Die standpunt word gehuldig dat die sielkunde, na 'n onafhanklike bestaan van meer as 100 jaar, as wetenskaplike projek misluk het. Dit word toegeskryf daaraan dat die sielkunde nie, in dialoog met sy menslike ‘materiaal’, 'n eie metodiek ontwikkel het nie maar voorrang verleen het aan die reedsontwikkelde natuurwetenskaplike metodiek waardeur die basiese aannames van die natuurwetenskap ook sonder voldoende besinning oorgeneem is. Die onderhawige bydrae pleit vir nuwe antropologiese en teoretiese grondslae gebaseer op eksistensieël-fenomenologiese denke eerder as op Cartesiaanse dualisme, idealisme, en logiese positivisme. Die nuwe grondslae moet steeds in kritiese dialoog met en gebruikmaking van ons primêre belewing van die wêreld opgebou word. Hoe die benadering bevrugtend kan inwerk op verskillende velde van die sielkunde, van waarneming tot psigopatologie en van bedryfs tot kritiese psigologie, word kortliks geïllustreer.

Abstract: Ernst Mach stands as a representative figure of the positivist philosophy of science at the turn of the twentieth century, yet he is by far the most misunderstood scientist-philosopher. The misunderstanding is largely caused by his epistemological rejection of the use of hypothetical entities that are ordinarily posited by scientists. He also argued against the mechanistic worldview which dominated scientific investigations in the nineteenth century. This essay will demonstrate that Mach’s positivism differs from the earlier positivism of August Comte. His anti metaphysical stance is deeply-rooted in his physical phenomenology, guided by the economy of thought in pursuit of the unity of science. In Mach’s view, scientific theories are merely biological tools for organizing experience by means of the fewest possible concepts, and all metaphysical elements are to be eliminated from science as methodologically and epistemologically superfluous. But Mach’s thesis of the unification of science does not share the common concern of the logical positivists to reduce various scientific statements to physical language. While Mach’s philosophy of science clearly exhibits a miscalculation of the strength of scientific conceptual tools, his physical phenomenology serves as a bridge between theory and experiment which has proved to be fruitful.

 Abstrak: Ernst Mach tampil sebagai tokoh representatif dari Filsafat Ilmu Pengetahuan positivis pada peralihan menuju abad ke-20, sekaligus sebagai ilmuwan-filsuf yang paling disalahpahami. Kesalahpahaman tersebut sebagian besar disebabkan oleh penolakan epitemologisnya terhadap penggunaan wujud-wujud hipotetis yang kerap diajukan oleh para ilmuwan. Ia juga melawan cara pandang mekanistis yang mendominasi penyelidikan ilmiah pada abad ke-19. Artikel ini memperlihatkan bahwa positivisme Mach berbeda dengan positivisme August Comte yang mendahuluinya. Pandangan anti-metafisis Mach berakar sangat dalam pada fisika fenomenologi yang dipandu oleh ekonomi pikiran untuk mencapai sains terpadu. Dalam pandangan Mach, teori-teori ilmiah semata-mata sarana biologis untuk menata pengalaman dengan memanfaatkan sesedikit mungkin konsep, dan semua elemen metafisika perlu disingkirkan dari sains karena secara metodologis dan epistemologis tidak bermanfaat. Namun, tesis Mach tentang sains terpadu tidak sejalan dengan gagasan para positivis logis yang mereduksi berbagai macam pernyataan ilmiah ke dalam bahasa fisika. Sementara Filsafat Ilmu Pengetahuan Mach jelas-jelas keliru dalam memperhitungkan kekuatan piranti-piranti konseptual sains, fisika fenomenologi yang menjembatani teori dan eksperimen telah terbukti sangat bermanfaat.

O presente trabalho tem como objetivo analisar o modo em que a bibliografia especializada busca explicar o constante emprego das Forças Armadas – instrumento de política externa – em missões de segurança pública na América do Sul. São identificados três níveis de explicação: internacional, regional e nacional. Defende-se que as análises podem ser agrupadas em duas lógicas explicativas – positivismo e o pós-positivismo –, as quais distinguem-se não apenas em termos teóricos, mas também, sob a ótica da teoria crítica, em relação às suas consequências políticas. Considera-se que a compreensão positivista do fenômeno em questão leva a uma subordinação da política à técnica, enquanto as análises pós-positivistas evidenciam o caráter político da escolha de envolver o instrumento militar em segurança pública.

