Abstract:
La ricerca persegue l'obiettivo di formulare e rispondere ad alcune domande relative al ruolo e alle competenze professionali dell'operatore che lavora con richiedenti e titolari di protezione internazionale. L'interrogativo di fondo nasce sul campo grazie all'esperienza della ricercatrice come operatrice di accoglienza presso la Provincia Autonoma di Trento, che costituisce il caso empirico approfondito. L'osservazione partecipante ha fatto emergere la rilevanza che le scelte, i ruoli e i valori degli operatori assumono nell'influenzare il significato dell'accoglienza praticata e talora persino i percorsi d'integrazione dei soggetti beneficiari. Oltre all'osservazione, la ricerca si è avvalsa di interviste in profondità a 55 operatori. Focalizzandosi sulle figure professionali che più lavorano con il concetto di "vulnerabilità" - operatori di accoglienza, assistenti sociali e psicologi - l'analisi va ad individuare i punti di intersezione e contatto tra le varie professionalità, permettendo di rilevare le micro-tattiche che sono messe in atto nella quotidianità del lavoro, rispetto alla formalità delle procedure. Si vedrà come l'operatore di accoglienza si sia di fatto professionalizzato all'interno del sistema, luogo dove ha sviluppato le proprie competenze e costruito le proprie "grammatiche d'azione". Su un versante parallelo e a tratti convergente, assistenti sociali e psicologi sono invece professionalità che si sono formate "fuori" dal sistema-mondo dell'accoglienza ma, una volta arrivate "dentro", si sono trovate ad assumere ruoli e competenze professionali in parte nuovi, che possono talora far emergere contraddizioni e contrasti, ma anche innovative forme di integrazione con quelle degli operatori di accoglienza.

AbstractA total of 153 free-ranging birds from Germany belonging to 15 species were examined for nematodes in their digestive and respiratory tracts. In 51.7% of the birds 14 different nematode species were found: the intestinal ascarids Porrocaecum depressum and P. angusticolle, the strongylid Hovorkonema variegatum, which inhabits the trachea and bronchi, the hairworms Eucoleus dispar and Capillaria tenuissima isolated from the digestive system, the spirurid nematodes Cyrnea leptoptera, C. mansioni, C. seurati, Microtetrameres cloacitectus, Physaloptera alata, P. apivori, Synhimantus hamatus and S. laticeps, which inhabit the proventriculus and gizzard of the raptors, and the spirurid nematode Serratospiculum tendo, which lives in the air sacs. To revise their systematic positions the ribosomal 18S gene regions of the nematode species were analysed and a phylogenetic tree was constructed. The molecular data confirmed the morphological systematics, except the spirurid family Physalopteridae, which grouped together with the Acuariidae.

In questo lavoro si propone un'analisi delle caratteristiche occupazionali della po-polazione straniera in Italia rispetto ai cittadini nazionali, confrontando i mesi di epidemia COVID-19 con i precedenti. L'analisi si avvale dei microdati della Forze di Lavoro ISTAT fino al secondo trimestre 2020. La banca dati è arricchita dalla Indagine Campionaria sulle Professioni INAPP che permette di includere nell'analisi le caratteristiche professionali, tra cui la prossimità con i colleghi, il con-tatto con il pubblico, l'importanza di mansioni di cura e l'esposizione a malattie con le quali è costruito un indicatore sintetico di rischio di contagio da SARS-Cov-2 sul posto di lavoro. Con un modello di probabilità lineare si stimano gli effetti del COVID-19 sulla perdita dell'occupazione e sulla sospensione dell'attività lavorati-va. I risultati mostrano per gli stranieri una maggiore incidenza della perdita di oc-cupazione e una minore sospensione dell'attività nei mesi della pandemia, con ef-fetti maggiori per le donne.

