Abstract:
Дисертацію присвячено визначенню та вирішенню проблемних аспектів правового регулювання праці суддів у межах поглибленої євроінтеграції України. Надано комплексну соціально-правову характеристику праці суддів, а саме розкрито соціальне значення праці суддів, визначено критерії та ознаки якісної роботи суддів, що засвідчують її належний соціальний вплив. Встановлено актуальні перешкоди ефективній роботі суддів в Україні, а також стан виконання державою євроінтеграційних завдань відносно поліпшення функціонування судів та суддів. Окреслено комплекс теоретичних і практичних проблем, які перешкоджають забезпеченню трудових прав суддів в Україні, впровадженню в систему правосуддя стандартів гідної праці на всіх етапах існування трудових правовідносин із цією категорією працівників: під час виникнення трудових відносин із кандидатами на посаду судді, у процесі перебігу та припинення трудових відносин із суддями. На підставі аналізу судової практики щодо захисту трудових прав суддів в Україні на кожному з означених етапів встановлено реальні проблеми, з якими стикаються судді на практиці під час реалізації свого права на працю, а також визначено роль судового захисту прав суддів у нашій державі. Виявлено особливості правового регулювання виникнення, перебігу та припинення трудових правовідносин за участю суддів в окремих державахчленах ЄС. Враховуючи проаналізований зарубіжний досвід, сформульовано конкретні пропозиції щодо вдосконалення національного законодавства у досліджуваній сфері. The dissertation is devoted to the search and solution of problematic aspects of legal regulation of judges' work within the framework of deep European integration of Ukraine. The study provides complex socio-legal characteristics of the work of judges. It defines the social significance of the work of judges, determinates the criteria and signs of quality work of judges, which confirm its proper social impact. A complex of theoretical and practical problems that hinder the provision of labor rights of judges in Ukraine and interfere the implementation of decent work standards in the justice system is described. The analysis of problems is made at all stages of the existence of labor legal relations with this category of workers: in the beginning of labor relations with candidates for the position of a judge, in the process and termination of employment with judges. Based on the analysis of judicial practice on the protection of labor rights of judges in Ukraine at each of these stages identified real problems faced by judges in practice during the realization of their right to work. The role of judicial protection of the rights of judges in state is also defined. Peculiarities of legal regulation of the emergence, course, and termination of employmentwith judges in some EU member states areinvestigated. Considering the analyzed foreign experience, specific proposals for improving national legislation in the study area are formulated.

Over the past several decades the business world has witnessed countless corporate mergers of unlimited size and description. The ramifications of these events are profound and the impacts are felt in every walk of life. Canada is not exempt. Consolidation of workforces following corporate mergers has become a complex undertaking which defines the extent and scope of impact on every employee. Employees enjoy varying degrees of control or influence over protection of their working conditions and benefits accrued over their employment service. The extent of an employee's influence over the impact of his corporate merger is governed by his placement in the hierarchy of the corporation. Management employees have the least influence while highly unionized employees have the greatest influence. This thesis will explore the evolution of legal, economic, and industrial relations principles identifiable as governing an employee's ability to carry forward his earned benefits of employment primarily in the Canadian context with some view to the international context.

