AbstractIn this paper, I am concerned with understanding the recent efforts to reform the laws governing marriage and inheritance, the code de la famille or the Family Code in Mali. Since the advent of multiparty elections in the 1990s, prominent members of the Malian government and civil servants, Malian women's rights activists, secular NGOs, and international and bilateral donors have made efforts to promote various social reforms, including the advancement of women's rights and the promotion of gender equality, particularly through changes in the Family Code. While some observers have attributed the lack of reform to the increased influence of “Islamists” and/or to religiously conservative Muslims, I draw on historical research and ethnography to propose an alternative reading of the lack of institutional law reform. As I argue, the gap between Malian civil law relating to the family and the lived experiences and social practices of many Malians, who are overwhelmingly Muslim, has become even more apparent in this era of political liberalization and promotion of global human rights discourses. This has helped to make such proposed social reforms as the promotion of women's rights and family law reform more contentious and the ultimate outcome even more uncertain.

Abstract:If the sudden downfall of Mali’s officially democratic system in early 2012 surprised many observers, the failings of the Malian state—including public disaffection with the political process, weak rule of law, and inadequate delivery of basic services—were widely known both at home and abroad. Focusing on activists based in Bamako, this article assesses Malian civil society’s response to these challenges since the March 2012 military coup and considers prospects for wider political engagement by the Malian public.

In a press release during the television news on the Malian television, Colonel Abdoulaye Maïga, government’s spokesperson, announces the rupture of the defense agreements with France. This denunciation, carrying out a threat that has been agitated for months, constitutes a new manifestation of the deterioration of relations between the authorities dominated by the soldiers who came to power by force in August 2020 and the former allies of Mali in the fight against the jihadists. Thus, the objective of this article is to report on the effects of the violation of the independence, power and autonomy of the Malian state by France. Starting from this objective, the problem statement to which this reflection invites is the following: what is the impact of the in observation of Malian sovereignty by France? This question is justified in view of the mutations or transformations of the law of international relations leading to the erosion of Malian sovereignty. By mobilizing legal casuistry, the hypothesis of this analysis is as follows: Malian sovereignty has more or less been affected and infected following French military espionage. On this basis, we arrive at two results, namely: first, the re-examine of the concept of sovereignty in context with regard to benevolence in the field of the law of international relations and, subsequently, the fragmentation of the law friendly relations between states through control over the internal activities of a state.

In early twentyfirst-century Mali, anxieties ran rampant among senior men who feared losing their status and privileges. These anxieties came to a head during efforts by the Malian government and civil-society groups to eliminate gender discrimination from Malian family law in the early 2000s. A broad coalition of patriarchal interests emerged to defend senior males' prerogatives against the perceived threats posed by gender equality. This backlash challenged the legitimacy of Mali's governing elite and exposed its weaknesses in the run-up to Mali's 2012 political collapse.

Located in Africa’s Sahel region, the Republic of Mali enjoyed various fruits of its transition to political pluralism and liberal economic restructuring from the 1990s to the early 2000s. When the Malian government sought to amend civil laws governing marriage and family life, and eliminate legal discrimination against women, however, it faced considerable political opposition. Islamic civil society groups capitalised on men’s heightened anxieties to claim a more assertive role in the national public sphere. Subsequent legal reforms constituted a clear political victory for political Islamism in the country and a corresponding setback for Western-backed women’s organisations. Tracing the evolution of Malian marriage and family law from the 1960s to the 2020s, this article argues that conflicting notions of what it means to protect women, coupled with the structural failings of Mali’s post-colonial state, have stymied efforts to ensure women’s rights within a secular, egalitarian legal framework.

Abstract:
The loessial tableland is a unique landform type on the Loess Plateau in China. Long-term soil erosion has led to the retreat of gullies and the rapid reduction of fertile arable land, which has further decreased agricultural production. In this study, we chose the Malian River basin to analyze the temporal and spatial variation of its runoff and sediment load, as well as the potential causes. The annual runoff and sediment load at six hydrological stations in the study area were collected for the period between 1960 and 2016. The Mann−Kendall and Pettitt tests were respectively applied to detect temporal variations and abrupt changes in the runoff and sediment loads. The results showed that an abrupt change in the runoff and sediment loads occurred in 2003. The average annual runoff in the Malian River was 4.42 × 108 m3 yr−1 from 1960 to 2002, and decreased to 3.32 × 108 m3 yr−1 in 2003–2016. The average annual sediment load was 1.27 × 108 t yr−1 in 1960–2002, and decreased to 0.65 × 108 t yr−1 in 2003–2016. The spatial patterns in the sediment load suggested that the Hongde sub-basin contributed a higher sediment count to the Malian River, which may require additional attention for soil and water conservation in the future. Anthropogenic activities significantly affected runoff and sediment load reduction according to the double-mass curve method, accounting for 90.7% and 78.7%, respectively, whereas rainfall changes were 9.3% and 21.3%, respectively. As such, the present study analyzed the loessial tableland runoff and sediment load characteristics of the Malian River basin for soil and water erosion management.

