Lex posterior derogat priori, lex specialis derogat generali, Guidelines for a history of conflicting norms with a focus on these two competing solutions. – The two Latin maxims, Lex posterior derogat priori and Lex specialis derogat generali, sometimes presented as evidentially logical, have a complex history and a delicate relationship (whereas the latter can contradict the former). They take their origins in the Digest, but in rather paradoxical forms: Lex posterior is coming from a text written in Greek by Modestinus, lex generalis is induced from a general regula exposed by Papinianus. How have these two ways of resolving the problem of conflicting norms emerged in Roman law? How have they been quoted and explained in canon and in civil law during the Middle Ages? How have they been used by sovereigns and in which scope do they serve the foundations of modern States? This paper tries to answer these questions by analyzing texts where the two maxims are mentioned and proposes to treat this subject as a significant chapter of the history of the sources of law.

Abstract:
This paper aims to analyze the legal aspects of the general seizure and criminal seizure in Indonesian positive law, as well as to understand the legal efforts of the curator towards the assets of bankrupt estates placed under criminal seizure for corruption and economic crimes. The method used in writing this article is the normative legal research method, which starts from the normative problem of conflict of norms, and the results of this journal article are to determine the position of general seizure and criminal seizure based on the principle of legal preference, namely the principle of lex superior derogat legi inferiori, lex posterior derogate legi priori, and lex specialis derogate legi generalis, and the legal efforts that can be taken by the curator when the assets of bankrupt estates are placed under criminal seizure is by filing an objection to the Corruption Court and by filing a pretrial against the seizure actions carried out by the corruption investigators. The legal status of general attachment and criminal attachment can be determined by the principles of legal preference, including lex superior derogat legi inferiori, lex posterior derogate legi priori, and lex specialis derogate legi generalis. In most cases, general attachment takes priority over criminal attachment, except in cases of corruption (tipikor). In such cases, neither general nor criminal attachment can take precedence over the other. If criminal attachment is imposed on a bankrupt estate, the Curator can file an objection with the Corruption Court within two months of the court decision.

Abstract:
The rule Lex posterior derogat legi priori (the later law cancels the earlier one) has a universal doctrinal meaning. The preservation of this principle over the centuries shows its importance and axiomatic character. However, the situation in the Armenian practice is different. This article discusses the legality of the conflict of laws rule of the RA Law On Normative Legal Acts, according to which, in the event of a conflict between the earlier and later laws in force, the earlier law applies. The author investigates the conflict rule Les posterior from comparative-legal and historical points of view, and concludes that the regulation provided by the RA Law On Normative Legal Acts contradicts the laws of dialectics, and axiomatic truths, reflected in Roman law, thus, it is essential to revise it. The philosophical basis of the new law abolishes the old rule is the law of the dialectics denial of the denial, which gives high authority and value to the Lex posterior rule. The rule Lex posterior is the means of ensuring the Constitutional freedom of generations. Freedom of generation implies that the new generation is free from the rules established by previous generations and is free to change them. In addition, a law written later must prevail over earlier laws, based on the principle of democracy by the people. Before Lex posterior derogat legi priori law is fixed in practice, in case of conflict between the old and the new norms that have equal legal force, the highest Courts of the Republic of Armenia should give preference to the legal norm that came into force later.

Keberadaan Bank telah mendukung upaya pertumbuhan ekonomi suatu negara. Fungsi bank menjadi intermediasi bagi masyarakat yang kelebihan dana kepada masyarakat dan kekurangan dana. Dalam rangka melakukan pemberdayaan ekonomi masyarakat, bank memberikan kredit kepada masyarakat ekonomi menengah untuk melakukan Usaha Kecil Masyarakat (UKM). Penelitian ini bertujuan untuk melihat bagaimana Implementasi Qanun Aceh Nomor 10 Tahun 2004 tentang Pemberdayaan Sentra Usaha kecil. Hasil penelitian terdapat bahwa qanun Aceh tetap dijalankan oleh Bank walaupun sebenarnya aturan hukumnya tidak memiliki kekuatan hukum bertentangan asas Lex posterior derogat legi priori dan asas Lex superior derogat legi inferior.

Abstract:
his research is focused on the regulation of implementing guarantee for halal products in Indonesia and crucial issues related to them. This research is normative juridical research using a statute approach. The conclusions of this study include; first, there are several crucial issues and topics relating to the implementation of guarantee of halal products in Indonesia, namely halal certification, mandatory and voluntary in halal certification, criminal provisions, and halal product guarantee management institutions. Second, the regulation of halal product guarantees when viewed from the Statute Approach can be analyzed using three legal principles: (1) lex superior derogat legi inferiori concludes that all rules for guaranteeing lower halal products are replaced by the higher ones; (2) lex specialis derogat legi generali confirms that the JPH Law is a specific regulation that regulates the guarantee of halal products; and (3) lex posterior derogat legi priori requires that the rules for guaranteeing halal products as contained in the JPH Law replace the guarantee rules for halal products that existed in the previous period.

Based on the Government Regulation of the of Indonesia Number 21 of 2020, Large-Scale Social Restrictions (PSBB). The Ministry of Health is authorized to make technical regulations. Minister of Health made Minister of Health Regulation Number 9 of 2020, PSBB. Seems like the synergy between the Ministries hasn’t been implemented properly, ex. the Ministry of Law and Human Rights published Regulation of The Ministry of Law and Human Rights Number 10 of 2020 and The Ministry of Transportation with their Regulation Minister of Transportation Number 18 of 2020 changed to Regulation of Minister of Transportation 41 of 2020. The regulations contradict with the Minister of Health a quo regulation. Which regulation should be used? Who’s responsible for it? It’s necessary to review synchronization between Ministry regulations. This research used Normative Juridical, Literature Study, Interview, and Analysis Method. A brief conclusion if there’s a lawsuit against the a quo regulation then the responsibility lies with the Ministry of Health. Disharmonization between ministerial regulations can be resolved by Judicial Review, Mediation by the Ministry of Law and Human Rights, and applying the principles of Lex Superior Derogat Legi Inferiori, Lex Specialis Derogat Legi Generalis, and Lex Posterior Derogat Legi Priori Principles.

