide an introduction to the vertebrate stress response and I describe the natural history of the red-cockaded woodpecker. In chapter two, I compare corticosterone and reproductive hormone levels between breeding males and helper males to examine hormonal mechanisms of reproductive suppression in helper males. No hormonal differences existed between breeding and helper males. However, baseline corticosterone levels were lower in all males living in groups with two or more helper males, suggesting that male helpers reduce the workload of all other group members. In chapter three, I compare corticosterone levels between birds living in clusters subject to two different training restriction regimes on a military installation. Males living in clusters without training restrictions had lower baseline corticosterone than those living in clusters with training restrictions, suggesting that males habituate to chronic disturbance by downregulating baseline corticosterone levels.

Nováky, Niklas I. M. "The deployment of European Union military operations : a collective action perspective." Thesis, University of Aberdeen, 2016. http://digitool.abdn.ac.uk:80/webclient/DeliveryManager?pid=230696.

Full text
Abstract:
The thesis works towards a new theoretically informed framework of analysis for understanding the deployment of military operations launched in the framework of the European Union's (EU) European Security and Defence Policy (ESDP). This multi level collective action approach is based on the assumption that the deployment of those operations is a highly complex process that cuts across different policy making levels from the national to the international and involves multiple actors from within and outside the EU. As a result, the thesis argues that we cannot understand the reasons behind their deployment adequately by focusing only on a single level of analysis. The thesis then develops a more holistic approach for understanding the deployment of ESDP military operations based on three different levels of analysis: firstly, the international level, where the emergence of events that threaten certain values catalyses the process leading to an operation; secondly, the national level, where EU member states formulate their national preferences towards prospective deployments based on utility expectations; and thirdly, the EU level, where the member states come to negotiate and seek compromises to accommodate their different national preferences towards a deployment. The strength of the framework is demonstrated through four case studies. These are EUFOR Althea in Bosnia and Herzegovina, Operation Artemis and EUFOR RD Congo in the Democratic Republic of Congo (DRC) and the anti-piracy naval operation EUNAVFOR Atalanta off the coast of Somalia. The thesis will also provide an overview and critique of the existing theoretical literature on the deployment of ESDP military operations.

Abstract:

Breeze, John. "Design validation of future ballistic neck protection through the development of novel injury models." Thesis, University of Birmingham, 2015. http://etheses.bham.ac.uk//id/eprint/5739/.

Full text
Abstract:
The primary aim of this thesis was to develop more acceptable methods of ballistic neck protection that could replace the existing OSPREY ballistic neck collar. Clinical and post mortem injury analysis, computed tomography interpretation and ergonomics assessments were undertaken, resulting in the recommendation of two prototype designs to the Ministry of Defence. These two prototypes have subsequently been renamed the Enhanced Protection Under Body Armour Combat Shirt and the Patrol collar, and are now issued to all UK armed forces personnel deploying on operations overseas. The secondary aim of this thesis was to develop methods to validate the potential medical effectiveness of future body armour designs. Two new novel injury models have been developed using an anthropometrically accurate three- dimensional representation of cervical anatomical structures. Penetration of representative fragment simulating projectiles through skin and muscle was determined experimentally using physical and animal simulants. The Coverage of Armour Tool is being used in the current Ministry of Defence VIRTUS procurement programme to rule out future body armour designs on medical grounds, thereby greatly reducing the number of prototypes requiring ergonomics assessment.

Morrison, Jonathan James. "Resuscitative endovascular haemorrhage control in wartime injury." Thesis, University of Glasgow, 2014. http://theses.gla.ac.uk/5669/.

