Marie, Jean-Baptiste. "Manager le projet par la synthèse : les collaborations entre ingénieurs et architectes." Thesis, Université Paris-Saclay (ComUE), 2018. http://www.theses.fr/2018SACLD001.
Full textWhether in its objectives, its organisation, its tools, or its techniques, the architectural project is undergoing profound transformations. Some arise from public policies, notably relating to the environment, others from increasing control over project cost management, yet others from innovations in construction and developments in digital technology, and others, finally, from changes in the framework of public contracts, such as design-build. As a result of these factors, more complex project management practices are emerging, in which the coordinating role is no longer confined to architects alone. Instead, it now takes more collaborative forms, with engineers playing an increasingly more important role. Nonetheless, there has been little description of this synthesising activity and it is poorly understood, or limited in its definition to the execution summary defined by act No. 85-704 of 12 July 1985, the so-called public project ownership (MOP) act. The aim of this thesis is to explain what is meant by project synthesis. We are interested here in a circumscribed aspect of the architectural and construction project – but one decisive to its success – which is the forms of collaboration between engineers and architects: modalities of thinking and organising, representational tools, differences and similarities in their activities. The theoretical and practical implications of this hypothesis will be explored through an analysis of the sharing of the architectural and constructional dimensions of eight examples of synthesis, drawn from three case studies: Maison Hermès in Tokyo, the Seine-Aval sewage plant in Achères, the Louis Vuitton Foundation in Paris. Through observation on the ground and interviews with engineers and architects, this analysis highlights two kinds of result: 1) a description of situations of synthesis, which details the role of representations, identifying three types: specific representations, exchanged representations, and shared representations; 2) assessment of the impacts of synthesis on the conduct and management of projects. These results demonstrate new forms of collaboration between engineers and architects and of project management which, though not entirely representative of projects conducted under the MOP act, offer methodological contributions that could help make them more effective

Full textThe industrial production led the emergence of a category of workers separated from the manufacturing and having the monopoly of the intellectual work. The work of the designers, grouped in design offices, was always rationalized, reproducing within it a logic of separation between preparation and execution of the work. Of the taylorist design offices to the project-based organization, a division of labor successively recomposed, distinguishing at first the engineers and the technicians then the engineers between them. Beyond the complexity of products, process and technical development, the transformations of the organization of the design work increase the productivity of the work in design offices and moving away engineers and technicians with their profession of designer. This configuration produces an engineering of the design work: the designers realize no more design, it is a technical and managerial fragmentary work. The rationalization of the intellectual work in the design activities transforms design offices to legitimize a design process without designers. It is a matter of reconstituting a population of designers for who the project-based organization, the realization of fragmentary tasks, the standards and managerial practices and the implication in a flexible teamwork are the mains features of the industrial designers professionality. This situation causes a loss of command among the intellectual workers about the organization of the activity, the working processes and the purposes of their activity

Full textThis work investigates the role of professional situations in the development of student-engineer's knowledge, within a sandwich course. Our study is carried out in a vocational school, at the tertiary level. This school (ISTP de Saint-Etienne France), trains engineers in charge of industrial production. The teaching is organised as a sandwich course, alternating periods at school, an periods in a firm. During this training course, students have to manage a large-scale project to improve the socio-technical organisation of the manufacturing units of the firm. To study the impact of professional situations in developing students' vocational abilities, we have developed a theorical framework on the basis of some aspects of activity and action theories (Rasmussen, Leontiev, Thévenot). This theoritical framework also uses the concept of milieu" proposed by the french didactician Brousseau. From a methodological point of view, we have chosen the case study. Two complementary levels of analysis are used to study the activity of two students. The first level (the global level of analysis), reconstitutes the students' activity during the 3 years of their training course. Whereas the second level (the local level analysis), focuses more closely upon a 5 days period situated in the middle of the training course. Our results show the consistency and the complementarity of these two levels in studying the students' activity. This study also shows that the students have gained two different types of expertise at the end of that training. We stress some important factors that explain this difference: (1) The socio-technical organisation of the firms, (2) The students' "location" in this organisation (from both hierarchical and functional point of view), (3) The type of project, (4) The two tutors role (school tutor and firm tutor), all of which play an important part in the development of some specific types of professional knowledge

