Abstract:
Reducing juvenile delinquency is an important issue because today’s juvenile population will become the next generation of contributing members to society. Therefore, the juvenile justice system is faced with the challenge of creating effective methods of decreasing delinquency and providing necessary treatment to juvenile offenders. Legislators implemented juvenile transfer to adult criminal court with the intent of increasing punishments in order to deter future juvenile crime and to hold juvenile offenders accountable for their criminal behavior. This paper shows why juvenile transfer is not an effective method in addressing the issues of juvenile delinquency by looking at several studies that analyze the negative effects of transfer in increasing recidivism and serious violent crimes. Furthermore, research shows that juvenile transfer undermines the criminal culpability of juvenile offenders who are undoubtedly not as mature and psychosocially developed as adult offenders. This implies that the juvenile justice system is faced with the ongoing challenge of finding new ways to address juvenile delinquency. This paper suggests that the juvenile justice system should return to an individualized rehabilitative system that focuses on the needs of individual offenders in providing appropriate treatment and services that will allow the juvenile to re-integrate back into the community.

Abstract:
Within the Florida Department of Juvenile Justice system, juvenile delinquency referrals have decreased, yet at the same time, juvenile recidivism rates continue to challenge policy makers. Using Hirschi's social learning theory as the foundation, the purpose of this descriptive phenomenological study was to examine the perceptions of juvenile justice professionals about their experiences with youthful offenders in order to determine the causes of juvenile recidivism. Data came from in-depth interviews with 9 participants including state attorneys, judges, and mental health counselors from within the central region of the state of Florida. Data were analyzed and coded using Colaizzi's method. Two primary themes emerged from the analysis of data: First, participants perceived that the influence of peers and factors such as environment, family criminal and mental health history, substance and abuse, truancy have a significant effect on juvenile recidivism. Second, participants perceived that parent bonding is the most important factor in reducing recidivism among juveniles aged 17 and 18 years old. The positive social change implications of this study include recommendations to the Florida Department of Juvenile Justice to implement, modify, and improve services and policy to reduce recidivism for juveniles aged 17 and 18 years old. This implementation, modification, and improvement may reduce recidivism among this subgroup of juvenile delinquents and may reduce the number of young adults entering the criminal justice system.

Abstract:
This study examined the relationship between aspects of social capital and self-reported delinquency among Turkish juveniles by using a secondary dataset, which is a part of the European Youth Survey. The survey was conducted among tenth graders in 2007 in Bağcılar, Istanbul. The dependent variable of this study, delinquency, was divided into two groups, minor and major, according to the stipulations of the Turkish Penal Code. Social capital was measured by assessing adolescents’ reports of their direct interactions with their parents, peers and community. In order to predict the likelihood of major and minor delinquency independently, two different subsets (N: 1879 and 1837, respectively) of the data set were used. The findings of the multivariate analyses suggest that a low level of social capital contributed significantly to Turkish juveniles’ engagement in major and minor delinquent activities. Among the social capital items, adolescents’ affiliation with delinquent peers had the strongest correlation with both dependent variables.

Fanniff, Amanda Marie. "The Measurement of Juveniles' Competence Related Abilities." Diss., The University of Arizona, 2009. http://hdl.handle.net/10150/195761.

Full text
Abstract:
Juveniles' right to be competent to stand trial has been increasingly recognized since In re Gault (1967) granted juveniles essential due process rights. One formulation of competence proposes two facets: competence to assist counsel (e.g., understanding the roles of legal actors, the adversarial system,) and decisional competence (Bonnie, 1992). The first goal of this project was to investigate the psychometric properties and relevant correlates of one instrument to assess competence to assist counsel, the Competence Assessment for Standing Trial for Defendants with Mental Retardation (CAST-MR; this study used only the first two scales). Results indicated acceptable internal consistency, although concerns were raised regarding the appropriateness of some items. Scores were related to age and intelligence, as in prior research. No relationship was found with most mental health scale scores, prior legal system involvement, contact with defense counsel, or learning problems. The second goal of the study centered on decisional competence and the role of immaturity; specifically whether age is associated with immature judgment (assessed using the Judgment in Legal Contexts instrument) and if immature judgment predicts decisions made about one's own case. The current study found few significant relationships between age or intelligence and variables coded from the JILC (including authority compliance, risk recognition, risk appraisal, future recognition, resistance to peer influence). Additionally, age and the perceived strength of evidence were not predictive of individuals' decisions to confess, to fully disclose to defense counsel, or to accept a plea bargain. Juveniles who had confessed scored higher on future recognition, those who fully disclosed to their attorney scored lower on authority compliance, and those who would accept a plea bargain scored higher on risk recognition and appraisal. While the results were modest, they suggest that immature performance on a judgment measure may predict individuals' legal decision-making. If a juvenile fails to appreciate the potential consequences of legal decisions, his or her decisional competence may be questioned. Generally, immaturity may need to be recognized as a basis for findings of incompetence if performance on relevant skills is shown to improve with age and immature performance is shown to interfere with competency.