Abstract:
Chapter 1. Developing countries and TNCs This chapter serves as a general introduction on the issue of TNC regulation in developing countries. The issues covered in it include the definition of a TNC, statistics on such issues as the scale and significance of TNC investment, factors influencing the bargaining strength of the corporation vis a vis the host state and the institutional and legislative response to the TNC challenge. (The questions of Nationalization and Transfer Pricing in view of their far-reaching implications as well as their contentious nature on investor/host country relations are given a fairly detailed treatment in this introduction). Chapter 2. Labour Issues This chapter discusses labour issues that arise in the context of TNC operations in developing countries. Focus is mainly on three basic issues: TNC impact on employment, conditions of work and industrial relations (conditions of work are treated briefly here but in greater detail in the next two chapters.) Chapter 3. 'Export Processing Zones' This chapter focuses on conditions of labour in TNC plants located in special zones created by some developing countries in order to attract foreign investment. The chapter also contains selected short country studies to illustrate how labour/management relations are regulated by countries that have opted for this road to 'development*. The final part of the chapter discusses what is being done at international level to help improve the fate of workers in these zones or in enterprises that may be outside such zones but which in law or practice enjoy similar status with enterprises in those zones. Chapter 4. National Regulation of TNCs in Developing Countries: The case of Bhopal Gas Leak Disaster. The chapter seeks to illustrate and evaluate, in the light of the Bhopal experience, the type of problems that developing countries may confront in their efforts to regulate the social implications of TNC operations in these countries. The approach of the national authorities and other regulatory institutions, as represented by India in this case study, to such problems is also discussed and evaluated. The chapter can be divided into five parts. The first part is an introduction, the second part outlines key issues, from the point of view of our enquiry, and discusses some of the legal questions arising therefrom. The third part discusses in-house safety management at Union Carbide in so far as it is relevant to the Bhopal plant. The fourth part deals with Indian government regulation of the plant. The fifth part deals with options, under Indian law to hold the extra-territorial legal parent of the Indian subsidiary responsible for the damage caused by the accident, as well as the policy implications of exercising such options. (It is important to stress that the chapter is about regulation and not about liability as such. Liability questions are raised only in so far as they are regarded as incidental to our discussion on regulation.) Chapter 5. In Search of an International Regulatory Frame-Work on TNCs. The chapter is intended as an introduction to the issue of international regulation of TNCs, which is the main subject of the remaining part of this work. It is essentially a review of efforts by developing countries and the the international labour movement to create a force, at the international level, to match the power of TNCs, as well as the attitude and responses of the TNCs and their home countries to those efforts. The chapter is divided into two sections. Section A, discusses labour movement initiatives, in particular the largely unsuccessful attempts at creating transnational forms of bargaining with TNCs. Section B, discusses developing countries' initiatives, within the UN System, to establish an international machinery for regulation of TNCs. The economic philosophy that guides these efforts as well as legal principles regarded by these countries as being more in line with their aspirations on these matters, are matters also discussed. Chapter 6. Codes of Conduct on TNCs and The Law. This chapter discusses the legal status and effect of international Codes of Conduct on TNCs, at municipal as well as international law. The main focus is on the 'declaration' type instrument, which is the legal form taken by ILO Tripartite Declaration Of Principles Concerning Multinational Enterprises and Social Policy. Other types of non-binding instruments, including resolutions and recommendations, are also discussed. The circumstances in which these instruments may become binding sources of law are also briefly reviewed. (The contents of such codes and the state practice in relation to such contents is not discussed here. A discussion of these questions is the subject of the next chapter). Chapter 7. The ILO Tripartite Declaration. The subject of this last substantive chapter is a discussion on the most important international instrument on regulation of TNC social policies and practices in developing countries, the ILO Code on TNCs. The chapter is essentially our assessment, in the light of evidence reviewed here, of the adequacy of this instrument, including its implementation mechanism, in coping with the problems identified as pertinent in this work. The chapter can be divided into three parts. The first part outlines briefly the history of the instrument. The second part deals briefly with the contents in so far as they are relevant on the labour issues that have emerged as important in the context of this work. The third part is a detailed discussion on the implementation of the instrument at the national as well as the international level. Chapter 8. Conclusions and Reflections.