Full textThe study of the history of the management strategies of the Loire valley flooding is of a great importance; the vulnerability to flooding has strongly increased during the last decades because of the urban growth and agricultural extension in floodplains. The study area is the Nivernais, located in the upper part of the middle Loire valley that was relatively neglected by scientific research, by comparison with the Touraine and Anjou valleys. The historical approach concerning the Loire valley vulnerability to inundations in the Nivernais demonstrates how present flooding management depends on a historical misunderstanding: “levees” (dykes) are presently considered by all (riverside inhabitants, managers and politicians) as the main infrastructure against flooding, however the dykes were built by XVIII° century engineers, who first aimed to improve navigation and to make the Loire River a modern fluvial axis. Political and economical origins of the change of use and perception of the fluvial works are investigated. As a paradox, limits of dykes in terms of protection against inundation were early identified and well known. A combination of different methods and tools is developed: analysis of maps and engineer memoires is reinforced by the elaboration of a historical GIS, that groups together data on fluvial bed evolution and engineering works, from the end of the XVII° century to the present

Full textThis action research was meant to design digitised learning resources as an integrated complement to a specific teaching context. In the light of current theoretical knowledge on second language acquisition and the use of information and communication technology, a learning system was implemented in which the resources had the role of developing explicit knowledge. Once in operation the resources were assessed through detailed measurements. They fulfil their function to the learners’ satisfaction although parts of their contents and aspects of their layout need amending. Using such resources entails that teachers should assume new functions requiring new skills. This action research, prompted by a sense of deontological responsibility, led to the achievement of greater theoretical expertise and the adoption of more reliable teaching practices. Thanks to rigorous methodology the hypotheses have been validated and the practices can be transferred to other contexts

Full textCESI school of engineering has implemented a PBL curriculum called A2P2 in its combined work and study engineering degree program since 2015. This curriculum revolves around cross-disciplinary projects carried out in small groups and was designed to professionalize students. This research work endeavours to question the challenges and assets of this learning environment as regards the professional identity construction of the future engineers. We first assumed that the program should positively affect their professional identity construction, but also advanced the hypothesis that its impact should differ from one student to another as students’ individual dispositions interact with the learning environment and thus affect their experiences. The research process involved gathering comprehensive data throughout the 3-year engineering program. A dual data collection approach was developed – a sampling, qualitative study (31 students) as well as quantitative data collection from the cohort (587 students), to infer development “profiles”. This student-centred methodology was supported by data triangulation, via external data collected from the tutors, from evaluation results. The data collected supports the theory of the school curriculum contributing to students’ identity development, through the iteration of efficient patterns of actions. They bring out several development profiles –professional identity dynamics, bolstered through specific resources and levers of development, depending on students’ set out goals for the training. The results point out that school and companies provide different levers to support students’ professional becoming

