Abstract:
Le livre de jeunesse constitue en Afrique un genre marginalisé. Pourtant, il sert de moyen de communication et de mode de transmission des valeurs, des normes de conduite à l’œuvre dans une culture donnée. À ce titre, il sert à l’éducation et à la socialisation de l’enfant. Ainsi, les auteurs injectent dans les livres pour enfants un ensemble de représentations de la société que l’enfant doit pouvoir (re)connaître et assimiler. Comment, dans cette perspective, le village est-il imaginé et représenté par rapport à la ville? Il s’agit pour nous d’étudier les représentations imaginaires que les auteurs des livres littéraires ivoiriens pour enfant font du village comme lieu de destination. Une analyse de contenu lexico-thématique puis sémiologique a été menée sur un corpus de 35 livres littéraires ivoiriens pour enfants. Les livres étudiés présentent le village comme un lieu de tranquillité, de repos et de paix comparé à la ville bruyante et pleine d’odeurs nauséabondes. Résumé Cette étude se pose le but d’examiner le cas spécifique d’un animal ‘mystérieux’ dans un des livres de conduite les plus célèbres du Moyen Âge, le Livre du Chevalier de la Tour Landry pour l’enseignement de ses filles. L’auteur, Geoffroi de la Tour Landry, instruit ses filles à vivre dans le monde, et il le fait en leur montrant les mauvais comportements à éviter et en leur proposant différents modèles à suivre. Dans un de ses chapitres, il mentionne quatre animaux, dont trois servent à illustrer un comportement à refuser et un, dont le nom varie dans les manuscrits, est en revanche proposé comme modèle de vertu. Dans la tentative d’identifier ce dernier animal, nous avons consulté plusieurs manuscrits ainsi que les traductions médiévales en anglais et en allemand du Livre du Chevalier de la Tour Landry, ce qui témoigne de l’importance d’une étude interlinguistique même pour les textes médiévaux.

La littérature sapientiale de la Bible est centrée sur l’homme, sur sa conduite pratique de la vie individuelle, familiale et sociale. D’autre part pourtant, les livres sapientiaux dessignent l’image de l’homme qui – pour parvenir à la pleine réalisation de soi-même – ne peut pas se limiter à la dimension pratique de la vie. Ses propres efforts et l’expérience des âges créent une première dimension de la recherche de ce qui est bon pour l’homme. Certaines questions qui ne trouvent pas les réponses dans cette dimension ouvrent l’homme à une dimension nouvelle – cette de la foi. L’homme en tant que créature, est conduit à la vraie sagesse qui est plus intérieure - puisqu’elle commence avec la crainte de Dieu, et très concrète – puisqu’on la trouve dans le livre de l’alliance qui nous lie au Dieu très-haut (Sir 24,23). Voilà une accomplissement naturelle de la recherche de l’homme demandant où trouver la voie vers la vie accomplie, pleine et heureuse. La première partie de cet article nous offre l’analise des étapes de l’itinéraire de l’homme qui le conduit à la rencontre avec la Parole de Dieu.Dans la deuxième partie de l’article on nous propose la réflexions qui cherche à répondre à la question suivante: quelle est la relation entre le livre de l’alliance proposé comme source de la sagesse avec d’autres parties de la Bible, surtout avec cette partie du canon qu’on appelle la littérature de sagesse.

Cette communication se propose dans un premier temps d’esquisser brièvement le chemin parcouru par le célèbre recueil de fables d’origine indienne, le Livre de Calila et Dimna. Transmis du sanscrit à l’arabe, puis au latin, ce texte a transité par l’italien, avec le Discorso degli animali de Angelo Fiorenzuola, pour arriver enfin en France. La tradition française des fables a certainement puisé à ce texte, dont une traduction anonyme parut chez Cottier à Lyon en 1559, sous le titre “Le plaisant et facétieux discours des animaux”. Notre attention se focalise ensuite sur les rapports éventuels de dérivation entre les différents recueils qui sont en rapport avec ces fables d’origine indienne, à partir du XVe siècle. Il est question de la traduction fournie en 1579 par Pierre de Larivey (“Deux livres de filosophie fabuleuse”), de celle faite par Gilbert Gaulmin en 1644 (“Livre des lumières, ou la Conduite des roys”), et de la traduction d’Antoine Galland, au XVIIIe siècle (“Les contes et fables indiennes, de Bidpaï et de Lokman”). Une analyse philologique des différentes traductions de quelques fables extraites de ces recueils est également proposée.

La correspondance du physicien hollandais Christiaan Huygens permet d’explorer la matérialité des échanges savants au xvii e siècle. Les dispositifs d’information que constituent les échanges épistolaires reposent d’abord sur des infrastructures qui empruntent aux lignes postales ordinaires, aux réseaux marchands et aux voies diplomatiques. La composition des missives révèle le nouage serré entre les pratiques d’écriture et l’exigence éthique d’une conduite scientifique précise. Avec les plis, circulent des dessins, des livres et des objets. L’administration de la preuve suppose de recourir à des artifices graphiques, à des surfaces éditoriales neuves (comme les revues), mais aussi à des instruments, comme moyen d’expérimenter ou d’observer par soi-même. L’information scientifique ne se limite pas aux abstractions des démonstrations ou des comptes rendus, elle s’incarne dans une matérialité profuse qui porte avec elle les valeurs socio-épistémique de la communauté savante et conjoint les fonctions rhétoriques, conversationnelles et polémiques de l’instrument épistolaire.

