Abstract:
The FBI is the most recognized law enforcement entity in the world. During its nearly 100-year history, the Bureau has been involved in many controversies, most as a result of straying from its stated mission to investigate violations of federal law. This survey is based on personal papers of the former head of the Richmond Bureau, John Edward Lawler. Fortunately for historians, these files, many of which exist nowhere else in the agency's archives, open a window into the operational methods and investigative techniques of FBI agents. An examination of John Lawler's career provides insight into the conduct of field agents and Agents in Charge of field bureaus during the 1940s.

Abstract:
The purpose of this thesis is to examine the artistic production of photo artist Louise Lawler and the evolution of critical response to her work between the 1970s and 1990s. Of main concern are the manner in which early scholarship and exhibition reviews effectively situated Lawler's work within the discourse of institutional critique, a field of critical scholarship and artistic production that examines institutions of art such as museums and galleries. The objective of this thesis is to reexamine Lawler from a feminist art historical perspective using French feminist theory to investigate how her work can arguably be considered to be a feminist intervention into the patriarchal structures of museums, galleries, and connoisseurship. Lawler's dominant practice is photographic in nature, yet she does not consider herself a photographer. Like many artists of her generation Lawler has capitalized upon the indexical nature of the photographic medium, using it as a tool to create images that "document" art objects in situ. She has made her art in all the places in which artworks circulate or are displayed, be it the curated spaces of museums, an auction house or a private house, well-lit gallery show room walls or crowded and dark storage rooms. Throughout her forty-year career Lawler has worked to disrupt the patriarchy of the art world by drawing attention to philosophies of display and exhibition. She has shown us what is not on display within art systems by consistently showing us what is on display. She has refused to comply with systems or organization, crafting textual interventions that disrupt the linguistics of wall labels and titles of artworks. She has fragmented and dislocated the authorship of artists to their works, and she has appropriated curatorial practices to claim both the physical spaces of display and gain control of what objects are deemed valuable enough to be shown there. Lawler's work has consistently interrupted normative practices of art institutions, effectively disrupting the patriarchy inherent within the systems and structures to define art.

Abstract:
The traditional way to study algebraic cycles on an algebraic variety uses the Chow groups. However, in the beginnings of the 90's, Blaine Lawson and Eric Friedlander developed a different way to study algebraic cycles on varieties over the complex numbers. Instead of taking discrete groups of cycles modulo some equivalence relation, they use the Chow varieties to provide the spaces of algebraic cycles with a topology, and use homotopy invariants of those cycle spaces as geometric invariants. In Chapter 1, we collect the basics of the semi-topological theories for algebraic cycles and cocycles, developed mainly by Friedlander and Lawson. This is an exposition of the state of the art, and we do not claim any results. We cover the topology on spaces of cycles, Lawson homology and morphic cohomology, including the bivariant cocycle spaces, and end with the duality theorem relating both theories. In Chapter 2 we reformulate a descent theorem of Guillén and Navarro in the modern language of infinity-categories, following the work of Joyal and particularly Lurie. The aim is to produce a variant of the main extension theorem of Guillén-Navarro with a much simpler proof. In Chapter 3 we study several flavours of descent for the Lawson homology and morphic cohomology. We define refined Gysin maps extending the definition from Friedlander and Gabber. Then we prove an excess intersection formula for those refined Gysin maps, and use it to prove a blow-up formula for the blow-up of a variety along a regularly embedded center. We do not assume smoothness, extending results of Hu to the singular case. After that, we collect several flavours of descent properties for the semi-topological theories. In particular, we have descent results for the covariant variable of the bivariant cycle complexes. On the other hand, not much is known regarding descent properties in the contravariant variable in the general case. We conclude the chapter by proving a generalized duality theorem relating complexes of algebraic cocycles, and extending the results of Friedlander and Lawson. Finally, in Chapter 4 we study morphic cohomology in the particular case of toric varieties. Toric varieties are a class of rational varieties which have a very explicit and rich combinatorial description. We prove Zariski descent for morphic cohomology of toric varieties, with respect to torus-equivariant open sets. Then we develop a spectral sequence that computes morphic cohomology for toric varieties in terms of a very explicit combinatorial description. Toric varieties are a very special class of varieties, of course, but the interest on those computations lay in the fact that very few computations of morphic cohomology for singular varieties are known.

