Abstract:
Globally there is a shortage of organs available for transplant resulting in thousands of lives lost as a result. Recently in the United Kingdom 457 people died as a result of organ shortage in just 1 year. 1 NHS Blood and Transplant suggest national debates to test public attitudes to radical actions to increase organ donation should be considered in addressing organ shortage. The selling of organs for transplant in the United Kingdom is prohibited under the Human Tissue Act 2004. This discussion paper considers five ethical objections raised in the United Kingdom to paid donation and discusses how these objections are addressed within the only legal and regulated paid living unrelated renal donation programme in the world in Iran, where its kidney transplant list was eliminated within 2 years of its commencement. This article discusses whether paid living unrelated donation in Iran increases riskier donations and reduced altruistic donation as opponents of paid donation claim. The paper debates whether objections to paid donation based upon commodification arguments only oppose enabling financial ends, even if these ends enable beneficent acts. Discussions in relation to whether valid consent can be given by the donor will take place and will also debate the objection that donors will be coerced and exploited by a paid model. This article suggests that exploitation of the paid donor within the Iranian model exists within the legally permitted framework. However, paid living kidney donation should be discussed further and other models of paid donation considered in the United Kingdom as a radical means of increasing donation.

Abstract:
The legal status of the human body is hotly contested, yet the law of the body remains in a state of confusion and chaos. Sometimes the body is treated as an object of property, sometimes it is dealt with under the rubric of contract, and sometimes it is not conceived as property at all, but rather as the subject of privacy rights. Which body of law should become the law of the body? This question is even more pressing in the context of current biomedical research, which permits commodification and commercialization of the body by everyone except the person who provides the “raw materials.” The lack of property protection for tangible parts of the human body is in stark contrast to the extensive protection granted to intellectual property in the body in the form of patents upon human genes and cell lines. Moreover, even courts that reject ownership claims on the part of those who supply body parts appear willing to grant property rights to scientists, universities, and others who use those body parts to conduct research and create products.

Abstract:
From an apparent impasse and crisis in the 1970s and 1980s – politically and intellectually – Marxism has recovered to offer critical insights into contemporary changes and developments in late capitalist societies. Sexuality has been one area where Marxist critiques of commodification and consumption, reification, cultural production and its hegemonic effects and the structures of feeling and meaning-making that compose contemporary subjectivities have been of significant value in decoding legal, political and cultural changes in the regulation, prohibition and propagation of forms of sex and sexuality. This discussion will draw from some of the most important contributions to Marxist critiques of sexuality, contemporary and historical, to outline the contours of a critique of contemporary sexuality in society, notably Peter Drucker, Holly Lewis, Rosemary Hennessy, David Evans, and Keith Floyd. The Marxist critique of contemporary sexual politics and rights claims both recognises the importance of these struggles and provides a materialist critique that demonstrates both the contemporary power of Marxist analysis and a critical engagement with queer and constructionist “orthodoxies”. Marxism has become a central and important ground for exploring the vagaries of sexuality under capitalism in all its objectifying, commodifying, alienating and exploitative forms.

Abstract:
Background Commercial surrogacy in India has become an increasingly controversial human rights and global health issue. Indian women living in dire poverty are the most vulnerable group in this transnational phenomenon. Reproductive tourism can be defined as the process whereby affluent people predominately from Global North countries (i.e., Canada) seek assisted reproduction in the Global South (in this case, India), to accomplish fertility and kinship formation goals while remaining oblivious to the inevitable social issues associated with this international trade. Objective This paper investigates how the media and academic anthropological research present current understandings of biotechnology, family, and kinship regarding commercial surrogacy. I argue that reproductive tourism is a multifaceted social issue with significant socio-cultural implications for kinship in India and the Global North, by being rooted in a gendered division of labour, culturally-specific belief systems, technological advancement, race and class stratification, capitalist structures, and globalization. Methods Although reproductive tourism is indeed interdisciplinary in nature, this project explicitly took an anthropological and global health approach to understanding its impacts on kinship in local and global communities. With regards to researcher positionality, I played an outsider role in understanding Indian women and the cultural context in India. I critically and reflexively analyzed diverse media sources that offered insights on reproductive tourism in India within the domains outlined in my thesis statement. These media sources were found online, and included mainstream media outlets, news articles, articles by journalists and social activists, websites for organizations of interest, corporate sources, blogs, videos, documentaries, and images. I used scholarly articles in anthropology as ethnographic evidence to support, challenge, or extend claims reported by the media. Academic sources included peer-reviewed publications, books, open access materials, grey literature, academic websites, and legal documents. I qualitatively compared and contrasted the presented narratives to conduct a secondary analysis of scholarly literature and media reports, and constructed valid arguments about the current state of reproductive tourism in India. Results The commodification of reproductive labour has had vast impacts on the cultural meanings of kinship in India and Global North countries. Reproductive tourism in India is evidence that culture influences biological, reproductive, and technological processes and how they are perceived in contemporary times. Technology and globalization were found to be propellers of commercial surrogacy that transcend international borders. Expectations related to family formation and gender within Western contexts, and Western forms of kinship contribute to the commercial surrogacy industry. Reproductive tourism perpetuates hierarchies along the lines of race and class, and Indian women face exploitation and serious health risks despite being paid for their reproductive labour. Conclusion Transnational surrogacy must be perceived by governments as a public matter rather than a private one, in order to adequately derive holistic solutions to halt the exploitation of vulnerable Indian women while balancing the desire of infertile individuals to utilize surrogacy as a means of kinship formation. Update This research paper was written in March 2018. As of December 2018, commercial surrogacy is illegal in India. The Surrogacy (Regulation) Act, 2018 is an attempt by the Indian government to control the industry and associated issues such as the exploitation of poor women and unprecedented health consequences. This law and policy shift by the Indian government affirms the importance of this research.

Abstract For two decades, economic agents have been investing in the personal data-driven industry on the assumption that courts, the keepers of the legal systems, would have backed their claims, turning their technological control of personal data into legally protected property rights. Courts' backing has proved only temporary as they are now revising early solutions by constraining collection, use, and trade of personal data to protect the hierarchically superior rights. The theory of ‘legal bubbles’ rationalizes the economics underlying the legal shockwaves affecting the personal data-driven economy. ‘Legal bubbles’ tend to arise when economic agents invest in the economic exploitation of a new resource in a context of uncertainty and ignorance about the legal implications of innovative activities. These legal foundations may eventually turn out to be unstable as a result of courts' ex-post attempt to re-adapt them to the previously ignored implications of unconstrained commodification, with disruptive economic consequences.

Abstract:
I first came across etoy in Linz, Austria in 1995. They turned up at Ars Electronica with their shaved heads, in their matching orange bomber jackets. They were not invited. The next year they would not have to crash the party. In 1996 they were awarded Arts Electronica’s prestigious Golden Nica for web art, and were on their way to fame and bitterness – the just rewards for their art of self-regard. As founding member Agent.ZAI says: “All of us were extremely greedy – for excitement, for drugs, for success.” (Wishart & Boschler: 16) The etoy story starts on the fringes of the squatters’ movement in Zurich. Disenchanted with the hard left rhetorics that permeate the movement in the 1980s, a small group look for another way of existing within a commodified world, without the fantasy of an ‘outside’ from which to critique it. What Antonio Negri and friends call the ‘real subsumption’ of life under the rule of commodification is something etoy grasps intuitively. The group would draw on a number of sources: David Bowie, the Sex Pistols, the Manchester rave scene, European Amiga art, rumors of the historic avant gardes from Dada to Fluxus. They came together in 1994, at a meeting in the Swiss resort town of Weggis on Lake Lucerne. While the staging of the founding meeting looks like a rerun of the origins of the Situationist International, the wording of the invitation might suggest the founding of a pop music boy band: “fun, money and the new world?” One of the – many – stories about the origins of the name Dada has it being chosen at random from a bilingual dictionary. The name etoy, in an update on that procedure, was spat out by a computer program designed to make four letter words at random. Ironically, both Dada and etoy, so casually chosen, would inspire furious struggles over the ownership of these chancey 4-bit words. The group decided to make money by servicing the growing rave scene. Being based in Vienna and Zurich, the group needed a way to communicate, and chose to use the internet. This was a far from obvious thing to do in 1994. Connections were slow and unreliable. Sometimes it was easier to tape a hard drive full of clubland graphics to the underside of a seat on the express train from Zurich to Vienna and simply email instructions to meet the train and retrieve it. The web was a primitive instrument in 1995 when etoy built its first website. They launched it with a party called etoy.FASTLANE, an optimistic title when the web was anything but. Coco, a transsexual model and tabloid sensation, sang a Japanese song while suspended in the air. She brought media interest, and was anointed etoy’s lifestyle angel. As Wishart and Bochsler write, “it was as if the Seven Dwarfs had discovered their Snow White.” (Wishart & Boschler: 33) The launch didn’t lead to much in the way of a music deal or television exposure. The old media were not so keen to validate the etoy dream of lifting themselves into fame and fortune by their bootstraps. And so etoy decided to be stars of the new media. The slogan was suitably revised: “etoy: the pop star is the pilot is the coder is the designer is the architect is the manager is the system is etoy.” (Wishart & Boschler: 34) The etoy boys were more than net.artists, they were artists of the brand. The brand was achieving a new prominence in the mid-90s. (Klein: 35) This was a time when capitalism was hollowing itself out in the overdeveloped world, shedding parts of its manufacturing base. Control of the circuits of commodification would rest less on the ownership of the means of production and more on maintaining a monopoly on the flows of information. The leading edge of the ruling class was becoming self-consciously vectoral. It controlled the flow of information about what to produce – the details of design, the underlying patents. It controlled the flows of information about what is produced – the brands and logos, the slogans and images. The capitalist class is supplanted by a vectoral class, controlling the commodity circuit through the vectors of information. (Wark) The genius of etoy was to grasp the aesthetic dimension of this new stage of commodification. The etoy boys styled themselves not so much as a parody of corporate branding and management groupthink, but as logical extension of it. They adopted matching uniforms and called themselves agents. In the dada-punk-hiphop tradition, they launched themselves on the world as brand new, self-created, self-named subjects: Agents Zai, Brainhard, Gramazio, Kubli, Esposto, Udatny and Goldstein. The etoy.com website was registered in 1995 with Network Solutions for a $100 fee. The homepage for this etoy.TANKSYSTEM was designed like a flow chart. As Gramazio says: “We wanted to create an environment with surreal content, to build a parallel world and put the content of this world into tanks.” (Wishart & Boschler: 51) One tank was a cybermotel, with Coco the first guest. Another tank showed you your IP number, with a big-brother eye looking on. A supermarket tank offered sunglasses and laughing gas for sale, but which may or may not be delivered. The underground tank included hardcore photos of a sensationalist kind. A picture of the Federal Building in Oklamoma City after the bombing was captioned in deadpan post-situ style “such work needs a lot of training.” (Wishart & Boschler: 52) The etoy agents were by now thoroughly invested in the etoy brand and the constellation of images they had built around it, on their website. Their slogan became “etoy: leaving reality behind.” (Wishart & Boschler: 53) They were not the first artists fascinated by commodification. It was Warhol who said “good art is good business.”