Abstract:
This thesis is concerned with the ways in which the laws and policies governing labour migration shape the relationship between migrant workers, employers, and labour markets in advanced industrialised countries. Specifically, it elucidates the intersections of immigration and labour market regulatory norms, structures, and processes that have salient implications for migrants’ work relations. The notions of ‘hyper-dependence’ and ‘hyper-precarity’ are developed as the main analytical and normative lenses in this thesis for examining the particular vulnerabilities associated with migrants’ precarious statuses under contemporary labour migration regimes. Hyper-dependence refers to an acute dependence that transcends the immediate context of an employment relationship, where other aspects of a worker’s life critically depend on that employer. For migrant workers, hyper-dependence may arise where their legal statuses is tethered to a specific employer sponsorship, accompanied by other de jure and de facto restrictions on their labour mobility. Hyper-precarity seeks to capture the multifaceted insecurities and uncertainties in migrants’ work relations and their broader migration projects, which are linked to their exclusion, in law and in practice, from a wide array of social, economic, and civil rights in the host state. Engaging with the various and often competing goals and concerns of immigration law and labour law, the two concepts of hyper-dependence and hyper-precarity are developed and applied through an in-depth comparative analysis of the legal and regulatory architectures of two contemporary temporary migrant workers’ programmes (TMWPs): Australia’s Temporary Work (Skilled) Subclass 457 Visa (‘457 visa’) scheme and the United Kingdom’s Tier 2 (General) visa scheme. In recent years, TMWPs in advanced industrialised countries have been touted by global and national policymakers as a desirable labour migration instrument that delivers ‘triple wins’ for host states, home states, and migrants and their families. I situate the normative concerns of the legally constructed hyper-dependence and hyper-precarity in the ethical debates on TMWPs in liberal states. I also consider how the worst extremes of the two ‘hyper’ conditions combined in highly exploitative work relations could be ameliorated, and in doing so propose some ideas for reforming key features of current TMWPs to enable migrants to exit any employment relationship and to resort to a range of voice mechanisms in the workplace.

L’activité professionnelle des acteurs sportifs suscite de la conflictualité. Les litiges qui en découlent sont extrêmement diversifiés. Matériellement, ils sont de nature associative ou contractuelle, administrative ou judiciaire, sociale, fiscale ou pénale, disciplinaire ou non disciplinaire. Territorialement, ils sont de dimension nationale ou internationale. Tous s’inscrivent dans un système de sources particulièrement étoffées : à des normes imposées aux acteurs (normes sportives, étatiques, supra-étatiques) se superposent des normes négociées par eux. Créant des interactions inévitables entre ces ensembles juridiques, un tel pluralisme juridique est à l’origine d’un véritable pluralisme de justice aux incidences processuelles et matérielles fortes.D’un point de vue processuel, qu’ils soient situés dans un ordre juridique national ou rattachés à un ordre juridique supranational ou transnational, les organes de justice ont des caractéristiques et des pouvoirs forts différents, mais répondent néanmoins à des logiques procédurales communes. Si les principes de répartition entre les divers modes de justice diffèrent selon que le litige sportif demeure dans la sphère nationale ou dépasse celle-ci, il reste que, dans leur ensemble, les juges interviennent dans une relation de combinaison, de complémentarité, plutôt que dans un rapport d’opposition.D’un point de vue du droit substantiel, cette démultiplication des juges n’en est pas pour autant malheureuse dans la mesure où ce pluralisme de justice vient, de son côté, opportunément consacrer et alimenter le pluralisme juridique sportif. Forts de leur action jurisprudentielle normative, ces juges, ces arbitres, participent, par une action isolée ou parfois dans le cadre d’un dialogue constructif, à une régulation adaptée et cohérente des différends liés à l’activité professionnelle des acteurs sportifs, en tenant compte des particularités de l’organisation du mouvement sportif et des rapports juridiques noués par ces derniers.Si bien qu’en définitive, les relations entre les phénomènes de pluralisme juridique et de pluralisme de justice participent d’un règlement des litiges sportifs fédéraux et de travail généralement conforme aux principes élémentaires de bonne justice et paraissant résolument adapté aux spécificités de l’activité professionnelle sportive. Ne serait-ce pas là, au fond, l’illustration saillante d’un « pluralisme ordonné » qui tend à respecter la diversité tout en permettant une harmonie d’ensemble ?
