Abstract:
Family and matrimonial contracts are often oral, unwritten and made without fear of breach. Consequently, spouses contribute both financially and non-financial towards the success of the marriage and acquisition of their matrimonial home. Often, the shared intentions of the spouses is usually to create a comfortable home for the family and each make indirect, invisible and unquantifiable sacrifices towards the success of the marriage. The State High Court is conferred with unlimited discretion in respect of matrimonial property and in exercising this discretion it often insists that a party must show evidence of substantial and direct financial contributions to the acquisition of matrimonial property before joint ownership of matrimonial property is inferred. Basically the library based research, is adopted in this article both the primary and secondary sources of law are cited. The findings of this article are: (1) Where there is a document of title in favour of one party to the marriage, that property is lost as a matrimonial property.(2) Where a party is insisting that the property in issue is jointly owned, that party is responsible for producing evidence to the effect that both parties contributed adequately to the acquisition of the said property, whether financially or otherwise.(3) Oral evidence, even, about the parties’ private arrangements cannot be allowed to contradict the content of document of title. This article recommends for a statutory definition of matrimonial property that will ingrain the socio-cultural norms and values regarding marital relations as a communal and partnership arrangement.

The other development under the justice and home affairs pillar of the Union relevant to European civil procedure is the so-called Brussels II Convention: the Convention on Jurisdiction and Enforcement of Judgments in Matrimonial Matters signed on 28 May 1998. This Convention continues the work of the 1968 Brussels Convention by extending similar principles to the field of matrimonial matters. The earlier Convention is seen as the general convention and the 1998 Convention as a lex specialis which follows the principles of the earlier Convention as far as possible.

Bolig, familieliv og hjemfølelse er historisk og kulturelt tæt knyttet sammen. I denne artikel er vi derfor interesseret i, hvad der sker med forholdet til boligen og med hjemfølelsen, når familien går i opløsning, og en eller begge parter flytter i forbindelse med en skilsmisse. Artiklen rummer dels en teoretisk introduktion til den internationale teori vedrørende bolig og hjemfølelse, dels en analyse af kvalitative interview med fraskilte om deres praktiske og følelsesmæssige forhold til deres bolig og hjem før og efter skilsmissen. Analysen peger på, at de følelsesmæssige bånd til en familiebolig kan forsvinde i dét øjeblik, beslutningen om en skilsmisse er truffet. Det praktiske arbejde med at etablere og indrette et nyt hjem kan blive en vigtig måde at søge ny identitet som enlig, og problemer med at finde et sted at bo, og deraf følgende midlertidige boliger, kan derfor gøre livet efter skilsmissen ekstra svært. Undersøgelsen peger endvidere på, at til trods for at mange fraskilte oplever det positivt at bo alene i en periode, så lever drømmen om kernefamilie og familiebolig videre. De fleste interviewpersoner giver således udtryk for, at de forestiller sig, at de på et tidspunkt etablerer en ny familiebolig med en ny partner. ENGELSK ABSTRACT: Kirsten Gram-Hanssen & Claus Bech-Danielsen: Divorce and Housing: Where does the Feeling of Being Home Move? House and home are historically and culturally closely connected to family life. In this article we investigate the ways in which the housing situation and the feeling of home are affected by divorce – when some or all members of the family move out of the matrimonial house. The article is based on an international literature review on the meaning of housing and home and on qualitative interviews of four men and five women in Denmark who were interviewed about their experiences with housing and home while being divorced. The article points out that emotional relations to the matrimonial house may disappear at the very moment the decision is made to divorce. It also points out that the practical work of creating a new home can play an important role in the process finding a new identity as a single parent. Many people find that life after being divorced is very difficult, when problems in finding a new house result in a number of temporary housing situations. Finally it is stressed that, even though many divorcees have positive experiences living alone, they never give up the dream of the nuclear family. Most of the interviewees picture themselves living in a new matrimonial house with a future partner. Key words: Housing, home, divorce, family, qualitative interviews.

RÉSUMÉDans le cadre de cette étude, nous examinons les répercussions de la situation de parent et de l'état matrimonial sur (1) les fondations des réseaux de soutien sociaux et (2) l'identité des personnes auxquelles on fait appel afin d'obtenir de l'aide pour accomplir ses activités quotidiennes. Les données proviennent d'entrevues structurées menées auprès de 678 personnes de 55 ans et plus vivant à leur domicile à London, en Ontario. Aux fins de l'analyse, cet échantillon compte une surreprésentation des personnes sans enfant, des célibataires (personnes jamais mariées) et des personnes divorcées afin d'assurer un nombre adéquat dans chaque catégorie. Nos résultats ont démontré que l'état matrimonial a une plus grande influence que la situation de parent en ce qui touche les différences dans les fondations du réseau de soutien social. Toutefois, dans le cas des formes d'assistance plus spécialisées, les personnes divorcées et les célibataires sont plus susceptibles que les personnes mariées, et les personnes sans enfant que les parents, de faire appel aux services de soutien formels et aux services d'aide professionnels, et moins portés à se reposer sur la famille. De plus, tant dans le cas de l'état matrimonial que dans la situation de parent, les résultats démontrent une importante interaction entre les sexes.

At the Justice and Home Affairs (JHA) Council meeting in Brussels on 2 and 3 October 2003 final political agreement was reached on a new and expanded version of the Brussels II Regulation, a text which has commonly become known as Brussels II bis. The instrument, which was adopted by the JHA ministers on 27 November, has now received formal classification as Council Regulation No 2201/2003 Concerning Jurisdiction and the Recognition and Enforcement of Judgments in Matrimonial Matters and Matters Relating to Parental Responsibility Repealing Regulation (EC) No 1347/2000.1 The net result of this precipitous reform is that Brussels JJ shall cease to have effect from 1 May 2005,2 a mere 4 years and 2 months after it entered into force. Henceforth there will be a single, integrated instrument which will cover, inter alia, the free movement of judgments in matters of parental responsibility as well as of matrimonial judgments and introduce provisions on cooperation between Member States.

