L’articolo si propone di indagare le numerose sfaccettature di un personaggio cruciale per il mercato dell’arte europeo del XIX secolo, a cui gli studi non hanno ancora rivolto la dovuta attenzione: l’antiquario Giuseppe Baslini. Ricordato dai contemporanei per l’eccezionale talento da connoisseur e la spregiudicata astuzia negli affari, Baslini fu probabilmente il più importante mercante milanese del secondo Ottocento. La sua bottega in via Montenapoleone 11 divenne riferimento e luogo di richiamo per restauratori, collezionisti e travelling agents di tutta Europa. Fu consulente e fornitore delle collezioni milanesi Poldi Pezzoli e Bagatti Valsecchi, che beneficiarono della poliedricità dei suoi interessi, ma anche della National Gallery di Londra e della Gemäldegalerie di Berlino. Il suo «perfido commercio», come pure il ruolo di mediatore presso gallerie e collezioni private, sono documentati dalle lettere di Giovanni Morelli e Austen Henry Layard, dai taccuini di viaggio di Charles Eastlake e Otto Mündler e dall’autobiografia di Wilhelm von Bode. La restituzione delle vicende biografiche e professionali dell’antiquario, attraverso lo studio di documenti d’archivio inediti, lettere, fatture e cataloghi d’asta, ha rivelato una personalità intrigante e controversa, importante tramite per ricostruire relazioni e provenienze collezionistiche sino a oggi ignote.

La collezione, composta di libri, certificazioni, lettere e materiali didattici, fra cui i quaderni sui quali annotava personali riflessioni sulle pratiche didattiche e ludiche svolte in classe, costituiscono parte del fondo archivistico personale custodito presso il Centro di documentazione e ricerca sulla storia delle istituzioni scolastiche, del libro scolastico e della letteratura per l’infanzia (Ce.S.I.S.) dell’Università del Molise, tra le cui finalità sono previsti il recupero, la conservazione e la valorizzazione degli archivi personali degli insegnanti. Tali fondi permettono una analisi dettagliata della funzione degli scritti personali (egodocumenti) di tipo professionale. Insieme all’uso delle categorie interpretative offerte dalla storia delle culture scolastiche nella analisi si intendono raccogliere le suggestioni proposte dalla storia della memoria scolastica.

Some aspects of a corpus of personal correspondence.English as used in business letters, job applications and different types of bureaucratic communication in India has become more or less standardized and is not much different from the language of similar letters written elsewhere in the English-speaking world. But this is not the case with private letters, which are intimate, informal and often lax. Since a personal letter is written to a friend, spouse or relative, the writer comes out with his/her ‘real self’ in the use of language. It may therefore be taken as an authentic indication of the extent to which one is proficient in English and also the extent to which nativised features of English in this specific genre are attributable to native socio-cultural factors.

This article discusses Tadeusz Kantor’s letters to the Foksal Gallery in Warsaw (mainly to Wiesław Borowski) from the years 1961–1979 with the aim to explore the interconnections between Kantor’s private concerns artistic categories. Kantor used his private notes as works of art, and his letters show different functions that he attributed to epistolography. The texts under discussion belong to different genres, and range from private telegrams to the happening (The Letter).

Abstract This article focuses on letters in private Ibadi libraries and their importance for understanding the primary means of communication among Ibadi communities in the premodern Maghrib. Using the example of a letter from the 7th/13th-century Ibadi Shaykh Abū ʿAbdallāh al-Ṣidghiyānī from the island of Djerba (Tunisia) to the Ibadis of Warjalān (Algeria), it seeks to highlight the importance of the archive of unedited Ibadi manuscript letters. This corpus of correspondences has not received the care and maintenance it merits because these letters do not belong to a recognized volume or book and are today located in private libraries unavailable to the public. The article also uses the example of al-Ṣidghiyānī’s letter to emphasize the importance of the manuscript letters and their role in maintaining intellectual ties among the Ibadi cities of the Maghrib. This brief article consists of two parts. The first part offers a general presentation of the archive where the letter is today held: the El Barounia Library in Djerba, Tunisia. The second part presents the manuscript and its author in their historical context.