Abstract:
The problems to be answered in this research are, first, how is the regulation of Islamic family law and marriage in Indonesia, second, how is underage marriage and legal protection for children, third is how to apply the lex posterior derogat legi priori principle in determining the adult age for marriage. The research method used is normative juridical research with a statute approach which was analyzed using statutory principles. The results of the research concluded that Islamic family law cannot be separated from the history of the legal system in Indonesia from the time of Dutch colonialism to the present which involved three parties, namely the interests of religion, the state and women. Underage marriage is influenced by economic problems, parental coercion and community culture. Based on the lex posterior legi priori principle, the age limit of a child must be seen in the context of what the maturity measure is to be used. If the maturity is for a marriage, then the adult age limit is 19 years, for both women and men. Although in the future it is suggested that further research is needed regarding the financial maturity of men who are married at the age of 19.

Abstract:
Law of job creation (UU-CK) already change, remove, and shift the new norm of law of environmental protection (UU-PPLH) in today potentially to create a matter and second legal conflict for this law in the action and law enforcement in the future. Among the urgency of economic affair through the acceleration of investment will face off the urgency of the protection and environmental management. Both matters come as the focus on this article analysis here are these, first the legislation as a system and implication of job creation's law legality against UU-PPLH as environmental clustering in Indonesia. Second, the implication of the change of UU-PPLH due to UU-CK. Here is the conclusion, first the change of UU-PPLH's primary norm due to UU-CK will impact on another norm which the legality directly related on the protection and environmental management overall. Second, the implication identified from the content material, both law potentially to create a norm conflict on the action and law enforcement. Meanwhile, if this case related to the principle of legal conflict settlement, then no principle can be used either the principle of lex specialis derogat legi generalis, the principles of Lex superior derogat legi inferior, and the principles of lex posterior derogat legi priori. To encounter the norm conflict matter, the better one in reformating regulation in the way of Omnibus law method, despite it is limited on the system of clustering and organization, but also not repeal and state the illegality of the impacted regulation.

Abstract:
The principle as a fundamental rule is the background of the legal system, starting from the formulation and formation of laws and regulations to the enforcement of the regulations in question. Legal principles are a very important element in the formation of laws and regulations. Violation of norms shows a tendency to violate principles, and the elimination of norms will impact the tendency to eliminate principles. The methods used are the conceptual approach and the statute approach. The data sources used are secondary data that researchers can obtain from literature studies in the form of books, records, newspapers, journals, and other documents that can be used in this study. Secondary data consists of primary legal materials, secondary legal materials, and tertiary legal materials. Research results: (1) The position of the lex posterior derogat legi priori principle cannot be placed as a basis for overcoming the conflict of norms between UUK-PKPU and UUHT. (2) Resolution of norm conflicts between UUK-PKPU and UUHT can be done through a harmonisation approach of the two laws through the legislative process in the DPR. The bankruptcy process shows a conflict arising between UUK-PKPU and UUHT because the holder of the dependent right should still be authorised to exercise all his rights even though the grantor of the dependent right is declared bankrupt by article 21 of the Law. In contrast, Article 56 paragraph (1) suspends the rights of creditors of the holder of the 'dependent right'. To overcome the conflict of norms, it should be understood that the principle of lex posterior derogat legi priori means that the new norms/rules of law perfect the enforceability of the old norms/rules of law in the same legal regime

This research was focused on the regulation of halal product assurance implementation in Indonesia on statute approaches study and the crucial issues associated with it. In the context of providing halal product assurance implementation, regulation is the basis of legality for all elements of the state in organizing the State. Before the emergence of the Halal Product assurance (JPH) Law, there were many regulations relating to the assurance of halal products. In forming a regulation, there are crucial issues/topics that suck up a lot of public attention, so that it can influence a policy that will be ratified. The conclusions of this research included; first, there were several crucial issues and topics related to the implementation of halal product assurance in Indonesia, they were; (1) halal certification/labeling; (2) mandatory (obligation) or voluntary in halal certification; (3) criminal provisions; and (4) halal product assurance management institutions. Second, halal product assurance regulations when viewed from the Statute Approach can be analyzed using three legal principles, consisting of (1) the principle of Lex Superior Derogat Legi Inferiori concluded that all halal product assurance rules that have a high position must replace all lower halal product assurance rules. (2) The principle of Lex Specialis Derogat Legi Generali confirmed that the Halal Product Assurance (JPH) Law was a specific regulation governing the assurance of halal products. This Halal Product assurance (JPH) Law replaced the previous halal product assurance rules; and (3) the principle of Lex Posterior Derogat Legi Priori required that the halal product assurance provisions contained in the Halal Product assurance (JPH) Law replaced the existing halal product assurance rules in the previous period.

