Full textIn accordance with Article 46 of the European Convention on Human Rights, the Contracting Parties undertake to abide by the final judgment of the European Court of Human Rights. It is however apparent from the Court’s case-law that its decisions are “essentially declaratory” and, by that, a freedom to choose the means to be used to fulfill the obligation to execute the decision is given to the respondent State. In any event, the sense of the execution of the Court’s decisions would remain paradoxical if we were to stop at accepting at the same time that a State must execute the European decision while having the free choice in the manner to achieve so. Such a shortcut would lead to a poor execution of the decisions of the Court in so far as, on one hand, the purpose of the enforcement of the decision is vaguely specified and, on the other hand, freedom of choice is expressly precise. The doctrine of the State's margin of appreciation thus gives the flexibility needed in delimiting the roles of the Court and those of the respondent State for the purpose of a better implementation of European decisions. To that end, the dual effect of the European decision only makes sense if it is accepted that the State indeed enjoys a margin of appreciation in the execution of the Court’s decision but that the limits of such margin are laid by the Court itself, in its decision. It is therefore necessary to systematically start from the decision of the Court which must specify what the expected execution is, and therefore what the compensation for the violation of the Convention should be, in order to determine whether the margin of appreciation of a State, at the stage of implementation of the decision, is rather broad or rather narrow. The freedom of choice of the respondent State as to the measures to be taken to implement the decision according to the expectations of the Court will thus relate to a range of choices predefined in the decision, depending on the nature of the violation of the Convention or the gravity of the consequences of such violation. In short, the more precise the ranges of choices of measures are, the more likely it is that the decision will be better executed. The essence of the work is therefore to try to identify the criteria for determining the extent of the State’s margin of appreciation in the execution of the Court’s decision. However, such an exercise cannot be carried out without first defining the very notion of “margin of appreciation” which, even if it has already been used by the Court and by a part of the doctrine, has not received a convincing definition, or has often been indistinctly associated with the notion of “margin of manoeuver”, the “principle of subsidiarity”, or even sovereignty, while it cannot be confused with them

Full textThe present work describes the dynamics of two pockmark areas, off West Africa. The intention is to propose two different approaches to study the relationships between fluid migration and pockmarks. The first investigated area corresponds to a pockmark cluster called Preowei, located off Nigeria. Geochemical analyses and modeling were combined with seismic data to detail the hydrocarbon migration pattern at this area, with implication on both the pockmark formation and the evolution of their morphology. The proposed interpretation seeks to identify the conceptual bases of pockmark evolution over time at this area. It is argued that the cluster has been active for at least 2700 years, and it is still at the stage of hydrate formation for some pockmarks and carbonate formation for other. The second investigated pockmark, called Regab, is located off Gabon. It is a giant pockmark of 800-m diameter, characterized by an ecosystem rich in fauna, with a large variety of living species. The main core of the work done on this pockmark was focused on finding a link between the fluid chemistry and the spatial distribution of the living communities which populate it. This was achieved by combining new geochemical and bathymetric results with a well-compiled dataset from the literature

Full textMy PhD project aims at better understanding the functioning of both organic proxies of sea surface temperature (SST), Uk’37 and TEX86, especially in terms of season and depth of alkenone and tetraether production, over the last 160 000 years on the Iberian Margin. The originality of this project lies in its double approach: on the one hand, with the acquisition of Uk’37 and TEX86 sedimentary records from the Iberian Margin, and on the other hand with the use of a coupled physics-biogeochemistry regional model to simulate these temperature proxies for 3 climate modes: at present, during the last glacial maximum, and during Heinrich Stadials. The comparison of biomarker results with those from modeling tests of production scenarios provided the following conclusions. Uk’37 does record annual mean SSTs, whereas TEX86 shows a priori too high temperature for this area. The formulation of a regional calibration for TEX86 index enables to obtain coherent past annual mean SSTs. The best location to apply both paleothermometers on the Iberian Margin is the Shackleton site. After refined analysis of multiproxy signal timings, TEX86 production seems to take place at intermediate depth, potentially by archaean communities coming from the Mediterranean Sea. Latitudinal thermal gradient variations are quantified, and glacial/interglacial surface and intermediate water masses reorganizations during 'Heinrich like' events are considered

