Full textSince twenty years, the non-discrimination law continues to enhance specially under the influence of the International and European Law. The multiplication of the norms isn’t however sufficient to achieve the desired effect ; their complexity even makes this law difficult to access for the employees as well as for the employers. The creation of an independent authority (2004), in charge of fighting against discrimination and promoting equality, has strongly contributed to improving the protection overall. The absorption of the Halde by the Defender of rights (2011) could have created a doubt regarding maintaining the objective of fighting against discriminations at work. It is not. The action of this new constitutional authority is involved in the effectiveness of the broad legal spectrum in this area. Evidenced by its contribution to the mobilization and the enhancement of the substantive law and the reinforcement of public action against discrimination in employment, which are probably the largest and therefore significant. If the political question (and constitutional) remains to determine if the the Defender of rights could become a counterpower, it appears that, legally, he helps to enrich the substance of the right of non-discrimination while working on the reinforcement and the multiplication of actions to enabling it’s implementation, especially in employment

Full textFor the past ten years, France has been committed to fighting "racial" discrimination, specifically discriminations based on the genuine or surmised origin of individuals based on their physical features or names. Influenced by EU Law, French legislation has adopted an objective definition of discrimination: direct discrimination that no longer requires an underlying intention to discriminate. Indirect discrimination serves to ensure that otherwise neutral measures do not have a deleterious effect on immigrant and Caribbean populations. Equal treatment can therefore be objectively appraised, which reinforces the effectiveness of the right not to be discriminated against. The admissibility of evidence must evolve to bring more discrimination cases to trial, which is a prerequisite to endow anti-discrimination law with more legitimacy and clarity. At the same time, a strict definition of discrimination creates positive obligations for legal entities to review their selection criteria and processes. It calls for a commitment among public authorities, including through HALDE, to support victims, to raise awareness of anti-discrimination law, and to promote the right to equal treatment. Nevertheless, implementing theses definitions is challenging, specifically in the context of “racial” discrimination. The French background, as well as the Constitutional ban on all discrimination (art. 1), which fully guarantees the right not to be discriminated against on racial grounds and bans the collection of ethnic data, must both be taken into account. Finally, the effectiveness of the right not to be discriminated against may be undermined by the rise of a utilitarian view of diversity

Full textThe respect of aboriginal peoples’ rights over their ancestral territory poses serious challenges for jurists. The challenge is best met by the conclusion of treaties. In Canada, this practice is hindered by the policy of “exchanging” vague rights for clearly defined ones. This policy affronts the aboriginal negotiating party, for whom the process should instead focus on the full recognition of aboriginal rights. The problem is a paradox for the jurist until a historical perspective coupled with a critique of legal thought shows how it results from the encounter between two different conceptions; not only of “aboriginal rights”, but of the very idea of “law”. This encounter is one between legal monism and legal pluralism. Even then, the jurist may feel ill-equipped to address the normative significance of the progressive recognition of the aboriginal juridical order by Canadian and supranational law. The defunct Innu Land Claims Agreement-in-Principle recognized ancestral rights as an expression of aboriginal identity. The Royal Commission on Aboriginal Peoples made “mutual recognition” the touchstone of its recommendations. The centrality of this theme of the “struggle for recognition” suggests that philosophy may provide much-needed guidance. Liberal multiculturalism and the politics of recognition authorize us to pose the hypothesis of a double struggle: for the legal protection of aboriginal legal cultures and for the presumption of their value. Yet, contrary to Charles Taylor, it was not multiculturalism that Axel Honneth had in mind when, at about the same time, he undertook the systematic reactualisation of what passes for a hegelian theme. This thesis presents itself as a philosophical inquiry into a legal problem. It also is a more general inquiry into the relevance of philosophy for the elucidation of legal problems.

Full textTraditionnally regarded as lands of immigration, the United States, Australia and the European Union have gradually closed their borders and are adopting similar policies in the fight against irregular immigration. These three major centers of immigration are trying to find solutions to secure their borders in order to prevent the entry of irregular migrants. In this context, the externalization of migration controls appears to be a relevant complementary method to fight against irregular immigration. The migration controls will no longer take place at national borders but they will be relocated to the territory of a third country or to an area of legal vacuum as the high seas. The countries of emigration and immigration shall cooperate and use the instruments of international law in order to carry out this goal. The complexity of the migration phenomenon and the lack of influence of international law on this field will make this issue particularly tricky. The compatibility of the actions led by the United States, Australia and the European Union will be assessed regarding conventions, customary law and jurisprudence, legal black holes will be revealed and some improvements will be suggested

Full textOn the dawning of the third millennium, democracy is encountering two different challenges. On the one hand, it is shaken by terrorism that flies in the face of the democratic principles and values whilst destabilizing the institutions and threatening citizens touching even the nation itself. Notwithstanding the fact that on the other hand, democracy could be challenged by non-proportional and even excessive measures taken in the context of the fight against terrorism acquitted by certain « democratic » regimes. Thus, under the pretext of countering terrorism, the behavioural pattern of some democratic states undermines the State of law and unveils violations of human rights and fundamental liberties. The current study aspires to investigate the legal infrastructure that conforms to the fight against terrorism away from compromising the principles and values of democracy. For this purpose, the following pages would highlight the dialectic contradiction between two concepts: democracy and terrorism. In fact, the current study treats two hot topics particularly significant. The first of those topics would be the establishment of the Special Tribunal for Lebanon [STL] being the first internationalized with jurisdiction over the acts of terrorism. The second of the above-mentioned topics would be a comparative study treating the current « revolutions » occurring within the Arab States, hence highlighting the need to pursue democracy versus the rise of terrorism in the region. Moreover, this study would exhibit a prospect of the fight against terrorism carried out by countries of the Near East. In addition, this study exposes some conditions by which a « disguised » democracy would be avoided, one that is struck by terrorism, towards an « authentic » democracy, striking with rights
في فجر الالفية الثالثة٬ تواجه الديمقراطية تحديين مختلفين. التحدي الاول يكمن في الارباك الذي يحدثه الارهاب بضربه المبادئ والقيم الديمقراطية معرضا المؤسسات الى الخلل٬ مهددا المواطنين والامة ايضا. التحدي الثاني يتجلى بالانحراف في مكافحة الارهاب احيانا بطرق غير متناسبة لا بل مجحفة. فتحت ستار مكافحة الارهاب يتبين بان ممارسات بعض الدول الديمقراطية يضعف دولة القانون ويظهر انتهاكات لحقوق الانسان وللحريات الاساسية. تعالج هذه الرسالة البحث حول الاسس القانونية التي تتجاوب مع مكافحة الارهاب دون التعرض للمبادئ والقيم الديمقراطية. كما تطرح التناقض الموجود ما بين مفهومي الديمقراطية والارهاب. تتناول هذه الدراسة ايضا موضوعين حاليين ذات اهمية خاصة. يتطرق الاول الى انشاء المحكمة الخاصة بلبنان كأول محكمة ذات طابع دولي تنظر في قضايا الارهاب. فيما الثاني يشمل دراسة مقارنة حول الثورات الحاصلة في الدول العربية٬ تسلط الضوء على أهمية التحول الديمقراطي في مواجهة تصاعد الارهاب في المنطقة. كما وتعرض الرسالة دراسة حول مناهضة دول الشرق الأدنى للارهاب. اخيرا تطرح معايير للخروج من الديمقراطية « المقنعة » التي يفجرها الارهاب نحو ديمقراطية « فعلية » تزخر بالقانون