Abstract:
<p><em>The purpose of this study is to examine how far the process of parate execution of mortgage rights without court order is regulated in Indonesia to solve non-performing loans and the legal considerations of the invalidity parate execution over the objection filed by the debtor granting the mortgage rights. Parate execution is the power granted by Article 6 and Article 14 paragraph (3) of the Mortgage Rights Law to the first holder of a mortgage rights to execute the mortgage rights on its own power based on the executorial power of the mortgage rights certificate without approval from the debtor granting the mortgage rights and court order. However, the practice of the article has not fully guaranteed legal certainty due to the inconsistency of the Mortgage Rights Law and the incompatibility of legal interpretation so it is important that this research is carried out to avoid repeated misunderstandings. This research is normative juridical that uses a statute and case approach with library research. The results show that the inconsistency of parate execution of mortgage rights still followed the procedure for execution of the grosse mortgage deed regulated in Article 1178 paragraph (2) of the Civil Code and Article 224 HIR/258 RBg, that need approval from the debtor granting the mortgage rights and court order. The application principles of lex posterior derogat legi priori and lex specialis derogat legi generalis, followed by the grammatical interpretation to positive law, affects the progressive aspect of the ease of execution.</em></p><p> </p><p>Penelitian ini bertujuan mengkaji sejauh mana proses parate eksekusi objek hak tanggungan tanpa fiat pengadilan untuk menyelesaikan kredit bermasalah di Indonesia diatur dan pertimbangan-pertimbangan hukum ketidakabsahan parate eksekusi atas perlawanan yang diajukan debitur pemberi hak tanggungan. Parate eksekusi merupakan kewenangan yang diberikan Pasal 6 <em>jo</em> Pasal 14 ayat (3) UUHT kepada pemegang hak tanggungan pertama mengeksekusi objek hak tanggungan atas kekuasaan sendiri berdasarkan kekuatan eksekutorial sertifikat hak tanggungan tanpa perlu persetujuan debitur pemberi hak tanggungan maupun fiat pengadilan. Namun praktiknya pasal tersebut belum sepenuhnya menjamin kepastian hukum sebab ketidakkonsistenan dari UUHT itu sendiri dan ketidakcermatan penafsiran hukum sehingga penting penelitian ini dilakukan demi menghindari kesalahpahaman yang berulang. Penelitian ini penelitian yuridis normatif yang menggunakan pendekatan perundang-undangan dan kasus melalui penelusuran kepustakaan. Hasil penelitian menunjukkan bahwa inkonsistensi pelaksanaan parate eksekusi objek hak tanggungan yang masih mengikuti tata cara eksekusi grosse akta hipotik yang diatur Pasal 1178 ayat (2) KUHPerdata serta Pasal 224 HIR dan/atau Pasal 258 RBg, yang memandang perlunya persetujuan terlebih dahulu dari debitur dan keterlibatan pengadilan untuk mengeksekusi. Penulis menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, dan penafsiran historis. Berdasarkan asas hukum lex prosterior derogat legi priori menegaskan Putusan MK Nomor 97/PUU-XIV/2016 yang diputuskan oleh MK belakangan mengesampingkan berlakunya Putusan MK Nomor 140/PUU-VII/2009.This article is intended to discuss interpretation on the religion meaning in the Constitution where there is a different result of interpretation to the meaning of the religion in the Constitution according to the Constitutional Court Decision Number 97/PUU-XIV/2016 and the Constitutional Court Decision Number 140/PUU-VII/2009. The Constitutional Court Decision Number 140/PUU-VII/2009 says the religion in the indigenous community (the Penghayat Kepercayaan) is not part of the religion meaning in the Constitution, but according to the Constitutional Court Decision Number 97/PUU-IV/2016 the religion in the indigenous community is part of the religion meaning in the Constitution. Finally, a law principle of Lex Posterior Derogat Legi Priori is applied to such legal issue where the Constitutional Court Decision Number 97/PUU-XIV/2016 overrules the Constitutional Court Decision Number 140/PUU-VII/2009.

Abstract:
This research stems from the conflict of competence between Commercial Court and Arbitration in a bankruptcy case involving an arbitration clause. This occurs when parties make an agreement including arbitration as a mechanism of dispute resolution. Nevertheless, when a dispute occurs, one of the parties file a bankruptcy petition to Commercial Court as contained in Article 303 of the Bankruptcy Law. Meanwhile, according to Article 3 and 11 of the Arbitration Law, agreements containing arbitration clause as a mean of dispute resolution provides absolute competence, which is consistent with the pacta sunt servanda principle outlined by Article 1338 of the Civil Code. This raises the question of whether Article 303 of the Bankruptcy Law is inconsistent with pacta sunt servanda or to the arbitration clause as the agreed mechanism of dispute resolution by the parties, because the substance of legal norms has philosophical basis. This research uses normative juridical approach which examines legal materials through the study of documents. The research show that Commercial Court is an extra ordinary court which settle bankruptcy filed to the court. Therefore, the competence cannot be set aside by arbitration in the sense of its legal position and capacity as extra judicial even though it originates from an agreement containing arbitration clause. The philosophical basis that can be applied in the conflict of law refers to the principles governing legislation, namely lex specialis derogat legi generalis, lex posterior derogat legi priori, and integration principles of Article 303 of the Bankruptcy Law.

Abstract:
The reviewed monograph is devoted to the theoretical and legal puzzle — complex conflicts of law (coincidence of conflicts, competition of conflict of laws). The book contains a number of valuable ideas on the topic of research. In particular, the authors correctly distinguish between positivized conflict-of-laws rules and principles (maxims) developed by lawyers to overcome conflicts (conflict-of-laws rules of interpretation), which may be inconsistent with each other. This gives rise to complex conflicts. The authors successfully demonstrate this by the example of the complex fate of the lex posteriori derogat priori principle in the legal system of Armenia. The work provides a comparative legal study of the legal regulation of the resolution of conflicts of norms, including complex conflicts, in the post-Soviet States. The hierarchical system of conflict criteria proposed by the authors to overcome complex conflicts of law is very interesting. In addition, the monograph describes in detail the problems of "non-systemic conflicts" in law, which are understood as antinomies of principles and norms of law and inconsistency between the principles of law. At the same time, there are a number of controversial theses in the work, for example, on the priority of the humanistic substantive criterion of conflict resolution over traditional legal criteria (such as lex superior, lex specialis, lex posterior); on the need to allocate competence and industry criteria as separate criteria for overcoming conflicts; on the restrictive author’s interpretation of the scope of application of the lex specialis conflict principle. These controversial ideas are criticized in the review in a well-reasoned manner.

This article found there has been an inconsistent enforcement of Parate Executie that was undertaken with compulsory Fiat. It results a constraint implementation of Article 6 of Mortgage Law. Surat Edaran Badan Urusan Piutang dan Lelang Negara (BUPLN) No. SE-21/PN/1998, jo SE-23/PN/2000/ regarding implementation regulation of Article 6 of Mortgage Law No. 4 1996 exists to be compatible with the Article. In addition, lex posterior derogat legi priori principle concludes that the latest rule (Mortgage Law No. 4 1999) overrides the former rule (MARI. Decision No. 3210 K/Pdt/ 1984 juncto Article 224 H.I.R).</p>

Abstract:
This research aims to address and propose solutions to the issue of conflicting norms within Indonesian Anti-Corruption Act (Act 19/2019). It is a normative study conducted through a statutory and conceptual approach. Primary and secondary legal materials were collected and analyzed prescriptively. The study suggests resolving the conflict between Article 69D and Article 70B-70C by applying the principle of Lex Posterior Derogat Legi Priori. As a result of this conflict, there are ongoing corruption cases that must now follow the legal process outlined in Act 19/2019, even if the alleged offenses took place prior to its enactment. This situation creates a loophole for objections to the legal process, raising concerns regarding justice, benefits, and legal certainty. Consequently, legal reforms are necessary to address these concerns and improve Act 19/2019. Based on these findings, this research asserts that regulations pertaining to corruption eradication should ensure the integrity of the rules by eliminating conflicts of norms and conflicts of interest. In cases where the process of updating regulations faces challenges, the government can establish derivative regulations or implement conflicting norms to achieve the legal objectives of justice, certainty, and benefit within Act 19/2019.