Russell, Kia Chevon. "Recidivism Rates Among Juveniles With Mental Illness." ScholarWorks, 2017. https://scholarworks.waldenu.edu/dissertations/4404.

Abstract:
Treating mental illness is imperative to help reduce criminal justice involvement within the juvenile population. Receiving mental health care will help decrease the likelihood for youth to reoffend, ultimately reducing recidivism rates. Past studies showed there are risk factors associated with juveniles and recidivism; however, very few studies have examined what factors are prevalent after services have been received. The purpose of this study was to identify factors that increase the risk of recidivism among juveniles who have received psychiatric stabilization in Harris County, Texas. Risk factors that were assessed included age, gender, ethnicity, and criminal offense. The psychodynamic perspective guided this study and archival data were obtained from the Harris County Psychiatric Center Database. Several statistical analyses were used in this study to include a t test, chi square analysis, and a binary logistic regression analysis. Results from this study found no significant relationship with mental health diagnosis and recidivism nor did it find a significant difference in the length of stay at the psychiatric center. This study did find that simple demographics were stronger than any predictor, concluding that younger Black males were more likely to recidivate. Based on the findings from this study, juvenile justice representatives will be able to evaluate and develop programs specifically targeted to the risk factors found to be associated with recidivism.

Abstract:

The present research arises from the interest to know about the incidence of socioeducational projects in the configuration of subjectivities of young people in conditions of social vulnerabilities. Considering by socio-educational projects, the actions with a public purpose and with a perspective of human formation, focus to the youths. It is asked, if socio-educational projects influence the configuration of juvenile subjectivity, understood as a cultural historical process that interferes at the individual level without eliminating the structural dimension for the formation of the subject category. Therefor, a qualitative research of an ethnographic perspective was carried out in the Jardim Gonzaga neighborhood, located in the peripheral zone of the city of São Carlos - SP- Brazil, through the conduction of interviews called conversational dynamics with five young people about their trajectories of participation in socio-educational projects, as well as the significance and vision of that process today. In addition, a weekly participant observation was made in a university extension project that takes place in this neighborhood, for a period of eight months and with specific participation in the following six months. The conversational dynamics addressed issues of socialization spaces, experiences, participation trajectories in socio-educational projects, contributions on the present moment of life and perspectives regarding the future. According to the data obtained through the conversations with the five young people, it was the spaces of socialization, the perception of the family, the difficulty of staying in school and the interest in the proposals brought that led them to participate in social projects, as well as the lived experiences in the relations with the technicians and the possibility of expanding their sociability; from where it was observed and concluded that socioeducational projects have influenced the configuration of individual and social subjectivity. This was evidenced, at the individual level in the recognition of their abilities, allowing them to acquire greater security for the confrontation of the tests of life, referred in the discourse of all, maintaining a differential in each one of them; which shows products of their experiences. At the social level, the expansion of the “moratoria juvenil” was evident, allowing experiences of this stage of life. Based on the present study, it can be concluded that the socio-educational projects aimed at the youth population of the peripheries do not succeed in promoting transformations of the vulnerability conditions; however, their contributions are in the mitigation of the impacts of these, mainly at the individual level. What socio-educational projects provide is the influence on the processes of subjectivation of young people, which can impact their lives, but not modify them from the structural point of view.

Abstract:
Psychological assessment ofjuveniles being considered for waiver to adult criminal courts often requires systematic evaluation of dangerousness, maturity-sophistication, and amenability to treatment (ATX). Despite the importance of these constructs to the evaluation of juveniles, little is known about the criteria that constitute these three constructs. This study was designed to assist in clarifying the constructs of dangerousness, maturity-sophistication, and ATX that typically guide juvenile transfers. Generally, prototypicality ratings were aligned with the current literature on dangerousness, sophistication-maturity, and ATX.

Trottier, Iva W. "Comparing the Perceptions of Family and Parenting Between Juvenile Sexual Offenders and Juveniles With No History of Sexual Offending." DigitalCommons@USU, 1991. https://digitalcommons.usu.edu/etd/6033.

