Abstract:
This article applies a late-Durkheimian theoretical framework to civil society as a sphere of solidarity in order to identify cultural codes and to explore their role in integrating or dividing members of South Korean civil society entering an information age coincident with processes of democratization. A policy debate relating to information, a debate over the Electronic National Identification Card, is used to show the co-existence of, and conflicts between, a ‘developmental code’ based on economic growth deriving from the authoritarian period of state-sponsored capitalism, and a later ‘democratic code’ based on human rights. This article argues that while the values of a ‘democratic code’ are becoming more dominant in the recent South Korean civil sphere, their validity is continuously challenged. The case also provides evidence that democratization and informatization can operate in tandem to establish dominance of the democratic code in public discourse in the South Korean civil sphere.

Abstract:
Purpose North Korea joined the United Nations Convention on Contracts for the International Sale of Goods (CISG) as a 90th member on March 27, 2019, which will necessitate the understanding of North Korean laws, in particular, the contract law for sale. This paper aims to compare the CISG and the North Korean contract law as to the formation of a contract focusing on form and writing requirement, offer and acceptance. Design/methodology/approach This paper analyzes the provisions of the North Korean Civil Code and the CISG and reviews the previous research studies concerning the formation of a contract. Findings The CISG and the North Korean Civil Code are very similar in many aspects as to the formation of a contract. However, there are some discrepancies as to the formation of a contract to which the parties need to pay attention in choosing the governing law. Practical implications The parties need to pay attention to the differences concerning the formation of a contract between the North Korean Civil Code and the CISG in concluding a contract for sale with North Korea. Originality/value This paper will be the first research work, to the best of the author’s knowledge, on the comparison of the CISG and the North Korean contract law as to the formation of a contract.

Abstract:
With the popularization of Building Information Modeling (BIM) technology, increasing numbers of countries are attempting to introduce BIM into their national building permitting processes. There are also many BIM-related research initiatives worldwide. Likewise, the Korean government has joined this trend by improving its existing e-Submission system, SEUMTER, to provide for BIM-based e-submission and automated code compliance checking. Further, the Ministry of Land, Infrastructure, and Transport in Korea has funded the Korea BIM (KBIM) building e-Submission system project. The Industry Foundation Classes (IFC) data model is an openBIM approach that has been designated as an international standard through the International Organization for Standardization. It is not dependent on specific design tools and is suitable for public works applications. Hence, this study performed a comprehensive analysis of and developed a framework for a prototypical system for an e-Submission process based on the IFC data model. Four main modules were developed to perform code checking, submission, pre-checking, and automated rule-making. A real-world project was used to verify the feasibility and effectiveness of the proposed framework. This study could increase the adoption of BIMbased building e-Submission systems by sharing effective and successful processes.

This study evaluated the design and performance of an improved 3.5 MW floating photovoltaic (PV) power generation system consisting of fiber-reinforced polymer (FRP) members and its installation in the ash pond of a thermal power plant. The FRP design code of the American Society of Civil Engineers was used to design the structure. The safety of the structure was then confirmed using a finite element analysis indicating that the induced stresses were less than the allowable stresses dictated by the Korean Highway Bridge Design Code. An examination of the energy performance of the floating PV energy generation system after installation determined that the measured electricity production was as high as approximately 94% of the installed 3.5-MW capacity. The energy production of the floating PV structure with the improved design and module angles was found to increase by 7.65 times.

Abstract:
Purpose The purpose of this paper is to describe and analyze the rules on the formation of contracts under Korean law and the Contracts for the International Sale of Goods (CISG) in a comparative way and introduce the relevant proposed rules under the Amendment Draft of the Korean Civil Code (KCC). In addition, it attempts to compare and evaluate them in light of the discipline of comparative law. Design/methodology/approach In order to achieve the purposes of the study, it executes a comparative study of the rules as to the formation of contracts of the CISG, Korean law and the Amendment Draft of the KCC. The basic question for this comparative study is placed on whether a solution from one jurisdiction is more logical than the others and to what extent each jurisdiction has responded to protect the reasonable expectations of the parties in the rules as to the formation of contracts. Findings The comparative study finds that most of the rules under the CISG are quite plausible and logical and they are more or less well reflected in the proposals advanced by the KCC amendment committee. On the other hand, the other rules under the CISG which have brought criticisms in terms of their complexity and inconsistent case law invite us their revision or consistent interpretation. The drawbacks of the CISG have also been well responded in the Amendment Draft of the KCC. Nevertheless, it is quite unfortunate that the Amendment Draft of the KCC still has a rule that regards any purported performance with non-material alteration of the terms of an offer as an acceptance. Originality/value This study may provide legal and practical advice to both the seller and the buyer when they enter into a contract for international sales of goods. In addition, it may render us an insight into newly developed or developing rules in this area and show us how they interact with each other. Furthermore, it may be particularly useful in Korea where there is an ongoing discussion for revision of the KCC.