Abstract:
The National CC’s (NCC) ratification has completed the mission of establishing a NCC adequately through a legislative process on the development of codified criminal science and practice adapted to the conditions and characteristics of the Indonesian nation and state, which differed from legal politics during the Dutch colonial administration. It can br concluded from the results of the study that the regulation of corruption crimes between the Corruption Law and the NCC is still classified as an extraordinary crime, but there is a slight difference of increase/decrease in the minimum/maximum prison terms and fines. This is motivated by the implementation of the legal principle of proportional criminal responsibility. Then, the existence of Article 630 of the NCC is the implementation of legal preference Lex Generalis Derogate Legi Specialis and Lex Posteriori Derogat Legi Priori principles, when there is a double arrangement between the Corruption Law and the NCC. However, the NCC also applies the In Dubio Pro Reo principle, which means that when considering two regulations that govern the same case, the rule that is more advantageous to the suspect or defendant is used. By taking into account the provisions of Article 632 of the NCC that this Criminal Code shall come into effect 2 (two) years from the date of promulgation, this should be seen as the implementation of the Government's task to socialize this NCC to the whole community before it is enacted.

Penerapan kurikulum Mata Kuliah Wajib Umum (MKWU) di seluruh perguruan tinggi di Indonesia hingga saat ini belum memiliki keseragaman, terutama pada mata kuliah pendidikan Pancasila dan pendidikan kewarganegaraan baik dari sisi nomenklatur pemberian nama mata kuliah maupun beban satuan kredit semester (SKS). Tujuan penelitian ini menganalisis mengenai kurikulum, pendidikan Pancasila, dan Pendidikan Kewarganegaraan dengan menggunakan analisis kajian hukum doktrinal. Pendekatan yang digunakan adalah pendekatan konseptual dan pendekatan perundang-undangan. Disharmoni antara ketentuan Pasal 37 ayat (2) UU Sisdiknas dan Pasal 35 UU Dikti merupakan salah bentuk disharmoni horizontal yang menimbulkan beberapa problematika yuridis antara lain disfungsi hukum, terjadinya perbedaan penafsiran dalam pelaksanaannya, tidak terlaksana secara efektif dan efisien dan dapat menimbulkan ketidakpastian hukum. Adapun upaya peraturan perundang-undangan yakni dengan cara mengubah atau mencabut pasal yang mengalami tidak sinkron oleh lembaga atau instansi yang memiliki kewenangan, namun demikian mekanisme ini memerlukan waktu yang relatif cukup lama karena untuk dapat mengubah suatu peraturan perundang-undangan harus masuk dalam prolegnas dan rangkaian pembentukan peraturana perundang-undangan. Mekanisme atau cara lain adalah dengan menggunakan asas hukum yakni lex posteriori derogat lege priori dan asas lex specialis derogat lege generalis sehingga Pasal 35 UU Dikti dapat mengesampingkan ketentuan Pasal 37 ayat (2) UU Sisdiknas.

Abstract:
The aim of this paper is to analyse the issue of regulations against speculation and usury in the first years of the Second Polish Republic (1918-1920). The long period of World War I resulted in a major economic shock and long-lasting condition of shortages of commodities, including the necessities of life. This situation had a terrific impact on politics and forced the Polish legislator to react. As soon as 5 December 1918 a Decree on war usury was issued. The regulation in the field of war usury identified several types of illicit acts and contained basic rules of a particular procedure which was supplementary to the common penal procedures. Due to a low level of legislation, the regulation was defective and incoherent with the system of the law. Since the previous regulation was still in force, a dissonance between law on the books and law in action occurred. Furthermore, due to provisions contained in the Decree it was not possible to eliminate the discrepancy thanks to common rules of interpretation of legal texts such as lex posterior derogat legi priori.

Abstract:
Abuses against Children are included in Extraordinary Crimes and often occue mainly to minors. This is due to the lack of government in acting on the case. In this case, it occurred in a 3 years old boy who is abused by his own teacher. Precisely happened on April 29, 2014 at Saint Monica Sunter during the dance extracurricular activity. The victim’s mother found out about it when the victim complained of pain in the part of his penis after the victim was abused. At that moment the victim’s mother reported the incident of abuse to the authorities. It was then estabilished that the defendant was guilty of fulfilling the elements of an offense against the victim. So the defendant must be held in the prison until the court process is decided. In the indictment given by the public Prosecutor charged with using Article 82 of Law Number 23 year 2002 on Child Protection. However, the Prosecutors should be using the updated Law which is Article 82 of Law Number 35 year 2014 on the protection of new Children in the Prosecution. This proves that the Prosecutor is less careful in preparing the indictment given so as to cause legal irregularities that should in decideng the case reflects the legal objectives of Justice, certainty and expediency. Where as in legislation known as the principle of lex posteriori derogat legi priori that should be in the case of obscenity this principle is enforced. Because in the new Child protection Law more confirms the perpetrator of abuse if it is proven to commit abuse then the punishment is heavier that the old Law, and more to give special protection guarantee to the victim of abuse so that its rights will not be violated.

Abstract:
The current positive law no longer allows HGB to be extended continuously, and must return to state land. One of the reasons for the loss of mortgage rights is related to the expiration of the HGB. The purpose of this study is to analyze the legal consequences and legal protection for creditors holding mortgage rights after the HGB expires. The results of the research are that the lex posteriori derogat lex priori principle results in PP 18/2021 which is in the hierarchy of the Job Creation Law to override old regulations that are at the same level as government regulations. With the implementation of Article 37 PP 18/2021 there is a gap in the position of banks as preferred creditors to become concurrent creditors because the HGB has returned to become state land. In non-litigation efforts by regulating clauses related to extension, renewal and re-application of HGB in credit agreements that are preventive in nature against Article 37 PP 18/2021. Litigation efforts against the abolition of mortgage rights must be carried out in a default suit or unlawful act.

