Esta dissertação visa à análise dos contos presentes na obra Há um incêndio sob a chuva rala (1999), da escritora gaúcha Vera Karam. Utilizo-me de postulados teóricos vinculados à Crítica Literária Feminista e às categorias da narrativa, bem como aos conceitos de ironia e ao sentido do trágico na contemporaneidade, para verificar de que forma eles são combinados na construção das personagens femininas. Essas bases conceituais encontram-se no primeiro capítulo, intitulado "Diálogos teóricos: a teoria a serviço da prática textual". Neste capítulo, abordo o estudo O conto sul-rio-grandense: tradição e modernidade (1999), da professora e crítica Gilda Neves Bittencourt, pois a tipologia proposta amplia as fronteiras de análise, no que diz respeiito às tendências temáticas e narratológicas do conto sulino contemporâneo. Para conceituar ironia, o posicionamento de Linda Hutcheon, em Teoria e política da ironia (2000), serve de apoio, possibilitando autenticar as diversas circunstâncias de uso desta figura por Karam. A abordagem aos postulados teóricos acerca do sentido do trágico na contemporaneidade inclui os posicionamentos de Yves Stalloni (2002), Emil Staiger (1997), Albin Lesky (1997) e principalmente de Gerd Bornheim (1975). Este conceito sustenta a dicussão a respeito da presença deste traço nas personagens femininas, que é enfatizado conforme os papéis que elas desempenham na sociedade. Recorro também às reflexões acerca de gênero formuladas por Susana Funck (1994), Joan Scott (1990), Rita Terezinha Schmidt (1994) e Marta Gordo García (2007), entre outras, com o fim de explicitar a perspectiva de uma leitura a partir deste conceito enquanto categoria de análise. No segundo capítulo, intitulado "Um olhar sobre os contos de Vera Karam", realizo a análise das narrativas, considerando a confluência de aspectos, tais quais, a tipologia do conto, a ironia e o trágico, bem como as questões de gênero na construção das personagens femininas. Distribuo as análises dos contos em dois subcapítulos: “A imagem refletida” e “A imagem construída”. Três, dos oito contos, estão inseridos na primeira parte, pois aqui as protagonistas mostram-se como se vêem. Elas se autodefinem, refletindo, portanto, suas próprias imagens. Nos demais contos, as personagens são destituídas de voz própria, e suas imagens resultam da visão de um/a narrador/a. Apesar dos modos diferenciados de narrar, Karam direciona seu fazer artístico para a construção formal e temática e do status social das personagens femininas. Por meio delas é que a autora elabora e propõe a denúncia e a crítica social, além de explorar possibilidades de transgressão das mulheres às normas a elas impostas. A inegável habilidade técnica de Vera Karam associada a padrões artísticos/estéticos demonstrados em sua écriture, constituem-se em fortes fatores determinantes para sua inserção na historiografia literária sul rio-grandense.
This dissertation aims at analyzing the short stories in Há um incêndio sob a chuva rala (1999), by the gaúcha writer Vera Karam. I use theoretical principles linked to the Literary Feminist Criticism and the narrative categories, as well as concepts such as irony and the sense of tragic in our days, in order to verify how they are mingled to build the female characters. These fundamental concepts are in the first chapter, entitled “Theoretical dialogues: theory yields to the textual practice”. In this chapter I focus on the study The Southern short story: tradition and modernity (1999), by the teacher and critic Gilda Neves Bittencourt, because the typology she proposes enlarges the borders of analysis in what concerns the thematic and narratologic tendencies of the contemporary Southern short story. In order to conceive irony, Linda Hutcheon`s view in Theory and politics of irony (2000) is supportive, leading to the authentication of the various circumstances in which such a figure is applied by Karam. The approach to the theoretical principles on the sense of tragic in our days include the ideas of Ives Stalloni (2002), Emil Staiger (1997), Albin Lesky (1997) and mainly of Gerd Bornheim (1975). Such a concept upholds the discussion on the resence of this feature in the female characters, which is stressed according to the role they play in society. I also investigate the reflections on gender brought by Susana Funck (1994), Joan Scott (1990), Rita Terezinha Schmidt (1994) and Marta Gordo García (2007), among others, in order to deal with a reading perspective based on this concept taken as an analytical category. In the second chapter, entitled “A glance on Vera Karam´s short stories”, I read the narratives by taking into account the confluence of aspects such as the typology of the short stories, irony and the sense of tragic, as well as the questions of gender applied to the female characters. I divide the analysis into two parts: “The reflected image” and “The built image”. Three of the eight short stories are in the first part, because here the protagonists appear as they see themselves. They self-define, therefore they reflect their own images. In the other short stories the protagonists are not given a voice of their own and their images are built as the result of a narrator´s vision. In spite of Karam´s distinct modes of narrating, she emphasizes her artistic work towards the formal and thematic building of the female characters and their social status. The writer elaborates and poses denunciation and social censure throughout the female characters, besides exploring women’s possibilities of transgression to the rules imposed on them. Vera Karam´s undeniable technical ability, associated to artistic/aesthetical patterns demonstrated in her écriture, are strong determinant factors of her insertion in the Southern literary historiography.

