The monograph is devoted to the problem of formation and development of this branch of the division of hermeneutics as a political hermeneutics. Considered as the very origins of this hermeneutic stemming directly from the history of classical hermeneutics (Chapter 1) and its methodological principles (Chapter 2) and application characteristics (Chapter 3). It is from this triad (history — theory — practice) by the author and displayed the Foundation of political hermeneutics, which seems to them as the "deep method" study of the essence of the political elites and elitism and is characterized as a methodological division of lithologie to uncover the political "backstage" as the main sphere of professional activity of non-public elites. In the formation of hermeneutical understanding, it is important to clarify the internal relationship of this triad as a "language — word — text". The author consistently reveals the idea that language is expressed in the word exactly the same as the word in the text, which in turn is designed for disclosure in another language and in another word (in the "I — don't-Ya"). Designed for students and professionals; anyone interested in the problems of political consciousness and thinking of the elites.

Activists have exposed startling forms of labor exploitation and environmental degradation in global industries, leading many large retailers and brands to adopt standards for fairness and sustainability. This book is about the idea that transnational corporations can push these rules through their global supply chains, and in effect, pull factories, forests, and farms out of their local contexts and up to global best practices. For many scholars and practitioners, this kind of private regulation and global standard-setting can provide an alternative to regulation by territorially bound, gridlocked, or incapacitated nation states, potentially improving environments and working conditions around the world and protecting the rights of exploited workers, impoverished farmers, and marginalized communities. But can private, voluntary rules actually create meaningful forms of regulation? Are forests and factories around the world being made into sustainable ecosystems and decent workplaces? Can global norms remake local orders? This book provides striking new answers by comparing the private regulation of land and labor in democratic and authoritarian settings. Case studies of sustainable forestry and fair labor standards in Indonesia and China show not only how transnational standards are implemented “on the ground” but also how they are constrained and reconfigured by domestic governance. Combining rich multi-method analyses, a powerful comparative approach, and a new theory of private regulation, this book reveals the contours and contradictions of transnational governance.

This chapter discusses the task of methodology. How might a court ascertain the appropriate mode of review in a given security-liberty case, and how might the court effectively undertake that review? The chapter suggests a calibrated judicial review method that affords the government wide latitude in most national security matters, with courts adopting a posture of substantial deference. However, when the government claims pressing public necessity to legitimate measures that curtail fundamental liberties of citizens or noncitizens, careful judicial scrutiny takes over. With Korematsu as backdrop, the method delineates the mechanics for selecting the appropriate type of review in a given case. In doing so, it speaks to a judicial review conundrum generated by a briar patch of unexplained boilerplate language in numerous case opinions—opinions that first recite “the court’s substantial deference” to the executive on security matters, then follow with “but the court is duty-bound to protect constitutional liberties,” implicating careful scrutiny.

Abstract:
For patients with multilevel lumbar spondylosis and back pain without leg symptoms, few surgical procedures exist to provide relief of pain. Axial back pain has been attributed in part to pain generated at the facet joints. The lumbar rhizotomy has emerged as an effective method for treatment of axial lumbar back pain in these patients. By performing a limited surgical approach and using an endoscopic method, patients report quick recovery without the pain that typically follows a larger surgical approach. This method provides effective means of ablating the medial branch of the dorsal root, with limited side effects and complications. The history of selective root rhizotomy is discussed, with focus on medial branch neurotomy for treatment of back pain. An endoscopically assisted rhizotomy technique using a minimally invasive approach to the lumbar spine is described. This technique may be expanded for use in other parts of the spine.

This chapter discusses the differences between the federal and state judiciary. Many state judges are elected through a variety of mechanisms. The workload of state supreme courts has evolved over the years from a private-law orientation to more constitutional law and public policy kinds of cases. In addition, state courts exercise a number of nonadjudicatory powers such as rulemaking on practice and procedure before the courts and regulation of lawyers. Some state courts have the authority to issue advisory opinions and answer certified questions, and some of them have asserted certain inherent powers such as to require adequate funding levels. State courts also retain the power to develop common law doctrine, as well as to resolve disputes among state and local government officials and agencies in ways that rarely involve the federal judiciary. State courts are also not bound by the rigid federal doctrines of standing, mootness, and ripeness.

