Abstract:
This chapter considers the history of judicial review of the merits of arbitration awards in the courts of England. Topics discussed include arbitration before and during the nineteenth century; the English Arbitration Act 1979; the decision in The Nema, a case which concerned the possible frustration of a seven-voyage consecutive voyage charter due to a prolonged strike at the loading port; and section 69 of the English Arbitration Act 1996. The chapter concludes by referring to Lord Wilberforce’s parliamentary observation cited by Lord Steyn in Lesotho Highlands Development Authority v Impregilo SpA. The case raised an issue under section 68(2)(b) of the 1996 Act as to whether the arbitral tribunal had ‘exceed[ed] its powers’. The House of Lords held that an erroneous exercise of a power that was possessed was a mere error of law and not the same thing as acting in excess of powers that were not possessed; and that therefore the award could not be challenged. In the context of arbitration, the House of Lords was determined to allow no possibility that errors of law might be dressed up as decisions in excess of powers. That would have opened the floodgates to the opportunities for judicial intervention in the merits of disputes.

Judicial review is a procedure whereby the courts determine the lawfulness of the exercise of executive power. It is concerned with the legality of the decision-making process as opposed to the merits of the actual decision. Thus it is supervisory rather than appellate. This chapter discusses the supervisory jurisdiction of the courts, procedural reform, the rule in O’Reilly v Mackman, the public law/private law distinction, collateral challenge, and exclusion of judicial review. The procedure for making a claim for judicial review under the Civil Procedural Rules (CPR) 54 is considered.

Abstract:
The United Kingdom should now be understood as a counter-terrorist state, that is a state in which counter-terrorism law, policy, discourse, and operations are mainstreamed across the domains of law and government in forms that are conceptualised and designed as ‘permanent’ in at least some cases; in which non-state actors are responsibilised for counter-terrorism; and in which all persons are the subjects of counter-terrorism, although not to equal degrees. This book argues that counter-terrorism review—which it defines as the legal, political, and policy processes that consider the application and impacts of counter-terrorism law and policy in theory as well as in practice, with a view to assessing its merits and contributing towards its improvement—has the capacity to enhance accountability in the counter-terrorist state. Building on exclusive interviews with political actors and practitioners, as well as detailed empirical analysis of existing reviews—it presents the first comprehensive, critical analysis of counter-terrorism review in the United Kingdom. While this reveals substantial pockets of good practice, it also shows that the accountability enhancing potential of counter-terrorism review is limited in practice by executive domination, parliamentary limitations, persistent state secrecy, and the absence of trust in the counter-terrorist state.

This chapter is organized into five sections, focusing on issues addressed by tribunals and courts in 2012 related to Jurisdiction, Merits, Compensation and Non-pecuniary Remedies, Procedure and Annulment, and Enforcement of Awards. Section A discusses the grounds for jurisdictional challenge by respondents. Section B provides a summary review of the merits decisions of the past year, showing that the fair and equitable treatment standard remains a primary basis for the awards of tribunals, with a resurgence of decisions by tribunals accepting that investments were expropriated without compensation. Section C reviews the eight awards in which compensation was granted in 2012. Section D addresses questions of procedure that arose in 2012. Finally, Section E reviews the two International Centre for Settlement of Investment Disputes ad hoc annulment committee decisions of the past year, plus a number of domestic court decisions regarding the enforcement of awards.

Understanding the conditions under which the Supreme Court sets its agenda is crucial to understanding Supreme Court behavior. After all, before the justices make any decision on the merits of a case, they must first decide whether to hear it at all. This chapter analyzes Supreme Court agenda-setting. It begins by describing the process justices employ to select cases to review. It examines how parties file certiorari petitions, the certiorari pool used to provide guidance to the justices, and the conferences in which justices vote to grant or deny review to cert petitions. The chapter then discusses four explanations political scientists have provided to explain the conditions under which justices set the agenda. The article concludes by examining limitations of existing scholarship and providing suggestions for future scholarship.

The case presented the International Court of Justice with the possibility of reviewing the legality, or at least the legal effects, of a Chapter VII resolution of the Security Council in contentious proceedings brought by Libya arising out of its refusal to extradite two Libyan agents suspected by the US and UK of being responsible for the 1988 bombing of a Pan Am plane over Lockerbie in Scotland. The case did not reach the merits state but the earlier judicial stages, highlighted in this chapter, suggested that the judicial arm of the UN might have been prepared to review the actions of the executive arm.

Abstract:
Postcolonialism provides theoretical resources that speak well to the concerns of critical diversity scholars, notably the interest in culture, power, and the construction of (human) differences. Yet, with notable exceptions, there is a paucity of research on workplace diversity underpinned by postcolonialism. This chapter seeks to animate and advance postcolonial scholarship in critical diversity studies, and responds to calls to revitalize this scholarly sub-field. Based on a review of critical diversity studies (including the few that have used postcolonial perspectives), two recommendations are made to advance postcolonial critiques. First, critical diversity scholars might undertake a closer engagement with psychoanalytic and discursive variants of postcolonial theory to generate complex understandings of the psychological dimensions of (post)colonial subjectivities and the persistence of racism in organizations. Second, scholars might also consider the merits of ‘Southern Theory’ in order to move beyond the noted Eurocentric limits of existing gender and diversity research.

Abstract:
This chapter briefly recaps the findings of this volume, then addresses more general questions concerning the types of organizational patterns that researchers should expect to find, and the most fruitful approaches to understanding the origins and implications of those patterns. The authors review the PPDB data in order to assess the empirical applicability of various well-known ideal-types of parties. They find that only a minority of the cases in the dataset fit into one of these ideal-type categories—even when the bar is set low for such classification. It is argued that the ideal-type approach, while it has its merits, is less useful as a practical guide for empirical research than analytical frameworks based on the key dimensions of party organization—resources, structures, and representational strategies. The chapter closes by emphasizing the very real consequences that the organizational choices made by parties can have for representative democracy.

This book addresses the judicial review on social public policies, intending to propose a new approach to its exercise in Brazil, based on the standards and instruments consolidated in the structural remedies practice. The review approach championed by Brazilian courts creates illegitimate, anti-isonomic and ineffective decisions, which derives from the reliance on a traditional form of adjudication, bipolar and adversarial, that is inadequate to the polycentric and distributive features of the conflicts involving the delivery of public services by the government. Inspired on pioneering experiences in both foreign and domestic jurisdictions, the work outlines a theory of structural remedies applied to public policy issues that seeks to address the shortcomings of the mainstream approach, resulting in a paradigmatic shift in three main aspects of adjudication, regarding legal reasoning (distributive and dialogical), remedial practice (experimentalist, prospective and consensual) and the characteristics of the adjudication process (flexible and cooperative). Besides sustaining the merits of the described methodological shift, the author’s efforts are also aimed at formulating interpretative constructions to allow for its implementation in the Brazilian legal system. By exploring practical solutions towards a more legitimate and effective judicial review, and arranging them in a coherent theoretical framework, the book contributes to the academic debate and also gives valuable input to the public law practitioners entrusted with the duty to oversee the public administration activities in Brazil.
