Full textIn the present paper are examinated the forms used by the collective agreement to make uncertain the economic treatment of employees. First we deal with the limit of the wage’s "flexibility" that is identified in the "sufficient compensation" (art. 36 of the Constitution), qualified as an essential element of the contract. Second we focus attention on the remuneration of productivity and profitability of private sector workers and the treatment of accessory privatized public employees. Abstractly these forms of remuneration have an incentive function, specifically they are unable to have this function: in the private work because of the egalitarian political followed by union and the way of setting goals; in the public sector because this part of the salary has been traditionally delivered "to rain". In the third chapter we consider the disputes that may arise if, during the period of time ranging from setting goals as you should verify their achievement, the employer introduce organizational changes that can affect the worker’s ability to achieve the results. In order to answer that question, at the close of the second chapter, the clause regarding variable pay has been classified as a condition because it is subjected to the achievement of productivity and profitability targets which are uncertain and future events. This qualification is designed to enable the application of article. 1359 of the Civil Code disputes: if the workers do not achieve their results because of changes that the employer has introduced in the organization, the workers can pretend that the event (which did not occur for conduct attributable to the employer) has occurred and, therefore, received the salary of results.
