Abstract:
Legal case brief writing is pedagogically important yet insufficiently discussed for Chinese EFL learners majoring in law. Based on process genre approach and discourse information theory (DIT), the present study designs a corpus-based analytical model for Chinese EFL learners’ autonomy in legal case brief writing and explores the process of case brief formation. The results show that in the stages of writing and self-assessment, learners can make full use of the corpus to obtain information, complete macro-information and micro-information output, and self-assess the specific legal register. The findings indicate that the realization of global coherence and local coherence in case briefs depends on discourse information output with appropriate language use. It is hoped that the study will help Chinese EFL learners build information awareness in legal writing and promote their language output and autonomous learning.

Abstract:
For the first time ever, the status of a cosmonaut of the Russian Fede-ration shall be treated not only through the review of the legislation or a separate regulatory act but also through the summarization of practical activity in the area of manned cosmonautics.The history of shaping a legal status of a cosmonaut has started since 1960. Over the first two decades of manned cosmonautics, four Regulations on cosmonauts of the USSR have been introduced and refined. However, for a quarter of a century in the Russian Federation, the practical space activities have been running without any instrument regulating the legal status of a cosmonaut. During the period 1992–2017, the preparation of the Regulation on cosmonauts in the Russian Federation was facing serious obstacles.The Regulation on cosmonauts of the Russian Federation approved by the Russian Government in 2017 has significant drawbacks and gaps. A list of challenges of the legal status of a cosmonaut to be addressed is provided. It is expected to supplement the Regulation on cosmonauts by new standards pertaining cosmonaut’s rights and obligations based upon space expertise.It is proposed to define the concept "cosmonaut" and cosmonaut’s job descri-ption using four components: speciality "cosmonaut", qualification "cosmonaut", position "cosmonaut" and profession "cosmonaut". Such approach differs from the logic of the applicable Regulation on cosmonauts 2017 where the cosmonaut’s job description shall be treated as a synonym of the cosmonaut’s professional activity.The need for availability of a Model Contract for execution of manned space mission and Model Contract for preparation to execution of manned space mission is rationalized; its content is provided in sufficient detail.It is proposed to introduce an international dimension into the legal status of a cosmonaut, and in doing so not only to use the whole array of rights and privileges of cosmonauts stipulated by the international law, but also to empower a cosmonaut to act as a representative of the State both at the overseas or international manned space object.The new regulatory acts, the need for which is given rationale in the article, will contribute to bridging gaps of legal regulation in the area of space missions in Russia between the western expertise and national practice of manned cosmonautics.

Abstract:
The effectiveness of drug abuse treatment for clients coerced into care remains controversial. Some studies find clients with legal pressure do better than those without legal pressure, while others report the exact opposite. Opposing views are often fueled by the wide-ranging models that guide delivery of addiction treatment. The present study examined how participants with and without legal pressure to attend treatment responded to a motivational (MET) vs. traditional (TAU) form of addiction treatment. Additionally, the predictive value of the Readiness to Change (RTC) score, from the URICA, was assessed across days of substance use and treatment retention. Legal status was shown to have a significant effect on days of primary substance use per week and treatment retention, regardless of intervention condition. The RTC score was shown not to be predictive of days of primary substance use or treatment retention. Research and clinical implications and future directions are discussed.

The number of people in Australia and around the world is increasing rapidly, particularly people over the age of 65. As part of the aging process, cases of dementia. cognitive impairment and mental iIIness become more prevalent. The issue of competence in this population has become more significant in recent years . Older people frequently face decisions that require the consultation of a lawyer, such as issues over wills and financial investments. Preventative law advocate lawyers act as therapeutic agents, preventing stress and discomfort in elderly clients making legal decisions. In order for practising lawyers to act as therapeutic agents, an ability to detect impaired decision making capacity in older adults is required. The present study explores this issue further.

Abstract:
This article addresses the issue referred to harmful lawful acts which also generate liability, thus ruling out the unlawfulness as an essential element for the generation of liability. In this regard, the author makes a conceptual analysis of the unlawfulness or illegality, and he examines three cases of liability, such as environmental damage, the interim resolution and withdraw the work of trade; demonstrating, effectively, the dispensable nature of the unlawfulness and the existence of scenarios of liability arising from harmful lawful acts.
El presente artículo aborda la temática referida a los actos lícitos dañosos, los cuales también generan responsabilidad civil, descartando así a la ilicitud como un elemento indispensable para la generación de responsabilidad civil. En este sentido, el artículo parte del análisis conceptual de la ilicitud o antijuridicidad, para luego arribar al examen de tres supuestos de responsabilidad civil, como lo son el daño ambiental, la resolución cautelar y el retiro de la obra del comercio; demostrando, efectivamente, el carácter prescindible de la ilicitud y la existencia de escenarios de responsabilidad civil derivados de actos lícitos dañosos.

