Abstract:
Currently, there is a rampant circulation of Balinese fermented drinks that do not have distribution permits. The Government of Indonesia has regulated regulations related to the circulation of fermented beverages that do not have a distribution permit in Presidential Regulation No. 74 of 2013 and Bali Provincial Governor Regulation No. 1 of 2020. Therefore, the purpose of this reserach is to examine the legal arrangements regarding the production of Balinese fermented drinks and to analyze law enforcement against Balinese fermented beverage business actors without a distribution permit. This reserach uses a normative legal research type, using a statutory approach and a conceptual approach. The sources of legal materials for this research are: primary, secondary and tertiary sources of legal materials. This research data collection technique is a literature reserach technique, namely by reviewing legal materials that intersect and then being categorized or classified and archived, written, quoted, summarized, investigated as needed with a qualitative approach. The researcher found that Legal arrangements regarding the production of Balinese fermented beverages are regulated in Bali Provincial Governor Regulation No. 1 of 2020. Bali Governor Regulation No. 1 of 2020 is a supporting factor for law enforcement because it is a reference for the law in addition to law enforcement factors, namely police officers in this case pamong praja police who have the task of supporting in organizing local government in the field of security and order and enforcement of local regulations in terms of controlling the circulation of alcoholic beverages.

Abstract:
The development of International Law that is taking place today has led to fragmentation. As a result, conflicts of norms arise from international treaties generated by each regime. This study aims to examine how conflict of norms can take place in a fragmented international law system and how to resolve it. It is normative legal research, used secondary data in the form of primary legal materials, secondary legal, and tertiary. The data collection technique uses library reserach, then analyze qualitatively. The results indicate that the absence of an authorized institution to create International Law causes conflict of norms International Law. The ways to resolve conflict of norms include not applying one of the conflicting norms; considering one of the conflicting norms is illegal; taking into consideration one of the conflicting norms is still valid but not illegal; and the two conflicting norms are considered to have the same position.

Abstract:
The problem of natural resources aspects involving the indigenous people with the goverments and stakeholders become more sorious. The indigenous people’s position as the minority groups frequently experiencing suppression as the effect of the inforcement of a legislation. Some laws governing the natural resources and communal rights of the indigenous people are not compliance with UUPA as the main law governing the natural resources. According to the facts above, the writer conducted a research using the theory of law harmonization to find the point of problems with the aim of making it easier for the goverments to fix what should be fixed. This normative juridicial research used the method of data collection such as library reserach with the main sources were literature materials and used the research approecher such as statue approach and anality approach. The result of research indicated that there were law disharmony and inconsistent norm toward UUPA because it did not fully elaborated the contains. Many norms overtapped and potentially excluded the communal rights of the indigenous people in using the natural resources were still extremely weak and it caused material and immaterial losses for them.

Abstract:
The problem of inequality related to wages for workers in a society that we often encounter must be resolved. So, this study aims to determine the effectiveness of the application of the Labor Law on wages of Small and Medium Enterprises workers in the culinary sector in Batam, as well as to see the obstacles that occur in the implementation of wages of Small and Medium Enterprises workers in the culinary sector of Batam City. This reserach is empirical research that is based on events that have occurred in the field regarding the application of the law through a series of observations, interviews with competent government officials, small and medium enterprises in the culinary sector. This research shows that the wages received by most of the Small and Medium Enterprises workers in the culinary sector in Batam City are not feasible, such as the absence of a work agreement as mandated by the Labor Law. This can occur because the Manpower Law does not explicitly accommodate the interests of Small and Medium Enterprises workers in the culinary sector, then the government's lack of awareness in preparing skilled workers, and the low quality of education of workers.