Full textIt is widely acknowledged today that the industrial placement is essential to academic study, even at university. However, few works have focused on the way in which the placement contributes to professional experience, the development and training of the students. The thesis undertaken at the Ecole Nationale Supérieure des Mines in Saint-Etienne (Graduate School of engineering) investigates to what extent the industrial placement could be a factor in the development of engineering students. Based on a socio-constructivist perspective and on the activity theory developed by Vygotsky’s approach, the thesis looks at the way in which the linguistic instruments structure the industrial placement itself, allowing a degree of reflexiveness and bringing to light contradictions in the activity systems between the company and the School as well as within the School itself. The theoretical approach allows us to establish the following hypotheses:- The industrial placement is integrated into a method of training that is set up in line with the rules of the community consisting of the authorities who validate the training. This methodology is embedded in the history of the profession. - The industrial placement is a way of socialising using the instruments because it allows the student to join a shared environment and to accept a set of rules around building a professional identity towards the engineering profession. The industrial placement gives the student a mechanism for conversation which allows him to modify and reconstruct the subjective reality, giving him a new professional identity. The written report and the viva voice are opportunities for the student to discuss the learning from the placement.- When the student presents his experience within the company, he is situated at the intersection of several activity systems: his own, that of the company at which he worked and that of the teacher who is going to validate this experience for his training, the engineering curriculum. We therefore characterise how the method proposed by the curriculum allows a level of reflexiveness and increased visibility of the contradictions experienced and how they can be overcome. We then look at to what extent these reflexions are contained within the written report and the viva voice..From an analysis of the history of engineering studies, we aim to understand the educational logic and the evolution of the industrial placement. An analysis of prescribed training courses is undertaken through the documents from the Engineering school. Questionnaires and interviews allow information about the placement to be recorded by the director of studies and of the students of the class of 2006 have on the placement. Then two case studies are undertaken based on the analysis of two students’ written reports and viva voices as well as interviews with their teachers. The data analysis showed that in order to work, a placement must be located in a variety of activity systems. The academic system which prescribes the placement is taken from the logic dependent on that of the authorities prescriptive to the engineering profession: companies and how they evolve, the politics of education, the CTI, the CEFI … On another scale, in the engineering curriculum that was observed, the activity systems questioned for this training course are those of the School, the company, the student, education and research. Finally, for the two students, we pointed out the convergences and the contradictions which exist between the activity system of a student, that of his teacher, that of the company, and that of the research

Full textDriven by reasons specific to their history or identity, or driven by complex problems, organizations may at times decide to engage in processes of “government by discussion”. These processes will take the shape of dispositive enabling stakeholders from various backgrounds to contribute to a political-strategic work whereby they imagine more desirable and feasible worlds, by which they may confront and compose between their experiences and affects within more or less instrumented spaces for discussion, sharing, controversies, collective wording and enacting: namely processes of “semantics building”.Taking the point of view of a consultant, the final aim of this work will be to suggest markers useful for the designing and accompanying of such processes. Avoiding traps of idealist illusions as well as those of pseudo-pragmatism, processes of “semantics building” must be designed bearing in mind the particular idea of regeneration of hybrid sovereignties, towards objects which exceed the capacities to think and act of stakeholders within the institutionalized organizational and political compromises. Aiming at going beyond the current tendencies of liquefaction of institutions, the underlying axiology of such design heuristics relies on the idea that the regeneration of institutions implies the instrumentation of a dynamic capacity to launch political-strategic work geared towards the emergence of organizational and political rhythms of a higher quality. Processes of “semantics building” then appear as the triggers of dynamics of collective action whereby more fruitful sovereignties can be instituted

Full textThe research studies the process of making of a knowledge on the communication resulting from reflective communication in online interchanges within a computerized media. It aims at understanding how this knowledge is acquired by analyzing the following triptych : users/device/other users. When using device like a multiplayer online battle arena League of Legends or female online discussion website Confidentielles.com, the users get involved in a psychosocial « adjustment system » to understand and assess the situations of communication they are facing. Thus, since it is developed during the practice, the « adjustment system » appears to be dynamic, mechanical and progressive thanks to reflective process. Two levels of reflexivity corresponding to the stages of this adjustment will be studied. The first level starts when the user facing the device has to work out and estimate the situation, decide on the strategy to adopt and grasp the importance of relations with others. The second level takes place all through the practice to manage efficiently the various interactivities and be as happy as possible in the given situation. On the one hand, these reflective process infer the production of ordinary knowledge; in the other hand the user has to adopt the « amateur-ethnologist position » when developing skills to understand the process and the situations of communication thanks to the « trips » between mediated communication and face to face communication