Abstract:
One of the main objectives of any legal system is legal certainty, which is understood as the provision of decisions in the work of the courts. To this end, in order to standardize the diversity of decisions of courts for the same conflict, there are meetings of supreme judges who seek to give a unique sense of resolution to the same conflict. Those meetings are called Cassation Plenaries.In this article, the author comments and develops the decision taken at the IX Civil Cassation Plenary. At that meeting a broad criterion of manifested nullity has been chosen, whenever the causal is “easy to warn”. However, throughout the text the author highlights the methodological vices of the Supreme Court to reach this conclusion and, using a legal comparison, proposes a different criterion of manifest nullity, demonstrating that for our legal system this should not be restricted to an “easy to warn” causation.
Uno de los objetivos principales de todo sistema normativo es la seguridad jurídica, la cual se entiende como la previsión de las decisiones en la labor de las cortes judiciales. Con dicho propósito, a fin de uniformizar la diversidad de decisiones de las cortes para un mismo conflicto, existen reuniones de jueces supremos las cuales buscan dar un sentido único de resolución a un mismo conflicto. Aquellas reuniones son denominadas Plenos Casatorios.En el presente artículo, el autor comenta y desarrolla la decisión tomada en el IX Pleno Casatorio Civil. En dicha reunión se ha optado por un criterio amplio de nulidad manifiesta siempre que la causal sea “fácil de advertir”. Sin embargo, a lo largo del texto el autor pone en evidencia los vicios metodológicos de la Corte Suprema para llegar a esta conclusión y, recurriendo a la comparación jurídica, propone un criterio distinto de nulidad manifiesta, demostrando que para nuestro ordenamiento jurídico esta no se debe restringir a una causal “fácil de advertir”.

Les mémoires judiciaires qu'il publia, dans ce but, empruntent à la fois à l'art du dramaturge, du polémiste et du plaideur. Son éloquence fait signe vers le théâtre par l'emploi de formes dramatiques, comme le dialogue ou le tableau, et par l'élaboration de personnages créés à partir de personnalités des parties adverses. Inversement, les factums furent un terrain d'exercices de style et constituent, à ce titre, un arrière-plan de l'œuvre littéraire. Ils éclairent, chez lui, une obsession du droit, qui se manifesta, au théâtre, par des allusions à l'actualité judiciaire, plébiscitées par le public, par des motifs juridiques reconnaissables et conformes aux procédures du temps, et par une mise en scène de la justice, que le dramaturge enrichissait de son expérience personnelle.Le goût de Beaumarchais pour la polémique est l'autre lien entre le théâtre et les mémoires judiciaires. “Speaker according to the danger”, Beaumarchais was in the five trials in which he had to defend himself. The legal briefs that he published, for this purpose, borrow at the same time from the art of the playwright, the polemicist and the litigator. His eloquence gestures towards the theater through the use of dramatic forms, such as dialogue or scenes, and through the development of characters created from personalities of the opposing parties. Conversely, the factums were a field of stylistic exercises and constitute, as such, a background to the literary work. They shed light, for him, on an obsession with the law, which manifested itself, in the theater, by allusions to legal news, acclaimed by the public, by recognizable legal motives conforming to the procedures of the time, and by a staging of justice, which the playwright enriched with his personal experience.Beaumarchais taste for controversy is the other link between theater and legal briefs. We place the latter in the fray of the briefs poured into the bag by the adversaries of the procedure, and the libels which were broadcast on the sidelines of the trials, to which the playwright responded with new memoirs, with songs, but also in his plays and in his prefaces, placing his art of response under the dual patronage of Pascal and Voltaire. Beaumarchais, in his time, contributed to making the factum fashionable among the general public and to renewing the genre, by practicing the art of the point with a sort of excess, and by mixing legal reasoning, satirical discourse, forms of self-narrative and theater. His literary pleadings, noticed by his contemporaries, helped to blur the boundaries with other polemical writings, such as the pamphlet.Finally, Beaumarchais legal briefs link him to a movement for the renewal of eloquence, which spanned the 18th century, from Henri-François d'Aguesseau to Jean-Étienne-Marie Portalis, and which was notably demanded by aspiring lawyers to greater transparency of justice, to less erudite and more accessible eloquence, and to greater freedom of expression, like Joseph Michel Antoine Servan, Jean-Baptiste Mercier Dupaty, Simon-Nicola-Henri Linguet or Jacques-Vincent Delacroix , and by figures like Voltaire and Mirabeau. Abstract:
The aim of this thesis is to improve the formal aspects of the Czech case briefs. The formal aspect represents the language, syntax and overall style of writing of case briefs written by lawyers. In the Czech Republic, the legal aspect is neglected. There is no professional literature dealing with this issue. The consequence of such an approach are then very confusing, stylistically poor-quality texts. Since I could not use any legal books when writing my thesis, I had to draw inspiration from other disciplines (linguistic, journalism, psychology and creative writing). I had to then apply this knowledge to the specific environment of legal writing in my thesis, namely on the case briefs. Fortunately, this legal issue is well mapped in the USA, so I also draw my inspiration from the American professional literature dealing with this issue. The thesis is divided into four chapters. In the first chapter, I focused on what do the typical Czech case briefs look like, what are their formal shortcomings and how to correct them. In the second chapter, I tried to figure out the factors that influence the style of the Czech case briefs. The third chapter is inspired by the American briefs. Abstract:
Women migrant domestic workers (WMDWs) constitute 7.7 percent of migrant workers worldwide, of whom more than a quarter live and work in the Arab region. In Lebanon, as in other Arab countries, WMDWs are recruited through the sponsorship system, Kafala. Under this system, a potential migrant worker can only obtain legal residency and a work permit in the country of destination if she is sponsored by a specific employer. Once in the destination country, the worker cannot transfer to a new employer unless granted permission by the original sponsor. The system heightens the social, economic, and legal vulnerability of WMDWs and has been described as unfree or bound labor and a system of racialized servitude. Yet, Kafala is not a written policy but rather a collection of administrative procedures, customary practices, and socially acceptable norms that are maintained by various players throughout the migration process. The question then arises as to whether advocacy efforts that focus on abolishing Kafala as a legal term would mitigate employers’ exploitative practices that violate the workers’ rights and freedoms, particularly in a country like Lebanon. This policy brief is based on a study carried out under the International Labour Organization’s (ILO) Work in Freedom project designed to mitigate the exploitation and forced labor of women migrating from South to West Asia to work in the domestic and garment sectors. This brief explores knowledge, awareness and attitudes to Kafala by employers in Lebanon.