L’agitation en Allemagne au début du XVIe. siècle contre Jean Reuchlin et la diffusion des textes hébreux n’est qu’une guer re de l’obscurantisme contre les progrès des humaniores litterae. Erasme n’aimait pas les écrits De verbo mirifico et De arte cabalistica qu’il possédait cependant dans sa bibliothèque (ainsi que les Rudimenta Hebraica), mais il ne pouvait pas ne pas soutenir Reuchlin comme pionnier de la bonne cause des lettres humaines. Cette polémique, un peu antérieure et en partie contemporaine de l’éveil de la Réforme évangélique, ne doit pas être confondue avec la protestation de Luther: elle est, en effet plus littéraire que théologique. L'Apotheosis Capnionis, dialogue écrit immédiatement après la mort de l’hébraïste et publié dans une nouvelle édition des Colloquia en 1522, fait état d’une vision, attribuée par l’auteur à un vertueux franciscain (identifié par certains comme Jean Vitrier). Dans cette vision, l’âme de Reuchlin est conduite par saint Jérôme à la gloire céleste. L’apothéose de l’humaniste représente le triomphe de la cause de l’Humanisme. Comme auteur des Rudimenta Hebraica, Jean Reuchlin a joui d’un immense prestige. Ses livres notamment le De arte cabalística, sont arrivés jusqu’au Portugal, où Francisco Manuel de Melo au XVIIe siècle se réclame de son ense ignement et de son autorité.

Les pratiques de narrations orales de contes populaires arabes, qui ont connu un déclin progressif aux XIXe et XXe siècles, sont marquées par l’affirmation d’une distinction de genre forte entre des récits propres aux hommes et d’autres aux femmes. À partir du milieu du XIXe siècle, l’essor de l’imprimerie au Proche-Orient conduit à une transposition de ces récits de l’oral vers l’imprimé, qui se fait selon deux modes. Des éditions sont, d’une part, produites à partir de manuscrits, tandis que d’autres le sont à partir d’un matériau oral, dont la langue est en général corrigée. Cet article étudie la manière dont le passage d’un médium à un autre a affecté la distinction de genre associée aux narrations orales, qui a pu se manifester dans le choix des textes publiés et les modalités de leur transposition. De ce point de vue, l’édition de contes populaires arabophones a suivi plusieurs directions. Elle a tout d’abord été marquée par la publication de contes associés à des narrations et des sociabilités masculines dans de petits recueils bon marché ainsi que celle de grandes œuvres du patrimoine oral masculin adaptées de manuscrits. Cette seconde forme a majoritairement perduré, en parallèle de l’émergence d’éditions de narrations féminines dans des contextes politiques et culturels spécifiques.

Le présent texte s’attarde au don de livres en territoire québécois sous trois aspects : la provenance des dons (individus ou institutions), les quantités et la redistribution par des organismes structurés. Sans prétendre à une étude exhaustive de cette réalité, nous aborderons dans un premier temps la situation générale du livre au Québec, vue sous l’angle du don. Cela nous conduira à survoler quelques cas d’organismes qui font la cueillette des livres et à examiner ce qu’ils en font. Sur ce point, nous nous attarderons en particulier à la Fondation des parlementaires québécois Cultures à partager. Nous verrons les origines et la mission de cet organisme, ses réalisations et ses projets. Il sera également question de son fonctionnement, surtout en ce qui concerne le tri des livres, ce qui représente le principal défi quand les dons se font nombreux.