The pseudonymous author has forged them as personal letters from ‘Paul’, because he had to reckon with his readers' critique concerning their authenticity, above all with critical scrutiny directed at possible contradictions in their circumstances of origin. Through the genre of a private letter he has attempted to concoct previously unknown letter-situations, and to make understandable the late discovery of the letters. At the same time, through the construction of three letters he has made a claim for general validity in respect of geography and time, so as to spread the ‘right meaning’ of the statements in theCorpus Paulinum.

Tesi L’art. 64, lettere b) e g) della L. 31 maggio 1995, n. 218 di riforma del sistema italiano di diritto internazionale privato deve essere interpretato nel senso che non può dirsi integrata una violazione dei diritti essenziali della difesa e delle garanzie ascrivibili all’ordine pubblico processuale italiano, idonea a giustificare il diniego del riconoscimento di una sentenza straniera, per il solo fatto che la sentenza in questione sia stata resa all’esito di un procedimento nel corso del quale il debitore della sentenza è stato il destinatario di un provvedimento cautelare in personam, concesso inaudita altera parte, secondo il modello della freezing injunction inglese. Il riconoscimento di una sentenza straniera preceduta da un provvedimento cautelare può essere negato in forza delle disposizioni citate solo quando l’emanazione di detto provvedimento abbia comportato una violazione delle garanzie processuali fondamentali tale da tradursi, per la sua rilevante incidenza, in una lesione del diritto di difesa rispetto all’intero processo. Abstract:
The development of ancient epistolography could be associated with the very development of literacy in Greece. Apart from its original function, to transfer a notice to a distant person, the letter has expanded its realm over time. Trough an overview of the letters preserved in the Greek language area and in the works of Greek authors, we can see various functions the letter assumed – both in everyday life and in literature. Numerous accounts and fragments of letters, from short business notice on lead tablets to private letters written on papyrus, which served as a means for preserving familiar or friendly relationships, point to a great popularity of the letter in ancient times. Given the flexibility of its form and the possibility of its usage on a number of occasions, whether public or private, both by the educated and by the uneducated, we notice that the epistolary form, as a means of communication, soon became firmly rooted in the Greek cultural area. The paper aims at highlighting the very beginning of developing the form of letter in Greece, its basic elements and characteristics, as well as the terms used for it in the Greek language.

Based on the special stock exchange comment letter system in China, this paper explores the relationship between the exchange tax-related comment letters and corporate tax avoidance behavior from the standpoint of securities regulation. We document that firms that engage in more aggressive tax avoidance are more likely to receive a tax-related exchange comment letter. Also, relative to firms receiving a non-tax-related comment letter, firms receiving a tax-related comment letter reduce their tax avoidance behaviors in subsequent years. Further study shows that the more the number of questions and the greater the level of detail in the comment letter, the stronger the effect of tax-related comment letters on corporate tax avoidance. After examining the sample with different degrees of political connection, we find that tax-related comment letters inhibit tax avoidance among state-owned enterprises and private enterprises with close political connections. Finally, the monitoring effect of comment letters on corporate tax avoidance is more pronounced in regions where tax administration is weak, suggesting that the comment letter system can be used as a complementary mechanism for tax administration.