Abstract:
In this era of globalization, everyone is certainly no stranger to fund transfer activities. Transfer of funds is very helpful in community activities, but with the convenience of the facilities provided by the bank, of course there are risks, such as errors in transferring funds. The purpose of this research is to determine the legal knowledge of banking fund transfers and to discuss the legal consequences of errors in bank fund transfers. This research is a normative legal research supported by primary and secondary legal materials. The data collection technique in this research is to record and document. The data analysis technique is to examine books, literature and electronic media related to this research. The results of the reserach explain that UUTD no. 3 of 2011 in Article 1 point 1 regulates the definition of transfer or transfer of funds, namely an activity of transferring funds of a certain amount by the original sender to the recipient who has been mentioned in the order for the transfer of funds until it is received. And based on Article 1360 of the Civil Code, which states: "Whoever knowingly or not, receives something that does not have to be paid to him, must return it to the person who gave it". So that according to civil law, a person is obliged to return funds that are not his right from the results of an error in transferring funds that occur with a note that the bank must be able to clearly prove that the funds are not intended for the person concerned.

Abstract:
This research is analyzing implementation of the rescheduling in Murābaḥah micro financing at Bank Shariah Mandiri, Indonesia. It was found that many Islamic banks in Indonesia are experiencing problems because of non-performing financing and can degrade the performance of the bank. Therefore, the bank implemented the rescheduling of non-performing murābaḥah micro financing not to exceed a predetermined rate of Bank Indonesia at 5%. This research was conducted to find out more about the legal implementation of rescheduling in Murābaḥah micro financing at Bank Shariah Mandiri Branch Dumai. The reserach used data collection methods by observation, interview and library data then analyzed using the inductive, deductive and comparative. The research found that the implementation of rescheduling in Murābaḥah micro-financing at Bank Shariah Mandiri Branch Dumai is not fully in line with the Shariah because there is an Islamic ruling of Syariah National Board of Indonesia that have not been implemented, which the bank parties have been still burdening customers other than the actual cost.

This research has the type of Normative legal research, which has done by examining the library materials or the secondary data. The result for this reserach explain which Presumption Of Guilty is very urgent to be contained on the Eradication Of Corruption Crime Law Policy and it is considered to implement as immediatly. The application of the Presumption Of Guilty theory should be limited only on the evidance step on the trial only. Through the method of reversing the burden of proof, which expected to eliminate the difficulties of Eradication on the Corruption Crime Law Policy which faced during this time. Therefore, it is reasonable if the legislators still desire to contained the reversing of the burden of proof system on the Corruption Crime Law Policy, so it should be able to find out the base of law, which is by making the presumption of guilty to become the foundation or the philosophy which has function as the base of law. Then, level of the principle to be implemented as a norm, so that the policy about the burden of proof can be included on every article clause in the Corruption Crime Law Policy. Legal rules which is in the context of eradicating corruption also should be developed progressively according to the development of times, to reduce the left behind and get lose of current corruption modes nowadays. This study is background to the curiosity of the author regarding the competence of the courts that authored the trial of divorce, in which it is known that the justice in Indonesia under the supreme courtis the common justice, the judicial justice, the military justice and the judiciary of each of the courts has its own jurisdiction in this matter public pretrial and the judicial courts have the same authority in the same way to investigate, prosecute and decide the case of divorce in which the judicial system of religion is consigned to any person who is islamic and a public trial is reserved for people outside of islam then what if the subject is them who after marriage and under the marriage bond of one convert, which court has the authority to prosecute this matter and how the law will result upon the child and treasure of the divorce married couples who after marriage change their religion. The reserach methods adjunct in this study are done by the normatif method, which means that the research is based on studies of laws, govornment regulation, judicial decisions, legal opinions and other books and literature relating to this research. Based on the religio of the marriage that occurs, if the marriage occurs in the islamic religion, then divorce must be based on the rules of islamic law, and in this case, the court of religion is the place.

Abstract:
Law Number 1 of 1946 concerning of Criminal Law is an affirmation made by the government from the enactment of Colonial Law known as Wetboek van Strafrecht (WvS) or widely known as Kitab Undang-Undang Hukum Pidana (KUHP). KUHP itself should be revised with the current condition of the Indonesia. However, the revision of Criminal Law within the draft of KUHP itself consist articles which cause conflict, one of which is the article about insult directed President and/or Vice President of the Indonesia. Wheres, this article is already removed by the Constitutional Court in 2006 under the statementNumber 013/022/PUU-IV/2006. The Governmment and House of Representatives seem to have disobeyed the statement of the Constitutional Court that makes the writer of this journal decides to take the revival of the article of insult to President and/Vice President as the background of the problem of a research. Further analysis will be carried out by the writer regarding the insult of President’s dignity and honor then analyze the policy of reactivating the said article about insult of the leader of the country in RKUHP by central government and House of Representatives. The said article is considered unconstitutional by Constitutional Court (MK) and has been objected to be a part of the RKUHP or articles with the same and similar contents. The process of the analysis will still use the reference from Constitutional Court’s decision and experts’ opinion. This reserach uses juridical normative approach which aim to discover rules and also norms to answer the legal issue being faced so that the solutions of the issue in this research can be made. In this case, the reactivation of the article of insult directed to the leader of the country in RKUHP is not the proper policy to be made because it has a tendency to be used as a tool to silent the people’s voice to criticize the performance of the President and/Vice President.