Few lawyers would dissent from the view, voiced by the Law Commission in 1989 in their Report on Trusts of Land, that the trust for sale mechanism, introduced in 1926 to regulate the co-ownership of land, had for long ceased to be appropriate to the conditions of modern home ownership. Every conveyancing practitioner will have experienced the difficulty of explaining to clients about to marry that the matrimonial home which they were so eagerly looking forward to occupying would by law be owned by them as trustees, subject to an immediate binding trust for sale. No doubt in practice discretion played the better part of valour. Soon after qualifying, solicitors learned to abandon any attempt to explore the mysteries of such an apparent absurdity.

RÉSUMÉUtilisant les donnés du recensement canadien de 2001, nous examinons le rôle des préférences culturelles et des contraintes économiques sur la situation domestique des personnes âgées (vivre avec son enfant et/ou une personne apparentée versus vivre de façon autonome). Nos analyses révèlent que les membres de groupes ethniques partageant des valeurs familialistes (italien, chinois, sud-asiatique, et indien d’Asie) sont plus susceptibles que leur homologues individualistes (britannique, allemand, et néerlandais) de vivre avec un proche parent. Toutefois, l’importance des préférences culturelles et des contraintes économiques dépendent en grande partie de l’état matrimonial. Pour les personnes mariées, les préférences culturelles expliquent une grande proportion de la variation des situations domestiques. Pour ce qui est des personnes célibataires, les contraintes économiques sont plus importantes. En comparaison avec les études antérieures, où celles-ci négligent le rôle de l’état matrimonial, cette recherche contribue à une compréhension plus nuancée de la situation domestique des personnes âgées.

This dissertation will focus on common intention constructive trusts in relation to shared ownership of the family home predominantly in relation to unmarried couples. These trusts are particularly important because as opposed to married couples where the court may determine a couple’s financial and property issues upon divorce using the provisions of the Matrimonial Causes Act 1973, the position of unmarried couples is not covered by any legislation and so judges need to refer back to case law and property law in order to establish the equitable ownership of property.

AbstractThe dominant story of matrimonial property law reform in English Canada treats the farming family case of Murdoch v. Murdoch as the great catalyst for change, but there are persistent inequalities affecting farm women, even in provinces that have made progressive changes in the law of relationship breakdown. The farm is the quintessential family business and is both place of residence and source of income. Since the farm is not readily divisible, it is not surprising that all the major marital property law cases to reach the Supreme Court of Canada have involved farm property. What is surprising is that most provincial property reforms, though inspired by the Murdoch case, explicitly exclude farms from division, and those that include farms in the property to be divided still have mechanisms that tend to favour husbands. This article examines Canadian courts' gendered conceptualization of what constitutes a family business by examining the cases on farm property and the related legislative reforms. Feminists, and all women who have benefited from matrimonial property law reform, have an obligation to recognize the problems created by our persistent failure to understand the farm as simultaneously home and place of business.

RÉSUMÉEn se basant sur des données extraites d'une enquête menée au Canada, on a examiné la participation de 4 258 personnes âgées de 55 ans et plus à trois types d'activités: fréquenter des lieux publics, voyager et sortir. Les résultats obtenus à l'aide du modèle de régression OLS indiquent que les personnes sans enfants fréquentent des lieux publics ou voyagent aussi souvent que celles qui ont des enfants. Par contre, elles sortent plus souvent. On remarque aussi d'importantes différences selon le sexe, l'état matrimonial, l'état de santé et le niveau d'éducation des participants. Les résultats obtenus grâce au modèle de régression logistique indiquent que les personnes sans enfants sont plus portées à rechercher la compagnie d'autrui auprès d'amis et d'autres parents que les personnes qui ont des enfants. Le sexe et l'état matrimonial sont toutefois souvent de plus importants indicateurs du type de compagnie recherchée que ne l'est le fait d'être un parent. Nous concluons que les personnes sans enfants tissent autour d'elles des réseaux uniques de participation sociale qui leur permettent d'être actives socialement à l'extérieur de la maison.

Leslie Hall James was convicted, at Nottingham Crown Court on May 1 1979, of the murder of his wife, and sentenced to life imprisonment - a plea of provocation having failed. He had stabbed, punched and suffocated her following an argument. On the morning of the killing he had left work and gone to her home carrying a knife he borrowed from a colleague, he said, in order to cut a cork template. After killing her he went back to work returning again to the house during his lunch hour to change the locks. Later that afternoon he collected his daughter from school. The background to this killing was that Mrs James had left the matrimonial home in December 1978 and formed a relationship with another man (Mr Dutfield). The police had been called on several occasions to disturbances between Dutfield, the appellant and Mrs James.

Ownership of the family home is usually not disputed until either the relationship between the spouses or cohabitants breakdown or there is a competing claim over the property by a third party. In such circumstances, determination of ownership rights becomes imperative. The Matrimonial Causes Act 1973 gives the courts adjustive powers to deal with disputes between spouses on the breakdown of the marriage. Notwithstanding this, there may be circumstances where it will be necessary or desirable to determine property rights between spouses. Furthermore, the adjustive powers of the courts are not applicable to cohabitants. Thus, in the absence of legal co-ownership in the family home, cohabitants and spouses who cannot rely on the 1973 Act will have to establish an equitable interest in the property. The analyses relied on are primarily based on property law and trusts principles and, more particularly, imputed trusts and proprietary estoppel. Under trusts principles, imputed trusts are usually taken to refer to resulting and constructive trusts.

The law applicable to the matrimonial property regime under Regulation 2016/1103 governs all the property relations between the spouses and with regard to third parties including the rules providing for the protection of the family home. The choice of law rules of the Regulation are based on the principle of party autonomy and on the need to ensure the predictability of the applicable law, to the detriment of the links connecting the current situation of the spouses with the law intended to govern it. Against the background of an increasing cross-border mobility, the connecting factors of the objective conflict rule, fixed at the time of the conclusion of the marriage, prove to be unsuitable with regard to the protective rules of the family home whose implementation would command the application of the law having the closest connection to the real situation of the spouses. In this context, the exceptional mechanisms consisting in the escape clause and in the overriding mandatory provisions of the lex fori are also inadequate to ensure the effectiveness of the protective measures of the family home under the lex situs.