A principis dels anys 90, Blain Lawson i Eric Friedlander van desenvolupar un enfoc diferent per a l'estudi de cicles algebraics en varietats algebraiques complexes. En lloc de fer quocient del grup lliure de cicles per una relació d'equivalència, usen la varietat de Chow per donar una topologia als espais de cicles algebraics, i fan servir invariants homotòpics d'aquest espai de cicles com invariants geomètrics. Al capítol 1, recollim resultats bàsics sobre aquestes teories semi-topològiques de cicles i cocicles algebraics, desenvolupades principalment per Lawson i Friedlander. Aquest capítol és purament expositori, tractant la topologia dels espais de cicles, homologia de Lawson i cohomologia mòrfica, incloent els espais de cocicles bivariants i acabant amb un teorema de dualitat relacionant les dues teories. Al capítol 2 reformulem un teorema de descens de Guillén i Navarro, en el llenguatge de les infinit-categories, seguint els treballs de Joyal i particularment Lurie. LA finalitat és obtenir una variant del teorema d'extensió de Guillén-Navarro, amb una demostració més senzilla. Al capítol 3, estudiem diverses variants de descens per la homologia de Lawson i cohomologia mòrfica. Definim un morfisme de Gysin refinat, estenent la definició de Friedlander i Gabber. Tot seguit demostrem una fórmula d'intersecció excedentària i la usem per a demostrar una fórmula de blow-up per una immersió regular. No assumim que les varietats siguin llises, generalitzant resultats de Hu al cas singular. Després, recollim diverses propietats de descens per les teories semi-topològiques. En particular, demostrem descens cdh per als complexos de cocicles bivariants respecte la variable covariant. En canvi, no coneixem gaire cosa sobre les propietats de descens en la variable contravariant per al cas general. Acabem el capítol demostrant un teorema de dualitat generalitzat, relacionant complexos de cocicles algebraics, i estenent els resultats de Friedlander i Lawson. Finalment, al capítol 4 estudiem la cohomologia mòrfica en el cas particular de les varietats tòriques. Les varietats tòriques són una classe de varietats racionals amb una descripció combinatòrica explícita. Demostrem descens per recobriments de Zariski en varietats tòriques, respecte oberts invariants. Usant aquesta propietat desenvolupem una successió espectral que calcula la cohomologia mòrfica de varietats tòriques de forma combinatòrica. Tot i que les varietats tòriques són una classe molt particular, l'interès d'aquest resultat està en el fet que es tenen molt pocs càlculs d'aquests invariants per varietats singulars.

Abstract:
This thesis addresses the exception regarding lawyers in the Swedish fastighetsmäklarlagens §5 and aims to understand the background and meaning of the exception. Further the thesis addresses whether the main purpose of the estate agents act, the protection of consumers, is satisfying when a lawyer is practicing real estate agency. The study is based on the Swedish fastighetsmäklarlagen and aims to investigate the application of the act on both real estate agents and lawyers as they convey real estate. In order to clarify and understand the application of the law and to receive a view of the specific characteristics of each occupation, the occupational roles are investigated in detail and compared. The act distinguishes between conveying real estate professionally and conveying on single occasions. The demarcation of the concept determines whether the person conveying real estate is obliged to follow fastighetsmäklarlagen or not. A lawyer that is professionally conveying real estate should, according to Sveriges Advokatsamfund, practice the intermediary within the lawyer’s activity. Since professional ethics in practicing real estate agency and practicing law is incompatible the lawyer is obliged to make an assessment of what is professional intermediary within and outside the lawyer’s activities. The study points out that the boundary should be clarified in order for the lawyer to facilitate the assessment. The exception in the Swedish fastighetsmäklarlagen is important if a lawyer is professionally conveying real estate within the lawyer’s activity, but if the intermediary is solely within the lawyer’s general activity the exception has no function. A lawyer is suitable to pursue only those activities that are included within the scope of legal services, including intermediary corresponding to advocacy and not professional intermediary. For those situations that can be listed as professional intermediary, a real estate agent should be hired. Consideration whether the §5 should be changed or removed is required.
Uppsatsen behandlar undantaget avseende advokater i fastighetsmäklarlagens 5 § och syftar på att förstå undantagets bakgrund och innebörd. Vidare behandlar uppsatsen huruvida fastighetsmäklarlagens huvudsakliga syfte, konsumentskyddet, tillgodoses då en advokat utövar fastighetsförmedling. Studien utgår från fastighetsmäklarlagen och utreder lagens tillämpning på respektive yrkesroll, fastighetsmäklaren och advokaten, vid förmedling av fastigheter. För att få klarhet i och förstå tillämpningen av lagen utreds yrkesrollerna ingående samt jämförs för att ge en inblick i yrkesspecifika egenskaper. Lagen skiljer på den som yrkesmässigt förmedlar och den som enbart förmedlar vid något enstaka tillfälle. Gränsdragning avseende förmedlingsbegreppet avgör huruvida den som utövar förmedlingen har skyldighet att följa fastighetsmäklarlagen eller inte. En advokat som yrkesmässigt förmedlar fastigheter ska, enligt Sveriges advokatsamfund, utöva förmedlingen inom ramen för advokatens verksamhet. Då god fastighetsmäklarsed och god advokatsed är oförenliga medför det att advokaten själv måste göra en bedömning av vad som är yrkesmässig förmedling inom och utom ramen för advokatens verksamhet. I studien menas att gränsdragningen bör tydliggöras för att underlätta advokatens bedömning. Undantaget i fastighetsmäklarlagen kan ha betydelse om advokaten yrkesmässigt förmedlar inom ramen för sin verksamhet, men fyller ingen funktion i de fall då advokaten enbart förmedlar inom ramen för advokatens generella verksamhet. Advokaten är lämplig att ägna sig åt enbart sådan verksamhet som ingår inom ramen för advokatverksamhet, däribland förmedling som motsvarar advokatverksamhet och inte yrkesmässig förmedling. I de förmedlingsfall som kan räknas till yrkesmässig förmedlingsverksamhet bör istället en fastighetsmäklare anlitas. Det bör övervägas om 5 § ska förändras och undantaget avlägsnas

