Marriage Constitution set is limited to marriages performed before the law was enacted, but the religious court based on legal considerans accept and grant approval under the hand of marriage to marriage after the Marriage Constitution enacted by basing on the Compilation of Islamic Law article 7, paragraph 3.

Abstract:
This study focuses on the legal impact of marriage registration in the context of itsbat marriages in religious courts, particularly for marriages that occurred after 1974 without an official certificate and were not registered in the compilation of Islamic law (KHI). It aims to evaluate the itsbat marriage as a legal mechanism for recognizing marriages that are not officially registered. Normative analysis, a philosophical and analytical approach, serves as the research method, reviewing the relevant legal framework and court practice in handling divorce cases. The results showed that unregistered marriages after 1974 can be legally recognised through the itsbat nikah procedure. The Article 7, Paragraph 3, letter KHI, outlines the necessary conditions. With this procedure, spouses can receive written evidence of their marriage’s legality in the form of a marriage certificate, which is then registered by the official Religious Affairs office. This study emphasizes the importance of marriage registration for legal certainty and protection of individual rights, and highlights how itsbat nikah plays a critical role in addressing the problem of marriage without official registration.

The Marriage Law stipulates that marriages that occur must be recorded by an authorized official. If you have not registered your marriage, you can apply to the Religious Courts for Muslims. The Marriage Law stipulates the age requirement for marriage as one of the requirements for marriage. Underage marriages to be carried out must obtain dispensation permission from the Court. Marriages are often carried out under the hands without regard to the terms of the marriage. For example, the application for itsbat marriage against underage marriages without a marriage dispensation that occurs in the Religious Courts. The purpose of this study was to determine and analyze the validity and legal consequences of itsbat marriage on underage marriages without a marriage dispensation in terms of Marriage Law and Islamic Law. This study uses a normative juridical approach with analytical descriptive specifications. The data collection technique used is by conducting library research and field studies through interviews with related sources. The analytical method used is juridical qualitative. The absence of a marriage dispensation does not affect the validity of an underage marriage. Underage marriages without a marriage dispensation can be legalized in the Religious Courts by taking into account the conditions for itsbat marriage. Underage marriages without a marriage dispensation that have been legalized in the Religious Courts will have the same legal consequences as marriages in general. The marital status will have permanent legal force as evidenced by obtaining a Marriage Certificate Quotation

Abstract:
Underage marriages have been happening in Indonesia for a long time, especially in rural communities that are categorized as not yet advanced in their level of education, economy, or because of the local community's traditions. From the perspective of the Marriage Law, this is contrary to the provisions of Article 7 paragraph (1) of Law Number 16 of 2019 and is contrary to the purpose of marriage is to form an eternal family based on God Almighty. Early marriage in adolescents impacts the physical aspect and psychological impact on the perpetrators. The research method is empirical juridical research. The research specification in this study is descriptive-analytical. The study results show that the existence of underage marriages, this indicates that Law Number 1 of 1974 concerning Marriage and Government Regulation Number 9 of 1975 concerning Implementing Regulations of Law Number 1 of 1974, is less effective. Given the existence of underage marriages, many divorces occur because the marriages are carried out by children who are still underage, so they have not been able to carry out the purpose of marriage fully.

Marriage registration is important in marriages in Indonesia because it can have legal consequences for those who carry out marriages. This study discusses the form of negligence of marriage registration in underage marriages in Gorontalo District and the legal consequences that occur due to negligence of marriage registration in age marriages in Gorontalo Regency. This research is a field research with a juridical and sociological approach. The collection of data in the form of observations at the study site, interviews with employees of the Office of Religious Affairs, parents and underage marriages with 182 respondents, as well as literature review. The results showed: First, the form of negligence in the registration of marriages in Gorontalo Regency, namely the negligence of parents, the negligence of children and the negligence of marriage registration officers; Second, due to the legal consequences caused by negligence in registering underage marriages in Gorontalo District, namely the legality of child marriages, divorce is easy, rejection of marriage dispensation, repeating the marriage contract and marriage without the presence of government officials.

<p align="justify">This article discusses the highest factors that hinder the settlement of property disputes. The legal status of contract marriages according to Islamic law, a marriage is said to be valid if it meets the requirements for a valid marriage and is carried out according to religion and belief, this is based on Article 2 of Law Number 1 of 1974 and Article 4 Islamic Law Compilation. Or in other words marriage is legal according to Islamic law if it fulfills the marriage requirements. The legal status of contract marriages in an unregistered marriage when viewed from Law Number 1 of 1974 concerning marriages does not have permanent law, because contract marriages are a form of marriage that is not registered so that it cannot be proven by an authentic certificate in the form of a marriage certificate. In this writing, the author uses a normative research method in which this method is a legal research method that is carried out by examining library materials or secondary data. Legal arrangements for contract marriages (mutah marriage) in the perspective of the Marriage Law are illegal marriages and have no legal force, as a result the contract marriage law for the position of wife and children is that the wife must carry out all obligations as a wife and child status. who was born illegitimate, because the marriage of his parents was not recorded in a legal marriage. If the marriage ends in a contractual marriage, there is no distribution of assets, even though assets were produced during the marriage. In addition, there is no inheritance right from the contract wife to the contract husband.</p>

