Full textThis paper is aimed at investigating the link between the regulation of migration for work reasons (both supranational and national) and the exploitation of the work of non-EU immigrants. In particular, this doctoral thesis aims to highlight the main critical aspects of the current legislation on the entry and stay of foreign workers in Italy, and the consequent effects that affect the legal and working conditions of non-citizens. Certain programming systems for access to the territory and to work may determine, strengthen and / or encourage irregular entries as well as the multiple forms of labour exploitation. Given this assumption, the ultimate goal is to discuss alternative models of regulation to entrances for work reasons that can finally bring the phenomenon of economic migration back to an interpretation that is not only utilitarian but also broader protection of the individual as a person, worker, migrant. The doctoral thesis is structured in four chapters. The first, dedicated to the supranational discipline of the phenomenon of economic migration, explores international regulation, with focus on its fragmentary and incomplete character. The perspective of the European Union is then examined, highlighting the main factors that have limited its action in the context of legal migration for work reasons. The second chapter investigates the national regulation of economic migration, highlighting the numerous criticalities and distorting effects it determines in the immigrant labour market. The conclusion reached is that the moment of access to work represents the main place in which the distorting effects of national migration policies are manifested. These effects can be identified, on the one hand, in the circumvention of the regulations related to entry and residence of the foreigner, and, on the other, in the spread of phenomena of labour exploitation. This analysis is followed by in-depth studies on the characteristics of the immigrant labour market and on the impact of the Covid-19 pandemic on the working conditions of foreigners. The third chapter deals with the exploitation of the labour of migrants in Italy and Spain in a comparative key. It moves from the assumption that migration represents a factor that facilitates exploitation. In particular, the latter is closely linked to the supranational and national regulatory framework of migration for work purposes in relation to both irregularly and regularly residing immigrant workers. It must be considered that the greater degree of vulnerability of irregularly residing immigrant workers derives primarily from the lack of a residence permit. Attention is then devoted to the phenomenon of “caporalato” and the illicit intermediation and exploitation of labour (art. 603-bis of the Criminal Code), examining its conditions (exploitation of labour and taking advantage of the state of need) and “symptomatic indices”, also through the examination of the criminal justice that has been used so far. Finally, the fourth chapter aims to identify a series of elements that could constitute a new "model" of management of economic migration with important implications on the regularity, working conditions and the process of integration and social inclusion of foreigners in the country of destination.

Full textMigrant populations experience poor health, and their outcomes tend to be poorer in comparison with the general population. Vulnerability and inequality are further exacerbated in undocumented migrants, as the most invisible to healthcare systems. This a public health challenge requiring tailored action towards universal health coverage and health system equity. Objectives: To estimate health needs among undocumented migrants in the areas of maternal & perinatal health and COVID-19; and to test a combination of methodologies for systematic monitoring and evaluation. Methods: This research is based on three retrospective studies (cohort and cross-sectional) using a combination of diverse and complementary data sources to reflect the complex nature of health outcomes and healthcare access in undocumented migrants, including: national/regional health management information systems, third sector healthcare provider health information systems, and surveys at selected healthcare facilities. Cohort: Undocumented migrants having accessed: (i) maternity healthcare through National/Regional Health Services in Lombardy Region (Italy) from 2016 to 2020; (ii) healthcare through a third sector healthcare providers in Milan (Italy) from February 24th to May 24th, 2020; (iii) healthcare through participating healthcare providers in Switzerland (Geneva Canton), USA (Baltimore City), Italy (Lombardy Region), and France (Paris Region) from February to May 2021. Results: (i) The study on maternal and perinatal health included 1595 undocumented migrant women and their neonates. 57.37% women had ≥4 antenatal visits, 68.21% the first one within 12 weeks of gestation, 63.45% at least two ultrasound tests including one within 12 weeks of gestation, and 6.21% complete laboratory tests. Total cesarean sections were 26.89%. Emergency neonatal resuscitation for birth asphyxia was conducted in 2.63% births, and 49.03% neonates initiated breastfeeding within 2 hours from birth. 