Abstract:
This study considers the competence of lawyers. in carrying out the work of interviewing their clients and the value of training and experience in acquiring client interviewing skills. Literature on legal skills is first surveyed to assist in understanding the concept and help decide on methodology. Literature on client, interviewing' and the educational value of experiencee reviewed to provide background to subsequent studies. The first study provides an overall framework for solicitors' work and monitors, through observation and questionnaire, the work of a number of solicitors over a four day period. Client interviewing is found to take up a larger proportion of solicitors' professional work than other categories noted, and observation proves to be a more sound basis for studying detail than a questionnaire approach. The second study assesses the competence of 27 new trainee solicitors at interviewing clients through a detailed monitoring of their performance over thirteen tasks using eighteen different techniques and providing thirteen heads of information. Their performance exhibited many of the deficiencies recognised in the literature. The trainees were then randomly allocated to three treatment groups. One group received full training, one received training without audio-visual feedback of first interviews and the third (control) received no training at all. They all then undertook a second interview which was similarly assessed. Training was found significantly to enhance performance over the spectrum of measurement, an audio-visual feedback) especially enhanced behavioral aspects of performance. In the final study, solicitors and trainees ranging widely in experience were videotaped interviewing their clients and similarly assessed. Experience was not found to have- the expected effect of enhancing performance significantly except in some minor respects, but it did increase the feeling of confidence in interviewing ability. In conclusion, suggestions are made for stronger linking of training with experience in the production of new lawyers.

Abstract:
The Gromov-Lmvson-Rosenberg conjecture for a group G states that a compact spin manifold with fundamental group G admits a metric of positive scalar curvature if and only if a certain topological obstruct ion vanishes. It is known to be true for G = 1 . if 0 has periodic cohomology, and if 0 is a free group, free abelian group, or the fundamental group of an orient able surface. It is also known to be false for a large class of infinite groups. However, there are no known counterexamples for finite groups. In this dissertation we will give a general outline of the positive scalar curvature problem, and sketch proofs of some of the known positive and negative results. We will then focus on finite groups, and proceed to prove the conjecture for the Klein 4-group, all dihedral groups, the semi-dihedral group of order 16, and the rank three group (Z2)3. Throughout the thesis. ko will represent the connective real K-theory spectrum, and KO the periodic real K-theory, and Z2 the field with two elements. It turns out that that the topological obstruction in question lies in the connective real homology ko*(BG) of the classifying space of G. Indeed, our method of proof is to first sketch calculations of ko* (BG), using the techniques and calculations of Bruner and Greenlees. We then give explicit geometric constructions to produce sufficiently many manifolds of positive scalar curvature.

Abstract:
Atkinson's virtual self-preparation for Cambridge is described and discussed, noting the importance of respons-· ible patronage. His objective was university study, a Fellowship, and the Bar, leading to public life. Cambridge's social and academic scene is viewed in the light of Atkinson's 1825 account of his experience, attention being directed to its 'alternative society', and the major change in Mathematics associated with the Analytical Society, betweeen 1817 and 1821, in which year he was Senior Wrangler. Note is taken of criticism, also published in 1825, by Cowling, Senior Wrangler in 1824. Particular consideration is given to Atkinson's assessment of what an University ought to offer, and his claims as to Cambridge's failure; to his not getting a Fellowship, and consequent difficulties when reading for the Bar. His Letters to Huskisson, 1826, are interpreted as a vain bid for the attention of the shipping interest, whose patronage might further his entry to 'the arena of public life'. He expounded the likely effects of repeal of the Navigation Acts, particularly in the light of his recent visit to America. Called to the Bar in 1827, he devoted his life thereafter to the Law, as conveyancer and equity draftsman, but, especially, as author of legal books for practitioners. His earliest work, 1829, was intended to caution the Real Property Commission, set up under Benthamite influence. His last, 1853, surveyed and offered solutions to some problems of the Profession in mid-century, especially those deriving from the 1846 Act, reviving the County Courts, and of which, unlike most of the Bar, he had been a supporter. Here, He. drew again on what he had found in Canada and the United States during an extended visit in 1836.

Abstract:
While several Australian and international studies have explored the family lawyer-client interaction, these studies have been limited to investigations of discrete areas of the lawyerclient relationship and have been necessarily limited in their methodologies. The present study employed a quantitative empirical methodology in an Australian wide field study of 230 family lawyers and 94 clients that investigated the family lawyer-client interaction from a procedural justice framework. Using multivariate analyses, the study establishes that the Tyler and Blader two-component model of procedural justice applies in the lawyer-client dyad and is influenced by the approach of the lawyer, the emotional response of the client, and the level of co-party conflict that the client is experiencing. Further, the study gives meaning to the terms 'conciliatory and constructive' and 'adversarial' as they apply to family law dispute resolution. The study establishes a construct to measure the conciliatory and adversarial approach of family lawyers and identifies that lawyers tend to incorporate a mixture of the two into their work. The results also identify four distinct behavioural factors that characterise the two approaches: the client-centred and interest-based factors characterise the conciliatory approach; and the lawyer-directed and court-focused factors characterise the adversarial. The study found that in terms of perceptions of fairness, and feelings of satisfaction, the clients preferred the lawyers who took a client-centred and interest-based approach, but in circumstances where the clients were experiencing high-levels of conflict, or fear for the safety of their children, they also appreciated the lawyer who was lawyer-directed and court-focused. Overall, the study shows that in order to create a fair and satisfying dispute resolution service for their clients, family lawyers need to maintain a fine balance of family lawyering behaviour. On a general level, the study provides a profile of Australian family lawyers in terms of their approach to dispute resolution, their attitude towards ADR processes and their favoured negotiation styles. It also profiles family law clients in terms of their emotional adjustment to the divorce and their perceptions of the family lawyers assisting them to resolve their disputes. The study substantially expands the procedural justice theory base and has significant implications for practical family law education, government policy, family lawyering, and the ADR and collaborative law movements. The study indicates where future research could benefit these communities.