The generalization of the registration of baptism and marriage in the Catholic countries is shown to be the result of a process in which France used the authority of the Council of Trent to impose on the whole Church a system of public registration it had started to implement through temporal law at home in 1539, so that the clerics in charge of the registration be subject to canonical penalties if they failed to comply. The registration of baptism and marriage was integrated into the Decree on the Reformation of Marriage that France maneuvered to impose on the Church to curb clandestine marriages which had dire effects on estate planning in France, given the peculiarities of its inheritance and matrimonial law.

RÉSUMÉLes personnes âgées constituent, en proportion, la population la plus importante parmi les joueurs (Ontario Lottery and Gaming Corporation [OLG], 2012). Les joueurs célibataires seraient plus isolés socialement et solitaires (Dykstra & de Jong Gierveld, 2004), et plus susceptibles de s’engager dans le jeu, présentant ainsi des risques accrus pour le jeu compulsif (McQuade & Gill, 2012). Cette étude a examiné si des motivations sociales (jeu associé à la socialisation ou à la solitude) et le contexte social (sorties au casino avec des amis ou la famille) expliquent la relation entre le statut matrimonial et le jeu compulsif chez les personnes âgées. Nous avons aussi exploré si ces associations diffèrent en fonction du genre. Les données ont été extraites d’un échantillon aléatoire de 2103 adultes âgés de 55 ans et plus qui ont été contactés dans des sites de jeu du sud-ouest de l’Ontario. Ces données ont indiqué que le jeu en compagnie de la famille ou d’amis et le jeu associé à la solitude médient la relation entre le statut matrimonial et le jeu compulsif. Les personnes âgées célibataires étaient moins susceptibles de jouer avec de la famille ou des amis, comparativement aux aînés qui étaient mariés; ils étaient plus susceptibles d’utiliser le jeu pour contrer la solitude et leur profil de jeu était davantage compulsif. Les initiatives de prévention et de traitement devraient examiner les moyens permettant de diminuer la solitude et l’isolement social chez les personnes âgées, et offrir des activités sociales alternatives.

During the Second World War, the United Kingdom became an epicenter of transnational, especially transatlantic, marriages, but not all these marriages proved successful. As one disappointed English war bride on her way back home expressed herself, she was “Too shocked to bring her baby up on the black tracks of a West Virginia mining town as against her own home in English countryside of rose-covered fences.” This essay examines the government program developed to provide financial aid and legal advice to British women estranged from or abandoned by their American husbands from the passage of the 1944 Matrimonial Causes (War Marriages) Act to its winding down in 1950. The analysis draws upon a wide range of documents to survey the formulation and implementation of the government response and to consider some illustrative cases dealt with by British consular officials in the United States. These examples illuminate the gap between human behavior envisioned by policy-makers and the more varied behavior encountered by those who carried out the duties charged to them. The cases thus represent the nexus between state intervention and the individual experience of larger-scale social dynamics set off by war and the global movement of populations.

This paper considers the possible reform of the law governing property rights upon the termination of a close personal relationship, taking as its point of departure the Law Commission's Discussion Paper on Home-Sharing (2002). Having considered the reasons for the inconclusive outcome of the Law Commission's project (and the Discussion Paper's comments on the law of trusts), the paper moves on to consider the possible shape of future reform. It examines first the preliminary question of whether possible legislation should focus on unmarried cohabitees or whether a wider range of relationships should be encompassed (with or without a cohabitation requirement), The paper then looks at the form which a legislative scheme might take, examining the possibility of focusing on contributions (along the lines of New South Wales’ legislation) and the Law Society's proposals for a regime based on‘economic advantage and disadvantage’. The experience of the courts in the matrimonial context is considered with a view to extracting relevant lessons. In general, rather defending one particular model for reform, the paper attempts to identify and explore key issues which will be of relevance across a variety of approaches to reform.

The target population of the study consisted of all married Lecturers of Federal University Dutsin-ma Katsina State. Thus, purposive sampling techniques was adopted to target only married Lecturers. Sample of sixty four Lecturers were randomly selected. The instrument for data collection ‘Working Couples’ Utilization of Communication Strategies’ (WCUCS) was adapted from Makinde & Adebanyi (2019) A pilot test of the instrument of data collection was done and obtained Cronbach value of 0.67 which makes it adequate for this study. Results show that there is significant influence of verbal and non-verbal Communication Skills on marital stability among married Lecturers of Federal University Dutsin-ma; There is significant influence of burnout experience at work on couple’s use of communication skills at home; There is significant influence of couple’s length of marriage on their utilization of communication skills; There is no significant gender difference of the influence of working couples communication skills on marital stability among married couples. Recommendations were made thus: Married couples should spare time within their matrimonial home to talk about pleasant and unpleasant issues before sleeping and married couples are strongly encouraged to be open and use verbal and non-verbal communication that can foster marital stability.

The other 11 person-were included into the age groups of 40–49, 50–59 years.2.The reasons of autoaggressive behaviour: Suicide attempts owing to divorce, ideas of matrimonial incorrectness - 52% (32 person).Owing to the unfair attitude from the nearest environment or a dissatisfaction with behaviour and personal qualities of significant another - 48% (30 person). Age features: For young age - unavailability of young spouses to home life, absence of tolerance and respect to each other. Average age group - a dissatisfaction with behaviour of the partner. The senior age group - somatic diseases, loneliness, loss of relatives 3. In 66% of cases (41 person) suicide had no in the anamnesis of mental diseases at relatives.ConclusionsThe primary goal at rendering the psychotherapeutic help - revealing and correction of non adaptive installations of the person. Formation of confidential and empathic attitudes in family. It has been confirmed correlation analysis between partners′ satisfaction attitudes, personal characteristics suicident. It is necessary to raise availability of the information on various aspects of sexual health, psychohygiene of intimate relations.

