Artikel ini bertujuan untuk menganalisa konsep liabiliti dalam kemalangan jalan raya menurut perundangan Islam dengan memfokuskan kepada kesalahan kecuaian dengan menggunakan pendekatan kualitatif. Dhaman atau denda ganti rugi dalam kajian ini akan menekankan prinsip khusus dan pendekatan ke atas aspek perlanggaran di jalan raya di dalam perundangan Islam. Kajian perpustakaan digunakan untuk liabiliti di dalam kes-kes perlanggaran berteraskan Al¬Quran, sunnah, ijma’ dan qiyas. Seterusnya ia menghubungkaitkan pemakaian konsep ini dengan kesalahan kecuaian menyebabkan perlanggaran di dalam kemalangan jalan raya. Dapatan kajian menunjukkan prinsip ‘penyebab’ dalam perundangan Islam amat jelas pemakaian dan perkaitannya di dalam menentukan liabiliti sama ada kes perlanggaran berlaku di daratan, lautan atau di ruang udara. Konsep liabiliti turut terpakai bagi menentukan tanggungan kecuaian dan pemberian pampasan ganti rugi oleh pihak-pihak yang terlibat dalam membina struktur jalan, jambatan, terowong dan lain-lain. Konsep ini juga berhubung dengan jalan raya sekiranya tanggungan bukan pada pemandu yang tidak bersalah dan tidak cuai. ABSTRACT The aspects of liability and compensation have been key points when discussing the issue of negligence in road traffic accidents. This article aims to analyze the concept of liability in road accidents, in accordance to Islamic law, that focuses on negligence by using a qualitative approach. The application of ‘dhaman’ or the compensation of damages, is a broad concept that will be examined in this study. Furthermore, this study will review the specific principles and approaches on collisions of road traffic within the Islamic law. The methodology carried out employs the use of library study to analyze the concept of liability in cases of collisions, based on the Al-Quran, sunnah, ijma’ and qiyas with regards to the application of ‘dhaman’ on the negligence that have resulted in collisions from road accidents. The research outcome suggests that the ‘causal’ principle in Islamic law is very clear on its application and relevance in determining the liability of either a case of collision that has occurred on the road, ocean or in air. The concept of liability is also applied to determine the liability of negligence and awarded compensation by the parties that are involved in constructing the roads, bridges, tunnels and other structures that are associated with the road, if the liability does not fall upon the innocent and negligent drivers.

Abstract:
The scandal concerning rigged emissions tests to circumvent regulations is regularly not reflected through the lense of the German rules of State liabilty. This lack of attention follows from the fact that compensation for damage caused to individuals is regularly precluded under the German rules of State liability when the underlying regulation scheme is applied diligently by the competent public authority. In consequence, an unlawful market approval by manipulated but lawfully investigating public authorities appears to exclude liability. However, liability under the German rules of State liability is not limited to cases of misconduct by public authorities. Against this background the case is made for a liability of the manipulated State even though there is no evidence of misconduct on behalf of its authorities when applying approval procedures. The proposed special case for State liability rests on two pillars: the structural vulnerability of the relevant approval procedures for manipulation and a high degree of dependency of third party economic actors on the validity of the State’s approval mechanisms.

Abstract:
Title VII is meant to protect employees from discrimination and has historically been a crucial tool for creating social change in the workplace. But when considering modern-day workplace discrimination wrought by “toxic workplace cultures” defined herein, Title VII’s frameworks for confronting systemic discrimination prove outdated and ineffective. This Note proposes the codification of a new theory of discrimination under Title VII targeting toxic workplace cultures, with substantive and procedural elements working in tandem to better enable plaintiffs to collectively bring actions to hold employers accountable for fostering discriminatory environments. Part I defines toxic workplace cultures and walks through case studies of such cultures in action. Part II explains the existing frameworks of Title VII and why they do not provide recourse for victims of toxic workplace cultures. Part III proposes a solution through codifying a new cause of action for toxic workplace cultures under the statute and offers a brief case study highlighting a potential outcome were this proposal to be implemented.