(Warhol ) But etoy reversed the equation: good business is good art. And good business, in this vectoral age, is in its most desirable form an essentially conceptual matter of creating a brand at the center of a constellation of signifiers. Late in 1995, etoy held another group meeting, at the Zurich youth center Dynamo. The problem was that while they had build a hardcore website, nobody was visiting it. Agents Gooldstein and Udatny thought that there might be a way of using the new search engines to steer visitors to the site. Zai and Brainhard helped secure a place at the Vienna Academy of Applied Arts where Udatny could use the computer lab to implement this idea. Udatny’s first step was to create a program that would go out and gather email addresses from the web. These addresses would form the lists for the early examples of art-spam that etoy would perpetrate. Udatny’s second idea was a bit more interesting. He worked out how to get the etoy.TANKSYSTEM page listed in search engines. Most search engines ranked pages by the frequency of the search term in the pages it had indexed, so etoy.TANKSYSTEM would contain pages of selected keywords. Porn sites were also discovering this method of creating free publicity. The difference was that etoy chose a very carefully curated list of 350 search terms, including: art, bondage, cyberspace, Doom, Elvis, Fidel, genx, heroin, internet, jungle and Kant. Users of search engines who searched for these terms would find dummy pages listed prominently in their search results that directed them, unsuspectingly, to etoy.com. They called this project Digital Hijack. To give the project a slightly political aura, the pages the user was directed to contained an appeal for the release of convicted hacker Kevin Mitnick. This was the project that won them a Golden Nica statuette at Ars Electronica in 1996, which Gramazio allegedly lost the same night playing roulette. It would also, briefly, require that they explain themselves to the police. Digital Hijack also led to the first splits in the group, under the intense pressure of organizing it on a notionally collective basis, but with the zealous Agent Zai acting as de facto leader. When Udatny was expelled, Zai and Brainhard even repossessed his Toshiba laptop, bought with etoy funds. As Udatny recalls, “It was the lowest point in my life ever. There was nothing left; I could not rely on etoy any more. I did not even have clothes, apart from the etoy uniform.” (Wishart & Boschler: 104) Here the etoy story repeats a common theme from the history of the avant gardes as forms of collective subjectivity. After Digital Hijack, etoy went into a bit of a slump. It’s something of a problem for a group so dependent on recognition from the other of the media, that without a buzz around them, etoy would tend to collapse in on itself like a fading supernova. Zai spend the early part of 1997 working up a series of management documents, in which he appeared as the group’s managing director. Zai employed the current management theory rhetoric of employee ‘empowerment’ while centralizing control. Like any other corporate-Trotskyite, his line was that “We have to get used to reworking the company structure constantly.” (Wishart & Boschler: 132) The plan was for each member of etoy to register the etoy trademark in a different territory, linking identity to information via ownership. As Zai wrote “If another company uses our name in a grand way, I’ll probably shoot myself. And that would not be cool.” (Wishart & Boschler:: 132) As it turned out, another company was interested – the company that would become eToys.com. Zai received an email offering “a reasonable sum” for the etoy.com domain name. Zai was not amused. “Damned Americans, they think they can take our hunting grounds for a handful of glass pearls….”. (Wishart & Boschler: 133) On an invitation from Suzy Meszoly of C3, the etoy boys traveled to Budapest to work on “protected by etoy”, a work exploring internet security. They spent most of their time – and C3’s grant money – producing a glossy corporate brochure. The folder sported a blurb from Bjork: “etoy: immature priests from another world” – which was of course completely fabricated. When Artothek, the official art collection of the Austrian Chancellor, approached etoy wanting to buy work, the group had to confront the problem of how to actually turn their brand into a product. The idea was always that the brand was the product, but this doesn’t quite resolve the question of how to produce the kind of unique artifacts that the art world requires. Certainly the old Conceptual Art strategy of selling ‘documentation’ would not do. The solution was as brilliant as it was simple – to sell etoy shares. The ‘works’ would be ‘share certificates’ – unique objects, whose only value, on the face of it, would be that they referred back to the value of the brand. The inspiration, according to Wishart & Boschsler, was David Bowie, ‘the man who sold the world’, who had announced the first rock and roll bond on the London financial markets, backed by future earnings of his back catalogue and publishing rights. Gramazio would end up presenting Chancellor Viktor Klima with the first ‘shares’ at a press conference. “It was a great start for the project”, he said, “A real hack.” (Wishart & Boschler: 142) For this vectoral age, etoy would create the perfect vectoral art. Zai and Brainhard took off next for Pasadena, where they got the idea of reverse-engineering the online etoy.TANKSYSTEM by building an actual tank in an orange shipping container, which would become etoy.TANK 17. This premiered at the San Francisco gallery Blasthaus in June 1998. Instant stars in the small world of San Francisco art, the group began once again to disintegrate. Brainhard and Esposito resigned. Back in Europe in late 1998, Zai was preparing to graduate from the Vienna Academy of Applied Arts. His final project would recapitulate the life and death of etoy. It would exist from here on only as an online archive, a digital mausoleum. As Kubli says “there was no possibility to earn our living with etoy.” (Wishart & Boschler: 192) Zai emailed eToys.com and asked them if them if they would like to place a banner ad on etoy.com, to redirect any errant web traffic. Lawyers for eToys.com offered etoy $30,000 for the etoy.com domain name, which the remaining members of etoy – Zai, Gramazio, Kubli – refused. The offer went up to $100,000, which they also refused. Through their lawyer Peter Wild they demanded $750,000. In September 1999, while etoy were making a business presentation as their contribution to Ars Electronica, eToys.com lodged a complaint against etoy in the Los Angeles Superior Court. The company hired Bruce Wessel, of the heavyweight LA law firm Irell & Manella, who specialized in trademark, copyright and other intellectual property litigation. The complaint Wessel drafted alleged that etoy had infringed and diluted the eToys trademark, were practicing unfair competition and had committed “intentional interference with prospective economic damage.” (Wishart & Boschler: 199) Wessel demanded an injunction that would oblige etoy to cease using its trademark and take down its etoy.com website. The complaint also sought to prevent etoy from selling shares, and demanded punitive damages. Displaying the aggressive lawyering for which he was so handsomely paid, Wessel invoked the California Unfair Competition Act, which was meant to protect citizens from fraudulent business scams. Meant as a piece of consumer protection legislation, its sweeping scope made it available for inventive suits such as Wessel’s against etoy. Wessel was able to use pretty much everything from the archive etoy built against it. As Wishart and Bochsler write, “The court papers were like a delicately curated catalogue of its practices.” (Wishart & Boschler: 199) And indeed, legal documents in copyright and trademark cases may be the most perfect literature of the vectoral age. The Unfair Competition claim was probably aimed at getting the suit heard in a Californian rather than a Federal court in which intellectual property issues were less frequently litigated. The central aim of the eToys suit was the trademark infringement, but on that head their claims were not all that strong. According to the 1946 Lanham Act, similar trademarks do not infringe upon each other if there they are for different kinds of business or in different geographical areas. The Act also says that the right to own a trademark depends on its use. So while etoy had not registered their trademark and eToys had, etoy were actually up and running before eToys, and could base their trademark claim on this fact. The eToys case rested on a somewhat selective reading of the facts. Wessel claimed that etoy was not using its trademark in the US when eToys was registered in 1997. Wessel did not dispute the fact that etoy existed in Europe prior to that time. He asserted that owning the etoy.com domain name was not sufficient to establish a right to the trademark. If the intention of the suit was to bully etoy into giving in, it had quite the opposite effect. It pissed them off. “They felt again like the teenage punks they had once been”, as Wishart & Bochsler put it. Their art imploded in on itself for lack of attention, but called upon by another, it flourished. Wessel and eToys.com unintentionally triggered a dialectic that worked in quite the opposite way to what they intended. The more pressure they put on etoy, the more valued – and valuable – they felt etoy to be. Conceptual business, like conceptual art, is about nothing but the management of signs within the constraints of given institutional forms of market. That this conflict was about nothing made it a conflict about everything. It was a perfectly vectoral struggle. Zai and Gramazio flew to the US to fire up enthusiasm for their cause. They asked Wolfgang Staehle of The Thing to register the domain toywar.com, as a space for anti-eToys activities at some remove from etoy.com, and as a safe haven should eToys prevail with their injunction in having etoy.com taken down. The etoy defense was handled by Marcia Ballard in New York and Robert Freimuth in Los Angeles. In their defense, they argued that etoy had existed since 1994, had registered its globally accessible domain in 1995, and won an international art prize in 1996. To counter a claim by eToys that they had a prior trademark claim because they had bought a trademark from another company that went back to 1990, Ballard and Freimuth argued that this particular trademark only applied to the importation of toys from the previous owner’s New York base and thus had no relevance. They capped their argument by charging that eToys had not shown that its customers were really confused by the existence of etoy. With Christmas looming, eToys wanted a quick settlement, so they offered Zurich-based etoy lawyer Peter Wild $160,000 in shares and cash for the etoy domain. Kubli was prepared to negotiate, but Zai and Gramazio wanted to gamble – and raise the stakes. As Zai recalls: “We did not want to be just the victims; that would have been cheap. We wanted to be giants too.” (Wishart & Boschler: 207) They refused the offer. The case was heard in November 1999 before Judge Rafeedie in the Federal Court. Freimuth, for etoy, argued that federal Court was the right place for what was essentially a trademark matter. Robert Kleiger, for eToys, countered that it should stay where it was because of the claims under the California Unfair Competition act. Judge Rafeedie took little time in agreeing with the eToys lawyer. Wessel’s strategy paid off and eToys won the first skirmish. The first round of a quite different kind of conflict opened when etoy sent out their first ‘toywar’ mass mailing, drawing the attention of the net.art, activism and theory crowd to these events. This drew a report from Felix Stalder in Telepolis: “Fences are