L'état de tous les patients a été évalué avant que ces derniers ne soient placés par le Service de co-ordination du placement. De plus, leurs dossiers informatisés ont servi à constituer la base de données de l'étude. Au cours des sept années, 25 pour cent des patients sont morts dans des maisons de santé, des maisons pour personnes âgées et des maisons d'hébergement; tandis que 50 pour cent des patients sont morts après avoir été placés dans des centres pour malades chroniques. Environ 10 per cent des décès ont eut lieu au cours de la première année qui a suivi le placement dans des maisons d'hébergement, des maisons pour personnes âgées et des maisons de santé; tandis que 25 pour cent des patients sont morts au cours de la même année dans des centres pour malades chroniques. Le sexe semble jouer un rôle important dans la survivance de l'ensemble des patients. Par contre, l'âge au moment du placement, l'état matrimonial, l'ambulation, les conditions de vie, l'endroit où ils vivaient comparativement à celui où ils se trouvent et le fait que l'endroit où ils devaient être placés et celui où ils sont ne font qu'un, semblent avoir moins d'impact sur le taux de survivance. Il semble y avoir un lien entre le niveau de mémoire des patients au moment où ils furent placés et leur survivance dans des maisons de santé. En effet, les hommes « sans mémoire » et les femmes « sans mémoire » ou affichant un état de « confusion marquée » ont survécu plus longtemps que ceux ayant une mémoire dite « normale «.

In Cameroon we are dealing with three types of marriage: traditional, universally practiced marriage; civil marriage, required by state law before entering into a religious marriage; and, finally, sacramental marriage. Most widespread is the traditional form of contracting marriage. This article will present this particular form, referring to Gidar traditions and also showing its similarities to, and differences from, the Christian tradition brought by the missionaries. It will also propose solutions which combine the two traditions. A characteristic feature of marriage rites was their multi-stage nature. They were not single acts but events long prepared and celebrated with suitable gestures, symbols, words, and events. The individual, successive stages of “taking a wife” consisted of the choice of a spouse, accepted by both families; an engagement period; an act by both families of acknowledgement of the joining of the young persons as one in marriage; the conveying of the bride to her husband’s home; celebrating; and paying the matrimonial fee. The Church in northern Cameroon recognized traditional marriages contracted outside of baptism as valid and licit, provided that local principles, e.g., payment of a marriage fee, were taken into account. If either of the parties accepted baptism, the marriage became for him or her sacramental. If the other party also made the same decision later on, their union took on a sacramental character, without a need to renew the marriage vows. Controversy would however arise if attempts were made to contract a traditional marriage if one party was [already] baptized, or if both parties were baptized. These controversies mainly concerned the unity, indissolubility, and sacramentality of marriage.

Iranian literature, like other literary works throughout the world, follows the social issues in society and attempt to depict them. One of such issues is portraying women position in the society. The present study focuses on three different novels by Iranian female writers to show three stages of female writing development in them based on Elain Showalter’s theory of gynocriticism: Feminine stage which is represented through concepts like home, immovability, consumption, reading, house chores, dependence and past, feminist stage dealing with concepts like mobility, production, independence and future, and female stage that presents a new awareness of women consciousness. The chosen works are: Hangover Dawn (1995) by Fataneh Haj Sejed Javadi that portrays the tragic life of a woman who insisted on marrying a person who is not a suitable match for her. The author has shown the pains that this woman has to suffer because of her wrong choice in patriarchal society. The next novel is titled Don’t Worry (2008) by Mahsa Moheb Ali which deals with the life of an addicted girl named Shadi. She is the main character whose life is corrupted by family issues. Shadi wanders throughout the streets to find drug and ironically herself. My Bird (2002) by Fariba Vafi shows the life of an anonymous married woman who is stuck in her matrimonial life. The woman is neglected and cheated by her own husband. However, gradually she can come to a realization of her own self as a woman and redefines her own role. Having analyzed these three stories, it can be said that these three chosen novels match Showalter’s model of female writing development. It can be concluded that Hangover Dawn follows the first stage – feminine stage - Don’t Worry follows the second stage – feminist stage – and My Bird follows the third stage – female stage – that Showalter has proposed.

Marriage in Islam is more contractual ('aqd') in nature than ceremonial or sacramental. This esteemed tie-up of spouses conveys legal rights and obligations to each spouse. The fabric of society is made up of family institutions. Islam places high value on establishing a balanced, well-behaved relationship between spouses for a happy home. Islamic jurisprudence considered its primary purpose to be to make intercourse lawful and to legitimate the resulting offspring in a matrimonial contract. For its formation, specific competency is required, including physical and intellectual. Islamic law defined the jurisprudential basis for marriage capacity and pended its determination on interpretation. It concerns gender, age, mental capacity, religion, relationship with each other, marital status, etc. The ultramodern way of life and the advancement of technological and scientific achievements have introduced alarming changes in family relationships also. Lack of a jurisprudential approach to marriage leads to imbalanced marriage contracts and results in disturbed marital life as well as for the children, the future generations. A jurisprudential approach to marriage contracts will resolve present contemporary issues such as child marriage, forced marriage, and polygamy. The current study looks at marriage competency through the lens of Islamic injunctions. It emphasizes the fundamental regulations governing the legality of marriage contract. This paper examines the legal capacity for marriage and outline the requirements for a marriage contract to achieve its true objectives. It also leads to increased success factors in marriage and fewer breakdowns in Pakistan. Furthermore, this study also analyzes the contemporary juridical approach to the marriage contract. It, finally, brings recommendations to review the marriage laws of Pakistan. This paper follows qualitative and descriptive research methodology along with an analytical research method.