Kewenangan pelaksanaan atau eksekusi putusan Badan Arbitrase Syariah Nasional secara peraturan perundang-undangan masih memakai Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Pilihan Penyelesaian Sengketa Pasal 61 yang merupakan kewenangan Pengadilan Negeri. Hal ini tidak sesuai dengan apa yang menjadi tugas dari Badan Arbitrase Syariah Nasional yang mempunyai tugas menyelesaikan sengketa-sengketa Arbitrase di bidang ekonomi syariah. Perkara-perkara Ekonomi Syariah menurut Undang-Undang Nomor 3 Tahun 2006 tentang Perubahan Atas Undang-Undang Nomor 7 Tahun 1989 tentang Peradilan Agama secara tegas bahwa dalam Pasal 49 menyebutkan kewenangan penyelesaian sengketa Ekonomi Syariah merupakan kewenangan absolut dari Pengadilan Agama. Oleh karenanya ada dua pendapat mengenai hal ini. Pertama, kewenangan eksekusi putusan Badan Arbitrase Syariah Nasional tersebut merupakan wewenang Pengadilan Negeri. Kedua, berpendapat bahwa semua yang berkaitan dengan penyelesaian sengketa ekonomi syariah berdasarkan Pasal 49 huruf (i) merupakan kewenangan Pengadilan Agama, pendapat ini didasarkan kepada asas hukum lex posteriori derogat legi priori dan lex specialis derogat legi generali. Selain itu Pasal 1 ayat (3) UUD 1945, Negara Republik Indonesia adalah negara hukum yang di dalamnya ada dua pengertian yaitu supreme of law dan equality before the law. Penafsiran terhadap supreme of law yaitu kepastian hukum. Pasal 61 UU No. 30 1999 merupakan suatu kepastian hukumnya untuk para pihak yang bersengketa di bidang Arbitrase. Mengenai pengertian equality before the law yaitu sama kedudukan di depan hukum, jadi kedudukan pengadilan negeri dan pengadilan agama sama di depan para pihak sengketa arbitrase, tetapi karena pengadilan agama telah dijustifikasi oleh undang-undang bahwa pengadilan agama mempunyai kewenangan absolut terhadap penyelesaian sengketa ekonomi syariah, dan sengketa-sengketa ekonomi syariah dapat pula diselesaikan melalui jalur nonlitigasi di Badan Arbitrase Syariah Nasional semuanya di bidang ekonomi syariah, maka tepatlah apabila pelaksanaan atau eksekusi putusan Badan Arbitrase Syariah Nasional di alihkan ke Pengadilan Agama.

Abstract:
Free Trade Zone area has its own rules in tax collection, including the delivery of taxable service. However, in the implementation of the policy in tax collection, there are still errors that cause conflicts between taxpayers and tax authorities. For example, such as the article in the Regulation of the Minister of Finance Number PMK-62/PMK.03.2012 which gives rise to multiple interpretations for taxpayers. The author will describe the implementation of correct policies in taxable service conflicts in the free trade zone using empirical juridical and normative juridical research methods. In the law there is the principle of lex posterior derogat legi priori which means that the new law (norm/legal rule) nullifies the validity of the old law (norm/rule of law). In addition, the use of the principle of legal fiction which assumes that when a statutory regulation has been promulgated, at that time everyone is considered to know (presumption iures de iure) and the provisions are binding. Thus, the taxpayer should be aware of the latest regulations regarding tax collections that he must pay. In this case, taxpayers can use the latest regulation, Regulation of the Minister of Finance PMK Number 171/PMK.03/2017.

Penelitian ini merupakan penelitian hukum normatif bersifat preskriptif. Data dalam penelitian ini diperoleh dari data primer dan data sekunder. Berdasarkan hasil penelitian dan pembahasan dihasilkan simpulan mengenai tinjauan putusan berkaitan dengan Pengaturan Hukum Pidana dan tinjauan Pertimbangan Hukum oleh Hakim dalam memutus perkara berdasarkan unsur-unsur Pasal yang ada. Based on the results of research and discussion resulted in conclusions regarding the review of the verdict related to the Regulation of Criminal Law and the review of Legal Considerations by the Judge obeserve based on elements of Criminal Law. Dalam rangka memberikan kepastian hukum atas kepemilikan sertipikat Hak Milik atas tanah sesuai dengan Peraturan Pemerintah No. 24 Tahun 1997 tentang Pendaftaran Tanah, pada Pasal 32 menyatakan sertipikat hak atas tanah adalah bukti kepemilikan yang kuat apabila setelah 5 tahun diterbitkan sertipikat tersebut, tidak ada pihak lain yang mengajukan keberatan sejak terbitnya sertipikat. Namun pada faktanya dalam perkara perdata Nomor: 27/Pdt.G/2016/ PN.Smr sertipikat tersebut dibatalkan pada saat persidangan.Untuk mengulas pembahasan Penulis mengunakan metode penelitian normatif empiris yang menghasilkan pembahasan, yaitu dalam penerapan pasal 32 PP. No. 24 Tahun 1997 terdapat dua sistem yakni sistem stelsel negatif dan stelsel positif terhadap pendaftaran atas tanah. Selain itu pula Penerapan Pasal 32 Peraturan Pemerintah Nomor 24 Tahun 1997 terjadi pertentangan pada tingkat asas hukum sebagai berikut ; (1) Penerapan asas Lex posterior derogate legi priori, (2) Penerapan asas Lex specialis derogate legi generalis (3) penerapan asas Lex superior derogate legi inferiori. Berdasarkan pembahasan tersebut dapat disimpulkan Penerapan Pasal 32 Peraturan Pemerintah Nomor 24 Tahun 1997 terhadap Perkara Perdata Nomor 27/Pdt.G/2016/PN.Smr, telah diabaikan atau tidak dapat diterapkan oleh Majelis Hakim sebagai dasar hukum karena apabila Pasal 32 Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Atas Tanah diterapkan, maka akan menimbulkan pertentangan-pertentangan. Dan Pertentangan yang timbul disebabkan kedudukan peraturan yang tidak balance (seimbang) sehingga tidak dapat diterapkan pada Peraturan Pemerintah Nomor 24 Tahun 1997 terhadap Undang-undang Nomor 48 Tahun 2009, KUHPerdata, dan Algemene Bepalingen, sedangkan Asas Lex superior derogate legi inferiori juga tidak dapat diterapkan mengingat pembidangan yang diatur pada kedua peraturan berbeda.

