Kepemilikan hak garap pada lahan yang sama oleh beberapa Kelompok Tani pada areal ijin pertambangan PT. Kaltim Prima Coal di Desa Swarga Bara, Kecamatan Sangatta Utara, Kabupaten Kutai Timur, Kalimantan Timur, memunculkan konflik antar kelompok masyarakat. Permasalahan terjadi karena aparat pejabat (Kepala Desa dan Camat) mengeluarkan surat keterangan tanah hak garap tanpa dasar hukum yang jelas sehingga terjadi tumpang tindih hak atas tanah garapan dan memunculkan alat bukti ganda hak garap atas tanah pada objek/lahan yang sama. Berdasarkan permasalahan tersebut maka penelitian ini mengkaji mengenai faktor penyebab alat bukti ganda atas hak garap di atas areal ijin pertambangan PT. Kaltim Prima Coal di Desa Swarga Bara, Kecamatan Sangatta Utara, Kabupaten Kutai Timur, Kalimantan Timur. Selain itu juga untuk mengetahui bagaimana bentuk penyelesaian sengketa antar sesama pemegang hak garap di atas areal ijin pertambangan PT. Kaltim Prima Coal di Desa Swarga Bara, Kecamatan Sangatta Utara, Kabupaten Kutai Timur, Kalimantan Timur agar penyelesaiannya dapat menguntungkan bagi semua pihak yang berselisih. Penulis menggunakan metode library research atau kajian pustaka. Ownership of cultivation rights on the same land by several farmer groups in the mining permit area of ​​PT. Kaltim Prima Coal in Swarga Bara Village, North Sangatta District, East Kutai Regency, East Kalimantan, has created conflicts between community groups. The problem occurred because the official apparatus (Village Head and Camat) issued a certificate of cultivating land rights without a clear legal basis so that there was overlapping of arable land rights and gave rise to double evidence of cultivating rights on land on the same object/land. AbstrakOrang utan (Pongo pygmaeus morio) merupakan salah satu primata dilindungi. Sebagian populasinya dapat ditemukan pada Kawasan Reklamasi Pasca Tambang Batubara (KRPT) di PT. Kaltim Prima Coal Sangatta. Penelitian ini bertujuan untuk menganalisis karakteristik vegetasi habitat orang utan di sekitar PT. Kaltim Prima Coal. Metode pengumpulan data vegetasi menggunakan kombinasi jalur berpetak. Hasil penelitian menunjukkan bahwa karakteristik vegetasi habitat orang utan di tiga lokasi KRPT terdiri dari 40 jenis tumbuhan. Sekitar 41-45% di antaranya merupakan jenis tumbuhan yang dimakan oleh orang utan. Nilai indeks keanekaragaman jenis vegetasi (H’) berkisar 1,00-1,09; indeks dominansi (D’) berkisar 0,14-0,40; dan indeks keseragaman (E’) berkisar 0,91-0,99. Vegetasi pada strata pertumbuhan semai dikuasai oleh paku resam (Dicranopteris linearis) dan ilalang (Imperata cylindrica). Strata pertumbuhan pancang cenderung dikuasai oleh jenis Leea indica dan Flemingia congesta. Sementara itu, vegetasi strata pohon dikuasai oleh jenis tanaman reklamasi yaitu Cassia siamea dan Cassia suratensis. Pola regenerasi vegetasi belum berjalan dengan normal, namun proses suksesi telah berjalan dengan hadirnya jenis-jenis alami. Karakteristik vegetasi tidak ideal bagi habitat orang utan. Peningkatan daya dukung habitat perlu dilakukan melalui pengembangan koridor vegetasi antar fragmen hutan tersisa.Abstract Orang utan (Pongo pygmaeus morio) is one of the protected primates. Some of their population might be found in the Mine Closure Area (MCA) at PT. Kaltim Prima Coal Sangatta. The aim of this research was to analyze the characteristics of the vegetation of their habitat at PT. Kaltim Prima Coal. Data was collected by using a combination of line-plot sampling method. The results showed that vegetation characteristic of orang utan habitat in three locations of MCA consisted of 40 plants species, which 41-45% of the plant species were fed by orang utan. Diversity index (H'), dominance index (D') and evenness index (E') were by 1.09-1.00, 0.14-0.40, and 0.91-0.99, respectively. The vegetation on the seedling stage was dominated by Dicranopteris linearis and Imperata cylindrica. The sapling stage was dominated by Leea indica and Flemingia congesta. Meanwhile, the tree stage was dominated by reclamation plants that were Cassia siamea and Cassia suratensis. The regeneration pattern of vegetation has not run normally but the succession process has been starting that indicated by the presence of species naturally. Vegetation characteristics were not ideal for orang utan habitat. Increasing carrying capacity needs to be carried out by developing vegetation corridors among the remaining forest fragments.

