Abstract:
SB Betawi Cultural Village is a region defined by the Jakarta administration as cultural preservation area. This research will discuss the link between this village with politics, history of Betawi ethnic origin, as well as field visits. This research will conduct a view from two perspectives, one is the perspective of an architect and the other is of a commoner. This research tries to understand the meaning of the presence of this cultural village and how it was presented as a preservation and reservation area, not only the nature but also the Betawi culture and ethnic. In addition, this research also describes an understanding of the participation of politic, architecture and space in building the image of the region and at the same time creating a development boundary. Because of the sensitive topic of this research then the subject has to be abbreviated into ‘SB’. Keywords: Betawi people, cultural village, heritage, power

Abstract:
Migrations and migrants have been in the focus of interest and activities of many governments, organizations, and institutions, both worldwide and in Croatia. According to international policies, children who seek or are under international protection have the right to education. To access the education system of the Republic of Croatia more easily, they are given the opportunity to attend Croatian language preparatory or remedial classes. The research aim was to determine the needs and challenges posed by the inclusion of a Syrian asylum seeker in a Croatian primary school. The qualitative approach was applied. The case study presents a ten-year-old Syrian girl, attending a primary school in Zagreb. The data were gathered with the use of semi-structured interviews with the girl's sister, teachers in the primary school, and her classmates. In order to gain a deeper insight into the girl's functioning in the school context, notes made by teachers during observation of the girl’s performance in the course of the educational process were gathered and analysed. Guidelines and recommendations were developed that could have a positive impact on quality inclusion of children refugees and asylum seekers in the Croatian education system. Abstract:
This essay explores the role of strategic ignorance in relation to access to legal advice in England and Wales, drawing on the work of Linsey McGoey (2012; 2019; 2020), taking areas of extreme shortage of immigration and asylum legal advice as an example of the wider phenomenon in access to justice. It argues that there is a misplaced belief in market-based procurement to meet advice needs, which leads to a failure to collect evidence to understand whether the market does in fact achieve this. This avoidance of evidence about market functioning and the relationship between demand and provision is facilitated by fragmentation of both policy and operational responsibilities, leaving large gaps for ignorance, in which the accounts and concerns of advice-users are dismissed as not credible. It argues that, in failing to collect adequate evidence about the functioning of the market, the Lord Chancellor is ignoring a statutory duty to secure the availability of legal aid. Keywords: legal aid; advice deserts; strategic ignorance; asylum and immigration; LASPO Act 2012 section 2.

Abstract:
ABSTRACT Objective: The aim of this research is to present and discuss the paradox of the right of asylum for refugees, considering that on one hand there is a right of protection of the human being, giving priority to the fundamental values of freedom and the protection to be afforded to political refugees and persons persecuted for political reasons and, on the other hand, there is the prerogative and sovereignty of each State. Methodology: The research was developed in deductive method, in bibliographic research, through interpretation of scientific articles, studies and jurisprudence, also seeking a historical perspective, as well as the interpretation of Brazilian legislation, comparative law and international bodies such as the Inter-American Court of Human Rights, the Asylum Convention, signed in Havana in 1928, the Cartagena Declaration, the Caracas Convention of 1954 and others. Results: The study reaches the conclusion that the right to asylum still has a very incipient treatment, as it is still considered a right of the State and not the right of the individual, despite its essential purpose of protecting the individual, which is considered a contradiction. This paradox is more evident when the prerogative of the State to grant asylum or not is confronted with the Universal Declaration of Human Rights. Contributions: Undoubtedly, this matter is currently relevant as it deals with international human rights and the expectation of millions of migrants hoping to obtain an asylum. As a contribution, this article reports several difficulties associated with the granting of an asylum in the national perspective as well as international cases and all efforts exercised by international bodies in favor of the refugees. KEYWORDS: Right of asylum; territorial asylum; political asylum; Interamerican Human Rights Court.