Abstract:
Zambians in all walks of life are affected by malnutrition, and working through human rights is one key way to address this injustice. Based on research aiming to understand how a ‘right to nutrition’ is perceived by different actors globally and in Zambia, this brief presents a clear framework for a rights-based approach to nutrition in Zambia. This framework identifies rhetorical, legal and practical functions of human rights, and offers a way to think through clearly how different actors might work on the different aspects of rights. Addressing these three aspects of a right to nutrition all together – instead of by very separate constituencies as happens now – is fundamental to a coherent rights-based approach to nutrition. This brief outlines which actors need to come together – from law and policy, activism and communities, across global, national and local levels – and suggests how to start. It lays out the Zambian policy, legal and practical environment as it stands, and suggests actions to move forward in each of these areas in ways that are consistent with the different aspects of rights. Through these steps, Zambia can become known as a hub of action on a right to nutrition, to join with others in using human rights to address the injustice of malnutrition.

Abstract:
African countries are progressing on SDG 13 (climate action) and strengthening their implementation, despite the insufficient delivery of climate finance. Recognising these countries' vulnerability to the impacts of climate change, accelerated efforts are necessary to build an enabling environment — political, legal, technical, financial, and programmatic — aligned with each country’s needs and priorities. This policy brief offers recommendations for national policymakers in Africa to strengthen climate strategies, based on analysis of the 21 VNRs presented by African countries in 2022 (see Notes). It provides insights to better synergise SDG 13 efforts (e.g., with NDCs), considering the state of data reporting and the critical role of finance, capacity-building, and partnerships for climate action. Recommendations: (i) enhance monitoring, reporting, and evaluation for SDG 13 and associated indicators across all levels and sectoral scales; (ii) take urgent action to increase financial flows and improve resource mobilisation; (iii) accelerate the local adoption of disaster risk reduction strategies and climate action plans; (iv) strengthen policy and legal frameworks and increase efforts to improve institutional capacity.

Abstract:
The global pandemic has brought renewed attention toward the everyday challenges in informal settlements. COVID-19 reminds us that southern urban life is rooted in ‘collective’ experiences where toilets and kitchens are shared by multiple families; where the categories of work and home, private and public space overlap; and where the majority live in vulnerable conditions. Despite these challenges, some of the most innovative and collective responses to COVID-19 have emerged from these areas. While informal settlements did face a host of risks and vulnerabilities during the pandemic, local responses have highlighted the resilience of informal settlement communities. However, few informal settlements are actually ‘resilient’ and any local responses must be robustly supported by system-wide change including support from local and national governments, improvements to built infrastructure, and improved access to health care services, among other priorities. The category of ‘informal settlements’ also captures a wide range of settlement types, from a legal slum to an informal settlement with no legal status, with many other types in between. This underscores the need to address fundamental issues that ‘perpetuate conditions of inequity, exclusion and vulnerability’ while also recognising the needs and contexts of different kinds of informal settlements. Whether COVID-19 helps governments recognise conditions of insecurity and vulnerability to address safe and secure housing and infrastructures remains to be seen. This is an update to the previous SSHAP brief on ‘COVID-19 in Informal Urban Settlements’ (March 2020). This evidence review highlights local responses, grassroots efforts, and challenges around COVID-19 recovery within urban informal settlements in South Asia. It focuses on specific examples from Karachi, Pakistan and Mumbai, India to inform policy responses for COVID-19 recovery and future epidemic preparedness and response. We show how local level responses are shaped in these cities where national and international responses have not reached communities at municipal and sub-municipal levels.