Abstract:
Juvenile sexual offenders and a matched sample of nonoffending youth were compared on the Family Environment Scale (FES), the Family Adaptability and Cohesion Evaluation Scales (FACES ill), the Adult Adolescent Parent Inventory (AAPI), and a biographical inventory. The purpose was to determine whether or not juvenile sexual offenders and nonoffenders would prove to have different perceptions of family characteristics and whether the biographical inventory could distinguish between the two groups. "The sample consisted of 95 participants (46 offenders, 49 nonoffenders) in the northern Utah area. The offending population were in outpatient treatment for their sexual offending. When the participants were categorized as offender/ nonoffender and 12-15 year olds/ 16-19 year olds, only an age effect was found to be significant on the variables cohesiveness, cohesion, and conflict. Offender group membership did not have any effect. Younger adolescents viewed their family environment as more cohesive and felt more freedom to express anger and dissent. Significant differences were found between offenders with multiple victims and all other groups on two AAPI variables: inappropriate developmental expectations of children and lack of empathic awareness of children. The discriminant function analysis of the biographical inventory items yielded a 90% correct classification rate on participants cooed as either offender or nonoffender. Only eight biographical items were used in this procedure. It is clear that, of the four instruments used in this study, the biographical inventory provided the best descriptive profile of the juvenile sexual offenders. Offenders reported more instability in their home-life and lack of positive emotional relationships with their caretakers. The perception of diminished humanness in relationships went hand in hand with victimizing others. One can conclude that family environment remains an important factor to consider in the development and treatment of sexually abusive behavior.

To describe the juvenile stadia of the most abundant representatives of the genus Allograpta in the Metropolitan Region of Chile, periodic samples were obtained with an entomological net from blooming plants in areas unexposed to insecticides in La Pintana commune, Santiago, Chile. The specimens were identified and sexed to set the fertilized females in conditions ideal for oviposition. Three species were reared to the completion of their cycle: A. hortensis (Philippi), A. exotica (Wiedemann) y A. pulchra Shannon, and the corrresponding morphological descriptions of their eggs, larvae I, II, and III, and pupae were made. These descriptions were used to build a key for the identification of juvenile stages of the genus Allograpta that allows for a simple and clear identification of the three species indicated. Also, observations of other aphid-feeding syrphid fly genera present in the study area allowed to determine morphological characteristics present in the genus studied. The knowledge of the aphid-feeding syrphids in their different development stages will allow for further studies focused on their potential use in biological control and integrated pest management of aphids.

Sharf, Allyson J. "Effects of Immaturity on Juveniles’ Miranda Comprehension and Reasoning." Thesis, University of North Texas, 2015. https://digital.library.unt.edu/ark:/67531/metadc804854/.

Abstract:
Over the last several decades, researchers have documented how impaired reasoning by adult offenders impeded the intelligent waiver of Miranda rights. Logically, it stands to reason that juveniles – who are developmentally less mature and have less life experience than their adult counterparts – would possess even greater impairment, thereby heightening their risk for invalid Miranda waivers. Juvenile Miranda research supports this notion; with some researchers finding that psychosocial maturity, among other factors, affect a juvenile’s understanding of their rights. Yet, relatively few studies have examined its relation to Miranda reasoning and decision-making. Thus, the current study investigated the specific role of maturity in juveniles’ Miranda comprehension and reasoning. Participants included 236 legally-involved juveniles recruited from either a juvenile detention center or a juvenile justice alternative education program. The effects of psychosocial maturity were examined on a variety of Miranda-related measures and assessed a broad range of Miranda abilities. It was found that, in general, immature juveniles performed more poorly on all Miranda measures as compared to their mature counterparts. However, the impact of maturity varied considerably depending on the ability. Specifically, maturity was most important in the context of Miranda reasoning. As a novel addition to the literature, the current study also investigated the effects of developmental timing on maturity (i.e., immaturity-delayed versus immaturity-expected) on Miranda abilities.