Full textAs part of the European Convention, the principle of subsidiarity is marked by ambiguity. Originating from judges, it has not been formally defined in legal texts nor in any related jurisprudence and is therefore characterized by a semantic and legal indeterminacy. Featuring both a procedural and a tangible dimension, it remains a fundamental principle of European law. On the one hand, it structures, the system’s organization and operations. On the other hand, it guides the court of Strasbourg’s interpretation and review. Naturally ambiguous but still guiding European law, the principle of subsidiarity is presented as a flexible and malleable principle, and therefore adaptable. The analysis of its implementation in the European jurisprudence highlights its inconsistency and variability at the free disposal of the court of Strasbourg. However, in the light of the current context of an unprecedented saturation of the system and therefore of an urgent reassertion of its subsidiary nature, a fluctuating use of the principle is assessed differently to make it not a guarantee of national liberties, but a guide for them. As a driving force for increased accountability of member states, the principle of subsidiarity appears to be essential to the judicial policy of the European court

Full textThe Miocene igneous activity in Lesser Kabylia includes a ~130 km-long EW-trending lineament that extends along the eastern Algerian margin from Kabylie de Collo to Ouest-Edough-Cap de Fer area. It includes mostly medium-K to High-K calc-alkaline plutonic and volcanic rocks. In the studied area, these magmatic rocks crosscut and/or overlie the inner zones of the Maghrebides represented by basement and Kabylian cretaceous and Numidian flyschs nappes. New U-Pb dating on zircons and K-Ar ages on whole rocks and separated minerals document a 17 Ma onset for the post-collisional K-rich calc-alkaline magmatism. These Upper Burdigalian ages obtained on the Bougaroun pluton are the oldest presently identified for Krich calc-alkaline rocks in the whole 1200 km-long EW trending magmatic belt located along the Mediterranean coast of Maghreb. However, according to new K-Ar ages, magmatic activity started in Ouest Edough zone at ~16 then persisted intermittently in the two studied areas at ~15.5 Ma, 14-13 Ma and stopped at ~11 Ma, with the emplacement of mafic and felsic dykes in Kabylie de Collo. In addition, we measured older (Upper Oligocene) Ar-Ar hornblende ages of 27.0 ± 3.0 Ma and 23.3 ± 3.2 Ma on LREE-depleted gabbros outcropping at Cap Bougaroun sensu stricto. According to our new geochemical and isotopic data, we distinguish two sources for magmatic rocks in the studied area: a depleted mantle source which could represent the ambient asthenosphere still not modified by the subduction processes at the time of emplacement of the Upper Oligocene LREE-depleted gabbros. The latter could be related to the Upper-Oligocene rifting before the back-arc crust formation in Algerian basin or to dyke systems or gabbroic intrusions crosscutting the stretched Kabylian continental crust. An enriched mantle source modified by a subduction component (melt or fluid) escaping from a northward-dipping subducted Tethyan oceanic lithosphere. The enriched mafic magmas are believed to come from this metasomatized mantle and are genetically related to the differentiated rocks through crystal fractionation and assimilation of large amounts of crustal lithologies, during their ascent through the African continental crust. We propose a tectono-magmatic model involving an Early Miocene Tethyan slab breakoff combined with delamination of the edges of the African and Kabylian continental lithospheres. At 17 Ma, the asthenospheric thermal flux upwelling through the slab tear induced the thermal erosion of the Kabylian lithospheric mantle metasomatized during the previous subduction event and triggered its partial melting. We attribute the strong trace element and isotopic crustal signature of Bougaroun felsic rocks to extensive interactions between ascending mafic melts and the African crust underthrust beneath the Kabylie de Collo basement

Full textThe NE American margin represents one of the best studied margins in the world, it was the subject of several scientific programs. In comparison, the conjugate NW African margin remains fairly unknown, only two deep seismic cruises were acquired: the SISMAR cruise (2001) offshore the Meseta and the DAKHLA cruise (2002) offshore the Sahara. The deep structure of the Canadian margin is known due to the SMART wide-angle seismic profiles 1, 2 and 3. The first objective of the MIRROR project was to acquire combined wide-angle and deep reflection seismic data offshore a segment conjugate to the SMART-1 profile. The comparison between the homologous segments of these two margins aimed to better understand the opening mechanism of the Central Atlantic Ocean. A comparison between Sismar, Dakhla and Mirror models shows that the continental crust is thicker in the north and thins toward the south. The width of the transition zone is narrower south and Sismar profiles are located on a sedimentary basin placed on a very thinned continental crust. Comparing the Mirror profile with that of the Canadian conjugate margin (Smart 1) shows that the thickness, the structure of the continental crust and the thinning is very similar. However, zones of exhumed and serpentinized mantle were imaged along the Canadian profile that have no conjugate on the African margin. Moreover, the thickness of the oceanic crust is variable with 8 km on the African side and only 3-4 km on the Canadian margin. Several hypotheses have been proposed to explain this difference (a) an age difference between the two types of crust (b) thickening associated with the passage of the Canary hotspot (c) an asymmetric accretion or (d) an accretion at slow to ultra-slow speading centers