 Abstract: The current paper aims to evaluate the way in which specialized scholars seek to clarify the constant employment of South Americans Armed Forces – foreign policy instrument – in public security. Three explanatory levels are identified: international, regional and domestic. It is argued that analyses can be classified in two logics of explanation – positivism and post positivism – that are distinguished by both its theoretical specificity and its politics implications. We sustain that rationalist explanation submits politics to technique, while post positivism analyses emphasize the political nature of the decision to involve the military in public security.

The planning and building of sustainable cities and communities yields operational theories on urban space. The novelty of this paper is that it discusses and explores the challenges for space syntax theory building within two key research traditions: positivism and hermeneutics. Applying a theory of science perspective, we first discuss the explanatory power of space syntax and its applications. Next, we distinguish between theories that attempt to explain a phenomenon and theories that seek to understand it, based on Von Wright’s modal logics and Bhaskar’s critical realism models. We demonstrate that space syntax research that focuses on spatial configurative changes in built environments, movement and economic activities can explain changes in a built environment in terms of cause and effect (positivism), whereas historical research or research focusing on social rationality, space and crime or cognition seeks to develop an understanding of the inherent cultural meaning of the space under investigation (hermeneutics). Evidently, the effect of human intentions and behaviour on spatial structures depends on the type of rationality underlying these intentions, which is the focus of this study. Positivist explanatory models are appropriate for examining market rationality in cases that entail unambiguous intentionality and that are associated with a high degree of predictability. By contrast, other kinds of reasoning require a hermeneutic understanding.

Dalam perkembangannya postivisme terdiri dari, positivisme sosial, positivisme evolusioner, positivisme kritis. Ketiga positivisme diatas dibahas dalam positivisme Auguste Comte dilihat dari analisa epistimologis dan nilai etisnya terhadap sains. Menghadapi filsafat positivisme Auguste Comte, disatu fihak orang mengatakan bahawa filsafat tersebut tidak lebih dari sebuah metode atau pendirian saja. Sedangkan dilain pihak orang mengatakan bahwa filsafat positivisme itu merupakan “sistem afirmai” sebuah konsep tentang dunia dan manusia. Aguste Comte telah menunjukkan bahwa didalam perkembangan jiwa manusia, baik secara individual maupun secara keseluruhan, terdapat suatu kemajuan. Kemajuan itu akan dicapai, pada saat perkembangan datang, pada saat yang disebut positif. Positivisme berakar pada empirisme. Positivisme adalah: bahwa ilmu adalah satu-satunya pengetahuan yang valid, dan fakta-fakta sejarah yang mungkin dapat menjadi obyek pengetahuan. Dengan demikian positivisme menolak keberadaan segala kekuatan atau subyek dibelakang fakta, menolak segala penggunaan metode diluar yang digunakan untuk menelaah fakta. Aguste Comte adalah tokoh aliran positivisme, pendapat aliran ini adalah indera amatlah penting dalam memperoleh pengetahuan, tetapi harus dipertajam dengan alat bantu dan diperkuat dengan eksperimen. Bila dilihat dari nilai etisnya terhadap sains maka dapat dinyatakan bahwa apabila pradigma positivisme maka objeknya empiris macam pengetahuannya menunjukkan sains dan dapat diukur dengan logis dan bukti empiris.

This approach to science as a philosophical paradigm takes no account of the way theories are built. What matters for logical empirism is the process of reconstruction in the framework of objective science. Indeed, within science, there is ample room for conceptual clarification. This is a philosophical work to be done by science itself. Philosophy is called upon to assume this rebuilding task, which is rational from outside. As a consequence, logical empirism is not relevant to science as a historical process. Only the context of justification is a matter for science philosophy, considered as the logic of sciences. Le positivisme logique a condamne la metaphysique et developpe une nouvelle conception de la connaissance. Rompant avec la philosophie traditionnelle, il a mis en oeuvre un processus de formalisation des enonces qui lui permette de construire une veritable logique de la science. Ce mouvement de pensee a neanmoins repris et transforme un theme philosophique fort ancien : la constitution d'un langage universel. Pour unifier la connaissance scientifique le positivisme logique a concu un projet et bati un programme de formalisation qui se sont principalement realises dans la syntaxe logique du langage de rudolf carnap. Malgre cette realisation l'importance de la philosophie ne s'est jamais dementie pendant les annees qui virent ce courant d'idees croitre et s'affermir. Les oppositions a la logique de la science et les debats sur la metaphysique, temoignent d'une presence de la philosophie dans une conception scientifique du monde qui cherche a l'ecarter ; presence dont les traits originaux revelent la continuite et la mutation d'une epistemologie contemporaine<br>Logical positivism has condemned metaphysics and developed a new conception of knowledge. Breaking from traditional philosophy, logical positivists have implemented a process to formalise sentences enabling them to build a genuine logic of science. This school of thought has nonetheless used and transformed a standard philosophical motif : building a universal language. To unify scientific knowledge, logical positivism has put forward a project and a programme of formalisation, mainly carried out in rudolf carnap's the logical syntaxe of language. In spite of this work, the importance of philosophy did not lessen in the years when this school of thought flowered and matured. The oppositions to the logic of science and the debates on metaphysics demonstrate the presence of philosophy in a scientific conception of the world which attempts to avoid it. The specific features of this presence reveal the continuity and mutation of a contemporary epistemology