The professional activity of those involved in sport provokes much conflict. Consequent disputes are extremely diverse. Materially, they are associative or contractual, administrative or legal, social, fiscal or criminal, disciplinary or non-disciplinary in nature. Territorially, they are national or international. All fit into a particularly robust system of sources: norms imposed on actors (sporting rules, state rules, and supranational rules) overlap with norms negotiated by them. Creating inevitable interactions between these legal entities, such legal pluralism is the source of a true pluralism of justice with strong litigation and material consequences.From a procedural standpoint, whether they are attached to a national legal system or a supranational or transnational one, legal bodies have strongly different characteristics and powers, yet still meet a common procedural logic. In general, judges intervene with a combination and a complementary approach, rather than in an adversarial relationship, even if the principles of distribution between the various methods of justice differ, whether a sporting dispute remains within the domestic sphere or exceeds it. From a substantive law standpoint, this multiplication of judges is not necessarily unfortunate in so far as this pluralism of justice appropriately consecrates and nourishes legal sporting pluralism. With their normative case law actions, these judges and arbitrators take part by acting alone or sometimes within a constructive dialogue, to an appropriate and consistent regulation of disputes relating to the professional activity of those involved in sport. This takes into account the peculiarities of the organisation of sport and the legal relationships established by these actors.Whereby, ultimately, the relationships between legal pluralism and pluralism of justice are part of a general settlement of federal sporting disputes and working disputes that generally conform to the basic principles of fair justice and appearing resolutely adapted to the specificities of professional sporting activity. Les conflits de normes ont fait l'objet d'analyses spécifiques dans le cadre du droit international privé, du droit transitoire ou encore de la logique juridique. Ils n'ont pas pour autant été systématisés afin d'extraire les conditions de leur émergence au sein des disciplines juridiques, plus particulièrement le droit du travail et le droit des affaires, et les effets de leur solution sur les situations appréhendées par le droit. Une perspective interdisciplinaire peut, en outre, être retenue. L'étude des conflits de normes envisagée sous l'angle d'une conception pluraliste du droit élargit le problème qu'ils posent traditionnellement et tente de trouver, dans le contexte actuel de la mondialisation, la voie d'une redéfinition de l'articulation des normes et d'un renouvellement du droit. Elle enrichit l'approche du droit déclinée sous forme d'organisations. Ces dernières sont fondées sur des mécanismes et des intérêts et produisent du droit, conformément à la théorie d'Hauriou et de Romano. Dès lors, compte tenu de l'hétérogénéité des intérêts surgissant de toute part sur la scène internationale, les organisations étatiques, privées, européennes, internationales, générant leur propre ordre juridique se confrontent. L'interaction entre les ordres juridiques se matérialise par des conflits de normes qui fragilisent leur autonomie intrinsèque. Leur revendication d'indépendance fait obstacle à l'interdépendance qui caractérise originellement leur relation. Néanmoins, la restauration de l'autonomie et le renforcement de l'interdépendance des organisations sont essentiels afin de garantir l'équilibre entre les intérêts économiques et sociaux, général et particuliers. Ils permettent de maîtriser le conflit de normes qui n'est plus subi mais choisi, ou de le faire disparaître
Conflicts of norms made the object of specific analysis as part of private international law, as transitional law or else as legal logic. They were not systematized therefore to extract the conditions of their emergence within legal disciplines, more particularly labour law and company law, and the effects of their resolution on situations caught by law. An interdisciplinary perspective can, besides, be kept. And the study of conflicts of norms considered from the angle of a pluralist conception of law enlarges the problem which they put down traditionally and try to find, in the present situation of globalization, the way of a redefining of the articulation of norms and of a renewal of law. It enriches the approach of law declined in form of organizations. These last are founded on mechanisms and interests and produce law, in accordance with the theory of Hauriou and Romano. Since then, considering the heterogeneity of interests coming into sight on the international stage from everywhere, the international, european, private, state organizations, generating their own legal order are confronted. The correlation between legal orders materializes by conflicts of norms which weaken their intrinsic autonomy. Their claim of independence stands in the way of the interrelationship which characterizes their relation originally. However, the restoration of the autonomy and the strengthening of the interrelationship of organizations are essential to guarantee balance between economic and social interests, general and individual interests. They allow to control the conflict of norms which is not undergone any more but chosen, or to remove it

