Artikel ini bertujuan untuk menganalisa konsep liabiliti dalam kemalangan jalan raya menurut perundangan Islam dengan memfokuskan kepada kesalahan kecuaian dengan menggunakan pendekatan kualitatif. Dhaman atau denda ganti rugi dalam kajian ini akan menekankan prinsip khusus dan pendekatan ke atas aspek perlanggaran di jalan raya di dalam perundangan Islam. Kajian perpustakaan digunakan untuk liabiliti di dalam kes-kes perlanggaran berteraskan Al¬Quran, sunnah, ijma’ dan qiyas. Seterusnya ia menghubungkaitkan pemakaian konsep ini dengan kesalahan kecuaian menyebabkan perlanggaran di dalam kemalangan jalan raya. Dapatan kajian menunjukkan prinsip ‘penyebab’ dalam perundangan Islam amat jelas pemakaian dan perkaitannya di dalam menentukan liabiliti sama ada kes perlanggaran berlaku di daratan, lautan atau di ruang udara. Konsep liabiliti turut terpakai bagi menentukan tanggungan kecuaian dan pemberian pampasan ganti rugi oleh pihak-pihak yang terlibat dalam membina struktur jalan, jambatan, terowong dan lain-lain. Konsep ini juga berhubung dengan jalan raya sekiranya tanggungan bukan pada pemandu yang tidak bersalah dan tidak cuai. ABSTRACT The aspects of liability and compensation have been key points when discussing the issue of negligence in road traffic accidents. This article aims to analyze the concept of liability in road accidents, in accordance to Islamic law, that focuses on negligence by using a qualitative approach. The application of ‘dhaman’ or the compensation of damages, is a broad concept that will be examined in this study. Furthermore, this study will review the specific principles and approaches on collisions of road traffic within the Islamic law. The methodology carried out employs the use of library study to analyze the concept of liability in cases of collisions, based on the Al-Quran, sunnah, ijma’ and qiyas with regards to the application of ‘dhaman’ on the negligence that have resulted in collisions from road accidents. The research outcome suggests that the ‘causal’ principle in Islamic law is very clear on its application and relevance in determining the liability of either a case of collision that has occurred on the road, ocean or in air. The concept of liability is also applied to determine the liability of negligence and awarded compensation by the parties that are involved in constructing the roads, bridges, tunnels and other structures that are associated with the road, if the liability does not fall upon the innocent and negligent drivers.

The scandal concerning rigged emissions tests to circumvent regulations is regularly not reflected through the lense of the German rules of State liabilty. This lack of attention follows from the fact that compensation for damage caused to individuals is regularly precluded under the German rules of State liability when the underlying regulation scheme is applied diligently by the competent public authority. In consequence, an unlawful market approval by manipulated but lawfully investigating public authorities appears to exclude liability. However, liability under the German rules of State liability is not limited to cases of misconduct by public authorities. Against this background the case is made for a liability of the manipulated State even though there is no evidence of misconduct on behalf of its authorities when applying approval procedures. The proposed special case for State liability rests on two pillars: the structural vulnerability of the relevant approval procedures for manipulation and a high degree of dependency of third party economic actors on the validity of the State’s approval mechanisms.

Title VII is meant to protect employees from discrimination and has historically been a crucial tool for creating social change in the workplace. But when considering modern-day workplace discrimination wrought by “toxic workplace cultures” defined herein, Title VII’s frameworks for confronting systemic discrimination prove outdated and ineffective. This Note proposes the codification of a new theory of discrimination under Title VII targeting toxic workplace cultures, with substantive and procedural elements working in tandem to better enable plaintiffs to collectively bring actions to hold employers accountable for fostering discriminatory environments. Part I defines toxic workplace cultures and walks through case studies of such cultures in action. Part II explains the existing frameworks of Title VII and why they do not provide recourse for victims of toxic workplace cultures. Part III proposes a solution through codifying a new cause of action for toxic workplace cultures under the statute and offers a brief case study highlighting a potential outcome were this proposal to be implemented.

AbstractIn the American legal academy, the prevailing wisdom about the rise of modern products liability law is framed by a debate which took place more than thirty years ago. George Priest’s brilliant 1985 paper The Invention of Enterprise Liability, asserted that modern American products liability law in its formative moment was enterprise liability incarnate, but condemned this commitment as itself a profound defect in products liability law. With rhetoric worthy of a Biblical Jeremiad, Priest argued that the “unavoidable implication of the three presuppositions of [enterprise liability] is absolute liability. The presuppositions themselves do not incorporate any conceptual limit to manufacturer liability.” Priest’s work was both immensely influential and sharply contested. Gary Schwartz, writing independently at first, argued that products liability law was really fault liability all along. According to Schwartz, the “vitality of negligence” was the driving force behind the expansion of tort liability over the course of the 20th century. Negligence conceptions lurked beneath product liability law’s surface embrace of strict liability. Or so Schwartz argued. Product defect liability was strict liability in name, but the risk-utility test of product defectiveness was in fact an aggressive application of negligence criteria.