Il lavoro accademico si divide tra ricerca, didattica e attività amministrative. Dopo la riforma Gelmini, la ricerca ha un peso rilevante ai fini dell'avanzamento di carriera. Secondo la letteratura, le donne sono più propense ad assumersi i compiti di insegnamento e quelli amministrativi, in virtù di un gender scheme che le vede più portate per queste mansioni. Le donne hanno meno probabilità di raggiungere posizioni apicali e le raggiungono più lentamente. In questo articolo esploriamo il ruolo attribuito dalle accademiche italiane ai compiti di didattica, indagando i percorsi di adattamento/resistenza alle nuove regole di competizione. Attraverso quindici interviste qualitative emerge che la didattica è considerata un elemento di ancoraggio: le intervistate percepiscono il rapporto diretto con gli studenti come indispensabile al raggiungimento della soddisfazione professionale, o considerano l'investimento in questo ambito come una potenziale porta di accesso alla carriera accademica. Alcune hanno subito richieste pressanti sia per l'espletamento di compiti di didattica sia amministrativi.

Abstract:
Mansions and individual residential houses of the early XX century form the basis of the historical center of Novocherkassk. The building of the city harmoniously combines features of traditional Cossack housing and adherence to the capital's architectural fashion, imitation of St. Petersburg. The history of the formation of the city, the social structure of the population, economy and culture determined the features of its architecture. In preparing the article, the methods of field and historical archival research, comparative analysis of works and their details, the method of analogies are used. A comprehensive analysis of typical objects – the mansion of G.M. Salnikov, the Shamarins' mansion, the house of the ataman A.V. Samsonov, residential buildings of the military master V.A. Ratchenkov and the сossack I.A. Suslova. The space-planning, compositional, architectural and artistic features of Novocherkassk mansions and residential buildings in the 1900–1910 s are identified. The authors present the patterns of location of two types of housing in the structure of the city. The tendencies of the Art Nouveau style in the mansions are revealed. A comparative analysis of the functional planning organization and artistic-figurative solution of the Cossack kuren and the city dwelling house is carried out. The study shows the influence of two trends on the residential architecture of Novocherkassk in 1900–1910 – the capital's professional design practice and the local folk tradition.

Il Veneto è stato caratterizzato nel corso degli ultimi dieci anni da consistenti flussi migratori interni e internazionali. Si tratta di una forza lavoro che si è inserita in vari settori produttivi sovente in mansioni a bassa qualificazione e assunta con maggiore frequenza, rispetto ai locali, attraverso contratti non standard. Se i lavoratori meridionali sono talvolta solo temporaneamente residenti nell'area veneta, i lavoratori stranieri tendono a risiedere in modo semi-permanente. La distinzione principale tra questi due segmenti di forza lavoro è che gli immigrati interni giungono talvolta attraverso imprese di appalto o agenzie di lavoro collocate nell'Italia meridionale, mentre i lavoratori stranieri vengono più spesso assunti direttamente dalle imprese venete o tramite agenzie di lavoro comunque collocate nella regione. L'analisi si sofferma sull'inserimento differenziato di immigrati meridionali e stranieri nel sistema produttivo e sulla presenza diffusa di forza lavoro solo temporaneamente residente, con un interesse relativo rispetto al sistema occupazionale locale. L'articolo quindi analizza l'inserimento di lavoratori immigrati con particolare attenzione alle forme contrattuali, ai rapporti lavorativi instaurati e più in generale alle condizioni di lavoro.

Abstract:
While visual emerges as a concept based on seeing in a narrow sense, it defines everything that can be seen with a broader meaning. The idea of seeing is not limited to taking images only by the eye, but also includes the interpretation of images by the brain. Mansions that are used in a television series shot in Turkey are presented to the viewer as a visual narrative text. In this context, these mansions are intended to be read semiotically. In the study, the placement of the mansion building style, which has an important place in Turkish culture, as a visual space and the meanings attributed to it are examined. Based on Panofsy's method of semiotic iconographic analysis, the use of these mansions is discussed in the context of the semiotic narrative. The narratives that exist through the meaning and visual narrative in which Turkish society has positioned the traditional living environments, as well as the narratives that it tries to place in the audience, are tried to be evaluated.