Full text
Abstract:
Non-compressible haemorrhage from within the torso and junctional regions constitutes the leading cause of potentially preventable death on the battlefield. It can be defined as haemorrhagic shock arising from injury to named torso vessels, pulmonary parenchyma, high grade solid organ injury and/or disruption of the bony pelvis. Data from the US Department of Defence Trauma Registry demonstrate a torso injury rate of 12.7% with 17.1% of casualties exhibiting torso injury and shock. The overall mortality is 18.7%, with major arterial injury and pulmonary injury identified as independent predictors of mortality on multivariate analysis. The UK Joint Theatre Trauma Registry reports similar findings with the greatest burden of mortality occurring prior to hospital admission (75.0%), a rate that has remained unchanged over a decade of war. Injury from improvised explosive devices (IEDs) in particular are associated with non-compressible haemorrhage, frequently causing traumatic lower extremity amputation in combination with torso injury. Contemporary surgical strategy relates to early operative haemorrhage control in patients presenting with shock. In patients sustaining a circulatory arrest, resuscitative thoracotomy and aortic cross clamping can be used to control inflow and increase cardiac afterload. The UK experience over 5 years at Camp Bastion demonstrated a mortality of 78.5%, with greatest survival observed in patients with the shortest time to thoracotomy. In patients sustaining lower extremity amputation following IED injury, 1 in 5 require a laparotomy for proximal vascular control, with less than half requiring further intra-abdominal intervention. There is a pressing need for a haemorrhage control and resuscitation adjunct in non-compressible haemorrhage that can be deployed prior to or as an adjunct to operative haemorrhage control. Resuscitative endovascular balloon occlusion of the aorta (REBOA) is a technique that can occlude the aorta without the need for an operating theatre. It is an experimental technique, so its effect on survival and physiology is unknown. In a porcine model of uncontrolled pelvic haemorrhage, infra-renal REBOA was shown to be as effective as chitosan gauze in the setting of normal coagulation. However, REBOA was associated with a significantly greater survival in a coagulopathic setting. Similar results were obtained when using a porcine model of abdominal haemorrhage in conjunction with thoracic REBOA. In both studies, balloon occlusion demonstrated a significant improvement in systolic blood pressure and other haemodynamic measures compared to the no-occlusion control groups. Having demonstrated a survival and haemodynamic benefit in uncontrolled haemorrhage models, the metabolic and inflammatory consequences of thoracic REBOA were characterised in further detail using a porcine model of controlled hypovolaemic shock. Occlusion for 30 and 90 minutes was associated with a significant lactate burden when compared to animals undergoing shock alone. However, following resuscitation with blood and intravenous fluid, normal physiology was restored within 6 hours. The inflammatory sequelae were studied following 30, 60 and 90 minutes of shock and occlusion. Increasing occlusion time resulted in an escalating release of interleukin-6 which manifest clinically as an increase in ARDS and need for vassopressor support. In order to develop a fluoroscopy free REBOA system, a series of human studies were undertaken to examine the relationship between an external measure of torso height and aortic length in order to guide insertion length. A retrospective examination of computed tomography in male trauma patients demonstrated a correlation between torso height and aortic length. This was confirmed by a prospective study which was also used linear regression to develop equations predictive of insertion length. Finally, the UK Joint Theatre Trauma Registry was used to determine the need for REBOA in a population of UK military personnel injured over 10 years of conflict. Of 1317 severely injured patients 70.2% had no indication, 11.2% had a contra-indication and 18.5% had an injury pattern indication for REBOA. Of those with an indication for REBOA, 66 (27.0%) patients died en-route to hospital and 29 (11.9%) died in-hospital. In conclusion, non-compressible haemorrhage constitutes a significant burden of potentially preventable battlefield mortality. REBOA is a technique that can be used in the thoracic or infra-renal aorta as a haemorrhage control and resuscitation adjunct, prior to operative haemorrhage control. While associated with a significant survival advantage in models of uncontrolled haemorrhage, it is associated with a significant metabolic penalty, although with resuscitation this can be ameliorated successfully.

Abstract:
The diploma thesis describes the design and assessment of steel structure of the roofing of the military museum in Králíky. The supporting structure of hall is 40.00 meters span. The total layout are 55.93 x 72.04 m, building height 11.43 m, 16.11 m pylon height. Main construction material is steel, grade S355, secondary constructions are made from steel grade S235, rods are made from steel grade S460. I did optimization of steel structure and chose the best option. For this option I made detailed structural analysis. It is prepared by static analysis of the main load-bearing parts of the structure, including joints and details. The supporting structure of hall consists in the transverse direction from the curved spatial lattice structure made of steel circular tubes which hang on rods on a sloped pylon. Part of the report is open-air roofing.

Abstract:
Low Intensity Conflict (LIC) is a significant feature of the contemporary world and it is a particular challenge to the armed forces of many states which are involved is such conflict, or are likely to become so. This thesis is not concerned with how such difficult conflict situations arise. Rather it is concerned with how, from the point of view of the state, they may be contained and ultimately brought to a satisfactory resolution. The work is thus concerned with the practicalities of ending LIC. More specifically, the purpose of this research is to establish a framework of doctrinal and military principles applicable to the prevention and resolution of LIC. The principles of this thesis are based in numerous historical examples of LIC and six in depth case studies. These distilled principles are analysed in two central chapters, and are then applied in two latter defence force chapters so as to ensure there practicality and resilience. Numerous defence academics and military practitioners have been consulted in the production of this thesis; their contribution has further reinforced the functionality of the principles examined in this research. The research illustrates the criticality of a holistic approach to LIC. The function of this approach is to guarantee the stability of the sovereign state, by unifying civil, police, intelligence and military services. The effectiveness of the military elements must also be ensured, as military force is central to the suppression of LIC. Consequently, the research makes strategic and operational prescriptions, so as to improve the capability of defence forces that are concerned with preventing or resolving LIC.