ABSTRACT: With increasing encroachment on natural communities by anthropogenic activity, it is important to understand the functions of natural ecosystems in an effort to conserve natural areas. A first-hand study of the population dynamics of South Florida Slash Pine (P. elliottii Engelm. var. densa) following a fire event provided insight to its recovery and dispersal following a fire. A natural fire (lightning-induced) occurred in the spring of 2000 at the T. Mabry Carlton, Jr. Reserve, Sarasota County, providing an opportunity to study aspects of slash pine in relation to fire. One objective of my research was to look at dispersal/recruitment conditions and slash pine dynamics in relation to fire. I looked at the varying degrees of tree mortality due to fire at different stands of slash pines.
ABSTRACT: I also looked at the stands in terms of stand composition and spatial arrangement of surviving adults. Finally, I studied how variable seedling establishment and survival was between stands. Few inferences could be drawn between fire and these individual analyses; however, all analyses revealed that at the scale of this study, pine flatwoods are patchy. I also looked at the dispersal of slash pines following a fire event. I modeled my research after Ribbens et al. (1994) and Clark et al. (1998), who took a phenomenological approach to dispersal modeling. This approach involved using distances between adults and seeds/seedlings and fecundity of adults to create dispersal models based on maximum likelihood estimates (MLE). I found that, while I could predict a model within acceptable parameters for most of the stands, more data was needed to predict models that better fit the data.
ABSTRACT: This finding, along with the fact that I recovered no seed data for analysis, suggests factors are contributing to dispersal and recruitment (e.g. cone-crop) that need to be accounted for in the future.

When learning Japanese, many Taiwanese students often interpret the conjunctive particles kara as causes and reasons. However, in many cases in Japanese novels or comic books, kara normally can’t be regard as causes and reasons. Generally speaking, Japanese often don’t finish their conversation, but use conjunctive particles to end it instead. Despite the fact, Japanese can understand each other without any problems. In other words, the speakers think that the audiences can understand what they want to express by deducing from the sequence of conversation. That is why the Japanese often use conjunctive particles at the end of conversation. This thesis will discuss mainly on the conjunctive particles kara in novels and comic books, to know and to analyze the function of kara in conversations. We can find out from the results of the analysis that the sentence-ending kara that normally interpreted as “causes and reasons” have the functions of “explaining and judging,” while those that can’t be interpret as “causes and reasons” and the sentence-final particles kara have the function of “concerning about others.” Through the above viewpoints, we can realize that the sentence-ending kara contains the speaker's subjective describing attitude, which means that the sentence-ending kara has the functions of delivering speaker’s information and asking others to perform a specific action. This thesis also discuss the discourse function of the sentence-ending kara with final particles “ne” “yo”. We find out that the attaching of ne means that the speaker wants to get agreements or reactions to that particular subject from the audiences, and the attaching of yo means that the speaker is eager to express his internal feelings. Finally, I want to use the above analysis on the Japanese education in Taiwan, hoping that the except for realizing the basic functions of kara, Japanese learners in Taiwan can also learn from the daily conversations of Japanese their unique speaking habits and put it into practice.

The purpose of this study is to show non-causal use of conjunctive particle “kara” and its features from a perspective of relevance theory. The subjects of analysis are suspended clause use (sentence-final use of “kara”) and complex sentences use. In some cases, the utterance meaning of suspended clause equals complex sentences. Accordingly, we assume Japanese native speaker and hearer have a criterion to complete utterance meaning (independent clause) from the suspended clause of “kara”, and analysis how it effect completed utterance meaning and (non-causal) use of conjunctive particle “kara” by relevance theory. The results are follows: 1) In the analysis of suspended clause use, the criterion to complete utterance meaning (independent clause) in the utterance background is called “implicated premise” that effects use of conjunctive particle “kara”(included non-causal use). 2) The “implicated premise” has two kinds of premise “consensus between speaker and hearer” and “common consensus”. In the suspended clause use of “kara” (dependent clause), “consensus between speaker and hearer” is collaboration agreement that has a strong intention to communicate utterance implication (independent clause). In contrast, “common consensus” has less intention to communicate utterance implication (independent clause), but can be used without any collaboration agreement. 3) In the case of “consensus between speaker and hearer”, the suspended clause use (dependent clause) has a trend that “kara” presents a necessary (method or information) to realize contents of independent clause. 4) In the analysis of complex sentences use, there is a “logic” that defines the relation between dependent clause and independent clause in the utterance background. This “logic” equals “implicated premise” that effects use of conjunctive particle “kara”(included non-causal use). In modern mandarin Chinese, preposition ”zai” is used fairly “zai” corresponds partly to the case particle “ni”, ”de”, ”wo” in Japanese. For example in sentences like”我在家”,”在百貨公司買衣服”,”小鳥在天空飛翔”,”zai” can be directly translated into “ni”,”de”,”wo” and they both occur in the same syntactic place. However, as “zai” can not be translated into “ni”,”de”,”wo”, in sentences like “在7點到9點”,Japanese speaking learners of Chinese often make errors. Next, through analysis of the data it’s known it’s found that more than half of the Chinese ”zai” correspond to “ni”, “de”, “wo” in Japanese. Finally, compared result implement to teaching to facilitate both teachers and students.

