Abstract:
The essential features of the legal systems of the countries of totalitarian socialism are analyzed, some issues of the formation of the socialist legal system in Russia are investigated, the main approaches to the typology of the legal systems of the countries of totali-tarian socialism are identified: from denial of existence at the present time to recognition as a global legal system. The characteristic features of socialist law are revealed, the close connection between legal genesis and political genesis is noted. The formation of the system of socialist law in Russia was based on a radical rejection of the legislation of the previous era; on the contrary, in some other countries of totalitarian socialism, a gradual change in the regulatory framework is noted. The leading role of ideology in the system of socialist law is characterized, which influenced the content of law, and its forms, and technical and legal features. From the point of view of content, socialist ideology gave rise to a special paradigm of relations in the “personality-state” system, which in one way or another affected all branches of law. The author also draws attention to the specifics of the sources of socialist law, the features of the legal culture of the countries of totalitarian socialism. All of the above allows us to conclude that the socialist legal system exists as an independent one. Despite the reduction in the number of countries included in this legal system after the collapse of the USSR, its preservation is noted, while in its classical form it remained only in the DPRK, other countries should be attributed to the modernized socialist legal system. The transformations concerned mainly socio-economic relations, the main political institutions did not undergo significant changes. An analysis of constitutional legislation and political practice does not indicate a desire to re-build the political and legal system along Western lines.

Abstract:
In this article we analyse the Marxist interpretation of F. M. Dostoevsky’s Crime and Punishment. Although Raskolnikov’s worldview may share some features with a socialist point of view, the hero of Dostoevsky’s first novel of ideas represents a complete ideological antithesis to Socialism. Thanks to a careful analysis of Raskolnikov’s utterances and with the help of Merezhkovsky’s reading of the novel, we conclude that if there is a Dostoevsky novel which resists a Socialist understanding, then this novel is Crime and Punishment.

Abstract:
The article investigates the characteristic features of legal socialism as one of the popular directions of French political and legal thought during the period of existence of the French Third Republic (1870–1940). For the fi rst time in the Russian science the similarities and differences of French legal socialism with the related political and ideological systems (Marxism, solidarism) and also with some foreign legal doctrines (legal socialism of Anton Menger von Wolfensgrün, Ferdinand Lassalle) are highlighted. The article focuses on the political and legal views of Emmanuel Levy, a prominent French jurist and socialist, who, according to many contemporaries, was the founder of legal socialism in France. On the basis of the analysis of literary sources of the epoch as well as modern publications, the author of the article evaluates Emmanuel Lévy’s contribution to the substantiation of socialism in legal categories (legal description of the logic of socialism). To achieve this goal, the author of the article considers Lévy’s ideas about the relative nature of law, about class antagonism as a factor of social life, about the absorption of individual law by collective law, about the triumph of collective law as the fi nal chord of the historical epoch of industrialisation, about the understanding of law as a social function and about the expansion of the boundaries of legal responsibility. Lévy’s ideas about the parameters of a peaceful and non-violent social revolution, the realization of which was linked to the growing infl uence of socialistically thinking judges in the French judicial hierarchy, were also studied. Responding to the social markings of the epoch and the demands of public opinion, these judges were to promote the establishment of a socialist legal order in the state by means of free interpretation of bourgeois laws (in the interests of poor classes).

Abstract:
With the end of the Cold War, many assumed that socialism, together with the specific constitutional values and political structures was dead (or dying). This article will challenge these assumptions. Post-Cold War reality did not, however, follow these assumptions. Some countries, especially in Asia, continue to adhere to socialist constitutional approaches. Some cannot fully overcome their socialist legacy. And still others include socialist values in their constitutions and practice. These values and ideas warrant study. Most notably, socialism carries with it a certain set of values and, consequently, a corresponding pressure on legal institutions. The authors, guest editors of this special issue of the Russian Law Journal on the socialist legacies in the world constitutions, outline a general approach for the study of socialist constitutional legacies. The article therefore addresses (a) the methodology of socialist constitutional legacies analysis, (b) the core values of the socialist constitutions and (c) ways in which socialist constitutional ideas and concepts can be combined with the principles of constitutionalism. This analysis raises a number of important – but under-researched questions. One is the extent to which these socialist ideas or concepts are actually socialist. Another is the extent to which these ideas can be included in constitutional discourse.