La tesi ha lo scopo di inquadrare Giordani nel contesto del mondo culturale cattolico tra le due guerre e di approfondire la sua proposta di «cristianesimo integrale» come soluzione alla crisi che negli anni Venti e Trenta viziò il mondo economico, il sistema politico e lo scenario culturale, a livello di principi fondamentali, di valori. Per questo si è dato assoluto rilievo ai rapporti di Giordani con molti intellettuali suoi contemporanei e con varie istituzioni culturali cattoliche. Il testo segue dapprima un indirizzo biografico, che permette di ripercorrere la vita di Giordani dalla giovinezza, segnata dalla guerra e dall’esperienza al fronte, alla sua serena fine, nel 1980. Si tratta di una testimonianza di come la sua conseguenzialità tra fede e opere abbia inciso negli ambienti che lo hanno visto protagonista, tanto che è stato avviato per lui il processo di beatificazione. La ricerca è stata condotta tenendo conto degli scritti di Giordani e della storiografia precedente, ma soprattutto utilizzando numerosi materiali d’archivio. In particolare i carteggi privati aiutano a ricostruire l’operato di Giordani a favore dell’impegno degli intellettuali cattolici negli anni oscuri del fascismo e la sua indefessa attività per la realizzazione di un nuovo umanesimo. Altro spazio è stato riservato ai rapporti maturati da Giordani con due esponenti del mondo cattolico italiano di quel periodo, ovvero Giovanni Papini e Piero Bargellini.
This dissertation aims at setting Igino Giordani within the broader framework of the catholic cultural environment between the two world wars. It focuses on his proposal of an «integral Christianity» as a solution to the recession which threatened the fundamental values and principles of the economy, politics and culture during the 1920's and 1930's. This is the reason why the relationships between Giordani and many of his colleagues and cultural catholic institutions have been studied in depth. The work starts with a biography, underlining how Giordani's youth has been affected by the war and the experience as a soldier, up to his peaceful death, in 1980. His life shows how the consistency of his actions with his faith made him an influent personality in his working environments, to the point that the beatification process has begun. The research is based on Giordani's writings and on the previous historiography, but the most important source is constituted by a large number of archive documents. Particularly, Giordani's private correspondence has been very useful in understanding how he acted in order to support the engagement of the catholic intellectuals during the dark fascist age and his endless activity in order to build a new humanism. The work also focuses on the relationships between Giordani and two members of the Italian catholic world of the time: Giovanni Papini and Piero Bargellini.

The aim of this thesis is to show that Emily Dickinson was not concerned with the publication of her poems and she herself decided to withdraw from the outside world, a decisive event which contributed to the original production of her almost eighteen hundred poems and over eleven hundred letters. Emily Dickinson withdrew into her untouched private world – which here is called “the bubble” – and developed the contemplation process based on the approach of apprehending perceptions which resulted in the instant captions that have enchanted readers. Since her withdrawal was as a result of her own free choice and own writing and living conventions, she was able to be the craftsperson that enjoyed living and writing. Her perception of nature by taking instant captions of the observable natural objects is perfected by the process of contemplation developed in some of her poems. The theoretical and methodological basis of the study comes from the analysis of the complete edition of poems edited by Thomas H. Johnson, the letters edited by Mabel Loomis Todd, and the concept of Nature by Hans Georg Schenk. For the analyses of different issues related to Dickinson’s verses, withdrawal, and apprehension of perceptions, the works of the biographer Richard Benson Sewall and critics such as Albert Gelpi, Barton Levi Armand, Karl Keller, Sharon Cameron, among others, were consulted. This study aims to demonstrate that Emily Dickinson was not concerned with publication and her withdrawal within her bubble was a positive event for her life and poetry. Such conclusion might contribute to enlighten the knowledge about the life and work of such an amazing personage of American Literature and American society as Emily Dickinson has been so far.

The target population of twenty-six colleges and universities was identified from the respondents to the campus questionnaire and included schools from the states of Maine, New Hampshire, New York, Massachusetts, Connecticut, and Pennsylvania.

This dissertation means to explore the aesthetics of Woolf’s epistolary writing. For Woolf, letters become a vast field, a free space for experimenting her original theories of writing, developing her unique techniques and perfecting her style of modern writing. They also provide a space for finding her authorial voice, position and self. Delving into the six volumes of Woolf’s private letters, we first explore how they depict the author’s daily life, its wealth and intensity. Through her exchanges with her numerous addressees, Woolf redefines the epistolary genre: apart from their informative function, letters offer artistic descriptions of life and people, which are composed by Woolf in a specific manner, often fuelled by various other arts—painting, cinema, music, or drama. Such a representation transforms the most private epistolary genre into a public, dialogical and inter-medial genre. Intimacy and self-protectiveness, together with a desire for self-exposure stimulate Woolf to develop a style of “central transparency”—her figurative or suggestive method that enables her to express emotion and represent herself.