Chapter II deals with the question of military grouping drawn from the services demanded by the king to his vassals and allies. Chapter III is about the organisation of the military establishment. A study of the military titles is presented. Very often the documents reveals that the army consisted of large forces made at disposal by levy. An analysis of this process is also proposed. Chapter IV offers a study of the weaponry. This study is based on a large scale of texts concerned by the manufacturing and distribution of weapons. Full textThe aim of this work is to constrain (1) whether exhumation of mantle rocks at mid oceanic ridges is compatible with the record of polarity reversals of the Earth magnetic field, (2) what is the origin and the processes responsible for the magnetic anomalies observed at magma-poor rifted margins and (3) what are the consequences of these processes on continental breakup. In a first part, in order to work with high-resolution data, we develop a method for calibration and interpretation of deep-tow three component magnetic data. In a second part, we apply these methods to the data acquired above the large exhumed mantle domains of the ultraslow-spreading Southwest Indian Ridge. We show that, in these areas, neither the magnetic properties of the dredge samples nor the deep-tow magnetic data are consistent with the seafloor-spreading magnetic pattern commonly observed at mid oceanic ridges. We further suggest that in contrast to mid oceanic ridges basalts the exhumed serpentinized mantle rocks do not carry a sufficiently stable remanant magnetization to produce marine magnetic anomalies. In the last part, we show that the “J” anomaly, previously interpreted as the first seafloor-spreading anomaly of the Iberia and Newfoundland passive margins, is associated with locally high topography and thickened crust. We propose that this peculiar crustal structure results from voluminous magma both erupted at the surface and added beneath the exhumed mantle domain. We therefore propose that the J anomaly did not form during seafloor spreading but instead represents a pulse of magmatism that have triggered continental breakup

Full textThe object of this doctoral thesis is to enhance the quality of Lucette DESVIGNES's works of fiction. The first step will be to show how this writing is in keeping with the notion of the margin: how it arises out of a university career, breaks free from the strict divisions in the literary genres, and is kept on the fringe of a certain literary recognition, specially in France. This margin writing can then be studied as the poetics of landscape writing through the originality of its engineering: through the analysis of the spatial structures and thematic entries, we propose to examine how and why this writing in its variations succeeds in modifying the significance of landscape as a function. Thus proceeding from the landscape in the page to the page as a landscape, a third step will finally be devoted to examining the margin in the proper sense (its use, its function, from the angle of a genetic approach on the manuscripts) and in the figurative meaning as well, i. Full textThanks to the work of the European Court of human rights and the Inter-American Court of human rights it has been consolidated a system of minimum standards of rights and freedoms which, over time, endeavours to ensure the protection of the individual in a comprehensive way and regardless of his/her sexual orientation: in the most intimate sphere (his/her private and family life), as well as, in the public sphere, at political and social levels, where, ultimately, their identities are constructed. This process, however, was not peaceful or easy. The struggle for rights and their protection takes places in an international scene characterised by a certain confrontation between States, jealous of their sovereignty and the international courts, guarantors of the orthodox interpretation of the rights and freedoms contained in the conventions. For this reason, we might ask ourselves: what are the mechanisms that the supranational judges have used to limit the power of the authorities of the State? To what extent the international courts are entitled to exercise this control? To answer these questions, we have analysed the steps and/or the leading cases which have entailed the key elements in the recognition of the legal status of homosexual citizens. We also have examined whether this status is the result of a consensus between States within the Council of Europe and the Organization of American States or, on the contrary, it is the result of an independent interpretation of international conventions by the courts of these organisations

Full textIn the Eastern Mediterranean, the South-Tethys paleo-margin experienced poly-phased rifting episodes during Paleozoic and Mesozoic times. This margin has been subsequently inverted by discontinuous events occurring since the Late Cretaceous as a consequence of the Africa-Eurasia convergence.The Cyrenaica margin (northeast Libya) has recorded these extensional and compressional events. It thus gives the opportunity to analyse these inversion and their possible causal links with events occurring along the plate boundary (i.e. within the Hellenic subduction).The adjacent Sirt Basin, follows an oblique direction, did not suffer the same deformation as Cyrenaica and has recorded a continuous subsidence since the Mesozoic.Offshore seismic data combined with well correlations have permitted us to investigate and discuss the interactions between Cyrenaica, Sirt Basin and the deeper domains (i.e. Ionian Basin).We were able to document the different rift episodes, better constrain the compressional events on Cyrenaica, observe characteristics of the architecture of the Sirt Basin and clarify part of its evolution.Finally we integrate this part of the margin, in the regional geodynamic frame of the East Mediterranean branch of the Neo-Tethys by discussing the timing and mechanism which led to its opening