In this article also contains the online arbitration procedure and also contains about weaknesses and advantages online arbitration as a means of dispute resolution business.This article is an empiric legal research. The location of the research at the BANI Arbitration Center, Jakarta. The specification of this article is the descriptive reserach, which is a research meant to give descriptions concerning research results accompanied by the analysis of the prevailing law. The article approach in this study is the approach of legislation and qualitative approach. This type of article data used include primary and secondary data. Source of research data collection techniques used is field study and literature study. Data analysis technique used in this research is qualitative data analysis technique.The result showed that online arbitration does not conflct with the Act No. 30 of 1999 about Arbitration and Alternative Dispute Resolution. Artikel ini merupakan penelitian hukum empiris. Lokasi penelitian yaitu di Badan Arbitrase Nasional Indonesia, Jakarta. Spesifikasi artikel ini adalah penelitian deskriptif, yaitu penelitian yang dimaksudkan untuk memberikan gambaran tentang hasil penelitian disertai analisa mengenai peraturan perundang-undangan yang berlaku. Pendekatan artikel dalam penelitian ini adalah pendekatan perundang-undangan dan pendekatan kualitatif. Jenis data artikel yang digunakan meliputi data primer dan data sekunder. Teknik pengumpulan sumber data penelitian yang digunakan yaitu studi lapangan dan studi kepustakaan. Teknik analisis data yang digunakan dalam penelitian ini adalah teknik analisis data kualitatif. Hasil penelitian menunjukkan bahwa arbitrase online tidak bertentangan dengan Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa. In this way, companies that practice this type of activity reduce their operational labor costs, payment of taxes and increase the profit margin, bringing economic and mainly social impacts to both the worker and society, a qualitative reserarch with the meatpacking segment, one of the sectors in the country where part of this harmful practice converges in society.

On 16 Juni 2023, the new government amended the previous law on Taxation and Redistributing Districts (BPHTB) to include all rights of land and property (exchange, grant, inheritance, land income into the company, etc.). The aim is to optimize the distribution of land through BPHTB. Abstract:
The crime of immorality began when a young man in Jambuwok Village, Trowulan District, committed acts that were considered to violate the norms of social good faith. A young man (AS) often peeked and stole his underwear and disturbed nearby citizens. These events were resolved in a restorative juctice manner by peaceful means. This type of research is field research (field reserch) with data search for the application of restorative justice in cases of verbal sexual violence. This study is the result of a study of an empirical juridical approach that aims to study and analyze the function of law in society that is manifested in the legal behavior of society. The case approach aims to study between legal theory and practice in the implementation of positive law regarding restorative juctice in cases of sexual harassment. All parties involved in the matter. The process of resolving immoral crimes committed in Trowulan is mediated by the village head, in accordance with the concept of restorative justice, namely through deliberations with all parties to maintain a sense of justice. It ended peacefully without hurting anyone.