Abstract:
On the surface, Anatole Livak’s The Snake Pit (1974) contains little more than a socially conservative overuse of pseudo-Freudianism. The film has been rightfully criticized for its departure from the novel on which it was based, specifically in its more traditional approach to Virginia, its female protagonist. To simply dismiss The Snake Pit for these reasons, however, would not do justice to the film’s importance within the history of cinema and psychiatry. This article will analyze the historical and cinematic factors that influenced Litvak’s The Snake Pit, a film worthy of both praise for its social impact and blame for its failure to go far enough. AbstractAim: Millions of people are displaced globally, as refugees, asylum seekers or migrants. Although, at a first glance, crisis and conflicts are considered the main trigger for these movements, the migration challenge may have different roots: demographic trends, poverty, the globalization of communication, etc. The present article is an introduction to the main concepts and terminology regarding migration and it links the migration with actual labor problems within the EU.Design: The article shows how migration terminology is reflected in the EU migration policy and how migration policy affects labor policy and vice versa. The article is to be considered a state of the art or methanalysis and explains the concepts: in-migration, out-migration, refugees, asylum-seekers. In addition, it draws attention to controversies regarding the use of concepts: illegal migration, irregular migration and return migration. Conclusions: The article presents eight main economic theories of migration. Five of them have as subject of analysis the determinants of migration and the other three have the subject of analysis the perpetuation of migration. Some of the main theories analyzed here are the neoclassical theory of migration, the human capital theory of migration, the new economics theory of migration, world system theory, network theory, migration systems theory.Originality: The article demonstrates the fact that neither of these economic theories/models explain adequately the actual determinants of migration and it proposes a new model focused more on the transdisciplinary effects of human movements. Abstract:
One of the contemporary international problems faced by the Governments in the world is asylum seekers and refugees. As an archipelagic country located at the junction of two oceans and two continents, Indonesia is a target for asylum seekers and refugees worldwide. This is certainly a challenge for Jokowi's foreign policy. In this context, Presidential Regulation/ Peraturan Pemerintah Nomer 125, 2016 concerning Handling of Foreign Refugees was issued. Through a qualitative descriptive method with data analysis techniques, this study came to the conclusion that the policy was issued due to at least two factors, namely: (1) as a temporary substitute for the 1951 and 1962 UN Conventions which had not been ratified; (2) The strengthening of international norms in the form of human rights. Keywords: International Norms, Asylum Seekers, Refugees, Perpres No 125 Tahun 2016 Abstraksi Salah satu masalah internasional kontemporer yang dihadapi Pemerintah Indonesia adalah Pencari Suaka dan Pengungsi. Abstract:
This study was made descriptive-cross sectional in order to identify the reasons why old people come to old age nursing home. This descriptive study was conducted with the participation of 64 old people among 69 who stayed in a nursing home in Samsun between 13.04.2016 and 15.06.2016, who could communicate with us and who were willing to participate. The data was collected by a survey form prepared by the researchers in line with the literature. Survey form consists of 59 questions aiming to determine the socio-demographical properties of old people and their social and family living conditions before coming to a nursing home. In the evaluation of data percentage calculation and chi-square test were used. The age average of old people is 74.9±8.4. 32.8% of the old people are women and 67.2% of them are men. 34.4% of them were graduated from primary school. 53.1% of them have chronic diseases, 40.6% of them do not have a relative to take care of them, 23.4% of them came to nursing home as they faced decline in proceeding with daily activities without dependence on others, 53.3% of them do not communicate with their children, 43.8% do not have any visitors coming to the institution. 76.6% of them expressed that they stay in the nursing home since their families consider the old people in the family as a burden. 45.3% of them describe the nursing home as a place where they wait for the end of their lives, 25% of them express that they were not wanted by their relatives before coming to a nursing home. 3.1% of them faced physical violence from the relatives with whom they stayed together. In this study, it was observed that reasons, why old people preferred to live in the nursing home, are the absence of individuals to give them care, loneliness, and conflict with children. It is suggested that interventions should be made in order to increase the interactions of old people with family members and convert nursing homes to joyful places where old people can perform social activities with their coevals. Abstract:
AbstractEach state has the right to protect their national security in every possible way, and illegal acts such as aliens entering their territory without permit is no exception. They implement regulations and policies to prevent people smuggling, including but not limited to maritime interception towards vessels under suspicion of carrying refugees and asylum seekers. Yet, in the implementation, human rights violations tend to happen towards the passengers. This study aims to analyze the legality of maritime interception on foreign vessels carrying refugee and asylum seekers, and whether the said conduct raised issues of state responsibility. This study was conducted by analyzing relevant international law instruments and principles such as non-refoulement and state responsibility. The analysis comes to the conclusion that states have certain jurisdiction to conduct interception operations at sea with the means of protecting their national security. Should the act of interception be proven to inflict threats of danger towards the lives of the intercepted refugees and asylum seekers, states should be held responsible for the damage bared to the refugees and asylum seekers. In conducting maritime interceptions, states should ensure the refugee identity of the intercepted vessel’s passengers and should seek that they are entitled to international protection. Keywords: Maritime Interception, Principle of Non-Refoulement, State Responsibility AbstrakSetiap negara mempunyai hak untuk melindungi keamanan nasionalnya dengan berbagai macam cara, dan tindakan ilegal seperti warga negara asing memasuki wilayah suatu negara tanpa izin bukan merupakan pengecualian. Abstract:
The increasing number of asylum seekers and refugees in the territory of Indonesia has caused social disturbances, political security, and even orders in society. The number of their arrivals is not proportional to the number of settlements or placement to the recipient country (Australia). To deal with the problem of asylum seekers and refugees who enter and are in the Indonesian territory, the government issued Presidential Regulation No. 125 of 2016 concerning Handling of Foreign Refugees. This regulation does not only confirm the position of Indonesia pro against refugee humanitarian policies, but also its manufacture which is not in accordance with the legal principles of the establishment of legislation. The legal position of Presidential Regulation No. 125 of 2016 raises disharmony in the legal order (immigration) in Indonesia. Article 7 of Law Number 12 of 2011 has stipulated the order of laws and regulations that form the basis of the enactment of all legal regulations in Indonesia. The provisions of this article are in harmony with the Theory of Norms Hierarchy (Hans Kelsen) which explains that lower norms are valid, sourced and based on higher norms. However, this theory is not enacted in the formation of Presidential Regulation Number 125 of 2016, where in the body the norm is in conflict with the higher legal norms above it. The existence of this regulation has created norm conflicts which have led to the absence of legal certainty. Keywords: Presidential Regulation Number 125 of 2016, Refugees, Immigration