Untuk menghindari terulangnya kembali sengketa tanah garapan, pemerintah daerah sebaiknya meningkatkan penertiban atas terjadinya tumpang tindih surat keterangan hak garap tanah yang diterbitkan oleh Kepala Desa dan RT setempat dan sekaligus melakukan sosialisasi kepada aparatur pemerintahan desa dan masyarakat tentang kewenangan dalam penerbitan izin membukan lahan beserta ketentuan-ketentuannya berdasarkan undang-undang dan atau peraturan pemerintah. Alas hak bagi para penggarap wajib diberikan untuk tertibnya administrasi di bidang pertanahan dan sekaligus dapat memberikan kepastian dan perlindungan hukum kepada para penggarap agar potensi sengketa pertanahan dapat dihindari sedini mungkin.

Mining areas where there should be a prosperous society, are in fact very contradictory to the high poverty rate there. The activities of mining companies have actually caused many natural disasters, not to mention the problem of post-mining holes, which so far have also claimed many lives because many of them are still left open and not immediately reclaimed. East Kalimantan and South Sumatera are the two provinces in Indonesia that have the most natural damage due to mining activities there. Kaltim Prima Coal, and Bukit Asam Company as the largest mining company there, have actually tried to manage their post-mining areas by implementing CSR programs to improve the welfare of the community, but this seems not to have been optimal. Several demonstrations were carried out by the community both in East Kalimantan and South Sumatera to demand an increase in the quality of life. Seeing this problem, the role of communication media is needed to be able to communicate effective and effective CSR programs for the community, so that there will be good acceptance and support from the community to jointly preserve the environment. This research is a qualitative research with a case study method, where researchers will examine how the dynamics of digital communication media management carried out by Kaltim Prima Coal and Bukit Asam Company to communicate their CSR programs. The results of the research are expected to provide an overview of how effective the management of digital communication media from the implementation of the CSR program by Kaltim Prima Coal and Bukit Asam Company is so that later it can become a reference for the CSR program communication process carried out by the company.

ABSTRAK “Industry 4.0 : It’s all about the people” Doug Gates, May 2017 Kita berada pada awal revolusi industri 4.0 yang secara fundamental mengubah cara hidup, bekerja dan berhubungan satu sama lain. Menghadapi industri digitalisasi saat ini, rencana pembangunan Indonesia akan mengedepankan optimalisasi Sumber Daya Manusia (SDM). Hal tersebut searah dengan score card dalam strategy map Human Resources Division (HRD) PT Kaltim Prima Coal (KPC), bahwa optimalisasi SDM pada produktivitas dan kegesitan karyawan menjadi salah satu tujuan perusahaan. Salah satu faktor penentu dalam keberhasilan optimalisasi produktivitas karyawan ini adalah dengan kondisi bugar baik secara fisik dan mental. Dari 56 juta kematian di seluruh dunia pada tahun 2015, 40 juta diantaranya disebabkan oleh Noncommunicable Diseases (NCDs) atau penyakit tidak menular. Penyakit yang disebabkan karena gaya hidup tidak baik. KPC sebagai produsen batubara terbesar di Indonesia, memiliki karyawan hingga 4,537 orang. Pengelolaan pelayanan medis kepada karyawan sudah diberikan dengan baik, dari fasilitas hingga rujukan ke luar kota Sangatta, tetapi angka karyawan sakit masih tinggi yaitu sekitar 2,000 orang per tahun. KPC menyadari harus melakukan perubahan paradigma kesehatan