Les arts d'aimer et les livres de conduite sont deux traditions littéraires très en vogue entre les XIIIe-XVe siècles. Grâce à leur célébrité et à leur longévité ils ont contribué à façonner la pensée de l'époque et au-delà.Sous la catégorie « arts d'aimer », applicable à une grande variété de textes à sujet érotique, nous considérons les traductions, voire les adaptations, de l'Ars amatoria d'Ovide, qui instruit les amants à maîtriser les techniques de l'amour, de la première approche jusqu'à l'accomplissement de l'acte sexuel. Cette œuvre écrite sous le règne d'Auguste et qui, déjà à l'époque de sa parution, avait causé des scandales, condamnant son auteur à l'exil, connut une vraie renaissance à partir du XIIe siècle, dans une période dénommée aetas Ovidiana. Elle fut traduite et reprise par les auteurs médiévaux les plus célèbres, dont Chrétien de Troyes, Guillaume de Lorris et Jean de Meun. Dans notre thèse nous analyserons cependant principalement les cinq traductions de l'Ars - encore assez peu étudiées par la critique -, toutes diverses entre elles, d'auteurs peu connus ou anonymes.Pour ce qui concerne les livres de conduite (dont le terme vient de l'anglais conduct literature), il s'agit de traités d'éducation à la vie laïque pensés tout d'abord pour la jeunesse. Ici, nous nous intéressons aux textes adressés aux jeunes femmes, qui couvrent toute l'échelle sociale, depuis la reine et les princesses jusqu' aux femmes du peuple et même aux prostituées, avec le Livre des Trois Vertus de Christine de Pizan. Les destinataires de ces œuvres sont parfois connues, comme Isabelle, fille aînée de Louis IX, la reine Jeanne de Navarre, interpellée par son confesseur Durand de Champagne, et Suzanne, fille d'Anne de France. Parmi les textes de notre corpus s'en trouvent de très célèbres, comme l'œuvre de Christine de Pizan et le Livre du Chevalier de la Tour Landry, et d'autres moins étudiés jusqu'ici par la critique, en particulier un texte qui nous est parvenu sous trois versions différentes et dont nous proposons la première édition.Les deux traditions littéraires ne pourraient être plus différentes entre elles, mais l'intérêt de les rapprocher repose sur le constat que, contrairement à notre attente, les livres de conduite présentent en creux le discours des arts d'aimer. Les auteurs et autrices de livres de conduite se révèlent en fait conscients et conscientes du discours érotodidactique en vogue à l'époque, qu'ils condamnent, tout en le reprenant ex negativo pour mieux enseigner à leurs protégées à se garder des périls de l'amour extra-conjugal. Pour analyser l'influence du discours de matrice ovidienne dans les traités d'éducation, notre étude se base sur les étapes individuelles du parcours amoureux selon la tradition des gradus amoris, à savoir la visio, l'allocutio, le tactus, l'osculum et le factum. Cette démarche permet de toucher à toutes les nuances de l'amour, ses degrés pouvant tous être associés aux cinq sens et à des parties du corps, ce qui facilite l'incursion dans d'autres domaines. Ainsi, nous explorons la mode vestimentaire, les contenances de table, les attentes que les hommes ont des femmes dans l'un et l'autre discours, pour arriver à la déconstruction de l'amour courtois opérée par les livres de conduite. Les attentes des deux discours sont basées sur l'image idéale (ou idéelle) que leurs auteurs ont de la femme ; en les croisant, notre analyse donne en revanche un aperçu de la vie réelle et plus complexe des femmes françaises du Moyen Âge et de leur rapport avec les hommes.Comprendre la formation de ces images idéales et de la conception des femmes, dont les textes de notre corpus sont un reflet et un moyen de diffusion, est fondamental pour saisir des vestiges millénaires qui se trouvent encore de nos jours, combattus par les mouvements d'émancipation féminine tels le #MeToo et le No Means No
The arts of love and the conduct books are two literary traditions that were very much in vogue between the 13th and the 15th centuries. Thanks to their celebrity and longevity, they helped to shape the thinking of the period and beyond.Under the definition of "arts of love", which can be applied to a wide range of texts on erotic subjects, we are considering translations, or even adaptations, of Ovid's Ars amatoria, which instructs lovers to master the techniques of love, from the first approach to the completion of the sexual act. Written during the reign of Augustus, Ovid's work caused scandal even at the time of its publication, condemning the author to exile. From the 12th century onwards, during a period known as the aetas Ovidiana, it enjoyed a veritable renaissance. It was translated and reprinted by the most famous medieval authors, including Chrétien de Troyes, Guillaume de Lorris and Jean de Meun. In our thesis, however, we will focus mainly on the five translations of the Ars by little-known or anonymous authors - still relatively little studied by critics -, all of which are different from one another.As for conduct books (from the English conduct literature), these are treatises on secular life, written primarily for young people. Here, we are interested in texts aimed at young women, covering the whole social scale, from queens and princesses to common women and even prostitutes, as in Christine de Pizan's Livre des Trois Vertus. We know some of the patrons of these works, such as Isabelle, the eldest daughter of Louis IX, Queen Jeanne de Navarre, who was addressed by her confessor Durand de Champagne, and Suzanne, the daughter of Anne de France. Among the texts in our corpus are some very famous ones, such as the work of Christine de Pizan and the Livre du Chevalier de la Tour Landry (the Book of the Knight of the Tower), and others less studied by critics, including one that has come down to us in three different versions and of which we are offering the first edition.The two literary traditions could not be more different, but the interest of comparing them is that, contrary to all expectations, the books of conduct present the discourse of the arts of love in an underlying way. The authors of books of conduct were in fact aware of the erotodidactic discourse so much in vogue at the time, which they condemned, while taking it up ex negativo to better teach their protégées to guard against the perils of extramarital love. To analyse the influence of the Ovidian discourse in the educational treatises, this study is based on the individual stages of the amorous journey in the tradition of the gradus amoris, namely visio, allocutio, tactus, osculum and factum. This approach allows us to touch on all the nuances of love, since its degrees can all be associated with the five senses and parts of the body, making it easier to delve into other areas. In this way, we explore fashion, table manners and the expectations that men have of women in both discourses, to arrive at the deconstruction of courtly love operated by the books of conduct. The expectations of the two discourses are based on the ideal image that their authors have of women; by cross-referencing them, however, our analysis provides an insight into the real and more complex lives of French women in the Middle Ages and their relationship with men.Understanding the formation of these ideal images and the conception of women, of which the texts in our corpus are both a reflection and a means that enabled them to be disseminated, is fundamental to grasping the age-old vestiges that are still with us today, opposed by women's emancipation movements such as #MeToo and No Means No