GREER, KIRSTEN ALETTA. "RED COATS AND WILD BIRDS: MILITARY CULTURE AND ORNITHOLOGY ACROSS THE NINETEENTH-CENTURY BRITISH EMPIRE." Thesis, 2011. http://hdl.handle.net/1974/6698.

Full text
Abstract:
“Red coats and wild birds: military culture and ornithology across the nineteenth-century British Empire” investigates the intersections between British military culture and the practices and ideas of ornithology, with a particular focus on the British Mediterranean. Considering that British officers often occupied several imperial sites over the course of their military careers, to what extent did their movements shape their ornithological knowledge and identities at “home” and abroad? How did British military naturalists perceive different local cultures (with different attitudes to hunting, birds, field science, etc.) and different local natures (different sets of birds and environments)? How can trans-imperial careers be written using not only textual sources (for example, biographies and personal correspondence) but also traces of material culture? In answering these questions, I centre my work on the Mediterranean region as a “colonial sea” in the production of hybrid identities and cultural practices, and the mingling of people, ideas, commodities, and migratory birds. I focus on the life geographies of four military officers: Thomas Wright Blakiston, Andrew Leith Adams, L. Howard Lloyd Irby, and Philip Savile Grey Reid. By the mid-nineteenth century, the Mediterranean region emerged as a crucial site for the security of the British “empire route” to India and South Asia, especially with the opening of the Suez Canal in 1869. Military stations served as trans-imperial sites, connecting Britain to India through the flow of military manpower, commodities, information, and bodily experiences across the empire. By using a “critical historical geopolitics of empire” to examine the material remnants of the “avian imperial archive,” I demonstrate how the practices and performances of British military field ornithology helped to: materialize the British Mediterranean as a moral “semi-tropical” place for the physical and cultural acclimatization of British officers en route to and from India; reinforce imperial presence in the region; and make “visible in new ways” the connectivity of North Africa to Europe through the geographical distribution of birds. I also highlight the ways in which the production of ornithological knowledge by army officers was entwined with forms of temperate martial masculinity.

Everyone knows that the terrible fire, but also often overlook the dangers of it.Many of the early constructed buildings of which the designs have become outdated in the change of time flow, and due to the illegal addition or part rebuild of these old buildings never been received fire security checks, so it can not be effectively in reducing fires. The analysis of fire statistics over the years found that residential fires accounted for an average annual rate of building fire up to 60%. Because of the high-temperature, smoke and a large number of toxic gases have broken many families and taken the precious lives. Therefore, this study utilizes Fire Dynamics Simulator (FDS) field model software to analyze Jhung-sing Shin Tsun military dependent’s Village fire. By studying temperature field, changes of the distribution and concentration field in fire scene as well as different parameters, and exploring the relationship between relevant parameters and the fire in order to understand the impact of various parameters on the staff to escape during a fire and provide a reference for fire protection engineering. The simulation results present that the change of materials will be more helpful for extending the time to escape from fire.

Bourhill, James F. "“Red Tabs” Life and death in the 6th South African Armoured Division, 1943 – 1945." Thesis, 2014. http://hdl.handle.net/2263/43290.

Full text
Abstract:
The thesis seeks to understand, first and foremost, what the members of the 6th South African Armoured Division in Italy during the Second World War experienced in their day-to-day lives on campaign. It is therefore primarily a social history. Although an exhaustive analysis of the demographics of the division is beyond the scope of this study, an attempt was made in Chapter 2 to identify some of the characteristics of the volunteers and their motivations for enlisting. Recruitment statistics and other sources show that in the final stage of the war, volunteers were most likely to be school-leavers and university students. Chapters three to eight detail the daily life in camp and on the road as the division progressed up the length of Italy. The main themes revolve around the necessities of life, recreation, leisure and ways of dealing with long periods of inactivity. The more controversial topics of sexuality, alcohol use, and battle fatigue are not avoided. Regardless of the capacity in which they served, all those attached to the 6th South African Armoured Division experienced the country and its people. Homesickness, discomfort and the fulfilling of basic needs was the common bond. Chapter nine examines the topic of casualties and what it reveals about the men and their experience. At first glance, it would appear that the casualty rate was exceptionally low for a front line division. However, on closer examination, the casualty rate was found to be in line with that experienced by other nations involved in the Italian campaign. As expected, it was found that casualties occurred mainly in infantry units, although accidents accounted for 25 per cent of injuries. In the final chapter, the conclusions are presented and discussed in a theoretical context. Memory is used as a category of analysis. Scholars are in agreement that distortion and cleansing occurred due to the tendency of contemporary accounts to accentuate the positive. The needs of post-war society also helped to ensure that the language and experience of the front line soldier was overwhelmed