Abstract:
La tesi ha affrontato il tema classico dello jus variandi del datore di lavoro, che come noto è disciplinato dall’art. 2103 c.c. La necessità di occuparsi oggi del tema è scaturita dal fatto che, dopo nove lustri, la relativa disciplina è stata recentemente interessata da importanti novità. Infatti, con l’art. 3, d.lgs. n. 81 del 15 giugno 2015, il legislatore ha proceduto alla completa riscrittura dell’art. 2103 c.c. L’elaborato si è mosso dunque su due piani sovrapposti: da un lato, si è proceduto alla lettura e all’esegesi del nuovo art. 2103 c.c. e alle più rilevanti questioni ermeneutiche ad esso connesse; dall’altro lato, si è cercato di volta in volta di analizzare la tecnica utilizzata dal legislatore delegato e di raffrontarla con quella dell’art. 13 S.l. La tesi si è proposta di dare una sistematizzazione delle risposte già date nel tempo dalla dottrina e dalla giurisprudenza sulla materia, oltre ad offrire un’elaborazione di nuovi quesiti; di ragionare criticamente sulla portata delle recenti novità introdotte; di evidenziare le differenze rispetto alla disciplina previgente; di stabilire in che misura un’ampia derogabilità dell’art. 2103 c.c. ad opera della contrattazione collettiva e dell’autonomia individuale possa aprire la via ad una rifondazione dogmatica dell’intera materia e ad una destrutturazione della legislazione lavoristica così come è stata concepita fino ad oggi. L’indagine è stata suddivisa in tre capitoli. Nel primo capitolo, dopo un breve excursus storico, ci si è concentrati sulle criticità dell’equivalenza professionale, quale criterio ordinatore della materia, che hanno portato alla sua eliminazione a favore di un nuovo criterio, individuato nelle mansioni riconducibili allo stesso livello e categoria legale di inquadramento rispetto alle ultime effettivamente svolte. Si è poi passati all’esame degli antecedenti dell’art. 3, d.lgs. n. 81 del 2015. In particolare, ci si è soffermati su due antecedenti normativi: l’art. 52, d.lgs. 165 del 2001 e l’art. 8, l. n. 148 del 2011. Si sono analizzati i nuovi limiti previsti per l’esercizio dello jus variandi orizzontale. Successivamente, si è cercato di capire il nuovo ruolo che è chiamata a svolgere l’autonomia collettiva. Infine, si è individuato il bene giuridico tutelato dalla nuova disposizione e il rapporto tra legge delega e provvedimento delegato. Nel secondo capitolo, dedicato alla mobilità verso il basso, si sono esaminate le tre ipotesi di demansionamento che possono verificarsi in due contesti differenti, quale conseguenza dell’esercizio dello jus variandi del datore di lavoro (commi 2, 4) o di un accordo modificativo non solo delle mansioni ma anche della categoria legale e della retribuzione (comma 6). In conclusione del capitolo, si analizzeranno i residui casi di “demansionamento” vietato e la tutela contro l’illegittima adibizione a mansioni inferiori. Nel terzo ed ultimo capitolo si è studiato lo jus variandi verso l’alto. Nello specifico, la disamina si è occupata della continuità e discontinuità con la disciplina previgente, per poi concentrarsi sull’assegnazione temporanea e sulle ragioni che giustificano l’assegnazione definitiva alle mansioni superiori. In particolare, ci si è focalizzati sull’inedito spazio dato alla diversa volontà del lavoratore, ossia al rifiuto della promozione da parte di questi. Il capitolo si è concluso con una breve trattazione sul risarcimento del danno da mancata promozione e da perdita di chance e sulle loro differenze.
The thesis is about the classical theme of the emplojer's jus variandi, that is disciplined by the art. 2103 c.c. Necessity to deal with this theme has sprung from the fact that the relative discipline has been interested by important news. In fact with the art. 3, d.lgs. n. 81 of June 14 th 2015, the legislator has proceeded to complete rewrite art. 2103 c.c. The elaborate has moved on two superimposed levels: o the one hand, I have proceeded to analyzed the new article 2103 c.c.; on the other hand, I tried to analyze the tecnique used by legislator. The thesis has been proposed to give a systematization of the answers already given by the doctrine and jurisprudence on the subject, as well as offering a new questions elaboration; to critically discuss the extent of the recent innovations introduced; to highlight the differences compared to the previous legislation; to establish to what extent a broad exceptability of the art. 2103 c.c. by collective bargaining and individual autonomy, it can open the way for a dogmatic refoundation of the whole subject and a deconstruction of labor legislation as it has been conceived to date. The thesis is divided in three chapters. In the first chapter, I wrote about horizontal jus variandi; the second chapter is about jus variandi in pejus and the last one is about promotion.

