Abstract:
This article compares several systems of administrative adjudication. In the U.S., adjudication is typically performed by the same agency that makes and enforces the rules. However, in Australia, almost all administrative adjudication is performed by the Administrative Appeals Tribunal [AAT], a non-specialized adjudicating agency, and several other specialized tribunals that are independent of the enforcing agency. These tribunals (which evolved out of concerns about separation of powers) have achieved great legitimacy. In the U.K., recent legislation [the Tribunals, Courts and Enforcement Act] merged numerous specialized tribunals into a single first-tier tribunal with much stronger guarantees of independence than previously existed. An upper tribunal hears appeals from the first tier and largely supplants judicial review. The article concludes by asking whether the U.S. could learn anything from the Australian and U.K. experience and suggests that a single tribunal to adjudicate federal benefits cases might be a significant improvement over the existing model.Cet article compare un certain nombre de systèmes de règlement judiciaire de différends dans le domaine administratif. Aux Etats-Unis, typiquement, le règlement de différends est effectué par la même agence qui établit les règles et qui les met en application. Toutefois, en Australie, presque tous ces règlements sont effectués par le Administrative Appeals Tribunal [AAT], une agence non-spécialisée de règlement de différends, ainsi qu‟un certain nombre d‟autres tribunaux spécialisés qui sont indépendants de l‟agence qui met les règles en application. Ces tribunaux (qui émanent de préoccupations au sujet de la séparation des pouvoirs) ont atteint un niveau élevé de légitimité. Au Royaume-Uni, une loi récente [la Tribunals, Courts and Enforcement Act] a fusionné plusieurs tribunaux spécialisés en un seul tribunal de première instance ayant des garanties d‟indépendance bien plus fortes qu‟auparavant. Courts and tribunals have distinct roles within the Australian administrative law system at the federal level, and to a lesser extent, in the states and territories. Questions of law are for the courts, and questions of fact are for the executive and tribunals. From time to time this orthodoxy is questioned. Suggestions are made that the courts are increasingly tending to intrude into the province of tribunals. Using cases as illustrations, this article explores five relevant jurisdictional areas —from appeals on a question of law to deference under the Administrative Decisions (Judicial Review) Act 1977 (Cth) s 10(2)(b)(ii)—to test the accuracy of the suggestion.

Abstract:
The concept of vaginal dysbiosis was for long considered synonymous with bacterial vaginosis (BV), which is characterized by a homogenous non-inflammatory vaginal discharge. The inflammatory variant of vaginal dysbiosis, called aerobic vaginitis (AV), has remained unknown to a large part of the global dermatology and venereology community, gynaecologists and reproductive tract infection specialists with consequential under diagnosis. AV significantly differs from BV, in clinical presentation, diagnostic criteria and management. The deleterious impact of untreated AV on pregnancy merits discussion. Understanding AV is also crucial for better comprehension of desquamative inflammatory vaginitis (DIV), the most severe form of the same entity. We review the condition’s epidemiology, risk factors and suspected aetiology, symptoms and signs, and the latest evidence-backed approach to diagnosis and treatment. The ideal diagnostic approach and treatment for AV/DIV are yet to be established. The currently recommended diagnostic approach for AV/DIV merits an overhaul by incorporating changes to render it feasible for resource-constraint countries. The diagnostic criteria lack a uniform applicability in different physiological groups of women and cannot be used in postpartum or postmenopausal states at the same cut-off levels. Similarly, treatment guidelines merit a relook, and customization, given the equivocality of options suggested by different investigators.

Under American rules, a very important factor for a court to consider when granting a preliminary injunction is the likelihood of success on the merits. To estimate this likelihood, the court must of course decide which legal provisions are applicable the parties’ dispute. And if the court errs in interpretation or application of those provisions, a party may successfully appeal to a higher court! As a result, the legal questions that must be answered to resolve the dispute on the merits are sometimes hotly and at great length discussed on the preliminary injunction stage, with appeals up to the highest-instance court. The ratios stated by higherinstance court in decisions on preliminary injunctions often become decisive when the dispute is resolved on the merits. Moreover, after the highest court ruled on a disputable issue of law in the preliminary injunction discussion, continuing the dispute may become redundant. Knowing the facts of the case (even if they are not yet formally established by a court) the parties often can easily understand who loses and who wins. After that it normally makes sense to settle out of court instead of wasting time and money for the process, the outcome of which is practically predetermined. Because of that many court orders granting or denying preliminary injunctions are far from being just “run-of-the-mill” ones. They may be very important for the ultimate outcome of the case and often contain detailed arguments on disputable issues of law, sometimes taking dozens of pages.

Federal habeas corpus challenges to state criminal convictions grew significantly between 1948 and 1996 when traditional de novo review was coupled with an expanding list of federal constitutional protections the Supreme Court made applicable to the states. The landscape changed dramatically in 1996 when Congress amended 28 U.S.C. § 2254 with the Anti-Terrorism and Effective Death Penalty Act. Old and new procedural barriers to habeas review were codified. Merits review of state court decisions became highly deferential. In a series of recent decisions discussed in this article, most notably Harrington v. Richter, 131 S. Ct. 770 (2011), the Court strongly expressed its frustration with the failure of lower courts to heed Congress' mandate. Federal courthouse doors are now closed to all but the rare case where there “is no possibility for fair-minded disagreement” the state court acted unreasonably (not just erroneously) in deciding the merits. Review becomes “doubly deferential” when the claim is one where deference is already owed in state court; most notably, challenges to the effectiveness of counsel and to the sufficiency of the evidence. Deference is owed even when the state court issues a summary merits decision without opinion.

