Abstract:
Family and matrimonial contracts are often oral, unwritten and made without fear of breach. Consequently, spouses contribute both financially and non-financial towards the success of the marriage and acquisition of their matrimonial home. Often, the shared intentions of the spouses is usually to create a comfortable home for the family and each make indirect, invisible and unquantifiable sacrifices towards the success of the marriage. The State High Court is conferred with unlimited discretion in respect of matrimonial property and in exercising this discretion it often insists that a party must show evidence of substantial and direct financial contributions to the acquisition of matrimonial property before joint ownership of matrimonial property is inferred. Basically the library based research, is adopted in this article both the primary and secondary sources of law are cited. The findings of this article are: (1) Where there is a document of title in favour of one party to the marriage, that property is lost as a matrimonial property.(2) Where a party is insisting that the property in issue is jointly owned, that party is responsible for producing evidence to the effect that both parties contributed adequately to the acquisition of the said property, whether financially or otherwise.(3) Oral evidence, even, about the parties’ private arrangements cannot be allowed to contradict the content of document of title. This article recommends for a statutory definition of matrimonial property that will ingrain the socio-cultural norms and values regarding marital relations as a communal and partnership arrangement.

The other development under the justice and home affairs pillar of the Union relevant to European civil procedure is the so-called Brussels II Convention: the Convention on Jurisdiction and Enforcement of Judgments in Matrimonial Matters signed on 28 May 1998. This Convention continues the work of the 1968 Brussels Convention by extending similar principles to the field of matrimonial matters. The earlier Convention is seen as the general convention and the 1998 Convention as a lex specialis which follows the principles of the earlier Convention as far as possible.

Bolig, familieliv og hjemfølelse er historisk og kulturelt tæt knyttet sammen. I denne artikel er vi derfor interesseret i, hvad der sker med forholdet til boligen og med hjemfølelsen, når familien går i opløsning, og en eller begge parter flytter i forbindelse med en skilsmisse. Artiklen rummer dels en teoretisk introduktion til den internationale teori vedrørende bolig og hjemfølelse, dels en analyse af kvalitative interview med fraskilte om deres praktiske og følelsesmæssige forhold til deres bolig og hjem før og efter skilsmissen. Analysen peger på, at de følelsesmæssige bånd til en familiebolig kan forsvinde i dét øjeblik, beslutningen om en skilsmisse er truffet. Det praktiske arbejde med at etablere og indrette et nyt hjem kan blive en vigtig måde at søge ny identitet som enlig, og problemer med at finde et sted at bo, og deraf følgende midlertidige boliger, kan derfor gøre livet efter skilsmissen ekstra svært. Undersøgelsen peger endvidere på, at til trods for at mange fraskilte oplever det positivt at bo alene i en periode, så lever drømmen om kernefamilie og familiebolig videre. De fleste interviewpersoner giver således udtryk for, at de forestiller sig, at de på et tidspunkt etablerer en ny familiebolig med en ny partner. ENGELSK ABSTRACT: Kirsten Gram-Hanssen & Claus Bech-Danielsen: Divorce and Housing: Where does the Feeling of Being Home Move? House and home are historically and culturally closely connected to family life. In this article we investigate the ways in which the housing situation and the feeling of home are affected by divorce – when some or all members of the family move out of the matrimonial house. The article is based on an international literature review on the meaning of housing and home and on qualitative interviews of four men and five women in Denmark who were interviewed about their experiences with housing and home while being divorced. The article points out that emotional relations to the matrimonial house may disappear at the very moment the decision is made to divorce. It also points out that the practical work of creating a new home can play an important role in the process finding a new identity as a single parent. Many people find that life after being divorced is very difficult, when problems in finding a new house result in a number of temporary housing situations. Finally it is stressed that, even though many divorcees have positive experiences living alone, they never give up the dream of the nuclear family. Most of the interviewees picture themselves living in a new matrimonial house with a future partner. Key words: Housing, home, divorce, family, qualitative interviews.

RÉSUMÉDans le cadre de cette étude, nous examinons les répercussions de la situation de parent et de l'état matrimonial sur (1) les fondations des réseaux de soutien sociaux et (2) l'identité des personnes auxquelles on fait appel afin d'obtenir de l'aide pour accomplir ses activités quotidiennes. Les données proviennent d'entrevues structurées menées auprès de 678 personnes de 55 ans et plus vivant à leur domicile à London, en Ontario. Aux fins de l'analyse, cet échantillon compte une surreprésentation des personnes sans enfant, des célibataires (personnes jamais mariées) et des personnes divorcées afin d'assurer un nombre adéquat dans chaque catégorie. Nos résultats ont démontré que l'état matrimonial a une plus grande influence que la situation de parent en ce qui touche les différences dans les fondations du réseau de soutien social. Toutefois, dans le cas des formes d'assistance plus spécialisées, les personnes divorcées et les célibataires sont plus susceptibles que les personnes mariées, et les personnes sans enfant que les parents, de faire appel aux services de soutien formels et aux services d'aide professionnels, et moins portés à se reposer sur la famille. De plus, tant dans le cas de l'état matrimonial que dans la situation de parent, les résultats démontrent une importante interaction entre les sexes.