Acreditando que o teatro, assim como as diversas formas de mídia, é responsável não apenas por ditar comportamentos e padrões sociais, mas também por representá-los, em uma relação de retroalimentação, as peças citadas são analisadas e seus conteúdos confrontados com os dados levantados através da pesquisa bibliográfica acerca de temas referentes à conjugalidade contemporânea, tais como divórcio, sexualidade e papéis de gênero.
The present work intends to analyze the representations of marriage and intimacy in the brazilian theatre through the plays Intimidade Indecente, by Leilah Assumpção, and Batalha de arroz num ringue para dois, by Mauro Rasi. We believe that theatre, as other kinds of media, is responsible not only for the influence of behaviors and social models, but also for representing them, in a feedback relationship. In that sense, we analyze these plays and confront their contents with the results obtained from the bibliographic research of some topics related with modern intimacy, such as divorce, sexuality and roles of genre.

Abstract:
Focussing on Scotland, this thesis adds a new perspective to the existing discussion surrounding marriage and marriage breakdown in the late twentieth century. It is the lived reality of marriage and marriage breakdown which is a key focus, using oral history and a range of contemporary and archival source materials. Whilst a renewed discursive emphasis on the 'companionate marriage' in the immediate post-war period is evident, in line with the social reconstruction ethos of the period, there existed alongside such enthusiasm a number of alternative, and often conflicting, contemporary discourses. With significant implications for marriage and family relations, sociologists and historians identify a further profound discursive shift as occurring during the 1970s, emphasising the increased availability of contraception, the emergence of second-wave feminism in Britain and landmark equality legislation as crucial factors intertwined with this. Perceived advances in terms of both mainstream ideology and legislation, including, for example, a revived feminist consciousness and the 1976 Divorce (Scotland) Act, did not influence marriage in a discursive vacuum but instead are likely to have integrated and competed not only with generic ideals regarding appropriate gender roles but also embedded local patterns of gender relations. Oral history is a particularly appropriate methodology with which to address this topic as it permits an otherwise unattainable insight into the experience of day-to-day life. Additional source materials drawn on include parliamentary, ecclesiastical and sociological commentary.

This thesis examines the development of the international marriage business in Japan in the 1980s and 1990s, and the experiences of female participants from China, South Korea, and the Philippines who married through this system and currently live in Japan. The study treats these women as active female migrants and contributes to a gendered understanding of the process of contemporary migration. The thesis argues for an acknowledgement of the way in which the international marriage business served the purposes of marriage and migration for women in male dominant and economically stratified societies in Asia, without downplaying the fact that the same system and its ideology oppresses women. The study argues that, for these women, participation in international marriage by introduction was about marriage and migration. Analysis of the intricate sites of marriage and migration was thus critical to understanding their experiences. The thesis also argues for recognition of the diverse and complex experiences of the women participants. Part I of this study investigates the macro-economic, social and political factors that influenced development of the international marriage business in Japan. It analyses representations of international introduction marriage and its female participants, and maps the ways in which patriarchal gender ideology in the international marriage business system intersects with global capitalism, and other hegemonic power relations operating in contemporary Japan. Part II examines the marriage and migration experiences of 45 women. The section identifies conflicts faced by the women and examines processes of negotiation inside and outside the family domain. It investigates the extent of the women's agency in their decision to many and live in a foreign country, covering interconnected arenas of marriage, family, paid work, involvement in women's groups and questions of legal citizenship. The women's narratives demonstrate the importance of articulating a structurally embedded analysis with active female agency in the study of international marriage migration.

Abstract:
Sweden has seen a reversal in marriage trends, from mainly declining marriage rates since the 1960s to increasing rates from 1998 and onwards. By applying event-history techniques to Swedish register data, this study examines whether the trend reversal is related to compositional changes in various socio-economic and demographic characteristics of the population, with special focus on childbearing. Only first marriages of women are studied as these largely represent the general marriage trends. The results show that the trend reversal only partly can be ascribed to compositional changes, more specifically to changes in labor-market attachment and childbearing. Thus, there is evidence of a new marriage trend in Sweden that does not conform very well to that of generally declining marriage rates as is often depicted in demographic literature. Furthermore, there is evidence of pro-cyclical marriage and childbearing trends. These patterns are especially interesting because Sweden is a country that in many aspects has been a forerunner in the development of new trends in family-demographic behavior and a country where childbearing and marriage are not necessarily seen as very closely interrelated.

