La décision d’un esclave de revendiquer sa liberté en justice est certes un acte de résistance contre l’esclavage, mais ce n’est pas nécessairement un acte antiesclavagiste. Au moyen de la micro histoire, cet article fait état des différences entre la compréhension personnelle d’un esclave de sa condition injuste et les arguments avancés par ses avocats pour obtenir sa liberté. La lutte individuelle de l’esclave Furcy n’a pas contribué de manière significative au mouvement antiesclavagiste français au XIXe siècle. Au contraire, la décision de la Cour royale d’affranchir Furcy en fonction du principe du sol libre a stabilisé le régime esclavagiste colonial jusqu’à la Révolution de 1848.

La philosophie médiévale a cherché la « racine de la liberté » (donc le libre arbitre radical), tantôt dans la raison (Siger de Brabant), tantôt dans la volonté (Henri de Gand), tantôt dans une combinaison des deux : la volonté comme sujet, la raison comme cause (Thomas d’Aquin). Faut-il donner raison à l’une de ces positions, et sont-elles « libertariennes » ( libertarian ) ou compatibilistes ? Au lieu de répondre à cette question, l’auteur essaie plutôt de chercher le sol nourricier, plus profond encore, qui donne sens à ce débat : à ce niveau plus fondamental que la dispute scolaire, la liberté consiste, non dans la faculté d’agir autrement, mais dans la manifestation du bien.

Dans les villes polonaises, l’institutions du maire héréditaire de ville (en polonais: wójt) est apparue en liaison de la location des villes sur le droit allemand. Le droit allemand constituait la forme d’organisation et institutionelle plus développée et son transplantation en Pologne ne serait pas possible, s’il n’y avait pas déjà les villes dans le sens des centres économiques et sociaux. Moyennant ses efforts dans la location, le maire de ville recevait la dotation du sol et d’autres revenus. La volonté du seigneur et la dimension de la ville décidaient du montant et de la qualité de cette dotation. La propriété de la terre constituait le droit le plus important dont juissait le maire. A part le sol strictement agricole, il recevait aussi les parcelles destinées à créer des jardins ou pour les exploiter comme prairies ou pâturages. Le privilège plus rare était la possession du sol pro ecclesia. Sur la terre non-censuelle, le maire avait le droit de pleine propriété utile (dominium utile). Outre cela, il juissait des droits forestiers, c’est-à-dire de l’abbatage libre des arbres et de la liberté de la chasse. Parmi les differentes formes de la dotation en faveur des maires de ville, il y avait aussi les droits à l’exploitation des rivières et des viviers, à établir des moulins, des tavernes, des bains et des atelliers d’artisan. De tous ses droits le maire pouvait juir aussi après les années de la liberté censuelle (en polonais: wolnizna). La position très attractive du maire de ville était une des causes de son déclin.

Il semble acquis qu’au milieu du XIe siècle, lorsque les sources écrites redeviennent abondantes, les serfs ne constituent pas en Normandie un groupe social identifiable. Quelques chartes isolées et le vocabulaire des actes gardent pourtant la trace de pratiques serviles, sans doute alors en voie de disparition. La documentation des XIIIe et XIVe siècles montre d’ailleurs la survie dans les institutions domaniales d’usages ailleurs qualifiés de serviles, comme la mainmorte et le formariage, pour des groupes de «vilains» que rien ne désigne autrement comme non-libres. Cette situation quelque peu paradoxale incite à s’interroger sur l’évolution complexe de la hiérarchie sociale de la paysannerie normande, jouissant de par la coutume d’une complète liberté personnelle, alors que les systèmes de tenure qui règlent la possession du sol gardent la marque de systèmes de dépendance anciens et stables.

L’exil est la condition même du langage romanesque et poétique et il serait vain de vouloir démêler la part du destin et de la liberté qui se joue dans la vie d’un écrivain : n’est-il pas, comme par vocation, toujours à l’œuvre au cours d’un inlassable exode ? Ici ou là, aussi simple et familier qu’il soit, la hantise de l’écriture le met à part des liens du sol et du sang. Un beau symbole de cette étrangeté irréductible nous est donné par le dernier recueil de François Cheng, Échos du silence (Créaphis, 2018). Ce livre a le format d’un passeport et vient en contrepoint de photographies en noir et blanc du fleuve Saint-Laurent au Québec. C’est un autre pays que la France ou la Chine, c’est l’arrière-pays de l’écriture.