Full textThe purpose of our thesis is to discuss a specific set of problems : the problems that arise from applying a pattern of intensive accumulation to an industrially-based developping economy. This specific discussion is set within the framework of more wide-ranging considerations bearing on the models of development and accumulation applied in latin america. We use the model concept here in its modal sense : conjunction of an accumulation system and institutional forms of regulation. These concepts are defined and discussed in the first part of our thesis. Long range transformations of accumulation systems and regulation procedures are studied in the context of argentinian growth (19301980). We look at the major features of the accumulation pattern : the different elements of intensive growth patterns as affected by external constraints (leading sectors, accumulation of capital and employment, fluctuations and cycle. . . ) dovetailing with the world economy, the macro-economic equilibrium within this regime of industrial accumulation. In the third part we present a discussion of the main characteristics of wages regulation and the consumption norm. This exercise in applied economics will have served, we hope, to buttress certain theories while confuting certain over-simple views held on the specificity of reproduction of capital and of work-force in a semi-industrialized economy

Full textThis thesis explores the processes supporting the action of managers and supervisors on occupational health. We used our experiences of professional interventions with team supervisors to question this issue. A first study questions the impasses of the concept of psychosocial risks to consider the action of managers on occupational health of the team members. Then, a second study investigates the operational concept of the psychological dynamics of the job related to discussion about work. For the third study, we test different management devices through discussion using a research-action methodology in an establishment for elderly dependents (EHPAD). Analysis of the results of this third study brings out the resistance to discussion. This requires individual learning, collective and organizational work for discussion with supervisors, teams and stakeholders involved in health at work (management, health professionals at work, social partners). Based on these results, we define the requirements for discussion spaces and the role of supervisors in order to develop psychological health of team members

Full textWastewater irrigation represents great interest in arid and semi-arid regions where water demand is important. However, wastewater irrigation results in, for example, soil contamination by emerging organic pollutants such as pharmaceuticals. Transport and transformation mechanisms of these substances are still poorly understood. The objective of this thesis was to study the processes of biodegradation and sorption of pharmaceutical products in laboratory experiments, with a special reflection in the context of wastewater irrigation. Firstly, we exploited the chiral signature of the antidepressant venlafaxine (VEN) and its major human metabolite O-desmethyl venlafaxine (ODV) in order to discriminate the biological processes from other processes. Laboratory experiment showed a correlation between the biodegradation rate and the change in enantiomer fraction. The VEN was then monitored at the outlet of a WWTP and in the river receiving the discharge. A change in enantiomer fraction showed the interest for a better development of this application to investigate in situ biodegradation. Secondly, the sorption of cationic molecules VEN and ODV, as well as the neutral molecules antiepileptic carbamazepine and its human metabolite trans-10,11-dihydro-10,11-dihydroxy carbamazepine, was studied in batch and soil column leaching experiments. The pH and ionic strength conditions in batch experiment influenced the sorption of VEN and ODV, while there was little impact for neutral compounds. The cationic exchange should play an important role in the sorption process of cationic molecules. Leaching study showed that neutral compounds are much more mobile than cationic compounds; therefore they may contaminate groundwater in the case of wastewater irrigation