This thesis examines the relationship between the private enforcement of EU competition law and forum shopping with a particular focus on cross-border collective end-consumer redress. There is no coherent framework across the EU for these types of cases. This lack of uniformity has the potential to create recourse to different national courts. Lawyers may engage in forum shopping when filing lawsuits on behalf of the victims of mass torts. Such practices can provide Member States with incentives to amend their laws to attract collective proceedings and create competition between national judicial systems. However, forum shopping is not the only concern. There appears to be a paucity of cross-border collective claims. This is coupled with an apparent lack of motivation for end-consumers to seek a remedy, particularly if the only choice is to litigate outside their own legal regime. Addressing this situation is vital given that end-consumers regularly suffer harm in the form of higher prices, lower output, reduced quality and limited innovation as a result of antitrust infringements but they are rarely compensated due to legal and practical obstacles. To each end-consumer the harm may indeed be de minimis. However, the aggregate harm can amount to a considerable sum. In the absence of effective redress procedures, infringing undertakings retain the spoils of their unlawful conduct. Against this background, this thesis examines the extent to which the conflicts-of-laws rules encourage forum shopping and considers the appropriate forum and the appropriate procedural measures that need to be adopted in order to facilitate effective and equal access to justice for end-consumer victims of EU competition law violations.

Abstract:
The inherent flexibility of the letter form or epistolary mode of writing frees the writer within the framework of salutations and closings to use vocabulary and language to create, to omit or to invert conventional constraints imposed on women by a patriarchal society. The letter begins as a blank page but becomes the space for writing one’s personal thoughts and emotions to the absent other in a communicative effort to minimize the separation. This dissertation examines the female narrator in actual letters written during the Spanish emigration to the New World in the sixteenth century and four epistolary novels written by female authors during the nineteenth- and twentieth centuries. The female “I” emerges in the selected texts and attests to the writer’s ability to inhabit her own writing space. By applying Mikhail Bakhtin’s theory of dialogism and Janet Altman’s formal approach to the epistolary novel, the epistolary and literary textual creations by women writers challenge the silence and traditional anonymity generally assigned to women. I explore the cultural enculturation of the transgressive female who loses her “self”, her very being because of her inability to conform to societal norms as outlined by Barbara Creed and Elaine Showalter. In addition, I apply ideas from Linda Kauffman’s study on the transformation of the female writer who metamorphoses from victim to artist through the use of pen and paper. The female ‘self’ crafted by each of the letter writers is studied as they narrate their space, exercise agency, and negotiate the conflicts and contradictions of their domestic and public space. Mais elle fut aussi, et surtout, une prodigue épistolière qui écrivit, dès 1833 et jusqu’à sa mort en 1883, plus de 22 000 lettres ‒ qu’elle appelait « ses restitus ‒ à son cher poète. Précieusement conservées par l’amant qui les confia, à la mort de Juliette, au neveu de cette dernière, Louis Koch, elles sont aujourd’hui progressivement publiées dans une édition en ligne, afin de mettre à la disposition du public et des chercheurs l’intégralité de cette formidable correspondance. L'édition critique et scientifique ‒ comprenant transcriptions, annotations savantes et manuscriptologiques, notices explicatives, index, glossaire ‒ de 568 lettres de 1841, alors que le couple célèbre ses huit ans d’amour, en montre les intérêts biographique, documentaire et littéraire. Julienne Gauvain, alias Juliette Drouet, is mainly well-known for her fifty-year relationship with Victor Hugo. But first and foremost, she was a lavish letter writer who wrote more than 22,000 letters to her dear poet – calling them her ‘restitus’- from 1833 until she died in 1883. They were safely kept by her lover, who entrusted them to Louis Koch – Juliette Drouet’s nephew – after she died. Today, they are gradually published online so as to provide the general public, as well as researchers, with this complete astounding correspondence. The critical and scientific edition – including transcriptions, scholar and manuscript-related annotations, explanatory notes, index, glossary – of 568 letters dating from 1841 (8th anniversary of the couple’s love story) highlights their biographical, documentary and literary interests. Indeed these ‘restitus’ allow a day-to-day study of the life of Juliette Drouet, who had just withdrawn from theatrical and public life in order to fully devote herself to her love, and of Victor Hugo who, freshly elected to the Académie française on January 7th and in the process of writing Le Rhin, had to face literary and family trials, started taking his first notes on the present times and was supervising the revivals of Hernani, Ruy Blas and Angelo, tyran de Padoue. These letters also account for an accurate testimony on the status of women, the sentimental ties, the customs and all sorts of small details of the 19th century daily life. As well, they supply precious information concerning the historical, political, medical, scientific, social and artistic context of the July Monarchy and the reign of Louis-Philippe. Finally, apart from its own stylistic and literary value, this true mass of text arouses a generic reflection given its hybrid status of epistolary diary