going up everywhere, molding what once seemed infinite space into an overcrowded and tightly controlled strip mall.” (Stalder ) The positive feedback from the net only emboldened etoy. For the Los Angeles court, lawyers for etoy filed papers arguing that the sale of ‘shares’ in etoy was not really a stock offering. “The etoy.com website is not about commerce per se, it is about artist and social protest”, they argued. (Wishart & Boschler: 209) They were obliged, in other words, to assert a difference that the art itself had intended to blur in order to escape eToy’s claims under the Unfair Competition Act. Moreover, etoy argued that there was no evidence of a victim. Nobody was claiming to have been fooled by etoy into buying something under false pretences. Ironically enough, art would turn out in hindsight to be a more straightforward transaction here, involving less simulation or dissimulation, than investing in a dot.com. Perhaps we have reached the age when art makes more, not less, claim than business to the rhetorical figure of ‘reality’. Having defended what appeared to be the vulnerable point under the Unfair Competition law, etoy went on the attack. It was the failure of eToys to do a proper search for other trademarks that created the problem in the first place. Meanwhile, in Federal Court, lawyers for etoy launched a counter-suit that reversed the claims against them made by eToys on the trademark question. While the suits and counter suits flew, eToys.com upped their offer to settle to a package of cash and shares worth $400,000. This rather puzzled the etoy lawyers. Those choosing to sue don’t usually try at the same time to settle. Lawyer Peter Wild advised his clients to take the money, but the parallel tactics of eToys.com only encouraged them to dig in their heels. “We felt that this was a tremendous final project for etoy”, says Gramazio. As Zai says, “eToys was our ideal enemy – we were its worst enemy.” (Wishart & Boschler: 210) Zai reported the offer to the net in another mass mail. Most people advised them to take the money, including Doug Rushkoff and Heath Bunting. Paul Garrin counseled fighting on. The etoy agents offered to settle for $750,000. The case came to court in late November 1999 before Judge Shook. The Judge accepted the plausibility of the eToys version of the facts on the trademark issue, which included the purchase of a registered trademark from another company that went back to 1990. He issued an injunction on their behalf, and added in his statement that he was worried about “the great danger of children being exposed to profane and hardcore pornographic issues on the computer.” (Wishart & Boschler: 222) The injunction was all eToys needed to get Network Solutions to shut down the etoy.com domain. Zai sent out a press release in early December, which percolated through Slashdot, rhizome, nettime (Staehle) and many other networks, and catalyzed the net community into action. A debate of sorts started on investor websites such as fool.com. The eToys stock price started to slide, and etoy ‘warriors’ felt free to take the credit for it. The story made the New York Times on 9th December, Washington Post on the 10th, Wired News on the 11th. Network Solutions finally removed the etoy.com domain on the 10th December. Zai responded with a press release: “this is robbery of digital territory, American imperialism, corporate destruction and bulldozing in the way of the 19th century.” (Wishart & Boschler: 237) RTMark set up a campaign fund for toywar, managed by Survival Research Laboratories’ Mark Pauline. The RTMark press release promised a “new internet ‘game’ designed to destroy eToys.com.” (Wishart & Boschler: 239) The RTMark press release grabbed the attention of the Associated Press newswire. The eToys.com share price actually rose on December 13th. Goldman Sachs’ e-commerce analyst Anthony Noto argued that the previous declines in the Etoys share price made it a good buy. Goldman Sachs was the lead underwriter of the eToys IPO. Noto’s writings may have been nothing more than the usual ‘IPOetry’ of the time, but the crash of the internet bubble was some months away yet. The RTMark campaign was called ‘The Twelve Days of Christmas’. It used the Floodnet technique that Ricardo Dominguez used in support of the Zapatistas. As Dominguez said, “this hysterical power-play perfectly demonstrates the intensions of the new net elite; to turn the World Wide Web into their own private home-shopping network.” (Wishart & Boschler: 242) The Floodnet attack may have slowed the eToys.com server down a bit, but it was robust and didn’t crash. Ironically, it ran on open source software. Dominguez claims that the ‘Twelve Days’ campaign, which relied on individuals manually launching Floodnet from their own computers, was not designed to destroy the eToys site, but to make a protest felt. “We had a single-bullet script that could have taken down eToys – a tactical nuke, if you will. But we felt this script did not represent the presence of a global group of people gathered to bear witness to a wrong.” (Wishart & Boschler: 245) While the eToys engineers did what they could to keep the site going, eToys also approached universities and businesses whose systems were being used to host Floodnet attacks. The Thing, which hosted Dominguez’s eToys Floodnet site was taken offline by The Thing’s ISP, Verio. After taking down the Floodnet scripts, The Thing was back up, restoring service to the 200 odd websites that The Thing hosted besides the offending Floodnet site. About 200 people gathered on December 20th at a demonstration against eToys outside the Museum of Modern Art. Among the crowd were Santas bearing signs that said ‘Coal for eToys’. The rally, inside the Museum, was led by the Reverend Billy of the Church of Stop Shopping: “We are drowning in a sea of identical details”, he said. (Wishart & Boschler: 249-250) Meanwhile etoy worked on the Toywar Platform, an online agitpop theater spectacle, in which participants could act as soldiers in the toywar. This would take some time to complete – ironically the dispute threatened to end before this last etoy artwork was ready, giving etoy further incentives to keep the dispute alive. The etoy agents had a new lawyer, Chris Truax, who was attracted to the case by the publicity it was generating. Through Truax, etoy offered to sell the etoy domain and trademark for $3.7 million. This may sound like an insane sum, but to put it in perspective, the business.com site changed hands for $7.5 million around this time. On December 29th, Wessel signaled that eToys was prepared to compromise. The problem was, the Toywar Platform was not quite ready, so etoy did what it could to drag out the negotiations. The site went live just before the scheduled court hearings, January 10th 2000. “TOYWAR.com is a place where all servers and all involved people melt and build a living system. In our eyes it is the best way to express and document what’s going on at the moment: people start to about new ways to fight for their ideas, their lifestyle, contemporary culture and power relations.” (Wishart & Boschler: 263) Meanwhile, in a California courtroom, Truax demanded that Network Solutions restore the etoy domain, that eToys pay the etoy legal expenses, and that the case be dropped without prejudice. No settlement was reached. Negotiations dragged on for another two weeks, with the etoy agents’ attention somewhat divided between two horizons – art and law. The dispute was settled on 25th January. Both parties dismissed their complaints without prejudice. The eToys company would pay the etoy artists $40,000 for legal costs, and contact Network Solutions to reinstate the etoy domain. “It was a pleasure doing business with one of the biggest e-commerce giants in the world” ran the etoy press release. (Wishart & Boschler: 265) That would make a charming end to the story. But what goes around comes around. Brainhard, still pissed off with Zai after leaving the group in San Francisco, filed for the etoy trademark in Austria. After that the internal etoy wranglings just gets boring. But it was fun while it lasted. What etoy grasped intuitively was the nexus between the internet as a cultural space and the transformation of the commodity economy in a yet-more abstract direction – its becoming-vectoral. They zeroed in on the heart of the new era of conceptual business – the brand. As Wittgenstein says of language, what gives words meaning is other words, so too for brands. What gives brands meaning is other brands. There is a syntax for brands as there is for words. What etoy discovered is how to insert a new brand into that syntax. The place of eToys as a brand depended on their business competition with other brands – with Toys ‘R’ Us, for example. For etoy, the syntax they discovered for relating their brand to another one was a legal opposition. What made etoy interesting was their lack of moral posturing. Their abandonment of leftist rhetorics opened them up to exploring the territory where media and business meet, but it also made them vulnerable to being consumed by the very dialectic that created the possibility of staging etoy in the first place. By abandoning obsolete political strategies, they discovered a media tactic, which collapsed for want of a new strategy, for the new vectoral terrain on which we find ourselves. Abstract:
The Internet has long been a venue for individuals to craft their online personas on their own terms, and many have embraced the opportunity to take on a persona that is not associated with a legally recognised name. The rise of social networking has continued to spur proliferation of online personas, but often in ways that intensify corporate mediation of these personas. Debates about online pseudonymity exemplify these tensions, especially when social media corporations attempt to implement “real name policies” that require users to use one, legally recognised name in their online interactions. These debates, however, have broader stakes: they are negotiations over who has the right to control the individual presentation of self, and thus part of a larger conversation about information control and the future of Internet culture. While there was some coverage of these debates in traditional news media, blogs were a key site for examining how real name policies affect oppressed or marginalised groups. To explore these issues, this essay analyses the rhetoric of feminist and anti-racist blog posts that argue for protecting online pseudonymity practices. In general, these sites construct pseudonymity as a technology of resistance and as a vital tool in ensuring that the Internet remains (or becomes) a democratising force. The essay will first provide an overview of the issue and of blog posts about real name policies and gender and/or race, which were selected by the depth and interest of their commentary, and found by search engine or Twitter hashtag using search terms such as “pseudonymity” and “real name policy.” The essay will then explore how these blog posts theorise how real name policies contribute to the broader move toward a surveillance society. Through these arguments, these bloggers reveal that various online communities have vastly different ways of understanding what it means to construct an online persona, and that these varied understandings in turn shape how communities inscribe value (or danger) in pseudonymous Internet practices. Feminist and Anti-Racist Blogger Responses to Real Name Policies While online pseudonymity has long been hotly debated, the conversation intensified following moves by Google-plus to implement “real name policies” in July 2011. Officially these real name policies were intended to improve the experience of users by making it easy to be found online and ensuring that online conversations remained civil. Critics of real name policies often object to the term “real name” and its implication that a pseudonym is a “fake” name. Moreover, proponents of pseudonymity tend to distinguish between pseudonymity and anonymity; a pseudonym is a public persona with relationships, a reputation to uphold, and often years of use. A pseudonym is thus not a way of escaping the responsibilities of having one’s online actions associated with one’s public persona—it is quite the opposite. Nevertheless, defenders of pseudonymity generally argue that both pseudonymity and anonymity must be permitted. Supporters argue that real name policies will enhance the experience of users, and particularly that they will help stop the widespread incivility of many internet comments, on the presumption that using one’s real name will ensure accountability for one’s behavior online. On the other side, many bloggers have argued that the use of real names will not solve these problems and will instead be a threat to the safety and privacy of users, as well as stymieing debate about important or controversial issues. Moreover, many of these bloggers theorise about gender, politics, technology, and identity in ways that resonate well with broader feminist and critical race theory, as well as current conversations about technology and surveillance society. Feminist and other defenses of pseudonymity have used a variety of tactics. One has been to portray pseudonymity as a standard part