O desenvolvimento infantil é impulsionado por meio de situações sociais nas quais a atividade da criança é privilegiada, mobilizando nela as ações de pensar, sentir e agir de modo cada vez mais elaborado. Por isso, o trabalho docente em escolas de Educação Infantil envolve a criação de condições objetivas para que ela brinque, se relacione, expresse suas ideias e exteriorize suas aprendizagens, tornando-se, assim, cada vez mais humana. Tais condições exigem a organização dos espaços, da utilização do tempo, dos materiais usados e dos relacionamentos em que a participação ativa da criança atua como elemento principal. Dessa forma, o problema norteador deste trabalho foi: como propor o tempo livre das crianças na Educação Infantil, tendo em vista seu pleno desenvolvimento? Buscando o objetivo geral da presente pesquisa de caracterizar os elementos que compõem o tempo livre na escola de Educação Infantil, foram abordadas questões relativas à gestão do tempo livre pelas crianças e a influência desse tempo para sua humanização sob a ótica da Teoria Histórico-Cultural. Além disso, esta pesquisa teve como objetivo específico discutir as contribuições do tempo livre para o desenvolvimento de capacidades humanas, em especial, a apropriação do autocontrole da conduta pela criança. A hipótese que norteou o estudo foi a de que o tempo livre na Educação Infantil possibilita à criança vivências que promovam o seu desenvolvimento humano. Com abordagem qualitativa, a pesquisa de tipo exploratória envolveu revisão bibliográfica em diversas fontes digitais para conhecimento da produção na área, entrevistas semiestruturadas com professoras e coordenadoras, e a observação de vivências do tempo livre propostas às crianças de quatro e cinco anos, em duas escolas municipais. Da análise de fundamentos teóricos derivaram implicações pedagógicas, tais como a possibilidade do tempo livre promover o exercício de diferentes capacidades humanas nas crianças e o acesso à cultura mais elaborada a fim de motivar, nos docentes, reflexões sobre o valor do tempo livre intencionalmente organizado para a formação e o desenvolvimento integral das crianças. As análises apontaram a necessidade de o professor reconhecer, no processo de desenvolvimento infantil, a importância do tempo livre para o protagonismo das crianças, promovendo propostas capazes de desenvolver e exercitar habilidades humanas fundamentais, tais como: a capacidade de escolher, de tomar decisões, de planejar, de buscar soluções e de trabalhar de forma colaborativa, gradativamente exercitando e apropriando-se do autocontrole em sua conduta.
Child development is achieved by means of social situations in which the child's activity is privileged, mobilizing her actions to think, feel and act in an increasingly elaborate way. For this reason, the *teacher`s work in a early childhood Education involves creating of objective conditions for children to play, to relate, to express ideas, to externalize learning, thus becoming more and more human. Such conditions require the organization of spaces, the use of time, materials used and relationships in which active participation of the child acts as the main element. Thus, the guiding problem of this work was: how to propose children's free time in Early Childhood Education, with a view to their full development? Seeking the general objective of the present research to characterize the elements that make up the free time in the School of Infant Education, questions were approached regarding the management of free time by the children and the influence of this time for their humanization from the perspective of Historical-Cultural Theory. In addition, this research had the specific objective of discussing the contributions of free time to the development of human capacities, in particular, the appropriation of the child's self-control of behavior. The hypothesis that guided the study was that the free time in Early Childhood Education enables children to experience their human development. With a qualitative approach, the exploratory research involved a bibliographical review in several digital sources for knowledge of the production in the area, semi-structured interviews with teachers and coordinators, and the observation of free time experiences offered to children of 4 and 5 years of age in two municipal schools. From the analysis of theoretical foundations derived pedagogical implications, such as the possibility of free time promoting the exercise of different human capacities in children and access to the more elaborate culture in order to motivate, in the teachers, reflections on the value of free time intentionally organized for training and development of children. The analyzes pointed out the need for the teacher to recognize in the process of child development the importance of free time for children to play a role, promoting proposals capable of developing and exercising fundamental human skills such as: the ability to choose, to plan, to seek solutions and to work collaboratively, gradually exercising and appropriating self-control in their conduct.

O presente trabalho analisa como o economista austríaco Friedrich August von Hayek estrutura sua teoria da justiça, identificando a realização do ideal de justiça numa sociedade livre com a vigência do Estado de Direito, ou seja, do governo das normas gerais de conduta justa, que deverão ser aplicadas sempre visando a igualdade formal (isonomia). Ainda, discute os motivos pelos quais o autor considera que a liberdade individual só poderá efetivamente florescer em uma ordem espontânea, que funciona baseada na concorrência, a qual só poderá se manter onde vigore o Estado de Direito e, portanto, haja justiça formal.
The present paper analyzes how the economist Friedrich August von Hayek structures his theory of justice, identifying the accomplishment of the ideal of justice in a free society with the Rule of Law, that is to say, in the government of rules of just conduct, which must be applied always aiming at the equality before the law (isonomia). Besides, this paper discusses the reasons why the author considers that liberty can effectively flourish only in a spontaneous order that performs based on competition, which will be maintained where the Rule of Law stands and, therefore, the formal justice is present.

This research discusses the relationship between music, youth culture and party in the urban space. Its part of the perception of youth as a socially constructed category, in addition to age and identity principles generally attributed to this stage of the life cycle of the individual. It aims to understand social practices, attitudes, consumption practices, discourses and symbols adopted by the youth during their participation in a specific type of electronic music festival, commonly known as rave. The raves happen not only in different places, but mainly in the open spaces, is also called “open air festivals”. These festivals occur most often in areas that stand out for its natural beauty, choosing to host the events from sites, farms and hotels away from the city. The empirical material from which stems the reflections that follow include bibliographical, documentary, and especially field research, participant observation carried out during the period 2008 to 2009, it was possible to attend 17 raves held in Fortaleza and cities neighbors.
A presente pesquisa trata da relação entre música, juventude e festa no espaço urbano. Parte da percepção da juventude como uma categoria socialmente construída, para além das faixas etárias e dos princípios identitários geralmente atribuídos a esta etapa do ciclo de vida do indivíduo. Tem como objetivo compreender sociabilidades, comportamentos, práticas de consumo, discursos e símbolos adotados pelos jovens durante sua participação em um tipo específico de festa de música eletrônica, comumente conhecida como rave. As raves acontecem não somente em locais diferentes, mas, principalmente, a céu aberto, sendo também chamadas de “festas open air”. Tais festas ocorrem, na maioria das vezes, em ambientes que se destacam por suas belezas naturais, elegendo como sede para os eventos desde sítios, chácaras e hotéis afastados da cidade, até barracas de praia localizadas em áreas pouco freqüentadas pela população em geral. O material empírico a partir do qual se estruturam as reflexões que se seguem inclui levantamento bibliográfico, documental e, principalmente, pesquisa de campo, com observação participante realizada durante o período de 2008 a 2009, onde foi possível freqüentar 17 raves organizadas em Fortaleza e cidades vizinhas.