This chapter considers the extent to which the state should seek to regulate any private religious or secular marriages that citizens might enter into. In the marriage-free state citizens could still take part in religious or secular marriage ceremonies. This is why the marriage-free state is not a marriage-free society. It does not follow, however, that the state should take no interest at all in such marriages, since they may take place in the context of oppression or injustice. The chapter sets out the case for intervention in marriages that are not recognized by the state, drawing on the model of liberal intervention in cultural practices set out in Clare Chambers, Sex, Culture, and Justice: The Limits of Choice and also on the UK Equality Act 2010. The chapter includes a case study of the agunah problem in Orthodox Jewish marriage and divorce law.

When the English court has to decide whether a marriage is valid, foreign elements may be involved: one or both of the spouses may be of overseas origin, or the marriage may have been celebrated in a foreign country. This chapter considers which law applies to determine the validity of such marriages. For choice of law purposes, rules about the validity of marriage are divided into two classes: those concerned with formal validity and those concerned with essential validity or capacity to marry. Rules of formal validity lay down the way in which a marriage must be celebrated (for example, to ensure publicity and proof of marriage). Rules of essential validity or capacity are concerned with the permissibility of the marriage relationship itself — whether the parties ought to be allowed to marry each other (or at all). The chapter also discusses the application of the doctrine of renvoi and rules for same-sex marriages, civil partnerships, and polygamous marriages.

Abstract:
The article considers marriage indicators in cities of the Perm governorate. The indicators of absolute marriage rates, average age of marriage, proportion of early marriages and other parameters of this demographic process were determined based on statistics of the Central Statistical Committee and city parish registers. A certain tendency towards a decrease in marriages at the beginning of the 20th century, as well as a slight increase in the age of marriage among women were observed. Marriage rates were influenced by social and economic indicators of urban development, leading to the democratisation of the marriage process. For women, later marriage resulted in an increased choice of life strategy. A significant number of unmarried and single lived in Perm and Ekaterinburg, where many migrants came.

Abstract:
The article analyses the changes in marriage and family relations of the population of Nizhny Tagil in 1990–2020 based on the data of the current statistical records and the census of 2010. The marriage rates in the city varied in waves influenced by changes in the number of Tagil residents at a young marriageable age. There was a gradual shift in the registration of marriages to a more mature age. The wide spread of repeated and unregistered marriages in the city, as well as high divorce rates indicate a violation of the stability of marriage, which negatively affects the reproduction of the population. To increase the birth rate, measures aimed at strengthening the family are necessary.

Abstract:
The article is devoted to the analysis of the marriage behaviour of Catholics in Tsarskoye Selo and Yamburg parishes of the Saint Petersburg governorate. For this purpose, the Russian-language copies of 1840–1859 parish registers, deposited in the 1822 collection (Petrograd Dean’s Office of Roman Catholic Churches) of the Central State Historical Archives of St. Petersburg were analysed. Statistical methods of processing mass sources were applied, the data were processed using Excel spreadsheets. The article examines the seasonal distribution of marriages, the average age at first marriage, peculiarities of the marriage choice of Catholics. The research findings were compared with the indicators previously obtained for the Orthodox population of Tsarskoye Selo in the 1840s.

The article analyzes the changes in the marriage rate in Moldova over the study period. It was revealed that against the background of a general trend of gradual decline, a significant drop in the number of marriages was recorded in 2020, which is largely due to measures to counter the spread of COVID-19 infection. Along with this, other factors are considered that have an adverse effect on the dynamics of marriages in the republic. The dynamics of marriage rates against the background of a general decline in the population and an unfavorable age-sex structure of young generations entering childbearing age is becoming one of the characteristics that explain the expected low fertility in the future. The aim of this paper is to provide as detailed as possible the biography of Hungarian princess Elisabeth, who has for some time Serbian queen and wife of King Milutin. Firstly, her origin will be discussed in more details, as well as her early life. Furthermore, particular stress will be on her marriages, firstly with King Milutin. Determining the date of that marriage and the children who had born in that marriage are not completely solved in the historiography, but there are indeed some interesting details which are worth concerning. Her alleged second (or for some scholars her first) marriage to Zaviš of Falkenstein (d. in 1290) will also be a special topic of the paper, since this topic is maybe not so well discussed. Finally, the authors will tend to describe one of the most interesting parts dedicated to Elizabeth’s veneration as blessed in the Roman Catholic Church.

As noted in this monograph, marriage forms a central element of social life for Egyptians. Marriage in Egypt is nearly universal, and parents invest heavily to establish their children in married life. Once married, couples are faced with social pressures to begin childbearing immediately, a reflection of the high value placed on parenthood and children. But not all marriages begin with the same prospects for stability and satisfaction. This study draws attention to the problems faced by women who marry at very early ages in parts of rural Egypt. Despite a legal minimum age of 16, significant numbers of young girls marry below that age, and many experience social, emotional, and health-related difficulties. This study tells why these young women married early and how that decision affected their later life. The study points to areas where the aspirations of these girls have been clearly thwarted—to go to school, delay marriage, and postpone childbearing until they feel physically and psychologically ready. A related picture emerges of the social and economic forces that propel rural girls into marriage at very young ages. Each of these problems suggest areas for policy attention.