L’elaborato è volto ad analizzare le principali problematiche relative al ricorso da parte del singolo lavoratore all’autotutela, quale strumento finalizzato alla salvaguardia dei diritti di quest’ultimo e a garantirne l'effettività, in alternativa al ricorso giudiziale. Dopo aver effettuato una generale rassegna delle caratteristiche dell’istituto all’interno del diritto civile, l’opera passa ad esaminare le ricadute sistematiche dell’autodifesa ove sia invocata all’interno di un contratto di lavoro subordinato da parte del prestatore di lavoro, in reazione a un utilizzo abusivo dei poteri datoriali. La parte finale è dedicata a verificare se il rimedio contrattuale basato sull’art. 1460 c.c. possa costituire uno strumento prezioso per contrastare, in particolare, demansionamenti ingiustificati o, in ogni caso, la violazione della normativa in materia di modifica delle mansioni, dopo la riforma dell’art. 2103 c.c. L’obiettivo dell’operazione consiste nel trovare un bilanciamento fra le prerogative imprenditoriali e la dignità professionale dei lavoratori, mediante l’uso delle clausole generali della buona fede e correttezza e alla luce della rilevanza della protezione del lavoro nella Costituzione italiana.
The essay aims to analyze the main problems related to the use of individual worker’s self defense, as a measure finalized to protect his rights and to enforce their effectiveness, as an alternative to a legal action in Court. After making some general remarks about the issue in civil law, the work moves on to examine the systematic effects of self defense, whenever it is used in employment contract by the employee to justify the refusal of job performance as a response to the unlawful use of employer’s powers. The final section is dedicated to check if the contractual remedy based on article 1460 of the civil code could be a useful tool particularly to counteract unjustified demotions or the breach of the regulation of the change of tasks after the reform of the article 2103 of the civil code. The research’s goal is to find a balance between managerial prerogatives and the human dignity and professionalism of workforce, using the general clauses of good faith and fair dealing, also considering the importance of Labour protection in the Italian Constitution.

Il lavoro ha lo scopo di approfondire gli aspetti legati all’obbligazione di facere del lavoratore, ovvero le mansioni che questo deve svolgere e per cui è stato assunto, e in particolare le vicende modificative che le riguardano. L’analisi parte da una visione della normativa di riferimento (art. 2103 c.c.), fino ad arrivare ad affrontare le questioni legate alla violazione della norma civilistica (il c.d. demansionamento) e le vicende che ne conseguono. L’elaborato ha come punto di riferimento l’orientamento della dottrina e della giurisprudenza, il quale oscilla da una posizione rigida dettata dal garantismo, ad una più flessibile e dinamica. Infine, si affronta il recente intervento legislativo (Jobs Act) che ha portato alla rivisitazione e modificazione della disciplina sulle mansioni.