This dissertation applies the concept of hegemonic masculinity. as first proposed by R.W Connell in her book Masculinities, to three works of medieval chivalric conduct literature. This dissertation asserts that the authors of the Ordene de chevalerie, the Livre de chevalerie of Geoffroi de Charny and the Espejo de verdadera nobleza create an image of knightly masculinity that demonstrates its superiority over other forms of medieval masculinity. At the same time, each text serves a secondary purpose; in elucidating the values and political aims of its author. The Ordene de chevalerie demonstrates the hegemonic nature of knighthood by means of its frame story while at the same time trying to show how the knighthood is intimately linked to the Christian faith by means of the ritual of initiation into the knighthood. The Livre de chevalerie provides guidance on how to obtain honor and prowess, while at the same showing how the knighthood is superior to the clerical class, another powerful mode of medieval masculinity. The Espejo de verdadera nobleza demonstrates that the hegemonic form of masculinity embodied in the knighthood was open to those who showed the necessary characteristics and won the approval of the sovereign. The Espejo acts as means of institutionalizing the knighthood and shows the first imaginings of how the knighthood would change with the advent of the Renaissance. By using a theoretical framework more common to the fields of sociology and management studies to explore these texts, this dissertation demonstrates how theories that are accepted in these fields may be applied to literary and medieval studies. This dissertation also seeks to bring greater attention to the genre of chivalric conduct literature, a genre that does not receive as much attention from scholars as other medieval genres such as epic and romance. This dissertation seeks to show that chivalric conduct literature is a fruitful field of study and that these three lesser known works in this genre provide valuable medieval perspectives on the concepts of knightly masculinity. Although these authors define knighthood differently, they all agree that knighthood plays a defining role in constructing and modeling a superior form of masculinity.

A presente dissertação abarcará cinco temas bastante específicos: a defesa da concorrência, a defesa do consumidor, a prática do cartel, as formas consensuais de seu combate e investigação e o bem-estar do consumidor. No Brasil, verifica-se que, tanto a defesa da concorrência como a do consumidor se unem por um objetivo comum: o bem-estar do consumidor. Por isso, práticas tidas como ofensivas à ordem econômica podem desencadear danos graves aos consumidores, sendo um relevante exemplo disto a formação de cartéis, especialmente os relacionados à alteração artificial de preços. Dentre as práticas abusivas previstas no CDC, foi lançada elevação de preços sem justa causa, o que torna possível que a prática do cartel ou, ao menos, os seus efeitos sobre o preço, possam vir a ser reprimidos por ambas as esferas. Nesse sentido, buscou-se analisar os institutos consensuais de combate aos cartéis previstos na lei de concorrência: o “compromisso de cessação de conduta” e o “programa de leniência”, assim como seus possíveis efeitos benéficos sobre os consumidores. Desta feita, a presente dissertação visou a responder aos seguintes problemas de pesquisa: (i) qual o arcabouço jurídico-institucional à disposição da defesa do consumidor e da concorrência? (ii) qual o liame entre estas duas esferas? (iii) o que é “cartel” e de que forma ele atinge os consumidores (iv) o que são o “compromisso de cessação de conduta” e o “programa de leniência” e qual a sua utilidade ao combate dos cartéis? A conclusão obtida é que a defesa da concorrência e a do consumidor possuem um objetivo comum, o bem-estar do consumidor, a primeira de forma mediata e a segunda, imediata. Ademais, verificou-se o “cartel” como uma conduta altamente agressiva à livre concorrência e aos interesses dos consumidores, sendo possível que seus efeitos, de forma indireta, sejam penalizados pelo CDC. Finalmente, verificou-se a grande utilidade das formas consensuais – “compromisso de cessação de conduta” e “programa de leniência” – não apenas ao combate aos cartéis quanto à imediata cessação de seus efeitos, mas também como grande ferramenta de prova de sua ocorrência e garantia do bem-estar dos consumidores.
The presente dissetation involves five very specific issues: antitrust, consumer protection, cartels, consensual forms of its combat and investigation and consumer welfare. In Brazil, it is found that both the defense of competition as the consumer defense are united by a common goal: consumer welfare. Therefore, practices seen as offensive to the economic order can trigger serious harm to consumers, being a relevant example the cartel formation, especially those related to artificial price change. Among the abusive practices set out in Brazilian Consumer Defese Code (CDC), it was registered the prices raise without just cause, which makes it possible that the cartel, or at least its effects on the price, may be suppressed by both spheres. Therefore, it sought to analyze the consensual institutes of cartel’s combat and investigation under competition law: the "Conduct Consent Decree" and "Leniency Program", as well as their possible beneficial effects on consumers. Thereby, this dissertation aimed to answer the following research problems: (i) what is the legal and institutional framework available to the consumer’s and competition’s protection? (ii) what is the link between these two spheres? (iii) what is "cartel" and how it affects consumers? (iv) what are the "Conduct Consent Decree" and "Leniency Program" and what is its usefulness to cartel’s combat? The reached conclusion is that the defense of competition and the defense of consumer have a common purpose, consumer welfare, the first in a mediate way and the second immediately. In addition, the "cartel" was established as a highly aggressive approach to free competition and to the interests of consumers, being possible that their effects, indirectly, be penalized by the CDC. - "Conduct Consent Decree" and "Leniency Program" - not only to fight against cartels to the immediate cessation of its effects, but also as a great proof tool of its occurrence and assurance of the well-being of consumers.

Normatively, protecting civilians from the conduct of hostilities is grounded in the Geneva Conventions and the UN Security Council protection of civilian agenda, both of which celebrate their 70 and 20 year anniversaries in 2019. Previous research focusses heavily on protection of civilians through peacekeeping whereas this research focuses on ‘non-armed’ approaches to enhancing civilian protection in conflict. Prior research and experience reveals a high level of missingness and variation in the level of available data on civilian harm in conflict. Where civilian harm is considered in the peace and conflict literature, it is predominantly from a securitized lens of understanding insurgent recruitment strategies and more recent counter-insurgent strategies aimed at winning ‘hearts and minds’. Through a structured focused comparison of four case studies the correlation between the level of quality, timely and consistent data on civilian harm and affect on the conduct of hostilities will be reviewed and potential confounders identified. Following this the hypothesized causal mechanism will be process traced through the pathway case of Afghanistan. The findings and analysis from both methods identify support for the theory and it’s refinement with important nuances in the factors conducive to quality, timely and consistent data collection on civilian harm in armed conflict.