FR. En 1870, lorsqu’éclate la guerre entre la France et la Prusse, le reportage de guerre n’existe pas encore sous la forme contemporaine. Les journaux quotidiens couvrent pourtant ce conflit de près, en envoyant des correspondants sur le terrain. Depuis le début de l’ère médiatique1, c’est en effet la première guerre sur le sol français. Cet article se focalise sur le récit qui en fait par ces correspondants, français, dans l’optique de chercher à identifier comment s’y forme un « proto-reportage » de guerre. À partir de la perspective représentationnelle formulée par Louis Marin, l’article montre comment les récits de guerre produisent un « effet de sujet-reporter » et comment cette posture spécifique à la guerre contribue à faire évoluer le reportage. Partant du postulat que la guerre constitue un moment d’accélération et de densification de la poétique de ce genre journalistique en construction, l’analyse est centrée sur le méta-discours qui, dans les articles de cinq quotidiens français, Le Figaro, Le journal des débats politiques et littéraires, Le Petit Journal, La Liberté et Le Gaulois, accompagne la couverture des faits d’armes. Ce méta-discours permet de saisir l’affirmation d’une figure du proto-reporter de guerre, à travers le récit des difficultés à surmonter pour réussir à communiquer l’information au quotidien comme à travers son imbrication dans différentes figures du collectif, de l’armée française à la nation toute entière. Au long de ces deux axes, l’article met en lumière la participation de ce « proto-reportage » de guerre et, à travers lui, de la presse d’information à la structuration d’imaginaires nationaux et à la « biographie des nations », tels que théorisés par Benedict Anderson. *** EN. When the war between France and Prussia broke out in 1870 the so-called “war reportage” did not exist as it is known today. Yet, the daily newspapers closely followed and covered this conflict, by sending journalists on the battlefield. Since the beginning of the “media era” 2 this was the first war that took place on French soil. This paper focuses on the narrative of the war as it was written by the French journalists in order to identify how this narrative shaped a “proto war reportage”. From a representational perspective, based on the writings of Louis Marin, the article shows how war narratives produced a “subject-reporter effect” and how this war-specific posture contributed to the evolution of the reportage. With the assumption that war acts as an acceleration and densification process in the development of this journalistic genre the analysis focuses on the meta-discourse in five French newspapers (Le Figaro, Le journal des débats politiques et littéraires, Le Petit Journal, La Liberté and Le Gaulois) that went along with the coverage of military and war. This meta-discourse enables to understand the affirmation of the proto war reporter through the narrative of difficulties regarding the daily communication with the newsrooms as well as its affiliation to several collective imaginaries such as the greatness of the French army or the French nation. Along these two topics the article highlights how this “proto war reportage” and therefore the news press contributes to the construction of national imaginaries and the “biography of nations” as theorized by Benedict Anderson. *** PT. Em 1870, quando explode a guerra entre a França e a Prússia, a reportagem de guerra ainda não existe em sua forma contemporânea. Entretanto, os jornais diários já cobriam de perto o conflito, enviando correspondentes a campo. Desde o início da era midiática, essa foi, de fato, a primeira guerra em solo francês. Este artigo dá foco às narrativas apresentadas por esses correspondentes franceses, no intuito de mostrar como se forma uma "proto-reportagem" de guerra. Com base na perspectiva representacional formulada por Louis Marin, o artigo mostra como as narrativas de guerra produzem um "efeito de sujeito-repórter" e como essa postura específica frente à guerra contribuiu para a evolução da reportagem. Partindo da premissa de que a guerra constitui um momento de aceleração e densificação da poética desse gênero jornalístico em construção, a análise se concentra no meta-discurso que, nas matérias de cinco diários franceses, Le Figaro, Le journal des débats politiques et littéraires, Le Petit Journal, La Liberté e Le Gaulois, acompanha a cobertura dos conflitos armados. Pela análise desse meta-discurso, identifica-se a afirmação da figura do proto-repórter de guerra, que se manifestas tanto nos relatos das dificuldades enfrentadas para conseguir comunicar diariamente informações, como na relação com diferentes figuras do coletivo, do exército francês e da nação como um todo. Five new species of Epitola s.l. (Lycaenidae: Poritiinae) are described in the genera Stempfferia Jackson, 1962 and Cephetola Libert, 1999. Stempfferia salonga sp. n. was found in the ‘Cuvette Centrale’ of the Democratic Republic of Congo and a single specimen was identified also from southern Cameroon. The similar S. buea sp. n. is known only from the unique holotype collected at the foothills of Mount Cameroon, while S. michelliberti sp. n. is distributed in lowland rainforest between southeast Ivory Coast and Guinea. The new species of Cephetola were found only in Liberia. Cephetola praecox sp. n. is known from a single upland forest locality in the Putu Range, whereas C. wologizi sp. n. was collected also in upland forest in the Wologizi Mountains.

