This book is about the role of lawyers in the movement to challenge economic inequality in one of America’s most unequal cities: Los Angeles. Covering a transformative period of city history—from the 1992 riots to the 2008 recession—the book examines how law has been used, and what it has achieved, in the struggle to make Los Angeles a more equal place. The backdrop is the dramatic growth of low-wage work powered by global outsourcing, declining unionism, increasing labor contingency, and surging immigration. The book’s narrative focus is on five pivotal campaigns in which lawyers allied with the city’s dynamic labor, immigrant rights, and environmental movements mobilize law to transform key sectors of the regional economy. These campaigns, analyzed through in-depth case studies, reveal how law has shaped low-wage work in Los Angeles—and at times provided a potent weapon to contest it. Drawing upon archival research, extensive interviews with key actors, and a review of court files, this book explores the role of lawyers in defining the city as a space for redefining work. Challenging critical accounts of lawyers in social movements, its central claim is that by advancing an innovative model of legal mobilization, the L.A. campaigns have achieved meaningful regulatory reform, while strengthening the position of workers in the field of local politics. Through multidimensional advocacy to promote worker organizing, lawyers and activists have succeeded in converting policy change into greater interest group power—forging a new model of progressive city-building for the twenty-first century.

This commentary focuses on Article 5.1.4 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning duty to achieve a specific result and duty of best efforts. According to Art 5.1.4, to the extent that an obligation of a party involves a duty to achieve a specific result, that party is bound to achieve that result. To the extent that an obligation of a party involves a duty of best efforts in the performance of an activity, that party is bound to make such efforts as would be made by a reasonable person of the same kind in the same circumstances. The distinction between duties to achieve a specific result and duties of best efforts helps to define the scope of the parties' contractual obligations. This commentary discusses the consequences of such a distinction as well as the content of the duty of best efforts.

Chronic low back pain (CLBP) in young adults is a great public health concern. CLBP affects individuals across all age groups with varying frequency, and it is associated with significant disability and morbidity, missed school or work, loss of productivity, and substantial health care expenditures. It can occur suddenly as a result of injury, or develop gradually due to degenerative changes in the spine. Correct diagnosis and proper management, usually involving a multidisciplinary approach, are paramount for optimal pain management. Usually, combinations of conservative management (pharmacologic and nonpharmacologic) with epidural steroid injections can achieve long-term pain relief and relapse prevention.

Russia is the second most active state going on the offense in cyberspace. From early disruptive actions against Estonia and Georgia to degrading attacks on critical infrastructure in Ukraine and, finally, complex espionage actions seeking to bring down the democratic processes, Russia has been one of the most aggressive and destructive actors in cyberspace. Yet, its efforts focus on breaking norms and disrupting the system rather than cyber violence. Evaluating the efficacy of Russia hacking activities, this chapter questions the conclusion that Moscow achieves its ends in cyberspace. More often than not, Russia fails, doubles down, and fails again. Rather, Moscow uses low-cost, deniable cyber actions to amplify broader propaganda efforts, sowing discontent within the governments and populations of the targeted state. This case demonstrates the mixed results of cyber strategies. Moscow has not achieved much, but its actions have put the world on notice that Russia is capable and dangerous.

Chapter 9 looks at a group of weapon technologies. The long-standing and customary prohibition of the use of poisons and of poisoned weapons is examined first. Then the discussion addresses efforts in 1899 to address the use of asphyxiating gases, pointing out that a prohibition on use was only achieved in 1925 with the adoption of the Geneva Protocol. While that protocol also addressed bacteriological methods of warfare, comprehensive arms control provision prohibiting all forms of biological weapon had to await the adoption in 1972 of the Biological Weapons Convention, whereas similar provision in relation to chemical weapons was not achieved until 1993. Both of these conventions are considered, and the status of the prohibition on use, and of related provisions, in both treaties is analysed. Novel technologies including incapacitating chemical agents, synthetic biology and the use of viruses are also considered.