Abstract:
This thesis focuses on trade union responses to casualisation of labour in the Eastern Cape. In the context of increased globalization, some employers have attempted to achieve high production outputs while saving on operational costs. The ‘flexible firm’ model is used as but one theory to explain increased flexibility in the workplace. In an effort to achieve increasingly flexible firms that may swiftly respond to subsequent challenges such as increased international competition, employers have been seen incorporating more non-standard workers in the form of casual, temporary, part-time, and seasonal workers. This has been a matter of concern for the unions for numerous reasons: some nonstandard workers are subjected to sub-standard working conditions, irregular working hours and little or no benefits; casual work is arranged in such a way that it is virtually impossible for these workers to join a union – a predicament which bears a high possibility of a decline in the typically standard worker–based membership of trade unions; and non-standard workers are often faced with the representation gap predicament which entails that they are not adequately protected by labour legislation. The thesis explores the responses of trade unions to these challenges, and the proposals that they have made in this regard, by focusing on the sectoral dynamics of non-standard labour in the province. It further discusses the regulation of non-standard labour, as poor representation of some non-standard workers bears consequences for the regulation of the practice of non-standard work. The research adopted qualitative research techniques in the form of semi-structured interviews, and used purposive and snowball sampling in accessing relevant data for analysis purposes.

Les entreprises sont aujourd’hui au coeur des échanges économiques mondiaux. Ces échanges se traduisent par la mise en place de relations commerciales desquelles peuvent émerger des structures souvent complexes et difficilement saisissables par le droit : les entreprises transnationales. Aucune réponse juridique satisfaisante n’a encore été trouvée pour les encadrer, alors que paradoxalement, la RSE donne naissance à des normes, des outils et des instruments pour les responsabiliser. L’étude de la responsabilité sociétale des entreprises transnationales à travers le prisme du droit révèle en réalité l’émergence d’un cadre de régulation hybride : les normes de RSE s’immiscent dans le droit, conduisant celui-ci à s’emparer de ces normes à son tour. Cet échange permet d’aborder l’entreprise transnationale à travers une approche nouvelle, tirée des normes de RSE, c’est-à-dire à travers son organisation et ses fonctions. Les relations de l’entreprise avec ses partenaires commerciaux deviennent alors une assise potentielle pour le droit, davantage que son statut ou que sa structure juridique, à partir desquelles peuvent être imputées des obligations, aujourd’hui inexistantes. Une fois l’entreprise transnationale saisie, c’est un cadre juridique adapté à son organisation complexe qui peut être mis à jour. L’étude des normes de RSE dévoile un enrichissement des règles applicables à l’entreprise transnationale et un renforcement potentiel de sa responsabilité juridique, fondée sur une approche préventive mais également solidaire du droit de la responsabilité. Passant outre les problèmes posés par l’absence de statut juridique, la RSE permet de saisir les entreprises transnationales par le biais de leurs relations commerciales, et d’envisager la conception d’un nouveau standard juridique de conduite sociétale, générateur d’une responsabilité individuelle et collective fondée sur une obligation de vigilance