<p>The author agrees with the Constitutional Tribunal’s opinion that Article 87 § 1 of the Penal Code to the extent that it imposes an obligation on the court to combine imprisonment and restriction of liberty and to impose a total penalty of deprivation of liberty after converting the penalty of restriction of liberty into imprisonment is inconsistent with the Constitution of the Republic of Poland. In addition, the author raised the problem of <em>ratio legis</em> of Article 87 of the Penal Code and indicated why the deficiencies in regulation were noticed so late in the case law.</p>

INTRODUÇÃO: A escleroterapia é um dos procedimentos mais realizados pelos angiologistas e cirurgiões vasculares brasileiros. O princípio básico é eliminar a veia varicosa, destruindo a sua parede interna. No Brasil, há uma diversidade de condutas que envolvem este tratamento, principalmente quanto ao tipo de esclerosante, associação com laser, uso de luva durante o procedimento, tempo recomendado de repouso, exposição ao sol, prática de atividade física, uso de compressão pós-escleroterapia, entre outros. OBJETIVO: conhecer as mais variadas condutas e técnicas desta modalidade terapêutica, muito praticada entre os angiologistas brasileiros. MÉTODO: A pesquisa foi realizada entre angiologistas membros da Sociedade Brasileira de Angiologia e Cirurgia Vascular - SBACV, que responderam um questionário sobre as técnicas e indicações da escleroterapia em varizes dos membros inferiores no Brasil. O link (www.iniciacaocientica.com.br/pne) foi disponibilizado com questões de múltipla escolha. RESULTADOS: Duzentos e trinta e dois médicos responderam ao questionário proposto. Luvas durante o procedimento são usadas por 79,74% dos médicos; a compressão é utilizada por 52,59%; quanto à atividade física pós-escleroterapia, 46,12% não restringem e 52,59% liberam após 1 a 3 dias; mecanismos para diminuir a dor durante o procedimento são utilizado por 43,53% dos entrevistados; a glicose 75% foi o esclerosante mais utilizado em 35,34%; a complicação sistêmica mais frequente foi a lipotimia com 7,76% e o local mais frequente foi a hipercromia com 66,38%; em relação à liberação para sol depois do procedimento: 28,02% liberam após a escleroterapia com filtro solar, 24,57% liberam após 15 a 30 dias e 25,43% liberam com menos de 15 dias. CONCLUSÃO: A pesquisa revelou que, apesar da escleroterapia ser amplamente utilizada na prática diária do angiologista brasileiro, há pouca concordância em pontos relevantes, como, por exemplo, o uso de compressão, liberação para atividade física e exposição ao sol.

O globo terrestre paralelo é um antigo dispositivo, muito simples e criativo que, empregado de forma sistemática nas aulas de astronomia, converte-se em uma ferramenta didática de grande potencialidade. Orientado adequadamente de acordo com o meridiano local, esse instrumento permite acompanhar as sombras em qualquer região da Terra que esteja iluminada pelo Sol, além de oferecer uma visualização clara do terminadouro, a linha que divide o dia da noite em nosso planeta. Com o conhecimento das sombras, é possível estimar a latitude de uma localidade e inferir a hora solar local em qualquer lugar do hemisfério iluminado do planeta. Além disso, mediante o emprego do globo terrestre paralelo, pode-se compreender, de maneira simples, que existem regiões onde os objetos às vezes não projetam sombras e outras, pelo contrário, que às vezes se convertem em “países das sombras longas”. Neste trabalho, primeiramente, descrevemos o dispositivo, seus fundamentos básicos de construção e funcionamento. Na segunda parte, descrevemos em detalhes algumas atividades que facilitam seu emprego na aula e que temos desenvolvido em oficinas de formação docente em nosso grupo de pesquisa.