Abstract:
The problem of the black-white gross earnings gap is near its largest amongst lawyers; blacks earn a significantly lower income than whites (Dinovitzer et al. 2004; Grodsky and Pager 2001). There is also a white advantage in overall job satisfaction amongst lawyers (Payne-Pikus et al. 2010; Dau-Schmidt and Mukhopadhaya 1999). This study examines how social capital contributes to racial differences in these two aspects of overall job success. Social capital theories hypothesize that more social capital leads to increased job status attainment (Lin et al. 1981; Lin 2001). Blacks receive fewer and lower paying jobs than whites, perhaps in part because of a lack of social capital in their lower status and segregated social networks (Braddock and McPartland 1987; Elliot 1999; although see Mouw (2003) for a challenge which showed little to no effect of the use of contacts on earnings). Similarly, Ducharme and Martin (2000) found that social relationships with co-workers increase overall job satisfaction. This project specifically examines social capital in the attorney job market, because this is a specific job market in which there are strong theoretical reasons to expect social capital to affect wages and job satisfaction. Using Portes' (1998) definition of social capital, the ability to secure benefits from one's social networks, I distinguish between three major social networks (professional, non-professional, and kinship), and then derive hypotheses about their effect on earnings and job satisfaction. The main hypothesis is that black and white differences in professional and non-professional networks account for part of the earnings and job satisfaction inequality between blacks and whites. The study also develops competing hypotheses to test the effect of kinship networks on job satisfaction. This study takes a mixed methods approach. Nationally representative longitudinal data from the After the Juris Doctorate Survey (AJD) test the hypotheses to see if there is an effect of social capital on earnings and satisfaction. Qualitative interviews seek to further investigate these relationships and look for emerging themes for racial differences in earnings and job satisfaction. The interviews take place with nine black and white lawyers in Chicago. The survey results reveal the significance of professional social capital networks in obtaining a higher salary among private firm attorneys. The effects of social capital do not vary across race. However, there are some black-white differences in the types of social capital used. The interview results reveal the significance of social capital in acquiring clients in small private firms, and of mentor-protégé relationships. Concluding remarks discuss the significance of professional and non-professional social capital in and beyond the legal profession, explanations for the higher levels of social capital in whites, and suggestions for ways to decrease these racial social capital disparities.