The standard terms of the bank, where a man got a loan for the restoration of the matrimonial home (where he also had his architect's firm) he was the sole proprietor of, obliged the spouse to grant security for the loan. The architect's wife made no objections. At the time of the conclusion of the whole transaction, she was 32, mother of a young child, owed two already several times charged pieces of land and got only a low income as employee in the bureau of her husband. After several delays in payments on the loan, the bank terminated the loan and called upon the wife as guarantee as the man was not able to repay. The editors of this journal made an interesting choice by taking the Vorlagebeschluss from the 29th June 1999 as case to be annotated. This not only because of the - at least - strange end of the affair, but mostly because of the style and form of the decision itself. The decision provides, like a real textbook, a complete overview of the different opinions concerning the Sittenwidrigkeit of contracts of suretyship of the IXth and the XIth Civil Chambers of the Bundesgerichtshof. After discussing the German Law, it will be investigated how (vulnerable) sureties can try to avoid liability under French, Belgian, Dutch, English and Scottish Law. The present standpoint in France upon this matter stems from the so-called Macron-case of the Court de Cassation of the 17th June 1997, which introduced the delictual libaility of banks that demanded "manifest disproportionate" sureties. Since then, French sureties are better protected than at the time when it was only possible to obtain annulment of the contract of suretyship for a defect of consent. In Belgium sureties still have to take the hard way and proof a defect of consent in order to get relief of a null contract. It will be considered therefore if sureties cannot profit from the latest case law-evolution on the contractors' duties in the precontractual stage.

ONE OF THEOED'S DEFINITIONSof the word “freak” is that of a freak of nature, “a monstrosity, an abnormally developed individual of any species; a living curiosity exhibited in a show.” The freak of nature I wish to focus on in this essay is marriage, and specifically, marriage as it is “exhibited” in Dickens's novelThe Old Curiosity Shop(1840–41). To refer to marriage in a Victorian novel as a freak of nature is perhaps surprising. To refer to the sacred institution as freakish in a Dickens novel may seem to border on heresy. After all, Dickens is the self-appointed novelist of hearth and home, the creator of conservative domestic plots that celebrate marriage as the institution that establishes closure for the novel and for the society it represents. Despite this apparent conservatism and despite our vague sense that most marriages in Dickens are as happy as David and Agnes's, Esther and Allen Woodcourt's, Biddy and Joe's, it is in fact the case that in all his novels, fromThe Pickwick PaperstoOur Mutual Friend, Dickens is fascinated–in a multiplicity of ways both large and small, in a manner that is alternately comic, tragic, melodramatic, ironic–with marriage's discontents. In fact, the disintegration of the institution is one of the things that Dickens makes fictions from, giving the failure of marriage a surprisingly high degree of visibility and presenting the breaking of the matrimonial bond with remarkable clarity and persistence. Dickens novels are full of wives who leave their husbands (Edith Dombey, Lady Dedlock, Louisa Gradgrind), breach of promise suits (inPickwickandOur Mutual Friendmost famously) and characters who try to find legal ways of escaping their marriages (Stephen Blackpool, Betsey Trotwood,Nickleby's Madame Mantalini). THE decisions of the House of Lords in Barclays Bank plc v. O'Brien [1994] 1 A.C. 180 and CIBC Mortgages plc v. Pitt [1994] 1 A.C. 200 sought to balance the legitimate commercial interests of banks and other lenders against the rights of spouses (usually, and hereafter for purposes of exposition, wives) or cohabitees in residential property, where the wife had been induced to accede to the transaction by the borrower's undue influence, duress or misrepresentation. This balance, necessary, in Lord Browne-Wilkinson's words, so that “a law designed to protect the vulnerable does not render the matrimonial home unacceptable as security to financial institutions”, was largely to be achieved by application of the doctrine of notice. A wife could therefore successfully resist attempts to recover possession where the bank had actual, constructive or imputed notice of her equity to set its charge aside. Constructive (and imputed) notice begs two questions: when will a bank be put upon enquiry, and what level of enquiry will be reasonable? O'Brien indicated that a bank should warn the wife, in a personal interview, of the amount of potential liability she was undertaking, of the risks involved, and of the desirability of obtaining her own independent legal advice. Experience since O'Brien has shown a reluctance by banks to conduct personal interviews, which would, they feel, carry greater risks. The practice adopted has been to refuse to complete the loan transaction until the wife has in fact obtained independent legal advice, proof thereof being made by the production of a certificate to that effect to the lender. The eight conjoined appeals in Royal Bank of Scotland v. Etridge (No. 2) [1998] 4 All E.R. 705 consider, at great length, the meaning and significance of “independent legal advice” in this context, and its consequential impact on the enforceability of security by a bank. Rather like O'Brien, Etridge seeks to provide clear guidelines and to facilitate a workable banking practice so that the likelihood of litigation against banks is substantially reduced. Where O'Brien failed, Etridge may well succeed. At its most basic level, it is good news for banks, and very bad news for solicitors.

But for an extraordinary order for a division of the joint estate stante matrimonio under section 20 or 21 of the Matrimonial Property Act 88 of 1984, the default joint estate of spouses married in community of property will come to an end with the demise of the marriage. This is either with the death of the firstdying spouse or by an order of the divorce court. It is impossible to extend the joint estate beyond these moments. With the end of the joint estate, the erstwhile spouses (or the estate of the demised spouse) are entitled to claim half of the value of the erstwhile joint estate. If the parties are unable to reach an amicable agreement to this end, a liquidator will be appointed to finalise the division of the assets. As from the end of the marriage, the former spouses have separate estates. Any new acquisition, gift, inheritance or income acquired after that date falls into the newly founded separate estate of the holder, and the other party has no claim to share in these assets. In Koko v Koko the respondent was married in community of property to Mr Koko in 1979 but that marriage ended in divorce by court order in 2001. The respondent left the previous marital home that was registered as joint property in the names of both spouses and retained inter alia some movable property from the erstwhile joint estate. Mr Koko remained in the house and continued to pay all rates and taxes, and the outstanding debt secured by a mortgage bond was amortised by the time of his demise. He later married the applicant and the couple lived in the house until his demise in 2013. Only years later did the respondent claim half of the current value of the immovable property as the still-registered co-owner. In this contribution, attention is devoted to the justifiability of the premise of the court that the claim should succeed notwithstanding the fact that more than nineteen years had lapsed since the applicable joint estate ended with the divorce order and the claimant did not contribute to the current unencumbered value of the property. If the claim to half of the value of the former joint estate is categorised as a personal right of the claimant, it is submitted that the effect of extinctive prescription should have been considered. By default, a debt is extinguished after three years and just the listed categories of debts mentioned in section 11(a) of the Prescription Act, including a judgment debt, will prescribe only after 30 years. It is submitted that the division of the joint estate is a natural consequence of the end of the marriage in community of property, and in KwaZulu-Natal orders for a division of the joint estate of parties married in community of property are consistently refused when divorce orders are granted for the very reason that they are unnecessary. In the absence of an applicable court order, the relevant debt cannot be defined as a “judgment debt” and the default prescription period governed by section 11(d) of Act 68 of 1969 should apply. It is inequitable that a previous spouse may, more than nineteen years after the divorce, benefit from the subsequent enhanced value of an asset that formed part of the erstwhile joint estate at the cost of another, who had contributed to that currently enhanced value of the asset since the joint estate came to an end. It boils down to unjustified enrichment if this is accomplished under the guise of her joint ownership of the immovable property still registered in the names of the former spouses as original co-owners because the real right of ownership is imprescriptible. A personal claim for half of the value of the assets in the estate would, however, have been prescribed after three years since the claim had vested.