Mali is a developing country that has marked inequalities between genders. Using the 2012-2013 Mali Demographic and Health Survey, a nationally representative sample of Malian women ( N = 2,527), the study examined the effect of controlling behaviors, childhood exposure to and experience of violence, husband’s alcohol use, woman’s use of violence, and sociocultural factors on the likelihood of experiencing physical and sexual abuse. Findings indicated that controlling behavior, childhood exposure to violence, and husband’s use of alcohol were predictors of physical and sexual abuse. Respondent’s use of violence increased risk of physical abuse. Implications for programming in Mali are discussed.

La République du Mali est une ancienne colonie française. De ce fait, il existe de ressemblances entre le droit français et le droit malien quant au niveau de la définition de la responsabilité, qu’elle soit pénale ou civile, applicable en matière médicale et les sanctions y afférentes. Mais dans la pratique, l'application de ces notions ne se fait pas de la même façon dans les deux pays. Cette différence dans l’application s'explique par des raisons sociales, culturelles et économiques. Pour illustrer les points de convergences et de divergences entre ces deux systèmes juridiques, nous avons analysé la responsabilité médicale dans les deux pays sur la base des dispositions pénales, civiles et déontologiques. A l’issue de cette étude, nous avons fait des suggestions pour améliorer le droit malien à l’image du droit français qui a connu d’énormes évolutions. Nous avons proposé également l’adoption d’un code qui traitera de mieux tous les aspects de la responsabilité médicale, en tenant compte de la médecine traditionnelle
The Republic of Mali is a former French colony. Consequently, there are similarities between French and Malian law as regards the level of the definition of liability, whether criminal or civil, applicable in medical matters and the corresponding penalties. But in practice, the application of these notions is not done in the same way in both countries. This difference in application is due to social, cultural and economic reasons. To illustrate the points of convergence and divergence between these two legal systems, we have analyzed medical liability in both countries on the basis of criminal, civil and ethical provisions. At the end of this study, we made suggestions to improve the Malian law in the image of French law which has undergone enormous changes. We have also proposed the adoption of a code that will better address all aspects of medical liability, taking into account traditional medicine