The topic of this scientific work is placed in the domain of social anomie. The effects of the action of informal forms of social anomie cause social entropy and indicate the permanent topicality of the topic. Social anomie destroys social processes, devalues institutions and devastates the fundamental values on which the community rests, so the social significance of research is unquestionable. Scientific justification is contained in the need to shed light on phenomena and processes from the domain of social pathology. The aim of the research is to define, classify, sistematize the observed phenomena and to offer optimal solutions to overcome them. The work for the Subject of reserch has: discovering the forms of social anomie, pointing out the harmful effects of these informal forms of social behavior, as well as proposing solutions to overcome the resulting situation in order to remove the harmful effects. In their work, the authors start from: the observation method, the development method, the comparative approach, the cross-cultural method, and the numerous methods of legal sciences. The subject framework of the research moves in the area of: sociology, social pathology, political and legal sciences. We have explained the logic of various forms of institutional action that cause social anomie and violate the basic rules of behavior on which a community rests. Anomic conditions point to illegal activity and violation of basic legal acts. And yet, social anomie goes beyond legal frameworks, pointing to the lack of social rules in regulating social relations that escape legal sanctions. Therefore, it is important to have a collective consciousness, which, among other things, distinguishes the value and moral elements of a community. Public opinion, public pressure, sense of responsibility, institutional procedures, as well as the rule of law, direct actors-in-situation towards those behaviors that significantly reduce anomic conditions.

Abstract:
A plot of land has an important meaning and role in human life. Indonesian government has legal authority in land as it is specified in Law No. 5/1960 on Basic Regulation of Agrarian Affairs. Land Certification is used to create legal certainty in land by organizing land registration and providing certificate as evidence. There many plots of land which have not been registered such as tanah ulayat (village land), especially in Sumatera Barat Province where the majority of its people is Minangkabaunese. The reserch problems are how about the process registering tanah pusako tinggi (ancestral land) by the adat (traditional) community, how about its legal consequences, and how about its obstacles. The research used juridical normative method. Primarv data were gathered by conducting interview and secondary data were obtained from library research such as from books, journals, and electronic media. Certification of tanah pusako tinggi has the same procedure as the other land certification which is referred to the Directive of the Head of the National Land Agency No. 1/2010 on the Standard of Land Service and Regulation. However, there are some things which distinguish them from land registration in general. One of them is the right which is attached to the land is communal right. The certification causes the recognition of land rights and anything related to the control, handing out, expiration, and land acquisition as well as legal certainty on the ancestral land. Some obstacles found in the process of certification are varied, viewed from the government's few point, the internal and external factors and the people. The government has also attempted to handle the obstacles in registering tanah pusako tinggi.

Abstract:
The Women's Cooperative (KOPWAN) Bina Citra Wanita is a legal entity cooperative that has a savings and loan business unit. KOPWAN is a form of joint effort based on the principles of kinship and mutual cooperation. However, problems arise when it comes to providing precise and accurate financial reports, in accordance with SAK ETAP (Financial Accounting Standards for Entities Without Public Accountability). These activities require extra work from KOPWAN administrators who double as housewives. This often creates conflicts of its own in dividing the time because the financial statements made are still using conventional methods. This condition is not balanced with the increasing number of activities because the number of members served is increasing. The purpose of this study will be to examine the extent to which the implementation of computerized-based financial reporting with accounting software can improve the quality of KOPWAN financial report information. This study uses an action research approach. The results of the study indicate that Accounting Software is quite effective and efficient in helping management make financial reports quickly, precisely and accurately and reduce fraud. In addition, it is able to save time and energy so that it does not interfere with the activities of mothers in carrying out domestic and public activities. Transparency of service is very important for government agencies in the provision of public services, because with the transparency of services so the public can easily find information or access about procedures in services provided olen government agencies. This study aims to describe, measure and analyze the Transparency of Public Service in the Office of Investment and Service of One Door of Bone Regency. This research is a qualitative research, approach method used is approach (social legal reserarch), data collection is done through interview, observation and documentation to informant in applying of transparency of public service. data analysis includes data reduction, data presentation and conclusion. The results of the research show that the application of transparency of the One Bint Department of Investment and Service Bone District has not been fully implemented in the indicator of service transparency expected by the service recipients such as Authorized and Responsible Officials there are still some authorities who have not yet fully know what they should do so much training is needed that can encourage transparency. Constraints faced by the internet network factors are not adequate so slow in the process of service delivery.