<p>In the case of illegal deprivation of liberty (Article 189 of the Penal Code) locomotive freedom (i.e. freedom to change the place of residence according to a person’s will) is the protected value. Both the actual and potential will of an individual in that respect is protected. The objective state of general possibility to execute the will’s activity is crucial for the being of the offence of illegal deprivation of liberty, while the victim’s awareness of that state is of secondary importance. Any person can be the object of the <em>actus reus</em> as long as he or she is capable of formulating a wish connected with the change of the place of residence and has the natural ability to leave the place he or she has been so far occupying, even if it is with the help of technical means (e.g. a wheelchair) or other persons. Whether the person who could activate the natural will to move, has actually such a will, is irrelevant (from the point of view of fulfilling the statutory features of the offence of deprivation of liberty). One should agree with the opinion presented by the Supreme Court in the commented verdict, according to which the statutory features of the offence from Article 189 of the Penal Code are not fulfilled by the deprivation of the liberty of movement of a person which is executed as a result of his or her own free will decision.</p>

Latar belakang. Anemia merupakan salah satu komplikasi yang sering dialami oleh bayi prematur. Batas kadar hemoglobin atau hematokrit untuk pemberian transfusi pada bayi prematur masih menjadi perdebatan. Transfusi sel darah merah bermanfaat, tetapi terdapat beberapa komplikasi. Saat ini, belum ada konsensus mengenai ambang batas kapan bayi prematur perlu mendapatkan transfusi sel darah merah.Tujuan. Mengetahui keamanan dan luaran klinis transfusi sel darah sel darah merah pada ambang batas hemoglobin liberal dan restriktif. Metode. Penulusuran pustaka database elektronik, yaitu Pubmed, Ebcohost, Embase, dan The Cochraine Library dengan kata kunci “preterm”, “AND” “transfusion”, “AND” “red blood cells”, “AND” “liberal”, “OR” “restrictive”Hasil. Penelusuran literatur diperoleh 2 artikel yang terpilih kemudian dilakukan telaah kritis. Studi oleh Fu dkk, transfusi liberal dapat mengurangi durasi suplementasi oksigen dan penggunaan ventilator dengan MD 3,56 (95% IK: 1,93-5,18, p<0,001) dan MD 3,31 (95% IK: 1,42-5,20, p=0,006), Untuk luaran keamanan kedua studi Fu dkk, dan Knee dkk, tidak didapatkan hasil yang bermakna pada kedua kelompok. Kesimpulan. Transfusi liberal tidak berbeda dalam keamanan dibandingkan dengan restriktif, tetapi dapat mengurangi durasi penggunaan ventilator dan durasi suplementasi oksigen.

Background Although supplemental oxygen (SO2) is routinely administered to laboring gravidas, benefits and harms are not well studied. Objective This article compares strategies of liberal versus indicated SO2 therapy during labor on cesarean delivery (CD) rate and neonatal outcomes. Study Design A controlled, before-and-after trial of laboring women with term, singleton pregnancies. During an initial 8-week period, maternal SO2 was administered at the discretion of the provider followed by an 8-week period where SO2 was to be given only for protocol indications. Results Our study included 844 women. There was no difference in number of women receiving SO2 (53% liberal vs. 50% indicated; p = 0.33). For those receiving SO2, there was no difference in SO2 duration (median, 89 minutes [interquartile range, 42–172] vs. 87 minutes [36–152]; p = 0.42). There were no differences in overall CD rate (20% vs. 17%; p = 0.70), CD for nonreassuring fetal status, or use of intrauterine resuscitative measures. There were more 5-minute APGAR < 7 in the indicated group, but no difference in umbilical artery pH < 7.1 or neonatal intensive care unit (NICU) admission. Conclusion Approximately half of women receive SO2 intrapartum regardless of a strategy of liberal or indicated oxygen use. There were no clinically significant differences in outcomes between strategies.

AbstractThe article aims to present the mototour through an analysis of the spatial displacement of those who seek for freedom, as a leisure option and a choice of life whose main motivation freedom. As the practitioner biker mototour has traveled to events is discussed the types of motorcycle attached event to tourism studies. As a methodological procedure were carried out interviews and field visits to the two largest motorcycle events in the state of Goiás, focusing on practitioners of this growing sport in Brazil.Key words: Mototour, Freedom, Events of the Tourism. RésuméL'article vise à présenter le mototourisme par une analyse du déplacement spatial de ceux qui cherchent la liberté, comme une option de loisirs et un choix de vie dont la liberté est la principale motivation. La conceptualisation et l'application d'expression liberté font partie de cette recherche, ainsi que les théories: du voyage de conformité, de nomadisme et de motivation. Comme le motard praticien de mototourisme a voyagé à des événements, est discutée types d'événements de moto existant attaché à des études de tourisme d'événements. L’ordre public et le droit fiscal ont des liens étroits. L’ordre public fiscal n’assure qu’une protection relative de la fonction financière de l’impôt. La crise sanitaire a bousculé le respect des principes fondamentaux (principes de légalité et de nécessité de l’impôt). Les atteintes portées aux libertés de circulation, prévues par les traités européens, au titre des exceptions liées à l’ordre public et à la santé, sont encadrées par la jurisprudence de la CJUE et du Conseil constitutionnel. Sous l’effet de la crise sanitaire, les fonctions de l’impôt ont évolué. La fonction instrumentale de l’impôt revêt une importance particulière.