The article analyzes the stages of the formation of a common immigration policy of the European Union. The article argues that the elimination of the stages is due to the need for answers to the challenges of both economic needs and the circumstances of the environment caused by regional and global threats. On the whole, it can be assumed that an increase in the role of the institutions in the area of immigration policy under the Lisabon Treaty will help to strengthen the protection of the rights of immigrants and deepen European integration. At the same time, it can be stated that certain areas of the Unions immigration policy will continue to be at different levels of harmonization: from the most „communitarization” (asylum policy, the fight against illegal immigration), to a large extent remaining in the competence of national governments (economic immigration). Abstract:
Continuous human rights persecutions have forced nearly one million Rohingyas to flee from Myanmar and seek refuge in Bangladesh. While their forced migration to the first asylum country of Bangladesh is inevitable, some have been compelled to move onward to other transit countries. Existing studies indicate various factors influencing cross-border activities among different segments of immigrants. They also suggest that the degree of transnationalism affects different kind of people on the move, subsequently brings about unique consequences to receiving community. In this study, we aim to determine factors contributing to the onward movement of Rohingyas from their refugee camps in Cox’s Bazar, Bangladesh to Malaysia. We utilize the broader concept of transnationalism in order to gauge the Rohingyas’ perception and the realities they face in relation to their onward movement from Bangladesh to Malaysia. This study employed three methods of data collection namely a survey, an in-depth interview and a focus group discussion in engaging the Rohingyas in Klang Valley, Malaysia. Resulting from a two-part of data collection conducted in 2013 and 2016, we found that the onward movement of Rohingyas was mostly driven by poverty, unconducive livelihood experiences, limited access to humanitarian aid, and inadequate refugee protection in Bangladesh. Meanwhile, positive Rohingyas’ perception toward Malaysia, coupled with the availability of job opportunities have attracted them to choose Malaysia as the next asylum country. While this study enriches the existing literatures on transnationalism and onward movement of refugees, it also provides empirical evidences for humanitarian assistances in Bangladesh and Malaysia. Abstract:
Papua New Guinea Solution is a bilateral relationship between Australia under Prime Minister Kevin Rudd and Papua New Guinea regarding anti-resettlement conducted by people who want to access Australia and obtain refugee status by boat. This solution was taken after Kevin Rudd who came from the Australian Labor Party sent Pacific Solutions which had been used during Prime Minister Howard's administration. The difference in efforts to overcome the arrival of aid can be seen by using the Bureaucratic Model in its analysis. This effort was carried out with the aim of securing Australia. The problem is that Australia ratified the 1951 Refugees conference. Abstract:
The process of human migration between Indonesia and Malaysia has been running for hundreds of years. Only in modern times have the problem becomes more complex. Migration not only provides benefits for both countries, as remittance and development, but it also has a negative impact and creates problems such as the abuse of migrant workers or increase of irregular migrants. This paper attempts to identify the driving forces of migration and explore different types of migration from Indonesia to Malaysia. It is found that there are five pull-push factors of migration, namely; economic, demographical, social, environmental and political factors. The economic and demographical factors become the main causes of migration in the form of workers. The social factor of migration encourages Indonesians to study in Malaysian universities. The political and environmental factors, which are obvious among the Acehnese, include migrating to Malaysia in the form of refugees and asylum seekers. By exploring all factors of migration, this paper attempts to mapping out the human migration process for Indonesia to Malaysia. Abstract:
The purpose of this study is to describe the views of immigrants on outside home activities and the support they have received. The data were collected via semi- structured questionnaires (n=113) during 2019 and analysed using statistical methods. The open questions were subjected to thematic analysis. The respondents’ mean age was 41 and they came from 29 countries. Fifty-seven percent of the respondents participated actively in an association or group. Participation had a positive correlation with their ability to speak and understand Finnish. A principal component analysis performed on the causes hindering participation produced seven factors, which explain 70% of the phenomena. The greatest causes were: 1) cultural rules, 2) fears and lack of skills, 3) lack of a computer and computer skills, 4) lack of time, 5) the costliness, 6) food and customs culture and 7) lack of a car. Causes supporting participation produced two factors: 1) Finnish friends, neighbours, authorities, other immigrants and study and work friends and 2) one’s own parents and family. This study reinforces earlier results about the advantages of participating in activities in learning the language and integrating into the culture and the environment of the new country. Abstract:
The maltreatment and torture of prisoners constitute a global problem. Methods of maltreatment are classified as the psychological and the physical, and physical methods inevitably lead to psychological sequelae. Our review offers an analysis from the medico-legal perspective of the literature on the torture and physical and sexual abuse experienced by prisoners and their psychological sequelae and aims to investigate the medico-legal issues of investigating maltreatment in prison so as to suggest methodologies and updated approaches for dealing with such cases in a forensic context. We performed a comprehensive literature search of peer-reviewed publications (articles and reviews), research reports, case studies, books, service models, protocols, and institutional documents available online using key electronic databases (Scopus, PubMed) and search engines (Google Scholar) with the following keywords: physical violence, psychological violence, torture, maltreatment, physical abuse, psychological abuse AND prison OR prisoner OR jail OR custody. In the medical literature, most of the publications on torture are based on retrospective studies of torture among survivors and often refer to asylum seekers. Forensic evaluation is crucial for assessing the determinant elements of torture and maltreatment. A multidisciplinary approach and standardized and updated methodologies are needed to support policymakers, national institutions, and public health system initiatives in this field.