Abstract:
The relationship of law to antagonisms and contradictions within state socialism is explored from a Weberian and a Marxian perspective. Examining legislation, court decision making, legal control of economic behavior, and law enforcement reveals contradictions between (I) a radical participatory ideology versus muted or extinct civil society; (2) the ideology of comprehensive planning versus the impotence of law; (3) strategies aiming at total control of public life versus the emergence of a niche society outside the reach of the state; (4) regulatory norms versus the functional necessity of norm-breaking behavior; (5) reliance on a revolutionary sense of justice versus the cultivation of “doublethought”; (6) a program of total control of economic behavior versus the emergence of deviant, even criminal, forms of organization to fulfill functionally necessary but ideologically unapproved economic tasks; and finally, (7) two distinct practices of law, responsive or postliberal versus repressive. Yet, contradictions typically did not lead through conflict to subsequent reform during the state socialist era, as conflicts were repressed. When reforms were attempted, they furthered conflict and system breakdown.

To comprehensively rule the country by law and build a country ruled by law is an important goal of socialist modernization with Chinese characteristics. The socialist rule of law culture with Chinese characteristics is the spiritual heritage of the socialist country under the rule of law with Chinese characteristics, and the construction of the socialist rule of law culture with Chinese characteristics is the cultural support of the construction of the socialist country under the rule of law with Chinese characteristics. Abstract This introductory essay provides an overview of the scholarship on state socialist engagements with international criminal and humanitarian law, arguing for a closer scrutiny of the socialist world’s role in shaping these fields of law. After the fall of the Berlin Wall, the historiography on post-1945 international law-making has been generally dominated by a post-1989 sense of Western triumphalism over socialism, where the Soviet Union and its allies have been presented as obstructionists of liberal progress. A wave of neo-Marxist scholarship has more recently sought to recover socialist legal contributions to international law, without however fully addressing them in the context of Cold War political conflict and of gross human rights violations committed within the Socialist Bloc. In contrast, this collection provides a balanced understanding of the socialist engagements with international criminal and humanitarian law, looking at the realpolitik agendas of state socialist countries while acknowledging their progressive contributions to the post-war international legal order.

Abstract:
The thesis examines the expressions and origins of negative attitudes to gender equality in the Czech Republic, which have been noticeable especially in the process of implementation of the EU sex equality acquis. It asks whether and how they can be explained with reference to socio-legal developments that started during Czechoslovakia’s State Socialist past, but are still relevant today. In order to answer these research questions, the thesis examines how gender equality has been regulated through law and how it has been understood by law-makers, judges and legal scholars in Czechoslovakia and the Czech Republic during State Socialism (1948-1989) and Transition (1989-today). The thesis examines legal developments in gender-relevant areas, most importantly in antidiscrimination law. It also excavates the underlying, sometimes hidden, but crucial understandings of key concepts such as ‘women’, ‘gender’, ‘equality’, ‘discrimination’ and ‘rights’. The thesis argues that while formal legal guarantees for women have largely been satisfactory in the Czech Republic by international standards, the way these formal legal guarantees are understood, interpreted and applied has not been gender-progressive. It argues that the reasons for this are: (i) entrenched patriarchal ideas about women’s appropriate role both in private and public life; (ii) a failure to understand gender as a social construct and to recognize gender order as a pervasive social structure; (iii) an inadequate conceptualization of equality and a refusal to combat sex discrimination; and (iv) a limited understanding of the role of law and of rights in the shaping of social relations. It argues that these understandings have been considerably path-dependent on State Socialism, be it through a rejection of anything perceived as State Socialist (which has harmed redistributive policies), as well as through the mostly unconscious retention of ideas or their absence (which has led to a blindness to the cultural aspects of patriarchy).