of Internet culture, and legal names or “wallet names” as an arbitrary way of governing production of public personas. Underlying this framing of pseudonymity as a fundamental part of Internet culture is a long tradition of defining the Internet as a free, open, and democratic space. Internet enthusiasts have long described and prescribed an Internet in which anyone is free to explore and exchange ideas without the ordinary limits imposed by the flesh world, arguing that the Internet encourages more open debate, decentralises networks of knowledge, allows users to try on new identities, and challenges the rigidity of categories and hierarchies that shape knowledge and conversations in the non-virtual world (Rheingold, Plant). Traditionally, pseudonymity and anonymity have been key ways for users to pursue these ends. Thus, the ability to create one or more online personas has, in this conversation, a direct relationship to questions of democracy and about whose practices count as legitimate or valuable in the online world. Additionally, many feminist bloggers frame real name policies as an attempt at corporate control; these policies thus are symbolic to some bloggers of the shift from what they imagine was once a free and open Internet to a corporate-controlled, highly commercialised realm. s.e. smith, for example, writes that “This is what the nymwars are about; a collision between capitalism and the rest of us, where identities are bargaining chips and tools,” with “nym” being the term for the name and persona that one employs online (“The Google+ Nymwars”). Pseudonymity is thus understood by these bloggers as a necessary practice in a democratic Internet, in which one has the right to define one’s own persona online, rather than allowing one’s persona to be defined by a corporation. This framing of pseudonymity as a normalised and valuable part of Internet communication also seems to be an attempt to pre-empt the question of why someone needs a pseudonym if they are not doing anything wrong, but many of the arguments in favor of pseudonyms in fact address this question directly by producing long lists, such as those at geekfeminism and techdirt. In particular, feminist and anti-racist arguments for protecting pseudonymity emphasise that this practice is especially important for women and other marginalised groups, especially since using a real name may expose them to harassment, discrimination, or social consequences. Women who discuss feminism, for example, are sometimes subject to death and rape threats (Hess; Sarkeesian; s.e. smith “On Blogging, Threats, and Silence”). While many feminist bloggers choose to use their real names anyway, most still suggest that pseudonymity must remain a choice anywhere where one seeks to have conversations about issues of import. Moreover, these arguments are a reversal of the claim that real name requirements will stop harassment—while real name policies are purportedly instated to protect the safety of online conversations, many bloggers, pseudonymous and otherwise, suggest that real name policies make women and minorities of all kinds less safe, both online and off-line, and have other negative effects on these groups as well. For instance, Elusis writes that: For minorities, often their name and reputation doesn’t just affect them, it affects their family, and it affects other members of their minority group. Stories of not just outing but of harassment, abuse, and death threats that escalated to the point of being taken seriously by law enforcement (which takes rather a lot). […] Men who get in arguments with other people online don’t get threatened with rape on a regular basis. Unsurprisingly, trans people get abused in this way too. People of color get driven from online spaces** for daring to speak out. (Hyperlinks in original) Likewise, Sarah Stokely writes: As a woman who’s written about feminism online and received anonymous hatemail and death threats for doing so, I would like to preserve my right to post under a pseudonym to keep myself safe in the real world and if I choose, so I’m not identified as a woman online in places where it might not be safe to do so. […] I don’t believe that getting rid of anonymity online will stop bad behaviour like the abuse and death threats I’ve received. I do think that getting rid of anonymity and pseudonymity online will make it easier for people like myself to become targets of abuse and potentially put us in danger. Note that these comments suggest that simply being a woman or member of any kind of minority may make one a target of harassment. Also notice that these comments tend to frame real name policies as an expression of the privileged—real name policies only appear innocuous because of the assumption that the experiences of financially privileged English-speaking white men are universal, and that knowledge of the experiences of marginalised groups is not necessary to design safe and effective policies for consumers of technology. According to feminist blogger critiques of real name policies, it is this privilege that assumes that those using pseudonyms are the “Others” that decent people must be protected from, instead of examining the possibility that those using the pseudonyms might be the ones in danger. A quotation from Geek Feminism, a site whose lengthy discussions of pseudonymity are often cited by bloggers, further illustrates the centrality of privilege to this debate: the writer notes that a proponents of real name policies has dismissed critique by saying, “Don’t say anything in a comment thread that you wouldn’t say in person,” and Geek Feminism responds, “but that sounds like the voice of someone who’s never received abuse or harassment in person” (“Hacker News and Pseudonymity”). The many bloggers who critique the privilege they find responsible for real name policies suggest that beneath conflicts over pseudonymity and accountability online is not the question of how the online world relates to the flesh world, but instead a fundamental disagreement about the nature of accountability and free expression in the flesh world. In this light, attempts to make the online world mimic the accountabilities and social norms of the offline world operate under the assumption that oppression and abuse are not the norm in the flesh world, and that it is Internet technology and Internet culture that has made conversations uncivil or unsafe, and that these should be converted to be more like the flesh world. In this set of assumptions, the flesh world is characterised by respectful and safe interactions, categories of identity are natural as opposed to something that society imposes on individuals, and the existing ways of holding people accountable for their words and actions is very effective at protecting people. Clearly, however, it takes a degree of privilege to characterise the flesh world this way. Thus, the pseudonymity debate is largely about deeper-seated questions on the nature of identity and power in online and offline settings, while appearing to be about the differences between the real world and the online world. Other bloggers have also countered the assumption that real name policies make the Internet safer, often by pointing out that sites that have mandated the use of real names still see a great deal of harassment. s.e. smith, for instance, argues, “If Google really cares about safety, it needs strong, effective, and enforceable site policies. It needs to create a culture of safety, because, well, if your website’s full of assholes, it’s your fault. Real names policies don’t work. Good site policies and the cultivation of a culture of mutual respect do” (“The Google+ Nymwars,” hyperlinks in original). Pseudonyms allow users to participate in important debates online while maintaining a public persona that allows for continued conversations and interactions, which is vital for sustained activism. In this light, policies that take away users’ abilities to control or shape their online personas may force users to choose silence for their own safety. Individual control over online personas is thus both a safety issue and a free speech issue; in direct contradiction to claims that real name policies make users safer and more able to participate in civil discussions. Other pro-pseudonymity bloggers also celebrate the way that a “robust culture of pseudonymity” focuses discussion on ideas rather than the privilege of the speaker, “which, I often think, is why authoritarians and those with authoritarian tendencies hate it” (Paolucci). boyd notes that: the issue of reputation must be turned on its head when thinking about marginalised people. Folks point to the issue of people using pseudonyms to obscure their identity and, in theory, ‘protect’ their reputation. The assumption baked into this is that the observer is qualified to actually assess someone’s reputation. All too often, and especially with marginalised people, the observer takes someone out of context and judges them inappropriately. boyd is one of many bloggers who note that if one’s name is coded as white, Anglo, and male, using one’s real name may often enhance one’s credibility and authority, but if one’s name is coded otherwise, a pseudonym may be helpful; again, assuming that the white male experience is universal allows one to assume that using a real name is a harmless request. In general, these bloggers’ tactics all serve to denaturalise the assumption that a real name is the normal, desirable, and traditional mode of presenting one’s persona, and highlight the ways that real name policies claim to reflect universal concerns but primarily reflect wealthy white men’s experiences with online personas. Information, Power, and Control over Online Personas Additionally, defenders of pseudonymity associate real name policies with the move to a surveillance society, with particular emphasis on corporate surveillance of consumer behavior, also known as the “personal information economy.” Many feminist blogger discussions of pseudonymity note that while real name policies are purportedly intended for safety and protection, they actually allow corporations to amass huge swaths of data about individuals and to keep nearly all the online activities of one person attached to their name. For example blogger much_a_luck writes that: This is exactly the source of trying to pin down who users ‘really’ are. The advertising economy is super-creepy to me, everybody trying to make money by telling people about something someone else is doing, as efficiently as possible. Maybe I'm naive, but I feel like the internet's advertising-driven economy, with it’s [sic] ability to track and target activity, has just blown this whole sector completely out of control. (Paolucci) And indeed the practice of gathering and storing as much information as possible, simply on the chance that an institution might one day use this information, is becoming a more common fear, whether with regard to corporate data mining or recent news stories about privacy and government surveillance. In the larger conversation about surveillance, in fact, it is often the case that while one side argues that information gathering makes everyone safer, an opposition will claim that such measures actually make people vulnerable to abuses of this information. Blogger Space_dinosaur_blue has called real name policies a “security placebo” that claims to stop harassment while actually doing nothing but invading privacy (comment to Paolucci). s.e. smith has argued: What this is really about, of course, is capitalism. […] For the owners of […] sites like Google+ and Facebook, there’s also a big potential to make a profit through the direct commodification of user identities. […] The standards that Google+ sets revolve around the purchase, sale, and exchange of identity, a multibillion dollar industry worldwide. This is what people should be talking about. (“The Google+ Nymwars”) Clearly, the pseudonymity debate resonates in many ways with broader discussions of surveillance, corporate and otherwise. First, scholars have often noted that surveillances practices tend to be more harmful to those in marginalised or oppressed groups, and feminist arguments for pseudonymity reinforce this finding. Additionally, many defenders of pseudonymity point out the dissembling found in companies’ claims that real name policies are there to protect the safety of users and create a civil and decent space for people to interact while actually using the data for marketing research purposes. Framing pseudonymity as anti-social, uncivil, and dangerous, assumes a criminality so to speak, or at the very least, an illegitimacy, on the part of pseudonym users. The rhetorical move here is worth noting: implicitly suggesting that a real name is an inherent part of civility and safety is also suggesting that you have an ethical obligation to those who would compile information about you. In other words, the rules of civility demand that you participate in the corporatisation and commodification of your identity and personal information. Shaping an online persona—or multiple personas—is not an act of creativity or political resistance or freedom; it is assumed to be an act of aggression toward others. We see here a new form of the “good citizenship” argument that characterises the surveillance society. In debates about national security, for instance, acceptance of extensive surveillance of all citizens is framed as a contribution to national security. Here, however, it is not national security but corporate interests that have been inserted as the epitome of the “common good.” In this framework, an anti-corporate approach to personal information appears to be anti-social and even unethical. Commodification of identity is not only the norm but also an obligation of citizenship. Furthermore, as scholars of surveillance have noted (Gilliom and Monahan for instance), social networking creates an environment in which most individuals are participating in creating a surveillance society simply through the level of documentation they voluntarily provide. Again, more and more, willing participation in surveillance practices—making it easy to be surveilled—is becoming part of one’s civic duty. Thus, the debate over pseudonymity is also a debate about the extent to which corporations can expect compliance to the increasingly normalised demands of a surveillance society. And so, for all of these reasons, debates over pseudonymity reveal a host of complex and multi-layered tensions about technology’s influence on the construction of personas, and how these personas are shaped by encroaching forms of surveillance and the marketing of identities. Proponents of pseudonymity use numerous strategies to challenge, subvert, or reconceptualise privileged assumptions about the complex relationships among names, personas, and identities. Abstract:
Introduction The purpose of this paper is to explore discourses of ‘ability’ and ‘ableism’. Terms such as abled, dis-abled, en-abled, dis-enabled, diff-abled, transable, assume different meanings as we eliminate ‘species-typical’ as the norm and make beyond ‘species-typical’ the norm. This paper contends that there is a pressing need for society to deal with ableism in all of its forms and its consequences. The discourses around 'able' and 'ableism' fall into two main categories. The discourse around species-typical versus sub-species-typical as identified by certain powerful members of the species is one category. This discourse has a long history and is linked to the discourse around health, disease and medicine. This discourse is about people (Harris, "One Principle"; Watson; Duke) who portray disabled people within a medical model of disability (Finkelstein; Penney; Malhotra; British Film Institute; Oliver), a model that classifies disabled people as having an intrinsic defect, an impairment that leads to ‘subnormal’ functioning. Disability Studies is an academic field that questions the medical model and the issue of ‘who defines whom’ as sub-species typical (Taylor, Shoultz, and Walker; Centre for Disability Studies; Disability and Human Development Department; Disabilitystudies.net; Society for Disability Studies; Campbell). The other category is the discourse around the claim that one has, as a species or a social group, superior abilities compared to other species or other segments in ones species whereby this superiority is seen as species-typical. Science and technology research and development and different forms of ableism have always been and will continue to be inter-related. The desire and expectation for certain abilities has led to science and technology research and development that promise the fulfillment of these desires and expectations. And science and technology research and development led to products that enabled new abilities and new expectations and desires for new forms of abilities and ableism. Emerging forms of science and technology, in particular the converging of nanotechnology, biotechnology, information technology, cognitive sciences and synthetic biology (NBICS), increasingly enable the modification of appearance and functioning of biological structures including the human body and the bodies of other species beyond existing norms and inter and intra species-typical boundaries. This leads to a changed understanding of the self, the body, relationships with others of the species, and with other species and the environment. There are also accompanying changes in anticipated, desired and rejected abilities and the transhumanisation of the two ableism categories. A transhumanised form of ableism is a network of beliefs, processes and practices that perceives the improvement of biological structures including the human body and functioning beyond species-typical boundaries as the norm, as essential. It judges an unenhanced biological structure including the human body as a diminished state of existence (Wolbring, "Triangle"; Wolbring, "Why"; Wolbring, "Glossary"). A by-product of this emerging form of ableism is the appearance of the ‘Techno Poor impaired and disabled people’ (Wolbring, "Glossary"); people who don’t want or who can’t afford beyond-species-typical body ability enhancements and who are, in accordance with the transhumanised form of ableism, perceived as people in a diminished state of being human and experience negative treatment as ‘disabled’ accordingly (Miller). Ableism Today: The First Category Ableism (Campbell; Carlson; Overboe) privileges ‘species typical abilities’ while labelling ‘sub-species-typical abilities’ as deficient, as impaired and undesirable often with the accompanying disablism (Miller) the discriminatory, oppressive, or abusive behaviour arising from the belief that sub-species-typical people are inferior to others. To quote the UK bioethicist John Harris I do define disability as “a physical or mental condition we have a strong [rational] preference not to be in” and that it is more importantly a condition which is in some sense a “‘harmed condition’”. So for me the essential elements are that a disabling condition is harmful to the person in that condition and that consequently that person has a strong rational preference not to be in such a condition. (Harris, "Is There") Harris’s quote highlights the non acceptance of sub-species-typical abilities as variations. Indeed the term “disabled” is mostly used to describe a person who is perceived as having an intrinsic defect, an impairment, disease, or chronic illness that leads to ‘subnormal’ functioning. A low quality of life and other negative consequences are often seen as the inevitable, unavoidable consequence of such ‘disability’. However many disabled people do not perceive themselves as suffering entities with a poor quality of life, in need of cure and fixing. As troubling as it is, that there is a difference in perception between the ‘afflicted’ and the ‘non-afflicted’ (Wolbring, "Triangle"; also see references in Wolbring, "Science") even more troubling is the fact that the ‘non-afflicted’ for the most part do not accept the self-perception of the ‘afflicted’ if the self-perception does not fit the agenda of the ‘non-afflicted’ (Wolbring, "Triangle"; Wolbring, "Science"). The views of disabled people who do not see themselves within the patient/medical model are rarely heard (see for example the positive non medical description of Down Syndrome — Canadian Down Syndrome Society), blatantly ignored — a fact that was recognised in the final documents of the 1999 UNESCO World Conference on Sciences (UNESCO, "Declaration on Science"; UNESCO, "Science Agenda") or rejected as shown by the Harris quote (Wolbring, "Science"). The non acceptance of ‘sub-species-typical functioning’ as a variation as evident in the Harris quote, also plays itself out in the case that a species-typical person wants to become sub-species-typical. Such behaviour is classified as a disorder, the sentiment being that no one with sound mind would seek to become sub-species-typical. Furthermore many of the so called sub-species-typical who accept their body structure and its way of functioning, use the ability language and measure employed by species-typical people to gain social acceptance and environmental accommodations. One can often hear ‘sub-species-typical people’ stating that “they can be as ‘able’ as the species-typical people if they receive the right accommodations”. Ableism Today: The Second Category The first category of ableism is only part of the ableism story. Ableism is much broader and more pervasive and not limited to the species-typical, sub-species dichotomy. The second category of ableism is a set of beliefs, processes and practices that produce a particular understanding of the self, the body, relationships with others of the species, and with other species and the environment, based on abilities that are exhibited or cherished (Wolbring, "Why"; Wolbring, "NBICS"). This form of ableism has been used historically and still is used by various social groups to justify their elevated level of rights and status in relation to other social groups, other species and to the environment they live in (Wolbring, "Why"; Wolbring, "NBICS"). In these cases the claim is not about species-typical versus sub-species-typical, but that one has - as a species or a social group- superior abilities compared to other species or other segments in ones species. Ableism reflects the sentiment of certain social groups and social structures to cherish and promote certain abilities such as productivity and competitiveness over others such as empathy, compassion and kindness (favouritism of abilities). This favouritism for certain abilities over others leads to the labelling of those who exhibit real or perceived differences from these ‘essential’ abilities, as deficient, and can lead to or justify other isms such as racism (it is often stated that the favoured race has superior cognitive abilities over other races), sexism (at the end of the 19th Century women were viewed as biologically fragile, lacking strength), emotional (exhibiting an undesirable ability), and thus incapable of bearing the responsibility of voting, owning property, and retaining custody of their own children (Wolbring, "Science"; Silvers), cast-ism, ageism (missing the ability one has as a youth), speciesism (the elevated status of the species homo sapiens is often justified by stating that the homo sapiens has superior cognitive abilities), anti-environmentalism, GDP-ism and consumerism (Wolbring, "Why"; Wolbring, "NBICS") and this superiority is seen as species-typical. This flavour of ableism is rarely questioned. Even as the less able classified group tries to show that they are as able as the other group. It is not questioned that ability is used as a measure of worthiness and judgement to start with (Wolbring, "Why"). Science and Technology and Ableism The direction and governance of science and technology and ableism are becoming increasingly interrelated. How we judge and deal with abilities and what abilities we cherish influences the direction and governance of science and technology processes, products and research and development. The increasing ability, demand for, and acceptance of changing, improving, modifying, enhancing the human body and other biological organisms including animals and microbes in terms of their structure, function or capabilities beyond their species-typical boundaries and the starting capability to synthesis, to generate, to design new genomes, new species from scratch (synthetic biology) leads to a changed understanding of oneself, one’s body, and one’s relationship with others of the species, other species and the environment and new forms of ableism and disablism. I have outlined so far the dynamics and characteristics of the existing ableism discourses. The story does not stop here. Advances in science and technology enable transhumanised forms of the two categories of ableism exhibiting similar dynamics and characteristics as seen with the non transhumanised forms of ableism. Transhumanisation of the First Category of AbleismThe transhumanised form of the first category of ableism is a network of beliefs, processes and practices that perceives the constant improvement of biological structures including the human body and functioning beyond species typical boundaries as the norm, as essential and judges an unenhanced biological structure — species-typical and sub-species-typical — including the human body as limited, defective, as a diminished state of existence (Wolbring, "Triangle"; Wolbring, "Why"; Wolbring, "Glossary"). It follows the same ideas and dynamics as its non transhumanised counterpart. It just moves the level of expected abilities from species-typical to beyond-species-typical. It follows a transhumanist model of health (43) where "health" is no longer the endpoint of biological systems functioning within species-typical, normative frameworks. In this model, all Homo sapiens — no matter how conventionally "medically healthy" — are defined as limited, defective, and in need of constant improvement made possible by new technologies (a little bit like the constant software upgrades we do on our computers). "Health" in this model means having obtained at any given time, maximum enhancement (improvement) of abilities, functioning and body structure. The transhumanist model of health sees enhancement beyond species-typical body structures and functioning as therapeutic interventions (transhumanisation of medicalisation; 2, 43). The transhumanisation of health and ableism could