Abstract:
Legal pluralism, as a way of thinking about law, is the seemingly straightforward idea that there is a range of normative orders, which are independent from the state and can be properly described as legal without committing any conceptual mistake. Without giving a full survey of the long and varied history of legal pluralism theory, this article will discuss some central moments in that history. It will focus specifically on the question whether it is possible and useful to capture law as conceptually separate from other normative phenomena so as to speak of specifically legal pluralism or whether it is best to take a panlegalist approach and not draw any clear distinctions between law and other instances of social normativity.

Abstract:
Legal pluralism involves the coexistence of multiple forms of law. This includes state law, international law, transnational law, customary law, religious law, indigenous law, and the law of distinct ethnic or cultural communities. Legal pluralism is a subject of discussion today in legal anthropology, legal sociology, legal history, comparative law, international law, transnational law, jurisprudence, and law and development scholarship. This book places legal pluralism in historical context going back to the Medieval period, describes the origins of legal pluralism in postcolonial countries and its implications today, identifies manifestations of legal pluralism within Western societies, discusses contemporary transnational legal pluralism, identifies problems with current theoretical accounts of legal pluralism, and articulates an approach to legal pluralism that avoids theoretical problems and is useful for social scientists, theorists, and law and development scholars and practitioners.

Abstract:
The Roman Empire systematically recognised alien polities in provincial landscapes and allowed them local powers of jurisdiction and legislation. It also created conditions of heightened human mobility and regularly endowed aliens with Roman citizenship. This chapter explores the procedural and theoretical resources developed by Roman authorities to deal with the conflicts of law that resulted from these processes. It explores principles governing choice of law, to wit, those of personality and territoriality. It also investigates procedural mechanisms that temporarily bracketed distinctions that rendered actions non-justiciable, for example, the legal fiction that assimilated aliens to citizens for the purposes of dispute resolution.