The arrangement of the PPAT work area is formulated in PP No. 24 of 2016 Article 12 Paragraph 1 formulates that the PPAT working area includes the province where the PPAT office is located. This research discusses the implementation of the PPAT work area and the sanctions that will be obtained if the PPAT exercises authority outside its working area. This research aims to discuss the legal arrangements regarding the work area of ​​the Land Deed Making Official and to find out the sanctions against the Land Deed Maker Officer who exercises authority outside the work area. This research is normative research using a statutory approach and a conceptual approach. The sources of legal materials for this research consist of primary, secondary, and tertiary sources of material. The collection of primary and secondary legal materials is carried out by collecting, reading, and recording legal materials in accordance with the laws related to the issues in this research. The results of this research explain that PP no. 24 of 2016 in Article 12 Paragraph 1 is not implemented according to the contents of the regulation. There is no article that explains the sanctions if the PPAT does not carry out the work area of ​​one province so that the PPAT who exercises authority outside the work area does not get sanctions. Abstract:
Boundary dispute is a new phenomenon that occurred in the era of regional autonomy followed by the expansion of the region. One of them occurred between Kepulauan Riau and Jambi Provinces related to Berhala Island ownership. Settlement of disputes between these two provinces took quite a long time and also caused tensions between two provinces. Actually, the government through the Ministry of Home Affairs has issued a regulation to solve the boundary problem of this area namely the Minister of Home Affairs Regulation No.1 in 2006 and No. 76 in 2012 on Guidelines for Confirmation of the Boundaries, however, is still less effective because although it has been done in such a way the party who feels aggrieved still take another way that is by testing the legislation to the Supreme Court or Mahkamah Konstitusional (Constitutional Court). An example is the boundary dispute between Kepulauan Riau and Jambi Province which was resolved through the examination of legislation to the Supreme Court and the Constitutional Court. In the case, there were 3 decisions, namely Supreme Court Decision No.49P/HUM/2011, Decision of the Constitutional Court No. 32/PUU-X/2012 and the decision of the Constitutional Court No. 62/PUU-X/2012. Based on the research results obtained as follows 1). Implementation of the principle or legal principle of lex posterior derogat lex priori by the Supreme Court 2). The decision of the Supreme Court was taken into consideration in the decision of the Constitutional Court 3). The cause of the territorial boundary disputes between Kepulauan Riau Province and Jambi Province was the synchronization of 3 related laws namely Indonesian Law no. 31 in 2003, Law no. 25 in 2002 and Law no. 54 of 1999.

Abstract:
Village regulations are a manifestation of Indonesia as a state of law. Its existence in the world of regional legal products is arguably still new and its existence is the answer to the challenges of the social conditions of society which always change from time to time. As a result of the issuance of Law number 12 of 2011 concerning the Formation of Legislation (UU PPPU), it shifted the hierarchy of the position of village regulations. This has an impact on the uncertainty of the juridical basis of village regulations. This has led to the neglect of this type of regional legal product, especially since it is still relatively new, often in the process of formation it is not in sync with the procedures contained in Minister of Home Affairs Regulation (Permendagri) Number 111 of 2014 and does not pay attention to the rules and principles of the formation of laws and regulations. From these problems, two problem formulations emerged, namely: 1) What is the Process of Formation of Village Regulations according to Permendagri Number 111 of 2014?, 2) How is Siyasah Duturiyah's Review of the Process of Formation of Village Regulations according to Permendagri Number 111 of 2014?. This research is library research in a qualitative form. To explore the data and analyze the data using a juridical-normative approach and Siyasah fiqh (Siyasah Duturiyah). The first results of this study are; the formation of village regulations must pay attention to 3 very fundamental and absolute rules or principles, namely the principle of lex superior derogate lex inferiori, principle of lex specialis derogate lex generalis, and principle of lex posterior derogate lex priori. The formation of village regulations according to Permendagri Number 111 of 2014 must go through 6 (six) stages, namely planning, preparation, discussion, determination and promulgation, dissemination, as well as evaluation and clarification. Second; based on the review of the dusturiyah siyasa on the substance of the process of forming village regulations, the principles of Islamic law have been realized, such as the application of the principles of deliberation and democracy. Because each stage does not leave the principle of amar ma'ruf nahi munkar. Even though in practice there are often legal defects and are used for personal and group interests only.

Penyusunan Peraturan Perundang-udangan termasuk produk hukum Daerah (Perda) hendaknya menyesuaikan dengan system pembentukan hukum Nasional berdasarkan ketentuan terbaru dalam UU No. 12 Tahun 2011, serta memperhatikan prosedur dan tata cara yang baik guna menciptakan hubungan (harmonisasi) antara regulasi satu dengan lainnya. Dari hasil penelitian dapat disimpulkan bahwa, Perda Transparansi No 3 Tahun 2002 di Kota Gorontalo masih memiliki kekurangan dan kelemahan, khususnya dari latar belakang pembentukan yang belum memenuhi landasan dan asas penyusunan peraturan perundang-undangan termasuk memuat landasan hukum (yuridis) aturan terbaru sebagai rujukan yakni ketentuan UU Keterbukaan Informasi Publik. This study aims to analyze: a) the concept of Notary maatschap in Law No. 30 of 2004 concerning the Position of Notary jo Law No. 2 of 2014 concerning the Position of Notary and also according to article 1618 of the Civil Code; b) knowing the legal consequences of the deletion of paragraph (3) of Article 20 of Law No. 2 of 2014 concerning the Position of Notary; c) knowing the basis for the implementation of the Notary maatschap.This research uses normative legal research methods and prescriptive analysis with a statute approach. The legal materials used are primary legal materials and secondary legal materials. The data collection techniques used are literature study, data analysis, description, construction, argumentation, and systematization techniques. The results of this study show that the first regulation Implementation in UUJN is no longer valid based on the principle of lex posterior derogat legi priori. So, the Notary Civil Partnership is based on the Civil Code and Article 20 of the UUJN. However, the provisions of the Civil Partnership of the Civil Code are not relevant if used by the Notary Maatschap. In the absence of clear regulations, the independence of Notary in working is limited because they have to collaborate with allied partners. This impacts the structural, functional, and financial independence of Notaries who previously worked independently. This includes maintaining the confidentiality of deeds. These two Notary Maatschap give rise to multiple interpretations and legal uncertainty, which can then lead to a violation of the Notary's oath of office, so the provisions of Article 20 of UUJN-P should be revoked.

