Full textArrest is always a topical subject, so, to evoke it from the point view of public safety, makes it possible to eliminate the associated notions of darkness and uncertainty. Re-examining arrest through the legal framework and with respect to human rights has highlighted commonalities but, more importantly, differences between French and Jordanian legislation. For the former, the main characteristic is its evolution, under the pressure of European authorities, towards a fairer trial, with the rights of the individual being strengthened. The latter is characterised by insufficient regulation, dominated by the general interest and the manifestation of truth, to the detriment of human rights. Effective protection of public safety, during the deprivation of liberty before trial, requires the verification by human and technical means, always in comparative law. Two words summarize the effects of this control, in these two rights, they are unstable and theoretical. The balance to be found between, on the one hand, the needs of the investigation to confound the perpetrators of the offence and, on the other hand, the protection of the person in custody, is complex and fluctuating, sometimes depending on the context of insecurity. French law, without offering the absolute panacea of an important legislation on police custody, should help guide Jordanian reflection, based on its successes but also its shortcomings, towards becoming more formalized in its Code of Criminal Procedure, in the desire for an adaptation in conformity with its cultural values

Full textSports practice today is subject to a wide variety of rules of different origins that draw separate legal orders, private and public: state legal orders and sports legal orders whose relations often take the form of a "positive organized legal pluralism. Lex sportiva or the right to sport can be defined as the set of rules that govern the rights and obligations of athletes. It deals in particular with the sports regulations of the various sports federations, the doping, the rules of transfer of players. Litigation can be defined as a dispute or disagreement between two parties, physical or moral, some of which dispute the others to be "holders of a right to the exercise of which they claim". Disagreement between the parties to the dispute may arise from a contract or a factual situation. These parties will first try to resolve their dispute amicably, if they can’t achieve an agreement, the dispute will be submitted to a court that will decide. We find litigation in all areas, civil, commercial, administrative, sports. The sport sector, or more specifically the sports conflicts, which are of various kinds and whose regulation requires the use of specialized bodies in the field and the application of texts specific to this type of sport. Disputes and conflicts constitute the main object of research of this work. Sports disputes can be resolved in ordinary courts. However, the inadequacy of the latter in disputes requiring specific technical skills which must be taken into account in the shortness of a career, to be settled rapidly, has led to the recourse - more and more frequently - to alternative methods of settlement of disputes conflicts. Unlike other disputes, which have a contrasting situation, the situation of sports disputes is clear, transparent, and original. To do this, and to meet their specific needs, sports organizations have created and developed specific legislative rules that ensure their functioning, and have constituted bodies that ensure the proper application of the rules they have enacted. Sporting conflicts are therefore regulated by special rules and statutes and specialized sports, which allow the parties to a dispute to lead to practical and satisfactory solutions. It can be said that the regularization of sports activity can be done autonomously and escape the public authorities, the state order. The Sports Regulations are therefore autonomous and supreme regulations with regard to the state legislations. The creation of these specific regulations, has led to the creation of specialized jurisdictional bodies competent to settle conflicts of sports organizations, and which operate in accordance with their regulatory power. In reviewing the Arbitration Rules governing sports organizations, it can be seen that they include specific provisions determining the jurisdiction of the Arbitral Instances in relation to the concept of Sport. With the growth and prosperity of international trade, arbitration has proven to be the preferred international transaction. Hence, and in the face of internationalization and the complexity of litigation, the domestic laws and jurisprudences of States have recognized and sanctioned the practice of arbitration

Full textSeniority in both French and Cameroonian legislations is taken into account either due to legal, conventional or contractual dispositions. Two principals are used to quantify seniority. One is the criteria of “continuity of services” meaning that the employee's seniority will be acknowledged throughout the contract until its term. The other is the principle of “effective work”; the worker's seniority should only be taken into consideration when the accomplished task corresponds with the criteria of effectiveness. A new definition of seniority has been proposed with the hope that in the two countries another dimension could be given to the concept. Seniority should be recognized by the States throughout the employee's career. It should be “seniority in employment”. All working period not rewarded by the employer should be by the States. This definition of seniority would certainly be of a financial weight but it could contribute in both countries to reduce to number of the unemployed

Full textThe dynamic of insolvency law resides in the contradiction of its foundations: individual freedom and the general interest.These subjective and objective foundations explain the dichotomy nature of positive purposes of insolvency law: payment of creditors, rescue of the failing firm. Contemporary laws are organized around these two objectives by erecting legal systems which are either contractual or institutional. This is the case of OHADA law and French law which are the subject of our study. The main idea is to say that if the antinomy of the foundations leads to a dual legal system of bankruptcy, it does not prevent a convergence of legislation. Overall, the observation reveals that the dichotomy of the objectives of bankruptcy laws tend to fade during the preparatory phase of the rescue, specifically in the effects of the opening of the rescue procedure on the creditors’ rights. We can observe in this field, a quasi-similarity of OHADA and French laws. Although rescue purposes are different, the legal techniques adopted towards the creditors are mutatis mutandis the same: identity which bears witness to their universality, consequently their efficiency. By contrast, the irreducibility of subjective and objective conceptions re-appears at the stage of solution of bankruptcy. This reveals the genuine concerns of the legislator when it establishes court-supervised recovery proceedings. It leads to the implementation of mechanisms which either organize the collective expression of the creditors by democratic way (majority rule), or inhibit the participation of these, in favor of the judicial authority. Saving the company is a question of collective interest of creditors or a matter of general interest. This divergence in the solution of rescuing in OHADA’s and French laws is the witness of the dialectical antinomy of the foundations of bankruptcy laws