Abstract:
My dissertation explains how the scientific study of sexuality became laden with emotions and the unforeseen results of this process. It begins with a scholarly tradition, forged during the eighteenth-century Enlightenment, which privileged sentimental articulations of feelings. This tradition helped inspire the late nineteenth-century foundation of sexology, or sexual science. Sexologists, as their discipline developed alongside the modern rational bureaucratic nation-state, maintained attention to emotive expressions. Sexologists also helped shape the interpretation and enforcement of laws against same-sex acts. While they built authority, however, sexologists lacked consensus. During the first third of the twentieth century, sexologists helped compile defendants' detailed sexual histories, replete with affective articulations of sexual desires, which led to calamitous consequences under National Socialism. Nazi technocrats utilized these same sexual histories, offered by same-sex attracted persons describing their feelings and actions before 1933, to prosecute them after a 1935 legal revision, which expanded the law's reach from specific acts to general expressions of feelings. My dissertation provides a genealogy of sexual research and the unexpected uses of its findings. It also revises the biography of sexology as an interdisciplinary field, braided with a history of emotions, tracing its previously underappreciated origins, tumultuous apex, and contested legacy.

Resumo: O senso comum marxista vê o direito como mera superestrutura a serviço da dominação de classe. Franz Neumann (1900-1954), teórico do direito ligado ao Instituto de Pesquisas Sociais de Frankfurt, discorda desse ponto de vista. Esta tese examina seus escritos da década de 30, especialmente O Império do direito (1936), para mostrar que o autor vê potenciais emancipatórios no direito liberal, num debate com o conceito de materialização do direito de Max Weber. Estes potenciais nascem da práxis parlamentar da classe trabalhadora e do advento do nazismo e se referem à possibilidade de o direito expressar a vontade da sociedade, inclusive o objetivo de controlar os meios de produção. Além disso, a tese mostra que o potencial emancipatório do direito não deve ser avaliado em abstrato, mas conforme um determinado diagnóstico do tempo. Por isso, esboça um diagnóstico da relação entre direito e sociedade no mundo contemporâneo, utilizando o conceito de projeto de juridificação, proposto por esta tese, inspirado nos escritos de Franz Neumann
Abstract: Vulgar Marxism considers Law as a superstructure to uphold class domination. Franz Neumann (1900-1954), a law theorist of the Institute of Social Research in Frankfurt, disagrees with this point of view. This Thesis examines his writings from the 30¿s, especially The rule of law (1936) to show how he sees liberal law as potentially emancipatory, engaging to a debate with Max Weber¿s concept of Law materialization. This potential emerges with working class parliamentary praxis and with the Nazism, and refers to Law¿s capacity to express social will, even the aim to control the means of production. Furthermore, this Thesis argues that Law¿s emancipatory potentials should not be evaluated in abstract, but in the context of a diagnosis of the time. It sketches a diagnosis of our time, especially regarding the relation between Law and Society, proposing and using the concept of project of juridification, inspired by Franz Neumann¿s writings

Why should a legal scholar be interested in development plans? The present work begins and evolves with such question in mind. In order to provide an answer, the research focuses on certain major epiphanies of modern development planning and tries to isolate their legal characters. Therefore, the first issue to be addressed is the identification of “legal models” of development planning. The legal nature and legal effects of planning acts is still not clear and moves along fuzzy borders between traditional categories of mid-twentieth century planning (socialist and nonsocialist) and modern soft law planning documents and guidelines. In the first place, the research will try to assess the notion of planning in a legal perspective as well as the legal features of the planning acts/planning norms. The objective of this phase is to decide whether or not, and to which extent, socio-economic development planning may be thought of legally. In order to do so, I will carry out an analysis from the perspective of legal anthropology. In the second place, the research will focus on the definition of the legal features of modern development planning in the People’s Republic of China, through the analysis of the relevant legal formants, with the purpose of determining whether or not the identification of a Chinese “development planning law” is logically feasible. In the third place, I will question and verify the existence of development planning acts and norms in European Law. The purpose of the phase is on one hand to reconstruct and define the legal value of the regulatory framework for the functioning of European development policies. On the other hand, at this stage certain categories and practical solutions verified on the “Chinese front” may be applied to the European context. In the fourth place, i.e. in the conclusive chapter, I will try to draw some results of the comparative analysis carried out, as well as to trace an evolutionary pattern, determining how legal models of development planning affect, on a global scale, the changes in the role of the state in its relationship with the market.