Foremost among these is the depressingly persistent and extended period of low capital market returns, driving concerns about how to rethink saving and investments in what can be called the ‘new normal.’ This chapter introduces the themes of the book: how we arrived at our current state of affairs and what changes need to be made to achieve adequate retirement incomes for future retirees, and exploring new designs for pension plan sponsors. With increasing life expectancy adding to the problem of low market returns, the chapter urges policymakers to start reforming now to ensure retirement financial security.

It is widely documented that infectious diseases have a very deep impact on numerous human populations. While public health campaigns have achieved spectacular successes, they do not appear to be evenly distributed throughout the world. Indeed, although many infectious diseases have been eliminated in the Western world, deadly pathogens are still spreading in many low-income countries. This chapter aims to describe the current epidemiological situations, reviewing control strategies and the progress that has been made in the fight against major human pathogens with the strongest impact in low-income countries. This chapter, therefore, introduces most of the pathogens that will be discussed in the book, and it describes why some epidemiological situations improved for some diseases more than for others.

This article describes the use of supramolecular chemistry to design low-dimensional nanostructures at surfaces. In particular, it discusses the design strategies of two types of low-dimensional supramolecular nanostructures: structures stabilized by hydrogen bonds and structures stabilized by metal-ligand co-ordination interactions. After providing an overview of hydrogen-bond systems such as 0D discrete clusters, 1D chains, and 2D open networks and close-packed arrays, the article considers metal-co-ordination systems. It also presents experimental results showing that both hydrogen bonds and metal co-ordination offer protocols to achieve unique nanostructured systems on 2D surfaces or interfaces. Noting that the conventional 3D supramolecular self-assembly has generated a vast number of nanostructures revealing high complexity and functionality, the article suggests that 2D approaches can be applied to substrates with different symmetries as well as physical and chemical properties.

This commentary focuses on Article 5.1.5 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning the determination of the kind of duty involved. Art 5.1.5 provides criteria for determining the nature of contractual obligations. The question of whether an obligation involves a duty to achieve a specific result or a duty of best efforts is a result of the interpretation of the contract. Thus, Art 5.1.5 supplements the rules on contractual interpretation in Chapter 4 of the PICC. In determining the extent to which a party's obligation involves a duty of best efforts in the performance of an activity or a duty to achieve a specific result, regard shall be had to the way in which the obligation is expressed in the contract; the contractual price and other terms of the contract; the degree of risk normally involved in achieving the expected result; and the ability of the other party to influence the performance of the obligation.

Abstract:
The relationship between low birth weight (LBW) and subsequent increased risk of hypertension and renal disease in humans is now well established. The initial hypothesis suggested that an adverse intrauterine environment, reflected by LBW, would impact renal development, resulting in a low nephron number and predisposition to hypertension and renal disease. Studies in various populations have shown a direct correlation between birth weight and nephron number, and in infants, nephron numbers are reduced in those of LBW. Among Caucasian and Australian Aboriginal adults, lower nephron numbers are associated with higher blood pressure, whereas higher nephron numbers appear to protect against hypertension. LBW is currently the best clinical surrogate for low nephron number and has been independently associated with higher blood pressure from infancy through to adulthood in many populations, as well as an increased risk of proteinuria, reduced glomerular filtration rate, chronic kidney disease, and end-stage renal disease in later life. The pathophysiology is analogous to that in other chronic kidney diseases where surviving nephrons are subject to hyperfiltration early on, resulting in glomerular hypertrophy, proteinuria, and eventually, especially in the setting of other renal disease risk factors, glomerulosclerosis, and loss of renal function. Mean nephron number varies by up to 13-fold in certain populations, however, therefore nephron number is unlikely the sole developmentally programmed risk factor for renal disease in later life, but may be a first ‘hit’ impacting an individual’s susceptibility to or resistance to superimposed renal injury. Augmentation of nephron number perinatally has only been addressed in experimental settings. In humans, therefore optimization of nephron number is likely best achieved through good perinatal care and adequate postnatal nutrition. Cardiovascular disease and diabetes are also developmentally programmed and therefore likely coexist in subjects with LBW and low nephron numbers. Awareness of an individual’s birth weight should serve to highlight the possibility of low nephron number and potential risk for future hypertension and renal disease, which may be attenuated by optimization of early nutrition, lifestyle choices, and management of other risk factors for renal disease.