Abstract:
Doctor Legum - LLD
Children have been committing crimes during times of war and other armed conflicts since time immemorial. Yet, it is only over the last few decades that cognisance is being taken of child soldiers as a type of juvenile. The unfortunate sight of a child holding a gun has become a familiar picture throughout armed conflicts, especially in Africa. Both boys and girls are used as child soldiers and they can be as young as 5 years old. They are mainly regarded as victims of crimes under international law and are therefore usually rehabilitated once they have been disarmed and demobilised. Notwithstanding their need for rehabilitation, it is a fact that child soldiers commit some of the most egregious crimes under international law. They receive military-style training and are presumably not afraid of killing and carrying out orders. Yet it is recognised that generally they do not have the same level of maturity as adults. The reality of child soldiers who join armed forces therefore presents complex legal questions in the face of contemporary international criminal law principles which, on the one hand, afford protection to all children, and on the other, unequivocally call for the prosecution and punishment of those who are individually responsible for committing crimes under international law. Consequently, various safeguards need to be upheld to ensure that the best interests of the child are maintained once a child soldier is held criminally responsible. This thesis analyses the extent to which child soldiers can be prosecuted under domestic and international law, as well as the implementation of alternative measures to prosecution. The thesis proposes that a case-by-case approach should be considered when child soldiers are prosecuted for crimes under international law, thereby investigating and analysing the often distinctive circumstances related to their crimes.

Abstract:
Current research indicates an association between intense adolescent work (twenty hours or more per week) and delinquent behavior. It has been widely speculated that this relationship is spurious, occurring only as a result of other factors which are common to both offending and intense employment. The current study attempts to fill a gap in the literature by utilizing the Pathways to Desistance dataset to examine the evolution of the relationship between work and self-reported offending in a longitudinal sample of juvenile offenders. Work intensity and consistency, social capital, and expectations for success were analyzed as potential predictors of recidivism or desistance as juvenile offenders mature into adulthood. Variations in the significance of these variables throughout the first seven waves of data collection were examined from the life course perspective. Results provide support for the theory of age graded social control and suggest that high risk youth self-select into intensive work roles as adolescents. No statistically significant differences in lifetime offending were found between respondents across varying levels of work intensity.

Abstract:
At the end of the nineteenth century, individuals identified as child savers pioneered an unprecedented movement to save America’s children from physical and moral harm. The establishment of the juvenile justice system came as a result of the actions of the child savers. Researchers have focused extensively on many aspects of the juvenile justice system including studies on the effectiveness of the system to tracking the changes the system has undergone since its establishment. Numerous other studies examined opinions of the juvenile justice system. However, the research has focused solely on the general public, juvenile probation officers and juvenile correctional staff. The current study examined the actual participants within the juvenile justice system - the juvenile offenders - to gauge their perceptions of the system that was created to protect and turn them into law-abiding individuals. A survey was conducted with juvenile offenders housed within two conservative, Midwestern juvenile correctional facilities. The juveniles believed that rehabilitation should be an integral goal of the juvenile justice system and they endorsed community-based interventions as a means to change behavior. The results indicate that the juvenile offenders are in tune with the general public as seeing the juvenile justice system as a child saving institution rather than as a punitive endeavor.

Abstract:
This research examined challenges social workers face when delivering mental health services to juveniles who have been incarcerated due to drug use. Through the use of a web-based survey program a total of ten research questions were examined statistically. The research questions discussed what challenges social workers face when trying to administer services to juveniles who have been incarcerated for drug use and also what services are available to juveniles with or without a mental health problem who have been incarcerated for drug use. Questionnaires were sent out electronically, with a response rate of twenty-seven participants. SurveyMonkey® was used to analyze the data. The results indicated that the participants felt very strongly about the recidivism rate being high in juveniles returning to jail due to drug use and that social workers have the opportunity to make a difference in the lives of these juveniles. As for social work practice we must make every opportunity to help our juveniles out of the juvenile justice system and into society to be productive citizen.

Abstract:

Pickard, Ronald D. "Family Structure and the Criminal Behavior of Juveniles in Tennessee." Digital Commons @ East Tennessee State University, 2008. https://dc.etsu.edu/etd/1974.