Transmesenteric portal access via mini-laparotomy may be used as a salvage technique when standard transjugular intrahepatic portosystemic shunt (TIPS) is unsuccessful due to difficult anatomy or portal vein thrombosis. This technique allows for precise determination of both the portal and the hepatic vein branch involved in the TIPS. This method usually involves the cooperation of a surgeon, who performs a mini-laparotomy and exposes a small bowel loop in the interventional suite. A mesenteric venous branch is then cannulated, providing direct access to the portal venous system. In distinction to standard technique, the hepatic parenchymal tract is created by a puncture from the portal vein into the hepatic vein. A guidewire advanced through the puncture needle is then snared from the hepatic vein, providing through-and-through access. The TIPS can be completed using standard techniques. Upon completion, the mini-laparotomy is closed by the surgeon.

The book presents a critique of what has come to be called “the method of cases”—theorizing on the basis of the “application” of words to cases—as well as of the recent debates between “armchair” and “experimental” philosophers concerning that method. It argues that the method of cases as commonly practiced by both armchair and experimental philosophers is underwritten by a “representationalist” conception of language that is philosophically challengeable and empirically poorly supported—a conception on which the primary function of language is to record and communicate “classifications” or “categorizations” of worldly “items,” or “cases”, where what, if any, classifications a word (or expression) is fit to record and communicate, is taken to be determinable apart from any consideration of how it normally and ordinarily functions in discourse. The first part of the book shows that both defenders of the method (Williamson, Cappelen, Jackson, Nagel, and others) and those who have been critical of it (Stich, Cummins, Weinberg, Nado, and others), together with all practitioners of the method—armchair and experimental alike—have shown themselves committed to some version or another of that conception. The second part of the book challenges that conception. Drawing on ideas of Wittgenstein’s and of Merleau-Ponty’s, as well as on empirical studies of first language acquisition, it presents and motivates, both philosophically and empirically, a broadly pragmatist conception of language on which the method of cases as commonly practiced by both armchair and experimental philosophers is fundamentally misguided and bound to lead us astray.

The first part of the article explores the obstacles that thwart theory, the second part describes features of our minds that work in our favor when it comes to practice. At the end it is suggested that the project of fully naturalizing our understanding of other minds — a project philosophers are bound to find enticing — is doomed. We understand others, but we cannot reduce this understanding to a branch of the natural sciences.

The very definition of “illusion” is elusive. Various distinct ontologies are considered. The concept is tightly bound to the understanding of reality, awareness, “God’s eye,” objectivity, subjectivity, emphatic relations, and several others. Here the distinctions between “illusion,” “ambiguity, “delusion,” and “deception,” are clarified. The very notion of illusion is closely tied to conceptual approaches to mind. Especially the dichotomy between a top-down “controlled hallucination” and a bottom-up “inverse physics” approach accounts for much confusion in the literature. It is suggested that a thoroughly biological approach might be preferable. In such an approach, experimental psychobiology would be a special sub-branch—devoted to the genus homo—of ethology. Does this help to impose a formal structure, such as a partial order, on the zoo of illusions as we know them? Unfortunately, not really. At this moment in history, we are still far from such a reasoned inventory.

This introductory chapter discusses the judiciary problems that may arise from the increasing number of multi-fora disputes in the international arbitration. International arbitration is widely considered to be the principal method of dispute resolution for international commercial disputes, which commonly involve multiple parties, contracts, and issues. The multiplicity of the subjects involved in the disputes often results in conflicts concerning the proper forum to be applied, and give rise to the question: if a national court renders a decision on the jurisdiction of the arbitral tribunal, would the arbitrators be bound by the prior decision, or could they decide anew whether they have jurisdiction? If the arbitrators are bound by a national court judgment, the parties’ arbitration agreement may be frustrated. On the other hand, if the arbitrators are not bound by the prior judgment and decide that there is a valid arbitration agreement, parallel court and arbitration proceedings may ensue.

Bleeding complications during percutaneous biliary intervention result from injury to the hepatic artery, hepatic vein, or portal vein. If bleeding originating from a hepatic artery branch is suspected, hepatic arteriography should be performed with and without the drainage catheter in place over a wire, and subselective embolization can be performed if a suitable target is identified. If a bleeding hepatic artery branch is not identified, bleeding from a portal vein branch is suspected. Treatment of portal vein injuries is challenging in this situation because obtaining direct percutaneous portal vein access is ill-advised. Although injuries to the hepatic artery or vein can often be treated by tract tamponade or arterial embolization, iatrogenic communication between the portal vein and biliary system can be difficult to treat effectively. This chapter presents a method to identify portal vein-to-biliary tract communications via cholangiography, with subsequent embolization via the transhepatic tract.