AbstractIn the American legal academy, the prevailing wisdom about the rise of modern products liability law is framed by a debate which took place more than thirty years ago. George Priest’s brilliant 1985 paper The Invention of Enterprise Liability, asserted that modern American products liability law in its formative moment was enterprise liability incarnate, but condemned this commitment as itself a profound defect in products liability law. With rhetoric worthy of a Biblical Jeremiad, Priest argued that the “unavoidable implication of the three presuppositions of [enterprise liability] is absolute liability. The presuppositions themselves do not incorporate any conceptual limit to manufacturer liability.” Priest’s work was both immensely influential and sharply contested. Gary Schwartz, writing independently at first, argued that products liability law was really fault liability all along. According to Schwartz, the “vitality of negligence” was the driving force behind the expansion of tort liability over the course of the 20th century. Negligence conceptions lurked beneath product liability law’s surface embrace of strict liability. Or so Schwartz argued. Product defect liability was strict liability in name, but the risk-utility test of product defectiveness was in fact an aggressive application of negligence criteria.

There are 2 (two) forms of liabilities which acknowledged by Civil Law, the first one is contractual based liability and the second one is tort based liability. If there is a liabilty that based on an event which fulfill the elements that known in tort theory, so the tort based liability will be used. La presente investigación tiene como propósito analizar la realización de las operaciones de liability management en el mercado de valores peruano. La importancia de la investigación radica en la necesidad que pueden tener las sociedades peruanas en realizar operaciones de liability mangement para alcanzar distintos objetivos relacionados al manejo de su estructura de deuda. De tal manera, la pregunta que orienta la investación es ¿Son viables las operaciones de liability management en el mercado de valores peruano? La hipotesis que se plantea sostiene que sí son posibles las operaciones de liability management dentro la regulación del mercado de valores peruano y la legislación societaria. No obstante, no existen suficientes condiciones para facilitar su realización como se debería. De tal manera, la investigación comienza con el uso del método funcional para analizar la naturaleza de las operaciones de liability management en las finanzas corporativas, y prosiguiendo con la aplicación de método de comparación jurídica para el análisis de dichas operaciones en la regulación del mercado de valores de los Estados Unidos de América. El aporte conseguido del análisis del principal modelo de regulación del mercado de valores del mundo, sirve para identificar las carencias de la regulación peruana para la realización de operaciones de liability management, y otorga sustento a las propuestas para solucionar dichos problemas.

Diversas crises financeiras tiveram sobre os fundos de pensões efeitos de decréscimo do valor dos ativos, redução do funding level e, por vezes, necessidade de contribuições adicionais por parte do sponsor ou de intervenção de organismos regulatórios. No ambiente descrito, fundos de pensões cuja estratégia de investimento passa apenas pela diversificação dos ativos parecem condenados a fracassar no longo-prazo, apesar de este continuar a ser um princípio financeiro basilar. É como resposta a este contexto que surgem os Liability-Driven Investments, estratégias especialmente preparadas para proteger os fundos de pensões de fatores de risco como como o risco de taxa de juro. Neste trabalho, apresentam-se quatro modelos pertencentes a essa categoria e comparam-se os resultados por eles produzidos. Os modelos são o Modelo Tradicional de Duração, o Modelo Vetorial de Duração, o Modelo de Duração Key-Rate e o Modelo de Duração da Componente Principal. Todos os modelos mostram um bom desempenho na reprodução da trajetória das responsabilidades, mas o Modelo de Duração Key-Rate destaca-se pelo facto de ter necessitado de menos contribuições para atingir um funding level mais elevado.
Pension schemes suffered from the same effects in various financial crisis. These effects were the reduction of the value of assets, the reduction of the funding level and, sometimes, the necessity for additional contributions from sponsor or for intervention from regulatory organisms. In the described environment, pension schemes whose investment strategy is based only on asset diversification are condemned to fail in the long-term, even considering that this is a valuable financial principle. Liability-Driven Investments appear as an answer to this context. These are strategies prepared to protect pension schemes from risk factors like interest rate risk. In this work, the author presents four models from this category and compares the results produced by them. The models are Traditional Duration Model, Duration Vector Model, Key-Rate Duration Model and Principal Component Duration Model. Each model shows a good performance on following the liabilities path, but the Key-Rate Duration Model stands out by the fact that it needed less contributions in order to achieve a higher funding level.