There are 2 (two) forms of liabilities which acknowledged by Civil Law, the first one is contractual based liability and the second one is tort based liability. To exercise the established objective, the method used will be deduction, being of a qualitative nature, as for the method of procedure used, it is the monographic one and the research technique is the bibliographic one. The work brings concepts of business partnership, specifies the limited liability company type and demonstrates how administrators work in limited liability companies. Therefore, it is concluded that compliance is a mechanism used as a safeguard against the responsibility of the administrator in the limited liability company, due to the obligation to comply with rules to standardize the conduct of action and reduce reputational and economic risks.

The government has issued the Job Creation Law. In the Job Creation Law, micro and small businesses can establish a legal entity company. This company is called a sole proprietorship. The establishment of a sole proprietorship is still difficult to distinguish from establishing a limited liability company based on the Law of the Republic of Indonesia Number 40 of 2007. One thing that becomes the attention of stakeholders is the responsibility of sole proprietorships with limited liability. Stakeholders include creditors of financial institutions. This research uses a normative judicial method. This research object is aims to discuss the disadvantage of sole proprietorships compared to limited liability companies to creditors of financial institutions. The research result is find the differences between a sole proprietorship and a limited liability company. This research concludes that a sole proprietorship with limited liability is the same as that of a limited liability company to creditors of financial institutions. Shareholders are not responsible for ties to individual companies. The board of directors is not personally accountable for respective companies' obligations. A particular company is responsible for relations made on its behalf as a legal entity. Any responsibility includes a credit agreement between the company and a financial institution.

Wright. 1990. “Strict Liability in a Principal-Agent Model.” International Review of Law and Economics 10: 219–231 and strengthens their result that the strict liability can attain social optimum in a principal-agent relation to the situation in which the court appreciates any contractual terms regarding apportionment of damages between an employer and an employee under vicarious liability rule. Our model also generalizes and extends vicarious liability to the negligence-based liability rule.

Liability to the parent company for policies implemented by subsidiaries that result in losses with third parties is a major problem in the practice of group. This problem This problem is due to absence of legislation that specifically regulate of the company group, the regulatory framework of the realationship the parent and it’s subsidiaries in the group companies is use Corporate Law. The incorporation of the company’s subsidiary in the group does not abolish the legal status of a subsidiary. Parent companies in the group company contractions have immunity over the implementation of the principle of limited liability. the purpose of writing this journal is to know, how is the assignment legal liability to the parent company for the policies applied to the subsidiary companies resulting in a loss to a third party and how to anticipate control without legal liability the parent company for its policies that impact the economic insecurity of the subsidiary in the construction of group companies. The research that the author uses is normative legal research. From this research, assigning legal liability to the parent company through the implementation of policies implemented by the subsidiary is certainly seen from the fault that cause losses. One effort that can be done to anticipate control without legal liabilty of the parent companies it’s Make Charter Corporate Relations and Between Subsidiaries or make agreement control between the parent company and subsidiary.

Abstract: Should states be liable towards individuals for failure to provide justice, good roads, or timely administrative decisions? In this article, we show that state liability can serve three different purposes, none of which implies that the state should be liable in tort, unless other specific conditions are met. One purpose is to provide incentives for state agencies and private individuals to act efficiently. Here, the effectiveness of liability depends on the channelling of incentives down the chain of command to the acting state employee. The second purpose of state liability is to remove incentives for private parties, when these incentives are distorted, as when compensating for wrongful conviction. The third aim of state liability is to allow a higher level of the administration to monitor the behaviour of a lower level. In this case, the judicial system and private parties are means towards the end of generating information about wrongful behaviour by public bodies and agencies. Within this framework, we discuss substantive and procedural aspects of state liability in torts. We provide an economic argument for court specialization in administrative law and explain why the different solutions around the world could be appropriate under local determinants. Résumé: Les Etats devraient-ils être tenus responsables envers les individus pour leurs manquements à assurer une bonne justice, des voiries en bon état, ou à rendre des décisions administratives dans des délais raisonnables? Dans cet article il est démontré que la responsabilité de l’Etat peut servir trois objectifs différents, aucun d’entre eux n’impliquant la responsabilité civile de l’Etat, excepté dans les cas où certaines conditions spécifiques sont réunies. L’un des objectifs est d’inciter les institutions de l’Etat et les individus à agir efficacement. Ici, une responsabilité effective dépend de la canalisation des motivations le long de la chaîne de prise de décisions jusqu’au fonctionnaire chargé d’agir. Le deuxième objectif de la responsabilité de l’Etat est d’éliminer toute incitation pour les personnes privées, lorsque leurs motivations sont perverties, comme dans le cas de compensation pour erreur judiciaire. Le troisième objectif de la responsabilité de l’Etat est de permettre à l’échelon supérieur de l’administration de superviser la conduite des échelons inférieurs. Dans ce cas, le système judiciaire et les parties personnes privées constituent des outils d’information sur le comportement fautif des institutions et services publics.