At the Justice and Home Affairs (JHA) Council meeting in Brussels on 2 and 3 October 2003 final political agreement was reached on a new and expanded version of the Brussels II Regulation, a text which has commonly become known as Brussels II bis. The instrument, which was adopted by the JHA ministers on 27 November, has now received formal classification as Council Regulation No 2201/2003 Concerning Jurisdiction and the Recognition and Enforcement of Judgments in Matrimonial Matters and Matters Relating to Parental Responsibility Repealing Regulation (EC) No 1347/2000.1 The net result of this precipitous reform is that Brussels JJ shall cease to have effect from 1 May 2005,2 a mere 4 years and 2 months after it entered into force. Henceforth there will be a single, integrated instrument which will cover, inter alia, the free movement of judgments in matters of parental responsibility as well as of matrimonial judgments and introduce provisions on cooperation between Member States.

Few lawyers would dissent from the view, voiced by the Law Commission in 1989 in their Report on Trusts of Land, that the trust for sale mechanism, introduced in 1926 to regulate the co-ownership of land, had for long ceased to be appropriate to the conditions of modern home ownership. Every conveyancing practitioner will have experienced the difficulty of explaining to clients about to marry that the matrimonial home which they were so eagerly looking forward to occupying would by law be owned by them as trustees, subject to an immediate binding trust for sale. No doubt in practice discretion played the better part of valour. Soon after qualifying, solicitors learned to abandon any attempt to explore the mysteries of such an apparent absurdity.

RÉSUMÉUtilisant les donnés du recensement canadien de 2001, nous examinons le rôle des préférences culturelles et des contraintes économiques sur la situation domestique des personnes âgées (vivre avec son enfant et/ou une personne apparentée versus vivre de façon autonome). Nos analyses révèlent que les membres de groupes ethniques partageant des valeurs familialistes (italien, chinois, sud-asiatique, et indien d’Asie) sont plus susceptibles que leur homologues individualistes (britannique, allemand, et néerlandais) de vivre avec un proche parent. Toutefois, l’importance des préférences culturelles et des contraintes économiques dépendent en grande partie de l’état matrimonial. Pour les personnes mariées, les préférences culturelles expliquent une grande proportion de la variation des situations domestiques. Pour ce qui est des personnes célibataires, les contraintes économiques sont plus importantes. En comparaison avec les études antérieures, où celles-ci négligent le rôle de l’état matrimonial, cette recherche contribue à une compréhension plus nuancée de la situation domestique des personnes âgées.