Cette thèse se propose de mettre en exergue les difficultés relatives à la coexistence au sein du droit malien de trois corps de règles successorales applicables (loi, droit religieux et droit coutumier : un pluralisme juridique issu de la Loi n°2011-87 AN/RM du 30 décembre 2011 portant Code des Personnes et de la Famille). Il s’agit alors de réfléchir aux solutions envisageables pour faire fonctionner le pluralisme juridique malien qui se caractérise par une absence de clarté. Outre les difficultés relatives à la recherche du droit successoral applicable en droit interne malien, cette thèse met également l’accent sur les difficultés liées à l’application du droit malien, spécialement ses règles religieuses et coutumières, au regard des dispositions fondamentales de la Constitution malienne et les traités internationaux ratifiés par la République du Mali. Ainsi, après avoir montré l’existence d’un conflit interne de lois et les insuffisances des systèmes de solutions aux conflits, cette thèse propose de le résoudre par le renforcement du rôle de la volonté individuelle. Pour l’application des règles religieuses et coutumières, la thèse propose l’institution d’une clause d’ordre public en droit interne afin de permettre au juge malien d’écarter les règles traditionnelles manifestement contraires à certains principes du droit moderne. Les difficultés auxquelles le droit malien est confronté dans le contexte interne peuvent surgir également sur le plan international lorsqu’une succession internationale impliquant un ressortissant malien est ouverte en France ou soumise à un notaire ou un juge français. Les maliens voyagent beaucoup et nombreux sont ceux qui choisissent la France comme pays de leur résidence. Le règlement de leur succession qui aura un caractère international, nécessite la mise en œuvre des règles de conflit de lois françaises afin de désigner soit la loi française soit la loi malienne en fonction des rattachements retenus. Avec l’entrée en application du Règlement (UE) n° 650/2012 du 4 juillet 2012 relatif à la compétence, à la loi applicable, à la reconnaissance et l'exécution des décisions, à l'acceptation et l'exécution des actes authentiques en matière de succession et à la création du certificat européen, l’application du droit malien en France peut être assez fréquente du fait notamment du choix de loi possible ou en cas de dernière résidence habituelle du défunt au Mali alors même que l’ouverture de la succession se ferait en France du fait de la présence d’héritiers (enfants ou conjoint survivant). En cas de désignation du droit malien, deux difficultés majeures se posent : l’identification du droit interne malien qui sera finalement applicable et l’application en France de certaines règles religieuses et coutumières désignées. Cette situation amène à réfléchir sur les risques de contrariété possible du droit malien avec les exigences liées à l’ordre public international français, notamment aux droits fondamentaux et donc sur les risques de mise à l’écart du droit malien en France
Focusing to highlight the challenges associated to the coexistence within the Malian Law of the three sets of applicable inheritance rules (statutory law, religious law and customary law) and to contribute to resolving internal conflicts of law between codified law and competing normative systems. The goal is to reflect on possible solutions to make Malian legal pluralism work, which is characterized by a lack of visibility and clarity. In addition to the difficulties when it comes to identifying inheritance law under Malian domestic law, this thesis also emphasizes the challenges linked to the application of Malian law, particularly its religious and customary rules, first within the Malian context, considering the fundamental provisions of the Malian Constitution and international treaties ratified by the Republic of Mali. Therefore, after showing the existence of internal conflicts of law and the shortcomings of the current conflict-resolution systems, this thesis proposes offers strengthening the role of individual will in matters of religious and customary. This thesis suggest introducing a public order clause into domestic law to allow Malian judges to exclude traditional rules that are manifestly contrary to certain principles of modern law. This challenge faced by Malian law in the domestic context may also rise internationally when an international inheritance involving a Malian national is opened in France or handled by a French notary or judge. Many Malians travel and a many of them choose France as their country of residence. The settlement of their succession, which will have an international character, requires the application of French conflict of law rules to determine whether French law or Malian law should apply, depending on the relevant connections with the entry into force of Regulation (EU) No. 650/2012 of 4 July 2012, on jurisdiction, applicable law, recognition and enforcement of decisions, the acceptance and enforcement of authentic instruments in matters of succession, and the creation of European Certificate of Succession. The application of Malian law in France may become more frequent, particularly due to the choice of law option or if the deceased’s last residence was in Mali, even if the succession is opened in France, due to the presence of heirs ( children or surviving spouse ), or because of the principle of unity of the estate which governs the regulation process. The conflit of law rules, whether from national or European sources, designate Malian law as applicable in an international inheritance case, two major challenges arise : identifying the Malian domestic law that will ultimately apply and applying certain religious or customary rules in France. This situation leads us to consider the potential conflict between Malian law and the requirements of French international public order, especially regarding fundamental rights and therefore the risk of Malian law being set aside in France