Abstract:
In response to the fact that academic projects on lay participation in China written in English have been very scarce, and also the views of the three schools of Chinese scholars, this thesis will conduct a thorough review of lay participation in China. Chapter 1 of this thesis firstly outlines the worldwide situation regarding lay participation. Chapter 2 sets out the historical background to the growth of lay participation in China, by recounting the various forms of and experiments with lay participation during China’s history. Chapters 3 and 4 study the status quo of the sole form of lay participation in China today, that is, the mixed tribunal system. Chapter 5 looks into the contribution that lay participation could potentially make to Chinese society. Chapter 6 offers some proposals with regard to the prospective direction for developing lay participation in China, from a realistic perspective. The thesis finds that lay participation has been neither declining worldwide, nor has been absent during China’s history. It also finds that although the mixed tribunal system in China today faces an array of problems, lay participation may potentially contribute to Chinese society in terms of a better justice system and improved democracy. After clarifying the prospects for continuing lay participation in China and proposing possible reformative measures, my thesis concludes that the system, with careful reconstruction, deserves a position in China’s future legal system; and that the leftist proposal, to abolish lay participation in China, should be rejected.

Abstract:
The article is devoted to the problem of the social state as one of the fundamental constitutional principles of the state structure of modern developed countries. The course of historical development of philosophical and legal thought on this problem is considered. The idea of a close connection between the concept of the social state and the ideas of utopian socialism of Thomas More and Henri Saint-Simon is put forward. Liberals also made a significant contribution to the development of the idea of the social state, they argued that the ratio of equality and freedom is a key problem for the classical liberal doctrine. It is concluded that the emergence of the theory of the social state for objective reasons was inevitable, since it is due to the historical development of society.

The promulgation of the "Civil Code" provides a path for the codification of other important legal departments closely related to the socialist market economy and the improvement of the socialist legal system with Chinese characteristics. The article, based on comparative historical analysis, shows that the rejection of the socialist civilizational project and the restoration of capitalism destroys traditional values and turns crimi- nal law into an instrument for expressing the interests of the criminal bourgeoisie. In the new geopolitical conditions, it is necessary to aban- don the class approach in criminal policy and ensure unconditional equality of all before the law. This means the need to strengthen the position of the state in the economy, the adoption of the Federal Law on Nationalization and the Program for the Nationalization of Eco- nomic Objects that ensure the national security of Russia.

En este trabajo analizamos el uso de la regulación en los sectores de políticas públicas orientados a la producción de bienestar social. Nos proponemos identificar el creciente uso de los instrumentos de regulación en las políticas sociales y mostrar la diversidad de fórmulas empleadas, tanto desde la lógica de la creación de mercados (regulación económica), como desde la lógica de la protección de los ciudadanos (regulación social). Los instrumentos de regulación, utilizados de forma intensa, están alcanzando un papel cada vez más importante para la conducción de las políticas sociales, y requieren de una adecuada clarificación conceptual. En estas políticas, la regulación puede incidir en los mercados, pero también puede actuar sobre otras actividades que tienen lugar fuera de los mercados. En todo caso, podemos encontrar en muchos ámbitos una actividad constante para desarrollar normas que establecen como deben ser los procesos, los comportamientos, los productos o los servicios que se transfieren en cualquier interacción social.

Esta presentación fue comisionada por la Red de Reducción de la Pobreza y Protección Social del Diálogo Regional de Política para la V Reunión Hemisférica celebrada los días 22 y 23 de mayo de 2003. En los 90 los gastos en el área social se incrementaron considerablemente, sobre todo en el sector educación, pero en general en gastos corrientes, con intervenciones universales e impacto limitado en las áreas de mayor pobreza. Hoy persiste la insuficiencia de recursos financieros para los programas universales, la ineficiencia y corrupción en su percepción y utilización, limitados recursos para programas focalizados y casi inexistentes recursos destinados a la protección social de los más pobres. Los desafíos más urgentes son crecer económicamente, y sanear y mejorar la gestión pública para la percepción, asignación y utilización de los recursos públicos con eficiencia y sentido de justicia social.