Abstract:
Cette thèse porte sur le rôle des avocats d’intérêt public dans les procès que les paysans intentent pour défendre leur droit au logement en Chine. Concernant les avocats d’intérêt public en Chine, deux figures sont valorisées dans cette thèse : l’avocat gouvernemental travaillant comme médiateur et l’avocat libéral travaillant comme acteur social. Le premier type d’avocat se compose de deux sous-groupes : les avocats recrutés comme fonctionnaires par le gouvernement local et les avocats libéraux sollicités provisoirement par le gouvernement local dans certaines affaires. Le deuxième type est également divisé en deux groupes : les avocats militants dans les grands cabinets et les avocats des petits cabinets. Dans sa dimension historique (chapitre 1), Cette profession s’inscrit dans la culture confucianiste de l’Empire - même si elle subit aussi l’influence de l’implantation juridique occidentale depuis la fin du XIXe siècle. Le concept occidental d’avocat a été introduit par le régime chinois de la dynastie de Qing de façon « top-down », et ce concept s’est superposé à la tradition du « Songshi ». Ces deux courants composent le fond sur lequel s’est construite la profession d’avocat chinois en se concentrant d’abord dans la région maritime du sud-ouest, surtout dans les grandes villes comme Shanghai et Canton. Dans les régions continentales, l’image de l’avocat reste encore fortement influencée par la tradition du « Songshi ». A partir de l’instauration de la République populaire de Chine, la profession d’avocat a obtenu du régime sa reconnaissance, mais elle a hérité de la tradition locale du « Songshi », et elle a fait partie des gestionnaires du régime (les fonctionnaires), au lieu d’être une profession libérale. Cette recherche met aussi en évidence la spécificité de l’institution judiciaire chinoise (chapitre 2): l’encastrement du système politique dans le système judiciaire conduit à une symbiose ; le passage par le politique est l’unique moyen de résoudre les problèmes ; les questions judiciaires et les problèmes sociaux sont politisés. Au niveau macro, l’organisation des grands corps de l’État est complexe et chaque corps défend son propre intérêt, bien davantage que l’intérêt général. Au niveau micro, tous les acteurs de l’action publique ont envie de devenir acteurs de l’action politique. Les avocats gouvernementaux sont un exemple, mais les avocats libéraux veulent aussi pénétrer dans l’administration de l’État par les activités extérieures de l’institution et du monde judiciaires. Les « cause lawyers » ont des prédispositions politiques (à gauche et à droite), et ils se confrontent au défi de défendre l’intérêt de leurs clients en même temps que de réaliser leur objectif politique. Dans le chapitre 3 et le chapitre 4, il nous montre les logiques d’activité dans différents groupes d’avocat, surtout dans l’affaire de démolition et d’expropriation. L’analyse de l’activité des avocats gouvernementaux qui travaille comme médiateur montre que ceux-ci utilisent la légitimité de la domination de l’État pour faire croire aux paysans que la destruction de leurs logements est une action politique légale. Leur rôle est plutôt celui d’un médiateur ou d’un conseil judiciaire que celui d’un avocat. La recherche porte sur les avocats libéraux s’engageant dans l’action publique comme acteurs. À cause du caractère politique de leurs interventions devant le tribunal, ces avocats perdent souvent leurs procès. Ils organisent des mobilisations à l’extérieur du tribunal comme des actions de ‘lobbying’, en espérant lancer un scandale sur les forums internet de sorte à faire pression sur les groupes d’intérêt. My study is about the role of Chinese public interest lawyers in the case of housing demolition of peasants. I want to know if there is a legal profession in China who has some similarity of cause lawyers in America. If there is, considering the reality of Chinese society, what are the same point and the difference between this professional group and the cause lawyers in the liberal democracy? These questions are relatives to the complex relation among the law, the politic, and the social change in chine. To answer these questions, I try to analyse the role of the lawyer in this relation from three dimensions. Firstly, it is necessary to describe the Chinese legal system in which the lawyer shows their characteristics, specially the relation between the law and the politic in China(Chapter 1 and chapter 2). Secondly, on the basis of interviews with the lawyers, observing the activity and the strategy of the lawyer inside and outside of their professional domain, I seek to make a conclusion of the specificity of the Chinese public interest lawyers (chapter 3); Thirdly, I will try to make a comparison with the cause lawyers according to these characteristics of Chinese public interest lawyers(chapter 4). This comparison can answer the question in the beginning of my study and give a good window into the role of Chinese public interest lawyer

A hipótese a ser investigada é a de que o autor não realiza uma crítica ontológica dos métodos que critica. A confirmação dessa hipótese traz problemas, pois esse tipo de crítica é fundamental à concepção teórico-filosófica da qual o autor faz parte, o Realismo Crítico. Ao final da análise será possível confirmar que Lawson indica elementos muito importantes para entender a ascensão do projeto matematizante na Economia, mas o autor não realiza uma crítica ontológica completa dessas concepções. Em geral, esse caráter incompleto está diretamente relacionado ao tipo de abstração feita por Lawson, que isola (em determinado nível, por abstração) as práticas teóricas da academia (especificamente em Economia) e acaba por ofuscar a conexão desse tipo de prática com uma concepção totalizante de sociedade. Para se chegar a esse resultado será preciso, no primeiro capítulo, defender que a crítica feita por Lawson ao dedutivismo a partir do Realismo Crítico é válida e, portanto, a presente análise é pertinente. Abstract: In this work, the main objective is to analyze the criticism made by the British author Tony Lawson to the deductive or mathematical-formalist methods that characterize most of the research done in Economics in the last 80 years or so. The hypothesis to be investigated is that the author does not perform an ontological critique of the methods he criticizes. The confirmation of this hypothesis brings problems, since this type of criticism is fundamental to the theoretical-philosophical conception of which the author is part, Critical Realism. At the end of the analysis it will be possible to confirm that Lawson indicates very important elements to understand the rise of the mathematical project in the economics, but the author does not realize a complete ontological critique of these conceptions. In general, this incomplete character is directly related to Lawson's type of abstraction, which isolates (at some level) the theoretical practices of academy (specifically in economics) and, with this blurs the connection between this specific practice and a totalizing conception of society. In order to achieve this result, it will be necessary, in the first chapter, to defend that Lawson's critical realist critique of deductivism is valid and, therefore, the present analysis is pertinent. Abstract:
This thesis is concerned with a very important aspect of the political life of one of the most neglected figures of nineteenth century British political history, Sir Wilfrid Lawson (1829-1906). Lawson, an extreme radical entered Parliament in 1859, where he remained almost continuously until his death. Today Lawson's name his rarely recalled, except for his work on temperance reform, where his critics continue to describe him as a temperance fanatic and a 'one idea man'. The reality of the situation is quite the reverse; Lawson was a man with undeviating radical principles, with plenty to say on an endless stream of subjects. Lawson was perhaps the most Cobdenite of the Cobdenites, especially in the matter of Britain's imperial and foreign policy, which is the main focus of this thesis. As such he campaigned against loans for standing armaments and all forms of aggressive warfare. When war finally came, as was often the case, Lawson vehemently opposed it, and supported a series of defiant parliamentary battles against government interventionist policies. Lawson had no enthusiasm for British expansion or for the pursuit of imperial glory, or any interest in promoting its civilising mission abroad, which he considered a distraction, supported by the ruling aristocracy, as a means of delaying the advance of much needed home reforms. I have structured the thesis around a number of key events in the development of British foreign and imperial policy in the period 1870 to 1892, primarily the expansionist programme promoted by Lord Beaconsfield, Gladstone's intervention in Egypt, and the affairs of Ireland and Home Rule. All were of major significance at the time and Lawson was heavily involved in the debates surrounding them.