O declínio de casamentos, especialmente os religiosos, documentados em várias pesquisas sócio-demográficas, tem suscitado inúmeras indagações. Paralelamente a esse declínio, as uniões consensuais, que independem de vínculo civil e religioso têm aumentado e, no plano da vida cotidiana, expressam rompimentos com valores e normas tradicionais, tornando-se uma prática comum atualmente. Contudo, o fiel que contrai matrimônio na Igreja Católica e se separa do cônjuge fica proibido de participar plenamente das atividades da Igreja se constituir nova união. Entretanto, nem todo casamento católico é válido. Para verificar a validade de um casamento, o poder judiciário da Igreja, a pedido do interessado, inicia um processo de nulidade matrimonial, por meio do qual, os juízes eclesiásticos apreciam a história conjugal do casal. Após várias fases, é homologada a sentença final e se for declarada a nulidade matrimonial, o fiel pode contrair novas núpcias. Tal procedimento da Igreja ainda é pouco conhecido entre os próprios fiéis. Os colaboradores da pesquisa foram dez pessoas, cinco homens e cinco mulheres, que deram entrada ao processo de nulidade matrimonial e já conseguiram a sentença final, tendo se casado novamente. A coleta de dados foi realizada através de entrevistas individuais, gravadas e transcritas na íntegra, e de observações registradas nas residências dos colaboradores, que foram anotadas em diário de campo. O trabalho objetivou compreender as motivações das pessoas que solicitaram a nulidade do casamento religioso através do Tribunal Eclesiástico, como souberam da possibilidade de nulidade matrimonial e por que iniciaram o processo de nulidade. Pretendeu-se ainda investigar como se deu o primeiro casamento, os significados que atribuíram à separação conjugal, como vivenciam a nova união e organizam a vida familiar após contraírem outra união e a influência que a Igreja exerce nessa nova união. A análise desses dados foi qualitativa e está fundamentada em referenciais teóricos da Psicologia, da Antropologia e do Direito Canônico. A análise dos dados indica que desde o início da primeira união o relacionamento com o cônjuge mostrou-se pouco profundo, e a isso foram se somando diversas dificuldades, inclusive a infidelidade, apontada como um dos motivos de separação. Os colaboradores descreveram o período da separação e o da tramitação do processo de nulidade matrimonial como doloroso, mas o fato de terem se casado novamente na Igreja - direito adquirido com a declaração de nulidade do casamento - é percebido e avaliado como conquista positiva, que contribui para o êxito do matrimônio atual. A interpretação dos dados aponta ainda que diversas instâncias da Igreja podem atuar em trabalhos preventivos para que as pastorais, especialmente a do curso de noivos, ofereçam formação adequada para a orientação dos nubentes.
The decline of marriages, especially the religious ones, well documented in several socio-demographic researches, has raised countless issues. Aside to this fall, the consensual unions that do not depend on civil and religious bond have grown daily and they express the rupture of traditional values and rules, which has become a pervasive practice nowadays. However, the churchgoer who marries in the Catholic Church and later separates from his or her spouse becomes prohibited from fully partaking in the Church activities if a new union may happen. Nevertheless, not every Catholic marriage is valid. In order to verify the authenticity of a marriage, upon request of the interested person, the judiciary power of the Church initiates a matrimonial nullity process in which the ecclesiastic judges examine the conjugal history of the couple. After several phases, a final sentence is homologated and if the matrimonial nullity is granted, the churchgoer is deemed enabled to remarry. Such Church procedure is little known among the churchgoers. There were ten research collaborators, five men and five women, who began the matrimonial nullity process. They were awarded the final sentence and have already remarried. The data collection was acquired through personal interviews, recorded and entirely transcribed, and from observations registered within the collaborators households, which were noted in a field diary. The project aimed to comprehend the motivation of the people requesting the religious matrimonial nullity through the Ecclesiastic Tribunal, how they found out the possibility of such process, and the reasons for pursuing it. In addition, this project sought to investigate details on how the first marriage happened, the meaning allotted to the marital separation, how the new union is lived as a family life after the new union, and the influence that the Church has in this new union. The analysis of these data was qualitative as it is supported by theoretical references of Psychology, Anthropology, and Canonized Law. The data analysis indicates that since the beginning of the first union the relationship with the spouse was not profound. As a result, various difficulties began to add up including infidelity, which was appointed as one of the reasons for the separation. The collaborators described the period of separation and the matrimonial nullity process as painful, however the fact of having been able to marry in the Church again a right acquired with the declaration of the matrimonial nullity is perceived and appraised as a positive accomplishment, which contributes to the success of the current matrimony. Furthermore, the data interpretation also reveals that various jurisdictions of the Church can act in preventive works so that the pastoral, particularly the pre-marital counseling courses, offer an adequate foundation for the orientation of the betrothed.

L'objectiu principal d'aquesta tesi doctoral ha estat aproximar-nos als canvis socials experimentats per la comarca del Baix Empordà durant el segle XVIII i la primera meitat del segle XIX, posant especial èmfasi en els oficis relacionats amb la terra. Com a tesi principal del nostre estudi hem plantejat que la pagesia pobra va poder tenir un paper més important del que se li ha atorgat històricament en els canvis agraris i socials produïts en el transcurs d'aquests dos segles. L'estudi s'ha dut a terme a partir de l'anàlisi de dos tipus de documents principalment; els inventaris post mortem i els capítols matrimonials que ens han permés analitzar l'evolució i els canvis en alguns oficis, mostrant un col·lectiu, el dels treballadors, i posteriorment menestrals que, segons les dades analitzades, va tenir una importància més rellevant en el conjunt de la societat i de les transformacions que es produïren durant els segles XVIII i XIX del que tradicionalment se li ha atorgat.
The main objective of this thesis has been to make an aproximation to the social changes experienced by the Baix Emporda during the eighteenth century and the first half of the nineteenth century, with particular emphasis on agricultural-related professions. As a main thesis of our study we suggest that the poor farmers could have played a more important role in agricultural and social changes produced during these two centuries than historically has been given credit for. The study was carried out from the analysis of mainly two types of documents, post mortem inventories and the marriage chapters. This has enabled us to analyze the evolution and changes in some trades, showing a collective, "treballadors", later called "menestrals", which, according to the data analyzed, had a more important role in the wider society and the transformations that occurred during the eighteenth and nineteenth centuries than traditionally has been considered.

One type of relationship, which has caused the most anxiety, is that between cohabiting couples in an intimate relationship. Much of the case law dealing with the acquisition of interests in land has arisen in the context of disputes over ownership of the family home. In the case of the matrimonial home, such disputes became possible only in 1882. This chapter, which explores legal issues concerning co-ownership of matrimonial property in England, focusing on acquisition of interests in the matrimonial home, first discusses the creation of co-ownership before turning to express declarations of ownership. It also considers resulting, implied, and constructive trusts as well as joint ownership of the legal title, sole ownership of the legal title, contributions and resulting trusts, purchase money resulting from trusts, and reform of the law on co-ownership.