Abstract This article examines false registration as a method of domestic adoption in South Korea. The article argues that the practice of falsely registering adoptees as natural births in the family registry emerged in response to the highly restrictive adoption laws in South Korea. As adopting agnatic kin for the purpose of family succession was deemed the only legitimate form of adoption, significant hurdles existed for other kinds of adoption in Korea. This article examines the history of domestic adoption in Korea and highlights the legal hurdles to domestic adoption. These restrictive adoption customs first originated during the Chosŏn dynasty (1392–1910) as a prescription for yangban elite; they were then codified as customary law for all Koreans under Japanese colonial rule (1910–45). The ban on non-agnatic adoption continued in the postcolonial period when it was codified in the new Civil Code of 1960. Multiple legal reforms were attempted since the 1970s to promote domestic adoptions, but change was slow. This article argues that the highly restrictive nature of adoption laws in South Korea produced an adoption regime that existed largely outside of the legal realm.

Abstract:
This study aims to estimate the wind loads acting on a tower structure by comparing and reviewing design codes and the results of wind tunnel tests. To this end, the modal properties of the tower were identified through short-term on-site measurements of the Busan Tower in Korea. The wind load acting on the tower was calculated using four design codes: KBC2009 (Korea), ASCE7-10 (USA), EUROCODE (Europe), and AIJ2004 (Japan). Additionally, force measurement tests and aeroelastic model tests were conducted for comparison. The results obtained indicated that the design wind velocity of each design code differed slightly, reflecting the individual characteristics of each country. The base shear force, base moment, and maximum displacement obtained from each design code were similar to those obtained in the wind tunnel tests. The magnitudes of the base moments and maximum displacements calculated by each design code were in the order of KBC > AIJ ≈ EUROCODE > ASCE7. The overall results indicate that each design code reasonably estimates the wind forces and the responses of the tower and also has an appropriate safety margin. The scatter in the predicted wind loads occurs primarily from the variations in the design wind velocity in the respective design codes.

Among the European codes the great ones were obviously included – French, Austrian and German, as well as those of less importance, but still relevant in Europe, such as Italian, Spanish codes or Swiss Law of Obligation, and also codes of Slavic and simultaneously post-socialist countries, like Poland, Czech Republic and Russia. In the case of Asia, the codes of China, Japan, South Korea and Vietnam were analysed. The question asked was whether the terminology used in Chinese law is unique or repeated and if so, how common it is in comparison with other legal systems. The research methods included the parametric approach to legal terminology comparison and techniques of legal construction (interpretation).

Abstract:
A kiskorúakra és a cselekvőképtelen nagykorúakra vonatkozó jogi szabályozás bemutatására a francia, az osztrák és a magyar jogrendszer összehasonlító elemzésén keresztül kerül sor. Az elemzés a cselekvőképességre és a gondnokságra vonatkozó szabályokat a Code Civil és az ABGB megalkotásának időszakától kezdődően a hatályos szabályozásig tárgyalja. A gyámságra és a gondnokságra vonatkozó jogintézmények bemutatása során figyelemmel van az állami szerepvállalás történeti alakulására, a hivatásos gondnoksági rendszer létrejöttére és szerepére, az intézetben történő elhelyezések növekvő számadataira. A gyámsági és gondnoksági feladatok megoldásában valamennyi vizsgált jogrendszerben szerepet kapott a szélesebb értelemben vett család, de a szabályozás eltérő volt abban a tekintetben, hogy csak a felügyeletet utalta bírósági hatáskörbe (francia megoldás), vagy maga a gyámi szerepkör ellátása valósult meg bíróságokon keresztül (osztrák jog) vagy a közigazgatási szervezetrendszer keretében (magyar jog). A jogfejlődés szoros összefüggésben volt a változó társadalmi-gazdasági körülményekkel, az iparosodás során végbement demográfiai változásokkal, a legújabb korban pedig szembenéz az egészségügy fejlődésével is. Az apai hatalomra, a szülő és a gyermek közötti viszonyra, a házastársak egymás közötti kapcsolatára, a házasságon kívül született gyermekek megítélésére vonatkozó szabályok bemutatása tükrözi a család fogalmának átalakulását, a gyermekek helyzetét és a nők megváltozott szerepkörét. A cselekvőképtelen nagykorúak vonatkozásában az egyes jogrendszerekben kialakuló gondnoksági szabályok különböztek aszerint, hogy milyen fokú cselekvőképességet ismertek, később pedig mennyiben valósították meg a gondnokság kiváltására alkalmas támogatási formákat. A cselekvőképtelen személyekre és a gondnokságra, gyámságra vonatkozóan a Code Civil és az ABGB rendelkezéseinek bemutatására kerül sor, figyelembe véve e szabályok későbbi változását is, összehasonlításban a XIX. századi magyar jogfejlődés eredményeivel, a XX. század elején megalkotott magyar magánjogi tervezetek szabályaival, valamint az 1959-es, a 2009-es és a 2013-as magyar polgári törvénykönyvvel.