Abstract:
ISP copyright liability for copyright infringement over the Internet is a now widely adopted approach for tackling extensive online copyright piracy in various jurisdictions. However, in China, the inconsistent ISP knowledge standard and the lack of peer-to-peer file-sharing liability provisions in the existing legal framework are among the factors that impede effective copyright law enforcement on the Internet. The adoption of a broad knowledge standard and its application in case law, both in the U.S. and Germany, which have great influence on a Chinese ISP copyright liability system, are discussed along with a similar knowledge standard provided by the Chinese Online Copyright Regulations and its application to ultimately show the need of a broad knowledge standard in a Chinese ISP copyright liability system. As for the liability issues over peer-to-peer file-sharing networks, analysis of several prominent cases and the enacted or proposed legislation in this regard in an international context sheds light on the importance of a filtering mandate in effectively deterring copyright piracy. In a Chinese context, the absence of peer-to-peer file-sharing liability legislation and the inadequacy of the applied provisions in the existing legislation entail the examination of the need and the possibility of the mandatory use of filters in a Chinese ISP copyright liability system. For an enhanced Chinese ISP copyright liability regime, the thesis concludes with two recommendations that a broad ISP knowledge standard should be retained in the Chinese ISP copyright liability system and a filtering mandate is needed and should be legislated for efforts against widespread unlawful peer-to-peer file-sharing.

In this thesis, Mean-Variance Asset-Liability management is studied ina multi-period setting. An investor aims at nding an optimal investmentstrategy in order to maximise the mean-variance objective. The prices ofassets and liabilities are formulated as geometric Brownian motions and wefurther extend them to exponential Levy process. By the Bellman principle,the explicit optimal solution is obtained under backward induction.

The subject of the research are special and general regulations and their application on liability for damages in the performance of state audit, with an emphasis on the state audit of Serbia. Liabilitiy for damages in this context can be liability of persons engaged in work in the supreme audit institution for damage caused to the institution; the liability of the Supreme Audit Institution for damages caused to third parties; and the liability of the Supreme Audit Institution for damages caused to persons engaged in work. The aim of the research is to determine the legal regime and determine the sources of law that apply to liability for damages. The main purpose of this paper is to examine the possibility of implementing in practice a specific procedure of liability for damages in the state audit regime of Serbia.

Abstract:
This paper presents the basic characteristics of a limited liability company and briefly analyses compulsory liquidation of this form of business entity and the consequences of the liquidation. It particularly depicts the provisions of The Companies Act which regulate company members’ liabilty for limited liability company’s obligations and gives a critical analysis of the legal order that all previously suspended court and administrative proceedings continue against a company member. Furthermore, the author claims that enforcement procedures against a limited liability company as an enforcement debtor cannot continue against a company member by default, unless there is a document regulated by the Article 48 of The Law on Enforcement and Security Interest, which proves the transfer of the obligation under the executive title or the authentic document from the company as an enforcement debtor to a company member.

Abstract:
Статья посвящена правовому анализу гражданско-правовой ответственности с точки зрения отнесения ее к одному из видов юридической ответственности, а также характеристике ее специфики. Институт юридической ответственности является необходимым механизмом регулирования общественных отношений. В рамках данного механизма выделяется своей спецификой и гражданско-правовая ответственность. Отдельно в статье приводятся доктринальные позиции ученых-цивилистов относительно формулировок гражданско-правовой ответственности. В качестве заключения по настоящему исследованию перечисляются характерные черты гражданско-правовой ответственности и приводятся элементы, отражающие специфику гражданско-правовой ответственности. The article is devoted to the legal analysis of civil liability from the point of view of its attribution to one of the types of legal liability, as well as the characteristic of its specificity. The Institute of legal responsibility is a necessary mechanism for regulating public relations. Within this mechanism, civil liability is also distinguished by its specificity. Separately, the article presents the doctrinal positions of civil scientists regarding the wording of civil liability. As a conclusion to this study, the characteristic features of civil liability are listed and elements reflecting the specifics of civil liability are provided.