In consideration of the private nature of the 286 letters, reading them gives an interesting and informal view of seventeenth-century life, as well as much information on the variegated world of the Baroque book culture providing a constant backdrop to the relationship of collaboration and friendship between the two figures.

Abstract:
The enduring issues regarding codes and standards for consumer products and corporate behavior are discussed in this paper. It has been frequently asserted that the adherence of a product to a recognized government or private standard ensures that the product has a minimal level of safety, and that said product is therefore presumably non-defective. The agencies which promulgate these codes and standards are ostensibly impartial and informed, and have the public’s best interests in mind. This conviction is undoubtedly true in some instances, but is also unquestionably false in others. The issues regarding codes and standards and their impact upon products and the trusting public include, but are not limited to, asymmetric information, cost concerns, ethics, foreseeable misuses, non-alignment of interests, and technological advancements after the standards were adopted. In short, the adherence to the letter, rather than the spirit, of individual codes and standards is a manifestation of the Principal-Agent conflict, in which the agent, acting on behalf of the principal, has a different set of incentives than does the principal. This conflict and the underlying issues listed above are discussed. Case studies of numerous products with possible, known, and unforeseen adverse impacts upon public health and safety will be used as illustrations of products that were within the letter of the code or standard, but manifestly defective.

Um dos mais importantes desempenhos dos Municípios em Portugal passa, em grande escala, pela gestão territorial, tarefa que tem vindo a enfrentar alguns obstáculos quanto à sua eficácia. Estes obstáculos têm relevância acrescida devido a lacunas na gestão de áreas de expansão urbana, tradicionalmente dispersas que correspondem aos espaços contíguos às zonas urbanas consolidadas,historicamente compactas para onde estas se poderão expandir. Ora, é precisamente nas áreas de expansão urbana, caracterizadas pelas baixas densidades, quer populacional quer habitacional, onde freqüentemente permanecem atividades de cariz dominante não urbano, de índole agrícola, que são entendidas como locais de reserva para o crescimento urbano futuro, que se registra uma maior dinâmica nas alterações de ocupação e utilização do território, em resultado da forte iniciativa privada. Esta iniciativa é freqüentemente morosa na sua execução e ineficaz quanto à continuidade com a envolvente, devido à deficiente informação disponibilizada pelo Município quanto às regras urbanísticas vigentes, ou devido ao deficiente entendimento dessas mesmas regras por parte dos agentes privados. Conseqüentemente, poder-se-á referir que a inexistência de um modelo de gestão territorial, organizado e simples que possa disponibilizar de forma eficaz a informação quanto às regras de ocupação e utilização do solo vigente, quer na óptica dos munícipes na sua iniciativa privada de intervir no território, quer na óptica do Município na sua tarefa técnica de fazer cumprir essas mesmas regras, tem vindo a agravar esta problemática, designadamente, dificultando a monetarização do processo. Verifica-se, assim, a necessidade de evoluir no modo de disponibilizar ao cidadão toda a informação relativa às possibilidades de ocupação e utilização do solo, incluindo as faculdades de edificar e de urbanizar, como as condicionantes que limitam o direito de propriedade e o uso do solo, provenientes dos conteúdos conceptuais dos instrumentos de gestão territorial de âmbito municipal. Atualmente, os vários instrumentos utilizados na gestão do território, a nível municipal, têm vindo a ser acompanhados com alguns softwares em desenvolvimento, como os Sistemas de Informação Geográfica, capazes de expor com maior facilidade e eficácia uma quantidade cada vez maior e mais complexa de informação, num processo moroso. Com este tipo de aplicações é possível, por exemplo, sobrepor a um Ortofotomapa de uma determinada parcela do território, a informação proveniente do elemento chave da gestão territorial de âmbito municipal, o Plano Diretor Municipal, das suas cartas de condicionantes, mapas da rede hidrográfica entre outras. Este artigo apresenta um modelo de gestão territorial aplicado às áreas de expansão urbana do conselho de Belmonte, localizado no interior do país junto à fronteira com a Espanha, recorrendo a uma base dedados e aos Sistemas de Informação