Cette thèse se veut à la fois critique et pragmatique. Critique de l’histoire récente du Mali lue à l’aune des outils procurés par l’analyse juridique, la sociologie et l’anthropologie du droit. Cette intention critique a conduit à interroger l’histoire du Mali des origines dans une perspective génétique qui a été détaillée dans les prolégomènes. Pragmatique, la thèse formule des propositions rattachées à la situation concrète du Mali, allant dans le sens d’un décloisonnement des consciences et de la restauration des normes constitutives de la République malienne. C’est à la satisfaction de ces deux impératifs que les analyses du langage ont été utiles. Elles ont également permis d’identifier certaines insuffisances de la dogmatique juridique généralement soucieuse de plaquer des concepts préfabriqués sur les réalités africaines, que de saisir au plus près ces réalités avec leurs nuances. Il est donc apparu opportun pour y parvenir de procéder à l’analyse des stratégies des acteurs ordinaires de la société politique malienne. La prise en considération des concepts manipulés par ces derniers explique le recours aux langues autochtones. La première partie de la thèse est consacrée à l’analyse du développement chaotique du Mali après l’abandon du projet des pères de l’indépendance sous la double pression des contraintes économiques et des déterminants culturels. La seconde partie en tire les conséquences du point de vue de la théorie constitutionnelle. C’est la raison pour laquelle la thèse s’achève sur la proposition d’une réforme du système de l’unité africaine inspirée, à l’image de tout ce qui précède, d’un dicton de la langue bambara : « Dormir sur la natte des autres, c’est comme si l’on dormait par terre »
This thesis is both critical and pragmatic. A criticism of Mali’s recent history read in the light of the tools provided by the legal analysis, sociology and anthropology of law. This critical intent led to examine the history of Mali’s origins in a genetic perspective that has been detailed in the prolegomena. Pragmatic, the thesis puts forward proposals related to the concrete situation of Mali, along the lines of a deregulation of consciences and the re-introduction of constitutive standards into the Malian Republic. The language analysis proved valuable in meeting these two requirements. They also enabled to identify some shortcomings in legal dogma generally more anxious to graft prefabricated concepts onto African realities, rather than capture these realities with their nuances as close as possible. It therefore seemed appropriate to analyze the strategies of ordinary actors of the Malian political society. The consideration of the concepts handled by these latter accounts for the use of indigenous languages. The first part of the thesis is devoted to the analysis of Mali’s chaotic development in the aftermath of the relinquishment of the fathers’ project of independence under the double pressure of economic constraints and cultural determinants. The second part draws the relevant consequences from the point of view of constitutional theory. Thus, the thesis concludes with the proposal for reform of the system of African Unity based, upon as all the above, Bambara language’s saying : “Sleeping on the mat of others is like sleeping on the floor

Abstract:
This thesis places malice at the centre of an account of criminal law jurisprudence. Malice is a well-known subject and object of criminal law. In legal materials, the concept of malice has had a consistent relationship with that which is bad, blameworthy, culpable and/or undesirable. An exploration of how malice has been organised and expressed is one way of analysing legal ideas of wickedness. Legal constructions of malice have varied across time, place and offence category. I analyse legal constructions of malice in homicide legal doctrine from the 13th century onwards. The thesis makes two gestures. The first is reconstructive. In contemporary jurisprudence malice is disregarded, ignored and trivialised. I reconstruct malice both historically and in contemporary criminal law. This also resuscitates the relationship of criminal law with morality. I reconstruct (part of) the substance of what it means to be bad or wicked in jurisprudence. My intervention is thus therapeutic — through care, I restore malice and its history to the law.

The problem with the corroboration requirement in sexual offences is that it is based on an improper foundation. The proffered rationale, that most complainants lie about sexual offence allegations, cannot be verified from empirical data. Regardless of this fact, due to the rule’s existence, the standard of proof in sexual offence cases is unnecessarily raised above that which normally obtains in other criminal cases, causing convictions in sexual offences very hard to come by. The rule is found to be only premised on discrimination against women. Such being the case, the rule runs counter to the current Constitutional order which is founded on principles of equality before the law, non-discrimination and the dignity of all persons. It is also against the Constitutional commitment of offering women full and effective protection. This paper advocates that such an evidential rule is undesirable for it serves no useful purpose in the adjudication of sexual matters and that the rule is unfairly discriminatory against women and unconstitutional in the present Malawi constitutional regime. It further advocates that the rule should be abolished both by judicial pronouncement and legislatively. Since the corroboration requirement is a common law rule, lessons will be drawn from comparative common law jurisdictions which used to have the rule but have now abolished it, such as South Africa, Namibia, the State of California, Canada and England.

In July, 2013 Malawi enacted a new Companies Act [Act No. 15 of 2013] replacing the old Companies Act 19 of 1984. The Companies Act, 1984 was basically an adoption of the English Companies Act, 1948 and in line with the English law, it regulated distributions through the classical capital maintenance rule. In contrast, the new Companies Act, 2013 which came into force in May, 2016 has jettisoned the capital maintenance rule. As an alternative to that rule, the Act has introduced for the first time in Malawian company law edifice, the concept of the solvency test. Jurisdictions that have adopted the solvency test in their company law essentially have done so on the basis that company law should focus on the core risk at stake – company insolvency, and that it is meaningless to state that creditors look to the company's capital as a trust fund out which their debts would be settled. Despite having the same theoretical basis for adopting the solvency test, the manner in which the solvency test is defined and applied in a particular statute has significant effects on whether in its operation, the test affords adequate protection to the interests of creditors. This research examines the definition and application of the solvency test under the Companies Act, 2013 so as to determine whether in its operation as a financial restriction for distributions and other company transactions, it will afford adequate protection to creditors. It follows the approach used by Professor Kathleen Van der Linde in her analysis of the solvency and liquidity approach in the Companies Act, 2008. Thus, it analyses the Malawian law by focusing on the two separate elements of the test (equity solvency and balance sheet solvency) as well as other aspects of the test which are likely to raise legal interpretation issues. The twin solvency test adopted in different jurisdictions ordinarily varies in its balance sheet solvency element. Some jurisdictions such as South Africa and New Zealand utilise the net assets approach in their balance sheet test. Others such as New York and Delaware still emphasise on the trust fund doctrine and thus utilise stated capital in their balance sheet test. Malawi is a stated capital/surplus jurisdiction. Its new solvency based regime still focuses on the meaningless trust fund doctrine. The new solvency test approach in Malawi is incomplete and inadequate to fully protect creditors against opportunistic shareholder behaviour. A number of recommendations are made for an effective solvency test approach that will afford adequate protection to creditors against opportunistic shareholder behaviour.