Tax aggressiveness is an action to engineer taxable income, whether legal (tax avoidance) or illegal (tax evasion). Companies conduct aggressive taxation because taxes are considered to reduce costs and increase company profits. The main goal of this research is to investigate the affect of capital intensity, leverage, and political connections on tax aggressiveness in mining sector companies were listed on the Indonesia Stock Exchange (IDX) from 2017 to 2021, both simultaneously and partially. The data analysis method used in this research is panel data regression using E-views software. The method used in this research is quantitative technique using secondary data. The population used in this research is mining sector companies were listed on the Indonesia Stock Exchange (IDX), and the sampling technique used in this research is purposive sampling with the acquisition of 10 companies in a 5-year period so that there are 50 samples that will be processed by researchers. According to the findings of the reserch, capital intensity, leverage, and political connections all have an impact on tax aggression. While partially affecting capital intensity, leverage and political connections have no significant effect on tax aggressiveness

Desde la existencia de una legislación especial para cooperativas el legislador consideró que las cooperativas como personas jurídicas sin ánimo de lucro estaban exoneradas del pago del Impuesto de la Renta. Esa norma ha estado acompañada por un régimen de reservas legales o fondos cooperativos dedicados a reserva legal, reserva de educación y reserva de bienestar social. Tales reseras obtienen sus fondos de las operaciones de las cooperativas en su ejercicio económico, cada año. Sin embargo, la falta de desarrollo de una cultura basada en los Valores y Principios Cooperativos y del Derecho Cooperativo ha llevado a funcionarios públicos y diputados a buscar medios para legales para obligar a las cooperativas al pago del impuesto sobre la renta, sin éxito porque siempre ha imperado la naturaleza jurídica de las cooperativas como organizaciones económico-sociales cuyo principal objetivo no es lucro sino el bienestar económico-social de sus miembros. Наличие более совершенных институтов облегчает многие аспекты экономики. Но это обстоятельство, принимая во внимание другие факторы, может привести к постепенному снижению его эффективности в продвижении инноваций. Предлог, стоящий за этим, заключается в том, что зрелые институты увеличивают затраты бизнеса на соблюдение требований законодательства. Ввиду этого правительства многих стран пытаются найти подходящий подход к вмешательству для поощрения инноваций. Данное исследование направлено на оценку нелинейного влияния развития институционального качества на инновации. Результаты, полученные в рамках данного исследования с использованием панельной модели выполнимых обобщенных наименьших квадратов, подтверждает актуальность кривой Кузнеца инновационно-институционального качества для четырех групп стран, разделенных в соответствии с их уровнем развития по индексу развития человеческого капитала: высокоразвитая, развитая, развивающаяся, низкоразвитая. Исследование показало, что во всех группах стран наблюдается обратная U-образная зависимость между развитием институционального качества и инновациями, что указывает на предлог обременительного воздействия нормативных актов. Кроме того, это бремя облегчается с повышением уровня экономического развития, поскольку кривая в странах из низкоразвитой группы изгибается выше по сравнению со странами из высокоразвитой группы. Modernized institutions facilitates many aspects of the economy. But this circumstance, taking into account other factors, may lead to a gradual decrease in its effectiveness in promoting innovation. The pretext behind this is that mature institutions increase the costs of businesses to comply with legal requirements. In view of this, many Governments are trying to find an appropriate approach to intervention to encourage innovation. This study is aimed at assessing the nonlinear impact of the development of institutional quality on innovation. The results obtained within the framework of this study using a panel model of feasible generalized least squares confirm the relevance of the Kuznets curve of innovation and institutional quality for four groups of countries divided according to their level of development according to the human capital development index: highly developed, developed, developing, low-developed. The study showed that in all groups of countries there is an inverse U-shaped relationship between the development of institutional quality and innovation, which indicates the pretext of burdensome impact of regulations. In addition, this burden is relieved with an increase in the level of economic development, since the curve in countries from the low-developed group bends higher compared to countries from the highly developed group.