O objetivo do presente estudo de cunho histórico é comparar e refletir através da ótica dos registros fotográficos as mudanças que a cultura matrimonial sofreu ao longo dos tempos, bem como evidenciar através da estética e das expressões faciais/corporais de noivos e noivas as transformações captadas pelas câmeras fotográficas e analisar as mudanças comportamentais entre as gerações de mulheres e homens, considerando a influência educacional. Com este intento, buscaram-se diversas fotografias de diferentes casais de duas cidades do interior do estado de São Paulo que se casaram entre os anos de 1949 a 1981, assim como fotografias recentes de casais que se casaram entre os anos de 2009 a 2013. A pesquisa é de cunho qualitativo e trata-se de uma análise interpretativa. Foram utilizados para a realização do estudo a entrevista estruturada com perguntas abertas, bem como registros fotográficos fornecidos pelos próprios casais e pelas famílias dos casais já falecidos. É possível compreender através desses registros que as mudanças dos hábitos e costumes frente à instituição matrimonial demonstram as transformações de ser homem e ser mulher. Deste modo, evidencia-se que a fotografia funciona como um índice do que foi e do que é ser nubente em datas distintas. As desigualdades entre os registros em preto e branco e colorido confirmam que a sociedade hodierna está em constante transformação em seus hábitos e valores e isso também no que diz respeito à manifestação de afeto. With this intent we got several photographs of different couples from two cities in the State of São Paulo who got married from 1949 to 1981, as well as recent pictures of couples who got married between the years of 2009 to 2013. The research is of a qualitative nature and it is an interpretative analysis. It was used for the realization of the study a structured interview with open-ended questions, as well as photographic records provided by couples and the families of the deceased couples. It was possible to understand through these records that the changes of habits and customs vis-à-vis the institution of marriage demonstrate the transformations of man and woman. Thus, evidence that the photo serves as an index of what was and what is to be betrothed at different dates. The inequalities between the records in black and white and colored confirm that society today are in constant transformation in their habits and values and that too with regard to expressions of affection. Front of the exposed, is mister deep reflection about the importance of equitable relations between men and women, given that many changes are required in order to have a fair suit society and even-handedly in the sexism and misogyny are actually extinct.Keywords: Female Culture. Marriage and gender ratio Registros Fotográficos Matrimoniales: evidencias de las distinciones de género en diferentes épocas.RESUMENEl objetivo del presente estudio de carácter histórico es comparar y reflexionar a través de la óptica de los registros fotográficos las mudanzas que la cultura matrimonial sufrió a lo largo del tiempo, así como evidenciar a través de la estética y de las expresiones faciales/corporales de novios y novias las transformaciones captadas por las cámaras fotográficas y analizar las mudanzas comportamentales entre las generaciones de mujeres y hombres, considerando la influencia educacional. Con este intento, se buscaron diversas fotografías de diferentes parejas de dos ciudades del interior del Estado de São Paulo que se casaron entre los años de 1949 y 1981, así como fotografías recientes de parejas que se casaron entre los años de 2009 y 2013. La investigación es de carácter cualitativo y se trata de un análisis interpretativo. Para la realización del estudio, se utilizó la entrevista estructurada con preguntas abiertas, así como fotografías cedidas por las parejas y por las familias de las parejas fallecidas. Es posible comprender a través de dichos registros que las mudanzas de hábitos y costumbres frente a la institución matrimonial demuestran las transformaciones de ser hombre y ser mujer. De este modo, se evidencia que la fotografía funciona como un índice del que fue y del que es novio en fechas diferentes. Las desigualdades entre los registros en blanco y negro y colorido confirman que la sociedad actual está en constante transformación de sus hábitos y valores y ello también en lo que respecta a la manifestación del afecto. Frente a lo expuesto, es míster la reflexión profunda acerca de la importancia de las relaciones equitativas entre hombres y mujeres, haya vista que muchas mudanzas son necesarias de manera a tenerse una sociedad de hecho justa y equitativa en que el sexismo y la misoginia sea en concreto extintos.Palabras clave: Cultura Femenina. Desde os anos setenta do século passado, os estudos de mulher e de gênero trouxeram para o campo da historiografia ocidental, além das inúmeras provas das contribuições das mulheres para a cultura obliteradas ou distorcidas pela historiografia oficial, uma visão bem completa das estratégias de exclusão, apropriação, distorção e perseguição desse matrimônio, com o objetivo de perpetuar e justificar a visão do patrimônio cultural como superior, único e (quase) exclusivamente masculino. Repensar as funções e os funcionamentos altamente politizados que tiveram nos séculos XIX e XX as historias das literaturas nacionais e os seus cânones a partir do conceito de matrimônio abre o caminho para uma nova historiografia da cultura ocidental. Resgatar a imensa riqueza dos matrimônios locais e regionais da Europa medieval, bem como detectar as suas raízes, sua continuidade e permanência ao longo dos séculos, permitirão re-descobrir o outro Mundo, o outro projeto histórico que mulheres e seus aliados masculinos instauraram no mundo indo-europeu e continuam defendendo até hoje contra um patriarcado violento e hegemônico.

