Abstract:
This book offers the first comprehensive legal analysis and empirical study of accountability concerning the EU’s peacebuilding endeavours—also referred to as civilian crisis management. Since 2003, the EU has launched more than twenty civilian missions under the CSDP in conflict-torn regions in Eastern Europe, the Western Balkan, sub-Saharan Africa, the Middle East, and South East Asia with the aim of restoring stability and security. Mission mandates cover a broad range of multidimensional tasks, such as border monitoring, rule of law support, police training, law enforcement capacity building, and security sector reform. In light of these numbers and tasks and given (recent) alarming insights from practice, it begs the question who is accountable (to whom) for the EU’s manifold extraterritorial peacebuilding activities. With a view to answering this question, this book combines tools of legal scholarship with insights from political science research, both in analytical and conceptual terms. The thorough analysis of the law and practice of political, legal, and administrative accountability in civilian CSDP leads to the following conclusion: when scrutinizing the institutional and procedural framework set out by law, the accountability assessment is sobering, but when approaching it from a practice angle, the verdict is promising—in particular as regards accountability at the EU level.

Abstract:
Abstract International investment law is at a crossroads. Civil society groups, prominent think tanks, and international organizations are calling for widespread reform. At the centre of controversy are international investment agreements (IIAs) and investor-state dispute settlement (ISDS). Over 1,000 legal claims have been brought by foreign investors under IIAs since the mid-1990s, resulting in multimillion-dollar fines imposed against governments for policies related to the environment, natural resource governance, and access to basic services among other areas of public concern. Governments targeted by investor claims are pursuing a variety of reforms that range from the incremental to paradigm-shifting. These different responses raise important questions about the politics of infringement and reform. Why do governments infringe on IIAs despite the costs of doing so? Why do some governments heavily targeted by investor claims pursue more substantive reforms than others? This book provides a timely examination of infringement and reform in Latin America, where governments felt the sting of investor claims sooner and with greater frequency than in other regions. It focuses on Peru, Argentina, and Ecuador, countries that responded very differently to waves of investor claims. Based on interviews with government officials and international lawyers, as well as an extensive analysis of legal transcripts, detailed case study chapters examine the conditions that prompted investor claims and the factors that inform countries’ reform agendas. In doing so, the book illustrates the conditions under which IIAs constrain state behaviour and how different belief systems produce different responses to external pressures for treaty compliance.

Abstract:
This chapter talks about how there are perfection requirements for only certain types of mortgage or charge created by non-corporate debtors over their property. The perfection of mortgages and charges over goods by non-corporate debtors is for the most part governed by statute, principally the Bills of Sale Acts. General assignments of book debts must also be registered under the Bills of Sale Act 1878. In addition, there are separate provisions for agricultural charges and charges created by cooperative, community benefit, and building societies. The chapter also shows how, in the Queen’s Speech in 2017, the government announced its intention to reform the law on bills of sale pursuant to recommendations by the Law Commission, which in July 2017 published a draft Goods Mortgages Bill for consultation.

Abstract:
This chapter looks at the role and development of the Financial Action Task Force (FAFT). The FAFT was formally established at the G7 Summit in Paris in July 1989 by the Heads of State or Government of the G7 countries and the President of the European Commission. The main concern motivating the establishment of the FATF was the proliferation of drug production and drug-related activities, including the laundering of drug proceeds. The G7 leaders understood that decisive action at the national and international levels would be needed to deal with this concern. The chapter looks at how the FAFT has changed since its founding. Today, the objectives of the FATF are to set the international standard, and promote effective implementation of measures, for combating money laundering, financing of terrorism, and other related threats to the integrity of the international financial system. It works to generate the necessary political will to bring about national legislative and regulatory reforms in these areas. It also monitors the progress of its members in implementing necessary measures.

This chapter discusses the classification of the cause of action and the classification of a rule of law as they relate to private international law. Classification of the cause of action refers to the allocation of the question raised by the factual situation before the court to its correct legal category, whereas classification of a rule of law is the identification of the department of law under which a particular legal rule falls. After explaining what ‘classification of the cause of action’ and ‘classification of a rule of law’ mean, the chapter considers the basis on which classification is made. In particular, it looks at two cases that illustrate the international spirit in which English judges fulfil the task of classification. It also examines the classification of an English rule and classification of a foreign rule (parental consent to marry, bona vacantia).

This chapter focuses on the role of the Guardian Council, an institution recognized as one of the main pillars of the Islamic government in Iran. Its religious-theoretical fundaments can be found in the doctrine of the Islamic state, the enforcement of the Islamic law, and the supervisory function of the clerical jurists. Under constitutional law, the task of the Guardian Council follows from the general rule in Art. 4 of the Iranian Constitution, which defines the Islamization of the legal system as a leading principle. In practice, the Council has often acted as an instance defending the status quo and has blocked the initiatives of a reform-minded parliament.

Between 1930 and 1962, the eminent Sanskritist and lawyer Pandurang Vaman Kane (pronounced KAH-nay) produced a five-volume monograph entitled History of Dharmaśāstra (Ancient and Mediaeval Religious and Civil Law), published by the Bhandarkar Oriental Research Institute in Pune, India. This work of over 6,500 pages provides much more than a narrow focus on law or the special genre of Sanskrit literature devoted to religious and legal duties, the Dharmaśāstra. It contains rather something close to an intellectual history of Hinduism, from its origins in the Vedic texts to contemporary debates about the “reform” of Hinduism in nineteenth and twentieth centuries. Kane understood his task as presenting the broadest possible survey of the role legal, religious, and ethical thought in the history of Hinduism, with regular incursions into other religious traditions as well. A modern scholar of Dharmaśāstra, Richard Lariviere, is fond of saying, “We all make our living from Kane’s footnotes.” Indeed, Kane’s work has become a constant source of reference and orientation in South Asian studies of law, religion, ritual, literature, history, and more. It is a work that has perhaps literally launched a thousand dissertations because it is so easy to refer a student or a colleague to the appropriate section of Kane as a way to get their bearings in relation to hundreds of topics in the fields of Hindu studies or Indian social and intellectual history....

Abstract:
The Affordable Care Act (ACA) required that each state set up a health insurance exchange or lose control to the federal government. Because Republicans had supported the concept before it became part of Obamacare, virtually every state was expected to cooperate and implement this core part of the law. However, 34 states refused to participate. This is a stunning miscalculation by the Obama administration. This book tells the story of what happened in the final two states to choose state control and the two that came the closest. The most intense split was not between Republicans and Democrats, but within the Republican Party. Governors were the most important people in the fight over exchanges, but did not always get their way. The Tea Party defeated the most powerful interest groups. State-level and national conservative think tanks were important allies to the Tea Party. The relative power of these groups was shaped by differences in institutional design and procedures, such as whether a state has term limits and the length of legislative sessions. Opposition was more easily overcome in states whose conditions facilitated the development of legislative “pockets of expertise.” This is a dramatic example of opponents using federalism to block national reform and serves as a warning of the challenge of inducing state cooperation in other policy domains such as the environment and education. Understanding the state-level fights over the ACA’s implementation is crucial to understanding the impact of future reforms.