Geográfica. Este modelo pretende servir de apoio à iniciativa privada bem como ao Município ao qual competirá assegurar a sua monitorização. *** ENG: One of the most important jobs of the Municipal Town Hall (MTH) is, largely, to manage the territory, which is something which has its difficulties along the way. These obstacles are even more relevant considering there are gaps in the management of areas where there is urban expansion, traditionally scattered; diversec ty; which correspond to the spaces adjacent to the consolidated urban areas, historically compact city into which these will be able to expand. It is precisely in the areas of urbane expansion, characterized by low densities, both in terms of population and housing, where frequently activities of a non-urban nature, of agricultural nature for example, which are considered as areas of future urban growth, which register a greater dynamic in the alterations of occupation and utilization of the territory, as a result of a strong private initiative. This initiative is frequently slow in its execution and ineffective with regards to continuity with the surroundings, due to the defective available information by the Local authority (MTH) with regard to the town planning rules in force, or due to the defective understanding of the same rules on the part of the private agents. As a result, we could say that the inexistence of any kind of territorial management model, organised and simple, and which could efficiently provide information regarding the rules of occupation and utilization, whether it be in the sight of the municipality in its private enterprise in the territory, or whether it be in the sight of the municipality in its technical role to enforce the keeping of these same rules, has come to aggravate this very issue, namely, making more difficult the monitoring of the process. In this we can confirm the necessity to evolve in the manner of making available to the citizen all the town planning information relative the possibilities of occupation and utilization of the land, including the facilities to build and urbanize as well as the conditioning factors which limit and rights of the owner in the occupation and utilization of the land, originating from the conceptual contents of the instruments of territorial management of the municipality. At present, the various instruments used in the management of territory in Portugal, on a municipal level,have come to be accompanied by various software currently being developed, such as Geographical Information Systems (GIS), able to expose with greater ease and efficiency a growing quantity and greater complexity of information, in a slow process. With these types of applications it is possible, for example, to superimpose an Ortophotomap of a determined piece of the territory, the information originating from the key element of the territorial management of municipal extent, the Municipal Director Plan, of its letters of restrictions, maps of the hydrographical network amongst other such things. This article presents a model of territorial management applied to the areas of expansion of the district of Belmonte, located in the interior of the country close to the border with Spain, resorting to a data base and to the Geographical Information Systems. This model intends to serve as a support to the private enterprise as well as to the Local authority to which it will compete to secure its monitoring.

Ritter in which he described the “erotic obsession” which had caused him to depict the statue of the Sleeping Ariadne in the gardens of Versailles as a scantily-clad odalisque in the painting entitled La Versailles du Grand Turc, up to his last graphic project of 1964 entitled “Nassaince du Minotaure II”, the “private mythology” of Le Corbusier’s works was dominated by Minoan-Cretan mythology, to the point that the bull symbol became the unifying principle of his entire pictorial, plastic and architectural work. Dozens of Le Corbusier’s architectural projects include the theme of the labyrinth. The “main ouverte” and Ariadne - la Licorne were intended to “join up” from afar Chandigarh with the Bhakra dam. For the dam Le Corbusier designed architectural elements and he planned to install a copy of the “Ariadne” sculpture, similar in size to the “open hand” at Chandigarh. The Chandigarh-Bhakra complex – the planned city and the hydroelectric infrastructure – was the realization of the global post-war reconstruction plan, an approach devised by Le Corbusier together with the UN’s CIAM, based on the model of the TVA, the New-Deal Federal Agency, which had planned the development of the most backward area in the States starting from hydropower generation.