Abstract:
This thesis analyses Germany's commitment to multilateral military operations. Following the research question why Germany participates in some multilateral military operations but not in others, Germany's respective decision-making process regarding troop deployment in the DR Congo in 2006 on one hand and military non-engagement in Libya 2011 on the other hand is traced. By contrasting the concept of strategic culture with a purely rational assessment of the factors of alliance politics, risk-analysis and military feasibility of the operations, the decisiveness of taking into account Germany's strategic culture to explain deployment decisions is stressed. Neither is there a lack of external pressure for German military participation in the case of Libya, nor is the military operation in the DR Congo decisively less risky or militarily more feasible. Rather, Germany's multilateral and anti- militaristic strategic cultural strands affect its decision-making. Next to demanding a thorough justification and legitimization of any military engagement, two red lines for military deployment can be identified. First, Germany refuses to act unilaterally and displays a high reluctance towards military engagement outside the multilateral framework of the UN, NATO or EU. Secondly, Germany rejects to engage in...

Abstract:
This thesis addressed the arms export control in the Federal Republic of Germany during the tenure of chancellor Helmut Kohl and Gerhard Schröder between 1989 and 2005. To this end this thesis elaborated an analytical framework, which analyses this phenomenon thought government arms export policy. Due to lack of preceding research in this area it was necessary to devote significant space for conceptual definition of the arms export policy and contextualization of analytical framework. It was argued that arms export policy of the Federal Republic of Germany should be analyzed as a passive sub-category within security policy. Analytical framework employed to analyze the period between 1989 and 2005 thus reflected four factors or standpoints that exert influence on arms export policy (foreign pressures, security policy, European coordination and legislative and institutional framework). This thesis designed as disciplined interpretive case study posited two hypothesis based on concepts that have been partially applied to arms export phenomenon in different context and time period. First hypothesis concerns the nature of change of arms exports control, which was supposed to change between periods restriction and relaxation of export control. Second hypothesis postulates the nature of change of arms exports...

Tyler, John. "A Pragmatic Standard of Legal Validity." Thesis, 2012. http://hdl.handle.net/1969.1/ETD-TAMU-2012-05-10885.

Full text
Abstract:
American jurisprudence currently applies two incompatible validity standards to determine which laws are enforceable. The natural law tradition evaluates validity by an uncertain standard of divine law, and its methodology relies on contradictory views of human reason. Legal positivism, on the other hand, relies on a methodology that commits the analytic fallacy, separates law from its application, and produces an incomplete model of law. These incompatible standards have created a schism in American jurisprudence that impairs the delivery of justice. This dissertation therefore formulates a new standard for legal validity. This new standard rejects the uncertainties and inconsistencies inherent in natural law theory. It also rejects the narrow linguistic methodology of legal positivism. In their stead, this dissertation adopts a pragmatic methodology that develops a standard for legal validity based on actual legal experience. This approach focuses on the operations of law and its effects upon ongoing human activities, and it evaluates legal principles by applying the experimental method to the social consequences they produce. Because legal history provides a long record of past experimentation with legal principles, legal history is an essential feature of this method. This new validity standard contains three principles. The principle of reason requires legal systems to respect every subject as a rational creature with a free will. The principle of reason also requires procedural due process to protect against the punishment of the innocent and the tyranny of the majority. Legal systems that respect their subjects' status as rational creatures with free wills permit their subjects to orient their own behavior. The principle of reason therefore requires substantive due process to ensure that laws provide dependable guideposts to individuals in orienting their behavior. The principle of consent recognizes that the legitimacy of law derives from the consent of those subject to its power. Common law custom, the doctrine of stare decisis, and legislation sanctioned by the subjects' legitimate representatives all evidence consent. The principle of autonomy establishes the authority of law. Laws must wield supremacy over political rulers, and political rulers must be subject to the same laws as other citizens. Political rulers may not arbitrarily alter the law to accord to their will. Legal history demonstrates that, in the absence of a validity standard based on these principles, legal systems will not treat their subjects as ends in themselves. They will inevitably treat their subjects as mere means to other ends. Once laws do this, men have no rest from evil.