AbstractVulnerable populations are often hard to reach. Ethnic or sexual minorities, people living at the margins of social, economic, educational or occupational systems and structures are frequently experiencing precariousness, dealing with unsure material and symbolic resources. However, those populations are most of the time concealed and unseen in big statistical surveys, precisely as they stand at the edges of main social groups. Therefore, it seems very worthwhile to develop specific tool to conduct surveys on those most vulnerable populations, and mixed methods approaches are particularly relevant for that purpose. In this chapter, we will mainly rely on the Musicians LIVES survey conducted between 2012 and 2016 on “ordinary musicians” (nor rich or famous) in French-speaking Switzerland. From the sampling method to the data collection, we crossed quantitative and qualitative approaches in order to get significant and accurate results on a very informal occupational space. The chapter will be enhanced by different example and cases from other surveys conducted within the NCCR LIVES over the last decade.

AbstractMore than 617 million children and adolescents lack the basic reading and mathematics skills required to live healthy and productive lives. Malawi ranks particularly poorly, with an average pupil to teacher ratio of 77:1 and a 50% dropout rate among primary school children. Established in 2013, the Unlocking Talent initiative uses e-Learning technology to help overcome educational challenges. It equips touch-screen tablets with customisable software that delivers lessons through multisensory experiences (e.g. pictures, sound, video and animation). Throughout Malawi, small groups of students in public primary schools have accessed these tablets during weekly sessions on-site. This case study describes a series of evaluations of this e-Learning technology in Malawi, conducted in tandem with experiments in other countries (including the United Kingdom, Brazil, South Africa, Tanzania, Kenya and Ethiopia). Following a pilot evaluation to assess the feasibility of e-Learning in raising learning outcomes, multiple large-scale randomised control trials were conducted. Learning gains hold across multiple cohorts of children and across different countries, generating more than a 3-month advantage in basic mathematics and more than a 4-month advantage in basic reading on average. The intervention also bridges gender gaps in mathematics skills attainment in Malawi.

Abstract A narrative approach is taken in this chapter to document and analyze the gendered social and socio-environmental consequences of globalized river basin development using water as the lens to understand the depth and breadth of these changes in people's lives. The chapter is based on primary multi-site ethnographic field research conducted in all three active dam areas of Lesotho in 1997 and 2000-2002, as well as ongoing documentary research. Water remains central within Lesotho's national development plans and to the stability of the region even amid changing climate conditions. More locally, as water becomes more precarious within the lives of highlands residents living near the Lesotho Highlands Water Project (LHWP), this chapter reveals the multi-layered, complex, embodied experiences of infrastructure policy and its consequences, for the everyday lives and livelihoods of people directly affected by these projects.

AbstractImmediately after the Great Hanshin-Awaji Earthquake in 1995 and the Great East Japan Earthquake in 2011, pneumonia outbreak among the elderly increased the rate of fatalities. What caused this? To use lessons learned during the large-scale disaster, specialists concerned with the field of dentistry began to take action using new perspectives. Consequently, they noticed the importance of giving care to the entire oral cavity as well as the teeth. Based on reports from a dentist and a dental hygienist who tackled the oral care of the Kumamoto Earthquake victims in 2016, their methods of effective health care following a disaster is presented in this paper. We also propose a preventative medical activity that can be conducted sustainably for anyone, not just medical personnel.

AbstractHuman rights have been facing criticism on many fronts, including the challenges of the “enforcement gap” and the “citizenship gap”, laying bare the shortcomings with regard to the implementation of human rights law as well as regarding its protection of highly vulnerable groups such as refugees. Research on the effectiveness of human rights, the “localisation” of human rights through invocations and practices on the ground, the increased engagement of local authorities with human rights, are all responses to such challenges to some degree. Based on empirical research conducted within municipalities in four countries, this chapter focuses on a missing piece of the puzzle in terms of conceptual and empirical research: the role of “individual agency”. We adopt a socio-legal perspective on human rights and demonstrate that individual agency can make an important contribution to the effective implementation of human rights in the field of migration governance. Behind the black box of the state and local authorities, we find individuals who use human rights—as law, practice and discourse—in local policymaking, in circumstances where invoking human rights is not self-explanatory. Finally, we put forward the notion that reasons such as individual background, motivations, and interactions between individuals influence municipal officials’ engagement with human rights, and we reflect on the conceptual and practical implications that result from this.

AbstractIn this chapter, we take a closer look at how the affordances of digital technology in children’s and young people’s everyday lives enable them to participate and take agency in a world that reaches outside the limitations of their physical one. Building on Bronfenbrenner’s nested ecological systems theory, and Neal and Neal’s networked ecological systems, we explore how children’s digital interactions contribute to constructing new mesosystems, beyond the ones predefined by their physical/everyday/tangible microsystems. Children and young people exploiting the porosity of such systems may lead to the creation of new learning spaces that teachers and parents are unaware of. In these spaces, knowledge that is or is not recognised in traditional learning spaces can be created and shared among children and young people themselves as well as moral strategies and conducts of behaviour. We argue that this calls for greater involvement from adults in children’s digital lives.