kepada karyawan dan tanggungannya, dimana lebih mengutamakan aspek pencegahan penyakit daripada sekedar mengobati. KPC juga mengajak karyawan untuk lebih peduli terhadap kesehatan agar terhindar dari resiko faktor penyakit kronis (NCDs). Dalam makalah ini, penulis membahas Wellness Program yang sedang dilaksanakan KPC dengan metode intervensi berupa berbagai kegiatan promotif dan preventif. Wellness Program merupakan sebuah upaya yang bertujuan lebih kepada peningkatan, pemeliharaan dan perlindungan kesehatan, bukan hanya penyembuhan orang sakit atau pemulihan kesehatan saja. Sebagai dasar dalam pelaksanaan Wellness Program adalah 5 Pilar Kesehatan yang terdiri dari : Mental Sehat, Tidak Merokok, Gerak Fisik atau Olahraga, Diet Seimbang, dan Istirahat Cukup. Perusahaan berharap karyawan dapat bekerja lebih produktif dan sehat hingga masa pensiun. Banyak hal positif yang didapat dengan pelaksanaan Wellness Program. In the midst of this digitalization era, one of Indonesia’s key development goals is to advance human development. This goal is in line with Human Resources Division (HRD) PT Kaltim Prima Coal (KPC) score card in strategic plan to achieve employees’ optimum productivity and agility. One of main factors to being successfully able to optimize employees’ productivity is by improving health (physically and mentally) and fitness. Globally, in 2015, not less than 40 million deaths (out of total 56 million deaths) are caused by non-communicable diseases (NCDs). This group of diseases has bad lifestyle as one of its risk factors. KPC as the largest coal mining company in Indonesia currently employs 4,537 individuals in total. Though provision of medical serivices benefit has been delivered well through establishing good health facility and referral to offsite Sangatta, number of work day lost due to illness is still high, but not less than 2,000 in one year. KPC recognizes the need to shift health paradigm of the employees and their dependants, that should be recognized as self-awareness not only as “the absence of illness (medical treatment)”. KPC should be able to keep employee care about their health in order to avoid the risk of chronic disease factors (NCDs). The objective of this paper is to describe Wellness Program as an intervention done by KPC to achieve, sustain, and protect health as a complete physical, mental and social wellbeing and not merely the absence of disease or infirmity. Wellness Program is mainly delivered through promotion and prevention campaign. KPC introduces 5 Pillars of Health: Mentally Healthy, Physically Active, Not Smoking, Balanced Diet, and Qualified Rest. The company expects its employees to be more productives and to be healthy even until retiree. Wellness Program has many benefits. Employees and their dependants have become more enthusiastic to participate in physical activity competition and health education sessions. The Influence of Organizational Culture, Work Motivation and Transformational Leadership Styles on Employee Performance With Job Satisfaction as an Intervening Variable in the Mining Support Division of PT Kaltim Prima Coal.This study aims to test the influence of organizational culture (X1), work motivation (X2) and transformational leadership style (X3) on employee performance (Y2) through job satisfaction (Y1) in the Mining Support Division of PT Kaltim Prima Coal. This study took a sample of 62 respondent. While the data analysis techniques used are descriptive statistical analysis and path analysis.The results show the influence of organizational culture on positive but insignificant job satisfaction, the influence of transfomasional leadership motivation and style on positive and significant job satisfaction; the influence of organizational culture on employee performance is insignificant and positive; the influence of motivation and transformational leadership style on employee performance is significant and positive; and the effect of job satisfaction on employee performance is significant and positive.Keywords: Job Motivation, Work Discipline, Organizational Culture, Employee Performance