Abstract:
The recognition of and respect for the party autonomy of every legal subject of majority not limited by any personal cognitive handicap is part and parcel of the foundation of an orderly legal community governed by the rule of law. “Making rules of law discretionary or subject to value judgments may be destructive of the rule of law” (Bredenkamp v Standard Bank of South Africa Ltd 2010 4 SA 468 (SCA) 481E). The discretionary power of a divorce court under section 7(3) of the Divorce Act 70 of 1979 stems from before the current constitutional dispensation. Almost thirty years after the acceptance of the constitutional values of the current system, it was hoped that as time went by, the transitional exception dating to 1984 that exhibits clear elements of arbitrariness would be relied on with declining frequency. There is only a limited number of marriages still in existence concluded before November 1984 with an ante-nuptial contract providing for the proverbial “cold exclusion of all benefits” that could potentially at this late stage in the spouses’ lives be expected to end in the divorce court justifying a reliance on this section. The act limits the discretionary power to explicit conditions: it can be considered only where the divorce concerned a marriage concluded before the commencement of Act 88 of 1984 with an ante-nuptial contract that excluded accrual sharing and any form of asset sharing and in the absence of any agreement at any time between the erstwhile spouses regarding the division of their assets. Provided these conditions are met, the court can order that such assets, or such part of the assets of the other party as the court may deem just, be transferred to the first-mentioned party (s 7(3)). In all these circumstances a valid ante-nuptial contract exists to which both parties agreed in the presence of a notary public and the applicant in reality never acquired any claim to the other party’s assets. The applicant in addition represented to the other spouse, the notary public and the public at large a claim would never be made to any of the respondent’s assets. “Reasonableness and fairness are not freestanding requirements for the exercise of a contractual right. … Acceptance of the notion that judges can refuse to enforce a contractual provision merely because it offends their personal sense of fairness and equity will give rise to legal and commercial uncertainty” (Potgieter v Potgieter NO 2012 1 SA 637 (SCA) 650F-H). In Greyling v Minister of Home Affairs ((40023/21) 2022 ZAGPPHC 311 (11 May 2022)) the court regarded the upholding of the claim of the applicant contrary to the explicit misrepresentation by the applicant that she is in agreement with the terms contained in the notarially registered ante-nuptial contract of 1989 governing the marriage, potentially fair. The court ordered the first condition in section 7(3) of Act 70 of 1979, limiting its application to pre-November 1984 marriages, unconstitutional. This judgment may be popular and in line with what the woman in the street might regard as fair, presumably abandoning the principle of pacta sunt servanda as well as the principles underlying estoppel, but does not bode well for the upholding of the rule of law. “The court does not as yet sit, as under a palm tree, to exercise a general discretion to do what the man in the street, on a general overview of the case, might regard as fair” (Springette v Defoe 1992 2 FLR 388 391). It is argued that legal certainty will not be enhanced should the constitutional court confirm this judgment. An alleged reliance on principles or policy exclusively based on common law jurisdictions as justification for the recognition of such a discretionary power under these circumstances, without any consideration of the position under civil law systems which indeed share common roots with specifically the South African private law system is once more an example of the demise of our jurisprudence where legal professionals seem to be unable to do proper, relevant and reliable comparative legal research. Since the husband in the Greyling case did not even oppose the claim of his spouse (all prior to a divorce application) and chose to abide by the court’s decision, it is indeed strange that the court refrained from referring to and recognising that the parties could at any stage since 1989, have relied on section 21(1) of Act 88 of 1984 to have effected a change in their matrimonial property regime. It reeks of misuse of the court process for the court, under these circumstances, to hold as unconstitutional that part of section 7(3) as being the only possible remedy for the claimant against the perceived injustice she would be suffering on divorcing her husband because of their matrimonial property regime, is mind-blowing. The only benefit of not relying on section 21(1) would be to not be bound by the requirements contained in section 21(1)(a-c) – there are sound reasons for the proposed change; sufficient notice of the proposed change has been given to all the creditors of the spouses; and no other person will be prejudiced by the proposed change – and that would constitute misuse. Section 36(1)(e) of the constitution provides that the rights in the bill of rights may be limited but only in terms of a law of general application to the extent that the limitation is reasonable and justifiable in an open and democratic society based on human dignity, equality and freedom (party autonomy), taking into account all relevant factors, including less restrictive means to achieve the purpose. It is clearly not the case in instances like these.

‘DEDUCTIO IN DOMUM MARITI’ AND THE CONCLUSION OF A ‘IUSTUM MATRIMONIUM’SummaryAccording to the communis opinio the classical Roman law did not have a formal procedure of concluding a marriage, since its conclusion required only the mutual consent of a man and a woman (affectio maritalis, consensus). Nonetheless, the Roman culture developed a number of ritual acts related to the conclusion of a marriage, most of them deeply rooted in the Roman tradition and history and of great symbolic significance. The central moment of a wedding ceremony appears to be the deductio in domum mariti i.e. the ritual bringing of the bride to her husband’s house. The significance of this ritual is reflected in language since the expression uxorem ducere (“to lead a wife”) is the most common Latin expression for “to marry,” also in the legal sense, since according to some jurists when deductio in domum mariti had been accomplished, the couple was considered duly and legally married. The main function of the deductio was thus to give a proof that the marriage had been concluded and to manifest mutual affectio maritalis. Deductio in domum mariti played a special role when a marriage was concluded inter absentes (it seems that only the groom person could be absent and not the bride). In this case the formal deductio ceremony seems to have been an indispensable act constituting the only way in which the mutual affectio maritalis could be expressed. Since the bride’s procession to her new husband’s house was considered the public declaration of the consensus necessary to conclude a legal marriage, if the groom was absent such a ceremony was necessary as a proof that mutual affectio maritalis had been expressed and thus the marriage had been concluded. Nonetheless the necessity of leading the bride to her husband’s home in the case of a matrimonium inter absentes should not be confused with the constitutive character of deductio in domum mariti. Consensus still remained the only constitutive element and deductio in domum mariti was only the formal way in which this consensus had to be expressed in the particular circumstances.