Le travail ici présenté offre une approche originelle des notions juridiques développées par Hans Kelsen dans ses efforts vers l'élaboration d'une théorie "pure" du droit. Cette étude est basée sur une analyse philosophique des principaux concepts juridiques qui ont, à leur tour, des caractéristiques philosophiques pertinentes, principalement les notions qui sont apparemment "partagées" entre les domaines juridique et philosophique, sans pour autant garder les mêmes significations sémantiques. La notion la plus pertinente à avoir ces caractéristiques est peut-être celle de "validité", étant donné qu'il s'agit d'une notion présente tant dans le domaine de la logique quant dans le domaine juridique; Dans ce sens, nous prétendons approcher aussi les notions de fiction normative, de science du droit, de conflits entre normes (qui sont aussi erronément appelés "contradictions entre normes"), et la règle d'inférence comme elle est appliquée dans le contexte de la création normative, donnant lieu à des notions trompeuses comme celle de raisonnement pratique. La notion de raisonnement pratique est d'ailleurs très riche concernant ce contexte de comparaison, et elle sera particulièrement traitée en fonction des autres notions problématiques qu'elle génère dans le champ normatif, telles que le Dilemme de Jørgensen; Cette notion, étant employée dans différents cas problématiques du droit, nous offre une opportunité de présenter une approche alternative pour le traitement logique du processus de justification dans la création d'une norme. Nous avons pour objectif aussi d'analyser les notions de condition logique et juridique, qui représentent un changement dans la perspective de Kelsen concernant l'utilité et la légitimité de l'application de la logique dans le champ normatif du droit. Une telle étude comparative, même si elle semble être fondamentale pour éclaircir les notions en question dans ces domaines respectifs, reste une tâche jamais réalisée dans une telle manière systématique. L'objectif de cette étude est de fournit un panorama clair concernant les limites entre les champs de la philosophie (spécialement la logique) et les normes juridiques. La compréhension des relations entre les notions "homonymes" doit aussi expliquer pourquoi elles sont utilisées de forme erronée aussi fréquemment quand les philosophes discutent du droit, mais aussi quand les juristes cherchent des justifications pour les concepts dans leurs théories. Ainsi, le contexte de cette étude est le positivisme juridique tel qu'il est présenté par le philosophe du droit Hans Kelsen. Notre choix est justifié par le fait que lathéorie de Kelsen s'avère l plus conforme à notre approche philosophique d'orientation logique et analytique. L’œuvre qui servira de base à notre investigation est la "Théorie Générale des Normes" (1979), surtout dû au fait de représenter l'intensité des efforts de son auteur pour traiter les problèmes juridiques liés à des aspect philosophiques ou logiques. Cela est particulièrement remarquable dans le cas de la possibilité d'application de la logique aux normes, mais aussi concernant les notions problématiques comme celle de norme fondamentale comme fiction ou encore la notion de substrat indifférent au mode<br>The present work offers an original approach on the legal notions developed by Hans Kelsen in his attempts towards a “pure” theory of Law, based on a philosophical analysis of the main legal concepts that have a strong philosophical feature, namely those notions which are somehow “shared” between the two fields in their name, but not always in their meaning. While the most striking notion to be approached via a philosophical perspective would probably be that of legal validity (since validity is a central term also in Logic), we aim, in the same way, to approach the notions of legal fictions, the notion of science in Law, normative conflicts or “contradictions” as they are commonly – and wrongly – named, and the rule of inference as it is applied in the context of normative creation, giving place to the wrong notion of practical reasoning. The notion of practical reasoning is very rich in this context of comparison, and will be a special one, as it serves for us to analyze traditional problems of legal theory, such as Jørgensen’s dilemma, as well as it offers us the opportunity of providing our own alternative of a logical treatment of the process of legal justification of the creation of a norm. We aim to analyze the notion of legal and logical conditions as well, which represent a changing in Kelsen’s perspective on the utility and legitimacy of the application of logic to the legal domain. Such a comparative study, even if it appears to be fundamental for clarifying those notions in their respective fields, is a task never before developed in this systematic manner. The objective of such a study is to provide a clear overview of the boundaries between the fields of philosophy (especially logic) and the legal norms. A clear understanding of the relations between those “homonym” notions may explain why they are most of the time misused when philosophers talk about law, as well as when lawyers try to justify the concepts composing the legal theory.The context of this study is the legal positivism as it is explained by the legal-philosopher Hans Kelsen. This choice is justified by the fact that Kelsen’s legal theory appears to be the most suitable frame for an analytical, logic-oriented investigation. The work emphasized will be the General Theory of Norms (1979), mainly because of the fact that this book represents how intensively Kelsen dedicated himself to the legal problems mostly related to philosophy or logic, namely the question of the application of logic to norms and the clarification of problematic notions such as the basic norm as a fiction or, still, the notion of modally indifferent substrate