Abstract:
The article considers what arbitrary law-making is and what may count as arbitrary law-making in the field of migration policy. It contributes to the discussion of arbitrary law-making in relation to migration policy in two ways. First, it offers an analysis of arbitrariness, pointing out that rhetorical definitions abound – perhaps not surprisingly, given that migration is a highly-contested policy area – and argues for why transposing a conception developed in ethical theory to the law has high theoretical costs. An alternative conception is described and found to be better equipped to deal with arbitrary law-making in migration policy. It is argued that if we want to understand how arbitrariness plays out in the field of migration law – which is necessary to find ways to hinder its spread by the adoption of specific law-making practices – we first need to distinguish arbitrariness from legitimate choices of legislators. Secondly, a typology of forms of arbitrariness is fleshed out in relation to contemporary migration policy. The policy area is here broadly construed to include not only naturalisation processes, but also migration, asylum and refugee policies and more generally border control. The examples are taken from a broad selection of countries. They have been chosen for illustrative purposes only. Abstract:
Adult education is a wide field which is dealing with the educational needs of adult learners from a diversity of groups, including people with special needs, women, refugees and asylum seekers. The aim of this study is to understand and analyse the opinions of the educators regarding their understanding of the participatory video method, the usage, the benefits and the contribution of the participatory video method to their professional development, and finally their thoughts on the participatory video method. The qualitative study and the case study with a holistic single case were used. Face-to-face interviews using semi-structured interview forms were used to collect data. The results show that the understanding of the participatory video method by the educators was the inclusion of different groups of people, collaborating and learning new skills; the benefits gained by educators were learning new things and skills; the participatory video method has contributed to their professional development and the majority of the educators are eager to implement it in their workshops and practices; and the educators perceived the participatory video method as an inclusive, connecting, tutorial and a generally positive phenomenon. These findings will inspire adult educators to use this method in their training organised for disadvantaged groups. Keywords Adult education; participatory video method; people with special needs

Abstract:
- In this article, we analyse the impact of Europeanisation on domestic actors, by looking at how Europeanisation affects the configurations of power and coalitional dynamics at the domestic level. Focusing on the Italian case, with the help of social network analysis and on the basis of 80 semi-structured interviews, we shall look at networks of alliance, disagreement and target among political actors that mobilise on European issues within three specific policy areas (European integration, agricultural policy and immigration and asylum policy), focusing in particular on the role that social movements and NGOs play in these networks (are they central? Are they peripheral? Who play a role as ‘broker'?). In fact, processes of Europeanisation can destabilise the configuration of power in public policies and the relative structure of policy networks, weakening stable and ‘dominant' actors while strengthening others and opening ‘windows of opportunity'. We also explore the formation of specific coalitions between social movements and NGOs and the other actors, as well as the cleavages around which the debate on Europe is structured and which can influence the path of Europeanisation of national collective actors. Observing these networks, our research recognises the importance that the multilevel structure of the EU creates in terms of offering new opportunities and organisational resources to actors, yet also acknowledges the crucial importance of meso-levels of decision-making, the dynamics of interaction between actors in the same context, and their subjective interpretations. Abstract:
During the 19th century, in Spain, different laws and orders for the establishment and organization of the Charity Public took place, being the public authorities who were to exercise social charity to the most vulnerable. In this context, further influenced by the emergence of Moral Treatment, a new philosophical and action concept was activated in management, treatment and care for the mentally ill, considered then insane and/or madness. Health care placed a greater emphasis on occupational activity as therapy, as well as improving healthiness and hygienic conditions. However, many factors made it impossible to consummate change, leading to the emergence of new asylum institutions with a marked asylating and custodial character. The aim of this historical study is to try to know the situation in health care to the demented of Alcalá la Real (Jaén) of the time. In the sources used, two fundamental pillars stand out in our study: the Municipal Archive of Alcalá la Real and the Archive of the Provincial Council of Granada. Fromthe data collected it is outlinedhowin the first two decades of the second half of the nineteenth century the madmen alcalaínos were transferred to the Hospital of Madness of Granada, section of the Royal Hospital. The absence of a hospital for these patients in Jaén justified such transfers. The latter were accompanied by a long bureaucratic process that began on the Municipal Board of Charity and ended with the approval of the governor of Jaén. Abstract:
The right to non-discriminatory access to healthcare is anchored in the European Convention on Human Rights and other international treaties or guidelines. Since its ratification, the European Convention on Human Rights was made binding in all Member States of the Council of Europe and is interpreted by the European Court of Human Rights (ECtHR). Despite its legal recognition, discrimination in healthcare provision has repeatedly been an issue of medicoethical and political consideration. In this context, minors are particularly in danger of being deprived of this fundamental right. The aim of this study is to analyze the current state of the ECtHR jurisdiction on challenges in accessing healthcare for minor patients. We conducted a systematic search of judgments by the ECtHR using the keywords “healthcare” and “child”. We performed descriptive statistics and qualitative thematic analysis. Our search resulted in n = 66 judgments, which were all screened. Access to healthcare for minors played a role in n = 21 judgments, which involved applications against n = 13 countries. We formed five, partially overlapping categories, which represent recurring themes regarding the research topic. These themes are governance failure (n = 11), the status of refugee, asylum seeker or migrant (n = 5), parental home (n = 5), maternity and birth (n = 4) and others (n = 2). The normative framework of the ECtHR’s jurisprudence illustrates intersections between social, legal and medicoethical aspects of minors’ discrimination in the healthcare system. It emphasizes the particular vulnerability of children, who require exceptional protection. Inadequate access to healthcare manifests itself in specific situations, such as in the context of migration or staying in public institutions. Healthcare professionals need to be sensitized for such discrimination mechanisms, as they are often at the forefront of encountering structural discrimination in the healthcare system.