Middle Horizon Textiles: Evidence from Huaca Malena, Asia ValleyArchaeological research was undertaken in 1997 at Huaca Malena in the Asia valley of Peru's south central coast, under the auspices of the Asia Municipal Government. The archaeological complex consists of an Early Intermediate architectural complex that has a huge Middle Horizon Epoch 2B and 3 cemetery intruded into its upper platforms. These intrusive tombs consist of circular pits containing several individuals. Textile wrappings on the bodies reveal a stratified society in which elites possessed extremely fine weavings characterized by Wari iconography reminiscent of the Conchopata and Atarco ceramic styles. Also associated, however, are textiles from other regional traditions, providing a new and broader vision of Middle Horizon societies.
Bajo los auspicios de la Municipalidad de Asia, en 1997 se realizaron estudios en el sitio denominado Huaca Malena, valle de Asia, costa sur-central del Perú. Esta es una construcción del Periodo lntermedio Temprano, sobre cuyas plataformas superiores se emplazó un gran cementerio correspondiente a las épocas 2B y 3 del Horizonte Medio. Las tumbas intrusivas son de planta circular y contienen varios individuos. Los fardos funerarios reflejan una sociedad estratificada cuyos contextos de elite contienen finísimos tejidos con iconografía wari, que recuerda a La cerámica de los estilos Conchopata y Atarco. Asociados a estos, igualmente, aparecen tejidos relacionados a otras tradiciones regionales y locales, lo que permite obtener una visión más amplia de las sociedades del Horizonte Medio.

A basic unit of any society, the family is one of the structures to which the right has given more consideration both in terms of the protection of the family institution and the vulnerable members of it. However, this protection is sometimes ineffective to the extent that it often harms the victim more than it protects the victim, hence the interest of our thesis, which aims not only to study behaviour that harms the family as a whole, but also to devote a significant part to the classification and treatment of family offences and, finally, to propose concrete solutions drawn from the field. The comparative study we are conducting as part of this thesis is to analyze and compare the benefits as the disadvantages of the French legal system, influenced by Catholic law and Malian law which originates in tradition and Islam in order to allow one to correct itself in the image of the other

Este capítulo comienza examinando el limitarismo instrumental de Robeyns y argumenta que esta perspectiva no es limitarista como tal, ya que los valores intrínsecos que promueve son defendidos de mejor manera por otros principios instrumentales. Después, se argumenta que es difícil imaginar una versión convincente del limitarismo intrínseco. Esto se debe a que, primero, las posibles versiones del limitarismo intrínseco sugeridas (aunque no respaldadas) por Robeyns realmente descansan sobre otros valores, lo cual relega al limitarismo al ámbito instrumental. Segundo, una versión del limitarismo basada directamente en la (supuesta) maldad de tener demasiado no es convincente. Subsecuentemente, las perspectivas instrumentales (aparte de la de Robeyns) son revisitadas; sin embargo, también se consideran deficientes. Finalmente, el intento de defender una “presunción limitarista” más limitada es evaluado y rechazado.