Full textIn the spite of the complexity of the search for ground on the works concerning the resiliency and particularly resiliency in school context, we were interested in the modalities and in the demonstrations of this one in establishments of the secondary sector in France, in the sensitive said building’s high schools. Seat of educational and social tensions, the relations between the actors are printed mistrust and translate social and psychosocial difficulties complicating the answer to the missions of teaching and educational, and tarnishing the image of the teenagers and the diplomas. Although the origin and the factors of dysfunction of the teenagers take root initially in problems exceeding the school, their coverage and their mediation are a matter of the education, to prepare the school’s exit and the entrance alive active and social. The appeal to the diagnosis and the solutions are registered within today institutionalized hours the objectives of which concern the development of the pupil. But when the contact got rid for years of previous academic failure, when the not sense settled down in spite of the orientation, when the behavior challenges the authority and when the early school leaving displays as a constant in progress in these establishments, how to think of an educational practice which can revive the bases of the reliable interactions between teenagers and teacher, while guaranteeing a frame of good volume in the unsettled affects by creating interactions which allow the pupil to work and to mediatize the past, to register it in a meaningful present by throwing it in the future in a harmonious way? If this educational practice allows the teacher and the educator to define his share, it’s also an educational contingency registered in the theories of the resiliency which is the faculty to bounce further to a trauma. In this optics to thwart the academic failure, to allow the creation of positive fates, off-camera of the reproduction of the failure, by being supported on the theories of the resiliency at the school, it’s possible to envisage an educational practice of coverage of the group classy of teenagers which implements these interactions between pupils and teacher according to a praxis of resiliency. And if this resiliency joins a cultural collective practice, leaning on the works of a culture and passed on by this one, it’s named cultural resiliency. Except field of therapeutics or of the psychology of group, the cultural resiliency answers the cognitive imperative to join a dialogical practice reassuring and demanding for pupils prevented from thinking, to fill the gaps and the defects of inner and previous languages. The practices of discussion with philosophic aim demonstrate that’s possible to create these spaces of mediation around the rigorous thought to develop various capacities to think guaranteeing the performance of a speech exempt from ease and from excuses. If this discussion is supported by a cultural supports of the literature, as the tales or the myths, then, a double mediation at the pupil is possible, since the isolated and silent mediation in connection with the theories of the tae towards the orals mediations which will follow the reading according to logic of philosophic questionings. If the choice of the support is ad hoc according to the recommendations of Lipman and what the tales speaks about resiliency then, it’s possible to lead discussions with philosophic aim in a praxis of driving process of cultural resiliency, which will be realized through the evolutions of the speeches of the high school students. This search for comprehensive type leans on the analysis of the speeches and the interactions in a pragmatic prospect which allows the highlit of contents registered within the framework of the cultural resiliency through factors of implementation of the process which are the link, the sense and the law. The experiment of signing of eighteen sessions of discussions [...]

Full textInformation and Communication Technologies are now part of the life of many institutions of higher education, secondary education and even primary education. The benefits for these institutions, as well as for teachers and learners are established. However, there are very few cases of experiments carried out in learning Institutions with positive results. This thesis is about integrating ICTs into a French course in the Anglo-Saxon university of Buea in Cameroon. The context in which the course is taught in classrooms makes it difficult for the objectives to be met. Because of the large class size, the little time allocated to the course and the heterogeneous nature of students’ language levels, speaking, writing and interactional skills are not worked out in class. This action research thesis sets out to propose a blended learning set-up that hinges around the university IT Centre. Online classes are articulated with classroom sessions. Thus, students have the opportunity to involve in small groups, in communicative activities and in quasi synchronous mode. These communication modality, very often less studied by CMC researchers, is an efficient alternative to synchronous communication and environments that are very much reliable as far as internet quality is concerned in that part of the world. The general question that has driven the research is: How can a technology instrumented approach help in overcoming difficulties and ease learning? To answer that question, two technology based experiences were carried out. They were guided by a research protocol. Data collected enable me to analyse interactions and determine traces of language acquisition. From the circumstances surrounding the experiments, it is discovered that there are a number of obstacles to the integration of ICT in “low tech context” like that which is studied. The technology-based stet-up pattern is then questioned. This research work goes further to propose mobile learning as an alternative to the ICT integration model that concentrates all the resources in a single location