Abstract:
La tematica delle mansioni, nel lavoro privato subordinato, rappresenta uno dei nodi più critici ed articolati della intera disciplina del diritto del lavoro. Essa, invero, si rende protagonista della principale vicenda di ogni contratto di lavoro: la prestazione lavorativa. La norma di riferimento, l’art. 2103 Cod. Civ. così come novellato dall'art. 13 dello Statuto dei Lavoratori, dispone che l’attività del soggetto lavoratore deve attenersi unicamente ai compiti (o meglio, al modello di prestazione) per cui è avvenuta la sua assunzione, condizionando poi, il suo spostamento, alle sole mansioni equivalenti o superiori sul piano concreto della professionalità. E’ questo il bene che la norma si prefigge principalmente di tutelare, in tal senso viene apposto il divieto di adibire il prestatore a mansioni inferiori (il cosiddetto demansionamento). Il cui precetto, nonostante trovi un'esplicita conferma nel secondo comma dell’articolo in questione, si nota come nel corso degli anni sia stato più volte disatteso dalla stessa legislazione ovvero dalla giurisprudenza. In alcuni casi, per garantire ai prestatori di lavoro la piena soddisfazione di beni costituzionalmente protetti (la salute, l’occupazione); in altri invece, per far recuperare alle aziende margini di flessibilità sempre più vitali, per far fronte alle minacce ed opportunità dell’ambiente esterno. Di fatto rendendo ancora più incerta e dibattuta la possibilità di rinvenire, nella qui presente materia, una regola generale da adottare in ordina a qualsiasi circostanza rilevante le mansioni.

L’obiettivo della tesi è quello di analizzare gli effetti dell’introduzione dell’articolo 3 del decreto legislativo 81/2015 (“Disciplina delle mansioni”) sul rapporto di lavoro subordinato nelle imprese private. Nel primo capitolo si esporranno i concetti di mansione, qualifica e categoria. Nel secondo capitolo, attraverso una analisi differenziale tra la nuova disciplina delle mansioni e la precedente, contenuta nell’articolo 2103 del Codice Civile, si evidenzieranno i principali cambiamenti apportati dalla riforma. Nel terzo capitolo si tenterà di studiare come è cambiato il concetto di tutela della professionalità del lavoratore e se abbia ancora rilevanza il concetto di demansionamento. Infine si proverà a fornire una risposta alla questione se le aperture della riforma favoriscono maggiormente il lavoratore o le esigenze di flessibilità dell’impresa.

Il presente scritto intende analizzare la nuova disciplina delle mansioni del lavoratore, introdotta dall’art. 3 del decreto attuativo del Jobs Act, il d.lgs. n. 81/2015, il quale ha riscritto buona parte dell’art. 2103 del codice civile. La nuova disciplina consente al datore di lavoro di superare il divieto di demansionamento: il prestatore di lavoro potrà infatti, diversamente da quanto precedentemente previsto, essere adibito a mansioni inferiori sia quando sussiste una modifica degli assetti organizzativi che incide sulla sua posizione, sia nel caso in cui manifesti il suo consenso, sia, ancora, nei casi ulteriori previsti dalla contrattazione collettiva. Alla luce dell’importante novità legislativa, la tesi si propone di analizzare l’evoluzione normativa lavoristica in tema di mansioni, per poi concentrarsi sulla novità del Jobs Act, ricostruendo il dibattito sul tema, alla luce delle critiche e delle preoccupazioni sollevate in ambito dottrinale, e per le novità in tema di demansionamento, e, in termini più generali, per le scelte di un legislatore (spesso in eccesso di delega) sempre più attento alle ragioni dell’impresa, anche a discapito dei diritti del lavoratore in nome delle esigenze sempre maggiori di flessibilità organizzativa e gestionale.