RESUMOGuimarães Rosa foi o escritor que, como poucos, soube explorar as potencialidades do olhar na experiência de seus personagens para que estes criassem, a partir daí, um universo simbólico para a renovação de si mesmos e do mundo que os cerca. O aprendizado do olhar em Rosa pode ser comparado com o processo em que o prisioneiro, na alegoria da caverna, liberta-se, e sucessivamente passa de um estado de ignorância, em que via apenas o ilusório e o aparente, para a visão das formas puras e inteligíveis. Platão compara o sol com a forma do Bem. Um texto do escritor mineiro ilustra esse aprendizado do olhar em paralelo com a visão platônica: a novela Campo geral. Nela, o personagem central é uma criança míope de oito anos que, num processo de descoberta do mundo, renova o seu olhar a cada momento, a exemplo do prisioneiro liberto da alegoria da caverna. Plato compares the sun with the Good forms. A specific text of the mineiro writer illustrates this learning of the look in parallel with the platonic vision: the Campo geral novel. Its main character is an eight-years-old shortsighted child who, in his world discovery proccess, renews his outlooks at each moment, at is done by prisioner released from the allegory of the cave. Abstract: In Charles Dickens's A Tale of Two Cities (1859), Madame Defarge knits a coded register of enemies to be sent to the guillotine. Civil registration became French law in 1792, serving as one of the principal means to track the lives and movements of the population. Nearly four decades later, the Births, Deaths, and Marriages Act passed in England and Wales. Registration meant that the state could practice centralized surveillance through a complex network of official registrars. This article argues that Dickens's contemporary personal turmoil prompted him to be suspicious of civil registration. Madame Defarge's "fatal register" demonstrates how registration could undermine individual liberty through a process of what Dickens calls "universal watchfulness."

Post-politik dönemde antagonizmaların kalkıp her şeyin mutabakat ile çözüleceğine inanç vardı. Kimlikler, sağ-sol ayrımı ortadan kalkacaktı ve çatışmalar kolektif boyuttan bireysel boyuta inecekti. Fakat Mouffe bunu kabul etmez. Ona göre husumet her daim var olacaktır. Mouffe için demokratik siyasetin doğasında husumet vardır. Mouffe’a göre sağ ve sol kalkabilir. Önemli olan o ikisi arasındaki ayrımı korumaktır. Sınırı olmayan post modern çoğulculuğa karşıdır. Farklı talepleri olan ve aralarında agonistik tartışma olan çoğulculuklar olması gerektiğini savunur. Bu grupları ahlaki anlamda iyi kötü değil siyasi olarak biz- onlar şeklinde ifade eder. Çünkü Mouffe için her şey siyasalın konusudur. Siyasalın ahlakın perdesi altında altı oyulmamalıdır. Tüm dünyada geleneksel partiler küreselleşmeyi savunmakta, liberal demokrasinin alternatifsiz model olduğunu savunmaktalar. Husumet yerine mutabakata dayalı yönetimin geçerli olduğu savunulmakta ve kimlikler yok edilmeye çalışılmaktadır. Solun da merkeze kayması ile çeşitli sebeplerle yeni kutuplaşmalar yaratan popülist sağ partiler yükselişe geçmektedir. Mouffe Siyasal Üzerine’de agonistik siyaslı destekleyecek ve agonistik siyasala karşı olacak pek çok düşünürün görüşlerinden örnekler vermektedir. Ayrıca küreselleşme, ulusaşırılaşma ile ilgili görüşleri açıklayarak bunları eleştirmektedir. Tüm dünyada tek tip insan, tek tip yönetim, tek tip adalet olabileceğinin doğru olmadığına inanmaktadır. O çoğulculuğu ve bu çoğulculuk arasında çıkacak çatışmalrın agonistik şekilde çözüleceği siyasal düzen tasavvur etmektedir.