Abstract:
The aims of this study are 1) to find out and analyze the legal position of policy holders and workers according to laws and regulations in Indonesia, 2) to find out and analyze the regulations regarding protection for policy holders and workers who have provided legal protection or vice versa. This research uses normative juridical research methods with statutory and conceptual approaches. Based on the research results obtained, it can be seen that the position of policy and workers holders in insurance companies that are declared bankrupt through decisions determined by the commercial court is as preferred creditors. In this case, there is a conflict regarding the fulfillment of the rights of policy holders and workers, so to resolve the problem of conflict, legal principles are needed. In this case, the principle of lex posterior derogat legi priori is used, namely that new laws and regulations override old laws and regulations. The Insurance Law is a longer statutory regulation than the Job Creation Replacement Law, so the position of workers in insurance companies that are declared bankrupt has a higher position than the position of policy holders. In terms of the order of fulfillment of rights between the policy holder and the worker, the worker must be paid first. The forms of legal protection for policy holders are regulated in the Civil Code, POJK Insurance and Marketing of Insurance Products, OJK Law, Consumer Protection Law, Bankruptcy and PKPU Law, and Insurance Law. Legal protection for workers is regulated in the Civil Code, Bankruptcy and PKPU Law, PP on Wages, Job Creation Replacement Law, and Constitutional Court Decision Number 67/PUU-XI/2013.

Hasil penelitian ini menunjukkan bahwa (1) Kedudukan jabatan Sekretaris Desa yang sah adalah Sekretaris Desa yang diangkat Kepala Desa dari unsur Non-PNS karena sudah sesuai dengan ketentuan Undang-Undang Nomor 6 Tahun 2014, Pasal 49 ayat (2) bahwa Kepala Desa dalam mengangkat perangkat Desa terlebih dahulu berkonsultasi ke camat atas nama Bupati/Walikota dan terhadap perangkat Desa yang diangkat bertanggung jawab sepenuhnya kepada kepala Desa. Sekretaris Desa yang lama berasal dari unsur PNS sudah tidak mempunyai legal standing untuk memangku jabatan sebagai Sekretaris Desa karena terjadi pelanggaran Undang-Undang Nomor 6 Tahun 2014 Tentang Desa. (2) Penyelesaian hukum terhadap adanya dua pemangku jabatan Sekretaris Dasa dalam pemerintahan desa akibat ketiadaan pemberhentian pejabat lama yaitu diberlakukan asas preferensi atau asas pengutamaan, yaitu “lex posteriori derogat legi priori” adalah peraturan perundang-undangan yang baru mengesampingkan peraturan perundang-undangan yang lama. Pengertian tersebut dapat dijelaskan bahwa Peraturan Pemerintah Nomor 78 Tahun 2013 tentang Pengadaan Pegawai Negeri Sipil, merupakan peraturan perundang-undangan yang baru, sedangkan Peraturan Pemerintah Nomor 45 Tahun 2007 tentang Persyaratan dan Tata Cara Pengangkatan Sekretaris Desa Menjadi Pegawai Negeri Sipil, merupakan peraturan perundang-undangan yang lama.

Abstract:
The state has a preference right (priority) to collect tax debts on goods which belong to the taxpayer (debtor), meaning that the state's position as a preferred creditor is declared to have advance rights to the taxpayer's property to be auctioned in public. Preference rights by the State for paying off tax debts are in fact not as easy as imagined, there are disharmony in several laws and regulations, namely between the Taxation, Bankruptcy and Labor Laws and the Constitutional Court Verdict No.67/PUU-IX /2013 and other problems that affect the State's pre-emptive rights over paying tax debts. The objective of this study is to determine the impact of disharmony of Legal Regulations relating to Debt Repayment in Bankruptcy Against the State's Standing on Preferential Rights of Tax Debt. Based on research, the position of laborers' wages in Constitutional Court Decision No. 67/PUU-XI /2013 contrary to the provisions of the KPKPU Code which regulates labor wages as a bill of general preferred creditors and based on the principle of lex posteriori derogat legi priori, the position of laborers' wages in bankruptcy is based on the provisions of the KPKPU Code which overrides the provisions of Code No. 13 of 2013. Second, the consideration of the Constitutional Court on Verdict No. 67/PUU-XI/2013, is not in same direction with the provisions of the KPKPU Code which regulates that the wages of workers owed both before and after the bankruptcy was declared is a bankruptcy debt.

Abstract:
The criminal offence ?killing and torturing animals? under Article 269 of the Criminal Code says that it can be committed only ?contrary to regulations?. The regulations governing the treatment of experimental animals are the Animal Welfare Law from 2009 and the Law on the Ratification of the European Convention for the Protection of Vertebrate Animals used for experimental and other scientific purposes amended by the Protocol of amendment to the European Convention for the Protection of Vertebrate Animals used for experimental and other scientific purposes from 2010. The first one imposes numerous obligations and introduces numerous prohibitions in the treatment of experimental animals, which at first sight make the possibilities of committing this criminal offence greater. The other law does not contain most of the prohibitions and restrictions that are included in the Animal Welfare Law. Thanks to a legal rule which says that a later law regulating the same subject replaces the former one (lex posterior derogate legi priori) and the aforementioned unconstitutionality of many provisions of the Animal Welfare Law, researchers and teachers in Serbia are not in particular danger of criminal prosecution.