The Historic John and Landon Carter Mansion, a satellite property of Sycamore Shoals State Historic Area in Elizabethton, Tennessee, is one of Tennessee's earliest historic homes. Because the house is not open year-round, the state park service has expressed a need for an interpretive kiosk to stand on the property and provide visitors with information on the Carter Mansion. This project represents an effort to summarize existing knowledge on the house, to address common misconceptions, and to create an interpretive kiosk design based on historical research.

Abstract:
This study analyzes the effects of gender stereotypes on women gubernatorial candidates in the post "Year of the Woman" era to determine whether or not the electoral gains made by women running for legislative office in 1992 also extended to women contesting executive elections in subsequent years. This study proceeds in two parts. The first part of this study provides an empirical analysis of contextual and candidate specific factors thought to affect the way in which gender stereotypes surface during gubernatorial campaigns and how they affect women candidates accordingly. The contextual factors include state culture, party dominance, and tradition of electing women in each state. Candidate specific factors include prior campaign and or office holding experience. The second part of this study adopts a case study approach and focuses on two gubernatorial elections – New Jersey and Virginia – to provide a more detailed examination of how gender stereotypes emerge when women are candidates for governor. The findings from the empirical analysis show that women are more likely to contest gubernatorial elections that are Democratic in their partisanship and non-traditionalist in their political culture. However, these variables did not explain whether women were successful in winning gubernatorial elections. The second part of the analysis expanded on these findings by examining the dominant role gender stereotypes played in a traditionalistic state (Virginia) and the minimal role they played in a non-traditionalistic state (New Jersey). Generalizations were made based on the findings that indicate the importance of the campaign in light of contextual factors and how this affects women candidates in executive elections. Recommendations for a future research agenda regarding elections in which women are candidates for various levels of office are also discussed.

In this collection of work there is a discernible connection to the act of correspondence--both in the sense of a literal examination of the letters of Emily Dickinson to T.W. Higginson, but also in the metaphorical sense of a correspondence between time and place, form and content. Much of this examination is arrived at through erasure, although a good deal of its unfolding is happened upon through an exploration of the sonnet form. Latent in my engagement with both of these forms are questions about the materiality of language as it encounters the subjectivity of memory; they both strive to balance an interior perception of memory that is not anterior to the truth of its experience, or to quote Wallace Stevens, "[to] speak by sight and insight as they are," to the end of locating "the words of the world that are the life of the world."

The aim of this study is to understand what was changed in a Levantine mansion in the Buca district of Izmir, from its construction date to now. Since the construction date is 1876, the study is scoped into a 150 years period in time. The data collection method includes photographic documentation and laser measurements. The evaluation method is comparative analysis to relate the common properties of Levantine houses with the plan typology and the traces in the building. A short periodization and descriptions of each space have been made. The mansion had not experienced radical changes, even if there were handovers in the property ownership. However, it can be analysed by considering small differences. In conclusion, the building is periodized in three-time slices as the 1. Period in the years between 1876 – 1890 / 1895, the 2. Abstract:
Chateaus (castles) and mansion houses (residences) are a common part of village and town settlements in our conditions in the Czech Republic. Due to the interruption of ownership and property relations to these buildings during the 20th century, many of them lost their original or additional useful purpose, were abandoned and fell into disrepair and ruins. Nowadays, these chateau and mansion houses wish regeneration and renewal, and they have thus become an important historical, urban and social element in the development of the territory and cultural landscape. Due to the absence of a theoretical definition of this type of brownfield, the intention of this paper is to try to do this through a synthesis of expertise in the field of brownfields and the historical context of the existence of chateaus (castles) and mansions and grounds (areas). The intention is also to identify the historical milestones that contributed to the formation of the castle brownfields. The findings are inductively generalized in the created conceptual scheme of the genesis and restoration of chateau and mansion brownfields. The term castle brownfield was defined and the main historical milestones were emphasized, which significantly contributed to the emergence of this type of brownfield in the Czech Republic.