Abstract:
Studi ini, bertujuan untuk mengukur peran ekosistem reklamasi pascatambang PT Kaltim Prima Coal (PT KPC) sebagai ekosistem penyangga kehidupan. Keberhasilan reklamasi diukur berdasarkan acuan bioindikator kondisi ekologis area rona awal. Kondisi ekologis yang diamati, meliputi kehadiran mamalia dan burung, populasi bakteri penambat fosfat dan nitrogen dan tingkat keanekaragaman hayati. Pengamatan flora untuk area reklamasi, menggunakan petak ukur permanen (PUP) berukuran 20m x 20m. Sedangkan pada hutan alam, menggunakan PUP berukuran 20m x 100m, mewakili area rona awal Sangatta dan Bengalon, seluruhnya berjumlah 42 plot. Untuk pengamatan fauna menggunakan dua metode, yakni pengamatan langsung dan pengamatan tidak langsung. Pengamatan langsung, yaitu perjumpaan dan kamera trap, sedangkan pengamatan tidak langsung, menggunakan identifikasi jejak, kotoran, bekas cakar, bulu, sarang, dan suara. Penilaian bioindikator menggunakan rumus Indeks keragaman Shannon-Wiener, Indeks Similaritas Sorensen, dan Indeks kehadiran mamalia. Hasil studi, untuk nilai keanekaragaman hayati kelompok tumbuhan di area reklamasi 3.2 satuan dan 3.4 satuan pada area rona awal. Sedangkan untuk kelimpahan jenis, area reklamasi sebesar 83 jenis berbanding 53 jenis pada rona awal. Dengan nilai indeks kesamaan jenis sebesar 25%. Untuk kehadiran mamalia area reklamasi sebesar 24 jenis berbanding 15 jenis pada rona awal. Kehadiran burung area reklamasi berjumlah 54 jenis dan 31 jenis pada rona awal. Populasi bakteri penambat fosfat untuk area reklamasi sebesar 0.06 x 107 cfu/ml dan rona awal nol. Untuk populasi bakteri penambat nitrogen area reklamasi sebesar 1.33 x 107 cfu/ml, sedangkan rona awal 0.82 x 107 cfu/ml. Dengan demikian, reklamasi pascatambang KPC telah mampu berperan sebagai ekoisistem penyangga kehidupan.

Kondisi jalan tambang selalu dilakukan pemeliharaan agar operasional pengangkutan material tambang dapat berjalan optimal dan aman. Kondisi jalan tambang yang buruk dapat menurunkan produktifitas alat, menaikan biaya operasi dan pemeliharaan pada haul truck, serta menjadi potensi bahaya. Proses pemantauan kondisi jalan tambang umumnya dilakukan secara manual, melalui inspeksi fisik langsung di lapangan. Teknologi Real-time Condition Monitoring (RTCM) mampu memantau kondisi operasi truk angkut secara real-time dari jauh, termasuk parameter yang erat hubungannya dengan kondisi jalan seperti tekanan suspensi. Tekanan suspensi memiliki standar yang digunakan untuk mengetahui tingkat keparahan kondisi operasi haul truck, melalui pengukuran nilai Rack, Pitch, dan Bias. Sistem RTCM dikembangkan agar mampu memantau nilai tersebut secara real-time dan memberikan notifikasi ketika terjadi nilai yang melebihi ambang batas, menandakan kondisi kelebihan beban pada rangka haul truck, yang umumnya disebabkan kondisi jalan yang buruk. Tim Condition Monitoring dapat segera memverifikasi kondisi tersebut untuk kemudian menyampaikannya ke tim pemeliharaan jalan mengenai kemungkinan segmen jalan yang kondisinya buruk. Pemantauan kondisi jalan secara remote dan real-time membantu mengetahui kondisi dan perbaikan jalan yang lebih cepat, yang membantu upaya optimalisasi operasional pertambangan.