Full textSince the 2000s, France set up important policies of State reforms. The aim of these reforms is to modernize the French State management by refocusing this one on its missions' priority as to improve the service provided to the user and to reduce the public spending. These reforms have repercussions on all the actors, in particular on the first-line managers. Between their hierarchy which sets goals of performance and their teams which “do” the work, these first-line managers translate day-to-day the objectives into concrete missions. In order to understand this balanced posture and its consequences on the activity and on the health of managers, this thesis is interested in the activity of the Head office of the Public finances' first-line managers. This administration was created in 2008 and joins in the line of New Public Management. This kind of managers is from the two former sectors which existed before the merger: the respective cultures differ in the approach of performance-based management and the relation to the agents. In an administration in permanent change, the first-line managers are pulled by contradictory orders. This kind of orders questions constantly the positioning towards the hierarchy and supervised team, towards objectives of performance and living conditions at work, towards logics of technical skill and managerial logics. Although the multidisciplinary literature – sciences of management, sociology, psychology – is extensive in particular on the role and the positioning of the first-line managers, the contents of their work are few approached. In ergonomics, some researches on the work of the first-line managers are rather interested in the analysis of working situations. For our part, we suggest analyzing this activity under the prism of the careers (Gaudart & Ledoux, 2013). These careers represent a succession of jobs or functions and a working course with an increase of real-life time (Molinié, Gaudart & Pueyo, 2012) which points at the experience's roles. Our two objectives are to understand how the work transformations impact on the first-line managers' activity and how the experience can be a resource to realize this activity, in particular to regulate the couple closeness / distances by these managers. Our strategy of research combines five methods: the analysis of an existing “space of dialogue” plan and its contents, interviews of the careers' reconstruction, observations of the 14 managers' activity, auto-confrontations from the tracks of the activity, and the organization of reflexive workshops

Full textIn 1945, French army engineers became the routes building branch. From the moment they arrive in Indochina, engineers reestablish itineraries, in spite of a limited number personnel. However the deep nature of the Indochina war and the particular of south-eastern Asian terrain force the engineers to adapt while they take more and more responsibilities. By 1951, the Chinese threat and the reinforcement of the Viet-Minh result in new missions which necessitate a development of infrastructures on the theatre, thanks to American support. Despite the increasing presence of the engineers, the French defeat is caused by a progressive restrain of the movement for the expeditionary corps. Eventually between 1954 and 1956, the engineers gather the refugees and the expeditionary corps units from North-Vietnam and manage the evacuation from Indochina

Full textIn the context of the effects of globalization on an emerging economy, the research presented here is aimed at demonstrating the process of internationalization of middle managers in Indian industrial enterprises, via advanced management training. These very large public enterprises are both, key actors engaged in deploying globalization effects, and the objects of those transformations. Based on empirical and qualitative study, using semi-structured interviews carried out in these large Indian industrial enterprises, what follows is a report describing and modeling the internationalization of a panel of former participants of a Post Graduated Diploma in Management for Executives (PGPMX), of American MBA inspiration. The originality of this research is to offer a reflexive report of the nature of this training, as the participants experienced it, and the consequences for them professionally and personally. This allows the investigation of the fit of managerial practices and theory as offered by business schools, using the US model vis-à-vis the managerial demands in Indian enterprises, wrapped in the specificities of the Indian culture. As an interpretative strategy, the data gathered from the extensive field work was treated in reference to the project of Pierre Bourdieu—with particular attention to the figure of habitus, and special focus on modifications of capital’—symbolic, cultural and social; Result show a gain in all three, and reveal a residual tension between the new management principles, and the traditional values. This research, should be of value for the Human Resource Development function of Indian Industrial Enterprises, and for the schools of management—both Indian and Western, that offer these training programs. It should also interest foreign enterprises that seek entry into the Indian market, by enabling a better comprehension of the ‘symbolic violence’, associated with the intrusion of foreign cultural practices and values

Full textThis multidisciplinary thesis clarifies the situation of the Spanish language in French engineering courses. Once language training has to meet specific objectives, the question of the most appropriate teaching-learning methodology must be asked. This central issue required consultation with the actors involved in the process in order to know their real language needs. While much has already been said about this kind of analysis, there is a lack of information on the relevant variables to sift through the requirements of this target audience. By bringing together theoretical frameworks and field experiments, two ad hoc models of survey instruments, both quantitative and qualitative, were proposed and tested for engineers and student engineers. The results show that opinions converge on a considerable number of points and, in particular, on the most appropriate way to teach and learn Spanish. The recommended method must be active and aim at the pragmatic aspects of the language, based on teamwork, favoring peer collaboration, in a communicative and action-oriented perspective, prioritizing “project” based expression and interaction tasks. The analysis of the didactic implications of this joint application leads to the conclusion that it can be satisfied by adopting the "problem-based learning" method. A protocol for the implementation of this innovative approach, accompanied by an example of application in a specialized Spanish course for engineers, is presented with the aim of transferring scientific advances likely to renew university pedagogy