Abstract:
This paper presents a code review (API 17G, ASME VIII Div 2 and ASME VIII Div 3) for addressing the fatigue capacity of steel cylindrical bodies and conduits subjected to cyclic pressure only. The fatigue capacity for pipes with a yield strength of 75ksi and 90ksi and with rated working pressures (RWP) ranging from 5ksi to 30ksi have been considered using both the S-N approach and the fracture mechanic approach. The S-N based fatigue lives from API 17G are found to be much longer than the corresponding S-N based fatigue lives from ASME VIII Div 2 and Div 3 and by the fracture mechanic (FM) approach as required in ASME VIII Div 3 for vessels where a leak-before-break condition can not be demonstrated. The S-N predicted fatigue lives are found to decrease with increasing RWP while the FM based fatigue lives are found to be rather independent of the RWP. The S-N based fatigue lives from ASME VIII Div 2 and Div 3 for free corrosion conditions are found to be shorter than the corresponding FM based fatigue lives for RWPs ≥ 25ksi and ≥ 20ksi, respectively. Based on this work, it is recommended to establish the fatigue capacity of steel cylindrical bodies and conduits subjected to cyclic pressure using either ASME VIII Div 2 or Div 3. The FM approach is considered to give a lower bound fatigue life as the number of cycles to initiate a crack is disregarded. Guidance on when it is considered applicable to use the API 17G criterion is given in the conclusion section of this paper.

Introduction: Almost two million people worldwide die annually due to hepatic-related diseases. Half of these diseases are attributed to cirrhosis and the other half are related to hepatitis and hepatocellular carcinoma (HCC). The liver is also a metastasis hub from adjacent organs. This research aims to create an accurate high-quality delineation of the human liver and prepare them to be 3D printed for medical analysis to help aid medical practitioners in pre-procedural planning. Materials and Methods: Convolutional neural networks (ConvNets) are used to perform the liver tissues delineation. A famous ConvNet, named U-net, is used as the basis benchmark architecture that is also known for its great outcomes in the medical segmentation field. Contrast-enhanced computerized tomography (CT) scans are used from the famous Medical Segmentation Decathlon Challenge (Task 8: Hepatic Vessel), abbreviated as MSDC-T8. It contains 443 CT scans, which is considered the largest dataset that contains both the tumors and vessels ground-truth segmentation. Some researchers also generated the liver masks for this dataset, making it a complete dataset that contains all the relevant tissues’ ground-truth masks. Results: Currently, the liver delineation has been successfully done with very high DICE = 98.12% (higher than the state-of-the-art results DICE = 97.61%), where a comparison between two famous schedulers namely, ReduceLRonPlateau and OneCycleLR has been conducted. Moreover, the 3D liver volume creation has also been completed and built via the marching cube algorithm. Conclusions/Future Directions: The developed ConvNet can segment livers with high confidence. The tumor(s) and vessels tissues segmentation are also under investigation now. Moreover, newly devised self-organized neural networks (Self-ONN) look promising and will be investigated soon. Lastly, a GUI will be built so that the medical practitioner can just insert the CT volume and get the 3D liver volume with all the segmented tissues.

This paper addresses the role of public leisure spaces in the construction of inclusive and sustainable cities. It is the result of reflections developed from research conducted on the squares in the continental portion of the city of Florianópolis, Brazil. It defines the concept of public open space as the material support for the existence of social and political life in cities. Moreover, it highlights the importance of public leisure spaces, squares and parks, which assume the character of multifunctionality, from the historical functions of fruition and sociability in the urban context to the ecological functions determined by the demands of climate change. The systems of public open spaces are, therefore, elements that structure the urban space and establish the bases and principles for territorial planning. Abstract Hypothermic machine perfusion preservation (MPP) has the potential to relieve the current donor shortage problem by providing superior preserved tissue and viable non-heart-beating donor tissue. For the liver, MPP has not improved preservation. Currently, the major cause of damage associated with MPP of livers is unknown. An intravital microscopy study was conducted to investigate the state of sinusoidal perfusion during 24-hour MPP. Fluorescein isothiocynate (FITC)-labeled albumin was utilized to mark the microvascular space while FITC-labeled red blood cells were used to determine the fluid velocity. The results showed that there was an increase in vascular resistance (> 275%) when the liver was perfused with a UW solution for 24 hours at 5°C and with a flow rate of 5 ml/min. This vascular resistance further increased (> 425%) during rewarming (for 1 hour, at 37°C and 15 ml/min). The mean flow velocities increased during initial MPP from 236 ±16 μm/s (mean ± standard error) to 434 ± 20 μm/s and the mean shear stress values increased from 5.3 ± 0.8 dynes/cm2 to 6.5 ± 0.8 dynes/cm2, after 24 hours of MPP the mean flow velocity values and shear stress values decreased (223 ± 13 μm/s and 3.3 ± 0.8 dynes/cm2) respectively. The reason for this was detected by the FITC-labeled albumin, in the tissue. It was evident that these areas (after 24 hours of MPP) also displayed increased blockage. It also appeared from the micrographs and the histology study that the blockage occurred as a result of endothelial cells rounding after 24 hours of MPP. The cells remained rounded even after rewarming the tissue. This could be a mechanism of damage to the liver during 24-hour of MPP.

This article is the first part of a broad research on digital inclusion policies in Brazil. In particular, this research aims to find out how free and open source software (FLOSS) has been used in digital inclusion actions. To support this work, we conducted a literature review, with no starting date limit, searching for scientific production that relates digital inclusion with the concepts of free software or open source software. We found 66 works, published between 2003 and 2022, which include journal articles, conference papers, bachelor, specialist and master dissertations, doctoral theses and books. These papers were produced by authors from 37 different research institutions, within 28 programs or courses. It was possible to highlight some categories in this preliminary analysis, such as accessibility, policies, and “telecentros” (community technological centers), but a deeper analysis is needed to better understand the contributions of this scientific production.