La cronologia obtinguda es basa en la integració d’un conjunt de sèries magnetostratigràfiques amb totes les dades biostratigràfiques dels registres marí i continental disponibles en aquest sector de la conca. L’establiment d’una correlació robusta amb l’escala de temps de polaritat geomagnètica proveeix al registre sedimentari Paleogen d’un marc cronològic amb edats absolutes que van des del cron C20n fins al cron C12r (ca. 43.0-31.0 Ma), és a dir, del Lutecià al Rupelià. Aquest nou marc cronològic proporciona les eines necessàries per a la quantificació i posterior comprensió de l’evolució tectonosedimentària dels marges adjacents a la Conca de l’Ebre. Finalment, la cronologia resultant de la present Tesi Doctoral contribueix a la calibració amb l’escala de temps geològic de les biozonacions de nanofòssil calcari i macroforaminífers (Shallow Benthic Zones), així com dels nivells de referència de mamífers paleògens europeus (European vertebrate Mammal Paleogene –MP- reference levels).

Non-inferiority trials have been widely used in many medical areas. The goal of a non-inferiority trial is to show that a new test therapy is either better or not too much worse than the active control rather than showing the test therapy is superior to a negative control (i.e. placebo). The appeal of a non-inferiority trial is that it is often unethical to give some patients a treatment with no therapeutic benefit. When designing a non-inferiority trial, the issues of assay sensitivity, sample size, constancy condition, and a suitable non-inferiority margin need to be considered. A poor choice of the non-inferiority margin is a major reason that many non-inferiority trials fail. A numerical example is presented to show how to estimate the non-inferiority margin without historical data.

La presente tesis de magister tuvo como objetivo analizar el comportamiento dinámico del puente Marga Marga, ubicado en Viña del Mar V región, durante el terremoto del Maule ocurrido el 27 de febrero de 2010 y sus principales réplicas. Con dicho fin, se analizan los registros de aceleraciones obtenidos por una red de 24 acelerómetros distribuidos en la estructura y valle del estero Marga Marga. Durante el sismo del 27/02/2010, los periodos fundamentales del puente varían entre 2.38 a 2.50 s y 2.17 a 2.38 s, con un amortiguamiento de 10.7 y 13.4% del amortiguamiento crítico, en dirección longitudinal y transversal, respectivamente. Estas propiedades fueron determinadas usando los registros de los sensores ubicados en el tablero. Estos períodos son mayores que los determinados para sismos moderados y cercanos a los considerados en la fase de diseño. Los periodos fundamentales del suelo fueron 0.83 y 0.95 s en dirección perpendicular y longitudinal al valle. Los desplazamientos máximos relativos del sistema de aislación, medidos sobre la cepa central, fueron de 10.9 cm (54% de deformación angular) y 15.6 cm (76.5% de deformación angular) en dirección longitudinal y transversal, respectivamente; y 5.8 cm (29% de deformación angular) sobre los estribos en dirección longitudinal. Posteriormente, se elaboraron dos modelos de elementos finitos del puente Marga Marga con el software OpenSees. Estos difieren en que en uno las cepas se representan con elementos lineales y elásticos, y en el otro con elementos de fibra no lineal que pueden presentar disipación por ciclos de histéresis. El análisis se realizó con input asincrónico. Los parámetros que se usaron para calibrar los modelos son: las propiedades al corte de los elementos elastoméricos bilineales ubicados en las cepas y la dimensión de la separación longitudinal entre los estribos y el tablero (que representa las juntas de dilatación). Variando estos parámetros se realizaron numerosos análisis y se eligieron los que mostraron menor error en los desplazamientos máximos absolutos respecto de lo registrado experimentalmente. Con los registros del 17/04/2012 se obtienen periodos fundamentales del puente de 1.75 y 1.54 s en dirección longitudinal y transversal, respectivamente. Estos períodos son mayores que los obtenidos para sismos moderados similares ocurridos antes de 2010, indicando una flexibilización de la estructura post-terremoto. La deformación máxima del sistema de aislación, es de 8.3%. El modelo calibrado para el sismo principal no logra reproducir de buena forma los desplazamientos de este sismo, debido a que las incursiones de los aisladores en el rango no lineal son menores y por lo tanto la disipación de energía del modelo es insuficiente, por lo tanto debiera aumentarse el amortiguamiento modal considerado. No obstante, las frecuencias obtenidas son bastante similares a las de los registros. Se concluye que el puente Marga Marga tiene un comportamiento muy dependiente del input aplicado que impide generar un modelo general que funcione para sismos de diferentes intensidades. Las acciones del terremoto del Maule se pueden considerar del orden del sismo de diseño.