Abstract:
Many studies have highlighted a substantial "bureaucracy domination" in procedures relating to migrants’ access to territory. This form of domination is marked by highly discretionary and arbitrary practices, enacted by the administrative authorities of the state. Only minor attention, however, has been devoted to the arbitrariness of judicial decisions and to the judicial role in general in the numerous proceedings that increasingly affect the path of migrants. This path is the main object of this paper. The study focuses on Italian case law in expulsion and detention proceedings of irregular third country national citizens and asylum seekers and presents qualitative empirical research on decisions issued by the competent national authorities. The results have been analysed using a selection of theoretical tools, all referable to the general concept of the rule of law. The judicial decisions on pre-removal detention proceedings in two case studies are examined: the jurisprudence on detention of irregular migrants, in different offices of the Justice of the Peace in Italy; and the case law on detention of asylum seekers in the Ordinary Tribunal of Rome. The assumption underlying the research is that various conceptions of the rule of law may have different explanatory power when it comes to explaining the empirical results. To verify this hypothesis, the study proposes an overview of the main rule of law doctrines in the Western tradition of political and legal thought and applies the method of historical-conceptual analysis. As a result, the explanatory power of six theoretical models of the rule of law was verified against the data with the view to highlight the virtues and vices of the respective explanatory frameworks. This article reaches a two-fold conclusion. First, as far as the explanatory frameworks are concerned: the results of the two case studies cannot be fully explained by any of the models considered in this study. This fact alone casts doubts on the explanatory power of these theories and calls for further research on judicial decision-making more generally. Secondly, a key finding of the study regarding the notions of discretion and arbitrariness is that the judicial approach which assures the highest protection of rights is also the one that is most easily influenced by arbitrariness. The author argues that this paradox can be easily dissolved by paying attention to the plural dimensions of arbitrariness. If we consider arbitrariness from a legal point of view, i.e. as an illegal decision, it is unsurprising that the authority that most uses its discretionary powers is also the one most at risk of abusing these discretionary powers and hence of exercising arbitrary power. However, if we consider arbitrariness from the point of view of philosophical-political theory, i.e. as a form of domination characterised by the absence of sufficient justification, it is unsurprising that the judicial approach which assures the highest protection of rights is also the one that takes its own role as guarantor of these rights and of the constitutional democratic legal order as such most seriously. This judicial approach thus most often risks exercising its power in criticisable ways, as compared to an authority much more in line with the requirements of law enforcement agencies. Abstract:
The article covers the activities of the Extraordinary Diplomatic Mission of the UPR in Bucharest. The year of 1920 marked a special period in the relations of the UPR of the Directorate times with the neighboring Kingdom of Romania, given a specific geopolitical situation and the conditions of almost complete isolation of Ukraine caused by the relentless advance of the Bolshevist army from the north and east as well as an offensive of the White Guard troops of A. Denikin and P. Wrangel from the south. Under such circumstances, the UPR considered Romania as its most important military, political, and economic partner. In turn, the erstwhile Romanian leadership was deeply interested in the existence of an independent Ukraine, primarily as a political and military buffer zone between Romania and the aggressive Soviet Russia. The article mentions the main areas of activity of the Extraordinary Diplomatic Mission in Bucharest: representing and protecting political, economic, and military interests of the UPR, encouraging trade relations, providing assistance to civilians and military emigrants from Ukraine who found themselves in the territory of the neighbouring country against their will as well as activities aimed at overcoming information vacuum around the UPR. The activities of the UPR Extraordinary Diplomatic Mission in Bucharest in 1920 contributed to the expansion of the Ukrainian idea abroad, promotion of knowledge about Ukraine and its struggle for independence, whilst drawing the attention of the international community to the acute problems Ukraine was facing at that time. The UPR Extraordinary Diplomatic Mission in Bucharest was also entrusted with a special task of providing the Ukrainian government with a full-fledged connection with Europe, especially with the En-tente countries. The article also is a pioneering research of the aspect of activities of the Extraordinary Diplomatic Mission in Bucharest associated with providing working conditions in the city for I. Mazepa, Head of the Council of People’s Commissars of the UPR, in March 2020, who was forced to flee Ukraine because of unconducive military circumstances and seek asylum in the adjacent country. Abstract:
The concept of vulnerability is blurred and often evoked in the context of refugee and forced migrant women. Paradoxically, it is also employed by the EU with regard to its external border security. Thus, the question arises of how the EU conceptualizes vulnerability in its external migration policies and who is perceived to be vulnerable – refugees and migrants, or external borders? Using a systematic lexical keyword search to identify relevant policy aims in the EU Pact on Migration and Asylum, the latest policy agenda on migration and asylum of the EU Commission published in September 2020, this paper highlights the mostly one-dimensional concept of vulnerability in external EU policies. In this article, it is argued that this entails significant gendered implications for asylum-seekers and migrants en route to Europe. It further reveals the detrimental effects for migrants and refugees caused by the EU’s focus and prioritization of its vulnerable borders. Ultimately, this paper by adopting a gendered lens calls into question whether the European Commission fully incorporates human rights commitments in its policy guidance on asylum and migration.

