Full text“Speaker according to the danger”, Beaumarchais was in the five trials in which he had to defend himself. The legal briefs that he published, for this purpose, borrow at the same time from the art of the playwright, the polemicist and the litigator. His eloquence gestures towards the theater through the use of dramatic forms, such as dialogue or scenes, and through the development of characters created from personalities of the opposing parties. Conversely, the factums were a field of stylistic exercises and constitute, as such, a background to the literary work. They shed light, for him, on an obsession with the law, which manifested itself, in the theater, by allusions to legal news, acclaimed by the public, by recognizable legal motives conforming to the procedures of the time, and by a staging of justice, which the playwright enriched with his personal experience.Beaumarchais taste for controversy is the other link between theater and legal briefs. We place the latter in the fray of the briefs poured into the bag by the adversaries of the procedure, and the libels which were broadcast on the sidelines of the trials, to which the playwright responded with new memoirs, with songs, but also in his plays and in his prefaces, placing his art of response under the dual patronage of Pascal and Voltaire. Beaumarchais, in his time, contributed to making the factum fashionable among the general public and to renewing the genre, by practicing the art of the point with a sort of excess, and by mixing legal reasoning, satirical discourse, forms of self-narrative and theater. His literary pleadings, noticed by his contemporaries, helped to blur the boundaries with other polemical writings, such as the pamphlet.Finally, Beaumarchais legal briefs link him to a movement for the renewal of eloquence, which spanned the 18th century, from Henri-François d'Aguesseau to Jean-Étienne-Marie Portalis, and which was notably demanded by aspiring lawyers to greater transparency of justice, to less erudite and more accessible eloquence, and to greater freedom of expression, like Joseph Michel Antoine Servan, Jean-Baptiste Mercier Dupaty, Simon-Nicola-Henri Linguet or Jacques-Vincent Delacroix , and by figures like Voltaire and Mirabeau. Full textThe subject of our doctoral thesis is the crisis of « Semana Santa », a military rebellion that triggered one of the most massive popular uprisings of the Argentinian Twentieth Century, April 16th and April 19th, 1987. This crisis penetrates the respective histories of the judicial system, the Army, the political parties, the media, the Human Rights Movement, in order to account for the complexity of the event. The thesis demonstrates how the popular mobilization was the result of a cultural transformation that involved all the actors mentioned, and that was pioneered under the new democratic regime founded in 1983. Our thesis is a methodological attempt to restore, in current historiography, the people as a political actor. For that purpose it is connected with the historiography of memory, to which it contributes the concept of “active memory” that allows to surpass the commemorative approach of the memorial phenomenon

Full textQuebec society, like all societies, has its own legendary crimes and criminals. Yet if these famous faits divers have been recently made into historiographical re-enactments, the cultural and historic manner in which they are transformed from local news reports into national myths – what we call mecanisms of “ légendarisation ” –, is practically unknown. It is this mutation that this thesis examines : drawing from four famous crimes of the 18th and 19th centuries (the Seigneur of Kamouraska’s murder [1839] as well as the crimes committed by “ La Corriveau ” [1763], by the “ docteur l’Indienne ” [1829] and by the “ brigands du Cap-Rouge ” [1834-1835]), our analysis recollects their two-hundred-year-long genealogy into collective memory. Through this collective memory, a complex discourse system arises for each crime : by intertwining newspaper reports and stories from oral and written traditions, social imagination manufactures great antagonist figures, incarnations of evil and avatars of the devil from ordinary criminal acts. This vast antagonizing process is in fact dependent on a whole epoch – the 19th century – where, in the western world, “ crime ” was suddenly placed at the heart of all social and political preoccupations. This era seemingly created a literary craze for crime, as well as a whole arsenal of specialized notions, ideas and technologies designed to understand, mesure and eliminate criminality. During the Lower Canada period, the phenomenon spreads across this side of the Atlantic. In the wake of this movement, the great criminals who impacted the collective mind are made to become especially rallying imaginary enemies : figures of a radical otherness, they become the foil against which Quebec society, from the 19th century onwards, instituted itself.