Baseia-se na análise de um caso ocorrido em meados dos anos 1960 no rio Amônia, na região acreana do Alto Juruá. Após refletir sobre a história dos Ashaninka nessa região de fronteira do Brasil com o Peru e mostrar a necessidade de repensar alguns lugares-comuns sobre a vinda desse povo indígena para o Alto Juruá brasileiro, o texto apresenta a trajetória de dois grupos familiares que se instalaram no rio Amônia na década de 1940. Mostra a singularidade desse matrimônio interétnico, discute seus significados, para os brancos da região e para os Ashaninka, e apresenta seus efeitos políticos. Sustenta a tese de que esse casamento é fundamental para entender o protagonismo e a visibilidade política dessa comunidade indígena no campo do indigenismo nas últimas duas décadas.

Unique sources of historical, demographic, toponymic, and linguistic information, the mission registers (baptisms, matrimonial inquiries, marriages, burials, and census) of Baja California have been used in varying degrees to good effect by Carl Sauer, Peveril Meigs, Sherburne Cook, Homer Aschmann, and Pablo L. Martínez, among others. What is, alas, not so unique, but true of many parochial archives in Mexico, is the fact that until quite recently they were often left exposed to the elements, rodents, insects, and looters. Gerhard attempted to make an inventory of the known surviving registers in 1952-1953, when he found some of them totally unguarded and uncared-for. This work was followed by Woodrow Borah in the 1970s, and since 1971 Mathes has brought this calendar upto-date, and has obtained or personally produced microfilm of the entire corpus, including certain folios which have since disappeared. Here we shall summarize the tortuous history of the dispersal of these documents.

L’objectiu d’aquest article és estudiar alguns mots que formen part del vocabulari usat en les relacions en què està present la unió d’un home i una dona fora del matrimoni. Es tracta de conductes sexuals considerades a l’època desordenades o contràries a la norma social, i, per tant, a més d’estar tipificades com a delictes de naturalesa penal, els qui les practicaven, especialment les dones, eren marginats per la societat. En ocasions, el vocabulari es fa ressò d’aquesta major marginalitat de la dona. Aquest treball es basa en nou processos criminals valencians inèdits dels segles XVI i XVII sobre adulteri i concubinat. En l’estudi del vocabulari se segueix una metodologia historicocomparativa, que repassa la història dels mots seleccionats, des de la seua primera documentació coneguda fins la seua presència en els diccionaris normatius actuals. Així mateix, les veus catalanes se situen en el context romànic, comparant-les amb les d’altres llengües.

<p>Os contos de Marina Colasanti transitam entre o real e o fantástico alinhavando ações que conduzem as relações humanas e seus dilemas. Suas narrativas curtas são retiradas das experiências diárias para suscitar reflexões muito mais abrangentes, pois são entrelaçados de palavras e situações que desvelam o cotidiano e o comportamento exigido da mulher. A partir da análise dos contos “A moça tecelã”, do livro <em>Doze reis e a moça no labirinto do vento</em> (1982), e “Plano matrimonial”, de <em>Contos do amor rasgado</em> (1982), evidenciamos de que forma a autora constrói, metaforicamente, na tessitura narrativa a roupa masculina e o trabalho da tecelã para refletir acerca do empoderamento da mulher. Os contos têm em comum a relação heterossexual das protagonistas intermediada pelos trajes masculinos, que se revestem de simbologia e revelam, no contexto literário, a explanação do lugar social da mulher e do homem, visto como uma das linhas que alinhavam a vivência humana. Desse modo, Marina Colasanti tece na trama discursiva as redes de significações reveladoras do fazer e do ser feminino.</p>

Com isso, a ideia do artigo é trazer a temática do poder dentro dessa perspectiva, sendo escolhido o matrimonio como exemplo, já que o mesmo teve um forte papel de controle social, tendo o domínio- pelo menos de acordo com fontes religiosas- as condutas tanto dos homens quanto das mulheres; tocando na questão da sexualidade humana, de forma que à regulasse e julgasse; assim como também teve o papel de dar sustento ao sistema aristocrático medieval, pois alimentava os princípios de hereditariedade, das linhagens e dos títulos sociais. Portanto, elementos essenciais para a estruturação da Idade Média- incluindo a Igreja e o Estado- que se enraizaram tão fortemente no mundo ocidental, repercutindo até tempos atuais e em países como o próprio Brasil.

O artigo insere-se no campo da História da Educação, mais especificamente na história de instituições escolares. O objetivo da pesquisa foi compreender como o mito da mulher virtuosa, à luz do exemplo de Maria, transforma-se em rito na Semana Mariana do Colégio Juvenal de Carvalho para fomentar a educação feminina voltada para a preservação de valores morais que mantinham a mulher na esfera privada a serviço da família e do lar. Realizou-se uma pesquisa amparada teoricamente na história cultural, que adotou a história oral temática como metodologia. Utilizaram-se as narrativas orais de uma professora, irmã salesiana e do coordenador da Semana Mariana, coletadas por meio de entrevistas, como fonte de análise. Constatou-se que a Semana Mariana era um rito realizado, todo mês de maio, que, ao exaltar a figura de Maria como exemplo feminino a ser seguido, educava as moças para: a castidade, o casamento e a maternidade. Essa formação endossava o papel social atribuído à mulher de subserviência ao homem – pai e esposo – ao disciplinar seu comportamento para a obediência inconteste, restando-lhe, se não a vida religiosa, a união matrimonial com os afazeres domésticos e os cuidados com os filhos e com o esposo.