Malgré sa condamnation post-positiviste et sa réception négative par la gauche, l’empirisme logique regagne en intérêt. Cette thèse est une contribution à la littérature émergente du «Cercle de Vienne de gauche» (CVG). Autour de Neurath et quelques autres personnalités de l’aile gauche du Cercle (Carnap, Frank, Hahn, Zilsel), nous proposons de repenser la relation de l’empirisme logique avec le marxisme. Ces deux courants se rejoignent dans leur défense d’une «conception scientifique du monde» et leur sécularisme radical. Les critiques communistes et néo-marxistes (l’École de Francfort, l’épistémologie féministe) adressées à l’empirisme logique sont recensées et leur pertinence questionnée à travers les données de l’historiographie du CVG. La politique de l’empirisme logique est examinée à travers les textes économiques de Neurath et son œuvre d’infographiste. Son engagement pour l’économie socialiste planifiée et ses efforts en graphisme pour la popularisation des méthodes quantitatives (la méthode Isotype pour la visualisation des statistiques sociales) sont présentés en vue d’une évaluation politique du CVG, ainsi que les connexions de l’empirisme logique avec le mouvement pour une langue auxiliaire internationale<br>Despite logical empiricism’s dismissal by ambient postpositivism in academia as well as by the Far Left, a growing interest in its previously unknown socialist origins has resulted in a new topic in the history of philosophy of science : «Left Vienna Circle» (LVC). This thesis dedicated to LVC studies aims to clarify the politics of European logical empiricism. A presentation of its major critics from the Left (from communist parties to neo-Marxist trends like Frankfurt School and feminist epistemology) is followed by more recent arguments about its socialist politics. The «scientific world conceptions» of logical empiricism and Marxism will be compared through the work of Neurath and some other representatives of LVC (Carnap, Frank, Zilsel, Hahn). Alongside the connections of logical empiricism to the movement for an international auxiliary language, Neurath’s economical writings and his efforts to popularize quantitative methods in social sciences (the Isotype method of visual statistics) will be presented in an attempt to evaluate the politics of logical empiricism

Ce travail de recherche fait le point sur le pluralisme théorique caractérisant le Cercle de Vienne et le dynamisme spécifiant le profil intellectuel de chacun de ses membres. Je suggère qu'une interprétation qui opposerait au sein du Cercle une aile droite conjuguant fondationalisme et phenoménalisme à une aile gauche monnayant faillibilisme et physicalisme ne donne pas une image adéquate de la philosophie des sciences développée par le Cercle. Celle-ci est animée par le problème kantien et néo-kantien qui est celui des conditions de possibilité de l'objectivité de la connaissance scientifique. Ce problème est résolu par le biais d'une réhabilitation de l'a priori kantien. La complexité doctrinale de la philosophie du Cercle de Vienne est mise au devant au moyen d'un examen des aspects systématiques et polémiques de la/les position(s) de ses membres. Les foyers d'incompréhension réciproque que ces derniers ont, à leur insu, cultivés sont en outre mis à découvert.