Abstract. It is now 48 years from the declaration of 1982 Burma Citizenship Law. A law that legally denied the citizenship of (Muslim) Rohingya in Myanmar. It means also that for 48 years (Muslim) Rohingya remains stateless. Their fight over citizenship then becomes a global, or at least a regional challenge in International Relations sphere. In one aspect, their attempt in finding asylum to other countries at some point threaten the (arrival) state’ security. However, in another side, they also fight for their (human) security or even so (human)rights. Both securities are equally important. This article is more an introduction to the Human Security concept that was first initiated in 1994. It starts with a simple question on “how does Human Security explain the issue of Rohingya?” It seeks for key points that Human Security can explain by reflecting on Rohingya as the case study. It aims to give a bigger picture of this conflict interpreted by Human Security concept. Finally, as we are living in the globalization era, this issue is not only a state or regional challenge, but also a global challenge where IR actors can take responsibilities in helping and solving this human insecurity issue. Keywords: Rohingya; Human Security. Abstract:
The refugee crisis that occurred in Europe in 2015 has caused various challenges to the EU's asylum and migration policies. Migration flows from refugees have posed the threat of internal crises to pressure on the Freedom of Movement regime, namely the Schengen Agreement. This study discusses the securitization of cross-border refugees carried out by the European Union against the Freedom of Movement regime. The research analysis uses the framework of securitization theory by Buzan through a speech act by the European Union as a securitization actor in the security governance in line with theory proposed by Sperling & Webber. The study used qualitative methods by reviewing documents and interviews with related informants. The findings of this study indicate that the initial speech act by the European Union has failed because of the rejection from member. Thus, the securitization process experienced recursive interactions between the European Union and the member in security governance. This recursive process has changed the speech act process and extraordinary measurement by the European Union, which initially focused on humanitarian discourse, turned into a border security discourse to protect the achievement of the EU's core integration, namely Schengen. Abstract:
The administrative practices of officials who process the admission of immigrants show severe variations in the ways in which migration policy is enforced on the ground. For the author, inequality of treatment lies in the very hierarchy of tasks and services of what he dubs, following Pierre Bourdieu, the immigration "field". According to the author, the governments’ securitizing priorities favour the sort of suspicion towards foreigners that the media then reproduces, thus authorizing so-called street-level bureaucrats to act with great leeway with regard to immigrants. Under pressure, governments implement what the author calls a "trompe-l’oeil policy" that explores the ambivalence between international and domestic law: while the state enforces repressive laws that apparently comply with fundamental human rights, it leaves to low-ranking civil servants enough discretion to make those rights ineffective. This point is the author’s central contention. The arbitrariness of these officials is neither contingent nor accidental: it actually constitutes a purposive "front-line policy" to enlarge the discretionary power of street-level bureaucrats in charge of regulating admissions. Unequal treatment comes in three flavours in this context. First, officials are asked to ensure that each right granted to a foreigner will not threaten the national order, which means the economic, social and political order. They are therefore in a position to judge the suitability of each application in view of their own arbitrary interpretation of what such "threats" consist of. The question of discretionary power is in this way intimately linked to the problem of equality before the law. Second, the scarcity of material and human resources allocated to services in charge of welcoming migrants starkly contrasts with the expenditure incurred to deport foreigners. Inequality also arises from how agents perceive users and the leeway they have to implement the law. Third, inequality is related to foreigners’ abilities and means to challenge discretionary power, especially through the legal tools they use or through legal intermediaries. The author thus concludes that such "front-line policy" has increasingly been used as a weapon against migrants, especially since the early 2000s, when immigration and detention policies were generalized in France. More broadly, in Europe as well as in United States, immigration reforms have made greater use of detention and focused on enforcement rather than on hosting programs and services for asylum seekers. But they have also strengthened the role of legal intermediaries. Hence the need to investigate how discretionary power is challenged as it sheds light on the power relations between states and migrants. Abstract:
The article analyses the modern court decisions of the European Court of Human Rights on the formation and implementation of the principle of gender equality in Ukraine. The research defines that the importance of ensuring equal rights and opportunities for women and men for Ukraine was because Ukraine is a member of all major international and European regional agreements in the field of human rights. The authors state that this is due both to Ukraine's general commitments to promoting respect for human rights and fundamental freedoms and their adherence, as well as the fact that its participation in European integration processes is important for Ukraine. The research stipulates that gender equality provides equal rights for women and men, as well as their same significance, opportunities, responsibilities and participation in all spheres of public and private life. The authors prove that the pioneering work of the Council of Europe in the field of human rights and gender equality contributed to the development of a comprehensive legal framework. Gender equality is one of the organization's priority areas of activity, and the Council of Europe continues to actively address current and emerging challenges and address barriers to achieving real and complete gender equality. The research investigates the provisions of the European Convention for the Protection of Human Rights and Fundamental Freedoms and Protocol No12 in terms of prohibition of discrimination and ensuring gender equality. It also determines that the conceptual principles of these documents are the protection of human rights, support for democracy and ensuring the principle of the rule of law. The article states that, in particular, the modern legal instrument in the field of gender equality is the Council of Europe's Gender Equality Strategy 2018–2023. The document provides for the achievement of the main six goals. These include combating gender stereotypes and gender discrimination; preventing and combating violence against women; ensuring equal access of women to justice; ensuring equal participation of women and men in political and public decision-making; implementation of the strategy for achieving gender equality in politics and all activities; protection of the rights of migrants, refugees, women and girls seeking asylum. The authors prove that the establishment of the European value of gender equality should be ensured both in society as a whole and in its various institutions, in particular. This is primarily to prevent gender discrimination, ensure equal participation of women and men in making socially important decisions, ensuring equal opportunities for women and men to combine professional and family responsibilities, prevent gender violence, etc. Keywords: Gender Equality, European Standards, Legal Mechanism, European Court of Human Rights, Discrimination, Equal Rights.