This thesis described the establishment of judge in Limboto Religious Caurt in adjudicating marriage dispentation proposal. The proposal was requested by the parents for the children�s underage marriage, while in marriage law chapter 7 says that the marriage can be arranged at the age of 19 years old for men and 16yeras for women. Meanwhile, chilidren under 18 years old should have protection on thair rights and welfare as stated in Child Protection Law. Therefore, this research was conducted based on big concern on violation of chiledren�s rights. In this research, the researcher discussed problems on 1) how the judges considered the marriage dispentation proposal in Limboto Religious Caourt? And 2) how the judges determined the marriage dispensation proposal? This thesis was conducted through fielld research by means a research done in a particuler location ar area, and in this case it was located in Limboto Religious Court. This research used descriptive �analytic mathod where the problem of research was solved by describing and analytic it through data collection, composition, data analysis, data presentation and assessment on the reserch problem. The result showed that the implementation of marriage dispensation in Limboto Religious Court is relevant with legal substanceof child protection law as well as marriage law number 1 of 1974 in which it is based on principile of the law, it also prioritizes welfare of the chilidren who are mature enough ini building a new family. Those children in marriage dispensation have met standrs in child protection that puts forward the regulation�s best principle, the right to live, and appreciation for the children. Therefore, the marriage dispensation in Limboto Religious Caourt is not contradictory to the child protection law.

The purpose of this research is to know what the change condition charateristic (rebus sic stantibus) in the implementation of contract as a diffrentiation with state of emergency (force majeure). Research method is juridical normative where a legal reserach procedure to discover truth base on logical law from nomative side. The result of this research that the change condition charateristic (Rebus Sic Stantibus) in the implementation of contract as a diffrentiation with state of emergency (Force Majeure) is in the implementation of contract imposibble to do it because of the legal reason, avoid economic trouble or economic imposibility, whereas in Rebus Sic Stantibus, the reason why the contract is not implemented because the contractual implementation is too difficult to do it, so include economic imposibility. Therefore, difficult level of Rebus Sic Stantibus is under Force Majeure.

The Indonesian government has made various efforts to suppress the massive corruptive behavior in Indonesia, both through means of law enforcement and prevention, but this has not had a significant impact in reducing the crime rate of corruption and providing a deterrent effect to the corruptors, because every year data on handling cases of corruption crimes in Indonesia tends to increase. The pattern of combating corruption has changed, law enforcement officials no longer only pursue criminal offenders and imprison them (follow the suspect), but also carry out efforts to trace, confiscate and for feit all assets that are the proceeds and instruments of criminal acts (follow the money). Various obstacles arise in efforts to seize assets that are the proceeds or instruments of criminal acts, one of which is the absence of legal rules governing the mechanism for the seizure of assets resulting from gratification crimes in cases that are stopped by law. The method used in this research is normative legal research, using a statutory approach (statue approach) and Court Decisions. This reserach aims to examine and formulate an ideal criminal law policy in the seizure of confiscated objects in the form of assets of gratification suspects whose cases are stopped for the sake of law in the future. The results in this research show that asset seizure in the eradication of corruption currently still places asset seizure as an additional crime so that asset seizure is still based on the defendant's guilt (conviction based asset forfeiture), in addition to through the criminal mechanism of asset forfeiture can also be done through civil mechanisms with the concept of non-conviction based asset forfeiture, but there is no rule governing the asset forfeiture mechanism proceeds of gratification in cases that are stopped by law. The criminal policy of asset seizure in the future based on the Asset Forfeiture Bill related to Criminal Acts with the concept (non-conviction-based asset forfeiture) has clearly regulated the mechanism for the seizure of assets belonging to Suspects or Defendants who died, escaped, became permanently ill, or whose whereabouts are unknown, so as to overcome the legal vacuum in terms of seizure of assets resulting from gratification crimes in cases that are stopped by law.

During the Covid-19 health emergency, telemedicine was an essential asset through which health systems strengthened their response during the critical phase of the pandemic. According to the post-pandemic economic reform plans of many countries, telemedicine will not be limited to a tool for responding to an emergency condition but it will become a structural resource that will contribute to the reorganization of Healthcare Systems and enable the transfer of part of health care from the hospital to the home-based care. However, scientific evidences have shown that health care delivered through telemedicine can be burdened by numerous ethical and legal issues. Although there is an emerging discussion on patient safety issues related to the use of telemedicine, there is a lack of reseraches specifically designed to investigate patient safety. On the contrary, it would be necessary to determine standards and specific application rules in order to ensure safety. This paper examines the telemedicine-risk profiles and proposes a position statement for clinical risk management to support continuous improvement in the safety of health care delivered through telemedicine.