Full text
Abstract:
The purpose of this study was to investigate the association between family type and criminal behavior of juveniles in Tennessee who were referred to Juvenile Court in 2006. The population used in the study comprised the juveniles who were referred to the Tennessee Juvenile Courts as reported by the Tennessee Council of Juvenile and Family Court Judges in 2006. This investigation focused on the criminal behavior as indicated by number and type of referrals to the Juvenile and Family Court system in Tennessee. The data were analyzed by family-of-origin type, age group, and geographic region in Tennessee. The findings of this study indicate there was a difference in criminal behavior of children referred to the Juvenile and Family Court system in Tennessee in 2006 according to family-of-origin type with referrals. For the family-of-origin types with referrals to the juvenile courts (TCJFCJ), 20,734 (26.2%) of the referrals came from married couples, 5,899 (7.5%) of the referrals came from fathers only, 33,802 (42.8%) of the referrals came from mothers only, and 18,620 (23.6%) of the referrals came from other family-of-origin type. For all family-of-origin types in Tennessee (TN 2006) with referrals to the juvenile court system, 20,734 ( 4.4%) of the married couples had referrals , 5,899 (11.3%) of the fathers only had referrals, 33,802 (17.8%) of the mothers only had referrals, and 18,620 (3.2%) of the other family-of-origin type had referrals. The findings also show that as children approach the age of 18, there is a dramatic increase in illegal conduct and a less dramatic increase in status offenses. The number of referrals for offenses against persons and offenses against property tend to have a constant increase as children approach age 19. The results also show that in East Tennessee, status offenses had the highest number of offenses and offenses against persons had the lowest number of offenses. In West Tennessee, offenses against persons had highest number of referrals and status offenses had the lowest number of referrals.

Coleman, Andrea R. "Suspicion, Suspicion: Police Perceptions of Juveniles as the “Symbolic Assailant”." Diss., NSUWorks, 2018. https://nsuworks.nova.edu/cahss_jhs_etd/16.

Full text
Abstract:
Jerome Skolnick’s (2011) "symbolic assailant" is a result of police attributing particular demeanor, gestures, language, and a style of dress to people they believed were most likely to commit violent crimes. The challenge became when police applied these characteristics to specific groups such as juveniles. Literature published before and after Skolnick (2011) indicated police were more likely to stop, arrest, interrogate, or surveille juveniles based on their demeanor, gestures, style of dress, lack of respect, deference to authority, the severity, and remorse for their offenses in addition to race. However, current research indicated race, gender, and Socioeconomic Status (SES) determined if police perceived juveniles as the symbolic assailant regardless of offense type. The current research also suggested the symbolic assailant is the foundation for related theories such as racial profiling and the “juvenile offender type-script.” Thus, this dissertation sought to determine if juveniles’ demeanor, gestures, race, gender, and offense type predicted if police perceived them as having characteristics analogous to the symbolic assailant. The researcher conducted a nonexperimental predictive correlational research design analyzing secondary data from Connecticut’s Effective Police Interactions with Youth’s Pretest Survey. The results showed weak to moderate relationships between the predictor and criterion variables such as police believed juveniles’ fidgeting, pacing, and mouthing off as signs of guilt indicated a weak relationship. The strongest predictor was a combination of race and offense type as the patrol officers responded all races and ethnicities were most likely to carry weapons equally in the past 30 days, which differed from the current symbolic assailant and related literature.

Abstract:
The proliferation of digital technologies has led to the emergence of new forms of sociability which videogames are a good example for understanding many of the new relational boundaries provided by these inventions. Videogames have been extensively discussed by psychosocial research. Among this interest concerns abound, mostly about the potential risks that the rapid expansion of the practices with these devices could have to correct and healthy lives of young century. Against this background it is necessary to turn on the approach to the role of videogames in everyday relationships. Before worrying in advance about the possible effects that these practices may have on young people, is more illuminating delve to understand the ways in which people participate on this particular form of play. Through an ethnographic approach is possible to identify many disparate natures agents inviting to think video games as everyday processes in which both technological elements, than humans or discoursives, are instantly associated, as a collective achievement by simulating hybrid play areas willing to interaction and enjoyment. A gamer, for all his piggyback experience, is a category that is formed in the very act of videoplay and a videogame, rather than an artifact or a computer program is the process by which they contact the player and played by connections like screen, controls or game consoles, but also many other types, such as recurrent associations between digital commands (executed with fingers and other movements) and graphic-sound rules, or alliances and clashes between various types of participants in the game. From this point of view, one of the interests that brings my research is based on a type of constructive sociology, focusing on understanding many of these connection processes that trigger instantaneous emergency in particular contexts of sociability, rather than trying to explain the dangers that these processes may pose to life in society.

Abstract:
This study examines the impact of relative deprivation on juvenile delinquency. Though this topic has been explored by several researchers, there has not been much consistency in the research due to the operationalization of key variables. Traditionally, relative deprivation has been referenced in relation to Merton's Classic Strain Theory, using economic indicators to measure relative deprivation. Webber and Runciman however, expanded upon Merton's original premise and integrated more diverse measures of relative deprivation into their research. The current study utilizes Agnew's General Strain Theory (GST) as a means to measure relative deprivation as a broader and more subjective topic. This unique approach in the study of relative deprivation utilizes aspirations as a primary measure of relative deprivation.
