Abstract:
This chapter examines Article 42 of the Vienna Convention on Diplomatic Relations which specifies the professional or commercial activity done by a diplomat. Article 42 states that a diplomatic agent shall not practise for personal profit any professional or commercial activity in the receiving State. The basis of the Article comes from the notion that it would give the sending State assurance that its diplomatic agents abroad would limit their activities to their official duties. It would assist the receiving State by eliminating difficult problems, and would enhance the dignity of the diplomatic corps accredited to its government. Lastly, it would serve to protect diplomatic agents from any suggestion that they might be using the prestige of their office to further their outside interests. In addition, the chapter also describes the relationship between Article 42 and Articles 31.1 (c) which deals with immunity and 34 (d) which tackles taxes on private income.

Abstract:
This chapter examines how the Chicago Police Department evolved into a professional police organization based on the ideology of paternalism. The election of Thomas Dyer as mayor in 1856 started a five-year period of contestation over the basic shape of the new police force. On the surface, this fight pitted law-and-order Republicans against Democratic supporters of immigrants and looser law enforcement. But party politics tells only a fraction of the story. The underlying dispute was between two conflicting visions of the police, each of which had supporters particularly within the Republican Party. Some members of both parties, most notably Dyer, a Democratic, and Republican Mayor John Wentworth, sought to fit the police into the older paternalistic method of keeping order. This chapter considers how the Chicago police came to occupy a central place in city machine politics and discusses Wentworth's organizational police policies that were consistent with his broader paternalistic vision of the institution. It also describes the police's daily activity between 1855 and 1862, including dealing with the problems arising from the Civil War.

Banks are in the front line of the battle against fraud and money laundering. The importance of denying banking facilities to criminals and fraudsters, especially where there is corruption among those who hold public office and the trust of their people, has been recognized in the context of claims made against banks under English law. An abiding theme of English commercial law is the desire to establish rules that are certain so that participants in commercial activity ‘know what ground to go upon’. However such certainty is difficult to achieve in circumstances where legal obligations will arise from subjective matters, such as a bank employee’s suspicion that a customer might be involved in unlawful activity. This notwithstanding, the chapter states, English law seeks to ensure that agents and professionals are obliged to provide information to relevant authorities and that sufficient protection is provided to suspicious agents (including banks). The overall purpose of this chapter is to provide an overview of claims which may be made under English law against or by a bank (or financial institution) involved in a dispute with a customer or third party relating to the source, fate, ownership of, or freedom to deal with, money held by the bank or institution.

This chapter examines the right to practice any profession or to engage in any occupation, trade, or business as embodied in the Indian Constitution. In particular, it considers Article 19(1)(g) and certain limitations on the right, and how this right interacts with India’s political economy. Three important questions are discussed. When is an activity treated as a profession, occupation, trade or business (POTB)? When are the restrictions upon this activity considered to be ‘reasonable’ with regard to Article 19(1)(6)? How does Article 19(1)(g) apply to the development of private educational institutions? These three inquiries help us see the nature of the jurisprudence under Article 19(1)(g) and the way in which it has developed.