Abstract:
The purpose of writing to be achieved in this paper is to know and analyze the return of state losses in the investigation process that can eliminate criminal perpetrators of corruption. This research is a normative legal research using the statutory approach "statute approach", the case approach "case approach", and the conceptual approach "conceptual approach". This study used analytical descriptive analysis techniques. The results of this study show that the return of state financial losses in the investigation stage of corruption can stop the process of handling criminal acts through police discretion. One of the elements of corruption is the element of state loss, meaning that when it has been returned, it means that the element has been lost, meaning there is no loss as a logical consequence of the Constitutional Court decision No. 25/PUU-XIV/2016. But with the condition that it must be before the investigation stage through police discretion and if it is based on the Lex Posterior Derogate Lege Priori, meaning that the new law overrides the old law, meaning that the new regulation ignores or overrides the old regulation in the same respect

Abstract:
This paper aims to determine the legal position of laws that use the omnibus method in the system of laws and regulations in Indonesia. The focus of the research focused on the legal position of laws using the omnibus method in terms of the provisions of Article 97A of the Law on the Establishment of Laws and Regulations. Using the normative juridical method through literature study, this paper concludes that with the characteristics of laws that use the omnibus method based on the regulations in Article 97A of the Law on the Establishment of Laws and Regulations, these provisions result in inconsistencies in norms with the provisions of the hierarchy of laws and regulations regulated by Article 7 paragraph (1) and paragraph (2), provision number 223 Annex II Law on the Establishment of Laws and Regulations, as well as deviating the principle of legal preverence, namely the principle of lex posterior derogate legi priori. The vagueness and inconsistency in the formulation of Article 97A norms results in legal uncertainty, thus contradicting the guarantee of legal certainty as mandated by Article 28D paragraph (1) of the NRI Constitution of 1945.

Istilah Perseroan Komanditer, Firma dan Persekutuan Perdata sudah tidak asing lagi bagi kita. Dasar hukum pendirian CV, Firma dan Persekutuan Perdata adalah berdasarkan KUHD dan KUHPerdata. Berdasarkan pasal 23 KUHD, pendaftaran pendirian CV, Firma dan Persekutuan Perdata dilakukan di Kepaniteraan Pengadilan Negeri. Akan tetapi, saat ini pemerintah telah menerbitkan Peraturan Menteri Hukum dan HAM Nomor 17 Tahun 2018 tentang Pendaftaran CV, Firma dan Persekutuan Perdata dimana pendaftarannya mirip dengan pendaftaran badan usaha berbadan hukum yaitu dilakukan kepada Menteri melalui Sistem Administrasi Badan Usaha (SABU) secara online. Ini menyebabkan adanya ketidaksesuaian norma mengenai pendaftaran pendirian badan usaha bukan badan hukum. Berdasarkan paparan tersebut penulis menemukan permasalahan yaitu Bagaimanakah pengaturan mengenai badan usaha bukan badan hukum dalam peraturan perundang- undangan yang berlaku di Indonesia dan Apa akibat hukum bagi badan usaha bukan badan hukum yang berdiri sebelum berlakunya Permenkumham No. 17 tahun 2018 yang tidak mendaftarkan dirinya pada Sistem Administrasi Badan Usaha (SABU). Jenis penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang- undangan (Statute Approach) dan pendekatan analisis konsep (Analytical Concept Approach). Dalam hal debitur cidera janji, maka terlebih dahulu akan diberi teguran kepada debitur untuk melunasi utangnya. Namun, apabila debitur tidak menanggapinya dapat dilaksanakan eksekusi langsung atas kekuasaan sendiri (parate executie). Parate executie merupakan sarana eksekusi termudah dan cepat bagi kreditur untuk pelunasan piutang manakala debitur cidera janji. Dalam Undang-Undang Nomor 4 Tahun 1996 Tentang Hak Tanggungan (UUHT) terjadi inkonsistensi terhadap mekanisme atau aturan formal dalam pelaksanaan parate executie obyek hak tanggungan itu sendiri. Inkonsistensi dalam peraturan tersebut dapat menciptakan ketidakpastian hukum dalam masyarakat. Tujuan dari penelitian ini adalah untuk mengetahui inkonsistensi pengaturan parate executie hak tanggungan dalam UUHT dan upaya mengatasi inkonsistensi terhadap pengaturan parate executie dalam UUHT. Metode yang digunakan adalah metode hukum normatif, dengan menggunakan pendekatan perundang-undangan dan pendekatan analisis konsep hukum. Hasil dari penelitian ini adalah apabila dikaitkan antara ketentuan pada Pasal 6 dengan Penjelasan Umum angka 9 dalam UUHT bahwa Penjelasan Umum angka 9 UUHT tersebut tidak dapat dijadikan sebagai sandaran bagi materi pokok yang diatur dalam batang tubuhnya, karena penjelasan dalam undang-undang tidak mempunyai kekuatan mengikat dan upaya mengatasi inkonsistensi dapat dilakukan dengan cara penerapan asas lex posterior derogate legi priori dan penyempurnaan pengaturan melalui revisi terhadap UUHT.Kata Kunci: Inkonsistensi, Parate Executie, Hak Tanggungan

Abstract:
He is behind the arguments against the imposition of chemical castration sanctions on perpetrators of pedophilia crimes, which are considered serious crimes due to the high number of victims and cause psychological trauma to children and harm. Therefore, the Indonesian government took this issue seriously and enacted Law No. 17 of 2016, which provides additional punishments for pedophile criminals in the form of chemical castration. This additional punishment is a cause of state concern for the children of the nation and for generations to come. This creates a dilemma, however, for doctors who have their own profession and experience in the medical field, who are worthy of being the perpetrators of chemical castration on criminals. The President of the Indonesian Medical Association (IDI) said he would reject use of doctors as enforcers of chemical castration sanctions. The medical profession is involved in the process of punishment through chemical castration against ethical rules or (oath) and the Medical Practices Act No. 29 of 2004, which they use as a guide to carry out all their actions.