80.56% pregnancies were physiological though severe hemorrhage (>1000ml) occurred in 2.26% women. Intra-uterine growth retardation affected 4.76% fetuses, 9.28% neonates were pre-term, 17.24% small for gestational age, 7.2% had a low weight at birth (<2.5Kg), 1.44% poor Apgar score, and 3.07% malformations. (ii) The study on COVID-19 illness included 272 undocumented migrants. Risk factors were frequent and included hypertension, immune depression, and prior close contact with COVID-19 cases. Presenting symptoms were worse, compared with patients with other respiratory conditions. (iii) The study on COVID-19 vaccination demand included 812 undocumented migrants. Overall, 14.1% of participants reported prior COVID-19 infection, 29.5% risk factors, and 26.2% fear of developing severe COVID-19 infection. Self-perceived accessibility of COVID-19 vaccination was high (86.4%), yet demand was low (41.1%) correlating with age, co-morbidity, and views on vaccination which were better for vaccination in general (77.3%) than vaccination against COVID-19 (56.5%) Participants mainly searched for information about vaccination in the traditional and social media. Conclusions: Health outcomes and healthcare access were poor in undocumented migrants. Socio-economic and health outcomes showed vulnerability and inequality in comparison to general population. Known risk factors including fragile socio-economic conditions along with legal and linguistic barriers to healthcare need to be addressed through tailored interventions including outreach health promotion focusing, healthcare provider training, cultural mediation, translation, and functional language learning. Furthermore, a systematic monitoring and evaluation system is needed to routinely collect, integrate, and analyze data on key indicators from both National/Regional Health Services in combination with ad hoc surveys for specific data outside routine information systems.

Full textThe international migrations are a process of movement of persons crossing borders of States. It is not a new phenomenon in the history of the man. What is different now is the magnitude and complexity of the phenomenon. This process has been both driven and facilitated by the globalisation of labour, commodity, and financial markets that has offered new incentives and new means for the international migration of people. The technical and cultural changes also help create both the means and the motivation to migrate. Migration plays a central role in current global processes of social, economic and political change; it is both moulded by and helps to mould these global transformations. For the destination countries immigration is key factor to managing the interconnections existing between the labour market, the efficiency and governance of globalised economy. With the decline in fertility, migration has taken on increased significance, becoming an important component of population growth in a number of countries and increasing the economical, social and cultural dynamism and innovation. States recognise the importance of managing the process in order to maintain their competitiveness in the global economy. For the most part, this involves distinguishing between highly skilled and low-skilled migrants. The former are seen as desirable and policies are designed to facilitate their movement, while the vast majority of the latter are excluded through legal obstacles that paradoxically try to go against the ‘globalising’ trends. The world pressure of the globalization and the demographic imbalance places in serious issue the urgency of an efficient legal regulation to manage the economic and forced migration. In the contemporary international community, it prevails, from the States, a suspicious idea of the International Law, as law of relationships between the States. Actually, the migration national and regional legal frameworks have succeeded only to fix restrictions on the movement of people across borders, without, however, building up a structure able to manage the phenomenon. While the global economy has succeeded to impose rules supporting the free circulation of goods and services, between the borders of the States, remarkable it is the deficit of the International Law carrying or regulates the free movement of the persons. Definitely, trend is totally contrary, with different justifications, as national and international security. In fact, the majority of developed countries adopted restrictive immigration policies that leading not to a reduction in migration, but rather to unintended and undesired outcomes, notably increase in people smuggling, trafficking and undocumented migration, at a significant and rising human cost. Failure to find mutual ways regulating migrations and protecting migrants leads to exploitation, social divisions and the weakening of the rule of law. While different States across the world have attempted to put measures in place to control the migration of people, these policies are based on a very limited understanding of migrants’ rights. The research is composed of three parts: it starts with the historical analysis of the international migrations from the XX° century, its relationship with the globalization process, the current state and highlights some of its emerging trends. The second part of research carry on analytical survey of the fragmented and copious migration international and regional laws, as result, principally, from the United Nations and regional organizations, like Council of Europe and European Union, to which an appropriate chapter is dedicated. The third part of study examine the security notion and it highlights the complexity of the issues, perspectives and requirements that have to be taken into account when dealing with the nexus of security and migration. The heightened concerns with foreigners and security in the post-9/11 era and its impact on the international migration laws are also investigated. The analysis of the emerging issue of the international and regional and global Inter-State consultation mechanisms in management of migrations phenomenon end the research.