Companies are now at the heart of global trade. These economic exchanges result in the establishment of commercial relationships, from which may emerge structures that are often complex and difficult to grapple with under the law: transnational corporations. While no satisfactory legal framework has yet been established to frame their work, paradoxically CSR gives rise to standards, tools and instruments to ensure their accountability. The study of the social responsibility of transnational corporations through the prism of the law actually reveals the emergence of a hybrid framework of regulation: CSR standards influence the law, forcing the law in turn to take note of these standards. This exchange allows us to handle a transnational business through a new approach derived from CSR standards, essentially through its organisation and functions. The relationship between a company and its business partners then becomes a potential basis for the law, rather than its status or its legal structure, from which can be derived responsibilities. Once a transnational corporation is seized, a legal framework adapted to its complex structure can come to light. The study of CSR standards reveals an enrichment of the rules applicable to transnational corporations and a potential strengthening of their legal liability, based on a preventive and joint and several approach of the law of responsibility. Ignoring the problems posed by the lack of legal status, CSR allows for the regulation of transnational enterprises through their commercial relations and provides a basis for the development of a new legal standard of social conduct, giving rise to individual and collective liability based on a duty of care

Abstract:
Picketing, a method used by employees, collectively, to assert their demands against employers, is a controversial subject arising from the conflict of interest existing between labour and employers! Previously, South African law neither forbade nor regulated picketing. Consequently, no immunity from civil liability existed in relation to a person's conduct during a picket. Presently, picketing is regulated by section 17 of the Constitution of the Republic of South Africa Act 108of19% (right to picket) and section 69 of the Labour Relations Act 66 of 1995, which provides for a protected picket (one that complies with the requirements of section 69) whereby immunity from civil liability attaches to a person's conduct during a picket. These provisions and their coexistence is examined, comparing foreign law where relevant, in an attempt to provide a foundation for a topic relatively disregarded. Section 69 reveals elements of uncertainty and vagueness.

Диссертация является первым в современной отечественной науке трудового права специальным комплексным исследованием правового статуса организаций работодателей, их объединений как субъектов трудовых правоотношений на основе международно-правовых актов, обновленного национального законодательства, проекта ТК Украины. У диссертации исследовано нормативное закрепление права работодателей на объединение в международно-правовых актах (актах ООН, МОТ, Совета Европы и Европейского Союза) и законодательстве Украины. Особое внимание уделяется анализу актов МОП, содержащих основной массив международных стандартов права на объединение. Сделаны выводы о соответствии национального законодавтельства, проекта Трудового кодекса Украины международным стандартам в этой сфере. Определены понятие и статус организаций работодателей, их объединений. Охарактеризован порядок создания и прекращения организаций работодателей, их объединений. Установлены цель и задачи организаций работодателей, их объединений. Выделены функции организаций работодателей, их объединений (представительская, защитная, контрольная, информационная, образовательная, консультационная) и раскрыто их содержание. Рассмотрены элементы правового статуса организаций работодателей, их объединений как субъектов трудовых правоотношений: трудовая правосубъектность; основные трудовые права и обязанности; юридические гарантии трудовых прав и обязанностей. Охарактеризовано участие организаций работодателей, их объединений в осуществлении таких форм социального диалога в сфере труда, как: обмен информацией, консультации, согласительные процедуры, коллективные переговоры по заключению коллективных договоров и соглашений. The dissertation is the first special comprehensive research of the legal status of employers’ organizations, their associations as subjects of labor relations. The statutory implementation of the right of employers to association in international legal acts and in the legislation of Ukraine is researched in the article. The definition and status of employers’ organizations are defined. The order of creation and termination of employers’ organizations, their associations are characterized. The functions of employers’ organizations, their associations were allocated and researched. The elements of the legal status of employers’ organizations, their associations as subjects of labor relations were examined. Basic forms of participation of employers’ organizations, their associations in the social dialogue in the field of labour were characterized. Scientifically based proposals for improvement of acts of current legislation, draft Labour Code in terms of implementation of the legal status of employers’ organizations, their associations as subjects of labor relations were formulated.