Djedi, Djongambolo Ohonge Daniel. "Le principe québécois de l'impartageabilité de la réserve des coopératives non financières: discussion critique autour du maintien ou de la suppression." Thèse, 2016. http://hdl.handle.net/1866/16369.
Full textForbidden general reserve sharing among members is mandatory to have, indivisible throughout the existence of the cooperative and subject to the "disinterested distribution upon liquidation or dissolution". The reserve functions as a support lever for the development of the cooperative and the cooperative movement as a whole. The principle of nondivisibility of the reserve is the prohibition to all cooperatives in Quebec to share the general reserve of all members and the prohibition of the decline, including the allocation of any rebate along the existence of the cooperative. Indeed, the nondivisibility of the reserve is based on the idea that the cooperative is not to the accumulation of capital in order to distribute them among members, but it is the creation of a collective capital that benefits all current and future members. If the concept of nondivisibility reserve therefore prohibits the sharing of reserve throughout the existence of the cooperative, the same prohibition takes the name of the disinterested distribution of net assets at the time of the disappearance of the cooperative. This disinterested distribution is in turn the ban on all non-financial cooperatives to share the remaining assets in the disappearance (dissolution or liquidation) of the cooperative except agricultural cooperatives that can decide in this case, distribute the remaining assets to members without knowing the reasons for the exception. Moreover, the nondivisibility of the reserve is considered a mere legal disadvantage for members and has had some rewrites in co-operative legislation without knowing either the reasons for these changes. The aim of our thesis is to engage a critical discussion around the following central question: given the current legal framework on cooperatives, the principle of nondivisibility the reserve must be maintained as such in the Cooperatives Act, or simply be deleted, as in the corporation, where it is nonexistent without this deletion does not affect the legal concept of the cooperative? Specifically, what is the legal framework and what are the motives which may plead in favor of maintaining or deletion of the principle of nondivisibility reserve? To answer this question, this thesis is divided into two parts. The first part explores the legal framework for non-financial cooperatives in Québec compared with certain legal concepts from other legislation. It examines the legal basis underlying the nondivisibility the Quebec law reserves of non-financial cooperatives. The second part makes a critical discussion around the history of the principle of nondivisibility Reserve (ch. 3), different legal arguments available (ch. 4) and assumptions based around concrete effects available (ch. 5). She exploire these dimensions to support maintaining or not the nondivisibility Reserve current legislation on non-financial cooperatives. Although the research lead to a nuanced response, the overall results rather militates in favor of maintaining the principle of nondivisibility reserve. Previously, the observation of the legal foundations of the underlying concepts in nondivisibility the Quebec law reserves of non-financial cooperatives helped to understand the concepts underlying this principle before answering the question about its maintenance or suppression of current legislation on cooperatives. The discussion made it possible to highlight the importance of a fairly obvious basic reality: this principle allows to preserve the reserve, useful for the development of the cooperative and the cooperative movement as a whole. Moreover, this principle of nondivisibility of the reserve part of the social mission of the cooperative, which is not intended maximizing monetary profit. The nondivisibility Reserve also part of the consistency of Quebec law cooperatives with the concept of cooperatives as defined by the Quebec cooperative movement and the ICA while addressing the historical purposes of fairness between generations and solidarity. Finally, while discussing the arguments of accounting data and illustrations of some interviews with some active members of the cooperative movement does not lead to any firm conclusion, it appears that the nondivisibility the reserve does not dampen the trend rising investment and sales of non-financial cooperatives. This prohibition even be a self-financing mechanism of the cooperative and a symbol of solidarity.