Abstract:
This study investigates the knowledge that legal practitioners use to solve authentic practical legal problems in naturalistic settings. The study examines the declarative and procedural knowledge that practitioners use in that context and whether experienced practitioners use knowledge organised in encapsulated and script form (Boshuizen & Schmidt, 1992; Schmidt, Norman, & Boshuizen, 1990) to enable ‘expert’ performance. The purpose of the study is to provide an empirically-based understanding of the knowledge used in solving real-life practical legal problems, for the information of the providers of practical legal training in Australia and other common law countries. The providers of that training use assumptions about that knowledge and how it is acquired, which do not always rest on coherent theoretical or empirically-derived foundations. The study uses the lawyering literature to identify the knowledge such literature considers is required to solve practical legal problems in lawyer and client interview settings. The study also examines the assumptions about the nature of that knowledge, and how it is acquired, which are apparent in the approaches of the providers of practical legal training. The limitations of those assumptions are identified from a cognitive perspective. The study examines cognitive conceptions of the knowledge used in problem solving in particular fields and how that knowledge becomes proceduralised and organised into structures called chunks and schemas. A particular examination is made of cognitive theories developed in the field of medical problem solving, which use the concepts of ‘encapsulations’ and ‘illness scripts’ to explain ‘expert’ performance in diagnosing disease in clinical settings. This analysis is used to synthesise the prediction that experienced legal practitioners may develop and use structures similar to encapsulations and illness scripts in problem solving. This prediction is based on the similarities between the way medical practitioners and legal practitioners are educated and trained, and are taught to solve problems using a hypotheticodeductive method (or a domain variant in the case of law), and on the similarities between clinical settings and lawyer and client interview settings. The study also examines theories that explain human problem solving by reference to a metaphorical ‘problem space’, and synthesises the prediction that practical legal problem solving can be explained by a problem space theory that was developed to accommodate complex, ill-defined problems. That theory uses the concepts of a problem zone to reflect the ill-defined nature of the problem as presented to the problem solver, a search and construction zone to reflect the phenomenon that the problem solver will have to construct operators to use to solve the problem, and a satisficing zone to reflect the phenomenon that there will be no single unambiguous solution to the problem (Middleton, 1998). The study uses the lawyering literature to identify the characteristics of practical legal problems in a lawyer and client interview setting. The cognitive literature is used to identify the cognitive conceptions that correspond to those characteristics. It is argued that these problems are complex, ill-defined problems that have to be found by the problem solver using weak problem solving strategies such as problem decomposition, attribute identification and means-ends analysis (Simon, 1973; Dillon, 1982; Newell, 1980). Based on these predictions two research questions are developed as follows: How do legal practitioners find and construct practical legal problems? Are there differences in the knowledge that experienced legal practitioners use and that which novice practitioners use? Do those differences reflect differences in the individual practitioner’s underlying knowledge and how that knowledge is organised? These questions are investigated in four case studies. Two of these studies involve experienced legal practitioners and two involve novices. These studies reveal that all the subjects used similar general problem solving strategies to find and construct problems. The subjects all constructed a series of problems rather than one large problem. The subjects did not all find and construct the same problems and some subjects’ constructions of problems changed as new information came to light. Most subjects did not finish the construction of problems at the interview. The processes that the subjects use to construct problems can be explained by Middleton’s (1998) problem space model, although this study suggests that model needs to be modified to accommodate the on-going emergent character of practical legal problems as they occur in lawyer and client interview settings. The investigation revealed qualitative differences between the problem attributes and moves that the experienced subjects identified and those that the novices identified. In summary, the experienced subjects identified attributes and moves that were more detailed, more directly related to the ‘facts’ and more concrete than those that the novices identified. Both the experienced subjects and the novices appeared to rely on recognition (Newell & Simon, 1972) to identify problem attributes and moves rather than on any apparent step-by-step legal analysis and reasoning process. This study suggests that the superior performance of the experienced subjects may be explained by their use of knowledge in encapsulated and script form, as predicted. The study discusses the implications of its findings for practical legal training courses as a need to provide students with general problem solving knowledge, provide them with the knowledge that they will need to recognise problems in specific areas of practice, to help them start to develop knowledge in encapsulated and script form, and to develop an understanding of the limits of institutional training in developing professional expertise.