La praxéologie de T. Kotarbiński consiste avant tout à déterminer l’action physique dans un système décisionniste par la seule notion d’efficacité. Notion qui suppose une structure causale stricte à l’image d’un monde rationnel et objectif, proche de la conception du positivisme logique. La conception pragmatique des théoriciens des actes de parole n’a pas besoin, quant à elle, de recourir à des règles de conduites déterminées pour atteindre cette efficacité, puisque ces règles sont déjà inhérentes au langage. Il suffit simplement de recourir au principe de rationalité des locuteurs. Il n’y a donc plus à recourir dans ce cas à une décision solipsiste pour créer une situation d’obligation, puisqu’en se jugeant d’avance au nom des autres, l’énonciateur s’approprie leur jugement. Pour sa part, la pragmatique de K. O. Apel et J. Habermas remplace le modèle monologique des théoriciens des actes de parole par un modèle intersubjectif de communication pour répondre aux questions de la démocratie et du droit. Toutefois, en présupposant subjectivement ce sur quoi il peut y avoir consensus, cette pragmatique ne diffère pas foncièrement de la théorie des actes de parole, ni même du système praxéologique<br>The praxiology of T. Kotarbiński means before all to determinate a physical action within a decision-maker system through the only notion of efficiency. Notion which suppose a strict causal structure from the image of an objective and rational world, close to the conception of logical positivism. The pragmatical conception of speech-acts theoreticians doesn’t need, for its part, to resort to determined proceeding rules in order to reach this efficiency, since theses rules are already inherent in language. It simply needs to resort to rationality principle of speakers. Habermas takes over the monological model of speech-acts theoriticians by an intersubjective model of communication, in order to respond to questions from democracy and law. However, in presupposing subjectively on what the concensus could be based on, this pragmatic does not differ significantly from the theory of speech-acts, not even from the praxiological system

Cette thèse cherche à reconstituer les bases philosophiques de la pensée juridique de H.L.A. Hart (1907-1992), figure majeure du positivisme juridique anglo-saxon au XXe siècle, et professeur de jurisprudence à l'université d'Oxford de 1952 à 1968. Ses travaux demeurent largement méconnus en France.Dégager les sources philosophiques du « positivisme analytique » de Hart permettra, premièrement, de reconstruire le dialogue entre le juriste d'Oxford et certaines figures importantes de la théorie du droit continentale. Hart oppose d’importantes critiques à certaines formes continentales de positivisme juridique, comme le normativisme de Hans Kelsen ou le réalisme scandinave d'Alf Ross. Cependant, cette thèse montrera également qu'il est possible d'établir des rapprochements étroits entre la pensée de Hart et celle du juriste francophone Chaïm Perelman. L'étude des bases philosophiques de la pensée juridique de Hart offre ainsi des points de contact intéressants entre ces différentes cultures juridiques.Deuxièmement, cette thèse cherche à faire ressortir l'influence déterminante de la philosophie du langage ordinaire qui se développa à Oxford au lendemain de la Seconde Guerre mondiale. Notre propos s'appuiera notamment sur un « premier corpus » de textes philosophiques publiés avant son accession à la chaire de jurisprudence en 1952, ainsi que sur les travaux préparatoires à son ouvrage The Concept of Law (1961). Nous défendons l'idée que ses prises de position philosophiques se retrouvent dans sa réflexion juridique et permettent de comprendre la cohérence de son œuvre, ainsi que la forme d'empirisme juridique qui sous-tend sa conception de la notion de Constitution<br>This thesis bears on the implicit epistemology and methodological considerations underlying the legal philosophy of H.L.A. Hart (1907-1992), the major representative of XXth century legal positivism in the English speaking world, and Oxford chair of jurisprudence (1952-1968). His work remains little known in France.We will seek to answer the view that Hart might not really have been durably influenced by ordinary language philosophy. We will address these questions by examining a corpus of earlier (overlooked) articles which he published as a young Oxford linguistic philosopher. This “early work” consists of the articles which Hart published before he in was elected to the Oxford chair of jurisprudence. Our view is that the work in general philosophy which he did in this early period is crucial to understand some of the positions which he defends in his legal writings. This thesis will thus show that Hart was active in the epistemological debate opposing the Oxford philosophers and the British representatives of logical atomism and logical empiricism. It will also show that these early positions are carried over into his later jurisprudence, including his major work The Concept of Law (1961).Shedding light on these philosophical foundations of Hart’s legal theory will ultimately allow us to reconstruct the debate opposing his own “analytical positivism” and Continental forms of positivism, such as Hans Kelsen’s normativism or Alf Ross Scandinavian legal realism. It will also allow us to draw important parallels between Hartian legal theory and that of the francophone philosopher Chaïm Perelman