Background : Nonalcoholic fatty liver disease (NAFLD) is increasingly recognized as a cause of chronic liver disease, and often results in the devastating outcomes of decompensated liver cirrhosis and hepatocellular carcinoma and is an important feature of metabolic syndromes and insulin resistance. The assessment of liver brosis is essential for predicting the prognosis and outcome of all forms of chronic liver disease. A liver biopsy is the gold standard for the assessment of liver brosis, but it has its limitations, which include life-threatening complications. Alternative methods of non-invasive laboratory and radiological testing for the assessment of liver brosis in NAFLD have evolved during the past decade, and these methods may be able to overcome the limitations of liver biopsy. These methods include the AST/ALT ratio, the AST platelet ratio index (APRI), and the Fibrosis 4 (FIB-4) score. This study was conducted in order to assess liver brosis using Fibroscan, and to compare these results to the use of AST platelet ratio index (APRI scores), and the AST/ALT ratios on NAFLD patients. METHODS: This was a cross sectional study conducted in King George Hospital Visakhapatnam,A total 122 patients were studied of which 65 were males and 57 were females.all the patients were subjected to relevant investigations including ultrasound abdomen,serum liver enzymes,broscan. The (SPSS) version 20 was used for the analysis.A Student's t-test was used to compare the AST/ALT ratio to the APRI scores between patients with advanced brosis higher than F2 and patients with mild to moderate brosis of F2 or less. RESULTS :The data showed that a high percentage of the NAFLD patients exhibited advanced stages of liver brosis based on the Fibroscan examinations. These results were supported by the strong correlation between the Fibroscan results and the AST/ALT ratio and APRI scores. Correlation analysis showed a signicant positive correlation between age and brosis scores (r = 0.27 with P = 0.004 for Pearson correlations). On the other hand, a signicant negative correlation between platelet count and stiffness scores was obtained (r = - 0.315 with P= 0.001 for Pearson correlations). Serum ALT level was determined to be signicantly negatively correlated with age by using Spearman correlations (r = - 0.232, and P = 0.022). A signicant positive correlation was observed between serum ALT and hepatic stiffness measurements using Spearman correlations (r = 0.284, and P = 0.005). This study has shown that the combination of Fibroscan CONCLUSION: and AST/ALT and APRI methods provides a valuable approach for assessing liver brosis in NAFLD patients. This can eliminate the need for liver biopsy in patients without clear indication

Firefighters routinely conduct live fire training in an effort to prepare themselves for the challenges of the fire ground. While conducting realistic live fire training is important, it also carries inherent risks. This is highlighted by several live fire training incidents in which an inappropriate fuel load contributed to the death of participants. NFPA 1403: Standard on Live Fire Training Evolutions was first established in response to a live fire training incident in which several firefighters died. Among the stipulations in NFPA 1403 is that the fuel load shall be composed of wood-based fuels. The challenge of balancing safety with fidelity has led instructors to explore a variety of different methods to create more realistic training conditions. A series of experiments was conducted in order to characterize common training fuels, compare these training fuels to furnishings, and examine the performance of these training fuels in a metal container prop. Heat release rate (HRR) characterization of training fuels indicated that wood-based training fuels had a constant effective heat of combustion. Depending on the method used, this value was between 13.6 and 13.9 MJ/kg. This indicates that, even in engineered wood products, wood is the primary material responsible for combustion. In order to further explore the conclusions from the HRR testing, additional experiments were conducted in an L-shaped metal training prop. The results of these experiments highlighted a number of considerations for firefighter training. Thermal conditions consistent with “realistic fires” could be produced using NFPA 1403 compliant fuels, and in fact the thermal conditions produced by larger wood-based fuel packages were more severe than those produced by fuel packages with a small amount of synthetic fuel. The fuel package used in training evolutions should reflect the training prop or building being used, the available ventilation, and the intended lesson. Fuel load weight and orientation are both important considerations when designing a fuel package. The training considerations drawn from this report will help to increase firefighters’ understanding of fire dynamics, and help instructors better understand fuel packages and the fire dynamics that they produce.

Twenty children documented their daily activities using a mobile app, with support and accompaniment from CLARISSA researchers. Subsequently, a collaborative analysis was conducted with participants and the CLARISSA research team, culminating in the formation of a number of GIS-based Action Research Groups to work on predominant issues or themes. This process generated evidence that is often deeply veiled and difficult to uncover. The formation of this ARG was prompted by recurring issues around children’s journeys to work that emerged through the research. The group was focused on the theme, ‘The journey to work and back’.

Large and growing numbers of young people are in neither employment nor education and training. Many of them are young mothers (termed “parenting girls” in this report). When the Commonwealth of Learning’s Open Schooling initiative heard that Rwanda was having some success in getting parenting girls back into school, it commissioned a study to get a better understanding of the learning pathways involved. Focus group interviews were conducted over several months with parenting girls who had returned to education. In these focus groups, the researchers explored how the girls’ pregnancy and subsequent dropping out of school had impacted their lives, the factors that led them to return to school and the factors that could help build their resilience to remain in school.

The direct benefits of transport projects are well known; paving roads reduces vehicular operating costs, mass transport systems reduce commuting times and road maintenance prolongs their operating lifespan. Impact evaluation reveals a range of ways in which transport projects improve lives. The empirical evidence shows that paved roads encourage preventive healthcare and increase employment opportunities, mass transport systems improve air quality and reduce crime, and satisfaction of road maintenance increases when services are provided by local communities.Impact evaluations generate valuable information for both executing agencies and stakeholders. Their results provide rigorous measurements of the effect of a project, who benefits the most and why. As a result, the evidence generated by well-conducted impact evaluations is increasingly used to attract resources to effective investments and to guide institutional choices.