One of the musical conductor's fundamental responsibilities is leading others to interpret and create music in a manner that was unfamiliar, unimagined, or inconceivable prior to the rehearsal experience. Regardless of the level or type of musical ensemble being conducted, each person within that ensemble possesses a unique perception of the musical, pedagogical, and stylistic elements, which must be compromised—if not completely abandoned in some instances—in the process of creating a cohesive musical ensemble. In addition to personal musical preparation and leadership, conductors are also responsible for leading, managing, and encouraging the carrying out of necessary administrative details that directly affect the desired musical product, such as resource management and staff development.This study begins by creating the general profile of an ideal leader based on theories common to numerous leadership and management scholars. Then, utilizing the established profile of the ideal leader, Robert Shaw's leadership behaviors and administrative practices were studied, documented, and organized into categories that correspond with those found in the profile of the ideal leader, providing an in-depth profile of Shaw's character, convictions, and competence, both as a human being and as a musician.Robert Shaw was not only an exceptional musician, but also an accomplished leader and manager of multifaceted musical organizations. As a result, Shaw's time was not only occupied with musical study and preparation, but he was equally aware of the administrative and organizational details necessary for the music to reach its highest potential. As is true with all successful leaders, Shaw delegated many duties and responsibilities to others, such as Nola Frink, Charles McKay, and Nick Jones. Even so, he maintained an acute awareness of the multitude of tasks being performed under his aegis. Also a vital leader within his local community, Shaw's leadership reached far beyond the realm of conducting. Frequently speaking in churches, social clubs, and graduation ceremonies, he was an activist for the arts, civil rights, and contemporary music throughout his life.

Narcissism has been identified as a threat to society and the individual. Individuals with high levels of narcissism (narcissistic personality disorder) struggle to maintain jobs, stable relationships, and healthy life perspectives. Without knowledge about the origins of narcissism, mental health professionals may only be treating the symptoms of narcissism and not the factors that perpetuate its development. The purpose of this study was to measure narcissism in farming and law careers and to determine whether career is a factor in the development of narcissism. It was predicted that career would be an important developmental event and process that would have the ability to influence character traits (such as narcissism) through self-presentation, a process in symbolic interaction theory. To date, there has been no research on type of career as a factor in the development of narcissism. A cross-sectional design and 2-way independent analysis of covariance was used to compare narcissism in farming (N = 46) and law careers (N = 267) at the beginning and middle of individuals' careers, as well as after 10 years of experience. Statistical analysis showed no significant difference in narcissism between farmers and lawyers. Further, there was no significant difference in narcissism levels at the different stages of a law or farming career. Thus, career may not be a factor in the development of narcissism, and future research, theory development, treatment design, and cultural considerations may be best served by focusing on other phenomena to explain narcissism's effect in adulthood.

Access to justice, particularly access to civil legal services, is a well-recognized problem for the Canadian legal system, with a recent estimate suggesting that 44.6 per cent of Canadians over the age of 18 – approximately 11.6 million people – have experienced a civil legal problem over the last three years, but also that less than 10 per cent of those individuals obtained legal assistance for that problem. Another problem for the Canadian legal system is the high rate of dissatisfaction among young lawyers – particularly the high rate of attrition among women and minorities. This thesis suggests a corrective for both these problems: an innovative type of law firm that provides accessible civil legal services while also providing an attractive work environment for lawyers. Through a case study of Pivot Legal LLP, a small firm formerly located in Vancouver’s Downtown Eastside, this thesis examines whether it is possible to run a sustainable legal practice that includes providing legal services to low- and middle-income individuals. Based on this case study, there is reason to believe that an innovative law firm model that provides low cost legal services is possible and would be a useful contribution to other efforts to improve access to justice.

The criminal defence lawyer is perhaps the most publicly identifiable and controversial figure in the criminal justice system, and is considered by many to represent the cornerstone of adversarial criminal justice. However, there is significant evidence that the context within which criminal defence lawyers operate in England and Wales is rapidly, and fundamentally, changing. Using a wide range of theoretical literature and commentary, the thesis begins by exploring theoretical constructions of the defence lawyer's role, and proceeds to an assessment of whether the traditional, theoretical, conception of the role remains relevant and useful in the context of the 21st century. It continues with an extensive exploration of modern, formal, regulation governing criminal defence lawyers in England and Wales, including relevant legislation, case law and professional conduct rules. The thesis aims to explore ethical conflicts in criminal defence work by identifying and analysing tensions between the various obligations owed by the defence lawyer. All of these issues are explored in the context of ‘real-life’ criminal defence practice through an empirical study, using the novel ‘vignette technique’ to simulate ethical conflicts that defence lawyers might face. Having explored theoretical, formal and practical conceptions of the defence role, the thesis draws conclusions about the usefulness and relevance of theory to the modern role, whether that theory is reflected both in formal regulation and in practice, and whether ethical conflicts pose a significant barrier to the functioning of the defence lawyer's role. Finally, using the research data, the thesis raises questions about the continuing validity of adversarial conceptions of criminal procedure in England and Wales, and makes proposals concerning the future of theoretical debate relating to the role of the criminal defence lawyer.

Abstract:
Understanding architecture through a contemporary context of the transformations of art and technology was the springboard for this thesis. Identifying folding as a basic transformation became the focus for developing an Old town, Alexandria, Virginia law firm building. Folding is conceptually used in the spatial and inhabitable forms of the building as well as the materials, textures, and finishes of the walls, ceilings, and floors. Folding is structurally investigated by taking once planer and flimsy elements and creating folded, rigid, and load-bearing elements. Architectural concepts of day lighting, shading, rain runoff, partitioning, vertical circulation, horizontal circulation, library stacks, file storage, solar energy collection, gardening, building services, furnishings, reading, and inhabitation are all thought of in terms of folding. Designing a law firm for Old town, Alexandria, Virginia was chosen from a random number generating process cross referenced with the Alexandria, Virginia phone book. I interviewed a local law firm and based the programmatic spaces on their office needs and relationships.

