Abstract:
One of the fundamental values of any legal system is the principle of certainty of law, whose highest expression is its encoding in the various bodies of law. However, today this value is strongly, albeit inadvertently, called into question by the European Union - in particular, by a set of principles, and related mechanisms, designed to ensure uniformity of law across the EU Member States. These include the principle of primacy of EU law over the laws of its Member States, the principle of the disapplication of national laws that are incompatible with EU law (including the provisions of directives that have not yet been implemented, or that have implemented in a manner deemed incorrect), the principle of interpretation of national law in conformity with EU law and, above all, the conclusive and binding effect of the judgments of the EU Court of Justice even when they provide a 'unique' or unusual interpretation, not expressly provided for in EU law. These principles are now well-established benchmarks in supreme and national courts as well, to the extent that there has been a radical shift in the system and hierarchy of sources of law in each legal system of the EU Member States, at the expense of citizens, businesspeople and legal practitioners, who all find it hard to identify the exact rule to apply to specific cases.

We examined the performance of airborne light detection and ranging (LiDAR) data obtained in 2011 for leaf area estimation in deciduous broad-leaved forest using the Beer–Lambert law in Takayama, Gifu, Japan. We estimated leaf area index (LAI, allometry-LAI) and vertical leaf area density (LAD) using field survey data by applying allometric equations to estimate leaf-area of trees and a Weibull distribution equation to estimate vertical leaf distribution. We then estimated extinction coefficients (Ke) of LiDAR data for three height layers from the ground to the canopy top using the vertical LAD and vertical laser pulse distribution. The estimated PAI (LiDAR-PAI) using the Beer–Lambert law and Ke, when treating the canopies as three height layers, showed a significant linear relationship with allometry-LAI (p < 0.001). However, LiDAR-PAI when treating the canopies as single layer saturated at a PAI of six. It was similar to the lesser PAI estimation by hemispherical photography or relative photosynthetic photon flux density which treated the canopy as a single layer, compared to LAI measurements by litter traps. It is therefore important to allocate distinct Ke values to each of the multiple height layers for an accurate estimation of PAI and vertical PAD when applying the Beer–Lambert law to airborne LiDAR data.

If you scan through the law reports ofthe last century or so, you will come across a sprinkling of references to Natural Law, commonly in conjunction with some such phrase as “manifest nonsense”.1 Introductory books dealing with the sources of law hardly place it in the forefront of their treatment, to say the least; and anyone writing a practitioners' manual on some practically useful area of law who began with a chapter on Natural Law would be thought to have taken leave of his senses. Go back two or three hundred years or so and the picture looks very different. References to the law of nature abound in the reports of the seventeenth and eighteenth centuries; institutional writers dealing with the Common Law will regularly list Natural Law as one of its principal sources, and when Stewart Kyd wrote the first English book on what we would now call company law2 the obvious starting pointfor his first chapter was the work of the Natural Lawyers of the previous century. England, like everywhere else in Europe, had been caught up in a fervour of Natural Law thinking. Legal historians, of course, are well aware of this, but commonly portray it in their books as part of the background against which the Common Law was worked out, rather than as an integral part ofthe story of English law's development.3 This downplaying of the practical significance of Natural Law represents something of a lost opportunity, not merely because it can give a frame of reference within which some sense can be made ofthe reorientation of English law in the eighteenth century, but also because it provides an important point ofcontact between the all-too-insular history ofEnglish law and the apparently more homogeneous legal history of the rest of Europe.