“Kara no Kyokai” is a Japanese legendary novel created by Kinoko Nasu during 1998 to 1999. Moreover, “Kara no Kyokai” has been adapted to ten animated films during 2007 to 2013. This study takes the novels and animated films of “Kara no Kyokai” as the case, and uses the archetype of eight characteristics with Yinyang-Bagua from Bai-jiun Shih; the theory of hero’s journey from Christopher Vogler and the argument of ‘narrative trick’ as the theoretical framework to explore the story. Research finds that most of the narrative structure of “Kara no Kyokai” can be interpreted by Vogler’s hero’s journey. There is no difference as the hero progresses from ignorant to awake stage, entering an exceptional world and returning to ordinary world. However, it can’t interpret the the cultivation of ‘kara’, which is close to the meaning of ‘emptiness’. The finding shows that there are generalities and particularities within hero’s journey. The creator may intend to reflect his/her own culture deeply to create a unique story. Besides, most of the narrative tricks used in the novels of “Kara no Kyokai” can barely be represented in the animated films of the story. In the course of animated film adaptation, the ambiguous message through rhetorics is converted to visual form with definite images. Therefore, most of the narrative tricks used in the novels lose the power. The finding shows that there are limitations within audio and video multimedia. The creator has to think over as choosing a suitable media to attain his/her aim.

Full textThe subject of the doctoral dissertation is the prohibition of ne bis in idem in adminis-trative law. The author assumes that the prohibition of ne bis in idem no longer concerns only criminal law standards, but that it is a system-wide directive which is, in some sense, also rele-vant from the point of view of the rules of administrative law. The doctoral disservice itself consists of five chapters preceded by preliminary observations and completed proposals. The author applies a formal-dogmatic test method. The first chapter examines the various aspects of the prohibition of ne bis in idem in criminal law. The author also proves that the prohibition of ne bis in idem from the criminal law regime has been liberated by the rules of international law. The second chapter draws attention to the specific design of the prohibition of ne bis in idem as a constitutional principle. In this regard, the author seeks to determine whether it is binding on the legislator and the authorities applying the law. It is also important for the au-thor to determine whether the prohibition of ne bis in idem forms part of the public subjective rights, or remains merely a legitimate expectation of citizens. The author draws attention to the clear breakdown of the legal matter in the area of application of the ne bis in idem prohibition at constitutional level into two spheres: punishment and sanctioning. The starting point for the considerations in the third chapter is that the case-law of the Constitutional Tribunal affects the scope of the ne bis in idem prohibition in administrative law. The author therefore undertakes to determine by which types of administrative sanctions citizens can claim legal protection. In the fourth chapter, it draws attention to the fact that, in the area of substantive law, the prohibition of ne bis in idem is limited to some of the many possible options of overlap-ping of legal sanctions. The author guards the conviction that the scope of the prohibition of ne bis in idem is justified in the axiology of administrative law. It therefore points to the bor-der set by the legislator between the typical measures of the administrative police and the means of administrative coerction and the legal sanctions of depriving or restricting certain categories of allowances. It also considers its compatibility in the light of the public interest clause and the constitutional requirement of proportionality of the legal response to breach of legal obligation. The fifth chapter concerns the procedural aspect of the prohibition of ne bis in idem in administrative law. The author assumes that in this regard it is closely linked to the procedural premise of res iudicata. It seeks, therefore, to demonstrate that it is relevant not only at the stage of the judicial procedure, but that it materialates the idea pursued by the prohibition of ne bis in idem by means of a general administrative procedure. In this chapter, the author seeks to further answer the question of whether the institution of preliminary issues and provi-sional decisions are of significant importance from the point of view of the prohibition of ne bis in idem.