Sense-making in interpreter-mediated encounters (IMEs) in a lawyers’ office has not been previously investigated on the micro-level by utilizing post-IME interviews of a reflective nature. This case study addresses this shortcoming by examining an IME in the Netherlands between a Syrian immigrant and his lawyer. It addresses three questions: 1) How does the interpreter translate the lawyer’s utterances? 2) Does the immigrant understand these utterances (via the translations), and what can be learned from his answers in terms of the sense-making processes? 3) How does the interpreter explain his translation decisions, and what can be learned from his answers in terms of the sense-making processes? After analysing the transcribed IME, two semi-structured interviews were conducted: the first with the immigrant and the second with the interpreter. Wadensjö’s (1998) analytical model is extremely valuable. However, it needs to be developed somewhat into order to fully understand how sense-making processes develop; her use of dialogism is accordingly extended to incorporate also situation-transcending knowledge/resources (STK/R), thereby going beyond the situated context. Her taxonomy is also extended. The findings show that the immigrant has understood the majority of the lawyer’s utterances, and that his understanding of them was not dependent solely on the translations; he has also resorted to a good extent to STK/R during the process of sense-making. However, this does not mean that STK/R helps in all cases, for not all originals were understood, even those in which STK/R played an important role. It is noticeable that these non-understood translations are mainly of a legal nature. Further, we have observed that the interpreter understandably does not have an explanation for every translation decision. In such cases, the factors that have been found to have probably influenced the interpreter’s translation decisions relate to the nature of interpreting as a profession, to the characteristics of the discourse utilized in it, and to constraints involving memory. Where the interpreter does mention an explanation, he has been found to be adopting a means of approaching communication which utilises decisions corresponding to central concepts in dialogism. The major theoretical contribution of this thesis is that it extends the model of Wadensjö using Linell’s dialogism to incorporate STK/R, in order to more adequately study sense-making. On a practical level, this gives rise to a new approach to data elicitation, which has not previously been applied to dialogue interpreting, enabling participants to re-construct their internal dialogue about meaning-making.

This is a study of a ledger written by Andrea di Gherardo Casoli between the years 1387 and 1412. Andrea was a lawyer in the Tuscan city of Arezzo, shortly after the city lost its sovereignty to the expanding Florentine state. While Andrea associated his identity with his legal practice, he engaged in many other, diverse enterprises, such as wine making, livestock commerce, and agricultural management. This thesis systematically examines each major facet of Andrea's life, with a detailed assessment of his involvement in rural commerce. Andrea's actions revolved around a central theme of maintaining and expanding the fortunes, both financial and social, of the Casoli family.

We determine several families of so-called associative 3-dimensional manifolds in R7. Such manifolds are of interest because associative 3-cycles in G2 holonomy manifolds such as R6 × S1, whose universal cover is R7, are candidates for representations of fundamental particles in String Theory. We apply the classic results of Harvey and Lawson to find 3-manifolds which are graphs of functions f : Im H → H and which are invariant under a particular 1-parameter subgroup of G2, the automorphism group of the Cayley numbers, O. Systems of PDEs are derived and solved, some special cases of a classic theorem of Harvey and Lawson are investigated, and theorems aiding in the classification of all such manifolds described here are proven. It is found that in most of the cases examined, the resulting manifold must be of the form of the graph of a holomorphic function crossed with R. However, some examples of other types of graphs are also found.

The Amtliche Schriften, published for the first time in their entirety by Klaus Hermsdorf in 1984, are not only distinguished informed pieces in their own right but an integral part of Kafka's output and life. They document the daily work at the Arbeiter-Unfall-Versicherungs-Anstalt which constitutes the conditions and substance for much of Kafka's creative writing. Conversely Kafka brought to his professional work: his Reports, 'Dienstreisen', court-case representations, prescription of safety measures, negotiations with State, Institute and manufacturers, his legal training, an analytical disposition, succinct persuasive prose and a basic, innate preoccupation with justice and authority that informs all his work. My first section covers Kafka's working years. It details the scope of his work, his seniors' assessments, his promotions, degree of commitment, pressures on his time, the effects of the war-years and his indispensability to the Institute, his deterioration into fatal illness in 1917, his last years and death in 1924. The second examines the business Reports and Letters, giving important reasons for reading them. These are technically informed, sociological, lawyerly documents which had reformative aims and effects and a positive optimistic tone rare in Kafka as he acts as judge, advocate, strategist and negotiator, even critic. The reports provide thematic and linguistic material; the letters reveal less well-known aspects of Kafka, his modesty, yet persuasive persistence in safeguarding his financial security. The ensuing sections examine the effects on the creative work of the 'Dienstreisen', the experience of industry and technology, and the image of the bureaucratic 'Apparat'. The latter is hard to separate from Kafka the 'Beamte'. The last sections concern Kafka's preoccupations with justice and authority, conditioning both his reformative legal work and his creative work. They explore Kafka's relation to social justice and probe some of the roots of his attitudes, from his upbringing to his Judaic heritage.