Abstract:
Purpose This paper aims to deduce and present an extended hospitality approach. In developed countries, hospitality is increasingly linked to tourism; in times of migration and increased refugee flows, the accompanying social, economic and political determining factors play a more prominent role, necessitating a new view of hospitality. This study aims to extend the domain of tourism in hospitality by including aspects related to asylum seekers and to combine it with topics regarding welcome culture, service quality and relational quality. The paper explores the question concerning whether, and in which ways, the various sectors may learn from each other. Design/methodology/approach To expand this new research area and to take the exploratory nature of the research aim into consideration, a qualitative approach was chosen. Fourteen qualitative interviews with experts from the tourism and industry sectors and organizations linked with asylum seekers were conducted; the interviewees were chosen by purposeful sampling, according to knowledge and diversity criteria. GABEK was used as a qualitative research strategy, which involves theories of a phenomenological and linguistic nature. This method allows for a more holistic approach to the complex nature of the topic through the collection of perceptions resulting from open qualitative interviews and a keyword-based analysis. Findings The paper presents a model for an extended hospitality approach, as hospitality should not be limited to its connection with tourism matters. Refugees as well as tourists rely on the friendliness and the welcoming nature (hereafter: “welcome culture”) of a host country. The tourism industry can stand to improve its unconditional hospitality toward refugees — the comprehension and understanding of different cultures and values is an important aspect of welcoming new arrivals in the local surroundings, be they tourists, migrants or refugees. Research limitations/implications As stated above, a qualitative research approach was chosen with the intent to open the research field toward an extended hospitality approach. Therefore, future research must focus on testing the results for application in a more general context. The study was also limited insofar as the conduction of research took place in Bavaria alone. Practical implications As stated above, a qualitative research approach was chosen with the intent to open the research field toward an extended hospitality approach. Therefore, future research must focus on testing the results for application in a more general context. The study was also limited insofar as the conduction of research took place in Bavaria alone. Originality/value This paper combines different access points to hospitality in a new form.

Security means the state of being free from danger, risk or threat. In social sciences, human security is an emerging paradigm shift concerning a person-centered, multi-disciplinary understanding of security involving a number of studies and human rights. According to Amartya Sen 2000 , “human security” is a keyword referring comprehensively everything free of the menaces that threaten the survival, daily lives, and dignity of individuals and to strengthening the efforts to confront these threats. On the other hand, “human insecurity” as a term stands for defining various situations where conflicts lead to perception of deprivation of some-kind, among certain people, in a given context Sirkeci, 2009 . Human insecurity affects migration movements in a way with the connection of 3Ds: namely democratic, development and demographic deficits. Accordingly, it is claimed that recent developments, the attempted coup on July 15, 2016 and the aftermath have made Turkey as a seemingly insecure place in reference to these 3Ds facilitating migration movements in and/or from the country. Sirkeci, 2017 According to the reports of Eurostat published in 2016, asylum applications filed by citizens of Turkey in European countries reached at 3779 in the third quarter comparing to the same quarter of 2015 at 985. After the attempted coup, this tendency seems on the rise, which actually signals us the fact that human insecurity perceptions among citizens. Abstract:
Abstract: Hospital is a social organization and logical combination of the activities of a number of persons with different level of knowledge and skill for achieving a common goal of patient care through a hierarchy of authority and responsibility. Public and professional interest in health services has increased dramatically over the last two decades. Medical sociologists have been interested in the structure, organization, dynamics, and impact of health services for well over 50 years. Sociologists have been instrumental in highlighting the challenges associated with integrating care, as well as the inter‐ and intra‐organizational dynamics that are occurring within increasingly complex healthcare systems (Flood and Fennel 1995; Light 2004; Scott et al. 2000). Understanding these organizational changes is critical because they reflect fundamental shifts in the nature of medical work and the delivery of health services. Today’s complex health systems represent fundamentally new configurations of an increasingly broad array of professional expertise that is altering the long standing system of professional. In this, the health care system has been elaborately discussed focusing mainly on hospital system. Following are some of the points focusing on hospital as a social organization. Goffman described hospitals as “total institutions” (referring in particular to asylums for those with mental health problems, but also to hospitals more generally), in which people were isolated from society over a period of time and led life an in enclosed and formally administered way (Goffman, 1968). He argued that, as a result of this experience, people often formed new relationships and attachments dependent on these institutions (i.e. underwent a process of “institutionalization”) that could make re-integration into the community on discharge very difficult. Abstract:
The research paper summarizes the arguments and counterarguments within the scientific discussion on the issue of social media platforms, HR marketing, E-recruitment and human capital management. The primary purpose of the research is to determine whether the size of the selected healthcare providers influences (1) the active use of social media platforms and (2) the creation of the recruitment videos to address potential employees on the internal or external labour market. Systematization literary sources and approaches for solving the problems of the social media platforms, HR marketing, E-recruitment and human capital management indicate that the implementation of IT technologies in the field of human resources management is becoming a necessity in today’s world. Regarding methodological tools of the research methods, this research study used quantitative and qualitative marketing research as the essential primary sources of information and data. For the precise questionnaire survey and understanding of the individual questions in the questionnaire, a pretest questionnaire survey was also carried out. The pretest was conducted in the fourth quarter of 2018 on a sample of eight respondents. A significant marketing quantitative research followed after the removal of minor shortcomings, from October 2018 to January 2019. The object of the study was selected healthcare service providers in the Czech Republic. Fifty-eight healthcare service providers were thus analysed. Besides other things, two research hypotheses and one research question were formulated. In the research study, the Pearson’s chi-square test, Microsoft Excel 2013 and IBM SPSS Statistics 23 were used to verify the research hypotheses. The research paper presents the results of an empirical analysis showing that (1) there is no statistically significant relationship between the size of the selected healthcare service provider and the active use of the social media platforms as an HR marketing tool; (2) there is a statistically significant relationship between the size of the selected healthcare service provider and the creation of recruiting videos to address potential employees on the internal or external labour market; (3) social media platforms are used for the communication with the patients, clients, public and further for PR or promotion of selected healthcare service provider and the recruitment purposes of human resources and HR marketing. The research also empirically confirms and theoretically proves the need for IT knowledge and the active use of IT technology in the area of human resources management, today in the 21st century. The results of the research can be useful for the domestic and foreign healthcare service providers such as hospitals, maternity hospitals, children’s hospitals, hospital wards, field hospitals, nursing homes, asylums, clinics, sanatoriums of long term disease, health resorts, thermal baths, healing spas and other health and medical institutions or for academicians that are interested in human resource management. Abstract:
<p><strong>Abstract</strong> : This article is aimed to explain trends in Moslem scholars’ understanding on abrogation (<em>naskh</em>) theory. The <em>naskh</em> has been commonly conceived as final abrogation of particular Quranic verse by other one. But, this term has transformed from <em>naskh</em> as final abrogation to postponement (<em>nas’</em>). There have been three trends in understanding the <em>naskh</em> as postponement. First, the concept of postponement does not differ basically from the substance of naskh as final abrogation in the sense that both <em>naskh </em>and <em>nas</em>` have same meaning, as the majority of Moslem scholars said. Second, the <em>nas’</em> has own meaning which differs from the <em>naskh</em>, but both are regarded as complementary to each other, as argued by al-Zarkasyi, al-Biqa’i, and Ibn Asyur.
Third, the idea that the postponement constitutes an alternative to the <em>naskh</em> as final abrogation, so its proponents, such as Muhammad ‘Abduh and Nashr Hamid Abu Zayd rejected the <em>naskh</em> as final abrogation and replaced it by the <em>nas’</em> as postponement.</p><p>Keywords : <em>Abrogation (naskh), Postponement (nas’), Replacement (ibdāl)</em></p><p> </p><p><strong>Abstrak</strong> : Artikel ini dimaksudkan untuk menjelaskan tren-tren pemahaman para ulama tentang teori <em>naskh</em>. <em>Naskh</em> umumnya dikonsepsi sebagai penganuliran permanen ayat al-Qur’an tertentu dengan ayat lain. Abstract:
Purpose. This study aims to describe the profile progression from cornea over limbus to sclera using the module CSP-Re- port (Corneo-Skleral-Profil-Report) of the Oculus Pentacam. Material and Methods. Seventy-four left eyes of healthy sub- jects were evaluated. Data was collected as part of previous research (bachelor-thesis) using the CSP-Report module of the Pentacam Basic. Sagittal height, limbal angle and scleral angle were analyzed over three diameters in eight semi- meridians. Results. At diameter 10.00 mm the shape of the anterior segment of the eye was nearly rotationally symmetrical, the average sagittal height of the eight semi-meridians was between 1734 µm and 1806 µm. At diameter 12.80 mm the shape was more asymmetrical, average sagittal height ranged from 2797 µm to 3000 µm. At diameter 15.00 mm the asym- metry was most pronounced, the average sagittal height was between 3595 µm and 4033 µm. The average limbal angles at 12.80 mm were in the range of 35.68° and 42.02°. For the scleral angle at 15.00 mm mean values between 34.71° and 43.11° were determined for the eight semi-meridians. The nasal segments always showed smaller sagittal heights, accompanied by smaller limbal and scleral angles compared to the temporal semi-meridians. The same pattern was obser- ved for the superior semi-meridians in relation to the inferior segments. For the nasal semi-meridians, concave transitions of the corneo-scleral profile were observed, whereas tempo- rally a convex course of the CSP was observed. Conclusion. The CSP-Report provides a method to describe the shape of the anterior segment of the eye. These additional data are useful for fitting scleral lenses. Abstract:
The veterinary doctor is a professional actor in public health through direct contact with the three spheres. One of these professional's main actions includes promoting community educational measures to disseminate information regarding the prevention of zoonotic diseases. In the face of the current pandemic, we developed the project: "Butterfly effect applied to asylums of Uberlândia, Minas Gerais State, Brazil, in the combat to COVID-19" to spread information about the disease playfully and to attend to the demands of the involved institutions. Ten educational materials were produced and distributed, such as videos and interactive games with guidelines regarding COVID-19, in 16 shelters for the elderly, along with the collection of cleaning and personal hygiene products, masks, and food products from donations from 23 companies, to emphasize preventive measures. Institutional staff developed the proposed activities with the elderly, emphasizing the importance of social distance and personal hygiene at this time. The action performed allowed the amplification of knowledge about the pandemic due to the use of methodologies applied to the difficulties and needs of the elderly, allied to the emotional motivation used in the proposal, which favored the teaching-learning process. This social action in the institutions helped to raise awareness and clarify doubts concerning VOCID-19 to the leading risk group and reinforced the context of the veterinarian's action in the one health.