Significant research efforts are directed towards finding new ways to reduce the cost, increase efficiency, and decrease the environmental impact of power-generation systems. The poly-generation concept is a promising strategy that enables the development of a sustainable power system. Over the past few years, the Proton Exchange Membrane Fuel Cell-based Poly-Generation Systems (PEMFC-PGSs) have received accelerated developments due to the low-temperature operation, high efficiency, and low environmental impact. This paper provides a comprehensive review of the main PEMFC-PGSs, including Combined Heat and Power (CHP) co-generation systems, Combined Cooling and Power (CCP) co-generation systems, Combined Cooling, Heat, and Power (CCHP) tri-generation systems, and Combined Water and Power (CWP) co-generation systems. First, the main technologies used in PEMFC-PGSs, such as those related to hydrogen production, energy storage, and Waste Heat Recovery (WHR), etc., are detailed. Then, the research progresses on the economic, energy, and environmental performance of the different PEMFC-PGSs are presented. Also, the recent commercialization activities on these systems are highlighted focusing on the leading countries in this field. Furthermore, the remaining economic and technical obstacles of these systems along with the future research directions to mitigate them are discussed. The review reveals the potential of the PEMFC-PGS in securing a sustainable future of the power systems. However, many economic and technical issues, particularly those related to high cost and degradation rate, still need to be addressed before unlocking the full benefits of such systems.

With the exception of an initial, somewhat disjointed commentary on Katherine’s cult, the Legenda aurea, and the vast topic of “Saints’ Lives in Medieval Literature,” the introduction provides a thorough and eminently readable survey of English versions of the St Katherine story, emphasizing other late Middle English prose texts and focussing especially on that in Southwell Ms 7. A concluding twelve-page description of the manuscript clearly merits the label “tour de force.” This carefully edited text is surrounded by helpful explanatory notes, glossary, bibliography, index of proper names, and index of words and forms with their frequencies.

Purpose Sediment measurement is usually accessible on a periodic or distinct basis. The measurement of sediment (suspended and bedload), especially in the field, is vital in keeping essential data of sediment transport and deposition. Various techniques for measuring sediment have been used over time each with its merits and demerits. The techniques discussed in this paper for suspended sediment include bottle, acoustic, pump, laser diffraction, nuclear and optical. Other techniques for bedload measurement are; River bedload trap (RBT), CSU/FU bedload trap, Helley–Smith, Polish Hydrological Services (PIHM) device, pit and trough, vortex tube, radioactive traces and bedload–surrogate technologies. However, the choice of technique depends on multiple factors ranging from budget constraint, availability of equipment, manpower and data requirement. The purpose of this paper is to present valuable information on selected techniques used in sediment measurement, to aid researchers/practitioners in the choice of sediment measurement technique. Design/methodology/approach This paper presents a general review of selected field techniques used in sediment measurement (suspended and bedload). Each techniques mode of operation, merits and demerits are discussed. Findings This paper highlights that each technique has its peculiar merits and demerits. However, two techniques are generally preferred over others; the bottle sampling and the Helley–Smith sampler for measuring suspended and bedload sediment. This is because the applicability of these techniques is quite widespread and time-tested. Originality/value This review paper provides an in-depth description and comparison of selected existing field sediment measurement techniques. The objective is to ease decision-making about the choice of technique, as well as to identify the suitability and applicability of the chosen technique.

The establishment of the Immigration Assessment Authority (‘IAA’) and the Fast Track Processing Regime for certain asylum seekers has posed new and important questions for Australian administrative law, especially in respect of the place, scope and effect of merits review. This article considers the early and formative jurisprudence of the federal courts in relation to ‘Fast Track decisions’ made by the IAA. It concludes that the Fast Track process represents a novel development in Australian public law: a partial review process which is not sufficient to correct the errors of the decision-maker at first instance but which appeared for a time capable of immunising elements of the decision from appeal or direct judicial review. It is, in its intention and current operation, more than a ‘targeted tinkering’ with the mechanics of merits review and of migration law in Australia. It deserves attention as it commences its journey through superior courts and as the regime settles into the Australian administrative law landscape.

Immunological response to SARS COV 2 is a major focus of discussion at present, from the perspectives of clinical presentation in patients, and prophylactic and therapeutic measures against the disease. A good understanding of the immunopathogenesis of the condition, and host response to the pathogen is pertinent for guiding effective treatment. In the current review, we discuss the essential concepts of neutralizing antibodies against SARS COV 2, elaborating on their mechanism of action, and their association, if any, in limiting the progression of the disease vis-à-vis in causing disease severity.

Hydroponics of fodder production allows to deliver on an industrial basis cultivation of high quality green forage. Merits and demerits of hydroponics are shown. Standardization of the "know-how" and hydroponic fodder quality is necessary to get the forage of preset properties. The basic attention in a review is given to quality indicators to be standardised and namely to organoleptic signs, dry matter content, metabolizable energy, crude protein, non structural carbohydrates. Terms and definitions of «hydroponic fodder» and its separate components are definately designated. On the basis of numerous sources it is established, that a content of the basic nutrients in hydroponic fodders are varying over a wide range: dry matter – from 100 to 400 g in 1 kg of a forage, crude protein — from 76 to 367 g/kg DM, crude fiber – from 168 to 228 g/kg DM, crude fat — from 19 to 76 g/kg DM, crude ash — from 17 to 107 g/kg DM. Such range of concentration of nutrients allows to form a quality gradation. Data of a zootechnical evaluation of hydroponic fodder in rations of various animal kinds are cited.
