Full textThis thesis aims to conduct a study on the impact that adoption legislation has on the intercountry adoption process, with the purpose of determining if inaccuracies in legislation offer opportunities for abuses related to intercountry adoption, which provisions of legislation may be exploited by the criminals and which methods or mechanisms may be developed in order to render adoption legislation crime proofed . The main working hypothesis is that low quality adoption legislation produces criminal opportunities for corruption and the concluding of illegal adoptions, while high quality adoption legislation reduces such criminal opportunities. In order to test this hypothesis, two national adoption legislations are considered and compared, by use of a horizontal comparison of the two adoption systems and the carrying out of a Crime Risk Assessment of the two legislations on adoption (the so called crime proofing ex post ). The first component of this horizontal comparison is the former Romanian adoption law (Law No. 25/1997), while the second one, determined after the completing of a selective analysis, is the Latvian adoption legislation.

Full textCrime-proofing is a crime prevention method promoted by the EU Commission since 2000. It starts from the assumption that the regulation governing legitimate sectors/markets might be criminogenic, i.e. producing unexpected opportunities for crime, in terms of new techniques, higher rewards and/or lower risk to criminals. It therefore aims at identifying such opportunities, if any, and finding out possible remedies. This thesis explores the crime-proofing approach, starting from a Crime Risk Assessment Mechanism (CRAM) that was developed to this purpose for the EU Commission. This is adapted and applied to a topical criminal phenomenon: the counterfeiting of trademarks, with special reference to the Italian fashion sector. Counterfeiting is nowadays a form of underground economy, which produces negative economic and social impacts. Fashion is one of the most affected industries, because of high consumer demand of counterfeit goods and low barriers for market entry. Italy is a leader country in the global fashion industry and is highly vulnerable to counterfeiting. The crime risk assessment undertaken in this study highlights how the Italian regulatory framework may inadvertently facilitate the counterfeiting industry, through unintended opportunities and regulatory loopholes. The ultimate goal is to check the crime-proofing functioning, whether the methodology can be improved and how it can be implemented at law-making level to minimize the risk of unexpected effects.

Full textThe thesis aims to update the principle of “certainty”, as a corollary of the principle of legality, in order to outline the binding scope of the principle with respect to the decision of crimnal law. The first part of the paper develops a reconnaissance analysis of the doctrinal and jurisprudential debate, also by reviewing the most significant rulings of the Constitutional Court, on the evolution of the principle in the Italian legal system. The results of this survey lead to developing a dimension of the principle in a "broad" sense, ie as a criterion of adherence of the norm to the reality, both procedural and human, which it intends to define and regulate. The study then analyzes, in the second part, the foundation and the impact of political-criminal action from a criminological and cognitive perspective considering, first of all, the factors and the empirical variables of the choices of criminalization and, secondly, combining the results obtained with the most current research conducted in the cognitive psychology. The cutting of originality of the work lies in applying these results in the activity of choice of the legal asset and typification of the criminal case. The empirical / cognitive perspective of the principle is therefore declined from a critical point of view in the analysis of some cases of special part, with specific reference to crimes of concussion (in constructive and inductive form) and corruption. The deficits of the two cases reflect, in fact, on the regulatory and judicial level the difficulties of preparing effective strategies to prevent and combat the phenomenon of corruption. In this sense, the study proposes a criminal model law that is integrated by the study of cognitive sciences and that allows it to act as a valid tool for the legislator in the fight against corruption.