lead to a move in priorities away from curing sub-species-typical people towards species-typical functioning — that might be seen increasingly as futile and a waste of healthcare and medical resources – towards using health care dollars first to enhance species-typical bodies towards beyond-species-typical functioning and then later to shift the priorities to further enhance the human bodies of beyond species-typical body structures and functioning (enhancement medicine). Similar to the discourse of its non transhumanised counterpart there might not be a choice in the future to reject the enhancements. An earlier quote by Harris (Harris, "Is There") highlighted the non acceptance of sub- species-typical as a state one can be in. Harris makes in his 2007 book Enhancing Evolution: The Ethical Case for Making Better People the case that its moral to do enhancement if not immoral not to do it (Harris, "One Principle"). Keeping in mind the disablement people face who are labelled as subnormative it is reasonable to expect that those who cannot afford or do not want certain enhancements will be perceived as impaired (techno poor impaired) and will experience disablement (techno poor disabled) in tune with how the ‘impaired labelled people’ are treated today. Transhumanisation of the Second Category of Ableism The second category of Ableism is less about species-typical but about arbitrary flagging certain abilities as indicators of rights. The hierarchy of worthiness and superiority is also transhumanised.Cognition: Moving from Human to Sentient Rights Cognition is one ability used to justify many hierarchies within and between species. If it comes to pass whether through artificial intelligence advances or through cognitive enhancement of non human biological entities that other cognitive able sentient species appear one can expect that rights will eventually shift towards cognition as the measure of rights entitlement (sentient rights) and away from belonging to a given species like homo sapiens as a prerequisite of rights. If species-typical abilities are not important anymore but certain abilities are, abilities that can be added to all kind of species, one can expect that species as a concept might become obsolete or we will see a reinterpretation of species as one that exhibits certain abilities (given or natural). The Climate Change Link: Ableism and Transhumanism The disregard for nature reflects another form of ableism: humans are here to use nature as they see fit as they see themselves as superior to nature because of their abilities. We might see a climate change-driven appeal for a transhuman version of ableism, where the transhumanisation of humans is seen as a solution for coping with climate change. This could become especially popular if we reach a ‘point of no return’, where severe climate change consequences can no longer be prevented. Other Developments One Can Anticipate under a Transhumanised Form of AbleismThe Olympics would see only beyond-species-typical enhanced athletes compete (it doesn’t matter whether they were species-typical before or seen as sub-species-typical) and the transhumanised version of the Paralympics would host species and sub-species-typical athletes (Wolbring, "Oscar Pistorius"). Transhumanised versions of Abled, dis-abled, en-abled, dis-enabled, diff-abled, transable, and out-able will appear where the goal is to have the newest upgrades (abled), that one tries to out-able others by having better enhancements, that access to enhancements is seen as en-ablement and the lack of access as disenablement, that differently abled will not be used for just about sub-species-typical but for species-typical and species-sub-typical, that transable will not be about the species-typical who want to be sub-species-typical but about the beyond-species-typical who want to be species-typical. A Final WordTo answer the questions posed in the title. With the fall of the species-typical barrier it is unlikely that there will be an endpoint to the race for abilities and the sentiment of out-able-ing others (on an individual or collective level). The question remaining is who will have access to which abilities and which abilities are thought after for which purpose. I leave the reader with an exchange of two characters in the videogame Deus Ex: Invisible War, a PC and X-Box videogame released in 2003. It is another indicator for the embeddiness of ableism in societies fabric that the below is the only hit in Google for the term ‘commodification of ability’ despite the widespread societal commodification of abilities as this paper has hopefully shown. Abstract:
‘Country’ is a word that is made to do much discursive work. In one common configuration, country is synonymous with ‘rural’, also evinced through terms like countryside and country-minded. Yet, at the same time, country is synonymous with ‘nation’. This usage is more emotive and identificatory than administrative, as in ‘my country’, ‘my land’, ‘my homeland’. Augmenting a sense of national allegiance, this use of country evokes something of the connection between people, landscape, belonging, identity and subjectivity. Moreover, country-as-rural(ity) and country-as-nation(ality) have significant overlaps. The rural landscape – the countryside – is often imagined as the ‘heartland’ of the modern Western nation-state – a source of national identity and a storehouse for values ‘lost’ through the experience of progress, modernity and industrialisation (Bell). Here, the countryside, supposedly, is a traditional material and discursive site for family, community and well-being (Little and Austin). From yet another angle, country is a genre or style, as in country music, country and western film, country living, country comfort and country cooking. In this way, country becomes a commercial selling point and a commodified imaginary – although this is not at all mutually exclusive with the evocation of belonging, identity and national cultural values through the countryside. This commodification is seen in the recent revaluing of country getaways (McCarthy), sea-change (Burnley and Murphy) and tree-change (Costello), which in turn invokes the notion of country as a store of traditional values, moral restoration and physical revitalisation. Clearly, then, these multifaceted invocations of country – as rurality, nationality and commodity – interleave and overlap in various and complex ways. The papers comprising this issue of M/C Journal seek to explore the intermingling discourses of country, and how these have changed (and continue to change) over time and between places. Indeed, many of these meanings have heightened importance in the present cultural and political moment, and the contents of the papers draw attention to these emerging currencies. Country-as-nation(ality) – and as homeland – is reinforced in the current context of social unrest around terror, security, minority political rights, and climate change threats. And as people search for anchors of security, reinvestments are made in the ‘authenticity’ of rurality and rural communities as sources of both personal respite and wider national cultural values. This has flow on effects in the sphere of the cultural economy, where country living, rustic style and bucolic retreats are increasingly sought by cultural consumers. These affiliations between country, nation, rurality, security, community and consumption are critically interrogated in the subsequent papers. One key theme elicited across the collection is how country – as style, commodity, rurality and/or nationality – shapes social and cultural identities. Annabel Cooper, Chris Gibson, Loria Maxwell and Kara Stooksbury, Anthony Lambert and Catherine Simpson, and Andrew Gorman-Murray, explore the links between country and national identities, and how these interconnections take both similar and different contours across the United States, Europe and the Antipodes. In their papers, Cooper and Gibson also consider the connections between national identities, country style and gendered subjectivities. Simpson and Lambert, Michael Wesch and Clemence Due, meanwhile, draw attention to the links between land, country and Indigenous subjectivities. In doing so, Due and Lambert and Simpson, as well as Lelia Green, Gerry Bloustien and Mark Balnaves, elicit how discourses of country exclude particular identities, and leave certain social groups with a sense of unease. Terry Maybury, Donna Lee Brien and Jesse Schlotterbeck focus on the broader intermingling of rurality, regionality and identity. Another key theme traced through the papers is how county is also linked with a range of media and cultural commodities. Country music is most well-known in this regard, but also prominent are country and western films and country cooking. Several authors in this collection – Gibson, Maxwell and Stooksbury, and Brien – show the ongoing importance of these products, and their role in linking different notions of country across the scales and sites of the rural, the national and the transnational. Cooper, Schlotterbeck, and Lambert and Simpson reveal how ideas of country seep into films not specifically designated as country films, such as the noir, period and thriller genres. The deployment of country in a range of other cultural and media products is explored in this collection as well, including print news media (Due; Gorman-Murray), tourist promotions (Brien; Gorman-Murray), archival photographs (Gorman-Murray), statecraft (Wesch), and social mores and practices of belonging, attachment and alienation (Green et al; Maybury). Importantly, then, the papers in this collection, drawing on a range of data, entry points and conceptual lenses, explore the way different meanings and scales country overlap, and how notions of country ‘travel’ between places and contexts, in the process transforming and taking on new inflections. In the lead paper, Annabel Cooper explores the way country, national identities and feminine subjectivities come together in Jane Campion’s Portrait of a Lady. In this evocative discussion she shows how gender is modulated by national identities as much as other subjectivities, and moreover, how the insertion of an Antipodean femininity in the film version of Portrait reworked the geographical underpinnings of Henry James’ novel. She argues that the United States’ national self-imagination has moved on in the century between the novel and the film, and that Campion rearticulated the story through a feminine Antipodean lens. In Campion’s Portrait, notions of country and narratives of national femininities travel not only between the United States and Europe, but between the Americas and the Antipodes as well. Chris Gibson provides a complementary piece. Focusing on the imagery and lyrics of country sheet music in pre-war Australia, he shows how masculinities are inflected by discourses of both country-as-rurality and country-as-nation. In this case, images of masculinities from the American West insinuated into Australia through the trans-Pacific transaction of country music, particularly in the simultaneously visual and oral register of sheet music. For both Gibson and Cooper, country, whether associated with rurality or nationality, is not singularly emplaced, but travels transnationally as well. Lori Maxwell and Kara Stooksbury also turn their attention to country music. In their case the focus is contemporary country music in the United States, and the role this genre and its artists has played in recent American political culture, particularly Republican positions on ‘love of country’ and national allegiance. Their analysis shows how country, as a commodity linked with a particular species of rurality, is used by presidents, politicians and commentators to frame discourses of patriotic nationalism and appropriate notions of American belonging. Also focusing on cultural production in the United States’ context, Jesse Schlotterbeck critically examines the diverse roles of rurality and rural places in film noir, helping to define a subgenre of ‘rural noir’. He not only discusses the deployment of the rural in noir as a place of goodness, decency and traditional values, but also how the rural is simultaneously drawn into networks of crime, and even becomes a haven for criminality. This adds to work which challenges the romantic idyllisation of the countryside as a site of moral integrity and a store of ‘proper’ national cultural values. Anthony Lambert and Catherine Simpson similarly raise the spectre of criminality in the countryside through film analysis, but their focus is on the Australian film Jindabyne and the associated geographical context of the Australian Alps. The issues around criminality and country(side) in their analysis is broader than legal transcendence, encompassing contemporary cultural politics and social justice. Jindabyne’s narrative focus on the murder of a young Aboriginal woman provides a catalyst for interrogating Indigenous dispossession, postcolonial race relations, environmental change, and the shifting senses of belonging to country for settler Australians negotiating this ‘aftermath culture’. Andrew Gorman-Murray also concentrates on the Australian Alps, and explores the changing links between this countryside and national identity in a