The African Court on Human and Peoples’ Rights is the newest of the three regional human rights courts. This brief analysis provides an overview of the most salient aspects of the Court’s 2018 case-law with respect to jurisdiction, provisional measures, admissibility, merits decisions, and reparations orders. Continuing its trajectory of increasing productivity, the Court in 2018 handed down the highest number of merits decisions in its brief history. As in previous years, most of these were fair-trial-related cases against Tanzania. The Court’s 2018 case-law contains a number of firsts. In Gombert v. Côte d’Ivoire, the Court for the first time ruled as inadmissible a case previously settled by an African subregional court, the Court of Justice of the Economic Community of West African States. In Anudo v. Tanzania, dealing with the right to nationality, the Court for the first time found a violation of the Universal Declaration of Human Rights, on the basis that the Declaration has attained the status of customary international law. In Makungu v. Tanzania, it for the first time ordered the applicant’s release as an appropriate remedy for serious fair trial violations. The Court’s most significant decision of 2018 is the Mali Marriage case, in which it held aspects of the 2011 Malian Family Code to be in violation not only of human rights treaties emanating from the African Union, but also the UN Convention on the Elimination of all forms of Discrimination Against Women.

For this purpose a detailed proposal for a general tort of malcompetitive copying will be described in order to show the weaknesses that prevail in a system in which the application of the doc trine of unjust enrichment is modified to protect market participants against unexpected claims. Factual situations will be taken from cases in order to demonstrate how the action provides a sound rationale in the assessment of liability. Consideration will also be given to the remedies that are the result of a successful action. The first part is a recapitulation of the grounds for the action in malign competition where the focus is on the action for free acceptance augmented by constructive knowledge principles to assess liability. The later part is an assessment of the action on a factual case-by-case basis. Abstract:
El "Manual de prácticas de enfermería para sujeción mecánica" se presenta al estudiante con el objetivo de adquirir conocimiento y habilidades en el cuidado integral frente a la realización de una adecuada inmovilización de manera segura y correcta, y así evitar lesiones o eventos adversos que perjudiquen el bienestar o la tranquilidad del paciente. Este documento abarca temáticas como el concepto o la definición de sujeción o inmovilización mecánica, las indicaciones para la realización del procedimiento, las contraindicaciones, el recurso humano que participa, el material utilizado para la sujeción, las consideraciones previas, las precauciones y los principales cuidados y las intervenciones de enfermería durante la contención. Estos temas permiten conocer de manera profunda la adecuada actuación e intervención de la enfermería en la sujeción mecánica o inmovilización al paciente que presenta cualquier condición médica que altere su salud tanto física o mental, y que pone en peligro la vida de la persona que lo rodean. Por lo tanto, es necesario profundizar y entender las prácticas de sujeción mecánica y las formas correctas de su aplicación garantizando la seguridad, el confort y el bienestar del paciente, y de esta manera prevenir los riesgos o las malas prácticas derivadas de estas intervenciones.

Abstract:
El orden de crecimiento de las ciudades es inevitable, pero, se deben controlar y establecer parámetros que permitan una circulación rápida, desde la lógica de las paradas de autobús hasta la programación de los semáforos de tipo autónomos, es decir, que sus tiempos sean cambiantes según sea el tráfico. Una mala organización de estaciones de autobuses puede generar un tráfico de 8 vehículos en 30 segundos para subir o bajar pasajeros (Toledo et al., 2008). Una estructura vial es importante para que una ciudad crezca, ya que estás facilitan el traslado y la comunicación, la estructura vial se debe planificar para que el servicio de la población, y que facilite el traslado de las personas de manera colectiva, particular y el transporte de productos. Es necesario que una infraestructura vial permita que las transacciones diarias se realicen con normalidad y en el menor tiempo posible, además, disminuyendo costos y la contaminación de las ciudades (Litman, 2013). El congestionamiento de vehículos ocasiona pérdidas de tiempo y dinero, incrementa el riesgo de accidentes y las emisiones del efecto invernadero. Al administrar el tráfico de mejor manera se disminuyen del 7% al 12% las emisiones de CO2 (Barth, 2009). Debido a que las TIC´s facilitan muchas transacciones, las sociedades están exigiendo cada vez más una mejor movilidad, el usuario es cada vez más intolerante con las demoras, y la mala calidad de algunos servicios de transporte, el estudio de Bermúdez propone que no es necesario construir más calles si no que se realice una optimización 3 del sistema de transporte actual y el desarrollo sostenible del mismo (Bermudez, 2011). Se puede pensar que ordenar el flujo vehicular es solamente trabajo de las autoridades, gobierno central y municipal, pero actualmente existe una variedad de aplicaciones que buscan disminuir el tiempo de viaje de los usuarios, desarrolladas por empresas o, como una propuesta de solución por parte de la academia.