Coal Losses merupakan proses hilangnya batubara yang terjadi pada saat proses penambangan berlangsung sampai pada saat pengiriman batubara ke tujuan. Proses penambangan batubara seperti clean up roof batubara, proses pemuatan batubara, serta saat pengangkutan batubara menuju stockpile berpotensi menimbulkan coal losses. PT Kalimantan Prima Coal menetapkan coal recovery criteria sebesar 98,5%, lebih ketat dari yang ditetapkan Kementerian Energi dan Sumber Daya Mineral (ESDM) sebesar 90%. Penelitian ini bertujuan untuk menghitung coal losses pada proses clean up batubara, pemuatan batubara di loading point, dan pengangkutan batubara; mengetahui faktor-faktor yang menyebabkan terjadinya coal losses; dan memberi rekomendasi upaya penanganan coal losses.Penelitian dilakukan di Pit Inul Middle Panel 3 pada PT KPC bulan Mei dan Juni 2019. Ada lima seam batubara yang diamati, yaitu seam K17LR, K13, K12, K9 dan K4. PT KPC menggunakan survey yang dibandingkan dengan truck count untuk menghitung coal recovery. Total coal losses yang didapat dari setiap seam dibagi menjadi tiga proses penambangan batubara, yaitu coal losses pada saat clean up roof batubara, di loading point, dan saat hauling.Coal Losses yang didapatkan pada seam K17LR bulan Mei dan Juni 2019 sebesar 4,49% dan 3,93%; seam K13 bulan Mei dan Juni 2019 sebesar 2,83% dan 1,47%; seam K12 bulan Mei dan Juni 2019 sebesar 3,57% dan 2,71%; seam K9 bulan Mei dan Juni 2019 sebesar 4,24% dan 4,15%; seam K4 bulan Mei dan Juni 2019 sebesar 4,3% dan 1,11%. Coal losses yang terjadi masih di atas dari kriteria yang diberikan oleh ESDM sehingga masih memenuhi batas kriteria. Persentase coal losses terbesar terjadi di loading point sehingga dilakukan simulasi pengurangan coal losses di loading point. Total losses 19.43% pada Bulan Mei and dan 13.38% pada Bulan Juni berhasil diturunkan menjadi 9,44% and 6,98%. Kata-kata kunci : batubara, recovery, clean up, loading point, hauling

Abstract:
This thesis presents an evaluation of the potential for gender equality to be promoted through Corporate Social Responsibility (CSR) in mining. Research was conducted at Kaltim Prima Coal (KPC), a major coal mining company located in East Kalimantan, Indonesia. Since the fall of President Suharto in 1998, Indonesia has increasingly embraced the concept of CSR as meaning the delivery of community development programs by large companies. Indonesia has also become decentralised and district governments and local communities have increased their demands for greater benefits from resource exploitation. Companies such as KPC have had to become active agents of development. Large-scale mining companies tend to employ majority male workforces and may have a series of gendered ‘impacts’ on local communities. Where mining companies act as development agencies their programs may also cause further social change. This thesis presents an evaluation of the potential for mitigating gendered impacts and striving for gender equality through CSR specific to KPC. It also looks outwards from this one specific case study of KPC to evaluate the recently developed guidelines on gender in mining by the World Bank, Rio Tinto and Oxfam Australia. This thesis is divided into three parts. Part I considers the various drivers of the CSR agenda and argues that due to the role of the male-dominated district government and local interest groups in driving the CSR agenda, women’s voices are marginalised from CSR debates. Part II presents an analysis of the gendered impacts of KPC’s mining operations taking the literature on the ‘impacts of mining on women’ as a starting point. Particular attention is paid to how female sex workers are depicted in this literature. The thesis demonstrates that while there is certainly a strong case for needing to mitigate the gendered impacts of mining, the ‘impacts of mining on women’ approach tends to exaggerate ‘impacts’ and emphasise ‘victimhood’ and to assume that all women have similar experiences of living in mine-affected communities. The evidence from KPC shows that in fact women’s experiences of mining are very diverse. Part III investigates the gendered aspects of community development policy and implementation. An analysis of KPC’s livelihoods and HIV prevention programs reveals that there are a number of inherent limitations within the CSR paradigm that inhibit the achievement of gender equal outcomes, including the propensity for the company to place business objectives ahead of development aims and to use CSR benefits as a way of pacifying vocal groups. As these vocal groups are usually male, women tend to be overlooked as CSR beneficiaries. This thesis argues that the guidelines by the World Bank, Rio Tinto and Oxfam, while they do make some positive contributions to the discourse on mining and gender, all assume the existence of homogeneous women victims of mining. They also fail to recognise the inherent political and gendered limitations within CSR, and thus need to be re-evaluated in order to be more effective tools for change.