postcolonial settler society, but his cultural political context and catalyst are different: the threats to landscape, country and national values from imminent climate change impacts in the Australian Alps. Cultural dimensions and meanings of climate change are an emerging and important research concern (Hulme), and his analysis demonstrates how national identities and ideals of country(side) are reconfigured through the anticipated effects of climate change on the landscape. The next few papers turn to minority or Indigenous social groups’ belonging and attachment to country, both as nation and (home)land, through various experiences of insecurity. Lelia Green, Gerry Bloustien and Mark Balnaves discuss their survey finding that Jewish-Australians express the highest level of fear amongst religious groups in this country. Analysing both survey responses and additional narratives, they comprehensively interpret this heightened fear through intersecting contemporary processes of terror, insecurity, anti-Semitism, and diasporic community-formation, which collide in the context of cultural and political rhetoric about national homeland security. Complimenting both this paper and Simpson and Lambert’s discussion, Clemence Due considers the vexed question of who can lay claim to country in Australia – understood at-once as the nation, the rural countryside, and its resources – in the cultural political context of Indigenous dispossession and native title issues. She examines how this debate – about negotiating Indigenous rights to country in a political and legal context of white sovereignty – has been depicted in The Australian during 2008. Michael Wesch explores similar tensions between government authority and Indigenous sovereignty in a different context, that of New Guinea. His ethnographic analysis is evocative, showing the quite different concepts of country deployed by the state and local peoples in relation to land, settlement and governance, where Indigenous relational connections to land and belonging rub up against the categorical imperatives of statecraft. The final two papers return to rural and regional areas of Australia, and consider embodied connections to place for settler Australians. Situating her discussion within the academic arenas of food studies and the cultural economy, Donna Lee Brien provides an illuminating analysis of the role and significance of rural and regional chefs within their local communities. Her geographical focus is Armidale and Guyra, in northern New South Wales. Linking country as a generic commodity and as a rural locality, she shows how ‘foodie culture’ is not merely a tourist drawcard, but also deeply implicated in the maintenance of the local community. Terry Maybury, meanwhile, delivers a provocative discussion of the links between country, regionality and belonging through a diagrammatical analysis of ‘home’ – home understood as both “the virtuality of digital flows and the reality of architectural footings.” In this conceptualisation, home provides a nexus for self in a global/regional network, the site which allows one to gather the various elements, scales and nuances of country together in a comprehensible fashion. Home, in this way, lies at the heart of country, and makes sense of all its multifarious and interleaving dimensions and meanings. I would also like to acknowledge and thank Rohan Tate, our cover artist, for providing a photographic montage of ‘country’ which draws together the various strands explored through this collection – as nationality, rurality and commodity. The collection of various signifiers and objects prompts one to question what country is and where it is to be found. I extend thanks to those who reviewed the submissions for this issue. Abstract:
IntroductionThe debate about the responsibility of museums to respect Indigenous peoples’ rights (Kelly and Gordon; Butts) has caught our attention on the basis of our previous research experience with regard to the protection of the tangible and intangible heritage of the San (former hunter gatherers) in Southern Africa (Martin and Vermeylen; Vermeylen, Contextualising; Vermeylen, Life Force; Vermeylen et al.; Vermeylen, Land Rights). This paper contributes to the critical debate about curatorial practices and the recovery of Indigenous peoples’ cultural practices and explores how museums can be transformed into cultural centres that “decolonise” their objects while simultaneously providing social agency to marginalised groups such as the San. Indigenous MuseumTraditional methods of displaying Indigenous heritage are now regarded with deep suspicion and resentment by Indigenous peoples (Simpson). A number of related issues such as the appropriation, ownership and repatriation of culture together with the treatment of sensitive and sacred materials and the stereotyping of Indigenous peoples’ identity (Carter; Simpson) have been identified as the main problems in the debate about museum curatorship and Indigenous heritage. The poignant question remains whether the concept of a classical museum—in the sense of how it continues to classify, value and display non-Western artworks—will ever be able to provide agency to Indigenous peoples as long as “their lives are reduced to an abstract set of largely arbitrary material items displayed without much sense of meaning” (Stanley 3). Indeed, as Salvador has argued, no matter how much Indigenous peoples have been involved in the planning and implementation of an exhibition, some issues remain problematic. First, there is the problem of representation: who speaks for the group; who should make decisions and under what circumstances; when is it acceptable for “outsiders” to be involved? Furthermore, Salvador raises another area of contestation and that is the issue of intention. As we agree with Salvador, no matter how good the intention to include Indigenous peoples in the curatorial practices, the fact that Indigenous peoples may have a (political) perspective about the exhibition that differs from the ideological foundation of the museum enterprise, is, indeed, a challenge that must not be overlooked in the discussion of the inclusive museum. This relates to, arguably, one of the most important challenges in respect to the concept of an Indigenous museum: how to present the past and present without creating an essentialising “Other”? As Stanley summarises, the modernising agenda of the museum, including those museums that claim to be Indigenous museums, continues to be heavily embedded in the belief that traditional cultural beliefs, practices and material manifestations must be saved. In other words, exhibitions focusing on Indigenous peoples fail to show them as dynamic, living cultures (Simpson). This raises the issue that museums recreate the past (Sepúlveda dos Santos) while Indigenous peoples’ interests can be best described “in terms of contemporaneity” (Bolton qtd. in Stanley 7). According to Bolton, Indigenous peoples’ interest in museums can be best understood in terms of using these (historical) collections and institutions to address contemporary issues. Or, as Sepúlveda dos Santos argues, in order for museums to be a true place of memory—or indeed a true place of recovery—it is important that the museum makes the link between the past and contemporary issues or to use its objects in such a way that these objects emphasize “the persistence of lived experiences transmitted through generations” (29). Under pressure from Indigenous rights movements, the major aim of some museums is now reconciliation with Indigenous peoples which, ultimately, should result in the return of the cultural objects to the originators of these objects (Kelly and Gordon). Using the Native American Graves Protection and Repatriation Act of 1990 (NAGPRA) as an illustration, we argue that the whole debate of returning or recovering Indigenous peoples’ cultural objects to the original source is still embedded in a discourse that emphasises the mummified aspect of these materials. As Harding argues, NAGPRA is provoking an image of “native Americans as mere passive recipients of their cultural identity, beholden to their ancestors and the museum community for the re-creation of their cultures” (137) when it defines cultural patrimony as objects having ongoing historical, traditional or cultural importance, central to the Native American group or culture itself. According to Harding (2005) NAGPRA’s dominating narrative focuses on the loss, alienation and cultural genocide of the objects as long as these are not returned to their originators. The recovery or the return of the objects to their “original” culture has been applauded as one of the most liberating and emancipatory events in recent years for Indigenous peoples. However, as we have argued elsewhere, the process of recovery needs to do more than just smother the object in its past; recovery can only happen when heritage or tradition is connected to the experience of everyday life. One way of achieving this is to move away from the objectification of Indigenous peoples’ cultures. ObjectificationIn our exploratory enquiry about new museum practices our attention was drawn to a recent debate about ownership and personhood within the context of museology (Busse; Baker; Herle; Bell; Geismar). Busse, in particular, makes the point that in order to reformulate curatorial practices it is important to redefine the concept and meaning of objects. While the above authors do not question the importance of the objects, they all argue that the real importance does not lie in the objects themselves but in the way these objects embody the physical manifestation of social relations. The whole idea that objects matter because they have agency and efficacy, and as such become a kind of person, draws upon recent anthropological theorising by Gell and Strathern. Furthermore, we have not only been inspired by Gell’s and Strathern’s approaches that suggests that objects are social persons, we have also been influenced by Appadurai’s and Kopytoff’s defining of objects as biographical agents and therefore valued because of the associations they have acquired throughout time. We argue that by framing objects in a social network throughout its lifecycle we can avoid the recurrent pitfalls of essentialising objects in terms of their “primitive” or “traditional” (aesthetic) qualities and mystifying the identity of Indigenous peoples as “noble savages.” Focusing more on the social network that surrounds a particular object opens up new avenues of enquiry as to how, and to what extent, museums can become more inclusive vis-à-vis Indigenous peoples. It allows moving beyond the current discourse that approaches the history of the (ethnographic) museum from only one dominant perspective. By tracing an artwork throughout its lifecycle a new metaphor can be discovered; one that shows that Indigenous peoples have not always been victims, but maybe more importantly it allows us to show a more complex narrative of the object itself. It gives us the space to counterweight some of the discourses that have steeped Indigenous artworks in a “postcolonial” framework of sacredness and mythical meaning. This is not to argue that it is not important to be reminded of the dangers of appropriating other cultures’ heritage, but we would argue that it is equally important to show that approaching a story from a one-sided perspective will create a dualism (Bush) and reducing the differences between different cultures to a dualistic opposition fails to recognise the fundamental areas of agency (Morphy). In order for museums to enliven and engage with objects, they must become institutions that emphasise a relational approach towards displaying and curating objects. In the next part of this paper we will explore to what extent an online museum could progressively facilitate the process of providing agency to the social relations that link objects, persons, environments and memories. As Solanilla argues, what has been described as cybermuseology may further transform the museum landscape and provide an opportunity to challenge some of the problems identified above (e.g. essentialising practices). Or to quote the museologist Langlais: “The communication and interaction possibilities offered by the Web to layer information and to allow exploration of multiple meanings are only starting to be exploited. In this context, cybermuseology is known as a practice that is knowledge-driven rather than object-driven, and its main goal is to disseminate knowledge using the interaction possibilities of Information Communication Technologies” (Langlais qtd. in Solanilla 108). One thing which shows promise and merits further exploration is the idea of transforming the act of exhibiting ethnographic objects accompanied by texts and graphics into an act of cyber discourse that allows Indigenous peoples through their own voices and gestures to involve us in their own history. This is particularly the case since Indigenous peoples are using technologies, such as the Internet, as a new medium through which they can recuperate their histories, land rights, knowledge and cultural heritage (Zimmerman et al.). As such, new technology has played a significant role in the contestation and formation of Indigenous peoples’ current identity