Abstract:

This chapter examines the scope of protection to which graphical user interfaces may be eligible under various intellectual property rights: namely, trade marks, unfair-competition laws, design rights, copyright, and patents. It first considers the extent of copyright protection over a software product’s ‘look-and-feel’ elements, with particular emphasis on graphical user interfaces protection under US and EU laws. It then discusses trade-mark, trade-dress, and unfair-competition protection for graphical user interfaces, along with intellectual property rights protection for design patents and registered designs. Finally, it describes the patent protection for graphical user interfaces in the United States and at the European Patent Office.

Abstract:

This chapter considers the meaning of the terms that appropriately denote the subject matter protectable by registered trade mark and allied rights, including the common law action of passing off. Drawing on the earlier analyses of the objects protectable by patent and copyright, it defines the trade mark, designation of origin, and geographical indication in their current European and UK conception as hybrid inventions/works in the form of purpose-limited expressive objects. It also considers the relationship between the different requirements for trade mark and allied rights protection, and related principles of entitlement. In its conclusion, the legal understandings of trade mark and allied rights subject matter are presented as answers to the questions identified in Chapter 3 concerning the categories and essential properties of the subject matter in question, their method of individuation, and the relationship between and method of establishing their and their tokens’ existence.

Lucrarea semnata de Anisoara Georgiana BLINDU, casatorita BADEA, are ca obiectiv principal studiul evolutiei limbii romane literare de-a lungul secolelor al XVII-lea – al XX-lea, dintr-o perspectiva specifica, aceea a conectorilor logico-sintactici si discursiv-pragmatici. „Martorul” acestei evolutii este textul biblic, mai precis, textul celor patru „Evanghelii” din cuprinsul Noului Testament, in versiunile romanesti realizate de- a lungul ultimelor patru veacuri de cultura scrisa romaneasca. Se intelege din aceasta selectie ca traducerile textelor sacre crestine sunt considerate reprezentative pentru limba romana ingrijita din epoca fiecarei versiuni: fiecare noua talmacire din NT valorifica posibilitatile limbii primitoare din etapa respectiva de evolutie, pe de o parte, si contribuie la rafinarea mijloacelor de comunicare verbala scrisa, pe de alta parte. Practic, corpusul de texte luat in considerare este format din sapte versiuni „mari” (adica, integrale, pe cat posibil) ale Tetraevanghelului; Noul Testament de la Balgrad (1648); Biblia de la Bucuresti (1688); Biblia de la Blaj (1795); Biblia de la Buzau (1854), Biblia Cornilescu (1924), Biblia in uz (1914/1934/1982), Biblia diortosita de Valeriu Anania (2001). La acestea se adauga, pentru analiza punctuala a unor aspecte gramaticale sau lexico-semantice, trimiterile la alte editii, cum ar fi Biblia de la Sibiu (1856 1858), texte din traducerile fragmentare din secolele al XVII- lea – al XVIII-lea s.a. De asemenea, pentru analiza unor forme si functii ale conectorilor sintactici, s-au facut comparatii cu diverse alte carti ale Noului Testament, dar si ale Vechiului Testament.

Abstract:

Although the law of infringement is relatively straightforward on the copying of literal and textual elements of software, the copying of non-literal and functional elements poses complex and topical questions in the context of intellectual property protection. In most cases, such elements contain the real value of a software product. This book examines the copying of non-literal and functional elements of software in both the United States and the European Union, using a holistic approach to address the most topical questions facing experts concerned with legal protection of software products across a range of technological platforms. The book focuses on five distinct but interrelated areas: contract, copyright, patent, trade-mark and trade-dress laws, and trade secrets. It also considers the protection of designs, in the context of graphical user interfaces. The book looks at software as a multilayered functional product, setting the scene for other legal discussions by highlighting software’s unique characteristics. It analyses models for the provision of software, addressing licensing patterns and overall enforceability, as well as the statutory and judicial tools for regulating the use of such licences. Further, it explores the protection of non-literal and functional software elements under EU and US copyright law, with emphasis on internal architecture and behavioural elements. Finally, it describes the application of trade-dress protection to software’s ‘look and feel’, particularly relevant to the provision of software in the cloud environment.