by creating new social and political spaces through visual and narrative cultural praxis (Ginsburg).Online MuseumsIt has been acknowledged for some time that a presence on the Web might mitigate the effects of what has been described as the “unassailable voice” in the recovery process undertaken by museums (Walsh 77). However, a museum’s online engagement with an Indigenous culture may have significance beyond undercutting the univocal authority of a museum. In the case of the South African National Gallery it was charged with challenging the extent to which it represents entrenched but unacceptable political ideologies. Online museums may provide opportunities in the conservation and dissemination of “life stories” that give an account of an Indigenous culture as it is experienced (Solanilla 105). We argue that in engaging with Indigenous cultural heritage a distinction needs to be drawn between data and the cognitive capacity to learn, “which enables us to extrapolate and learn new knowledge” (Langlois 74). The problem is that access to data about an Indigenous culture does not necessarily lead to an understanding of its knowledge. It has been argued that cybermuseology loses the essential interpersonal element that needs to be present if intangible heritage is understood as “the process of making sense that is generally transmitted orally and through face-to-face experience” (Langlois 78). We agree that the online museum does not enable a reality to be reproduced (Langlois 78).This does not mean that cybermuseology should be dismissed. Instead it provides the opportunity to construct a valuable, but completely new, experience of cultural knowledge (Langlois 78). The technology employed in cybermuseology provides the means by which control over meaning may, at least to some extent, be dispersed (Langlois 78). In this way online museums provide the opportunity for Indigenous peoples to challenge being subjected to manipulation by one authoritative museological voice. One of the ways this may be achieved is through interactivity by enabling the use of social tagging and folksonomy (Solanilla 110; Trant 2). In these processes keywords (tags) are supplied and shared by visitors as a means of accessing museum content. These tags in turn give rise to a classification system (folksonomy). In the context of an online museum engaging with an Indigenous culture we have reservations about the undifferentiated interactivity on the part of all visitors. This issue may be investigated further by examining how interactivity relates to communication. Arguably, an online museum is engaged in communicating Indigenous cultural heritage because it helps to keep it alive and pass it on to others (Langlois 77). However, enabling all visitors to structure online access to that culture may be detrimental to the communication of knowledge that might otherwise occur. The narratives by which Indigenous cultures, rather than visitors, order access to information about their cultures may lead to the communication of important knowledge. An illustration of the potential of this approach is the work Sharon Daniel has been involved with, which enables communities to “produce knowledge and interpret their own experience using media and information technologies” (Daniel, Palabras) partly by means of generating folksonomies. One way in which such issues may be engaged with in the context of online museums is through the argument that database and narrative in such new media objects are opposed to each other (Manovich, New Media 225). A new media work such as an online museum may be understood to be comprised of a database and an interface to that database. A visitor to an online museum may only move through the content of the database by following those paths that have been enabled by those who created the museum (Manovich, New Media 227). In short it is by means of the interface provided to the viewer that the content of the database is structured into a narrative (Manovich, New Media: 226). It is possible to understand online museums as constructions in which narrative and database aspects are emphasized to varying degrees for users. There are a variety of museum projects in which the importance of the interface in creating a narrative interface has been acknowledged. Goldblum et al. describe three examples of websites in which interfaces may be understood as, and explicitly designed for, carrying meaning as well as enabling interactivity: Life after the Holocaust; Ripples of Genocide; and Yearbook 2006.As with these examples, we suggest that it is important there be an explicit engagement with the significance of interface(s) for online museums about Indigenous peoples. The means by which visitors access content is important not only for the way in which visitors interact with material, but also as to what is communicated about, culture. It has been suggested that the curator’s role should be moved away from expertly representing knowledge toward that of assisting people outside the museum to make “authored statements” within it (Bennett 11). In this regard it seems to us that involvement of Indigenous peoples with the construction of the interface(s) to online museums is of considerable significance. Pieterse suggests that ethnographic museums should be guided by a process of self-representation by the “others” portrayed (Pieterse 133). Moreover it should not be forgotten that, because of the separation of content and interface, it is possible to have access to a database of material through more than one interface (Manovich, New Media 226-7). Online museums provide a means by which the artificial homogenization of Indigenous peoples may be challenged.We regard an important potential benefit of an online museum as the replacement of accessing material through the “unassailable voice” with the multiplicity of Indigenous voices. A number of ways to do this are suggested by a variety of new media artworks, including those that employ a database to rearrange information to reveal underlying cultural positions (Paul 100). Paul discusses the work of, amongst others, George Legrady. She describes how it engages with the archive and database as sites that record culture (104-6). Paul specifically discusses Legrady’s work Slippery Traces. This involved viewers navigating through more than 240 postcards. Viewers of work were invited to “first chose one of three quotes appearing on the screen, each of which embodies a different perspective—anthropological, colonialist, or media theory—and thus provides an interpretive angle for the experience of the projects” (104-5). In the same way visitors to an online museum could be provided with a choice of possible Indigenous voices by which its collection might be experienced. We are specifically interested in the implications that such approaches have for the way in which online museums could engage with film. Inspired by Basu’s work on reframing ethnographic film, we see the online museum as providing the possibility of a platform to experiment with new media art in order to expose the meta-narrative(s) about the politics of film making. As Basu argues, in order to provoke a feeling of involvement with the viewer, it is important that the viewer becomes aware “of the plurality of alternative readings/navigations that they might have made” (105). As Weinbren has observed, where a fixed narrative pathway has been constructed by a film, digital technology provides a particularly effective means to challenge it. It would be possible to reveal the way in which dominant political interests regarding Indigenous cultures have been asserted, such as for example in the popular film The Gods Must Be Crazy. New media art once again provides some interesting examples of the way ideology, that might otherwise remain unclear, may be exposed. Paul describes the example of Jennifer and Kevin McCoy’s project How I learned. The work restructures a television series Kung Fu by employing “categories such as ‘how I learned about blocking punches,’ ‘how I learned about exploiting workers,’ or ‘how I learned to love the land’” (Paul 103) to reveal in greater clarity, than otherwise might be possible, the cultural stereotypes used in the visual narratives of the program (Paul 102-4). We suggest that such examples suggest the ways in which online museums could work to reveal and explore the existence not only of meta-narratives expressed by museums as a whole, but also the means by which they are realised within existing items held in museum collections.ConclusionWe argue that the agency for such reflective moments between the San, who have been repeatedly misrepresented or underrepresented in exhibitions and films, and multiple audiences, may be enabled through the generation of multiple narratives within online museums. We would like to make the point that, first and foremost, the theory of representation must be fully understood and acknowledged in order to determine whether, and how, modes of online curating are censorious. As such we see online museums having the potential to play a significant role in illuminating for both the San and multiple audiences the way that any form of representation or displaying restricts the meanings that may be recovered about Indigenous peoples. Access to justice is an important human right that ensures adequate redress for harm, and which consequently helps deter future wrongdoing. Without access to justice citizens are precluded from the full enjoyment of their economic and social entitlements. The cost of litigation is a significant impediment to access to justice. Although the courts have attempted to increase access to justice by broadening the range of available dispute resolution options and by improving productivity through the implementation of case flow management systems, the cost of prosecuting claims remains disproportionately high and unaffordable for most small to medium sized claimholders. Legal claim assignment to parties able to aggregate claims and to apply their expertise as litigation entrepreneurs to deal with claim prosecution efficiently is one means of redressing the imbalance between the cost of claim prosecution to individual claimholders compared to the value of their claims. However, the well-entrenched doctrines of maintenance and champerty prohibit legal claim assignment. The continued resort to the doctrines of maintenance and champerty despite a strong and independent modern judiciary reflects distaste for claim commodification. However, the advent of litigation funding and its acceptance by the High Court of Australia in Campbell’s Cash and Carry v Fostif Pty Ltd (and to some extent United Kingdom and United States courts) on access to justice grounds has challenged conventional maintenance and champerty dogma. Together with other measures such as the introduction of conditional fee agreements that shift the cost of funding access to justice from the public to the private purse, the resistance to full claim alienability has been significantly weakened. The thesis argues that full claim alienability is favoured on normative and efficiency grounds and examines developments in Australia, England and the United States, which portend toward claim commodification. In addition, the thesis examines regulatory instruments required to ensure that the present partial claim market and the potential full claim market operates fairly and efficiently. It also considers how claim commodification may affect the relationship between legal practitioners and claim holders. Abstract:
This chapter examines the legal doctrines relating to credit markets and commodification, looking at the issue of assets the legal system protected from the claims of creditors. It describes how colonial legislatures reformed English law to expand the scope of creditors' remedies against land and slaves. The chapter then considers the way that, prior to 1732, colonial legislatures used debtor–creditor law strategically to advance local interests vis-à-vis English creditors. Colonial legislatures were also responsible for creating the law of slavery, a foreign concept to English law. Laws were enacted throughout the colonial era defining slaves variously as “real estate” or “chattel” to achieve alternate ends.

This chapter expands on the difficulties in claiming the body as special and addresses some of the arguments for and against claiming it as property, before laying out the general grounds of the present critique. It begins by defining the concepts of objectification, commodification, and self-ownership. It then explains the influence of feminist theory on the author's views about what it means to think of the body as property, and whether we can justify treating it as different from other “things.” It goes on to analyze property rights, which have come to be understood as fashioned through legal and social relationships that regulate your claims on me as well as my claims on you. It argues that bodily rights and property rights should be kept in their separate boxes. The reasons for this are only partly grounded in the fear that thinking of our relationship to our bodies and selves in property terms will assist and normalize their commodification. Even where there is no danger of this, the adoption of property models is problematic.
